[people shouting] >> in this draft opinion justice aloety roe was egregiously wrong from start, reason was weak and the decision has had damaging consequences. in december the justices heard arguments over a mississippi state law banning abortions after 15 weeks. roe versus wade decision made abortions legal nationwide up to 24 weeks when a fetus is determined to be able to survive outside the womb. the mississippi case highlights states rest pekt to court precedent. this does not mean abortion would be illegal with the snap of a finger immediately in every state. individual states would have the power to decide whether or not to allow abortion. that means that they may remain legal in california but illegal in nevada. >> it would trigger the laws in over 20 states that have already said that they will outlaw abortion in their state. it will create a patchwork of laws across the country. >> president biden weighing in this morning with a statement. he said in part at the federal level we will need more pro-choice senators and a pro-choice majority in the house to adopt legislation that codifies roe that i will work to pass and sign into law. codifying meaning turning roe versus wade into law across the street at the u.s. capitol. a tremendous amount of pressure on members of the house and senate ahead of the mid-term elections. i suspect the entire narrative of this 2022 mid-term election season will change because of what came out of this building in that leak. sandra. >> david spunt outside of the supreme court. meanwhile there is plenty of reaction to the unprecedented nature of this leak. supreme court is known for its deliberative secrecy. legal observer jeffrey toou bin says he has never seen anything like it. >> there has never been a leak of a vote much less an actual opinion, much less in the case of this significance. the idea that a decision of this magnitude could leak is really a shattering experience for the justices and the court. i really don't know how this institution will recover. >> bill: james langford of oklahoma sits on the senate committee on homeland security and government affairs. welcome. mitch mcconnell called the nature of this leak shocking from the senate floor. what are you and your republican colleagues discussing this morning in the wake of this historic leak? >> first of all we don't know if this is the final opinion or how factual this really is. if it proves to be an actual leak all the statements made just from from many are true. this is not only epic and earth shattering and trying to get a leak out of the supreme court, it will destroy trust within the body. who whoever leaked it out has an agenda that they are trying to accomplish pushing toward more mob rule. the justices work in quiet and secret because their focus is on the law, not where things are opinion. their push is and even from the leak it's interesting to note their push is to say this is a difficult political issue. it should be resolved by the people through the legislatures both federal and state. not through the courts. the court is supposed to be insulated from this and whoever leaked this out is trying to bring politics to the court. >> mitch mcconnell saying in his statement the leak aims to elevate mob rule. a brand-new statement in my hands at this moment where senator lindsey graham released a statement saying in america the radical left is hell bent on reshaping institutions that have stood in the way of the outcomes they desire. this is a portion of his statement saying they want to pack the supreme court to change the current conservative nature of the court achieved through the democratic process. to your earlier point, senator, you've got members of congress saying people should take to the streets across the country. bernie sanders wants to end the filibuster. senator blumenthal says we'll support people that resist. turley is making the point this leak is a malicious act. to that you say what? >> that's clear. there is an agenda in this. someone is trying the accomplish. we don't know who that someone is and how it was leaked out there. we should know in the days ahead and will know. what is whispered in a secret place will one day be shouted from the rooftop. we'll know the motivations on this eventually. it is interesting to see chuck schumer wanting to bring a bill to the floor to have a vote to be able to codify roe. interesting enough as the what the court is saying should happen. this should be resolved in the legislative body, not in the court. obviously i will adamantly oppose any kind of codfication of roe and avans on abortion. i believe every child is valuable and protected and honored. right now democrats are already talking about we'll bring this to the body for a vote. actually that's the same thing the court is actually saying. the court is saying this should happen in states and federal legislatures. decided by the people through their elected officials not through unelected judges. unelected judges say what the law is. elected officials create law. >> what do you want to see happen as far as an investigation? >> chief justice would be able to determine where the leak came from. they should go top to bottom who handed this kind of paperwork over. if it proves to be accurate on that and get it out. >> are you confident we'll get a name? >> i am confident it will come out in the days ahead. >> moving on from the leak to it being a ruling as we have not. i specifically have not been waved off this draft that does indicate the supreme court may be moving to overturn roe versus wade. what are implications for the country and party coming up with the mid-term elections? >> put it this way, sandra. hunter biden is a domestic issue. on the surface we won't look into that. wait a second. it is classic russian disinformation. therefore, it is in the purview of the disinformation czar. anything that pops up you can say looks like china did it even if it involves an american citizen. everything could have a foreign entity to it because they don't know. it could be disinformation so when in doubt, suspend the accounts that do it, stop people from reading it. i actually don't want anyone screening what i read period. i think the average american, the pushback so their lives are regulated for the last two years. the last thing we want is information regulated by some would be musical theater star that says she should be trusted even though her track record reveals the opposite. >> sandra: interesting. last question on this. oh, i'm told president biden is speaking. let's listen. >> president biden: the draft doesn't represent who will vote for it yet. i hope they aren't enough votes for it. the main reason why i worked so hard the keep him off the court reflects his view almost -- anyway, look, the idea that -- it concerns me a great deal that after 50 years we'll decide a woman doesn't have the right to choose. the limit the supreme court decision, number one. but even more equally profound is the rationale used and it would mean that every other decision the thrown into question. i realize this goes back a long way but one of the debates i had with robert bork was whether griswald versus connecticut should stand as well. the state of connecticut said the privacy of your bedroom, husband and wife or couple could use contraception. if the rationale of this decision as relief were to be sustained the whole range of rights are in question. a whole range of rights. the idea we're letting the states make those decisions would be a fundamental shift from what we've done. so it goes far beyond in my view. if it becomes the law and if what is written is what remains goes far beyond the concerns of whether or not there is the right to choose. it goes to other basic rights. the right to marry, the right to determine a whole range of things because one of the issues that this court, many members of the court, a number of the members of the court have not acknowledged is that there is a right to privacy in our constitution. i strongly believe there is. i think the decision griswald was correct overruling. i think the decision in roe was correct because of the right to privacy. there are limitations on it but it cannot be denied. >> do you think that it has irrepably hurt the court. >> if this decision holds, it is quite a radical decision. and again, the underlying premise. i have not had a chance to thoroughly go into the report. but it basically says all the decisions relating to your private life, who you marry, whether or not you decide to conceive a child or not. whether or not you can have an abortion, a range of other decisions, how you raise your child, what does this do -- does this mean in florida they can decide they'll pass a law saying same-sex marriage is not permissible? against the law in florida? so there is a whole -- a fundamental shift in american jurisprudence. >> the filibuster to codify roe? >> i'm not prepared to make those judgments now about -- but, you know, i think the codfication of roe makes a lot of sense. look, think what roe says. roe says what all basic mainstream religions have concluded. that the human life and being is a question, is it at the moment of conception, is it six months, six weeks, is it quickening like aquinas argues? the idea that we'll make a judgment that is going to say that no one can make the judgment to abort a child based on a decision by the supreme court, i think it goes way overboard. >> thank you, thank you guys. >> what does it mean for the democrats' argument in the mid-terms? >> president biden: i haven't thought that through yet. >> do changes need to be made to the court in light of this if this -- >> president biden: look, one of the reasons why i voted against a number of the members of the court they refused to acknowledge there is a ninth amendment. the right to privacy. fundamental rights are affected by that and i'm not prepared to leave that to the whims and the -- of the public at the moment and local areas. thank you so much. >> thank you, guys. come on, guys. >> sandra: all right. that was the first vocal reaction from the president. he has put out a statement on the supreme court leak and focused now former biden campaign surrogate and the executive director of the america rising pac. kevin, are you surprised or shocked that the president didn't address the leak from the supreme court itself in those comments? >> i'm not necessarily shocked about the leak. i do think it's a process story. the fundamentals of what the leak has done in terms of this opinion being released something that has been circulating around the court since february is the larger story here. the ramifications not just for women in this country but also the political ramifications now that we're 189 days away from this election. obviously democrats and the president are focusing on the ramifications. the huge ramifications of what this opinion will do in terms of fundamentally changing our society in this country going forward. >> sandra: some might disagree this isn't the way things are supposed to work. we aren't supposed to have a significant leak especially from the supreme court even dick durbin was just speaking a moment ago, a democrat from illinois on the leak. i don't condone the leaking of internal supreme court documents. he just said this. we have this sound, listen. >> i don't condone the leaking of internal supreme court documents. senator kennedy is correct, it is unprecedented. i don't know who leaked the opinion or why. but i know that today women and men across this country are grappling with the very real concern and yes the fear that they may lose a critical constitutional right in just a matter of weeks. >> sandra: very clearly stating on the record he does not condone the leaking of the internal supreme court documents. jonathan turley calling it a malicious attack on the court saying it is an egregious act. mcconnell calling the leak shocking to have this come from our highest court. should the president address that specifically and be announcing investigations into how this could happen? >> well, he clearly wasn't willing to go that far in the comments that we heard. but if these democrats think this is so shocking and appalling and a concern for the future integrity of the court, which i would agree with, they need to look to their leftist activists and tell them to knock it off. by all points this is where this might come from. we've seen them try to take these actions to heavily politicize these. the kevin's point trying to move on to the process point of the leak to the ramification. one thing i thought was shocking in the president's comments he pointed out and underscored how far the democrat party has gone to the left on the issue of abortion. joe biden himself when he was a senator in 1982 voted in support of an amendment that would have given states the right to overturn roe versus wade and to hear him today and how giving his party line vote there and i would note this is the start of primary season for the mid-term elections. these democrats and these target states will have a tough time reconciling their far left view on this issue which is far, far to the left of where so many voters are, much more moderate on this issue. this will be a really interesting thing to see for the democrats. their activists have hijacked the issue and it is trouble for them in november. >> sandra: more news from the president a second ago. i hope there is not enough votes for it, he said. this is a fundamental shift in american jurisprudence, he said. also saying if this holds, he called it a radical decision from the supreme court. meanwhile biden has a mixed record, kevin, when it comes to the issue of abortion. in 1974 the then senator told an interviewer a woman should not have the seoul -- sole -- and then said the government doesn't have a right to tell women to control their bodies. he hasn't been consistent on the issue. >> this president is a practicing catholic who believes strongly in the church's teaching. this is something that he has grappled with over time but recognizes where church and state meet and where they diverge. he has been committed not just as vice president but as president to a woman's right to choose and spoke at andrews to the issues not just beyond abortion but regarding any kind of privacy notion with regards to marriage, to contraception access and the ramifications go far beyond if this decision holds and is the opinion of the court, affecting all facets of american life. cassie's point is a good one. the vast majority of americans support this right. 4 in 10 support roe. this is an issue that has been decided 50 years ago that has been the law of the land for five decades. >> sandra: a fair point. polls show that while most support roe and restrictions on abortion important to point out. polling shows that americans overwhelmingly want some sort of restrictions on abortion overall 71% of all adults, 93% of republicans, 49% of democrats, cassie. >> yes, such an important distinction because again today's democrat party you have former chair of the dnc saying there is no room for a pro-life candidate in today's democrat party. that is far removed from where the majority of americans are who might say this is where i personally stand but i want some restrictions and you have both the federal and state level democrats trying to remove all restrictions. the science doesn't back that up. people's hearts and minds don't back that up and you certainly can't get away i'm a devout catholic but we have to have a separation of church and state. that isn't how it works. the president has moved far to the left alongside his party and people don't buy the devout catholic cop-out. >> sandra: we continue to get reaction. republican response from lindsey graham earlier, we got response from the chief justice and now krysten sinema, the arizona democratic senator released a statement saying a woman's healthcare choices should be between her, her family and doctor, overturning roe versus wade. no specific comment if her statement on the fill busfer. we did hear that from bernie sanders earlier. kevin, i want to go back to the chief justice statement. i read it in its entirety at the top there was news. it cited a news organization published a copy of the draft opinion in the pending case he did note that justices circulate draft opinions as a routine and essential part of the court's confidential work. the document described in yesterday's report is authentic news but we were waved off thinking it wasn't authentic it does not represent a decision of the court by the final position in the final issues of this case. do you believe the left wants to influence those certain justices? >> yes, good question. we don't know who is behind the leak. if it even came from the chief justice's office. we know he isn't fully on board from this leak with the majority of the opinion. i think that process has to play out. president biden should not -- and the executive department should not have a role in that. this is a separate branch of government. in that statement and it is important to share that with the virus he has directed the marshal service, the law enforcement agency within the department of justice and the article 3 constitution branch of government to carry out this investigation. this isn't something for the executive branch or legislative branch. they should police it on their own. there should be an investigation into how this happened. certainly going forward. to dick durbin's point, this should not have happened. >> sandra: indeed. they know there will be with. at the conclusion of job robert's statement i've directed the marshal to investigate the source of the leak. if there will be consequences for that person. to send a message that shouldn't happen in this country. >> i think that's one thing we can all agree on there needs to be a strong consequence whether it's disbarring or depending who it is something that falls in line with the highest consequence possible to maintain the integrity of the court. and to get to that why. is it to try to change the hearts and mind of justices? not sure that would be effective or to say hey guys, you democrats may lose your majorities come november so you better codify this while you have the chance? are they trying to throw out that warning flag to them? that remains to be seen. but certainly for those that this is their number one issue it will be a base energizer. i have to also say that we've still got an economy and inflation to focus on, too. so the news of today we still have to give voters credit there will be a lot more pressing issues as well. >> sandra: something they would have to appreciate not having to focus on. diesel prices hitting record high. it will worsen the supply chain and lead to a very difficult decision on the part of the federal reserve to bring those prices down for the american people. meanwhile to the politics of this, the ramifications, the implications for the mid-term elections, the dnc is offering this preview of how it says the issue will affect november's mid-term elections quote, make no mistake reproductive rights will be on the ballot and the mid-term election is more important now than ever before. voters will make their voices heard. we'll fight back with everything we have and republicans will have to answer for their party's relentless attacks on americans' rights. senate majority leader chuck schumer echoed those sentiments last hour. >> this is a dark and disturbing warning for america. the elections this move will have consequences because the rights of 100 million women are now on the ballot. to help fight this court's awful decision, i urge every american to make their voices heard this week, and this year. >> sandra: could i get your reaction to that? >> i think as a pro-life person what about the rights of the tens of millions of unborn babies relentlessly under attack by the left? we're not talking about 40 years ago. today's democrats are advocating for the right to have an abortion beyond the birth of the child. and most americans would say that's not something that sits well with me and so for democrats to go out on the campaign trail if they want to put all their eggs in the basket and have the conversation about a much more aggressive -- much more aggressive conversation about this issue, i think that will be at their own political peril because it's out of step with what most americans feel on this sensitive issue. >> sandra: you look at the timing of this the administration not tackling the crisis at the southern border, inflation, middle of a war with russia invading ukraine. it is a horrific time for so many. on so many fronts in this country right now. but it appears some on the left had chosen to go this route and attempt to ruin the supreme court as an institution. this is former hillary rodham clinton press secretary. a brave clerk warning the country what is country to see if the public response might cause the court to reconsider? seriously shout-out to whoever the hero was in the supreme court who said f it, let's burn this place down. is this the intention to fire up the base at a difficult time in president biden's presidency? >> that's a good question. i'm with senator durbin on this. i don't condone this leak whatsoever and there should be an investigation by the marshals into this. i don't know of any serious leading democrat, real elected democrat that supports abortion for a baby already delivered. that is extreme and murder in this country. and no democrat supports that. i support fundamental limits on abortion in terms of -- which governor? the child's answer, now. a statement from the district's board reads as for the allegation the district is violating state and federal law are unfounded as can be seen by reading the statutes they cite. the district complies in all respects with the family educational rights and privacy act and the protection of pupil rights amendment. jason rantz, ktth seattle radio talk show host in "focus." you have to stop and think about second graders. you are talking 7 and 8 years old. this as young as 4 years old. parents want them to learn to be nice to each other and learn in school and then you learn this is happening. are you shocked? >> i'm not shocked at all. i think it's one of those instances where we've clearly seen the trend all across the country and there is no state or city or county regardless of the ideological identity of the voters this is immune to this. we see it as part of a strategy that normalizes these topics among kids that it's okay to talk to them about gender identity or race or quiz them on political beliefs. i think part of the reason why they are doing this is to make it seem like it is okay. despite every sort of instinct from parents and from members of the public that this just seems wrong, that this is going to actually create division. because to the point of that second grader who answered that question, they are not thinking about race. they are not judging people by the color of their skin or some gender identity at that age and that's how it is supposed to be and i thought that's what we were trying to get to as a society, not judging people. now we're teaching these kids the only thing that matters is identity. >> sandra: we know this is happening all over the country in some places and even our nation's capital. a public school in washington, d.c. is taking heat after giving kids a lesson on anti-racism. students at an elementary school were given an anti-racism fight club fist book for kids. where do you see white privilege in your own environment and racism in yourself? a decision to overrule roe would lead to abortion bans in roughly half the united states and could have huge ramifications for this year's mid-term elections. it is unclear if the preliminary draft represents the court's final word on this matter. opinions often do change in the drafting process. important to note. senate minority leader mitch mcconnell moments ago taking to the senate floor among the republicans many of them denouncing the leak in the very strongest terms. >> somebody, likely somebody inside the court itself, leaked a confidential internal draft to the press, almost certainly in an effort to stir up an inappropriate pressure campaign to sway an outcome. they want to elevate mob rule over the rule of law. >> we have complete fox coverage for you. republican senator james langford of oklahoma will weigh in and we begin the david spunt live outside the u.s. supreme court which was barricaded last night within an hour of this leak actually happening. david. >> a lot of passionate opinions and we keep saying draft. it is important for those watching and listening to understand this is a draft opinion by justice samuel alito that was circulated behind me to his colleagues in february. but that doesn't matter to many people because they believe the cat is out of the bag. the other important part of the story is the fact that this was leaked. this is unprecedented. scotus blog, a popular blog and site that follows supreme court in and outs in this building they tweeted it is impossible to overstate the earthquake this will cause inside the court in terms of the destruction of trust among the justices and staff. this leak is the gravest, most unforgiveable sin. a steady stream of people outside the court with a range of emotions. we expect this to continue throughout the day. this morning both pro-life and pro-choice advocates came out to shout back and forth. take a quick listen. [people shouting] >> in this draft opinion justice aloety roe was egregiously wrong from start, reason was weak and the decision has had damaging consequences. in december the justices heard arguments over a mississippi state law banning abortions after 15 weeks. roe versus wade decision made abortions legal nationwide up to 24 weeks when a fetus is determined to be able to survive outside the womb. the mississippi case highlights states rest pekt to court precedent. this does not mean abortion would be illegal with the snap of a finger immediately in every state. individual states would have the power to decide whether or not to allow abortion. that means that they may remain legal in california but illegal in nevada. >> it would trigger the laws in over 20 states that have already said that they will outlaw abortion in their state. it will create a patchwork of laws across the country. >> president biden weighing in this morning with a statement. he said in part at the federal level we will need more pro-choice senators and a pro-choice majority in the house to adopt legislation that codifies roe that i will work to pass and sign into law. codifying meaning turning roe versus wade into law across the street at the u.s. capitol. a tremendous amount of pressure on members of the house and senate ahead of the mid-term elections. i suspect the entire narrative of this 2022 mid-term election season will change because of what came out of this building in that leak. sandra. >> david spunt outside of the supreme court. meanwhile there is plenty of reaction to the unprecedented nature of this leak. supreme court is known for its deliberative secrecy. legal observer jeffrey toou bin says he has never seen anything like it. >> there has never been a leak of a vote much less an actual opinion, much less in the case of this significance. the idea that a decision of this magnitude could leak is really a shattering experience for the justices and the court. i really don't know how this institution will recover. >> bill: james langford of oklahoma sits on the senate committee on homeland security and government affairs. welcome. mitch mcconnell called the nature of this leak shocking from the senate floor. what are you and your republican colleagues discussing this morning in the wake of this historic leak? >> first of all we don't know if this is the final opinion or how factual this really is. if it proves to be an actual leak all the statements made just from from many are true. this is not only epic and earth shattering and trying to get a leak out of the supreme court, it will destroy trust within the body. who whoever leaked it out has an agenda that they are trying to accomplish pushing toward more mob rule. the justices work in quiet and secret because their focus is on the law, not where things are opinion. their push is and even from the leak it's interesting to note their push is to say this is a difficult political issue. it should be resolved by the people through the legislatures both federal and state. not through the courts. the court is supposed to be insulated from this and whoever leaked this out is trying to bring politics to the court. >> mitch mcconnell saying in his statement the leak aims to elevate mob rule. a brand-new statement in my hands at this moment where senator lindsey graham released a statement saying in america the radical left is hell bent on reshaping institutions that have stood in the way of the outcomes they desire. this is a portion of his statement saying they want to pack the supreme court to change the current conservative nature of the court achieved through the democratic process. to your earlier point, senator, you've got members of congress saying people should take to the streets across the country. bernie sanders wants to end the filibuster. senator blumenthal says we'll support people that resist. turley is making the point this leak is a malicious act. to that you say what? >> that's clear. there is an agenda in this. someone is trying the accomplish. we don't know who that someone is and how it was leaked out there. we should know in the days ahead and will know. what is whispered in a secret place will one day be shouted from the rooftop. we'll know the motivations on this eventually. it is interesting to see chuck schumer wanting to bring a bill to the floor to have a vote to be able to codify roe. interesting enough as the what the court is saying should happen. this should be resolved in the legislative body, not in the court. obviously i will adamantly oppose any kind of codfication of roe and avans on abortion. i believe every child is valuable and protected and honored. right now democrats are already talking about we'll bring this to the body for a vote. actually that's the same thing the court is actually saying. the court is saying this should happen in states and federal legislatures. decided by the people through their elected officials not through unelected judges. unelected judges say what the law is. elected officials create law. >> what do you want to see happen as far as an investigation? >> chief justice would be able to determine where the leak came from. they should go top to bottom who handed this kind of paperwork over. if it proves to be accurate on that and get it out. >> are you confident we'll get a name? >> i am confident it will come out in the days ahead. >> moving on from the leak to it being a ruling as we have not. i specifically have not been waved off this draft that does indicate the supreme court may be moving to overturn roe versus wade. what are implications for the country and party coming up with the mid-term elections? >> let me be clear. the primary mission is to establish best practices to ensure efforts to respond to disinformation. >> officials here are deflecting blame for this idea saying the fight against disinformation actually started under president trump. sandra. >> sandra: all very interesting stuff. peter doocy live at the white house for us. thank you. brian kilmeade is on deck with his take. the left no longer has any idea what neutral is. now to brian kilmeade co-host of "fox & friends." i'm sure you have nothing to say about this. but please go ahead. >> i mean, it is amazing that people think that this is going to be somebody that is a neutral observer when you look at her background and this disinformation czar came out and said that well, the dossier looks authentic. we have a situation where christopher steele is going to give a speech, everyone should look into it. then we find out about the hunter biden laptop. no curiosity to find out if it should be sidelined. now they roll out and say it will be part of it. sunday they sent mayorkas to the white house correspondents dinner and quickly put him on the sunday shows saying i could have done that a little bit smoother. the roll-out could have been better. the bottom line we need to give the american people the right answers and saying that it really is the working class, minority communities hurt the most by the mistruths. who will judge about that? such a joke. to me it was such an outlandish decision and knowing it was already in place for two months and that jen psaki couldn't explain it or who was in charge? one of the few times she had no answer. >> sandra: what does that tell you about the roll-out of this? so in true "new york post" fashion when they are writing about the left no longer has any idea what neutral even is quoting mayorkas saying over the weekend the board is absolutely politically neutral. follows up with right, aoc is also a republican, ha ha. according to the media research center your reaction. media coverage of this story. since last wednesday all three networks ignored the disinformation board on their morning and evening newscasts except nbc sunday show that spent under a minute and a half discussing it. they're avoiding it, brian. >> a lot of them avoided the illegal immigration of the border and the drowning of the national guardsman in texas. saw the chaos that will be happening title 42 being rescinded and ignored the disinformation czar, really? if you have an issue, let me ask them how many meetings do you go in with producers and they tell you what are the top five biggest stories in the country? it's one of the top three. they say i would rather not do it and get less ratings. do something people care less about in order to do something that could make the administration look bad. that's what it is about. if you look some democrats upset by it. mark penn on our channel. that is not how a democrat acts to accept a disinformation czar without a screening process and new division of homeland security. harold ford or joe rogan who voted for obama in the past and bill maher, he doesn't recognize this party nor does he recognize the media's treatment of what our major stories are. i think we are seeing this over and over again. my hope is there is a degree of rationality that begins to rise up and demand that shows like that do the stories that matter. >> sandra: we'll see if there is any further information provided on this board. how it will operate. because mayorkas on sunday saying the board will just focus on foreign disinformation, brian, making that what they saw is an important distinction saying it will not monitor american citizens noting quote the board does not have any operational authority or capability. do you believe it? >> put it this way, sandra. hunter biden is a domestic issue. on the surface we won't look into that. wait a second. it is classic russian disinformation. therefore, it is in the purview of the disinformation czar. anything that pops up you can say looks like china did it even if it involves an american citizen. everything could have a foreign entity to it because they don't know. it could be disinformation so when in doubt, suspend the accounts that do it, stop people from reading it. i actually don't want anyone screening what i read period. i think the average american, the pushback so their lives are regulated for the last two years. the last thing we want is information regulated by some would be musical theater star that says she should be trusted even though her track record reveals the opposite. >> sandra: interesting. last question on this. oh, i'm told president biden is speaking. let's listen. >> president biden: the draft doesn't represent who will vote for it yet. i hope they aren't enough votes for it. the main reason why i worked so hard the keep him off the court reflects his view almost -- anyway, look, the idea that -- it concerns me a great deal that after 50 years we'll decide a woman doesn't have the right to choose. the limit the supreme court decision, number one. but even more equally profound is the rationale used and it would mean that every other decision the thrown into question. i realize this goes back a long way but one of the debates i had with robert bork was whether griswald versus connecticut should stand as well. the state of connecticut said the privacy of your bedroom, husband and wife or couple could use contraception. if the rationale of this decision as relief were to be sustained the whole range of rights are in question. a whole range of rights. the idea we're letting the states make those decisions would be a fundamental shift from what we've done. so it goes far beyond in my view. if it becomes the law and if what is written is what remains goes far beyond the concerns of whether or not there is the right to choose. it goes to other basic rights. the right to marry, the right to determine a whole range of things because one of the issues that this court, many members of the court, a number of the members of the court have not acknowledged is that there is a right to privacy in our constitution. i strongly believe there is. i think the decision griswald was correct overruling. i think the decision in roe was correct because of the right to privacy. there are limitations on it but it cannot be denied. >> do you think that it has irrepably hurt the court. >> if this decision holds, it is quite a radical decision. and again, the underlying premise. i have not had a chance to thoroughly go into the report. but it basically says all the decisions relating to your private life, who you marry, whether or not you decide to conceive a child or not. whether or not you can have an abortion, a range of other decisions, how you raise your child, what does this do -- does this mean in florida they can decide they'll pass a law saying same-sex marriage is not permissible? against the law in florida? so there is a whole -- a fundamental shift in american jurisprudence. >> the filibuster to codify roe? >> i'm not prepared to make those judgments now about -- but, you know, i think the codfication of roe makes a lot of sense. look, think what roe says. roe says what all basic mainstream religions have concluded. that the human life and being is a question, is it at the moment of conception, is it six months, six weeks, is it quickening like aquinas argues? the idea that we'll make a judgment that is going to say that no one can make the judgment to abort a child based on a decision by the supreme court, i think it goes way overboard. >> thank you, thank you guys. >> what does it mean for the democrats' argument in the mid-terms? >> president biden: i haven't thought that through yet. >> do changes need to be made to the court in light of this if this -- >> president biden: look, one of the reasons why i voted against a number of the members of the court they refused to acknowledge there is a ninth amendment. the right to privacy. fundamental rights are affected by that and i'm not prepared to leave that to the whims and the -- of the public at the moment and local areas. thank you so much. >> thank you, guys. come on, guys. >> sandra: all right. that was the first vocal reaction from the president. he has put out a statement on the supreme court leak and focused now former biden campaign surrogate and the executive director of the america rising pac. kevin, are you surprised or shocked that the president didn't address the leak from the supreme court itself in those comments? >> i'm not necessarily shocked about the leak. i do think it's a process story. the fundamentals of what the leak has done in terms of this opinion being released something that has been circulating around the court since february is the larger story here. the ramifications not just for women in this country but also the political ramifications now that we're 189 days away from this election. obviously democrats and the president are focusing on the ramifications. the huge ramifications of what this opinion will do in terms of fundamentally changing our society in this country going forward. >> sandra: some might disagree this isn't the way things are supposed to work. we aren't supposed to have a significant leak especially from the supreme court even dick durbin was just speaking a moment ago, a democrat from illinois on the leak. i don't condone the leaking of internal supreme court documents. he just said this. we have this sound, listen. >> i don't condone the leaking of internal supreme court documents. senator kennedy is correct, it is unprecedented. i don't know who leaked the opinion or why. but i know that today women and men across this country are grappling with the very real concern and yes the fear that they may lose a critical constitutional right in just a matter of weeks. >> sandra: very clearly stating on the record he does not condone the leaking of the internal supreme court documents. jonathan turley calling it a malicious attack on the court saying it is an egregious act. mcconnell calling the leak shocking to have this come from our highest court. should the president address that specifically and be announcing investigations into how this could happen? >> well, he clearly wasn't willing to go that far in the comments that we heard. but if these democrats think this is so shocking and appalling and a concern for the future integrity of the court, which i would agree with, they need to look to their leftist activists and tell them to knock it off. by all points this is where this might come from. we've seen them try to take these actions to heavily politicize these. the kevin's point trying to move on to the process point of the leak to the ramification. one thing i thought was shocking in the president's comments he pointed out and underscored how far the democrat party has gone to the left on the issue of abortion. joe biden himself when he was a senator in 1982 voted in support of an amendment that would have given states the right to overturn roe versus wade and to hear him today and how giving his party line vote there and i would note this is the start of primary season for the mid-term elections. these democrats and these target states will have a tough time reconciling their far left view on this issue which is far, far to the left of where so many voters are, much more moderate on this issue. this will be a really interesting thing to see for the democrats. their activists have hijacked the issue and it is trouble for them in november. >> sandra: more news from the president a second ago. i hope there is not enough votes for it, he said. this is a fundamental shift in american jurisprudence, he said. also saying if this holds, he called it a radical decision from the supreme court. meanwhile biden has a mixed record, kevin, when it comes to the issue of abortion. in 1974 the then senator told an interviewer a woman should not have the seoul -- sole -- and then said the government doesn't have a right to tell women to control their bodies. he hasn't been consistent on the issue. >> this president is a practicing catholic who believes strongly in the church's teaching. this is something that he has grappled with over time but recognizes where church and state meet and where they diverge. he has been committed not just as vice president but as president to a woman's right to choose and spoke at andrews to the issues not just beyond abortion but regarding any kind of privacy notion with regards to marriage, to contraception access and the ramifications go far beyond if this decision holds and is the opinion of the court, affecting all facets of american life. cassie's point is a good one. the vast majority of americans support this right. 4 in 10 support roe. this is an issue that has been decided 50 years ago that has been the law of the land for five decades. >> sandra: a fair point. polls show that while most support roe and restrictions on abortion important to point out. polling shows that americans overwhelmingly want some sort of restrictions on abortion overall 71% of all adults, 93% of republicans, 49% of democrats, cassie. >> yes, such an important distinction because again today's democrat party you have former chair of the dnc saying there is no room for a pro-life candidate in today's democrat party. that is far removed from where the majority of americans are who might say this is where i personally stand but i want some restrictions and you have both the federal and state level democrats trying to remove all restrictions. the science doesn't back that up. people's hearts and minds don't back that up and you certainly can't get away i'm a devout catholic but we have to have a separation of church and state. that isn't how it works. the president has moved far to the left alongside his party and people don't buy the devout catholic cop-out. >> sandra: we continue to get reaction. republican response from lindsey graham earlier, we got response from the chief justice and now krysten sinema, the arizona democratic senator released a statement saying a woman's healthcare choices should be between her, her family and doctor, overturning roe versus wade. no specific comment if her statement on the fill busfer. we did hear that from bernie sanders earlier. kevin, i want to go back to the chief justice statement. i read it in its entirety at the top there was news. it cited a news organization published a copy of the draft opinion in the pending case he did note that justices circulate draft opinions as a routine and essential part of the court's confidential work. the document described in yesterday's report is authentic news but we were waved off thinking it wasn't authentic it does not represent a decision of the court by the final position in the final issues of this case. do you believe the left wants to influence those certain justices? >> yes, good question. we don't know who is behind the leak. if it even came from the chief justice's office. we know he isn't fully on board from this leak with the majority of the opinion. i think that process has to play out. president biden should not -- and the executive department should not have a role in that. this is a separate branch of government. in that statement and it is important to share that with the virus he has directed the marshal service, the law enforcement agency within the department of justice and the article 3 constitution branch of government to carry out this investigation. this isn't something for the executive branch or legislative branch. they should police it on their own. there should be an investigation into how this happened. certainly going forward. to dick durbin's point, this should not have happened. >> sandra: indeed. they know there will be with. at the conclusion of job robert's statement i've directed the marshal to investigate the source of the leak. if there will be consequences for that person. to send a message that shouldn't happen in this country. >> i think that's one thing we can all agree on there needs to be a strong consequence whether it's disbarring or depending who it is something that falls in line with the highest consequence possible to maintain the integrity of the court. and to get to that why. is it to try to change the hearts and mind of justices? not sure that would be effective or to say hey guys, you democrats may lose your majorities come november so you better codify this while you have the chance? are they trying to throw out that warning flag to them? that remains to be seen. but certainly for those that this is their number one issue it will be a base energizer. i have to also say that we've still got an economy and inflation to focus on, too. so the news of today we still have to give voters credit there will be a lot more pressing issues as well. >> sandra: something they would have to appreciate not having to focus on. diesel prices hitting record high. it will worsen the supply chain and lead to a very difficult decision on the part of the federal reserve to bring those prices down for the american people. meanwhile to the politics of this, the ramifications, the implications for the mid-term elections, the dnc is offering this preview of how it says the issue will affect november's mid-term elections quote, make no mistake reproductive rights will be on the ballot and the mid-term election is more important now than ever before. voters will make their voices heard. we'll fight back with everything we have and republicans will have to answer for their party's relentless attacks on americans' rights. senate majority leader chuck schumer echoed those sentiments last hour. >> this is a dark and disturbing warning for america. the elections this move will have consequences because the rights of 100 million women are now on the ballot. to help fight this court's awful decision, i urge every american to make their voices heard this week, and this year. >> sandra: could i get your reaction to that? >> i think as a pro-life person what about the rights of the tens of millions of unborn babies relentlessly under attack by the left? we're not talking about 40 years ago. today's democrats are advocating for the right to have an abortion beyond the birth of the child. and most americans would say that's not something that sits well with me and so for democrats to go out on the campaign trail if they want to put all their eggs in the basket and have the conversation about a much more aggressive -- much more aggressive conversation about this issue, i think that will be at their own political peril because it's out of step with what most americans feel on this sensitive issue. >> sandra: you look at the timing of this the administration not tackling the crisis at the southern border, inflation, middle of a war with russia invading ukraine. it is a horrific time for so many. on so many fronts in this country right now. but it appears some on the left had chosen to go this route and attempt to ruin the supreme court as an institution. this is former hillary rodham clinton press secretary. a brave clerk warning the country what is country to see if the public response might cause the court to reconsider? seriously shout-out to whoever the hero was in the supreme court who said f it, let's burn this place down. is this the intention to fire up the base at a difficult time in president biden's presidency? >> that's a good question. i'm with senator durbin on this. i don't condone this leak whatsoever and there should be an investigation by the marshals into this. i don't know of any serious leading democrat, real elected democrat that supports abortion for a baby already delivered. that is extreme and murder in this country. and no democrat supports that. i support fundamental limits on abortion in terms of -- which governor? the child's answer, now. a statement from the district's board reads as for the allegation the district is violating state and federal law are unfounded as can be seen by reading the statutes they cite. the district complies in all respects with the family educational rights and privacy act and the protection of pupil rights amendment. jason rantz, ktth seattle radio talk show host in "focus." you have to stop and think about second graders. you are talking 7 and 8 years old. this as young as 4 years old. parents want them to learn to be nice to each other and learn in school and then you learn this is happening. are you shocked? >> i'm not shocked at all. i think it's one of those instances where we've clearly seen the trend all across the country and there is no state or city or county regardless of the ideological identity of the voters this is immune to this. we see it as part of a strategy that normalizes these topics among kids that it's okay to talk to them about gender identity or race or quiz them on political beliefs. i think part of the reason why they are doing this is to make it seem like it is okay. despite every sort of instinct from parents and from members of the public that this just seems wrong, that this is going to actually create division. because to the point of that second grader who answered that question, they are not thinking about race. they are not judging people by the color of their skin or some gender identity at that age and that's how it is supposed to be and i thought that's what we were trying to get to as a society, not judging people. now we're teaching these kids the only thing that matters is identity. >> sandra: we know this is happening all over the country in some places and even our nation's capital. a public school in washington, d.c. is taking heat after giving kids a lesson on anti-racism. students at an elementary school were given an anti-racism fight club fist book for kids. where do you see white privilege in your own environment and racism in yourself? who in your family has racist beliefs? nothing could go wrong there, jason. >> no kidding. again, the intent here is to indoctrinate these kids to adopt a worldview. much more difficult to convince adults who have in some cases decades of life experience to buy into some of the talking points from the left. it is very difficult to do that. but it is easy to do it with kids. kids don't know any better and they are in class, captive audience in front of a teacher telling them over and over from an early age about white privilege. pretty much viewing the world through the critical race theory lens on the gender identity stuff as well. if you get that every single day for years and years and years, they are shaping the way these kids are thinking, which means then they go into the real world, they become doctors and lawyers and ceos and politicians and then they start to shift the narrative, the culture on these issues. that's how you win in the long term. >> sandra: it goes back to the shutdowns of 2020 whether so many parents saw their kids at home learning looking over their shoulders and listening and hearing about soeft things that were happening in the classrooms and they were learning more and more about american classrooms and what's being taught. 30 seconds left. this is why parental rights is becoming a bigger and bigger message for the republican party in the mid-term elections. >> this is going to be a meaningful push to get folks in the middle to go to the conservatives on this unless the democrats decide they change their tune. with the roe verse wade news they believe mothers will side with them automatically but forgetting about the living children being betrayed by the moves of the democratic party. >> sandra: interesting stuff. jason rantz, always good to have a conversation with you. thank you very much for joining us. thanks to everybody at home for watching and thanks for being with us today. this is "the faulkner focus". i'm sandra smith. i'll see you back here at 1:00 p.m. eastern time with john roberts as we anchor america reports on a big news day indeed.
