a rope falls other rights and supreme court precedents are in jeopardy. >> every other decision related to the notion is thrown into question. it goes far beyond the concern of whether or not there is the right to choose. there are other right to marriage, right to determine a whole range of things. this is quite a radical decision. spieth let's bring in constitutional law he is the author of the book supreme disorder traditional nominations the politics of america's highest court. good to see you again. first let's talk about this leak and how much damage this has done and how much of its credibility but. >> we will not know for a while this is literally an unprecedented situation you have a full draft of an opinion let alone in the biggest controversy and jurisprudence that comes out before the opinion is decided. a lot of loss of institutional trust the internal dynamic of the court how much clerks are trusted perhaps is in disarray. we are in the eye of the storm still paid will not know for a while with this actually means. paul: chief justice of course denounce the leak and asked the marshal of the supreme court to investigate. but were you surprised all nine justices did not unite to issue a statement condemning it and without have made a difference? >> i think they're still probably still shellshocked. i heard justice's been taken to an undisclosed location to us on the others and other security ramped up. i would hope all nine of them issue a statement soon, this coming week i would be surprised if that does not happen actually. so far it's there at dealing with new situation trying to figure out how to limit the fallout on top of obviously the fallout of the decision it self and what it means for abortion in america politics. >> you raise this issue might startle the audience that justice has been moved for their security. i've heard it's been stepped up for the court in general. we live in fanatical times, okay i know that. all it takes is one crazy person to do some harm. but are you saying there is really an increased level of concern about that potentially happening? >> i mean we are in uncharted waters unfortunately. the activists who see this as armageddon, as something that is completely illegitimate beyond the pale of desperate times require desperate measures there's a publication of all the justices home addresses on a website. i hope for the best but you have to plan for the worst. paul: just tell our viewers a little bit about how the court works. you have a draft like this assist back in february now now it is early may. the opinions typically would be issued in june sometime. how much do opinions change from a draft like this typically through the end of the process? >> it can change substantially. it can change just in terms of correcting typos or toning down certain language but it really depends upon the case. i imagine it's possible this is still the latest draft the majority and justice are waiting for defense to come up they will then respond to certainly there is no response and this a draft i would expect a final version to go back to that. paul: that often happens. we think the impact in terms of shifting opinions achieve that if anybody thanks is going to change the views on the court they are sadly mistaken. do you agree with that? >> i think so. i doubt any of the justices will change their views. how could this change their views really. it is unpredictable or however the responses to this kind of decision that will happen regardless whether the final decision is issued without a leak or with one. and i think all the justices are fully political savvy of what everything means without an early disposition. paul: i want you to address what the president said this week about essentially if roe is overturned, this is going to lead to other precedents involvement rights, falling like dominoes because of the right to privacy that was in underpinning of a row will now have fallen, respond to that, is that likely? >> i think it's wrong for at least three reasons. one is the explicit text of the draft disclaims it affects any other rights. i don't think there'd be five votes to change those precedents whether respect to same marriage, comfortable contraceptives, pornography a lot of things could potentially be affected. number two is the logic of how abortion is different that it involves potential unborn life. a human being of some sense. none of the other issues regarding culture wars or privacy involved that. and finally the bear politics of it. there is no great groundswell to get rid of interracial marriage or criminal laws contraceptives. even gay marriage the approval of that has continued to increase in society. where in the 50 years since roe v wade came down if anything the battle over abortion has been less settled and more contentious. paul: wrote did not settle anything it's more contentious were these other issues really have to some significant census settled the issue. ilya shapiro thanks much for joining us appreciate it. we come back a closer look at the political follow-up from this week supreme court leak is democrat see an opportunity to change the subject. she and that means long-lasting clearer skin and fast itch relief for adults. with dupixent, you can show more skin with less eczema. hide my skin? schumer is going to bring this up i assume nancy pelosi will bring this bill kyle described up in the house for this talk about breaking the filibuster for this. there's talk about again packing the court. is any of that, at the national level likely to happen or is all of the action, serious action going to be? >> not in the short term because for now you have the traditional protectors of the filibuster joe manchin kyrsten sinema saying they will not change but although those issues themselves will be on the ballot two, paul this fall you have a number of democrats running saying you need to elect me to the senate so we have a greater majority to get rid of the filibuster and make these dramatic changes. out in the states i think you are right biggest issue here is going to be an governor's races and state legislative races those are going to be the politicians putting -- having to put in effect to these new wrote laws the post wrote laws how are they going to handle abortion in their states? i think it is a bigger question and a bigger risk for democrats, can you really sustain the level of outrage, can you really put abortion is the number one priority on the ticket in federal elections and sustain that over six months? they tried that in virginia against glenn and in the end polls showed abortion was the top issue for about 5% of voters in that race could be a little different this opinion becomes reality. but again it's a big bet. stick kyle what about the implications for the court? i do not mean the internal deliberations which could increasingly be fraught. i'm thinking outside with this credibility because we found this kind of a leak really undermines -- to potentially undermines the confidence the public house and the court for 20 fewer institutions than is actually retained some public trust. set an explicit goal here some of the critics of this? >> it seems to be. schumer and pelosi have been running explicitly for years against the supreme court. it is notable i think one thing they should consider is the way that judges even judges appointed by president trump turned back his claims about a stolen election. i understand they will disagree with this decision if the supreme court overturns roe v wade. an independent judiciary is the guarantor of all the rights that are in the constitution is the guarantor of free elections if they start going down the path of trying to delegitimize the court turned into a more political body to pack the court put more justices on it think that's a dark road to go down. >> liberal judges may be have a majority at the court sooner than we all might think. when we come back trump hopeful wins ohio republican primary early test of the former president influence in the party. so is a sign of things to come as republican voters head to the polls in pennsylvania and georgia later this month. customr car insurance, so you only pay for what you need. if anyone objects to this marriage... >> if you've got in a written a race like ohio seven counts five of whom are significant players is not necessary going be the case in idaho over the governors race there he has endorsed the lieutenant governor consists sitting governor there's 11 canids in the primary but there are really only two significant ones the presidents endorsement may or may not be positive adult think is going to an ido for example. nebraska is coming up there are three significant candidates they are. some people say four. he has endorsed one i'm not sure it's going to be as positive there. let's step back for a minute. it's an interesting observation and national review getting involved in so many primaries is moving himself from being to the leader of what you called a faction. does he really want to do that as he approaches 2024 because there are going to be hurt feelings left in ohio there's going to be hurt feelings in any state in which he endorses and win or lose us people who backed candidates who he did not endorse some are going to remember and a lot of them are true pro trumpet we saw in ohio. >> think arguably the race trump cares most about is maybe georgia, the governor's race he recruited david for the former senator to run against the governor current governor brian kemp. who did not do enough donald trump things to help overturn the election in georgia. kemp is doing very, very well there. how do you explain that? >> first of always been a good ineffective conservative governor bird second of all in the last five years as he began running for governor even before that is a statewide official before then. two or three republicans gathered together anywhere in georgia he was likely to be there. not the same for david pretty wonderful guy but when he ran and served as united states senator he became very distant from the state kemp has a lot of reserve a people who know him, believe him, understand he is done as governor appreciated think you be more effective given a second term then putting david perdue in. you are right the polls are showing that races widening and president trump is both endorsed david perdue he has also gone in and held a rally in the state. i'm not certain there's much more he can do that's going to be a big one. it's going to prove something which is the president endorses a lot of people he was crowing the other day on the day of the ohio and indiana primary city had 22 winners three of the winners were statewide officials in ohio who had no opponent ten were five congressmen in ohio and five in indiana who had no opponents in their five congressmen, fort congressmen in ohio and one in indiana who had virtually no opponents no serious opposition one statewide elected official 19 of the 22 endorsements he made are people who were arty going to win their primaries and in many cases because they had no primary. people are going to remember the losses more than their member the winners are not going to member he endorsed steve in cincinnati and an uncontested primary but they are going to remember if brian kemp wins the president took on brian kemp and lost. that's going to weaken his whole hold on the party overall three. >> is going to be interesting to watch things carpet still ahead tumultuous week on wall street's concerns over inflation and rising interest rates grow. is the fed doing what is needed to tame soaring prices?ow ♪ and provides guidance. connected to your health and your phone. visit onetouch.com today. >> think one of the things that happened on wednesday is j powell created unforced error by saying very explicitly that he was taking 875 basis point hike and hedge fund rate off the table. and i think the market thought well maybe he's a little more dovish than we expected or that it is how it has been read. of course he did not need to do that. what he really needed to do was say the markets were making the 50 basis point hike right now and we are going to continue to do whatever it takes to tame inflation that is the message the fed has to be putting out there. currency the only thing that keeps things anchored is the credibility of the fed. his remarks are very important i think he ignited a lot of uncertainty there was a little bit of fear of missing out. if the fed is not going to be so tough, maybe we should get in there and not miss the next leg up and then after the whole thing sunk in, people headed for the exits. paul: is the larger message here, in the market decline on that and continuing market decline really since january and has been a significant decline, that inflation is bad enough the interest rates are going to have to go up significantly former fed chairman not chairman said it's going to have to be above 3.5% before this gets under control. >> will yes. that is the question everyone is dealing with right now. jerome powell has tried to keep the market study by saying even though we let inflation get out of control we believe are going to have to go to about 3% he wants the markets to know it's not likely to go above that. so they can make their determination about how much businesses are going to be affected by rising borrowing costs. the problem is we do not know how much inflation is going to increase from this point and how long it's going to take for it to start coming down. and so the possibility always exists as you said richard address today that inflation is going to continue to go higher than what the fed currently projects a. if that is true that means powell will relive shot himself in the foot by laying down such a firm marker what his plans to it's important for him to be able to adjust based on what the movement looks like a month over month with prices. rich: america, it sounds like uncertainty here is one of the big problems. we are dealing with the situation we have it in a very long time inflation this time, first time in 40 years. they are raising rates to cope with it. they're also peering back the balance sheet, the bond purchases that's an additional tightening move according to what the fed thanks. so everybody flying blind here, trying to figure out just how high the fed has to go and what impact that will be on the real economy. >> i think of that the amount of concern and market reflected by the drop in fall last week is really a reflection of the fact that market knows there is a problem between wages and inflation. there's more and more pressure to increase wages because they are not keeping up with inflation. people compensation is going up and inflation is going up faster. we have that kind of situation you risk getting into a spiraling effect. that means the fed will have to get more and more hawkish. i think that's really what the market is afraid of. as you say, if the fed has to go even further than what it has already signaled, that is going to have a detrimental effect on the real economy the capitals going to become more expensive we are probably meant a tip into a recession. >> there goes that word. still ahead the biden administration defends its newly created disinformation board amid fears of a a free-speech crackdown. rer. that's right, jamie. but it's not just about savings. it's about the friends we make along the way. you said it, flo. and don't forget to floss before you brush. your gums will thank you. -that's right, dr. gary. -jamie? [ sighs ] i can't remember. helen knew exercise could help her diabetes. but she didn't know what was right for her. no. nope. no way. but then helen went from no to know. with freestyle libre 2, now she knows what activity helps lower her glucose. and can see what works best for her. take the mystery out of your glucose levels, and lower your a1c. now you know. freestyle libre 2. now covered by medicare for those who qualify. >> the working group that we named disinformation governance board, does not have operational authority does not have operational capability. our mission is to protect the security of the homeland. and we address disinformation when it threatens the security of the homeland. >> homeland security secretary this week defending the biden administration's newly created disinformation governance aboard which he says it was formed to warn americans about falsehoods from foreign adversaries including russia, china, and the cartel that struggled migrants into the united states. critics fear the board will play the role of a national fact checked or government agency put in charge of refereeing domestic political debates white house press secretary jen psaki says the panel will be apolitical. ask the mandate is not to adjudicate what's true or false online or otherwise. it will operate in a nonpartisan apolitical manner it's basically meant to coordinate a lot of the ongoing work that is happening. >> we are back with chemist russell and kyle peterson. so kyle, why don't you give us your view of how credible, persuasive secretary mayorkas explanation of this board is. >> well it is hard to know because he is saying it has no operational capacity now. that is after all the criticism that's impossible to know how much of backtracking is going on inside. i will say some of the stuff they are claiming that it will do is perfectly legitimate if the biden administration wants to be more aggressive about calling out russian disinformation are more aggressive about countering whatever the cartels in mexico are saying, more power to them. the department of homeland security saying already that stuff is being done and this new governance board is just supposed to coordinate the policies and make sure everybody is talking to each other in the correct away. maybe that is true this is a pr problem of their own making because they created this board, they gave it an ominous name if it was called the interdisciplinary policy coordination working group we probably would not be having this conversation. they really did not explain what it was going to do and then they put somebody in charge who has publicly called for stricter controls on what people are saying online for example she said early in the pandemic in march of 2020 she hoped tech platforms would stop accepting advertising for masks because that was a time at which masks were not supposed to be part of the response or covid. i think they have a lot of cleanup to do here maybe the best thing to do is shove it down and start over. paul: that is an important point, kim we don't really know how this would work. are they going to track foreign sources of information and if something is on the web or on twitter, on platforms to the and then call it out and say we are telling you this is in fact information we are supposed to believe it i guess this is in fact the case. but it is pretty easy we south the 2016 election campaign or foreign operators to blend into domestic politics. that is where it will get pretty dicey. >> right it's not just what actions isn't going to take but also what is it going to define? how's it going to draw the lines of protecting? or the scary things is a woman they seem to tap if you look at her prior work she has done for instance the wilson center there been a working paper she pretty much defines everything as a question of national security if you make what she considers eight racist comment or a misogynistic comment that affects national security. that is with the scary thing about this from the top level. it does not even a matter in the end about how they draw those lines the tendency and the temptation for bureaucrats to wade into this content moderation world which is another word for censorship, a lot of people understand how powerful that tool is it is inevitable if you have a board like this it is going to wander into that field. i would just build on kyle's point i would shut it down and keep it shut down. no good can come from this. paul: that point, kyle relates not just to this administration but to a republican administration. i think the trump administration and set this up under democrats of the protesting and saying what is this all about and so would we i think. do we really want government actors basically defining what is disinformation for the american public? is it truly malign a foreign attempt to poison somehow what americans think. you kind of what the government out of here yet there are a lot of republicans who say let's give the federal trade commission more power to monitor the platforms. >> right in particular i don't think you want the government doing it behind-the-scenes the department of homeland security at the press office the white house has a press office if they want to take issue with something that is circulating there completely free to do that. part of what the issue is here there's been a lot of reporting amid covid about the federal government flagging things as misinformation for facebook, for twitter, for social sites we don't really have a lot of visibility but those conversations look like, how much leverage the government was applying how much the social sites were ever pushing back and saying we don't think that is misinformation there are real concerns here. as far as the free speech point goes the reaction to this board i think shows the american public will not stand for this kind of thing going on. and if republicans take congress here in november i expect he'll probably try to defend this board right away. smith i'll be my expectation till the president could say he will veto it but i don't know think they would defund it. when we come back the white house steps up his push for private sector unions workers at one amazon warehouse in new york reject a bid to organize. when tired, achy feet make your whole body want to stop, it's dr. scholl's time. our insoles are designed with unique massaging gel waves, for all-day comfort and energy. find your relief in store or online. sweet vice president, here is hosting a meeting thursday with organizers representing amazon, starbucks and other employers as a biden administration up its support for unions. the meeting come as amazon workers at a staten island warehouse voted against forming a union this week. a blow to organizer who has successfully won a union vote just last month at a nearby facility. we are back with current kim strassel. what do you make of the mixed results at amazon? that victory by the union a while ago it was hailed as may be a sign a waiver was building. but i guess not because i think you are right. if you look over the past couple of years there has been a remarkable moment for the national labor movement we have seen big companies go on strike in the past couple of years that includes a john deere, kellogg they secured a pretty big gains for their workers obviously there been high profile movements to organize new companies we have seen starbucks workers starting to succeed at organizing stores and the biggest one has been amazon without the first successful organization of an amazon warehouse just a month or so ago. a lot of people thought this was going to put a lot of wind in the sales of labor organizers and just down the street about four minutes from the warehouse success will unionize deliver month ago they failed to persuade their colleagues just down the way to join up it really shows the labor movement is something that plays out plant by plants, location by location a lot of workers doubt if the union will be able to deliver they are being promised. paul: kim, amazon hasn't founded and well he's not ceo he still plays a role, jeff bezos knows who's a politics are left essentially owns the "washington post" very prounion at least in their editorials of reporting. how do you explain that? [laughter] try explaining some of these left-leaning billionaires. look it is right to of those. because it is bad for business and generally. usually bad for workers which by the way a lot of workers understand that is why you're seeing the results you see. if you look at unionization over the years, paul the heyday for private sector unionization was in the 1950s about 35% of all workers are unionized now at 6% most workers don't like it they know it won't not not necessarily material benefit them. i think you do end up with a lot of corporate ceos especially ones who maybe have a mouthpiece they want to talk the talk and their editorial boards they give you their sound bites but in reality there is an understanding in the business world of just how much this raises costs and how it actually makes it harder to hire more people and provide better benefits to the ones you have periods. paul: could it be the union movement is actually winning in the sense even if it doesn't organize the specific worksites it is getting the companies to raise their wages. amazon very prominently has raised wages across the pandemic. howard schultz the farmer and now again head of starbucks is were going to be raising wages for our coffee shop workers. >> that is possible in the specific cases you mentioned it is very likely the threat or presence of union opposition within the company accelerate the timeline for starbucks and amazon to increase their pay. but remember, we so wages rising at a fast level especially for lower skilled workers with me for the pandemic over the course of the past couple of years we've had inflation we have seen a wages continual rise nominally because these employers have to stay competitive to try to keep their workforces staffed. wages are being eclipsed by inflation. it is difficult looking across the broader economy to the surge how much of the upward pressure is coming from labor movement i would not to give them too much credit. >> kim let's talk about the white house meeting with these organizers that is really extraordinary in my experience for the white house to focus so much attention on a particular organizing campaign. usually the present stay out of this kind of labor dispute unless there is a strike in some danger of a broader risk to the economy. what explains this white house devotion to the union cause?
