secure the nearly half a billion dollar bond or else a new york state could begin seizing his assets and freeze his bank accounts. mr. trump's legal team now trying to convince an appeals court to waive the judgment in that civil fraud cages saying the board of 54 million-dollar penalty is impossible for their client to pay. hello everyone welcome to fox news like i am eric shawn, hi anita. anita: i am indeed a vocal and for arthel neville. letitia james is already indicating she is prepared to collect if trump cannot pay court documents filed in westchester new york earlier this month that's home to a sprawling estate in a trump golf course. assets in the big apple to include trump tower. that could also be up for grabs. some critics accused james of using the law to play political games. ask any time someone with a power, prosecutor, ada, and he went with power that can enforce the laws of this country. when they stopped caring about the actual case at hand and they care more about making it difficult for an individual that they do not like that we have lost the interest of fairness of the administration of justice. smooth for wrote what will happn tomorrow? is standing by to discuss the potential fall output versus go courtesy because she is live outside trump tower in new york city with the very latest from what is going on there. >> hi eric. we all know former president donald trump has some price real estate like trump tower behind me. earlier this week his attorneys told the court not of it has helped the former president secure a bond nearly half a billion dollars. no trump's legal team is waiting to see whether the state appellate court will make a decision on trump's request to have the bond it waived while he appeals a civil fraud judgment against him. this morning on "sunday morning futures" with the maria trump's son, eric said this. walk to help the division comes back with something that's very sensible. we have offered that would try to beat re be reasonable known s overseeing a bond the size every single person when i came to that sake i could happily dollar bond maria, they were laughing but thepart they were laughing p executives of the largest companies had never seen anything of the site so what they're going to start seizing assets? if you cannot put up something that's not available in the united states? >> if a former president trump does not secure the bond the state could start the process to collect on the civil fraud judgment. legal experts tells new york attorney general letitia james will likely go after trump's and bank accounts first. seizing real estate is long and complex. former federal prosecutor tells fox the trump family has every reason to be concerned. one says of the trump team is worried about there is a foreclosure to force the sales to therefore satisfy the judgment could go for much below the price. at that point trump cannot get the proper respect they have been sold. they get the money from the sale back if you win on appeal but that is what his team is trying to avoid is the sale of the real estate it cannot be an done. >> also happen tomorrow a hearing in trump's hush money case. trump's ltrumps lawyers the mans office have been sparring over a dump of the thousandt date trian or to throw it out altogether. tomorrow the judge as you know good to postpone the trial even further. back to you. eric: the coverage i'll start tomorrow at 6:00 a.m. down in court on fox and friends he former president will be in court tomorrow, see beat thank you. anita: busy day for you, eric. craig say ruling against trump sets a dangerous precedent some democrats argued the former president is being treated just like anyone else. listen. >> it is my belief that all people should be treated equally under the law. and if that seizure of assets would be pursued to any other american than donald trump should be treated the same. i respect the attorney general's discretion here. but i do think he should be treated equally under the law. >> former deputy independent counsel fox news contributor saul weiss and burger joints now. thank you so much for coming in on this. we are certainly in the 11th hour here beyond that we are te former president has appealed to the new york state appellate court on both reducing the massive bond amount or grant a stay or a pause. no word yet from the court. what do you expect will happen? >> they really have no idea. i am not an expert on new york state civil law. it seems to me t they could've already granted this before the very last minute so i am skeptical anything will happen in this courts and that of course will be bad for former president trump. the idea this is what in the others civil defendant would face i think it's ridiculous. i am unaware of any case from new york or anywhere else there's a 355 million-dollar judgment that is before interest where there is no jury there was no loss. under this particular statute you do not even have to prove reliance. i am unaware of any case like that. my question is one of my many questions is where was the attorney general in previous attorney general's? where was the manhattan das office where was the u.s. attorney's office during the 30 years before trump became president and he was operating in new york? they did not try to do anything to him along these lines it's only after he became a political figure. i don't think there's any doubt this is political in nature. >> former president has said he believes this whole thing is unfair. the judge here is out of line. and he, former president trump would like to take this all the way to the super in court to appeal it. but at one point could actually do that? because he and the clock is ticking here and it is ticking fast. >> right now it's virtually impossible he could get any kind of ruling from the u.s. supreme court before tomorrow on this and he is not even attempted to do so. this is a really unique ruling the lower court made he made very detailed factual findings about whether or not there is misrepresentation. but the idea you can impose this kind of a remedy. remember this is that equitable remedy and getting a lot nerdy up actions in law, actions and equity this is an equitable statute that's the only reason white near court opinion about 10 years ago said it's okay you don't have a jury here. and yet because it damages or ae incidental to the statute and yet three and $55 million judgment under the statute. i do think there's potential constitutional problems with it. the problem is those issues have not been raised at a federal level. anita: i don't know if you can talk about this but they talk about maybe taking trump tower. but trump tower is not fully owned by donald trump but my colleague eric shawn reminded me of that there's a lot of individual condominium owners inside of trump tower. so, what legal protections do they have if letitia james goes after something like trump tower? >> is one of your previous guests pointed out it is easier to go after bank accounts than after property. you could file a judgment rate letitia james can file a judgment in any court she wants too. based upon the judge's ruling. but that is very different from being able to take the property. my understanding is lot of these properties not only are they not owned wholly by trump or his companies but there are all kinds of layers of ownership. that will be a lengthy and laborious process even assuming she's allowed to start the process. anita: final question, what do you think will happen tomorrow? do you think former president trump will be able to cope with the money? or are his is going to start being seized if you had to guess? >> well if you're asking my opinion but with the court will do, whether or not they will grant the stay or reduce the bond amount, my guess would be they won't based on the fact they have not done it yet. anita: all eyes on the courthouse tomorrow are eric shawn will be there waiting to see what happens as are the rest of us. sol wisenberg thank you for your insight today, appreciate it. >> thank you for having me. anita: you got it. >> did we went wild men between 20 and 40 that we don't know anything about their background coming from all over the world barging, charging, stampeding into our country? there are a whole lot of questions that need to be answered. >> eric, source with dps says troopers would only pursue suspects that they knew cross the border illegally paid whether it be from seeing a migrant cross the border outside a port of entry or possibly on a camera it would be another scenario rather than stopping random people and checking their immigration status we will send it back to you pickwick see what happens, nate's thank you. anita: vita ministration pointed a finger at fort the latest cast lucas thompson picks that up live at the white house. lex good afternoon. vice president harris interview with abc was asked if she had seen that video of the texas national guardsmen being run over by the hundred or so it migrants she did not say. she would also estimate any potential executive action the white house would take when it comes to the border. >> they are refusing to put it up for a vote. in large part because we know the former president would prefer to run on a problem instead of fixing a problem. as of right now is executive action on the board us on the table? secure the nearly half a billion dollar bond or else a new york state could begin seizing his assets and freeze his bank accounts. mr. trump's legal team now trying to convince an appeals court to waive the judgment in that civil fraud cages saying the board of 54 million-dollar penalty is impossible for their client to pay. hello everyone welcome to fox news like i am eric shawn, hi anita. anita: i am indeed a vocal and for arthel neville. letitia james is already indicating she is prepared to collect if trump cannot pay court documents filed in westchester new york earlier this month that's home to a sprawling estate in a trump golf course. assets in the big apple to include trump tower. that could also be up for grabs. some critics accused james of using the law to play political games. ask any time someone with a power, prosecutor, ada, and he went with power that can enforce the laws of this country. when they stopped caring about the actual case at hand and they care more about making it difficult for an individual that they do not like that we have lost the interest of fairness of the administration of justice. smooth for wrote what will happn tomorrow? is standing by to discuss the potential fall output versus go courtesy because she is live outside trump tower in new york city with the very latest from what is going on there. >> hi eric. we all know former president donald trump has some price real estate like trump tower behind me. earlier this week his attorneys told the court not of it has helped the former president secure a bond nearly half a billion dollars. no trump's legal team is waiting to see whether the state appellate court will make a decision on trump's request to have the bond it waived while he appeals a civil fraud judgment against him. this morning on "sunday morning futures" with the maria trump's son, eric said this. walk to help the division comes back with something that's very sensible. we have offered that would try to beat re be reasonable known s overseeing a bond the size every single person when i came to that sake i could happily dollar bond maria, they were laughing but thepart they were laughing p executives of the largest companies had never seen anything of the site so what they're going to start seizing assets? if you cannot put up something that's not available in the united states? >> if a former president trump does not secure the bond the state could start the process to collect on the civil fraud judgment. legal experts tells new york attorney general letitia james will likely go after trump's and bank accounts first. seizing real estate is long and complex. former federal prosecutor tells fox the trump family has every reason to be concerned. one says of the trump team is worried about there is a foreclosure to force the sales to therefore satisfy the judgment could go for much below the price. at that point trump cannot get the proper respect they have been sold. they get the money from the sale back if you win on appeal but that is what his team is trying to avoid is the sale of the real estate it cannot be an done. >> also happen tomorrow a hearing in trump's hush money case. trump's ltrumps lawyers the mans office have been sparring over a dump of the thousandt date trian or to throw it out altogether. tomorrow the judge as you know good to postpone the trial even further. back to you. eric: the coverage i'll start tomorrow at 6:00 a.m. down in court on fox and friends he former president will be in court tomorrow, see beat thank you. anita: busy day for you, eric. craig say ruling against trump sets a dangerous precedent some democrats argued the former president is being treated just like anyone else. listen. >> it is my belief that all people should be treated equally under the law. and if that seizure of assets would be pursued to any other american than donald trump should be treated the same. i respect the attorney general's discretion here. but i do think he should be treated equally under the law. >> former deputy independent counsel fox news contributor saul weiss and burger joints now. thank you so much for coming in on this. we are certainly in the 11th hour here beyond that we are te former president has appealed to the new york state appellate court on both reducing the massive bond amount or grant a stay or a pause. no word yet from the court. what do you expect will happen? >> they really have no idea. i am not an expert on new york state civil law. it seems to me t they could've already granted this before the very last minute so i am skeptical anything will happen in this courts and that of course will be bad for former president trump. the idea this is what in the others civil defendant would face i think it's ridiculous. i am unaware of any case from new york or anywhere else there's a 355 million-dollar judgment that is before interest where there is no jury there was no loss. under this particular statute you do not even have to prove reliance. i am unaware of any case like that. my question is one of my many questions is where was the attorney general in previous attorney general's? where was the manhattan das office where was the u.s. attorney's office during the 30 years before trump became president and he was operating in new york? they did not try to do anything to him along these lines it's only after he became a political figure. i don't think there's any doubt this is political in nature. >> former president has said he believes this whole thing is unfair. the judge here is out of line. and he, former president trump would like to take this all the way to the super in court to appeal it. but at one point could actually do that? because he and the clock is ticking here and it is ticking fast. >> right now it's virtually impossible he could get any kind of ruling from the u.s. supreme court before tomorrow on this and he is not even attempted to do so. this is a really unique ruling the lower court made he made very detailed factual findings about whether or not there is misrepresentation. but the idea you can impose this kind of a remedy. remember this is that equitable remedy and getting a lot nerdy up actions in law, actions and equity this is an equitable statute that's the only reason white near court opinion about 10 years ago said it's okay you don't have a jury here. and yet because it damages or ae incidental to the statute and yet three and $55 million judgment under the statute. i do think there's potential constitutional problems with it. the problem is those issues have not been raised at a federal level. anita: i don't know if you can talk about this but they talk about maybe taking trump tower. but trump tower is not fully owned by donald trump but my colleague eric shawn reminded me of that there's a lot of individual condominium owners inside of trump tower. so, what legal protections do they have if letitia james goes after something like trump tower? >> is one of your previous guests pointed out it is easier to go after bank accounts than after property. you could file a judgment rate letitia james can file a judgment in any court she wants too. based upon the judge's ruling. but that is very different from being able to take the property. my understanding is lot of these properties not only are they not owned wholly by trump or his companies but there are all kinds of layers of ownership. that will be a lengthy and laborious process even assuming she's allowed to start the process. anita: final question, what do you think will happen tomorrow? do you think former president trump will be able to cope with the money? or are his is going to start being seized if you had to guess? >> well if you're asking my opinion but with the court will do, whether or not they will grant the stay or reduce the bond amount, my guess would be they won't based on the fact they have not done it yet. anita: all eyes on the courthouse tomorrow are eric shawn will be there waiting to see what happens as are the rest of us. sol wisenberg thank you for your insight today, appreciate it. >> thank you for having me. anita: you got it. >> did we went wild men between 20 and 40 that we don't know anything about their background coming from all over the world barging, charging, stampeding into our country? any president within his right mind in the white house would say this must end. eric: texas dan patrick about the scene that really shocked people happe happened last wedn. a migrant stampede in el paso. meantime the biden administration is battling texas in court over the state's new law that allows it to arrest and deport migrants without the help of the federal government for now federal appeals court with that on hold. nate foy live in eagle pass, texas with the very latest from there. nay, people talking about the shot the video that shows some of those migrants basically going wild on some of the law enforcement officers? >> people certainly are talking about that video. that was one of two days this week where we sought migrants clash with texas authorities in el paso. to date the u.s. border patrol chchief jason owens says what happened is a national security crisis and he referenced the 140,000 known and got away so far this fiscal year pre-take another look at the video you just played from el paso, texas dps is still investigating possibly going to make more arrests as a result of this they arrested one migrant for assaulting a texas national guard soldier rate troopers may arrest more migrants for criminal trespass and destruction of property. the new budget deal increases funding for cpp to $9.6 billion that's three-point to billion more than last fiscal year. republican congressman tony gonzalez says this will not be solved until there's either a new president for clear policy changes from president joe biden. >> i have given up on joe biden doing what is right. it is very clear we are going into year four of this sort of crisis. this is exactly what they wanted. the only way this stops is a new administration. a new president. i cannot imagine what your five, six, seven, eight looks like under joe biden. >> meanwhile democrats call on republicans to pass a bipartisan border bill in congress. this happens as texas awaits a key ruling on senate bill four which would allow the state to arrest and possibly deport migrants across the border illegally without turning them over to border patrol but democrat congresswoman is against as before, listen to this. >> what happens to el paso and who is accused of being here illegally who might not have id on him? there are a whole lot of questions that need to be answered. >> eric, source with dps says troopers would only pursue suspects that they knew cross the border illegally paid whether it be from seeing a migrant cross the border outside a port of entry or possibly on a camera it would be another scenario rather than stopping random people and checking their immigration status we will send it back to you pickwick see what happens, nate's thank you. anita: vita ministration pointed a finger at fort the latest cast lucas thompson picks that up live at the white house. lex good afternoon. vice president harris interview with abc was asked if she had seen that video of the texas national guardsmen being run over by the hundred or so it migrants she did not say. she would also estimate any potential executive action the white house would take when it comes to the border. >> they are refusing to put it up for a vote. in large part because we know the former president would prefer to run on a problem instead of fixing a problem. as of right now is executive action on the board us on the table? do we see that? >> that does not absolve the fact that the real fix is going to feel in congress acts. it's still on the table though? >> yes for consideration. >> on fox news is that it senator tom cotton says president biden should go back to trump era border policies which she said stopped in millions of illegal immigrants from coming into the united states. >> the only person responsible for the catheter borders joe biden. in 2020 he said he reverse all president trump's highly effective policies that send a signal to everyone around the world if you got to our border you could get in and that's exactly what he did on day one. >> also on "fox news sunday" virginia democratic senator tim kaine who is up for reelection this year urge the president to take executive action to solve what he calls a crisis on the southern border. >> i do encourage him to use executive actions. i don't think he can do everything that was in a bipartisan bill by executive order but there's probably a subset of things he can do and i think his team is considering it. >> president biden returns her to the white house later this afternoon from his home and at willington. perhaps he will take some questions on the border after he arrives. anita: you get in there and try to ask him. lucas tomlinson live at the white house. thank you lucas for. >> lucas certainly will. the islamic state terror groups on the rise. experts say it's a growing threat to the middle east and europe after claiming responsibility for the massacre in moscow. physis kate launch an attack against us right here at home?
