talk about something that doesn't get enough attention a disastrous withdrawal from afghanistan. the president will almost not acknowledge and believe it or not various times cites it as a success. one of the most embarrassing things admiral kirby has ever said is he doesn't see chaos when he sees. they just is not seeing it. guess what, if you are one of the family members that lost a loved one in a mission that they never thought should have taken place you are seething today because this administration has given you nothing but the heisman since two summers ago when you led the country to this disastrous withdrawal. there has been seven suicides since along with the 13 dead because of what they witnessed there. >> thank you to darrell issa, the congressman out in california. he arranged this forum for the families because this is the first time, ever, we have heard testimony to congress from these families all jointly together. they want some answers. the parents were crying yesterday. they were wiping tears away as they were talking about how the government gave incomplete and incorrect reports to them. they said it was total disrespect. and they want answers. they said the biden administration has told them lie after lie. >> steve: they have. and so there they are gathered in escondido, california at the city hall. the reason they had this particular family where 13 gold star families of those killed back in 2021 were gathered there was a majority of those killed were assigned to the second battalion first marine regiment which was based in nearby camp pendleton. we are about to listen to kelly barnett and darin hoover. they are gold star parents of marine staff sergeant taylor hoover. and they made it very clear over the last two years from the biden administration after the helter skelter way they pulled out they have simply been lied to. these are families who lost american service personnel. they feel they deserve better. watch. >> my son, these 12 others left the earth thinking that their command cared nothing for them. >> the wounded feel that their command felt nothing for them. the survivors felt that their command felt nothing for them. i feel this as well. after seeing their friends die, picking them up off the ground, sending them off, them being told to destroy everything at the airport. they were told you got clean up the airport. we can't leave it dirty for the taliban. they had to clean up the errant. the airport. that kind of disrespect. that kind of hatred for our military. what kind of mess confusion, deceit, lost, angry, sad, heartbroken and disgusted. these are the feelings that the service members felt and are still feeling. these are the feelings i'm feeling. we were told lies. given incomplete reports, incorrect reports, total disrespect. there were gunshots. all i wanted to know it where my kid was. where he fell. how long did he last? did he fight? many i was told to my face he died on trump put out there. he spent his entire presidency trying to reverse everything trump did is the agreement that he said was already in motion. but this was not the deal that trump cut. if you talk to people like ambassador khalilzad, this is not the way it was supposed to go. and, also, they were going to adjust to things on the ground as they developed. and if you are going to tell me that donald trump would have done the same thing, you haven't really been paying attention to entrepreneurship. he do -- presidenttrump. he does not like to lose. our men and women would not have south. they would probably, i would imagine, in retrospect, empowered our snipers to take out the suicide bomber that was about to kill 13 americans and over 100 afghans. they knew he was coming. they told us he was coming. when the guy actually came, they had him in sights and did not give him permission to pull the trigger. this was something totally avoidable and tie it directly to what is happening now with recruiting. people that gave 20 years of their lives saying my kids are not going to do it. people who watched the way we left afghanistan said i don't want to wear that uniform. it's all from. this and when joe biden was given a report to tell everyone what went wrong an after action report, he would not hear, he would not read it. he would not hear it. when people offered to brief him, he said it was going to be too long. when they knocked it down to 20 minutes he said i don't have the time. that's how little he cares. that's what the families picked up. he said the president didn't care, didn't to want to hear their story. >> ainsley: the mom of staff sergeant hoover asked did he fight? when you allow your children to enlist and send them to another country to fight for us. you trust that their leaders are going to put them in proper situations and not in harm's way. she said that's not at all what happened. she said this was chaos. it was a lack of leadership. and her son's death could have been avoided. she said a witness did tell me the truth that he did not die on impact. so, imagine knowing that as a parent that your son is dying slowly there on the ground and that's what she had to learn later because they didn't tell her the truth. then we heard from cheryl rex who is going to be on our show later the president walked up to her and said my wife and i know how you feel we lost our son as well and we brought him home in a flag draped coffin. she said my heart started beating faster and shaking. i knew their son had died from cancer and they were able to be by their side. no more personal correspondence. >> brian: so the president lied. >> ainsley: my son has not been honored since. she said my son, his name has not been spoken since that day, since the commander-in-chief from the commander-in-chief, the boss of the military, or his administration. and this, to your point, if this were donald j. trump, this probably would not have happened, if it had, he would have invited all those families to the white house. he would have been in correspondence with them, and he would have honored those. >> brian: but the president lied. the president keeps on saying that beau biden died in combat in rickenbacker. they said he came home in a flag draped coffin. he didn't in either case why would you try to do that. >> ainsley: checked his walch on the lost their life that day you could hear their hearts breaking because they were reliving it. it was so awful. you know, the gold star families, we have had them on before. they tell their stories about how their children served proudly the united states. and these two lost that boy over there in kabul on that awful day. >> and the first thing that the u.s. government owes them is an explanation and the truth. and darrell issa and company, the members of congress who were gathered there are trying to get to the truth. they are trying to get the administration to spill all the beans. we have got that mom and step-father coming up with us just about 20 minutes from right now. also, you mentioned cheryl rex, she is coming up a little later in the show as well. a terrible day. the request to file the first under seal writing quote. special counsel states in conclusionary terms that the should be sealed from public view to comport with grand jury secrecy. the motion plainly failed to burden of establishing sufficient legal or factual basis to warrant sealing the motion and supplement. so a lot of legal terminology there. but all of this is happening while we are learning that another one of hunter biden's long time business partners eric schwerin visited the obama white house and vice president's residence at least 36 times between 2009 and 2016 and far more than >> no. absolutely not a single one of them no one moved from one post to another. they haven't gone down to a lower post. they haven't been removed from whatever office and put in another one. and they sure heavens haven't been impeached or resigned. and that does not sit well. >> brian: you know, kelly, another thing that burns you and burns me and i didn't have someone who died in afghanistan in kabul in that airport, is when admiral kirby gets up and talks about i didn't see chaos, and i see this as a success. i couldn't believe he is getting away with this. what's your reaction? >> i don't know what perch he was sitting on. maybe he was on a beach somewhere and drinking a marge rita. i don't know -- i don't know what perch he was sitting on. i think he should have talked with some people that were on the ground to get a better perspective. >> brian: and before i let you go. i know you said general milley and all these others should be let go, they should be fired, but they said that they advised the president not to do this. what is your reaction, darin, and real quick, kelly, about the fact that the military guy said this would be a disaster and not to do it and the president did anyway so they executed it does texonerate you want to way weigh in first, darin. >> it does not it. makes it worse for them because they didn't stand up for their men and their women in order to do the job the right way. they weren't -- they weren't doing it right. they could have said nope, it's not going to end this way. and fought the president a little bit harder and at the end of the day taken care of their men. >> brian: kelly? why do you need to file this suit? >> what they have done in the budget act they agreed not to use the hero's act from 9/11 and that's what the supreme court struck down. this is their second best attempt where they are trying to use the higher education act and just press releases to knock off 39 billion and then potentially another 116 billion on top of that. >> ainsley: yeah. and 475 billion over the course of 10 years according to wharton. now, your argument is congress needs to decide this. not the administration? >> that is correct. it's just basic civics. with an amount of money like this, you need clear direction from congress. that's what was decided in the biden vs. nebraska case by the supreme court. the biden administration doesn't seem to have learned that lesson. they have issued two press releases. press releases are not legislation. and until they do it right, they can't make this kind of policy change. >> ainsley: okay. now, you say if we do, this we will take away the students' incentive to participate in the public service loan forgiveness program and other nonprofits. explain how that effects all of us americans? >> sure. there is a program that has been put in place in order to forgive loans after 10 years if you go into public service. if you work for charity or government. if we knock three years off of that, it makes it a little bit harder or less likely that people are going to want to work in those kinds of places. and that has a lot to do with the standing arguments we are making in case. >> ainsley: you know, i never knew you all did that. that's wonderful. what a great program. encourages others to go into nonprofit and help others. >> obviously set up by congress, but it is a program that we in kato another plaintiff, benefit from. and local governments, state governments, all kinds of places. >> ainsley: patrick, doesn't this go back to you probably paid for your education. maybe you paid for your children's education. this is the government saying our tax dollars are going to pay for other children's education?
