>> good evening and thank you for joining us i am trey gowdy and it is "sunday night in america". are we in the era of dooley impeachments the era and which whatever party controls the house seeks to remove a president from the other party and is there a double standard when it comes to congressional investigations. eric swalwell is a corner if you will a medical examiner displaying his version of a death certificate for the biden impeachment probe. it's the same eric swalwell for years perform cpr on the russia collision investigation on a daily basis. the same eric swalwell who badgered witnesses and leaked to the press of a duly elected president in the media never challenged him and they never challenged adam schiff when he invented a whole new category of evidence and never produced it. >> there is more than circumstantial evidence now. >> use indirect evidence of collusion. >> i don't want to go into specifics but i will say there is evidence that is not circumstantial and very much worthy of investigation. >> adam schiff was wrong about russia and fisa and the steele dossier and he pursued to failed impeachments and as punishment for the failures was the undying adoration of the d.c. media coupled with the democrat nomination for u.s. senate. so much for consequent is. impeachment is tantamount to the political death penalty. the investigation and trial will resemble a chaotic carnival. >> the chair has ruled. >> what are you afraid of. >> so far in this. it is felt like the worst episode of the apprentice. i'm sure you're familiar with that show. >> it seems like my colleagues in you and others are trying to become the next vice president. you're wasting over time, hours and hours going down fake rabbit holes and amplifying conspiracy. >> this is a show it's all fake. >> make no mistake, the chaos is intentional and is correlated between house democrats and their defenders in the state. the house democrats disrupt while the d.c. media minimizes gop investigation. democrat investigation on the other hand are treated like the college of cardinals, they demand to know when the gop will move forward with impeachment. >> let's do the impeachment, why continue to waste millions of dollars the taxpayers money if were going to impeach because you believe you've shown he's committed a high crime and misdemeanor, what you waiting on. >> we have chairman jordan here also the double chairman why are you calling for the vote in your committee, when is it going to happen. >> they did not seem to mind when nancy pelosi took weeks to simply transmit articles of impeachment from the house to the senate. it took her weeks to walk a couple hundred steps from one side of the capital to the other. were left to wonder whether impeachment has become washington's version of dueling banjos and if the reason americans have a dim view of the media. the media never met a republican investigation that should begin or democrat investigation that should end. joining is now house oversight chairman james comer, welcome mr. chairman where does the impeachment inquiry stand, what witnesses are left for you to examine. >> right now we want to hear from joe biden, what we heard three former business associates all testified under oath that joe biden was a central figure in the family's influence peddling schemes. what we have proven and the democrats will not dispute nor will the media dispute, the biden family influence peddling and they did not have a single legitimate business in the biden family did not provide one single hour of work for the tens of millions of dollars they received from her enemies around the world that is influence peddling one-on-one, although further the biden family did not pay a penny of taxes on the $28 million they received from our adversaries around the world but the problem joe biden has three business associates have testified that joe biden was the central figure and their influence peddling schemes. what the democrats were saying that the hearing, impeach one, they want an impeachment because they know the senate is not going to do anything. i want to hold the biden family accountable and the best way to hold them accountable is through criminal referrals. we have proven many crimes were committed and the democrats are not disputing that the president's son and brother committed crimes and what their disputing joe biden was involved in the scheme that is why we given joe biden an opportunity to come before the committee to explain himself. >> president biden sat down for an interview and special rob her did not turn out that well for him deeply not inviting him to sit down for a transcribed interview, do you want to send questions to him you want to send questions to his lawyer, how do you propose to get answers to them. >> we're going to send him some questions were definitely going to do that but were going to give them opportunity if he wants to come in front of the house oversight committee he has an open invitation he better do it quickly if he wants to sit down for a transcribed interview i will bring the oversight staff to the white house and we will conduct a transcribed interview. it is his choice. if he does not come forward and answer for himself, we're going to have to believe the testimony of bob belinsky and archer who testified that joe biden was a central figure in joe biden met with all these people and is like dozens of times about his knowledge of and participation and benefit from his family's influence peddling schemes and that's not going to play well for joe biden moving forward when we entered the real accountability phase of this investigation. >> chairman you mention criminal referrals those would be to a d.o.j. run by merrick garland put in place by joe biden. you expect this criminal referrals to be in addition to impeachment articles or in lieu of impeachment articles. >> that's a decision that leadership is going to have to make but again the fact that the senate is not going to take impeachment seriously just like they have not taken merrick garland impeachment seriously i think is evidence if we want to hold them accountable we're going to have to focus on the justice. the merrick garland of the justice will not hold this family accountable then maybe if trump wins president then trey gaddy department of justice can hold this family accountable for the wrongdoing that is one of my hopes there. >> chairman, my wife cannot live on the salary that the attorney general makes but thank you for saying that. i love being a prosecutor that i love working for fox because i get to talk to you, thank you for spending some time with us on sunday night all the best to you and your beloved state of kentucky. >> thank you. >> former president trump has until tomorrow to find half a billion dollars for an appeal bond in the new york civil fraud case otherwise he runs the risk of the state of new york and start seizing assets. joining us to survey the legal landscape and former prosecutor andrew kerr caskey and attorney john yoo. the justice system is different and used to be different and even opponents are entitled to due process and fundamental fairness. half a million dollars judgment in a case with no financial loss and no real victim to some of us seems personal and punitive are we missing something is there something that justifies that amount whizze which is ten amouo the business death penalty to donald trump. >> there is not the appellate division credibility depends on how they act on the state that trump's team has filed with it. right now looking at a state or relief from the astronomical judgment and the requirement to pay it by monday the defense team has gone forward and given the appellate court rationale that they need this day allows for exceptions to be made in the courts have made the exceptions of the past in a case is of far less gravity and amount that we have in this case we talk about the likelihood of success on appeal and they go through all sorts of issues or calculation at accounting and judge arthur engoron did and they hit on the eighth amendment the amount of penalty is astronomically higher in any calculation that you can put forward to show damages where there are no factually evidence of damages, their very solid grounds for the appellate court and i hope that they don't do that right down. trey: the news was a little better for the former president and georgia nathan wade is off the case they are allowing the defense to appeal to leave fani willis on the case. what do you think will happen on appeal and is the timing of this trial and definitely push beyond november because of this. >> it's hard to see how this case gets to a verdict before november given that we haven't started any real proceedings in front of a jury but the more important thing were all former employees and we all know the department prosecutors have to have the highest integrity and they need to have higher integrity if they get a after president for the first time in history and bring charges against a presidential reelection campaign which is an exercise of first amendment rights because ultimately prosecutors in the legal system can't succeed and can't maintain law and order unless they have the confidence of the cooperation of the public and if the public sees prosecutors and monkey business and sometimes seem to be lying on the court on tv in front of everybody then we have to be worried whether they have the integrity necessary. >> this is for both of you will start with you. >> he won the colorado case and the impossible it was 19 megs 0. and i doubt that's going to be 19 megs 0 will start with you professor then you andrew. >> i would not bet against you, you have a good track record. i think it might be 19 megs 0 but it might be 19 megs 0 against president trump and the reason i say that all the presidents in the past decision seem to run against trump i don't think the court is likely to say that the president have immunity from federal criminal prosecution but people should keep in mind immunity means trump doesn't mean he has to show up and appear and whether this is really fraud i don't think it is and if it's interfering with the congressional process i'm not sure it is and trump took away everyone's voting rights i definitely don't think he will be able to make those important constitutional legal arguments even when he loses immunity of the line between a personal act i don't think the oral argument went well for trump's lawyers for the d.c. court of appeals. what do you think. >> i'm going to disagree with john i think is a case for the supreme court to grant some degree of immunity. this is a case of first impression no president has been prosecuted criminally before we have some precedent that talks about the outer perimeter of the presidency and not be in a guideline for the idea of immunity. the d.c. circuit court totally ignored that and said that the president doesn't enjoy immuni immunity. that seems to suggest the opposite of what we see all the time the government actors have a certain degree of immunity. if the board gives the outer perimeter standard to donald trump then how do you define what that looks like that's good to be the difficulty for the supreme court this decision is good to go forward for hundreds of years on how to prosecute presidents. how that line is drawn is very tricky of the engagement of the president and the legitimacy or the sanctity of voting does not have to deal with foreign interactions or policies which is an article one function of the presidency is very difficult to say. i think the supreme court is going to set a guideline for what immunity looks like it is going to be relatively far down the line and they're not going to get into the politics of deciding what is and was not a presidential act versus a personal act. >> members of congress should listen to both of you to highly esteemed lawyers drawing different conclusions but doing so with such civility and grace. thank member told me recently he said he has not seen this many of his republican colleagues line up against the sitting member like bob good as they have liz cheney, there is an irony here, bob good is extremely detrimental for the mental health of young people they are not having the same social connection experiences even though they are connected to a lot of information. the fact that social media pushes the comparison standard is what are the things that is undermining the mental health of the people. and if i answer a question on a scale of 0 - 10 and ten is the best life i could be living rank yourself, social media artificially inflates what they believe it would be in their best life could be in that type of comparison is undermining their wellness, we see young people as young as 12 or 13 years old to experiencing heightened experiences with negative emotion because of the comparison standard and we see a gap between young women and young men so girls are struggling even more as a result of this comparison standard. i encourage parents to help manage how their children are engaging with social media in the painful emotional experiences undermine mental health in ways that could last a lifetime. >> doctor anita phillips a trauma mental health expert the book is the garden within. thank you for joining us on the sunday night. i look forward to talking to you
