county, virginia. next. >> dana: fox news alert now. former president trump is in federal court in fort pierce, florida, where his legal team will present arguments in a bid to get his classified documents case dismissed. they claim mr. trump is protected under provisions of the presidential records act and they are asking the judge to reject prosecution claims of espionage and obstruction. americans trapped in haiti begging for help in the rush to get them out as vicious gangs take overturning haiti into a lawless danger zone. welcome to a new hour of "america's newsroom." i'm dana perino. >> bill: good morning. second hour begins now. i'm bill hemmer, good morning. right now a team of elite marines on the ground in haiti to defend the u.s. embassy and help secure the safety of americans there. the island country as it descends into bloody chaos. notorious gang leader barbecue at the center of growing violence calling for a bloody revolution. it sparks fears the crisis could go spew into the u.s. >> dana: biden administration is considering plans to -- the chaos in haiti before this man was rescued. >> we've been through this stuff before. our obligation is to our kids. a lot of people need to get out still and then the thing is, we went through what it was like to have your freedom taken away for eight or nine days. >> dana: we're live at the state department as this crisis has been building for quite a while and now reaching a peak. >> that's right. there may be thousands of americans trapped inside haiti right now with the country really teetering on the brink of total collapse. the state department does not appear to know precisely how many americans are there on the ground needing rescue. >> how many american citizens are you aware of in haiti wanting to leave? >> i don't have a number. >> as gang violence and blood-letting is spiraling out of control by the hour the state department is trying now to evacuate the embassy and state officials are acknowledging concerns this crisis could prompt a mass exodus haitians from the country with many seeking asylum in the u.s. >> what often happens when you have an unstable security situation is increase in people attempting to flee the country and leave to other places. >> right now the country's most notorious gang leaders are leading the charge and in total control of the capital city and shut erred government buildings, roads, airports. border officials in florida have already been put on high alert to the possibility of a new wave of mass migration prompting governor desantis to deploy extra assets to protect the state's coast. military experts fear conditions on the ground could result in what they're calling afghanistan 2.0. >> this is a failed state. there is no government. there is no police enforcement. gangs and anarchy are ruling the day. we learned it in iraq in afghanistan, security becomes the necessary condition. >> secretary blinken spoke to us reporters the at the state department yesterday saying his top priority the u.s. top priority right now is working to set up this interim coalition government inside the country that will soon nominate a new prime minister to take over. maybe there is chance that will restore some security. >> dana: keep us posted. >> bill: the white house facing a p.r. nightmare as allegations over verbal abuse from top aides goes public. this headache coming as president biden ramps up campaign travel turning focus to critical battleground states in the upper midwest. he will go to michigan today for the first time since 100,000 voters cast uncommitted ballots in protest during michigan's primary. peter doocy has the low down on the road trip today from the north lawn. good morning. >> good morning. the only way this president or any president who is in office can have a successful out of town trip is if the advance teams identifies any possible problem that could pop up and addresses it before the president gets there. but the white house advance team now is in crisis. the two staffers responsible for more logistics over the last three years than anybody else serving president biden are gone amid complaints of bad behavior. >> the president is deeply proud of his advance team. he is grateful to everyone who has served and is serving on an unmatched team that represents the diversity of the country as they have fought every day to help him bring his message to the american people and to the entire world. >> that advance team has set up more events in pennsylvania than anywhere else and trump is now beating biden head-to-head there by two in a fox poll 49-47. pennsylvania voters surveyed trust trump over biden to do better on the border, economy and on foreign policy. and more tough news for biden in arizona. trump is leading him at the moment by four spots, 49-45. in that state, trump is also favored by 19 points by voters who think it is extremely important to have a president who is mentally sound. biden is trying to fortify his blue wall with stops in michigan and wisconsin. >> president biden: i know it sounds like but it is all in your hands. folks like you all across the country because this is how i won the first time i ever ran and how we win again. you helped me in 2020 and we want to make sure he was a loser. he is a loser. we will make sure that happens again. >> if it will happen again for president biden he will have to stop the trend of voters moving away from him. the only top three issue in these two swing states that were polled that biden is beating trump in is election integrity. bill. >> bill: watching the upper midwest. keep an eye on michigan and wisconsin, critical battleground states. separated by a few votes four years ago. go back to 2016, wisconsin and michigan 10,000 votes here and there. that decided the electoral counts. toss it to dana. byron york will join us now and get a sense of where the campaign is right now. i thought the fox polling yesterday was very interesting, right? pennsylvania and arizona seem to be as razor tight as some of these upper midwest states. >> dana: what karl rove writes today is if you are a democrat, you need to understand that trump is more formidable today than he was in 2020. that is what they are trying to say. byron york with us, he is a fox news contributor and good to have you with us. so take a look at those polls. upper midwest area, it's -- democrats tried to hold onto it. right now trump in a slight lead in these cases. where do you think it will end up? >> first of all, i think we've been really showing an important part of this campaign today because today joe biden is going to be in michigan and wisconsin, and donald trump is in a courtroom in fort pierce, florida. that's a huge difference that we are going to see in this campaign and it will go on and on and on as the former president's legal cases continue. now as far as the close states are concerned, i think there is something we really need to pay attention to in the new fox polling. there is a couple of ways you can poll. you can poll trump versus biden. or you can poll a five-way race with robert f. kennedy and stein and cornell in there. if you look at the polls five ways you see the three third party candidates getting between ten and 15% of the vote. that's a huge factor when you have two candidates who are as tightly matched right now as joe biden and donald trump. >> dana: just on that this morning it was released that the democratic national committee for the first time in its history will dedicate a team to the third party threat. that will be led by liz smith who helped pete buttigieg in 2020. >> bill: before we talk more about rfk. he had an interesting comment with trace gallagher with fox news @ night and aaron rodgers. economy was number one in arizona and pennsylvania. immigration ranked high in arizona as well. who do you trust more to do a better job? arizona is up 14 for trump and pennsylvania he is up 12 on that same issue, byron. if it stays there, you saw the inflation number from what, an hour and a half ago, that story is going to stay with america unfortunately for the rest of this year at least. >> absolutely. and a big factor here again which nobody has experienced in anybody's lifetime is that you have two candidates running against each other, both of whom have been president of the united states. so when usually you have one candidate who is the the president seeking re-election and another promising what he will do if he is elected president. that's not the case here. you have had two men who both have been in the office and i think that's a real strength for donald trump. perhaps voter's memories of him have gotten rosier of him. things were better economically when donald trump was president. you can measure that in all sorts of measurements like inflation. and that gives him a big, big edge over joe biden. >> dana: that's true also with hispanics in particular. the liberal patriot blog writing about that specifically yesterday. let's talk about third parties more. rfk junior made a little bit of news last night with trace gallagher talking about a potential v.p. pick that he will announce next week on march 26th. watch here. >> i really like aaron because our appeal is to young people. we're trying to make sure that young people are participating in the political process. aaron rodgers has been hammered by the press and aware of health issues. that's one of the things -- that's one of the key parts of my agenda. >> dana: i'm intrigued. i want to see what will happen. what do you think will happen here? >> well, rfk junior is an interesting candidate and talking about some interesting choices, either aaron rodgers or jesse ventura, the former wrestler and governor of minnesota. now, if you've noticed, if this was a trial balloon that rfk junior sent up it has been shot at a lot among democrats, among their allies in the media who were just absolutely trashing this. i think the sub text of that, whatever aaron rodgers qualifications to be vice president are, the sub text is they're scared that an rfk junior candidacy will hurt joe biden more than it hurts donald trump. after all, rfk is really a democrat. he is a kennedy democrat and his presence on the ballot is probably going to hurt the democrat more than it hurts donald trump. >> dana: hence the worry by the democratic national committee. thanks, byron, good to see you. >> thanks, folks. >> dana: we were mentioning the third party candidacy possibility could make or break the race in some states. biden administration senior officials are reportedly meeting with pro-palestinian leaders in chicago today. why does that matter? it's where the convention is. the president faces mounting backlash from his own party over the israel/hamas war. it whats one of the largest palestinian populations in the public and trying to regain support as early voting is happening now in illinois for the state's primary. they don't want to see a repeat like they did in minnesota. the fate of fani willis hanging in the balance. a judge to decide whether she will be removed from the trump election case. >> bill: newly released surveillance student of missing student riley strain. will this shed light on his disappearance? have a look at that and also this, roll it. >> what type of folks do you anticipate coming for spring break? >> it will be a lot of young people, college kids and mostly that's what we'll see here. we are accustomed to it. >> dana: revelers. not everyone is in a party mood. lawrence jones on the rowdy times. here he is. - [speaker] at first, just leaving the house was hard. - [speaker] but wounded warrior project helps you realize it's possible to get out there - [speaker] to feel sense of camaraderie again. - [speaker] to find the tools to live life better. - [narrator] through generous community support, we've connected warriors and their families with no cost physical and mental health services, legislative advocacy, career assistance, and life skill training for 20 years, and we are just getting started. planning to move? >> dana: federal judge setting a date for hunter biden's gun trial and the judge who blew up the plea deal. >> her name is judge noreika based in wilmington, delaware and penciled in the week of june 3rd for hunter biden to appear and answer during his trial on federal gun charges. she held a conference call yesterday with parties from the special counsel david weiss's office. both sides expect the trial to last two weeks tops. david weiss says hunter lied on a federal firearm form when he answered know to having a drug addiction. he is heading to trial on june 20th in los angeles for federal criminal tax charges. that date may slide given when the delaware trial starts. also some sharp words from hunter's attorney yesterday sent a scathing letter to james comer saying his client would not appear for a public hearing next week. far from the smoking guns you claim the evidence doesn't amount to drop lets from a water system. if you are serious pursuing this in a legitimate and bipartisan fashion you would hold a hearing with relatives of former president trump about whom you indicated you would ask. if you do, mr. biden would consider an invitation for that event. james comer firing back to house oversight committee has called hunter biden's bluff. he stated he wanted a public hearing now that one has offered alongside business associates he worked with for years, he is refusing to come. remember hunter biden spent the day before congress on february 28th answering questions under oath off camera. his former business associate tony bobulinski has already confirmed he will attend next week. dana and bill. >> dana: david spunt, thank you. >> bill: thank you, david. florida beach towns will be put to test over the weekend traditionally the most rowdy week of spring break. city officials are getting ready for the possibility of violence and party to peak. florida governor ron desantis signeding extra troops to miami and fort lauderdale to bolster support and prevent chaos. lawrence jones has already been there and just back and talked to a lot of spring breakers down there. >> dana: you have the toughest assignments. >> bill: we saw you in new orleans and miami. >> lawrence: how many drinks can you tolerate a day? >> me personally? probably 15. >> 15 drinks? >> during a day i like to prepare myself for the evening festivities. >> what's the rule if you put the drink down. >> not to pick it back up. >> do not pick it back up. >> all our shots we bought. >> bill: what did you learn? >> there is a mix of reporting trying to figure out what's happening at the spring break b but educating the younger people. don't experiment with the drugs because half are laced with fentanyl. one thing i learned is miami beach stepped up. they got a new mayor, three new commissioners on city council. have a great relationship with the governor now and shutting the city down. dui checkpoints. towing cars, checks on the beach. as a result, a lot of the kids are leaving miami beach and going to fort lauderdale because they can't do the insane stuff they were once doing. if you remember last year when i covered spring break we were talking to folks. someone pulled a gun on us and three murders that happened that same weekend. so it was just not -- it wasn't just the drugs. it was the violence and shooting and a lot of businesses were upset about it as well because they ransacked their area. >> dana: you were in new orleans as well. residents versus revelers. is that tension reaching a point where somebody like the mayor says i have to pay attention to my tax paying businesses although some businesses might mix out on big nights. >> i talked to the mayor. i was elected to do this. public safety is my number one responsibility. i will say, dana, there are businesses that like the rush for that two weeks feeling like they get at least a quarter of their income for the whole year in that two weeks but for other people it is like we live here all the time and if we are having to leave and take a vacation somewhere else because they are coming, it's not right. >> bill: i heard lauderdale was a mess. >> it is a mess. they will have to deal with it. new orleans i never anticipated it being a spring break destination. apparently got some young people there. >> bill: you were talking to us during the commercial and said you were surprised how willing they were to jump on camera and do an interview at any time of day. >> it surprised me. the clip of the young lady i always ask the kids what's the first thing that you do and she said bronzeer and cocaine. i went to spring break a few times when we had the money. i never would have jumped in front of a camera. the willingness of these young people to be drunk in the middle of the street and be willing to tell the whole world i just think it says something about this generation. >> bill: maybe you grew up with a phone. >> dana: and where do you think it goes from here? do you think fort lauderdale is making a bad decision? >> you mean miami beach. >> dana: if all the revelers get pushed there. >> they will change their policies to be more reflective of miami beach. the they have to. again, there was some traction in fort lauderdale. everyone wanted to go to the most beautiful beach in the country miami beach. they will adjust the policy. i think this year, dana, ainsley used to cover spring break before i did. she said when she did all this coverage for years they ended up shutting down panama beach because parents were so concerned. i think the same thing will happen to all of these beaches once more cameras shine on it. >> bill: miami has a different composition since covid. a lot of people moved down there. >> one day you should do the show with me for spring break. >> dana: for spring break, no. i'm sure -- i'm not going. >> bill: the biden team coming up against a major deadline on the border wall and impact the border crisis as we just saw with the fresh video in arizona. s.a.t. undergoing a major makeover. different testing for different students. how will that turn out? >> well dana, first of all measles is not political, right? it has been made political but shouldn't be. for measles you feel initially malaise, fever, red eyes and four or five days later headache, fever, cough, you can get pneumonia and you develop bright red rash. that's measles. it is the most highly contagious respiratory virus on the planet. here is the stark medicine of this. if you are vaccinated you are almost 100% not going to get measles. if you are not vaccinated against it and you encounter is there is a 100% you are going to get measles. that's the problem. now the head of the cdc told me last week that we're about at 93ers p percent in the united states. i think it's lower now. that was a year ago. we have had so much anti-vaccine sentiment that the measles vaccination is dropping. the number for herd immunity. a term we said a lot during the pandemic. it's 95 or 96%. if the whole herd is vaccinated we'll protect the others who can't get it who can't get it. we are not at 96% now. that's why chicago is at risk. in addition to the fact one more point here, dana, i don't think the issue of migrants and measles is political. i tell you why. because if you are coming across the southern border you come from a country that's 85 to 90% vaccinated. on top of that you think if you are rushing across the border or trying to escape somewhere you will pause to get a vaccination? i don't think you'll do that. >> dana: apparent will i now at these shelters in chicago, at this one they are providing vaccines to people there. how quickly can you become protected from measles if you get a vaccine today?
