all right. we will continue to watch these pictures. top of the hour and right now hunter biden's legal team is making closing arguments in his criminal gun trial. hunter himself did not take the stand. he faces up to 25 years in prison if convicted on all three counts. at this pace, because the prosecution has finished closing arguments and the defense has begun, the jury could get this case before leaving tonight. hour two of "america reports." this case is moving at lightning speed. to be too good to be with you, i'm sandra smith in new york. the prosecution gave closing arguments i made it clear to the jury that only one things mattered when deciding the fate of the president's son is evidence. >> the prosecution open with a bang and this is what they did. they pointed to where the first lady was sitting, where all of hunter biden's family was sitting to support him, and they said this. the people sitting in this gallery are not evidence. to be able to present to the jury the sound of the defendant and his own words admitting to all kinds of drug use during the time period in which he purchased this gun which of course is against federal law." >> sandra: jonathan turley on developments in that courtroom. rich edson's live outside the court in wilmington, delaware. what's the latest? >> good afternoon, sandra. the defenses up making its closing arguments, you heard a little bit of that from carrie. as you mentioned, this thing is really moving quickly and there's a chance that the jury could begin deliberations this evening. when the prosecution began its closing arguments focused on hunter biden's active drug use from 2015 through 2019 and presented a summary of his text messages, bank records. prosecutors highlighted his ex-girlfriend and sister-in-law's testimonies of his drug use. they also said gordon cleveland, he's the firearm salesman that the quote only relevant witness from the gun shop" since he was the only person to testify he saw hunter fill out the federal form swearing he was not a drug user. all attempting to prove beyond reasonable doubt that prosecutors allegations that hunter was a drug user when he signed that form, bought that gun and possessed it for 11 days. prosecutors let off the presentation referring directly to biden family members including the first lady saying people sitting in the gallery aren't evidence that nobody is above the law. the defense is arguing that no witnesses testified they saw hunter doing drugs in october 2018. hunter's attorneys maintain he was drinking at the time, not using illegal drugs, and stressing drug use before or after does not prove drug use the week the week and a half that he had that gun. after the defense finishes its closing, prosecution has an opportunity to offer a rebuttal and then jury instructions and deliberations. if he's convicted, there's a maximum penalty up to 25 years in prison. $750,000 in fines. if he is convicted would be a first-time nonviolent offender. sandra. >> sandra: rich edson outside the court for us. thank you. >> john: let's bring in jonathan turley, constitutional law attorney and fox news contributor as well as a law professor. an esteemed one at that. this is moving quickly. this morning they had arguments and discussions as to whether or not hunter biden would appear. they decided that wasn't going to happen. the prosecution completed its closing arguments, another defense is going and prosecution will get a rebuttal and then it's off to the jury. from what you know of this, has abbe lowell in any way, shape, or form been making a compelling argument to the jury to a quick hunter are the very least go easy on him? >> i think the most compelling argument that lowell made to the jury was stating the last name of his client. this is biden town. i think if you look at the defense, this is just as clear as you can get for a jury nullification case. the defense that lowell put up in the opening argument collapsed within 48 hours. the prosecutors just made mincemeat out of these arguments. there was a series of them, all of them implausible. that's not the point. these are placeholders and they are hoping that the jury will nullify this evidence. they are not asking for the jury to -- they are asking for them to ignore the evidence. many -- all the juries said that they had experience with people with drug problems. it was very emotional testimony from hunter himself as to what he went through. but also you have a sizable biden contingent in that courtroom reminding the jurors that this is biden town. this was their hometown. i think the prosecutors are worried that no matter how strong their case they might not be able to overcome it. >> john: abbe lowell seems to be trying to thread a needle here to say okay, there's all this talk about drug use but in the time period literally down to the week that he bought the gun he wasn't doing crack cocaine or anything else. he was drinking. but if you sign "no" on that federal gun purchase form. to this idea, are you addicted to or using drugs, is it on that day? is it that week? or is it more in general? >> according to abbe lowell it appears the question was, are you doing drugs right now? he did this so that he'd have to be doing lines of coke on the revolver in the courtroom. obviously that's not the intention of the question. the government really slammed this argument by putting up texts that hunter put out the very next day trying to score, he said he was trying to score drugs with a guy named mookie. he had these witnesses that said when they saw him he was doing crack every 20 minutes. so you have this sort of immaculate period that lowell is suggesting where he might have just been drinking heavily. most people would say that's completely implausible. that's not the point of the defense. the point of the defenses to give some jurors an excuse to say "i'm just going to acquit," even though the defense collapsed days ago. >> john: all the data. i was on with dana perino earlier today on "america's newsroom." andy mccarthy does not think hunter biden is going to be looking at the inside of a jail cell. listen to what he said. >> looking at his potential sentencing guidelines it looks to me like even if he gets convicted here he's got a good chance of avoiding a prison sentence. >> john: what do you think, professor? >> i try never to disagree with andy and i don't disagree with that comment. i think the odds are that he will not get jailed. but this was an open and shut case and this defendant put this court through this trial. if he is convicted, some judges actually do not look kindly upon that. if you put everyone through a trial on a case that seemed strict liability, you check the box. some of them may feel you have to do a little time in jail even if it's a brief stint. i would not discount that possibility because of what he went through or put the court through by challenging overwhelming evidence of guilt. >> john: ten seconds on this. can you believe this is a guy who almost got away with a plea agreement that gave him lifetime immunity? >> yes, that's really incredible here. i think the defense is counting on the fact that you've got the wrong zip code as prosecutors. there is no way they're going to convict a biden in this courthouse but they can be wrong. those jurors taken also look at the evidence and the evidence here is unavoidably strong. >> john: we will find out probably sooner rather than later. professor, always good to spend time with you. >> thanks, john. >> sandra: all right, massive three-alarm fire at at miami apartment building has sent multiple people to the hospital here we are going to have a live report on the efforts to put that fire out, coming up. >> free, free, free, free palestine. >> john: thousands of anti-israel protesters decide on -- descend on the white house, leaving nothing but damage in their wake. steve hilton on that after the break. stay with us. yay - woo hoo! ensure, with 27 vitamins and minerals, nutrients for immune health. and ensure complete with 30 grams of protein. >> we call them anti-israel. that's what they claim. but really they are pro-hamas, pro-terrorism. let's be honest. they are pro-genocide. they use the word -- they constantly attack joe biden because they disagree with this policy. pathetically weak. they call him genocide joe. the genocide is in the minds of hamas. that's what they want. they want to eliminate the jewish state, it's very clear. that's what this effort has been about. the atrocities on october 7th and everything we've seen since then. these people are marching on the streets of our capital defacing our monuments in the name of genocide. we've got to be really clear about that. the fact that they just sort of lead off and can deface monuments and carry on as this is perfectly normal is not acceptable. we have to be really clear. what's happening now, on the left and in this country and around the world, they have completely lost the plot morally, completely lost the ability to be clear about the moral state here we have a terrorist organization seeking to wipe out the jewish people and the jewish state. speech of some of the reaction to all that including this from an msnbc analyst. >> war is ugly but in the case of this instance with a hostages are being held by a palestinian journalist, civilian, and palestinian doctor, these are not civilians. these are hamas ambassadors. >> sandra: i wanted to get your reaction to that and how the white house is handling all of this. this is vice president kamala harris warning palestinians killed on saturday and gets heckled at this event in midian. listen. >> we mourn all the innocent lives that have been lost in gaza, including those tragically killed today. for the past eight months, president biden and i have been working every day to bring this conflict -- i'm speaking right now. [indistinct shouting" i value and respect your voice but i'm speaking right now. >> sandra: your reaction. >> for goodness sake. the position of joe biden and vice president harris, it's obscene. it's insane to draw some kind of equivalence between the deaths of the palestinians there. of course it's true that we don't want anyone to die but let's remember who killed these palestinians effectively. hamas. they are responsible for every single palestinian death. they started this, they committed these barbaric atrocities in october 7th that the media and the left and the democrats want to sweep under the rug. they are responsible. of all the comments i found the most obscene was from the u.n. the special rapporteur on the conflict in gaza. i will read you part of her tweet. "israel has used hostages to legitimize killing, injury, maiming, starving and traumatizing palestinians in gaza." she goes on to say. this is what the u.n. repertory says. israel could have freed all hostages alive and intact, eight months ago. she's blaming israel for the hostages. she's basically saying that israel is responsible for its own people being taken hostage. this is an absolute moral mess that the left is in these days and we've got to be really clear. months into this it's getting worse, not better. you have the vice president and the president for their own political reasons. effectively siding with the palestinian apologists for genocide, it's absolutely disgusting. >> sandra: more reaction from last hour. michael oren joined us. the difficulty of separating civilians from hamas fighters in gaza. listen. >> these hostages that were released, that would not have happened if not for israeli commandos. they can enter furious fire from hamas gunmen. not only gunmen. hundreds of civilians have been given guns. the whole division between civilians and combatants in gaza breaks down. >> sandra: your final thought on that? >> exactly right. that's the whole strategy. the evil sick strategy of hamas. they don't care about their own people. they don't care about the palestinians. they are cannon fodder to them because they have this in session, this ideological obsession with destroying israel and this is what they want, they want this carnage. they think it helps their cause. pathetically, tragically, it is helping their cause. we have the apologists for their terror right here in our midst. not just a far left students on campuses and protesting in our capital but right there in the white house as well in the form of biden and vice president harris as we saw this weekend. it's such an absolute disgrace what's going on. >> sandra: good to have you want to get your reaction. >> thank you, sandra. >> it's 110 but it doesn't feel it to me, right? so we will stay out here for a little while. everybody was so worried yesterday about you and they never mentioned me. i'm up here sweating like a dog. >> this was your father. you take him in for neurological exam. that trump is senile, incoherent, crazy, offensive, outrageous. disgusting, evil, and convicted. >> john: the liberal media once again throwing jabs at former president trump following a sweltering rally in nevada. but it's a dry heat. what is it that it's the constant left-wing animosity for the former president. >> sandra: byron york here to discuss all that more. he will join us live right after the break. boring does. boring makes vacations happen, early retirements possible, and startups start up. because it's smart, dependable, and steady. all words you want from your bank. for nearly 160 years, pnc bank has been brilliantly boring so you can be happily fulfilled... which is pretty un-boring if you think about it. this is the easiest, non-toxic swap you'll ever make. lumineux toothpaste was made by dentists designed to break up plaque and remove any toxins in the mouth, so it'll deep clean your teeth and whiten your teeth without any sensitivity. find lumineux toothpaste at a walmart and target. dad is a legend. and his legendary moves might be passed down to you. ancestrydna can show you which traits were inherited, where they came from, and who he shares them with. but get movin', this sale is only for a limited time. >> sandra: new election results in the european union are showing a clear rejection of far left policies as voters delivered a major blow to several liberal european leaders. it even forced french president emmanuel macron to call a new snap election. alex hogan's live in london. she's got the details. alex, was macron expected to make this decision? >> hi, sandra. no, this was a complete shock but when he made after the initial results of this parliamentary elections. those results still rolling in today. macron spoke directly to his citizens saying that he hears them and he will not leave their questions go unanswered. [speaking non-english language] >> interpreter: i am dissolving -- >> all of this before the country host the olympics. the initial results of the cu parliamentary election. le pen vowed to turn the country around and cracked down on. data showing immigration, the economy, key concern for voters. italy, italian prime minister gloria maloney's conservative brothers of italy group doubled her party seats in the e.u. assembly and in germany, chancellor scholz's social democrats saw their worst ever results of about 14%, losing to the conservative opposition. in austria the right-leaning freedom party outperform the conservative party as well as the social democrats. there are 720 seats in the parliament that represent about 450 million people, giving you a scope of the magnitude of some of the votes and the importance of people making their way to the polls. >> sandra: alex hogan reporting live in london. thank you. >> it's 110 but it doesn't feel it to me. so we will stay out here
