the attorney for heuermann's estranged wife will join us in moments. first to bryan llenas live outside that courthouse watching all of this unfold just moments ago in river head, new york. hi, bryan. >> hi, martha. what we just heard, the suffolk county direct attorney ray tierney explain what happened. there was a 30-minute delay. the two attorneys spoke with the judge and the preliminary conference hearing began, lasted 5-10 minutes. rex heuermann in his black coat suit, khaki pants, staring ahead with no emotion as they discussed the fact that they have to begin the long process, weeks-long process of turning over 13 years worth of evidence involving these three murders that he's accused of committing to the defense. that process is going to happen on a rolling basis. the d.a. saying there's about eight gigabytes worth of evidence. none of the evidence that has begun to be turned over doesn't include the evidence that they removed from the house after that 12-day search there were at least two family members that fox has identified, sisters of two of the victims inside the courtroom today. obviously they have chosen not to speak to the press as of this moment. the people also absent was the two children of rex heuermann. they were not inside this courtroom. in fact, they have not visited the jail where rex heuermann has been over the last two weeks. that brings me to what asa has said to the "new york post." the estranged wife who filed divorce. she's upset about how the police ransacked her home. she says, i woke up in the middle of night shivering. my children cry themselves to sleep. martha, the d.a. said about the way they treated the home, she can do what she wants in terms of seeking remedy. martha? >> thanks, bryan. rex heuermann's court-appointed attorney speaking at the court. let's listen in. >> do you have any questions about the case that haven't been answered? >> any remarks about the fact that he's filed for divorce? >> i'm not representing him in that. i can't discuss anything about his divorce. >> last time you said he was emotional after hearing the charges. has it settled in. is there any change in his emotion since? >> well, now that -- when's been meeting with him at the jail, we're talking about substance as opposed to the initial shock. now it's gearing up for the defense of this case. >> does she believe her husband? does she believe he's innocent? >> you have to talk to her. i don't know. >> [question inaudible] >> yeah, i'm not trying this case in the press. this case is a case that we're going to try in a courtroom. the press has convicted my client without seeing a shred of evidence. so he doesn't stand a chance with the press. we're not going to try the case in the press. i doubt that any one of you for a moment have contemplated the possibility -- >> martha: okay. that is michael brown. the last time we heard from him, he said i just got this case about 30 minutes ago. now we're hearing from the defense attorney for rex heuermann with a little bit more information under his belt. he's met with his client a couple times. he said he was emotional when they first met. now he's focused on his defense. let's bring in bob, the attorney for rex heuermann's wife. very good to have you here today. thanks for being with us. >> thank you, martha. >> martha: i thought it was interesting in that quick interview with michael brown, he asked does he wife, heuermann's wife, think he's innocent. does she? >> well, the only thing that his wife knows about the charges is what is relayed by the press. like mr. brown just said, we're not trying it in the press. the only thing she's heard is from the media. she has no independent knowledge, no recollection of what the dates she was in the country, when she went on vacation 10 to 12 years ago. she doesn't have any judgment of guilt or innocence at all. >> martha: but she's not made any effort to speak with him? >> all the jail telephone calls are recorded. any in-person visitation at the time, i don't trust being not recorded either. we've had to limit her conversation to anything but the facts of the case. then we have not advised her to go in person yet. i don't trust the facilities not to report the conversation. >> martha: is she requesting a desire to speak to her husband? >> listen, at this point in time, she's trying to protect her children and put her own life back in order. how the criminal case will play out, she's aware it may take a year or two before there's a final result one way or another. >> martha: i guess what i'm getting at, when she had the realization that he was being arrested for these heinous crimes that have been plaguing them where they live for over ten years, is it your feeling that she felt, yes, this is probably what happened or that she's vehement in this -- there's no way my husband did this? they're divorcing. she's filed for divorce. >> she needs to protect herself and her own assets. whether she believes he's innocent or guilty, that will come out in time. any criminal case, whether it's your own family or a stranger, the media has the person convicted the men they're arrested. the evidence will play out in the courtroom. she's seen none of the evidence or heard the ed other than when played out on the media. they have destroyed her entire house. they took the mattress, the couches, cut the bathtub open, all the electronics. she's putting her life back together, showing strength for her children that relay upon her. >> martha: of course. it's hard to imagine the position that she and her children -- >> not to undermine the victims. the victims, we sympathize with their families. her and her children are also victims. they're blindsided with this. they have nothing to do with these alleged crimes. their lives have been destroyed. they'll never regain any life that they had. >> martha: yeah. you can say that again. mr. macedonio, thanks very much. we hope to talk to you in the future as this moves forward. thanks for taking the time to speak with us in the middle of this breaking news. thank you. >> thank you, martha. >> martha: criminal defense attorney mercedes colwin is here as well with me here on set. good to have you with us. what is your take on what we heard and watched play out over the last hour? >> it's interesting. that defense attorney was defensive. he's like wait, don't rush to judgment. there's so much here. 8 gigabytes of documents? that's tremendous. the more evidence gathered, the more hopes that can be poked. that's why he's telling the press, stand off for a minute. if you read the affidavit that supported the arrest of rex heuermann, it's shocking the amount of evidence that is now going to be the basis of the prosecution. yes, he's a suspect. yes, it's due process. yes, there's a long road ahead of us. you have to read the affidavit and see the deep coordination by law enforcement. not just the local police but they looped in the fbi. those resources, they have been gathering evidence over ten years. it's amazing what they have done. digital evidence, photographs. they linked burner phones to rex heuermann. we'll have to see how it plays out. there's a lot of procedural steps. there's a lot of fire between the d.a. and the attorney trying to fight for the suppression of some of this evidence. that's why mike brown was so adamant that we just don't know where it's going. it's a long path. stand off in terms of indicting my client just yet. >> martha: just think about his family. i don't remember other cases -- i'm trying to think of the other serial cases where you have a wife and two children living in the house. often these people are loners in many cases. this strikes me as an unusual situation. you can see -- we have the photos of their house that got turned upside-down and ripped apart. you can understand that they had to get under the bathtub, in the basement. we show the photos published today. how do you handle that answer an investigator when you have to get in there but you have these other lives? they said no. so now they're trying to come up with a new deal that the judge will approve. david spunt reporting live from the department of justice. hi, david. >> hi, martha. good afternoon. it's possible hunter biden will enter into a plea agreement with the government in a few weeks. may not be the plea agreement that hunter biden wants. may not be the plea agreement that the department of justice wants or u.s. attorney david weiss wants. tomorrow will be a week since they were chastised publicly by the judge. she said she wouldn't be a rubber stamp and told both parties to do more work. this was an unusual case and she wants an agreement that she finds acceptable. she gave them 30 days. that means the end of this month. she's a donald trump appointed judge. she's giving them a few weeks to figure out a compromise rooted in legal precedent. she said what was before her was not in legal precedent. the negotiations come on the heels of a transcribed interview with devin archer. irs whistle-blower gary shapley that worked on the hunter biden tax probe for several years said republicans and democrats need to continue pressing and asking questions. listen. >> they need to talk to as many people as they can. that's what we hope they do. devin archer was another step in that process to fully investigate the true links to where this ends up to. >> house republicans are demanding attorney general merrick garland answer questions and give information about the probe. they're asking for an explanation of why the department originally agreed to a plea agreement if other investigations concerning hunter biden are ongoing. they're giving him until august 14 to answer those questions, provide that force. unlikely garland will provide that information because it's an ongoing investigation that is run by the u.s. attorney's office. he's under immense political pressure to appoint a special counsel. he said it's not needed. we'll see if that changing given what happened last week in court. martha. >> martha: a lot of questions about how they reached a plea agreement when the investigation was ongoing. thanks, david spunt. this is interesting. let's bring in a former biden donor who went to prison on campaign finance and tax charges. in part he believes because his last night isn't biden. he filed a legal brief offering to help the court whether to accept hunter's newest plea deal and he joins us now. thanks for being here. good to have you. >> thanks for having me, martha. >> martha: so you had a liquor distribution business. now president biden was considering a run in 2008. as i understand it, hunter and beau approached you and said look, we need $75,000 for billboards. what happened then? >> i raised the money for them. then two years later, the government looked at a interview in the local newspaper. they investigated the contributions and found out that they were made through my company through my employees through the company. and that was a violation of the law. >> martha: so your employees -- did they encourage -- did hunter and beau biden said you can divvy this money up? a plan for the money? >> the person that did that was dennis toner. that's the campaign manager. beau and hunter talked to me about it at the bar after the third debate at drexel university. and then dennis came over and said, how many employees do you have that you can trust? i said all of them. have them write a check. they know what's going on. they knew what was going on then. that's why they have people like me that were considered bundlers or could raise money. they know what's going on. >> martha: what did they do to help you when the fbi came knocking? >> well, when the fbi came knocking, i being a law abiding citizen, i sat down and talked to him and was happy to do so. the minute that -- i cooperated with them. the mitigating factor is that i cooperated with the government. when dennis toner and i spoke and he said he didn't know what i was talking about, the next day that unsealed the indictment, wouldn't let me talk to the bidens and would not -- now it certainly makes sense what i was suspecting back then. certainly makes sense now. >> martha: what do you mean by that? >> well, they were protecting the bidens then, they're protecting them now and i think the evidence is overwhelming that when attorney general merrick garland said that he treats like cases alike, that's really what upset me. i can tell you no, sir, you do not. you do not treat like cases alike. that's why i filed my intent to file a brief called an amicus brief to help the court understand because she's required under statute 18 u.s. code section 355-3 a-6, she's required to enter a sentence, one of is seven factors that avoids desperate sentences of defendants that have been committed -- defendants with similar records that have been found guilty of similar conduct. normally that done to protect people from getting a sentence higher than they should get. but in this case, it's to guard against somebody getting a sentence lower than other people got. hunter's tax loss is in the millions of dollars. it's the highest that delaware has ever had aside from a drug dealer or someone charged with other multiple crimes, this is a misdemeanor with a tax loss of over $1 million. my tax loss was $361,000 and i was in jail two years. >> martha: it's extraordinary. as you point out, generally these plea deals are done with the highest chargeable offense. this is completely not that. this is really the lowest in many ways. quick thoughts and then i have to let you'd go. >> in fact, hunter and one thing i point out to hunter, he's the only personal charged with a stand-alone misdemeanor in delaware in the last 30 years. it's probably for history. nobody has ever been charged as a stand-alone misdemeanor with failure to file without a primary charge of tax evasion, which they have in the statement of facts that they report. he told his california accountants that he underreported income and tried to deduct things. so they certainly could do a more even job. i hope the court will consider my brief and what impact that people who have been through the process and who have been treated -- >> martha: it's a great point. yeah, you did your time for two years and now you'd like the court to take that into consideration when they look at this. judging all people equally under the law. chris tigani, thanks very much. good to talk to you. >> thanks, martha. >> martha: thank you, sir. so president biden has long insisted this about his family's business dealings. >> i have never discussed my business or their business. >> i have never discussed with my son or my brother or anyone else anything have to to with their business, period. >> martha: okay. so do those hold up? in light of what we now know? under the new scrutiny? after hunter's -- hunter biden's ex-business partner, devin archer testified behind closed doors at the oversight committee yesterday that more than two dozen times, over 20, i think that he would put his father on the phone in the middle of these business meetings with the ukrainian and chinese business leaders to "sell the brand" of what they were offering these companies. here's how democrats described those calls. >> beau biden got very sick early 2015. he died in the spring of 2015. at that point joe biden and hunter biden began to speak every day. the witness testified that over his ten-year relationship with hunter biden, there may be approximately 20 times when in one of those conversations hunter biden would put his father at a dinner, not at a business meeting, at a dinner that he was having if he happened to get ahold of his father and would ask his father to say hello to whoever was at the table. that was essentially the extent of it. >> martha: there you go. leo terrell fired up about this. he's standing by. first to chad pergram live with the latest. hi, chad. >> martha, good afternoon. besides our diametrically opposed characterizing what this means, republicans this is the most concrete evidence yet linking president biden to the business deals. >> if my wife or my son say hey, dad, come to dinner or can you come to dinner, one of the first questions out of my mouth is who is at dinner? you don't show up just because you're the vice president of the united states. it's influence pedalling. >> democrats say the evidence is circumstantial at best. democrats characterize the gop probe as a fishing expedition which is wasting time and money. they say president biden is not responsible for the conduct of family members. >> have they pointed to anything to suggest that joe biden engaged in corrupt behavior? no. on the contrary, hunter biden's business partner said yeah, he was on phone calls talking about the weather. exchanging pleasantries, which is not a crime. >> the next step in the process is the release of the transcript from the archer interview this week but that could be delayed. it's unclear where the investigation goes next. transcribed interviews prompt committees to call additional witnesses. >> there remains a lot of work to be done. it's important to continue to bring in witnesses. each witness that comes in provide more and more evidence and it cannot be denied. >> also a committee source says to expect bank records this month on transactions related to russia, ukraine and kazakhstan. martha? >> martha: thanks, chad. let's bring in leo terrell, civil rights attorney and fox news contributor. leo, great to have you here today. so you hear these very sympathetic -- i try to say, if you switch the names around to ot other politicians, would they be characterizing this the same way? we should feel sad that beau biden was sick at the time. he had to check in all the time like any of us would. put your dad on the speaker phone in the middle of a maining with ukrainian business leaders. leo? >> the statements about beau biden's death have nothing to do about pedalling influence. martha, it's easy for joe biden to make these statements outside the presence of being outside of deposition or under oath. if he was in a courtroom, martha, he would have been impeached in court based on those testimony statements by archer. what you have here is this is being done by a congressional republican subcommittee. where is the department of justice? griff jenkins reporting live from d.c. hi, griff. >> good afternoon, martha. what we're looking at now behind me is to see if anything is handed up. it will go through really why we think it could be possibly a decision coming soon. if you see behind me for the first time out here because we've been coming here since last week, martha, for the first time we saw the federal protection service vehicles being driven out behind me. that is something that we haven't seen before. we saw it this morning. we know, fox confirmed last week, there were preliminary security preparations underway for just such a situation. let's go back to why we were so close or watching things so closely last week. it was because on thursday it was the former president's defense met with jack smith and his counsel for about an hour at smith's office. that is usually that typical last step before you can see indictments. goes all the way back to july 16 when trump's attorneys were given that target letter. what we have learned from our sources about that target letter is that trump could be facing three areas of charges. deprivation of rights, specifically with regards to civil rights. there's also the conspiracy to commit offense or defraud the u.s. finally witness tampering. so we'll be watching those areas if indeed news comes. as you mentioned in the open, the grand jury met today. they have left. they've been trickling out the last hour or so. we believe they're gone. so we have to find out if they're going to hand one up today. it comes after we saw three new charges added in that alleged mishandling case out of florida. we'll see what the news brings. keeping a close watch. we'll bring it to you as soon as we get any developments. >> martha: thanks, griff. former president trump's legal troubles are not hurting him at all in the polls. in fact, he's way ahead of his republican rivals and doing better in hypothetical matchups with president biden than he was in 2020. let's bring in down schroen, polster and former clinton adviser and tomi lahren, fox news contributor and host of tomi lahren is fearless on outkick and now on fox nation. welcome to you. great to have you here. >> thank you. >> polling very interesting numbers coming from "the new york times" sienna polls. whether or not the former president has committed crimes, only 13% of republicans say they believe he has. let's look at the independents. 55 say he has. 28% say has not. 17% refuse to answer that question. when you look at where he is, he has a 37% lead over ron desantis in the latest poll. trump is really all of the other gop candidates combined. doug, explain that dynamic as you see it. >> sure. there's two things going on. the dominant dynamic that you alluded to, martha, is that among republicans, there's a clear sense that president trump is being victimized, treated unfairly, duel standard of justice between he and hunter a and joe biden. however, you want to put it, republicans agree with that and feel that the president is being treated unfairly and that the deep state, if you will, is trying to take him out of the race. hence his numbers have gotten stronger in the republican primary since the indictments. >> martha: there is, tomi, when you talk to people over the weekend or on vacation, a lot of people that i spoke with saying -- some cases, people surprised me. say the more they throw at him, the more i want to support him, this is something that i'm hearing from a lot of different places in the country. we see this in the numbers clearly. >> yeah, clearly among republican voters or would-be republican voters. the prevailing narrative out of team trump has been i am getting screwed over. will that message of i'm getting screwed over translate to independent voters that believe maybe they are being screwed over by the country and the leadership of the democrat party? that's where i'm concerned. further more, when you look at the millions, the $40 million that the trump campaign has hemorrhaged in legal fees, that's another concern. they're burning through money on legal fees for him and advisers and swept up in the legal snafus. i'm a little concerned. i talked to you about this before. it's easier for me on twit tore say trump is the guy, he can easily sail in. when you look at the general election, joe biden who is scandal ridden, elderly, not able to form a sentence is in a dead heat with donald trump who has his own problems. so we look at a general election and you see a dead heat, that concerns me a little bit. i don't think we can just say, yeah, donald trump has this one in the bag. >> martha: he's certainly -- when you look at the republican side, there's nobody touching him at this point. that's pretty clear. tomi is right, doug. when you look at the head-to-head, this is tied. 43-43 at this point, a national poll of registered voters. it's not a likely voter poll. most people don't want either one of them to run again. but none of these other people is cutting through the noise out there, doug. >> that is correct. tomi put her finger on what the real problem that the trump candidacy faces and the republicans face, which are independents. given the number of independents that said president trump did something wrong, i think it was 55%, and the mid-term elections from 2022 last year when democrats did very well with independents in selective contests, these given the democrats hope not withstanding the challenges that joe biden and his administration faces and that times poll had biden's approval at 39%, which, you know, i've been at this business a long time. that is very low. that is warning time. that means that his message is just not working. >> martha: let's play this from ron desantis talking to bret baier about the importance of showing up at the debate on august 23. watch this. a quick thought from you, tomi, if i may. >> you have to earn this norm nation. nobody is entitled to it. you have to work. the debates are part of the process. if the election ends up about all of these side issues and it's a referendum on trump, biden will be in the basement again, hiding out, no scrutiny and he will get away with it again. >> martha: tomi?
