>> martha: we have not seen a rematch like this in more than 100 years. a former president runs against a current president. also today, our brand new fox power rankings show that the american electorate is quite depressed about it. we'll show you why that is the headline here. 72% say they're dissatisfied with the way things are going in the country. 60% view both candidates unfavorably and 20% said they would support a third-party candidate. former president trump has a lead in the battle to 270 electoral votes, which is what you need to win. moments ago, peter doocy pressed the white house about the president's willingness to debate. >> is president biden going to commit to a debate with donald trump? >> that's something for the campaign to speak to. >> well, we know when the debates will be. we know where they're going to be. is he going to go? >> you should speak to the campaign. >> in 2020, once it got down to one-on-one, joe biden said i can hardly wait to debate him. how about now? >> i'm going to sound like a broken record. you should reach out to the campaign. >> sounds like she's happy to have that answer to fall back on. joe concha is here, a fox news contributor. and arnie michigan, director of the fox business business desk and jessica tarlov, co host of "the five." great to have you here. first off, that exchange, jessica, will biden debate and should he? >> i hope so. i think yes. i think that is his impulse to want to do it. we're talking about this last night. the big new yorker interview feels like a bit of a turning of the page where he's saying i'm in charge now of my own destiny. you'll try to block me, sideline me when i'm talking to supporters or press people on the ropeline. no, i'm going to do this my way. and the flip side of it, obviously i'm a strong supporter of the administration and i hope he wins re-election by a lot but the american people deserve to see who the two candidates are doing their thing. that goes for joe biden and goes for donald trump. i hope that we see debates and it will be a fun evening. >> martha: really. we always look forward to it. always a great night. you know, i mean, people say oh, i heard some folks saying today that president trump didn't participate in the early debates in the primary process, which is true. of course we wish he had done that. he has always said i have to do the one when it's me and biden. >> i don't understand why the biden people are playing coy with this answer. if they really think they're going to get out of debating trump, they should -- it's insane. the position they should take is, look, we've always said we're going to participate in the presidential debates. they can attack trump for saying he would participate with the presidential commission. the notion that they can get away without debating is insane. >> martha: i don't think it will improve that six in ten number that are not happy with the pairing if the two of them are like grumpy old men. we're not going out anymore. i don't like it. joe, let's take a look at this from nate cone at the "new york times." he says on paper, biden should be the favorite. he's an incumbent with a strong economy. according to the polls, trump begins in the lead. over the last four months, he's led nearly every poll in michigan, nevada, arizona and georgia along with the states that he carried in 2020, he giving him 283 electoral votes. our power ranking was at 251. >> yes. donald trump has led since october in north carolina, georgia, arizona, nevada, wisconsin, pennsylvania and michigan. those are all states that outside of north carolina donald trump lost in 2020. so the fact that he's leading at this stage and the fact that he seems to have the wind at his back, i think donald trump to go back to the previous conversation absolutely wants to debate joe biden. if the biden team makes some sort of excuse they can't do it because perhaps joe biden is above being on the same stage as donald trump, you're forfeiting 80 million people watching at home. that's what debates -- the type of number that we get. we saw him skip that super bowl interview pregame. that game drew 125 million viewers. 40 million people were watching the pregame and he skipped that. a pretaped interview with nora o'donnell. you have to ask where is the president these days? he had one public event or not even a public event. one event in the last five days. he's not done a television interview with a news organization since october. you can't win by pleading the fifth. there's no covid to hide behind anymore. >> martha: state of the union tomorrow night. that's one of those big opportunities to reach people. i think people will want to hear from him, what he thinks about the border situation, for example. we know that immigration is the number 1 issue. we'll get to that in a second. what do you expect to hear from him tomorrow night and how does he reach out to black voters, hispanics, women. all of them trending in these polls away from him. >> in the statement that he released this morning when nikki haley bowed out and didn't endorse trump and said we're available to be wooed is setting the tone for what the state of the union will be. the campaign has heard the criticism that he hasn't lived up to what people thought he would be in terms of a unifier and he's going to go back to that. that's where his roots are. his been paying attention to the hot button issues in these primaries and caucuses. he knows that immigration is a big deal. you wouldn't have seen the support for the bipartisan border deal if he didn't hear that from folks like john fetterman and henry cuellar that are pushing him. you'll see an emphasis on the themes that they want to run on. they want to talk about the economy, not in terms of bidenomics but in specifics. prescription drug prices being lowers. you'll hear about a women's right to choose. tim kaine has the first woman conceived through ivf that is a major issue. talking about immigration as well, a lot of his achievements and the finish the job. i needed eight years to finish this. >> martha: let's take a look at this sound bite with regard to immigration. this was last night on the msnbc panel. they were laughing about the fact that immigration ranks as the number 1 issue in this state of virginia. watch this. >> if you look at some of these exit polls -- i live in virginia. immigration was the number 1 issue. i mean, again, these could change, in virginia. >> virginia does have a border with west virginia. very contested area. >> build a wall. >> what? >> story about a teenager that was assaulted in virginia by a migrant that was in the state illegally. joe, what does that reveal? >> a 14-year-old girl was raped. what that reveals is an elitist bubble. what shows that panelists that don't leave washington d.c. and speak to people in virginia, chicago or new york where all of these migrants are coming in and the budgets can't handle it. you can see in new york, cuts to sanitation and education and to police forces. this is a very real problem. it's a number 1 issue. you have the former white house press secretary laughing that it's a number 1 issue. talk about tone deaf. you just watched it. >> when you look ahead, everyone today is sort of the montra, it's all set. going to be trump versus biden. you have 18% that say they're looking for another candidate. any surprises ahead? clearly they're trying to clear everyone out of the room when he's staring around. >> it's what he's done the last two years. it is. i'm not going to answer questions. i hear them but i won't answer them because i was told not to. he says what we think is happening. he said i'm better off not talking, not doing anything trailing every battleground state and including three national polls just this past weekend. what he is saying, his people are saying it's worse if i speak. that's what you saw. because they stayed close up on his face. when i saw the description, the caption, i thought that something happened physically, like mitch mcconnell where he had that issue. it's not physical. that is a choice. it's a choice rather than saying, i want these answers. i just -- compare it to the person he's running against. that person said i don't need a press secretary for 1 1/2 years. he told stephanie grisham, i'm just going to take my own questions. he used to walk -- people got crazy. up and down, you, you, you. >> so free wheeling and he would answer every question. you know, he would go up and down, hearing every one perfectly. this is a little montage from how many times the president of the united states has told the american people that he is not allowed to answer questions from the press. watch. >> i'm not supposed to be answering all of these questions. >> i'm sorry. i'm going to get in trouble with staff. >> i'm following my orders here. staff, anybody -- >> will you meet mccarthy next week? >> jessica tarlov was here. she talked about the new yorker interview piece. she said it's clear in that piece, which i haven't read all of yet, that now joe biden is going to be the boss. he's going to do what he believes is right. so i would imagine these moments will disappear and he's going to start answering whatever questions he feels like answering. >> no more surrogates in the rose garden. he's going at it. we'll see. i didn't know this. mick jagger is the same age as president biden. mick jagger dancing around the stage in lycra. i don't want to see that but shows you i'm not against anyone 80. it's not his fault that he has issues in his back. but for decades, he had a springiness. an energy that was hard not to like. for better or for worse, he's more solemn. his voice is thin and clotted. in our conversation, his mind is unchanged. that's what they were doing. no one buys it. jon stewart didn't buy it. can we see that joe biden? you reason the clips. when she saw snl, can we see that joe biden? sooner or later if we didn't see that joe biden, i believe that donald trump's lead will lengthen. it will grow. the other issue that we have, and i think it's bad for the country, nothing about negative advertising. i understand it will be here forever. their win of winning is to make donald trump hitler, unelectable, a dictator, i don't know what will be left of the country when he tries to go for his next four years. people will take that personal, at least to 72 million that voted for him last time. >> martha: i think it's an example going too far. you don't need -- people are smart. they understand what's going on in the country. i think they went way too far with these legal challenges and these cases. look at people who have murdered several people and they have three or four indictments. he's got 91. it has increased his polling numbers. they better be careful with how they go about it. >> his cfo is in rikers island for miss recording the size of his penthouse. >> martha: he pleaded guilty in order to not have to testify at the stormy daniels case. so he's doing this partly out of loyalty. he's going back to prison again for another six months in his late 70s. it's stunning. >> it's unacceptable if you ask me. >> in new jersey, chris christie said when he was the ag, they had a rule, you didn't put anyone in prison over the age of 70. >> cops can get beat up by illegals and they get out on bail. >> martha: yes. so a georgia senate hearing committee hearing from the attorney that exposed an alleged affair with fani willis and nathan wade, the d.a. so the ag is investigating trump and his team. alina habba joins me next. >> you know what maybe the average american spends on a vacation? we were loading our suv when... crack! safelite came right to us, and we could see exactly when they'd arrive with a replacement we could trust. that's service the way we want it. >> singers: ♪ safelite repair, safelite replace. ♪ >> martha: the supreme court set to hear arguments on former president trump's claim of immunity. and that will happen on april 25. an appeals court ruled that he's not immune from prosecution in jack smith's election case. the former president said he did notice wrong. the trial is now on hold until we hear on the issue of immunity. this will be a major decision in all of this when that comes down between april and june likely after they do that hearing at the end of april. we'll be watching that very closely. a new showdown over the relationship between the prosecutors in former president trump's election interference case if georgia. state lawmakers questioning the lawyer who exposed the relationship about the timing and the vacations fani willis and nathan wade took together. alina habba is standing by. first to jonathan serrie reporting live on what happened today in atlanta. hi, jonathan. >> hi, martha. republican leaders of this georgia state senate committee saying they're trying to determine whether district attorney fani willis misused any public funds. their only witness, ashley merchant, the first defense attorney in the georgia election interference case to attempt to have willis disqualified from prosecuting it. mer chant said that they worked out a special agreement while the two were trialing together. >> there was a period of 15 or 16 days where he did not have a contract. they -- which also happened to be one of the times that they were out of town. so they reuped the contract nobody 15 and then it had a cap. the cap was significantly higher. >> martha: after the committee hearing, one senatener the democratic minority said that willis' fate should be determined by the courts, not legislative politics. >> that judge is going to make a decision in a couple weeks. that's the role that will be played out. we ought not to be doing that. >> that's where we stand after this committee meeting. back to you, martha. >> martha: thanks, jonathan. former president trump's attorney alina habba joins me from mar-a-largo. she was at the super tuesday celebration. looked like a big night last night. the president celebrating. he's got a lot of these legal cases still in the background, right? >> well, of course. that's all part of the plan and their plan for election interference. they can't beat him. the energy was so amazing last night, martha. he is really focused. you can just tell that he's ready to get back to business. the energy in the room said it all. no matter what they do, no matter all the garbage that they throw at him, he's determined and undeterred and he will continue to fight for the coupry to stop this madness that we're seeing with the legal law fare. >> martha: he's a resilient politician and figure of our times. he certainly has had every piece of the book thrown at him and still wants to be president of the united states. that's very clear. it's going to be fascinating to watch his campaign the next nine months as this unfolds. what did you make of this back and forth today as this republican committee in georgia listened to the evidence that will be ultimately decided by the judge, as i understand it, in terms of whether or notfani willis and nathan wade and the team will be thrown off of this georgia election case, alina? >> i tend to agree with the clip you played before. i think the judge has a determination to make. i think that the evidence has spoken pretty clearly. there's obviously some inconsistencies with testimony that have to be handled. there's many levels of issues. let's not talk about whether it's in congress, in a court but there's ethical issues that will be addressed. i'm happy to say i'm not involved with the mess that has been georgia. i will tell you this, she's made quite a mess for herself. i think it will be handled ethically and hopefully by the court. but there's no business bringing in people to prosecute and persecute somebody that is a political figure. to do so in such a manner with taxpayer dollars in any state is problematic. it is. it's diggs turning. that's the state of our country right now. >> martha: it's very interesting again watching the back and forth here. they put up the text message. ashley merchant had been in touch with nathan wade as she prepared for this case. she said do you think it started before she hired him? which is key. terrence bradley, that worked on nathan wade's divorce. she said absolutely. it started when she was a judge in south fulton. then they went back around on this about how many times he visited her condo during the time period when they say they had no romantic relationship and watch this. >> when i say frequent, do you think prior to november 21, 2022, you were at the condo ten times? >> no, sir. >> less than ten times? >> yes, sir. >> martha: let's play the part about the pings. >> so it's pinging from his house. he calls her when he gets there. then it goes silent for four or five hours. and then early in the morning hours, he starts pinging again driving back. he texts her when he gets home. >> this is before he gets hired in november of >> yes. >> martha: wow. she's very diligent with the details on all of this. you think this will be persuasive to the judge in georgia, alina? >> i hope so. i think that the judge has a tough determination to make. i think honestly never mind any of it. the perjury issue is something that concerns me with her. if that is the case, that is a concern. there's been too much inconsistencies. if they have forensic evidence that is clear, they can't deny that. facts are facts. he made a comment about referring them to ethics. that should happen no matter what. you can't play with taxpayer dollars while trying to go after a former president. that's the bottom line. you can't lie under oath, which is what happened. >> martha: before i let you go, any update on the hundreds of millions that the former president is due to pay in the new york case? there was a request to make it a smaller amount. where does that stand now? >> we're waiting on appeal obviously. the judge was recept ty to some of our arguments. we appeared before the appellate division last week. he obviously amended the order in terms of allowing the trump children and trump family to continue to operate their business and to get loans, which was a big step in the right direction. as i always said, this is going to be a long game. we knew we were not going to be successful. we lost before the trial started. we have to push and push and hopefully have our facts and case heard like it was last week and chip away at this. >> martha: what is your understanding when the rest of the money is due, alina? do you get nervous about going out there? you got the word perfectly. do you ever worry that you might forget words to the song? like a lot of people more famous than you have done? >> no. i don't get nervous. because i just feel really happy. i feel like i can do this in my mind. especially when the crowd cheers. they're just like woo! and that gets me going. especially at the duke game. at the beginning, they were cheering a lot. and then somebody after every one was cheering, they're like i want a selfie! and it inspired me. >> martha: you know what?
