a fox news alert. president biden and former president donald trump are both making trips down to our southern border today. >> steve: the former president is going to go to eagle pass, texas, as you can see right there at the bend of the rio grande, which is real hot spot with over 2,000 migrant apprehensions in the last five days. while joe biden is visiting an area with brownsville with only 46 apprehensions in the same time frame. >> brian: we have live team coverage lawrence is on the ground in brownsville ahead of the president's arrival. we begin with lucas tomlinson in washington as the democrats and republicans trade jabs. >> we have dueling visits to texas today and duling accusations and ventriclives being hurled across the aisle. as you mentioned steve, president biden and former president trump heading to texas today where there will be about five hours apart. trump will be in eagle pass where more than 2,000 migrants have crossed the border in recent days. biden going to the quieter city, brownsville, where 46 migrants have showed up in the past five days. here is california congressman robert garcia taking a swipe at republicans. >> his visit tomorrow is nothing more than a massive political stunt to try to get reelected. >> i wonder if you could speak to republican claims that biden's trip is also a political stunt. >> republicans have been screaming and yelling and complaining and begging the president to go to the border now for months. and so for any of them to now say it's political, i think, of course, is just totally another insane statement about by any republican. >> here is what it looked like on eagle pass on monday and here is karine jean-pierre white house yesterday. >> they are turning this into a political stunt by listening to donald trump and saying that they need to kill it. this is what they have been doing. and making it political. >> immigration a top issue among voters in 2024. texas governor greg abbott's decision to bus migrants to so-called sanctuary city brought this issue to the country's largest urban areas and a number of high profile crimes in recent days by illegal migrants bringing more attention to the issue, guys. >> steve: lucas tomlinson live in d.c. now let's go down to the very southern point of texas. and i bet you flew into, let's see, south padre island international airport, right, lawrence? or did you go brownsville? >> close, close. i'm flying out of there. i flew into mcallen. the reason why we are here, steve, is because, obviously, the president of the united states is going to be here today. the concerning thing is when you talk to residents here. they don't understand why he is coming now. the place that i'm at right now averages about 15 to 17 crossings a day. i mean, i was here a year ago when there was a surge here. that would have been the ideal time for the president to come. but, why he is coming now, when you have got eagle pass and, you know, i think it's important to know that in that area of eagle pass, greg abbott, because of his action with the border, the razor wire and shipping containers there it's down there and pushing the migrants back. right here, particularly, there is no action. there is nothing to see. maybe is he going to meet with some of the border agents, talk with some residents. i don't know. but, if you really want to get to the border crisis right now, maybe go to arizona. >> steve: yeah, because that's where the most action is right now. you did arrive early yesterday. you talked to some of the folks, riment? >> lawrence: yeah. yeah. so i talked with some of the residents there. interesting enough, a lot of the people there are hispanic. they're passionate. they are fired up. and they put into perspective why is the president coming now? here they are. >> why do you think joe biden has come here so late? >> nobody understands. why is he coming now? >> is he too late. >> i think it's great sphoiment disappointment to most of us who live and work here. >> lawrence: what do you think about him finally coming to the border? >> about time. >> lawrence: do you think is he actually going to fix the problem? >> i don't think by coming here is going to fix the problem. i'm not really expecting joe biden to do very much. you know, i think he -- i'm not sure if he is in his mess. >> capacity to do anything. >> he should have been here when it wars a real surge, a real crisis, when thousands were coming by at a time. he is coming in right now when he won't see anything. >> lawrence: who was better for the border, donald trump or joe biden? >> donald trump. all the way. >> mr. trump was far, far better. >> definitely donald trump. >> oh, everybody knows trump. >> without a doubt, donald trump. >> lawrence: guys, the reason why i asked the final question who is better for the border because the president claims that he didn't know that the former president was coming to the border. but that's been released for about two weeks. and i think everybody knows why is he coming on the same day. >> brian: probably going to get a tour. last time he had a german shepherds find drugs in a police car. i'm sure that was a learned moment for him. it's going to be a press conference. is he going to say, look, brownsville is fixed here. i could have fixed the whole border but republicans bailed on the bipartisan deal. this is about politics. they are probably going to wheel out a podium for him. what else can you expect? >> lawrence: brian, i hope someone in the press asks the current president, there is a wall behind me. this is not the donald trump wall. this is probably one of the walls that joe biden used to vote for. now all of a sudden he is not for barriers at the border. so the question to joe biden is what changed from when you were in the senate to now as president? >> ainsley: yeah. i mean, the reason brownsville is not seeing as much traffic is because of president trump's infrastructure and also greg abbott has really worked on that area. if you look at some of the numbers from ice. in fiscal year 2021, illegals on the non-detained docket, they soared from 3.7 million in '21 to 4.8 million in '22, fiscal year to nearly 6.2 million in fiscal year 23. the critics are right to accuse joe biden of making this a political stunt. this is his crisis. now, every city in the country has become a border city as a result. this looks very insincere. looks like he is just chasing trump down to the border. don't tell me he didn't know. he might not have known based on some of his mental acuity problems but his staff definitely knew. this was announced several weeks ago that donald trump was going. and you know where your political opponent is going. every moment of the day they know what his schedule is. >> brian: i know trump is going to see shelby park and see what the governor did as opposed to what the federal government is doing. that's the story. if you want to solve a problem. find outer why texas shut down that park. and what the results have been. that's somebody that solved a problem himself, and joe biden knows he can't take on the governor in illinois state judge disqualifying him for the march 19th primary, putting order on hold until tomorrow in anticipation of a likely appeal. >> ainsley: our next guest calls this political -- he calls it a political stunt. fox news legal analyst gregg jarrett joins us now. what's your reaction with this. what is happening with colorado and maine too. third state. >> well, the supreme court will dispense with that the oral argument walls three weeks ago today, so, you know, they will come out with their decision sometime soon. but this latest decision from what is essentially a low level circuit judge cook county, illinois. i read it. this is a political statement. it's a stunt. it is not a well-reasoned decision. thee relied almost entirely on the colorado decision, which was deeply flawed. and turned the meaning of the constitution on its head. it's obvious from the recent supreme court hearing that the high court will overturn colorado, will not disqualify trump from the ballot. even liberal justices scoffed at the idea that the 14th amendment applies. it doesn't. the office of the president was specifically excluded in the amendment. and declaring by fiat that trump is guilty of insurrection, when he hasn't even been charged or tried for that, that is an assault on the due process guaranteed by the 14th amendment. and, it would allow republicans to remove biden from the ballot. so, the illinois decision, which is barely literate, legally, isn't worth the paper on which it's written. >> steve: it comes at a perilous time because they have already started early voting in illinois. primary vote is march the 19th. she stated until friday. and, of course, trump will appeal. meanwhile, the trump campaign delighted that the supreme court has decided to review whether or not he can claim immunity from prosecution. gregg, it is a very narrow thing what they are going to consider. they're only going to consider whether and if so to what extent a former president enjoy presidential immunity for criminal prosecution conduct alleged to involve official acts during his tenure in office. this has never been ruled on before because, you know, no president has ever been up for criminal charges before. >> the decision to take the case obviously, steve, puts both federal trials brought by special counsel jack smith on hold it. likely means those trials will not happen before the presidential election. and the opinion is not going to be a quick one. the decision is historic. so, a late june ruling means all the pre-trial motions don't start until july. those are very, very time-consuming. as for the immunity issue itself, it's not an easy one, as you point out. four decades ago, in the nixon fitzgerald case, the high court ruled presidents do have absolute immunity from civil lawsuits. and they set out the parameters of when it applies. now the same question, of course, arises with criminal culpability. and donald trump does have a viable argument as long as he can show that his act action in challenging the election results were consistent with his duties to uphold the law. without some immunity, there would be a severe chilling effect on all future presidents in making decisions. >> brian: you know, the thing is, greg, there's a couple of things. one of the arguments his team put forward was let's say you want to get seal team 6 to assassinate your political opponent? could you do that if you had immunity? they were arguing that theory out like where could this go? is there a nuances there to if i'm acting on behalf of the country, that's on behalf, i guess, political gain. so if he is acting on behalf of the country, let's say taking down the wall, in come a bunch of criminals. i'm going to sue you, mile daughter got killed because you took down the wall or because you brought us into iraq without weapons of mass destruction. my kid lost his life. i'm going to sue you, mr. president, as opposed to some theory that he is going to go do something clearly against the law and that's assassinate a political opponent. >> you are absolutely right. the commander-in-chief is a unique position in our constitutional republic. presidents must have latitude and discretion to make decisions in the best interest of the nation to protect its national security. and if they ever now going to be second-guessed by worrying about whether they will be prosecuted criminally, after they leave office, you know, as i say that has a severe chilling effect, what it would result in, if a president doesn't have immunity, is not a commander-in-chief, but a committee of lawyers, which would have to vet every single decision a president makes and who in the world wants lawyers making the decision? >> steve: good point. thank you, mr. lawyer. gregg, thanks for getting up early today. lots to talk about. >> brian: the president did have another ruling. he wanted to get down locally. he has been fined 400-plus million dollars by the city for a business practices. we know the ridiculous argument there. he is on appeal. he said you got to put up $400 million. he said what about 100 million? the judge said no, i need $400 million. he has a few weeks to get that up. i don't know how he gets that up. >> steve: well, and there is another story about how does he raise the money? and, as it turns out, the truth social asset is worth something like $4 billion? >> brian: amazing, right? >> steve: the question is whether or not he could get his money out of that. he might just ask some rich people. >> ainsley: we will see. let's give you more headlines this morning. at least one person is dead. several others injured after a shooting overnight. this time in orlando. officers say several shots were fired before they arrived on the scene. it's not clear now what exactly led to the shooting. we're going to bring you updates on the developing story throughout the morning. also, to a fox weather alert. at least one person is dead as several out-of-control wildfires are tearing through more than a million acres across texas and oklahoma. thousands of residents were forced to evacuate their homes as the firefighters are working around the clock to protect the houses and businesses there. meanwhile, in the upper midwest, residents surveying damage after suspected tornadoes tore through their region. in dayton, ohio, a lot of damage at the wright-patt terson air force base, which is home to the national air force museum. we also have a fox news alert about hunter biden. he is testifying or did yesterday on capitol hill as part of a house impeachment inquiry against president biden. hunter's lawyer says, quote: he could not have been clearer that there was no time that he involved his father in any of his businesses now that hunter has put this partisan conspiracy to the lie that it is. on the record and under oath, this political charade should finally come to an end. all right. it's hearing very soon. florida's governor ron desantis expected to sign a bill clearing the way for the release of jeffrey epstein's grand jury records. epstein was investigated by palm beach county back in 2006 for allegedly sexually abusing young girls in his mansion. the bill would release limited grand jury testimony and is expected to take effect on july 1st. defense secretary lloyd austin will appear in front of the house armed services committee today on capitol hill. this is the first time is he going to face lawmakers publicly after he failed to notify the president and senior leaders when he entered the hospital for complications from his prostate cancer surgery earlier this year. hospital earlier this year but surgery the end of december. congressman cory mills will join us next hour with what he wants to hear from secretary austin. now, take a look at this wild video showing former ufc fire brendan schaub flipping his truck in off roading crash earlier this month. earlier on murder nor florida georgia nursing student laken riley will be held tomorrow. >> steve: police there say the illegal migrant charged in her killing prevented her from calling 911 and they will not release the audio. todd piro joins us with the very latest. todd? as if the details of this case could not get any worse they seem to right here. police revealing that laken riley tried to call 911 on the morning she was murdered. hosea stopped her from calling for help moments before dragging her body away into a wooded area on campus near the university of georgia. police confirmed the suspect panicked and bashed her skull when laken tried to fight back. as of enough to the 911 call will not be released like steve said because this is an ongoing investigation. ice records show ibarra illegally entered the u.s. through el paso in september of 2022. he was charged with child endangerment in new york city last august only to be released. georgia governor brian kemp says laken's murder was prevent being. >> you have a situation where this person is arrested in new york and released and then arrested again in georgia and released and nobody is checking them. you have someone a sanctuary city. apparently it has had sanctuary status since 2019. a lot of people didn't realize that and so there is this town hall yesterday where the mayor of the city of theansz, kelly girtz, got into a shouting match with people who showed up because essentially they said, okay, this migrant came here because it's a sanctuary city just like new york of course he is extraordinarily blaming donald trump for this. watch this caution against immigration and crime. the data suggests the two are not connected there has been no legislation from this government that has created sanctuary of the great state of atlanta. and he says they were a sanctuary city. >> brian: he claims he wasn't. but it was his rules aren't. having said that, he is on camera in 2019 with his hands on hispanic man saying that i'm going to guard against his rights. and for him to come out there and not just express regret and talk about what is he going to do for law enforcement on in, among the city centers reexamining sanctuary city status is new york coming up with laken's law, republicans, this guy was in new york and should have been stopped in new york when he broke the law. >> ainsley: tell you the history of what happened in that college town. uga is. this guy is a democrat, the mayor. in 2018, the sheriff's office said it would no longer enforce detainer inmates not accused of a crime. that policy appeared to change day later. then a year later in 2019, the city council passed a resolution welcoming all immigrants. a few years ago the city clarified in a memo, we are just expressing that we welcome people from all background and all nationalities policy says a detainer is issued no federal warrant or court order, the illegal immigrant northbound be held solely on ice redeigner. they will be released after 48 hours if the federal agents don't pick them up. congressman collins keeps say if a duck looks like a duck and walks like a duck and quacks like a duck it's a duck. this is speaker adrian adams says we will not change the law in new york. and she runs the show. >> ainsley: the mayor says that athens can't be a sanctuary city because the state banned it, which i assumed the governor band it and makes them prove that he are not breaking the law every single year. >> steve: we have the attorney general coming on to clarify. also, his daughter is a student, a freshman people dead wildfires tear through a million acres they have charred across texas and oklahoma. the so-called smokehouse creek fire is now the second largest fire in texas history. that wildfire was charged -- has charred more than 850,000 acres. that is bigger than the entire state of rhode island. charred let's check in with meteorologist adam klotz for our fox weather forecast. i see a lot of the red zone right there this is a massive wildfire and the weather obviously playing a huge part of that this is the wildfire that we ever talking about. 80 miles and only contained at 3%. the largest of those wildfires, 850,000 acres as you mentioned now active for three days, just taking up a huge swath of country. winds have really been driving. this as of right now, you see just there in amarillo area. winds are not that bad. only 5 or 6 miles per hour. >> we are expecting decent weather for firefighters today. winds won't be horribly high. you are seeing a little bit of moisture. before the day is over, get. this a little bit of all over the place. thursday, 48 degrees. we could be seeing snow coming down on this region today on those wildfires. but, by the time you get into a home just moments after he escaped police custody in philadelphia on monday. authorities also releasing this footage of the suspect running through a gas station with his hands cuffed behind his back. the marshals say they were closing in on the suspect, but he vanished after running down a train embankment. there's a $2,500 reward for information leading to his arrest. the white house press same town in louisiana is set to be deported after being sentenced on gun charges. local law enforcement including our next guest sounding the alarm on the challenges of fighting crime amid this migrant crisis. louisiana police chief keith conley joining us from kenner to explain. good morning. thank you very much for getting up early. >> good morning, thank you for having me. >> steve: i have been to kenner. this doesn't seem like that's normal behavior. people who live there. >> it is not. it's kind of shocking to the conscience of everybody in kenner. we are a safe community. we have a great law enforcement community down here. we all work together. >> our sole job should be patrolling our streets and enforcing traffic laws and making sure children get to school safely. whenever things like this happens it drains our resources. >> it's a financial drain to our budgets. we are spending taxpayer's money on things that come out of the blue. this individual came into the country from what the information we have received in october of 2023 and within a year he has committed two of the most heinous crimes we have seen in the city in a while. the aggravated rape, a first degree rape of a 14-year-old minor, and then he robs a 62-year-old gentleman in his front yard and stabs him in the face and the neck. so, you know, we are glad he is off the streets but, due to the lack of resources that we have, local law enforcement, we don't have the ability to certain federal data bases to track people to keep tabs on how they move through the system, the justice system. it puts us at a disadvantage. >> steve: kenner is not a sanctuary city. you cooperate with the feds. you cooperate with ice, when you have to and when it's necessary. but one of the problems that you and other chiefs of police across the country are facing is you have got this migrant surge and i know one of the problems facing you is the lack of reliable i.d. makes it hard to keep track of who these people are. they are going by aliases. did we arrest this guy a alread, right? >> that's absolutely true. we have to depend on our federal partners to identify these people. they use different ids, different names. counterfeit license plates. counterfeit registrations. it is hard to identify them we take a stance here in kenner where if you don't have a driver's license and operating a motor vehicle you have to go to jail to be process sod we can at least start some kind of history on these individuals. >> steve: seems to you if they are not in this country legally you shouldn't have to deal with them unfortunately you do. >> that's the most frustrating part. you know, we try to do our best in our community to keep our community safe. and we would like to put our resources to better use towards that purpose. but, you know, now, with the influx of the immigrants coming in, illegally, since we have no borders, essentially, you know, it is another challenge to law
