>> bret: i'm bret baier. this is "america's newsroom." 55 people killed and expected to rise as rescue crews comb through the rubble of neighborhoods. the sheer scale of the devastation there. they turned a tropical paradise into what is called an apocalypse. officials are scrambling to find shelter for thousands left homeless. >> dana: putting more stress on fire crews who have been working around the clock, bret. this happened quickly. the devastation on day two here i'm afraid what people will end up finding. they have so many people still missing. >> bret: the most amazing thing. some of the video that started coming out a couple days ago are the people jumping into the ocean to avoid the flames. the devastation is unbelievable. now federal authorities are trying to get as much as they can to these people who have lost everything. >> dana: one more point on this. will cain spent a lot of time there as a child and throughout his adult life and he has been giving us some information how close knit this community is, how historical it was. and his heart breaks. now that we have these federal resources on the ground we'll talk to somebody in a little bit who is a global recovery expert and have some harrowing tales for us coming up. >> bret: quite a story. meantime, heavy hitters in the hawkeye state. republicans descending on iowa in search of a breakthrough moment and fried food along the way at the iowa state fair. >> dana: lots of calories to be had. a storied tradition in presidential politics. an event for candidates to get up close and personal with voters who could make or break them at next year's caucuses. nearly every candidate will be there including former president donald trump. his appearance comes as we await a potential fourth indictment against the former president. whether his mounting legal troubles will cut into his lead remains to be seen. >> bret: james freeman with analysis. lucas lucas -- we have a pivotal hearing in the election case against former president trump with david spunt. >> donald trump not here today but still an important hearing. his attorneys will be here. the only reason that we're having this hearing today here in washington, d.c. is because of a truth social post made by the former president one week ago. very short, it reads, quote, if you go after me, i'm coming after you, end quote. special counsel jack smith's team as possibly threatening to witnesses or prosecutors and think trump may talk about evidence in the case publicly. his attorneys say he was talking about rivals on the campaign trail. smith asked for a protective order to limit what the former president can say about evidence and witnesses. the judge will ultimately issue a decision to either grant the special counsel's proposal or perhaps something more limited. >> it is a virtual certainty that the judge will impose a protective order in this case. i'm not as confident that she is going to endorse the fairly robust protective order that the special counsel was recommending. my guess is that she may be inclined to split the difference and put limitations on certain types of evidence or categories of evidence that can't be disclosed. >> where things get tricky is the fact donald trump told supporters in front of cameras earlier this week if there is such a protective order he says he will ignore it. if he does ignore it, expect the judge to call him back in front of her and likely admonish him for doing so. she could punish him and also issue a gag order, the full she bang with no talking about the case at all. highly unlikely given the fact we're in the middle of a presidential campaign and he is the clear frontrunner. also the u.s. government says they want the trial to begin on january 2nd just several months away right after new year's in the middle of iowa, south carolina primaries. they believe it could take somewhere between 6 to 8 weeks possibly. trump's team expected to fight that. see what she says in court today. >> bret: 13 days before the iowa caucuses. david spunt, thanks. >> he has been indicted now three times. probably a fourth. at the end of next week. polls show he is tied with your candidate, the president. that has to be a warning sign. >> we'll stay focused on insuring that we're communicating what this president has delivered for the american people. we know it's a winning message. we saw it in 2020 and saw it in 2022 and know we'll see it again this election cycle. >> bret: president biden's campaign manager touting his record in his first three years in offices. many of the promises made by him have not been kept. the president is placing the blame on the u.s. supreme court. lucas tomlinson is live on the north lawn of the white house with a closer look. good morning. >> you're right. the supreme court is not being kind to the biden agenda striking down rulings on affirmative action and student loans. president also says the high court has blocked his climate agenda. >> president biden: yes, the courts overrule me. the court said i couldn't do it. i want to stop all drilling on the east coast and the west coast and in the gulf. i lost in court. but we're still pushing. we're still pushing very hard. >> the president speaking to the weather channel at the grand canyon referring to a louisiana federal judge last year blocking the biden administration's built to pause oil and gas leasing in 13 states. who could forget jacque heinrich after the student loan plan asking biden if he gave millions of students across the country false hopes. he blamed republicans. tennessee senator marsha blackburn saying the white house is angry. >> they do not want to understand what the supreme court has said. they go about trying to delegitimize the supreme court every way they can. so to go against them and their ruling and to remind the biden administration that they do not have the authority to do this, they just feel like that's an obstacle. >> the supreme court is out for the summer and doesn't start the next term until october well into football season, bret. >> bret: lucas, thanks. >> we want to get a candidate that has a vision and can execute on day one and bottom line, we want the candidate that we believe can win in 2024 and put a republican in the white house. and that's the mindset of iowans. >> dana: they mean business when it comes to screening the candidates at the iowa state fair. james freeman, great to have you. one quote from "the new york times" article the reporter says what's different about iowa this time is that before republicans consider a broad field of candidates they are asking themselves a more basic question, trump or not trump? let me show you a little bit of the polling we have now versus july. you have desantis chipping away a little bit at the lead. donald trump at 46 to 16% in july now 44 to 20. what do you make of that, james freeman, as the iowa state fair gets underway? >> that's the way to frame it. it is a two-man race. donald trump views it that way. when he shows up at the iowa state fair he is not bringing along endorseers from iowa but from florida. congressman from florida. so he certainly views desantis as his competition and i think he should. not just on polling but on the really impressive record of the florida governor. >> bret: nine congressman who have not endorsed florida governor but endorsed the former president traveling with former president trump to iowa. you know, iowa is different. the caucus system is different, they expect you to really court their vote much like new hampshire people do. can some candidate have a breakthrough moment considering how big this lead is for the former president at this point? >> it could happen. there is plenty of time. obviously the fox debate coming up is a chance for people to shine. you mention that sort of retail nature of iowa. desantis is trying to go to all 99 counties. donald trump is not going to do that and it will be interesting to see when donald trump shows up, we remember in 2015 he flies in in the helicopter and a lot of excitement. doesn't talk like any other politician. are we going to see that same excitement? is it trump or not? we're talking about whether the indictments will hurt him. i think they're helping him now among republican voters because they're seen as not legitimate. the idea you prosecute a politician for making a false claim as a criminal fraud. >> dana: that's so interesting that we have these dual stories going on. you have the campaign and you have the legal issues as one of our david spunt was pointing out, you could have the president end up not being able to talk about the case while he is in the middle of the presidential race and in the lead. one of your colleagues on the editorial page kim strassel writes. free ron desantis. he is smothered under of focus groups and chattering advisors. the problem is the governor's adoption of trump-style grievance policy and chasing a slice of voters that won't have him anyway. he is -- he has a perfect opportunity for reversal at the debate. let the guy who shows up be the florida governor of old. do you think that's what ron desantis' problem has been? he has recommended in by consultants? >> i think it is a challenge. i think absolutely voters want to know and he has the florida record to show he will stand up against wokeness and stand up for families against radical social agendas but he needs to draw a contrast with trump. and it is challenging. if a voter is saying i want the most politically incorrect brawler they will probably choose trump. i think there is a lot of room for desantis to run based on that record. by the way, the finances, the taxation, the spending in the state of florida compare very favorably with what has been happening in washington including on donald trump's watch. a lot of wins for conservatives during the trump years but terrible record on spending. not as reckless as president biden but i think the economic issues are there waiting for a desantis attack. >> bret: the former president has 100% name recognition. some opponents say it's part of this big lead. others say it is a big lead. but as far as the local effort, you know, the governor, kim reynolds, the former president hasn't warmed up to her. how big a machine is the reynolds machine in iowa? how big are those coattails? >> we'll find out. i don't know if it's a machine so much as she is popular and for good reason. she, like ron desantis, has put a lot of wins on the board in terms of school choice, in terms of tax reform. she is really kind of a gold standard governor right now. i think some people probably hope she might get in the race. so i think if anyone could pull people away from trump in iowa it might be kim reynolds but she is staying neutral. trump suspects that she is a desantis backer but she has not endorsed anyone. she is supporting an open primary. but i think if she were to endorse, i suspect it would have an impact. >> dana: a lot of chatter about her as a vice presidential choice as well. >> what we need most is housing. the situation here is dire. those housing shortage before this fire and now with all the people that are basically staying in shelters, that's really the solution we need to figure out and we're working on. >> dana: gabe, can you describe what it was like for you when the fire came through? >> when the fire came through, i helped get a lot of our people out of the town and then i ran back into the town and had to jump because the flames were engulfing and sailed out. our team returned back at midnight and started rescuing people off the beach. we walked over dead bodies. it was apocalypse. >> dana: what is it like for reuniting families if they got separated because there is little power on the island, no internet access. how is that working? >> it's been really challenging. we have 150 employees with our company and our people, we have families that look for each other and they ran through hotels. there is no connection, no one knows what's going on. people are finding their spouses on the side of the road sleeping in their cars. it is terrible. nothing like i have ever seen in my life. >> bret: the governor said there could be still some 1,000 people missing. the death toll we know is going up. what do you see about families there? where are they going? >> they are going to various shelters all throughout the island. i believe there are about 12, including small little ones throughout. so our foundation global empowerment mission, our job is to supply some of the shelters, give them the needs for blankets to whatever is needed there. and then we have through our be strong program we have a cash card like a visa card and we go to all the shelters and we let people -- we give them funds so they have short-term incidental money. people need clean underwear, all kinds of things that they need to buy themselves. i've been in 300 disasters around the world and spent the last 15 months in ukraine. this is armageddon here. it is completely wiped out. we were on the boat at 4:00 p.m. by 5:30 the whole city had burned down. >> dana: could you describe -- moving to hear about how close knit the community was. we recognize the historical significance of lahaina. maybe in your own words what you feel you've lost here. >> you are never going to get it back. lahaina was a generational town. everybody has passed it from family to family and why a lot of people didn't want to leave. they just -- you can never imagine this would happen. lahaina was the capital of hawaii for many years and has so much rich heritage. we hear the bannan tree might be able to regrow. a lot of people. not just us but worldwide had a connection to lahaina. a historic town from the whaling days and when we came here our company came here in 1973, it was the first place we landed and it has been the same. we never would imagine it would happen and why no one left. they were there and didn't believe it would happen. >> bret: if people want to donate, where do they go? >> this is always going to end with the bidens coming in front of the committee. we are going to subpoena the family. we want to talk to 3 or 4 more associates first. this is a complicated case and we are being obstructed every step of the way by the department of justice, by the f.b.i., by the secret service, by the i.r.s. and by the biden family attorneys. but that's not stopping us. >> dana: the gop is not going to stop. you have covered many white houses. they are saying there is nothing to see here. now there are bank records and emails. because they have subpoena power they can get more information. how do you think it goes from here? >> not the first white house will say there is nothing to see here. that's what we'll continue to see from the biden white house. they will try to say no, this is not a story. president biden said repeatedly and again this week to peter doocy he was not involved in any of hunter's business dealings. stepping back and looking at the political picture, it is a political weakness for him. >> dana: peter doocy stepping over the barrier. watch here. >> there is this testimony now where one of your son's former business associates is claiming that you were on speakerphone a lot with them talking business. is that -- >> president biden: i never talked business with them. i knew you would have a lousy question. >> why is that a lousy question? >> president biden: it's not true. >> thank you, mr. president. >> dana: couple white house coms questions for you. for a long time the white house and joe biden said i never talked to my hunter about business dealings. three weeks ago the white house press secretary changed the language and she said joe biden has never been in business with his son. then the other day she said i've said that a million times. she hasn't. it was changed. now you have president biden saying i never talked business with my son. there is a discrepancy there. why is there such a lack of curiosity? >> there is interest in the white house press corps. it's about the politics. you can see -- >> dana: is it? do you think the white house press corps presses the press secretary on this? >> not my job to defend them since i'm not wearing the hat anymore. >> dana: i was there in the room. when i would say i can't believe they never asked me about such and such. we dodged a bullet there. this one day after day and there is frustration in the "new york times" today there is nothing on the front page about biden, hunter biden, the whole issue at all even though emails and bank records but we do have 16 mentions of president trump. people out there reading the press feel like there is a discrepancy. >> that's an issue. what i said before. it's a political weakness for biden. lots of political weaknesses for president trump related to larger things with regard to these 3 or 4 indictments. hunter biden is a political weakness for his father, no question. does it deserve to be asked about more? probably. >> dana: all right. let's ask you about this. senator joe manchin is saying he could possibly become an independent. listen here. >> why not just say i'll be an independent? you thought about that? >> absolutely. absolutely. i would think very seriously about that and been thinking about that for quite some time. i haven't made any decisions on any of my political direction. i want to make sure my voice is an independent voice. >> dana: will he do it? he has been teasing it. >> will he do that and then run for president? if he decides to become an independent in his state and run for senator, run for the senate again, he would have a good chance. >> dana: what is the level of concern at the white house about joe manchin jumping in as a third party candidate? >> not that high. i don't think there is that much concern about him becoming an independent. i don't know the answer to that. >> dana: i keep trying. >> they don't like either of them. >> dana: thanks for coming in. >> bret: caught on video suspected cartel members threatening migrants with machetes. what it reveals. the white house defending a deal to free five americans held in iran. does that agreement amount to a ransom payment? >> look, this is a tough work of international diplomacy and negotiations and i'm not surprised about the criticism but the reality is, if you get into the details of this deal it is pretty smart. we get americans back who are held in a terrible prison. we release funds that can only be used for humanitarian purposes. they will be supervised by our ally qatar, who will actually have to make the payments themselves out of a bank account in qatar to only buy grain and food stuffs and things like that. but this is what you have to do. you have to make deals like this if you want to get americans free. it's a tough world out there. look, the same criticism was issued to president reagan at the height of the cold war when he negotiated with the soviets and the evil empire. a lot of conservative republicans at the time criticized the president for making deals with the soviets. but ultimately it was the right thing to do. when we look back now and praise ronald reagan for his efforts. >> bret: former secretary of state mike pompeo last night. >> the upshot is this. we're now about a billion dollars a hostage. that will be recognized by the russians and north koreas and the chance iranians will take further american hostages only increases. they don't have spend it on medicine and food but put american lives at risk. >> bret: we've been dealing in one way or another through proxies or another way with tehran for a while. have you seen any indication that money that goes there is not used to fund terrorism, is not used for bad goals? >> look, i think secretary pompeo is wrong in his criticism. he is talking about the way that deals like this were handled in the past. that's different than the stipulations that have been put on this deal. this money will still sit in a qatar bank account. only qatar will have authorities to release it. what will happen is iran will say we want to buy $10 million worth of grain. qatar writes the check themselves. the grain goes to iran. there is no way they can actually use these funds, this money, which again to be clear is actually their money. it has been held sanctioned by us. there is no way they can actually use that money to buy weapons. it is not an accurate criticism in this case. >> bret: but have you seen iran change its stripes in recent years? >> look, this is a great example of where ronald reagan's trust but verify really applies. you cannot trust the iranians without verifying everything that you hold them accountable for and why it's such a problem that because we don't have any kind of nuclear deal with them anymore, we have no inspectors to verify where they are in their nuclear process. as a result of that, they are much closer to developing a nuclear weapon today than they were under the deal, however imperfect that it was, that president obama made that included really tough verification measures. >> bret: one last quick thing about your party. every recent poll says the democrats, even democrats are doubtful about president biden whether they want him to be the nominee. are you convinced that president biden will be your party's nominee by the democratic convention? >> bret: i'm bret baier. this is "america's newsroom." 55 people killed and expected to rise as rescue crews comb through the rubble of neighborhoods. the sheer scale of the devastation there. they turned a tropical paradise into what is called an apocalypse. officials are scrambling to find shelter for thousands left homeless. >> dana: putting more stress on fire crews who have been working around the clock, bret. this happened quickly. the devastation on day two here i'm afraid what people will end up finding. they have so many people still missing. >> bret: the most amazing thing. some of the video that started coming out a couple days ago are the people jumping into the ocean to avoid the flames. the devastation is unbelievable. now federal authorities are trying to get as much as they can to these people who have lost everything. >> dana: one more point on this. will cain spent a lot of time there as a child and throughout his adult life and he has been giving us some information how close knit this community is, how historical it was. and his heart breaks. now that we have these federal resources on the ground we'll talk to somebody in a little bit who is a global recovery expert and have some harrowing tales for us coming up. >> bret: quite a story. meantime, heavy hitters in the hawkeye state. republicans descending on iowa in search of a breakthrough moment and fried food along the way at the iowa state fair. >> dana: lots of calories to be had. a storied tradition in presidential politics. an event for candidates to get up close and personal with voters who could make or break them at next year's caucuses. nearly every candidate will be there including former president donald trump. his appearance comes as we await a potential fourth indictment against the former president. whether his mounting legal troubles will cut into his lead remains to be seen. >> bret: james freeman with analysis. lucas lucas -- we have a pivotal hearing in the election case against former president trump with david spunt. >> donald trump not here today but still an important hearing. his attorneys will be here. the only reason that we're having this hearing today here in washington, d.c. is because of a truth social post made by the former president one week ago. very short, it reads, quote, if you go after me, i'm coming after you, end quote. special counsel jack smith's team as possibly threatening to witnesses or prosecutors and think trump may talk about evidence in the case publicly. his attorneys say he was talking about rivals on the campaign trail. smith asked for a protective order to limit what the former president can say about evidence and witnesses. the judge will ultimately issue a decision to either grant the special counsel's proposal or perhaps something more limited. >> it is a virtual certainty that the judge will impose a protective order in this case. i'm not as confident that she is going to endorse the fairly robust protective order that the special counsel was recommending. my guess is that she may be inclined to split the difference and put limitations on certain types of evidence or categories of evidence that can't be disclosed. >> where things get tricky is the fact donald trump told supporters in front of cameras earlier this week if there is such a protective order he says he will ignore it. if he does ignore it, expect the judge to call him back in front of her and likely admonish him for doing so. she could punish him and also issue a gag order, the full she bang with no talking about the case at all. highly unlikely given the fact we're in the middle of a presidential campaign and he is the clear frontrunner. also the u.s. government says they want the trial to begin on january 2nd just several months away right after new year's in the middle of iowa, south carolina primaries. they believe it could take somewhere between 6 to 8 weeks possibly. trump's team expected to fight that. see what she says in court today. >> bret: 13 days before the iowa caucuses. david spunt, thanks. >> he has been indicted now three times. probably a fourth. at the end of next week. polls show he is tied with your candidate, the president. that has to be a warning sign. >> we'll stay focused on insuring that we're communicating what this president has delivered for the american people. we know it's a winning message. we saw it in 2020 and saw it in 2022 and know we'll see it again this election cycle. >> bret: president biden's campaign manager touting his record in his first three years in offices. many of the promises made by him have not been kept. the president is placing the blame on the u.s. supreme court. lucas tomlinson is live on the north lawn of the white house with a closer look. good morning. >> you're right. the supreme court is not being kind to the biden agenda striking down rulings on affirmative action and student loans. president also says the high court has blocked his climate agenda. >> president biden: yes, the courts overrule me. the court said i couldn't do it. i want to stop all drilling on the east coast and the west coast and in the gulf. i lost in court. but we're still pushing. we're still pushing very hard. >> the president speaking to the weather channel at the grand canyon referring to a louisiana federal judge last year blocking the biden administration's built to pause oil and gas leasing in 13 states. who could forget jacque heinrich after the student loan plan asking biden if he gave millions of students across the country false hopes. he blamed republicans. tennessee senator marsha blackburn saying the white house is angry. >> they do not want to understand what the supreme court has said. they go about trying to delegitimize the supreme court every way they can. so to go against them and their ruling and to remind the biden administration that they do not have the authority to do this, they just feel like that's an obstacle. >> the supreme court is out for the summer and doesn't start the next term until october well into football season, bret. >> bret: lucas, thanks. >> we want to get a candidate that has a vision and can execute on day one and bottom line, we want the candidate that we believe can win in 2024 and put a republican in the white house. and that's the mindset of iowans. >> dana: they mean business when it comes to screening the candidates at the iowa state fair. james freeman, great to have you. one quote from "the new york times" article the reporter says what's different about iowa this time is that before republicans consider a broad field of candidates they are asking themselves a more basic question, trump or not trump? let me show you a little bit of the polling we have now versus july. you have desantis chipping away a little bit at the lead. donald trump at 46 to 16% in july now 44 to 20. what do you make of that, james freeman, as the iowa state fair gets underway? >> that's the way to frame it. it is a two-man race. donald trump views it that way. when he shows up at the iowa state fair he is not bringing along endorseers from iowa but from florida. congressman from florida. so he certainly views desantis as his competition and i think he should. not just on polling but on the really impressive record of the florida governor. >> bret: nine congressman who have not endorsed florida governor but endorsed the former president traveling with former president trump to iowa. you know, iowa is different. the caucus system is different, they expect you to really court their vote much like new hampshire people do. can some candidate have a breakthrough moment considering how big this lead is for the former president at this point? >> it could happen. there is plenty of time. obviously the fox debate coming up is a chance for people to shine. you mention that sort of retail nature of iowa. desantis is trying to go to all 99 counties. donald trump is not going to do that and it will be interesting to see when donald trump shows up, we remember in 2015 he flies in in the helicopter and a lot of excitement. doesn't talk like any other politician. are we going to see that same excitement? is it trump or not? we're talking about whether the indictments will hurt him. i think they're helping him now among republican voters because they're seen as not legitimate. the idea you prosecute a politician for making a false claim as a criminal fraud. >> dana: that's so interesting that we have these dual stories going on. you have the campaign and you have the legal issues as one of our david spunt was pointing out, you could have the president end up not being able to talk about the case while he is in the middle of the presidential race and in the lead. one of your colleagues on the editorial page kim strassel writes. free ron desantis. he is smothered under of focus groups and chattering advisors. the problem is the governor's adoption of trump-style grievance policy and chasing a slice of voters that won't have him anyway. he is -- he has a perfect opportunity for reversal at the debate. let the guy who shows up be the florida governor of old. do you think that's what ron desantis' problem has been? he has recommended in by consultants? >> i think it is a challenge. i think absolutely voters want to know and he has the florida record to show he will stand up against wokeness and stand up for families against radical social agendas but he needs to draw a contrast with trump. and it is challenging. if a voter is saying i want the most politically incorrect brawler they will probably choose trump. i think there is a lot of room for desantis to run based on that record. by the way, the finances, the taxation, the spending in the state of florida compare very favorably with what has been happening in washington including on donald trump's watch. a lot of wins for conservatives during the trump years but terrible record on spending. not as reckless as president biden but i think the economic issues are there waiting for a desantis attack. >> bret: the former president has 100% name recognition. some opponents say it's part of this big lead. others say it is a big lead. but as far as the local effort, you know, the governor, kim reynolds, the former president hasn't warmed up to her. how big a machine is the reynolds machine in iowa? how big are those coattails? >> we'll find out. i don't know if it's a machine so much as she is popular and for good reason. she, like ron desantis, has put a lot of wins on the board in terms of school choice, in terms of tax reform. she is really kind of a gold standard governor right now. i think some people probably hope she might get in the race. so i think if anyone could pull people away from trump in iowa it might be kim reynolds but she is staying neutral. trump suspects that she is a desantis backer but she has not endorsed anyone. she is supporting an open primary. but i think if she were to endorse, i suspect it would have an impact. >> dana: a lot of chatter about her as a vice presidential choice as well. >> what we need most is housing. the situation here is dire. those housing shortage before this fire and now with all the people that are basically staying in shelters, that's really the solution we need to figure out and we're working on. >> dana: gabe, can you describe what it was like for you when the fire came through? >> when the fire came through, i helped get a lot of our people out of the town and then i ran back into the town and had to jump because the flames were engulfing and sailed out. our team returned back at midnight and started rescuing people off the beach. we walked over dead bodies. it was apocalypse. >> dana: what is it like for reuniting families if they got separated because there is little power on the island, no internet access. how is that working? >> it's been really challenging. we have 150 employees with our company and our people, we have families that look for each other and they ran through hotels. there is no connection, no one knows what's going on. people are finding their spouses on the side of the road sleeping in their cars. it is terrible. nothing like i have ever seen in my life. >> bret: the governor said there could be still some 1,000 people missing. the death toll we know is going up. what do you see about families there? where are they going? >> they are going to various shelters all throughout the island. i believe there are about 12, including small little ones throughout. so our foundation global empowerment mission, our job is to supply some of the shelters, give them the needs for blankets to whatever is needed there. and then we have through our be strong program we have a cash card like a visa card and we go to all the shelters and we let people -- we give them funds so they have short-term incidental money. people need clean underwear, all kinds of things that they need to buy themselves. i've been in 300 disasters around the world and spent the last 15 months in ukraine. this is armageddon here. it is completely wiped out. we were on the boat at 4:00 p.m. by 5:30 the whole city had burned down. >> dana: could you describe -- moving to hear about how close knit the community was. we recognize the historical significance of lahaina. maybe in your own words what you feel you've lost here. >> you are never going to get it back. lahaina was a generational town. everybody has passed it from family to family and why a lot of people didn't want to leave. they just -- you can never imagine this would happen. lahaina was the capital of hawaii for many years and has so much rich heritage. we hear the bannan tree might be able to regrow. a lot of people. not just us but worldwide had a connection to lahaina. a historic town from the whaling days and when we came here our company came here in 1973, it was the first place we landed and it has been the same. we never would imagine it would happen and why no one left. they were there and didn't believe it would happen. >> bret: if people want to donate, where do they go? >> this is always going to end with the bidens coming in front of the committee. we are going to subpoena the family. we want to talk to 3 or 4 more associates first. this is a complicated case and we are being obstructed every step of the way by the department of justice, by the f.b.i., by the secret service, by the i.r.s. and by the biden family attorneys. but that's not stopping us. >> dana: the gop is not going to stop. you have covered many white houses. they are saying there is nothing to see here. now there are bank records and emails. because they have subpoena power they can get more information. how do you think it goes from here? >> not the first white house will say there is nothing to see here. that's what we'll continue to see from the biden white house. they will try to say no, this is not a story. president biden said repeatedly and again this week to peter doocy he was not involved in any of hunter's business dealings. stepping back and looking at the political picture, it is a political weakness for him. >> dana: peter doocy stepping over the barrier. watch here. >> there is this testimony now where one of your son's former business associates is claiming that you were on speakerphone a lot with them talking business. is that -- >> president biden: i never talked business with them. i knew you would have a lousy question. >> why is that a lousy question? >> president biden: it's not true. >> thank you, mr. president. >> dana: couple white house coms questions for you. for a long time the white house and joe biden said i never talked to my hunter about business dealings. three weeks ago the white house press secretary changed the language and she said joe biden has never been in business with his son. then the other day she said i've said that a million times. she hasn't. it was changed. now you have president biden saying i never talked business with my son. there is a discrepancy there. why is there such a lack of curiosity? >> there is interest in the white house press corps. it's about the politics. you can see -- >> dana: is it? do you think the white house press corps presses the press secretary on this? >> not my job to defend them since i'm not wearing the hat anymore. >> dana: i was there in the room. when i would say i can't believe they never asked me about such and such. we dodged a bullet there. this one day after day and there is frustration in the "new york times" today there is nothing on the front page about biden, hunter biden, the whole issue at all even though emails and bank records but we do have 16 mentions of president trump. people out there reading the press feel like there is a discrepancy. >> that's an issue. what i said before. it's a political weakness for biden. lots of political weaknesses for president trump related to larger things with regard to these 3 or 4 indictments. hunter biden is a political weakness for his father, no question. does it deserve to be asked about more? probably. >> dana: all right. let's ask you about this. senator joe manchin is saying he could possibly become an independent. listen here. >> why not just say i'll be an independent? you thought about that? >> absolutely. absolutely. i would think very seriously about that and been thinking about that for quite some time. i haven't made any decisions on any of my political direction. i want to make sure my voice is an independent voice. >> dana: will he do it? he has been teasing it. >> will he do that and then run for president? if he decides to become an independent in his state and run for senator, run for the senate again, he would have a good chance. >> dana: what is the level of concern at the white house about joe manchin jumping in as a third party candidate? >> not that high. i don't think there is that much concern about him becoming an independent. i don't know the answer to that. >> dana: i keep trying. >> they don't like either of them. >> dana: thanks for coming in. >> bret: caught on video suspected cartel members threatening migrants with machetes. what it reveals. the white house defending a deal to free five americans held in iran. does that agreement amount to a ransom payment? >> look, this is a tough work of international diplomacy and negotiations and i'm not surprised about the criticism but the reality is, if you get into the details of this deal it is pretty smart. we get americans back who are held in a terrible prison. we release funds that can only be used for humanitarian purposes. they will be supervised by our ally qatar, who will actually have to make the payments themselves out of a bank account in qatar to only buy grain and food stuffs and things like that. but this is what you have to do. you have to make deals like this if you want to get americans free. it's a tough world out there. look, the same criticism was issued to president reagan at the height of the cold war when he negotiated with the soviets and the evil empire. a lot of conservative republicans at the time criticized the president for making deals with the soviets. but ultimately it was the right thing to do. when we look back now and praise ronald reagan for his efforts. >> bret: former secretary of state mike pompeo last night. >> the upshot is this. we're now about a billion dollars a hostage. that will be recognized by the russians and north koreas and the chance iranians will take further american hostages only increases. they don't have spend it on medicine and food but put american lives at risk. >> bret: we've been dealing in one way or another through proxies or another way with tehran for a while. have you seen any indication that money that goes there is not used to fund terrorism, is not used for bad goals? >> look, i think secretary pompeo is wrong in his criticism. he is talking about the way that deals like this were handled in the past. that's different than the stipulations that have been put on this deal. this money will still sit in a qatar bank account. only qatar will have authorities to release it. what will happen is iran will say we want to buy $10 million worth of grain. qatar writes the check themselves. the grain goes to iran. there is no way they can actually use these funds, this money, which again to be clear is actually their money. it has been held sanctioned by us. there is no way they can actually use that money to buy weapons. it is not an accurate criticism in this case. >> bret: but have you seen iran change its stripes in recent years? >> look, this is a great example of where ronald reagan's trust but verify really applies. you cannot trust the iranians without verifying everything that you hold them accountable for and why it's such a problem that because we don't have any kind of nuclear deal with them anymore, we have no inspectors to verify where they are in their nuclear process. as a result of that, they are much closer to developing a nuclear weapon today than they were under the deal, however imperfect that it was, that president obama made that included really tough verification measures. >> bret: one last quick thing about your party. every recent poll says the democrats, even democrats are doubtful about president biden whether they want him to be the nominee. are you convinced that president biden will be your party's nominee by the democratic convention?
