the white house has stated shokin was not investigating burisma holdings when he was fired, and he says he was, and a list of special attention due to the board member being the vice president's son. he joined the board in 2014 and 2 2015 then vice president biden traveled to ukraine for an anti-corruption message. and a year later, looking at shokin saying he was the corrupt one. he pressures the devon archer and others. >> you heard devon archer, that brings us to him, hunter biden's former business partner also served on the burisma board. in a redacted state department email obtained through the freedom of information act shows archer met with someone named s less than four weeks before shokin was fired. they say it's a reference to then secretary of state john kerry. of course it's unclear if the two discussed burisma at the meeting but the timeline is tricky and we will hear if the white house has any response to that today. back to you. >> sandra: we will indeed, the briefing should be underway any moment now. alex, thank you. >> john: bring in leo terrell, civil rights attorney and fox news contributor. can you fathom any reason why hunter biden's former business partner, devon archer, would be meeting with the secretary of state just weeks before viktor shokin was fired? >> nothing that would be normal or regular. i could see something sinister and criminal. john, when you look at the totality. as a lawyer for 30 years, totality of the evidence. mentioned are the walls coming in? the walls have fallen on joe biden. shokin's testimony was critical. i would recommend immediately he testifies before congress. the oversight committee and i'll tell you right now, congress has to get a backbone, the house republicans, and start the impeachment proceedings because there is overwhelming evidence that 1023 reports, bank statements, you have all this irs investigation and the failure to prosecute hunter biden. there is overwhelming evidence. they went after trump for j walking, they need to pursue this immediately, john. >> john: you say the house republicans need to pursue immediately, we have a u.s. attorney in delaware who is supposed to be investigating all of this, david weiss. this would fall under the purview of his investigation. do you not have faith that he would be an impartial investigator here? >> do i have faith in david weiss, no, john, absolutely not. the evidence is clear. he basically tried to create a settlement, a plea agreement that was never done before. basically if the judge did not stop him in delaware, hunter biden would be off scott free. so i don't have any -- any credibility or any trust in david weiss. david weiss has not demonstrated any intent or desire to prosecute hunter biden. you prosecute hunter biden, you prosecute joe biden. and that's what david weiss will not do because everyone knows that the department of justice, the fbi is in bed with the democratic party and they have weaponized the departments. >> john: you mentioned the interview that brian kilmeade did with shokin over the weekend that aired on "one nation," an excerpt where shokin says he believes joe biden took a bribe in a quid pro quo scheme. >> i did not want to deal in unproven facts but my personal conviction is that yes, this was the case. they were being bribed. the fact that joe biden gave away $1 billion in u.s. money in exchange for my dismissal, my firing, isn't that alone a case of corruption? >> john: the white house insists that shokin is lying and they criticized fox news for giving him a platform. do you think shokin is credible? he does have an axe to grind here. >> i think he's very credible, john. and what the oversight committee, the house should do is fly him to washington, take his testimony under oath. but john, the totality, the 1023 reports, the bank statements, the amount of money that hunter biden basically collected from his -- for his foreign dealings. that's overwhelming evidence to present impeachment. house republicans, grow that backbone, start the proceedings now before the end of september at the latest. >> john: this horrific racially based shooting king "i have a dream" speech, and the country has made tremendous progress in the last 60 years. people of all colors in every segment of american life. we didn't have it 60 years ago and what has happened now, the democrats have basically tried to attach themselves to king's legacy without the premises. king would not have done critical race theory or 1619 project. all the division. i'm not telling you that racism does not exist, not a perfect union, but john roberts systemic racism does not exist in any segment of the country. we had a black president. we have black congressmen. people of color every aspect of this country. we have people of color running major mets pan cities. -- metropolitan systems. they will not let go of the racism card, if they do, you will not have a party. black americans and hispanics are leaving the democratic party and said we don't believe you, and we are joining the republican party and the trump team. >> john: the case of jacksonville at least and president donald trump will go to trial on march 4th of next year in the federal case surrounding the efforts to overturn the 2020 election. jack smith previously proposed january 2024 trial date but the president wanted it pushed back to april of 2026. david spunt has the latest. how might that start date impact the primaries? >> it's going to do it tremendously, sandra. donald trump is dealing with a legal schedule, his court appearances here and other courtrooms and the political schedule, so this is supposed to start on march 4th, 2024. the next day, march 5th is super tuesday, the judge made the announcement in court donald trump is not immune from following the schedule of this trial. said she's not taking his campaigning schedule into consideration by any means, and wants to follow normal order. she believes his team has plenty of time to prepare for a trial that would begin with jury selection on the 4th of march. before she issued the trial date, john lauro said it's a request for a show trial, not a speedy trial, the judge replied let's take the temperature down. the former president's attorneys wanted it in april 2026. smith's team wanted january 2024. the government today, sandra, said they have 12.8 million pages of discovery evidence, handed over the majority of that, trump team says they cannot get ready in time for a trial. also today, former trump chief of staff mark meadows is in atlanta with the goal to move his trial to federal court. the team argues he was the chief of staff to the president of the united states and the case in atlanta deals with a federal election. 19 people, including meadows, were charged in that state. donald trump has not yet made a move from state court to federal court. so march 4th back here in washington, d.c., one day before super tuesday and happens to be from historical perspective the day when presidents of the united states were inaugurated, from george washington to herbert hoover. that changed in 1923. >> have all kinds of updates for you throughout the day. >> sandra: meanwhile, lawyers for the suspected idaho student killer bryan kohberger are asking the judge to toss out the case, alleging grand jury bias, inadmissible and insufficient evidence and prosecutorial misconduct. nancy grace, what do you think about this, nancy? why is this happening? >> well, the truth is, it's all just a big game right now anyway for the defense. speedy trial demand, they didn't want a speedy trial no more than the man in the moon. the defense's best friend is delay, delay, delay. in every case. they don't want a speedy, which means the case has to be tried six months from the arraignment. the longer you wait, the less memories are sharp, you lose witnesses, you lose evidence, the public interest dies down. so they want to delay. that was the big game. now they want the indictment thrown out, another big game. that indictment is not getting thrown out. now, they are saying there are secret grounds to have it thrown out, 24 grounds, that's not true. all that means is the judge put it under seal. they are claiming prosecutorial misconduct, the wrong standard approved, grand jury bias, lack of evidence. if there wasn't enough evidence the grand jury would not have indicted. obviously there was enough evidence. all of these claims are going to fail. it's just another way to antagonize and paper the state to keep them busy answering motions. but i find this interest, too. they have also filed for a ban on cameras in the courtroom as we all know, we don't live in russia, we don't live in china, we have open courtrooms to avoid wrongdoing, right? this courtroom is open. a camera allows the country to see justice unfold but they don't want that. why? they don't want a camera looking at bryan kohberger. do you blame them? >> sandra: they are claiming the camera wielding courtroom observers have failed to obey the earlier directive to not focus exclusively on their client, pointing to photos they say were a blatant violation and to headlines they called blatantly sensationalistic and prejudicial. nancy, it's fascinating, we are learning a lot more since this suspect was taken into custody, including his drug habits. listen here. >> claim kohberger develops anger issues, even putting one friend in a head lock leading that friend to cut ties. he says he only sees that side when kohberger is drinking. >> when he got drunk, he was rowdy. >> they allege alcohol use turns to drug abuse and kohberger is hooked on heroin. >> sandra: how big a part of all of this were his drug and alcohol habits, nancy? >> well, according to some, he went clean, stone cold sober. i don't know if that's true, but i think we will find out as the evidence unfolds. another very disturbing thing, possibly even more problematic, to me, it definitely is more problematic, is his frustration and anger towards women. and in our special, called "i am blank," i said what does that mean? that's what it means, nobody knows who is kohberger and go back to middle school, he argues with a lady cop, can't get along with female colleagues, spies on female colleagues, and frustration with women dating >> john: you know, i appreciate musicians and other artists for what they do in their art but they are also people and they have their opinions about things. we have a lot of them on our air. we have joe, lady gaga's father on a lot. if she wanted to come on and talk about an issue, i'm sure we would be happy to put her on. but sometimes people get themselves in trouble and it's obviously the case with alice cooper. >> sandra: interesting to see the reaction. and we are tracking tropical storm idalia as it heads toward florida, predicting it will slam into the west coast as a major hurricane. robert ray, are there mandatory evacuations happening right now? >> yeah, good afternoon, sandra. there are not. at least in pinellas county. officials met this morning and they have not issued mandatory evacuations to the surprise of many. and you see like this bridge here that goes over this causeway, that's where people will begin to leave if they decide to leave voluntarily, but nothing mandatory. here is the thing, sandra, and john. look at this. the gulf of mexico here, and these waters are sitting at close to 90° in a temperature. and what that means for the strengthening and the rapid intensification of this tropical system that's headed up, expected to be a category 3, is that it will get a lot of juice really quickly. what it means to rapid intensify is the warm waters, the energy, humidity level through the roof and not a lot of wind to knock it down, knock the hurricane, so counterclockwise come in here. it's expected to be about 80 miles off of the gulf of mexico. take a look out there as it makes its way to the big bend of florida, that curve that goes into the panhandle. but sandra and john, we know this for a fact, that these storms have their own minds and they change the trajectory. we saw it with ian last year. so we will monitor this every three hours the national hurricane center comes out with a new advisory as the hurricane hunters are up in the air going in and out of this storm and we'll find out more as to whether this storm wants to make a quick track to the east, a wobble, let's hope not, because tampa will be in serious trouble. as we speak right now, the storm surge here could be up to seven feet. if that happens, it's a record, a modern record for this part of the country. if the storm gets a little closer, it's going to be even worse. this is not good, and people need to save themselves if they feel they are in lowland. don't want another ian. >> sandra: you have so much experience with these types of weather situations, you watched them for a long time, you bring it to the people like nobody else. thanks for joining us and download your fox weather app. thank you. >> john: good to have robert on the story. the first day that missouri's gender changing treatment ban goes into effect. it blocks healthcare providers from giving gender changing surgeries to minors, including prescribing puberty blockers and hormones, came after a trial court did not block the law, citing unclear and conflicting medical evidence. the attorney general of the state of missouri, andrew bailey. attorney general bailey, good to have you with us. this is a big win in court. why do you think it is important for the show me state for this law to go into effect? >> well, this is a huge win in the fight to protect children and the law is vitally important to stop left wing experimentation on kids. 0 fda approval for puberty blockers or the surgeries are safe and effective. european nations have curtailed the procedures and this bill is a huge step in protecting kids from the forced sterilization, and getting into court, testing the other side's evidence, making their expert own the fact reliance on weak science was misplaced and no medicine or science to back this up was vitally important. >> john: at the same time, general bailey, you make that point. opponents are taking the law will have extremely serious negative health consequences. listen to what susan, the president of transparent said. >> transgender children will die if this law goes into effect. if they cannot get treatment to treat their gender dysphoria, children will die. >> john: what do you say to that argument? >> there are ample treatments, it's called psychology and psychiatry. it's more left wing lunacy. i would point to the expert we had testify in court last week who opined that children who undergo hormone therapy for gender dysphoria are more likely suicidal. we are protecting kids. they are in a march to harm them, what the fight is all about. >> john: chloe cole joining us next hour talked about the permanent effects of double mastectomy and testosterone treatment and supported the law in missouri. listen to what she told congress in very compelling testimony. >> my voice will forever be deeper, my jaw line sharper, nose longer, bone structure masculinized, adam's apple more prominent, fertility unknown. i look in the mirror sometimes and feel like a monster. >> john: i look in the mirror and look like a monster. she was not suicidal, even though her parents said you would live with a dead daughter or transgender son. she said she was suicidal after the treatments. >> that's my point exactly, and point out we had detransitioners come forward and testify in our case and put that evidence in open court for the world to see and how brave these victims are, you know, at the end of the day, there is justice where they have private causes of action to go after "medical experts" who led them down this trail of sterilization and it's important to find justice for those victims and i support the bravery of those willing to come forward and speak out against this, and very helpful to us in our court hearings last week. >> john: you have extended the statute of limitations to 15 years instead of the two, which is in effect now in the state of missouri. this -- a lot of the reason why this happened because of the whistleblower, jamie reed, worked for a youth gender clinic associated with washington university. she came out with a story earlier this year that a lot of kids were getting thrown into treatments or surgeries without getting any mental health counseling. now the "new york times" has said you know what, we corroborated a lot of what she said. is that the automatic reaction of many people on the left is that anybody who challenges this gets pillarated? >> the left wing machine goes into full tilt. welcome to the godless reformation, burned at the stake for trying to protect kids from forced sterilization. that's what the fight is about and why it's important and jamie reed when she came forward with specific credible allegations against one of the clinics in missouri, we launched a first of its kind investigation into the matter, and now a lot of her claims are corroborated. and she was willing to testify under oath in the affidavit, she came to testify in support of the law, willing to be cross examined by the plaintiffs who have an agenda against this kind of law. she cares about protecting children as well, and her evidence has to be taken seriously and was found credible by the court. >> john: the law goes into effect today, may not be the end of the story, opponents say they are going to take it to the court of appeals. attorney general, thanks for being with us. appreciate it. >> thanks for having me on. >> sandra: chicago is now blaming automakers for the city spike in car thefts. mayor brandon johnson is calling the car companies to put anti-theft technology in cars. why isn't he addressing the real problem? >> well you know, what they say, sandra, the devil made me do it, in this case it's the cars made me do it, they were too easy to steal. as you report, chicago now joins multiple other big cities like milwaukee, st. louis, seattle, new york city in suing hyundai and kia because they say it was just too easy for them to be stolen and it caused a lot of havoc in the city. you remember those videos and hyundai and kia do admit there is a problem with theft for some of their models between 2015 and 2019. those videos online were a how to to steal a hundai or kia, just basically took a usb cable and the city says chicago does in the filing that it is bearing the cost of the defendants' unlawful conduct as it pays for property damage, diverts law enforcement resources and strives to keep the public safe from harm that the defendants could have prevented if only they had done something. nobody is disputing car theft is up nationwide. in chicago alone, double this year, up 104% from what it was last year and they point out in the court filing that before those videos came out about june or july of last year, there were about 500 kias and hyundai's stolen in chicago. after the videos, about 8,000, and so they say the company should have done a better job. what does kia say? we reached out to them on fox business and they said "lawsuits by municipalities against kia are without merit. the government has determined this does not constitute a safety defect or noncompliance with applicable motor vehicle safety standards." indeed, they are not required to put the latest anti-theft devices on their vehicles, and they didn't. there's no law that said they had to. the law says you have to put headlights on the cars, tires on the cars, you don't have to have the latest anti-theft technology and of course the critics say maybe they should do a better job of prosecuting the people who took the cars unlawfully and did bad things with them. not the cars themselves. sandra. >> sandra: that is almost hard to believe, jeff. interesting story to be reporting on, we'll see where all that goes. we want a fox news alert to the white house, as promised, karine jean-pierre is taking to the podium to brief the first time in two weeks, she's taking a question on getting kids back up to speed in the classroom following the covid pandemic. let's dip in and listen. >> to making sure that education for all of our children regardless if you are in rural america, urban america, all across the communities is a priority, and the students and the kids get what they need. and it's not just education, right. we talked about mental health, right. we talked about kids making sure that they're getting healthy lunches. that's something this administration has provided. and so we've seen the data, the numbers, what it means to us is more work needs to be done and we are committed and this president and administration is committed to doing that work. look, we are going to hear as i mentioned secretary cardona is going to go on a bus tour, across the country as school is opening up. he's going to lay out what the department of education is doing to continue to improve our schools so make sure that students get the education and get the rightfully the education that they deserve and so the work continues. i don't have a ten-step laid out for you but i can say for sure this president is committed and you see that through the secretary of education and something is incredibly to the first lady as well. >> a new a.p. poll asked americans, open end question on the thoughts to the president and the most common is his age, how old he is, does this white house have additional plans to demonstrate he can continue to do the job at his advanced age and alay some concerns? >> i appreciate the question i get it often as you know. and what i would say and i've said this many times and many colleagues have said this, the president says this. if you watch him, have seen what he's done the last two years, this is a president has had an historic administration in two years. look at the 13.5, more than 13.5 million jobs he's been able to create, how he's able to turn the economy around so it works for middle class americans. look at the inflation reduction act and what it's going to do to really help americans as relates to healthcare, as it relates to utility bills, if you think about -- this is a president who has done his -- has taken historic actions and not just with democrats on the hill, but in a bipartisan way. i just mentioned the chips and science act, in many ways the president is able to do things that are going to change how american families move forward, whether it is economic with economy, whether it's healthcare, whether, you know, it is trying to make sure that they are able to give to their, you know do, what they can for their family, for their kids. that is important, and so that's what we will happily, happily discuss as it relates to age, what the president has been able to do and how he's and able to deliver. >> and the president walked in the oval office with his personal physician, is there an appointment, a health concern? >> i didn't see that, i can't speak to that, i don't know. >> good to see you. >> welcome back. >> it has for a lot of us, and it has the new briefing room smell. >> like a new car. >> in the call with the governor of florida this morning regarding the approaching storm and the shooting in jacksonville, any chance the president raised his concerns to the governor about the state's new slavery education standards? >> they kept it to what the readout was. we are careful not to read out private conversation. they talked about clearly the president offering any assistance the governor might need as we are talking about the jacksonville shooting as you all know and also the storm, idalia, that's headed to florida. that is kind of the -- that is clearly what's on everybody's mind as we see this potential category 3 storm and as a community is mourning, i don't have anything else to read out from that call, but clearly those are the two kind of pertinent things at the moment that they were able to discuss and the president wanted to make sure that not just the governor, but the people of florida knew and understood that this is -- the president, the federal government is with them through the different -- through the different kind of events that they are dealing with at this time. >> get back on the phone together? >> if need be, absolutely, if need be. and let's not forget the major declaration the president approved within hours, as we are now watching the potential category 3 hurricane that could hit florida, which is important. >> now that we know he's officially going to be -- questions we have throughout the year, are there still plans to somehow, some day soon meet with chinese president xi? >> back to what the president said during his press conference at camp david recently. he spoke to this. don't have anything else to add. he's been very clear he is looking forward to having that discussion at some point, just don't have anything to share. >> the white house would like to do that this year? >> i'm not going to put a timeline on it. but you know, they have spoken multiple times in the past two years, or the president's tenure. >> house speaker yesterday said moving towards impeachment now is "a natural step forward." and would be an opportunity for congress to get all the information they need. what is the white house's response to the apparent march to impeachment by house republicans and does it make working with him this fall on matters of dollars and cents more difficult? >> look, ed, i cannot really speak to the house republicans and what they are focusing on. you've heard from speaker mccarthy, i'm not going to dive into what's in his head or what they want to do on the other side of pennsylvania. the real priorities that americans care about. i talked about how the president and the first lady visited a middle school and one of the messages he wanted to make sure he highlighted is the importance of every child in america having access to quality public education and also let's not forget what we are celebrating today, 60 years, or commemorating today. that's what the president will focus on. later this week focus on lowering healthcare costs, response to maui wildfire, you just ask me about his conversation with the governor of florida and what they are dealing with, very devastating shooting that we saw in the city of jacksonville and this hurricane. that's about to hit potentially hit florida. those are the things the president is going to focus on and you ask me how the president is going to work with speaker mccarthy, look, this is a president who wants to work in a bipartisan way and he has been able to do that as it relates to historical pieces of legislation. he wants to continue to do that. and he hopes congressional republicans would continue to join him or join him on doing that, and that's going to be -- that's going to be his focus, instead of, you know, more baseless political stunts. that's what they are focusing on. >> some of the frustration appears to be the inability to get information out of the state department, homeland security department, other aspects of the government. any validity in view of the white house or should the white house urge departments to cooperate with ongoing investigations? >> look, we always urge different agencies and departments to, you know, to work with congress, of course. something we always urge and i can't speak to that, to what they are complaining about. what i can speak to is what the president is focused on and again, we want to work in a bipartisan way with congressional republicans, that's what we want to do. we want to get things done for the american people. issues that actually matter to them, not these political stunts that they are clearly focused on. >> three u.s. marines were killed in this osprey crash in australia during a training exercise. has the president been briefed on early read or early information about potential cause of this, any sense whether it was weather-related, mechanical. >> any specifics to what caused it and what was related to it i would certainly refer you to the department of defense for any specific questions. yesterday the president extended his condolences to the families of the marines who lost their lives in this horrific, horrific crash, as well as his prayers to those who also suffered injuries. any additional information on the specifics of the crash or what caused the crash i would have to refer you to department of defense. >> does the president have any broader concerns, we are seeing it seems too many of these aviation incidents, mishaps in the military. does he feel there needs to be some sort of a reevaluation or reconsidering of training or focus on maintenance? >> look, the president fshg when it comes to our military force, he's always going to be concerned, always make sure they have everything they need and of course that they are safe. anything related to this, i don't want to get ahead of what the department of defense might be looking into, what might be causing this, i don't want to get ahead of them so they would have to answer more specifically on those questions. >> additional question on the house speaker. also would investigate the response to the deadly fires on maui, and does the -- >> appreciate the question, a couple things. since the onset of the unprecedented tragedy that we saw in maui, the president launched a whole of government approach. you heard me say it, him say it and the fema director, they lost so much, they lost historical land, they lost their community, and also as soon as the governor in hawaii, josh green, he has said this himself, requested a major disaster declaration, the president signed it and you have heard from the governor, and the two senators who have lifted up and said how quickly the president responded and the federal government responded, refer you to their own words. a week ago today, the president, first lady, they met with survivors, emergency responders and state and local federal officials. they saw firsthand themselves the overwhelming destruction that caused the wildfires and it was heartbreaking. and the president has said he is committed to delivering everything that he can to the people of hawaii, what they need, and we will be with them as long as it takes for them to rebuild. the president has been very clear about that, the first lady clearly has supported that, the fema administrator has said that. i will say this. what is currently on the ground the federal government has deployed more than 1,000 staff members on the ground and the fema has already given nearly $15 million insistance to families. and so again, we will be there, the federal government will be there, certainly at the direction of the president as long as it takes for this community to rebuild and certainly our hearts continue to be with the families and the people in hawaii who have lost so much. >> any closer to determining what brought down prigozhin's plane? >> so, look, a couple of things on a couple of things on that, i know that folks have had questions on prigozhin. so we are increasingly confident that prigozhin died in the plane crash that took place on august 23rd, this past wednesday. i don't have any new assessment on this, so i'll leave it there. >> and secondly, the president said in tahoe that he intended to recommend everyone get the new vaccine. when is he going to decide finally? >> i think you have heard from fda and cdc, they have made an announcement on the new vaccine so certainly they said that they will have -- updated vaccine mid-september, i believe, so we know that as you all know, vaccinations against covid-19 remains the safest protection for avoiding hospitalization, long-term health outcomes and death, why we are going to be encouraging americans to stay up to date on their vaccines. i would refer you to dhs as i just mentioned, fda and cdc mentioned that they will have the new vaccines by september, mid-september. >> thanks, karine. we are about a month away from the government running out of money, potentially shutting down. what's the president's plan to avert a government shutdown? >> so, look, i'll defer to congress on the government shutdown. shouldn't be no reason for congress to shut down the government, none at all, none. they should fund vital government programs for the american people and we have asked emergency funding for, there should be none. that is for congress to speak to, and as you know -->> sandra: all right, we have been listening to karine jean-pierre, telling our viewers, the first time she's briefed in a couple weeks as the president's been travelling on and off vacation. she was asked about the march to impeachment by house republicans to which she said biden is not focused on baseless political stunts but what real americans want. she was also asked about the president's age out of the gate there, responding by saying the president has had an historic administration in just two years citing off what they see as big policy wins under this administration. >> john: the reason she was asked about it is because the associated press have a new poll out, 77% of respondents believe biden is too old to efficiently carry on a second four-year term, and you would expect republicans, 89% say yes, that's the case, but 69% of democrats think he's too old. we'll talk about that in the next hour with jason chaffetz. >> sandra: and peter doocy is in the room, but quick, mollie hemingway, you were sitting here having reaction to everything we were hearing out of the white house. one of which was her response to being asked about the president's age, responding on his historic achievements of which she noted the inflation reduction act, which correct me if i'm wrong, didn't the president say he wished they never would have called it that, but talked about the historic turning around of the america economy. >> it's interesting, president biden really has accomplished much of the democrat party's agenda, so they have every reason to be happy with him in
