how do they get brand new mope heads and motorcycles? i'm told by authorities part of this is the migrants deliver food, some deliver weed, and some deliver other migrants all over town. i spoke to some of the locals here about the impact of having this migrant shelter in the middle of manhattan is 46th street and madison and how it's affected their lives and their businesses. >> you are right next door to the roosevelt hotel. what impact has this had for your business, traffic et cetera? >> laura: pretty like laissez-faire the chinese are going to come and commit espionage. i lived in the former soviet union for a little while when i was a student and we didn't have the same openness with the former soviet union. it ended up working out well for us in the end elbridge so i actually have a different view of this that we shouldn't be inviting the foxes into the hen house. this is the hen house. these are military facilities. i agree with isaac in part we don't want to turn into a closed society and replicate what the. there are advantages military rised top down systems like the people's republic have. in order to protect our open society, we need to be tough and we need to protect the secrets that are critical for our security and, of course, more than anything else is our missiles facilities, submarine bases and so forth. we can't have foreign nationals. particularly foreign nationals from hostile countries poking around there. >> laura: isaac, do you think we should have more than 350,000 chinese students in the united states which is what we have currently? should we go for a half million or maybe a million? bring in more? >> it's a fascinating questions what are the odds? i think we should have more international students from other parts of the world, india is very under represented. vietnam, other countries. i think it's sad that we can't go and study china anymore regardless what you have think about china and the future of the communist party knowing your enemy or knowing your friend, however you see it is incredibly important. there is a major problem chinese students and espionage. mostly spying on other chinese students. glad you are bringing these issues is up. i don't mean to skirt the question. it's hard to know if there should be more or fewer i think a more honest reckoning. >> laura: here's the problem we have is that there is no rest reciprocity. a smattering of american students studying in china they are moving about unsurveilled. we aren't allowed to buy big tracks of land near military bases in china. they have a different view. and given what china has declared, its intentions for the rest of the century and beyond, why should we allow china to be buying up land near military bases? >> i don't think it does. you know, there are academics that have thought about this seriously and have supported this theory. i think it's the most dangerous theory that has emerged in decades. i think it's entirely unsupported by the text and the history of the 14th amendment. this provision was written after the civil war of an actual rebellion where hundreds of thousands of people died. there was an army on the other side. they had their own foreign policy. that's a rebellion. now, that doesn't necessarily mean that it can't be used for anything that isn't of that magnitude, but it is notable that trump has not been charged even with incitement, let alone rebellion or insurrection. yet, they say that this doesn't even require an act of congress that any judge can simply announce that he was supporting an insurrection and that he, therefore, disqualified and voters will not get the choice of whether to vote for him or not. that's what makes this so dangerous. i don't think this will withstand review. they could end up getting a couple of judges to go with them. but, in the long run, i think it will be rejected. that's why i'm eager for them to take it to court so we could finally put this on the road and see if they can take -- you know, get this off the ground. i don't think it will. >> laura: i can imagine what justice alito and a few of the others would say about this. i mean, talk about anti-democratic. this is the ultimate anti-democratic move that you could think about. like it doesn't matter what the people want. whoever the nominee is, if they want trump, if it wasn't trump, you know, desantis would be, you know, they try to charge him with kidnapping the migrants and sending them to, you know, massachusetts or, you know, california. i mean, you can see that this would -- could go in a lot of different directions, none of them good. >> no, i mean, this is comforting tale to tell liberal children at night so they can sleep restfully, you know, donald trump will not be on the ballot. but he will be on the ballot. the thing is this thing was written after the vice president of the confederacy showed up in congress to retake his oath. and people were just a bit peeved about that. because he had taken that oath before we have all have disagreement what january 6th was. it was a horrible day. a desis he scration of our constitutional system. in my view. and in the view of a majority of people polled, it was a protest that became riot. i don't believe it was technically a insurrection. should we have a system where any judge can just takes a riot like that and say well, in my view it was an insurrection you aided and abetted it by not responding fast enough using rhetoric that was inflammatory. that is a very dangerous theory and it would be replicated over and over again if we allow it to be accepted. >> laura: to that point, jonathan, arizona's secretary of state let slip what an important detail about the broader implications of this 1st amendment strategy. watch this. >> section 36 the 14th amendment is a radical and sweeping proposition. this isn't just about one person and one office. >> um-huh. >> this is about everyone who is running for any office in the united states of america. >> laura: so, look, if they can use this against trump, what stops them from finding that someone else supported, you know, refresh your recollection -- insurrection that wasn't an insurrection? so you can see where this would continue to leapfrog against other potential races. >> that's right. and the ambiguity within this theory is quite maddening. if trump had asked people to come back an hour earlier, would that have been not an insurrection? if he had mentioned go there peacefully three more times, would that have made the difference? we need a bright line rule. raskin and democrats tried to stop the certification 2016. there were violent riots in washington, d.c. against his inauguration. they had no grounds for that there were no grounds in earliey stenks fights by democrats. does that mean they were involved in some rebellion or insurrection. no it doesn't. we have to some v. some type of bright line rule that guarantees that the voters can make on these questions i'm not saying people can read this as insurrection as opposed to a riot. you have to ask yourself is this what you want replicated for the future? i know there was a facebook reference and juror 630. i'm devouring all this information but tell us. >> martha: yeah, we always knew that dick hoorpt and jim griffin were going to appeal this case, laura, they said that as soon as it was over. we thought it would be along the lines of the judge allowing all these financial improprieties to be part of this murder case. but what we got today was something completely different. it was based on becky hill's book. she released a book of her inside story of this case. she really became kind of a character in this whole case and the narrative of it. so she released this book and it talked a lot about what happened behind the scenes. and that gave harpootlian and griffin an open door so they started going through that door based on things that she said, like this, for example. we all remember, laura, when they went to the scene of the crime right before they started deliberating. she says when all of us at the -- from the courthouse, law enforcement or the jury went to moselle, we had an epiphany and we shared our thoughts with our eyes. at that moment, any of us standing there knew, i knew and they knew that alex was guilty. okay. so she is talking about communication between the jurors. there is two jurors who say that -- who told harpootlian and griffin they knocked on every jurors' doors two of them indicated that she indicated to them don't be fooled by alec murdaugh, she also indicated to them according to their sworn testimony, look, this isn't going to take long. and then they also say that she wouldn't allow them to take smoke breaks during deliberations that they couldn't smoke until they were done. now, this is their side of the story. we'll see what about when we hear the other side of the story. it could be very, very different. this is what we got today from the defense attorneys, laura. >> laura: isn't there is a claim, also, that a juror was dismissed for of incorrect grounds?
