rachel: what is she shooting out of there? jee welcome back, everybody. welcome back, everybody, back to "fox & friends." we're in our fourth and final hour. we're looking at abby hornacek in boulder looking at usc playing colorado, and she's got a t-shirt cannon, a t-shirt gun. she's going to fire a t-shirt out. and i'm telling you, they have been there all morning long which is pretty early for them, and they are excited. the crowd's gotten bigger, i'd like to say moring sober, but i don't know. abby, what's going on? >> reporter: i'm seeing a lot of sides of usc that i do not like. but these fans are so nice, they're so excited. where is all of this energy coming from? >> we've been up -- >> long night! we're ready! it's game day, baby. we're so good. >> reporter: their eyes are super wide, the ones who didn't go to bed. [cheers and applause] what are you most excited about many. >> i'm most excite for the energy, the game, everything. the hype is great. >> [inaudible] we're going to get the w! [cheers and applause] >> reporter: what do you have to say to coach deion sanders in. >> we're gonna win. 100% today. >> reporter: are there any usc fans? you, come here. come here. i found some s -- usc fans, you guys. come a little closer, you are in a sea of colorado fans, and you are brave to wear the usc trojans. >> all i have to say is get ready -- [inaudible] [inaudible conversations] [background sounds] >> they know the ultimate outcome of this game. it's all good. they're here to support, they know the outcome. >> reporter: they do know the outcome because, you know, usc is undefeated. colorado's coming off a tough loss against oregon so so, guys, we'll see what happens. i did say i would stay neutral. i'm not doing a good job, and i apologize for that. go, trojans. [laughter] rachel: thanks, abby. joey: i love that guy came with an agenda, give the heisman back, reggie. rachel: does it make you pine for your college days, when you see all those -- president not one bit. [laughter] i appreciate the enthusiasm, but i would have rather heard morgan wallen, whiskey glasses. they were playing that song, and i was like, kids, quiet. morgan wallen -- rachel: you are getting old. you're getting old. pete: i am old. rachel: kids, you're too loud. pipe down. [laughter] joey: you talk about reminiscing of college days, i went to georgetown which was great for me, a good education, but we had larger crowds for sandra fluking when we did -- than we did football. rachel: ray that was a blast from the if past. i went to asu, so that's very familiar, what i just saw. la a. [laughter] pete: speaking of georgetown and d.c., let's turn to washington where less than 15 hours away from a government shutdown. joey: the house will reconvene in a half an hour to try to strike a last minute deal after failing to pass a very conservative stopgap spending plan yesterday. rachel: aishah hasnie joins us live. she is on capitol hill with the latest. aishah? >> reporter: good morning to you guys. the house actually reconvenes at 10:00, and house speaker kevin mccarthy not here yet. i'm told he will be walking in momentarily and will walk right into a gop conference meeting at 9:30. the entire conference will huddle together and try and figure out what in the heck they are going to do today as we are getting closer and closer to a government shutdown. there's supposed to be votes today, we just done know what they're going to vote on and when they're going to vote on it. speaker mccarthy told reporters yesterday that he does think that that he can still avert a government shutdown despite the fact that these 21 house republicans yesterday took down an attempt to pass a one-month stopgap bill that included cuts in spending and border security measures. so after huddling with his conference last night, it appears that we might see mccarthy try to bring up a two week clean stopgap bill to the floor instead. this one will not have any ukraine funding. meanwhile, he was telling reporters after the meeting that the house will keep on voting on the 2024 budget, those appropriations bills, and he's going to find a way to avoid a government shutdown. >> i think if we had a clean one without ukraine on it, we could probably be able to move that through. i think if the senate puts ukraine on there and focuses ukraine over america, i think that could cause real problems. >> reporter: the senate will be taking a procedural vote later today on its own 45-day clean stopgap bill. that will include ukraine funding. meanwhile, over on the other side of pennsylvania avenue the white house saying the president bears no responsibility for a shutdown. watch this. >> spending is at the heart of this impasse, so does the president bear any responsibility for a shutdown? >> absolutely not. they've taken the smallest amount of spending, do nothing about taxes for the rich, and they want to cut the smallest amount of spending. that's not serious fiscal conversation. >> reporter: now, guys, in past years, you know, we might have seen a speaker john boehner reach out to democrats for help in trying to avert a government shutdown. so far speaker mccarthy has been trying to avoid that. he does not want to work with democrats whatsoever. but we are watching some members talk with each other about perhaps using a different proceed e your. it's called a discharge petition to the basically force the speaker to put a particular bill on the floor giving him some cover in case republicans want to work with democrats and fund the government. it would protect him. finish guys? pete: aishah, thank you. rachel: thank you, aishah. joey: it seems complicated. there are certain members in fact caucus that already had this date circled on the calendar when they had the speaker -- and they knew this was a place they could corner him. there are other members who have issues with how we're spending money, and this is their opportunity to do something about it. rachel: yeah. i think there's some very sun sere people who are concerned not just about the $33 trillion in debt and all the, you know, outrageous amount of money that our government spends on a lot of stuff we don't care about, but also on the issue of ukraine which is absolutely dividing the republican party. i believe 101 members now voting, you know, to continue funding ukraine, 117 saying, no, we don't want to, want to separate that out and vote on this separately. so that's definitely happening. the dirty little secret, pete, is that in the end even the people that get sent home because supposedly the government's shut down, they'll get paid anyway. pete: they'll get back pay. it's such a dust cloud, and the democrats will, of course, blame the republicans no matter what. part of me says shut it down. i'd love to shut down half the government if i could, but i understand the people who are affected who have no -- who shouldn't be, right? and congress is the one who should be defunded, frankly. all the people who can't get it done shouldn't receive hair salaries. practically speaking, it is a conservative bill that they could -- not conservative, it's all too big. it's the best they could probably get, pass through because they still have to negotiate with the senate which is never going to agree -- joey: exactly. mccarthy needs, he's either going to need senate democrats to come in and bail him out or house democrats bail him out. if it's the house democrat, that's where -- pete: the motion to vacate. joey: and i just want to point out, there are a lot of people working on this, honestly. this fight was circled back when they did the budget fight. and they've had this entire time to decide what are we going to stand on. when it comes to appropriations and funding time, what are we going to make an issue. and then we see names popping up of congressmen and women that are voting against the bill that you haven't really voiced concerns. nancy mace voting against this bill. and it makes you wonder, are the dynamics shifting? what is our congress made up of now? where is the republican caucus? i think there's a spirit of independence among conservatives that liberals don't have, and that's why nancy pelosi never had these problems because democrats will never, ever let principle take victory away, but republicans -- pete: because their goal is always more. rachel: yeah. i'd like to see the country debate on ukraine. if this is something that helps bring that issue forward, because i think it's a big issue that has huge implications. it's not just a money issue, it has a lot of geopolitical implications, china, russia coming together, all this kind of stuff that are a result of that war and really pressuring the people in charge to bring about a peace if agreement. i think there's a lot of americans that want that. we should have that debate. we had a little bit on the stagn when my husband was in congress, there was, you know, a famous shutdown. and that one was, ted cruz was behind some of that. pete: yeah. rachel: and just watch. if that happens, if the government shuts down, there's a really interesting back story, and we've talked about it off set. when the members are stuck in d.c., the spouses get a word on the shutdown. [laughter] there is a, you know, these are human beings with families -- joey: yes, staff members that are just there working 24/7. rachel: exactly. and i can remember that shutdown going, honey, just make it happen, get home. [laughter] pete: the countdown clock continues. let's move to california because all eyes are on governor gavin newsom. senator feinstein passed at the age of 900 which means the -- can 90 which means the governor of california has the opportunity to temporarily appoint the next senator for california which will be a democrat, and in 2021 gavin newsom promised to to appoint a black woman to that position, so that narrows down who that might be. plenty of speculation this morning, plenty of people -- adam shift's -- ad adam schiff's picked, because he wanted it -- rachel: he's not a black woman. pete: rachel floated meghan markle. what about kamala harris? then joe doesn't make it, then gavin's the nominee. i'm just saying -- rachel: is that farfetched? pete: it is very. [laughter] rachel: more farfetched than the princess of montecito who's clearly been lobbying and eyeing this for a while? joey: what i like best about that plan is gavin says whoever he appoints has a promise to to not run for the seat, so that would effectively terminate kamala harris -- pete: is that that part of what a he said e? joey: what he said is whoever he put in there had to be someone who isn't looking to -- pete: once you're in, can't you just run for it? joey: it's not up to him. when they make deals like that, there's ways. pete: welcome to the shifting sands of 20 if, because -- 2023, because two things are true at once. joe, they know, can't be the candidate, and donald trump's not running ahead. the status quo has to change, and another thing is changing on the democrat side. according to one web site, robert f. kennedy jr. is planning to announce, he's got a big announcement coming, they believe it will be for an independent run. we though he's been shunned out of the democratic process. they won't debate, they won't give him secret service protection, as you pointed out, rachel. so now he put out a video, he didn't say what it's about, but it gives you a sense october 9th rfk might be going independent. watch this. >> i'm going to be in philadelphia on october 9th to make a major announcement. i'm not going to tell you right now exactly what that announcement will be. i can say though that if you've been waiting to come to one of my public events, this will be the one to come to. pete: shake things up bigtime. rachel: it definitely will. and, you know, the democrats only have themselves to blame for him going third party because they've really not allowed him to participate in any real way in this primary. they won't debate, as we mentioned, and i think it really got personal when they, he's had threats against him, and they refused to give him, joe biden refuses to give him secret service protection which is totally unprecedented, you know? candidates with far less prominence and certainly none of the back history, his father and his uncle being assassinated, have gotten secret service protection. it's actually, it's pretty cruel and awful. and so i think he said, you know what? i have something to say with that almost 20% of the democrat vote in that primary, and so he's going to strike out asen dependent -- as independent. it'll be interesting to see how this shakes things up. joey: that's going to be on october 9th. i wonder if on october 8th we hear there's going to be a democrat debate? we'll know then if they're worried about it. pete: yeah. on its face, it looks like it takes from joe biden. but he's been an interesting cross-candidate -- rachel: sure has. pete: anti-establishment. so those initial polls will give us a sense after that of who he's pulling from and how it shapes up in battleground states. joey: this morning a lady whose family is from ukraine, she cares about funding for ukraine more, he said as an anti-war person he does not care to do that, but she'd still look at voting for him because where he was on vaccine and covid. this might be an election where people have issues that pull them in different directions, and they have to decide when of those -- which of those issues matter most because we're going to have a gambit of characters that really kind of cross each other's path -- rachel: and you brought up covid. it's interesting, the opening that covid has given to rfk jr., i don't think prior to basically everything we learned during covid about big pharma, about vaccines, about the lies that come from if the public health officials all the time, i don't think there was an opening for somebody like rf fk jr., and he's sort of been mainstreamedded really because so many soft of the lies of our government have been revealed. pete: and think about it, we're talking about a shutdown in washington, yet our government was able to shut people and businesses down for months and years. rachel: that's right. excellent point. joey: and, you know, understanding that president trump had the very beginning of it and before we had any information whatsoever, there's still images of him on, standing there with dr. fauci and dr. birx. ron desantis doesn't have that, and rfk jr. doesn't have that. ron desantis has failed to use that in any way as a point of leverage. rfk jr. hasn't used it against trump, but he's used it as a platform. when you become a third party candidate, maybe that is a way of slacking off votes. pete: a lot of us didn't know what we didn't know -- joey: none of us signed trillions of dollars of spendin- pete: well, and ron desantis gave talking points to joe biden. [laughter] what he said at the debate last time. so donald trump was yesterday at california gop, talked a little bit about gavin newsom who has a pick to the make and also joe biden. watch this. >> gavin has become crooked joe biden's top surrogate, i think, because he doesn't think biden's going to make it. that's why he's doing it. he doesn't think he's going to make it, and it won't be him so easy. he's going to have a big fight. some people think biden's going to make it. does anybody think he's going to make it to the starting gate? >> no! >> i mean, the guy can't find his way off of a stage. i've never seen this stupid stage before, right? [laughter] i've never seen it. but if i walk left, there's a stair -- [laughter] and if i walk right, there's a stair. [applause] and this guy gets up -- where am i? [laughter] [cheers and applause] where the hell am i? where am i? nah, he's terrible. terrible. [laughter] rachel: he's very funny, and he gets off script and says stuff like this, but he brings up a point that we all know is true. and it seems like he respects gavin newsom a lot more than joe biden. pete: and it seems mutual in that sense. but i had a chance to talk with gavin newsom, he pointed to the loyalty he has for biden as to opposed to the loyalty some in the republican party have been unwilling to show donald trump as they indict him 91 times and try to take the name off of trump tower. and i think that's why you've seen trump's numbers since the last debate up 5 points. no one benefited from it at all. joey: we call it off script or, i don't know that it's off script as much as genuine, authentic honesty. rachel: that's who he is. joey: he knew coming there the he was going to the talk about that probably. it just means unscripted, and all we saw on that stage were scripted talking points. i pointed out earlier, i have nothing against tim scott, but there was a moment when he just blurt out some tagline that didn't even make sense for the argument that was happening. and it really just became -- when they start yelling at each other, yelling taglines and talking points, hi mama was poor and my daddy works hard, that's what campaign candidates do. that's not what donald trump does. and until someone emerges that can speak to americans and connect with them the i way he just did making fun of bind, i don't see how anyone can beat him. pete: no one's going to. rachel: there are pre-trump candidates and post-trump candidates, and maybe vivek ramaswamy cams closer to that -- comes closer to that post-trump candidate, but still he doesn't have that thing that donald trump has. and it was definitely apparent on the stage. but funny moments, and gavin newsom, by the way, similar in some ways. he's able to feel comfortable -- pete: political to his core. rachel: political to his core but comfortable in his skin. pete: will benefit him, in doubt on that one. rachel: yeah. we're getting ready, pete. all right. we're going to get ready for your headlines, is and they start with a fox news alert. the u.s. central command confirming they conducted a successful helicopter raid in northern syria on september 28th capturing an isis facilitator. defense officials say no civilian were injured or killed during this operation. police now saying multiple people are dead in southern illinois after a tanker truck carrying ammonia overturned on a highway overnight. an evacuation order was ordered for all residents in the area due to the dangerous chemical leak. photos of the emergency staging ground show officials awaiting clearance to investigate as hazmat crews mop up the spill. hope is rising in a small kentucky town nearly two years after the deadliest and longest track this state history. 16 families from mayfield who lost their homes just weeks before christmas received keys to brand new homes yesterday, all thanks to samaritan's purse. >> not only thank god, but to dedicate this property, these houses and you, these families that will be living here, dedicate you to god and his glory. rachel: the fully-furnishedded homes are part of a new subdivision called new hope acres. the families only have to pay for home insurance and property taxes. i love samaritan's purse. they're always doing good stuff. buffalo bills' star josh allen showing off a new way to drink pepsi. >> how to buffalo your pepsi. order buffalo wings and pepsi, ten two, and here's the key, other extra buffalo sauce. mix with celery. step four, enjoy your new favorite drink. rachel: and we have pepsi and hot sauce for joey -- pete: going to have to report back. (how do you feel about that?) pretty sad. i posted it to show that kenny's not always happy. within 24 hours people had donated over $5,000. no, you're kidding. (none of this would've happened without tiktok.) it's funny how travel costs money yet makes us richer... and how our most important things really aren't things, like our memories. this is what makes life, life. yet how much of life are we willing to miss out on? because even mild hearing loss doubles our risk of dementia. yes, dementia. good hearing health can help you stay engaged and keep your brain younger. hear well and stay vital. get a hearing health check every year. >> a clark county grand jury has indicted duane keith davis with one count of open murder with use of a deadly weapon with a gang enhancement. davis will appear in court in the next few days or so for a hearing to determine his custody status and to set a jury trial date. pete: one of the last remaining witnesses of rapper tupac shakur's 1996 murder has been indicted and charged for the infamous slaying. the rapper was only 25 when he was killed in a drive-by shooting in las vegas are. our next guest with was the first officer on the scene who heard tupac's last words and joins us now to the share his thoughts on the developments, lieutenant chris carroll. lieutenant the, thanks for being here. you have literally been on this case from the start. did you think they would ever be able to find the person to indict, and what do you make of where we are? >> well, i'm happy that we do have an indictment, and it's good to see that things are moving forward, you know? for many years i, probably along with most people, never thought we'd see any kind of arrest or trial come forward. but, you know, new developments have happened. it's unusual for a case to go if to trial 27 the years later. we'll see if there's going to be a trial. it seems to be heading in that direction, but i'm glad to see that things are moving forward and and there is progress. pete: do you have a sense of what additional evidence -- i mean, i know they showed the tape of a fight that occurred or hours earlier where, what is his name, duane davis' relative was involved in that -- >> right. pete: but when they did the search, are you aware of things they'll be able to use in court? >> well, first of all, it wasn't keithy d who was involved -- pete: it was his nephew, right? >> correct. who later was the trigger man mt. murder. so he played a role at. as far as new evidence, you know, there may be some things that the police have that they've not shown us yet or none of us are aware of, and we'll see that should trial take place. but i think what has happened that has changed the game is davis himself has gone on multiple media outlets and openly talked about his active role in the murder. he's done it again and again, and and, you know, it gets to a point how long is the police department and the d.a.'s office and society in general suppose weed to sit by and do nothing -- supposed to the sit by and do nothing while this guy openly confesses to playing an active role in a murder? pete: interesting. so he's almost implicated himself. the fact that it was his nephew who was in this fight probably shines a light at his involvement potentially, and now he's done things since -- did he think he was, he would never be charged, that at this point he was beyond reproach? >> i gotta think that he thought he would never be charged. and i remember when he first started talking about five years ago, he came out and said he had cancer, and this was a death bed type of confession sort of a thing. and then that just kind of went away. and that hasn't been with brought up so much lately, but, you know, it's five or six years later. clearly, he was not on on his death bed. and i, you know, this is a guy who's talked and talked, and now he's got himself in a position where he's going to have to answer for it. pete: well, anytime we get justice, it's a good thing because we look around these day, and we see a lot of justice not being served. in this case, it might just be even though it's so many years later. lieutenant chris carroll, thank you for your time. >> my pleasure. pete: still ahead, the white house tried to crack down on hunting and arch erie. really? -- ashley. but -- archery. we'll talk to two veterans how they're using hunting to help our nation's heroses. but first, back to boulder, colorado, where abby hornacek is ahead of the big game on fox. >> reporter: coming up, i am talking to the legendary matt leinart. finally, another trojan, so i'm going to talk to him, and he's going to toss it to break. coming up on fox and friends. ♪ ♪ knows you want the best quality products for the best price. and when you save more on the things you need, you can get more of the things you want. that's why if you find the same product for less, we'll match it. shop now with the confidence of our lowest price guarantee. so many hotels... [cheers and applause] pete: we are getting closer to kickoff in boulder. joey: that's where abby hornacek is ahead of colorado versus usc -- rachel: and she's joined by heisman trophy winner matt leinart. that's right. matt, abby, how's it going? >> reporter: it is going great thousand that i have a trojan next to me. it has been rough all morning long here, matt. >> look, we're getting booed right now. right on! if -- [background sounds] >> reporter: we've got a few trojan fans -- >> there's not very many of us. >> reporter: no, there aren't. obviously, a lot of people's eyes are going to be on the quarterback, both in the heisman conversation. you have one of those trophies, so what goes into that? what's special about them this year? >> gosh,ing they are so good. trawl, when you look -- first of all, he was doing it at jackson state, but he's a terrific player. we've had a chance to coffer him multiple time, we feel like we're living many boulderer, but he's having a great year, and he's going to be a tremendous player at this level and the next level. caleb williams, he's the reigning heisman trophy winner, he's the great player -- best player or in college football. he's having another great season. the quarterback position is the most important in football, and both of those guys want a win today. t going to be exciting to watch. >> reporter: it definitely is. another storyline, obviously, is deion sanders. i think the cheapest ticket for this game is around $200, the most ebbs expensive about $1700. talk to me more about deion sanders. what about him sets him apart in the college -- >> it's truly the coach prime effect deion sanders is one of one. he is a unique individual. he's been like that since he played, and i've kind of known him even before all of this when he was doing tv stuff. he is genuine, he is authentic. everything you see or hear, it is who he is. and he can speak to the kids, he can motivate the kids, he can inspire or the kids. obviously, or he has the credentials and the credibility being a half of faller, one of the best players to -- famer, one of the best players to to play the game, and his impact is felt here. you talk about the money he's brought in, merchandise, ticket sales but also, like, recruiting. it actually reminds me when i was at usc back in the day when even wanted to the come watch with us play. he's got celebrities and musicians and actors and everybody wants to see coach prime. and that that's the effect he's had. it's the biggest story in college football. i've said this, it doesn't really matter how many games they win this year, it's already worked. the experiment has worked, the effect has worked. he's going to put colorado on the map now and in the future. >> reporter: yeah. well, you said people are out here to watch him, it's we'ved by the amount of people -- it's evidenced by the amount of people who are here now, been here since one in the morning. [applause] >> you said he did everything right. pete: a recent abc news poll of the republican primary race shows desantis polling at 15%. 40 points behind donald trump. rachel: wow. you could add up all of the people who were on the debate stage this week for the fox business debate, and they still don't add up to donald trump. they're still behind by 20 points. pete: all right. girl scout troops will be feeling the bite of inflation next cookie season. a single box of cookies will cost you as a much as $6. rachel: what in. pete: seems cheap to me compared to everything else it's up from $5 last year. this is due to increased cost of ingreened -- ingredients and manufacturing. i paid $18 for a breakfast sap witch yesterday. -- sandwich. rachel: that's insane. i used to sell these cookies for $2 a box. joey: when you grow up in the south, you're not learning skills, you just live, so we don't really do that. is it a good organization? rachel: it was at one time. pete: it was. rachel: just like everything else, it changed. thousand i wouldn't let my kids in it, but whatever -- joey: i get keebler at the grocery store, call it a day. rachel: yeah. they're rich the same. [laughter] pete: rachel, i know you're fired up about this story because the biden administration's going for another one of the appliances in your house. rachel: yeah. it's the war on families, the war on appliances. energy secretary jennifer granholm said at the direction of congress, department of energy is continuing to review and finalize energy standards for household appliances such as residential furnaces to lower costs for working families by reducing energy use and slashing harmful pollutants in homeses across the nation. they went after your fridge, your dryer, your washer, your dishwasher which really made me mad. thousand they're going after -- now they're going after gas furnaces. they have plans for more stuff, they're going to go after ceiling fans, dehumidifiers, also after the thermostat in your home. they want to control everything and look at all the problems in this country, guys. and nobody wants this from the government. this is not the role of the government, to tell you what kind of appliance you have. pete: well, the government said it is our role, and 110 times just in 2022 alone they're cracking down on household appliances. joey, i thought you made a great point in an earlier hour that even though these are being announced, they won't take effect for years, we think -- joey: yeah, it's, i don't fully understand the process. i read the article earlier because i found this interesting. i think they have a 12-month period before they have to decide what the policies will be, and so you've got 12 months, they make that decision. it's 2028 before they go into effect. those two timelines line up with the election, and it makes me feel like they're doing this as a way to keep that green new deal enclave of people tied to the party, but they know if they went all in on it, they would probably lose in a land slide. rachel: do you know who else it hurts? not just consumers who don't want these appliances that don't actually work, clean your clothes or wash your dishes, it also hurts our manufacturers who can't predict what's going to come next. they also have to go back and and redo what they do. joey: these people who go through storms and lose power for five days. you know what?
