is sacrosanct and it's key to the court's ability on any issue to engage in thet give and take and all the decision making that's required to reach these decisions based on legal principles, basedin on the constitution, notno because of political pressure. that's what the legislature does, not the court and those who clerk at the court, ll especially the law clerks, they are t afforded a tremendous privilege.em think aboutendous privi to workt the court to to learn from the justices. but the inviolable deal that you strike when you accept c that clerkship, which is the most coveted thing you can have as a youngou lawyer, is that you swear confidentiality regarding everything you seeer and everything you hear in especially the internal deliberations of the court, especially that it is not up ton a law clerk to decide when t the decision of the court willhe be announced and it is not up a to a law clerk or any employee of the court to make a decision in what is a naked attempt to try to change the outcome before the final opinion is issued. now why am i som passionate about this tonight?ually know i actually know what i'mwh talking about. a lot ofab people on televisione and i don't know what they're talking about. i was a supreme court lawaw clerkrk and i know because i saw my opinions go back and forth, drafts of opinions go back and forth, language changesge sometimes sometimes even votes might change. maybe a justice will see an argument he or she didn't think of breyer, but it does happen.n. but this is all done confidentially to encourage this free exchange of ideas that's always deemed by everyone. doesn't matter what your political background is--, ti doesn't matter seemed essentiall to the proper functioning of our nation's highest court. now chief justice rehnquist and our orientation session. the court said to all of us there are nine justices, four clerks for each chamber is usually thirty six and then a couple of the retired justices still have clerks that are still at the court but not many, many young people. about 30 , 40 young youn lawyers. he looked a us and he said if you leak anything fromhi this court, you can kissoo your legal career bye bye. >> done that .t. we remember that and doy the entirety of the court's history. no matter how controversial or disruptive the court's decisions. ben, i'm talking decades, decades ofki decisions on freedm of religion, rights ofig criminals, same-sex marriage, none of those draft opinions ever leaked. know why? know because everyone in that building understood that was a line that could never be crossed. and it is a sad commentary a that someone in that building took it upon himself or herself to totally usurp the role of the justices and hijack the court's deliberative process. this was a bald faced attempt to tip the balance of the vote.e one way or another that we know which way the leaker undoubtedly hopes, right. that this leaked opinion willoo drive activists to the court's doors where they were desperately bangingna on the doors during brett kavanaugh's confirmation hearing. and i thinkve that's going to have an impact on all the activists outside screamingt people, all the colorful sides that's going to have some impact that will have one of the justices in the majority change his or her vote. but once again, it looks like the left will just smash an established government process to get their wayay to anything in their power to stop a principled conservative a majority from issuing a ruling on a pending case. this leaker is going to be sorely disappointed and should be immediately discovered and disbarredred. joining me now, jonathan turley ,university law professor, fox news contributor and harmeet dhillon, civil rights attorney and ceo for the center for american liberty. we also hope to be joined by former doj lawyer james truste in justnt a moment. professor turley. i am this is one of those things i thought i would never see in my life. i'ven seen a lot in my time in washington. i've been here way too long. this is one of the most destructive things than i can ever imagine to happen to our legal system. take it away when we're all in disbelief. >> i've covered the court for y four years and iea teach a class on the supreme court and i really didn't think this dayth would come. that's a strange thing tong say in a city that literally floats on leaks, the only island and that sea they did not have leaks was the supreme court and it existed on a level of integrity that is all true foreign today in politics and to see people celebratingod today, this leak is perhaps the most disturbing thing of all. that it just seems that there's no or institutional value that can withstand this age of rage. what happened with this leak? caused lasting damage to the supreme court. he this i c think that the court will never be quite the same it hase it has always existed. as you said, laura , on an understanding of people of good faith that believed in that institution, believed truly in each other even thoughis they disagreed wholeheartedly in opinions. this was a malicious act and the only reason to leak it was to try to create external pressure to changee the position of the court and maybe encourage congress to passs this federal abortion law to try to federalize the abortion area. what's really quite about this , if anything, the justices are more likely to dig in the second grade below to the court would not just be after the leak itself would be if the justices did cave to external pressure. so this has turned everything into a morass. and what what this person did cheapens the institution to a degreest that is breathtakingi you know that i don't know why i maybe it was the last area off naiveté that i hadte left after years in washington, but i truly never thought we'd come to this moment. well, halmet to thi, we've been hearing now for the last year plus from democrats that they exist merely to really at this point to safeguard democracy. right. the other cables have been spending since january 6th. f d. they're the true guardians of democracy. all the institutions, allct the norms are being protected by joe biden and the left. what doat we see tonight with with this having happened? well, laura , i mean, there's so many thoughts going through my mind as a lawyer for the pro-life movement, as a constitutional lawyer and also somebody involved in politics.ve involved in politics this is a deeply political act ,laura , and i f think it was a aimed not only at legislation like you mentioned at undermining potentially the court's legitimacy and court packing, but also ital affecting the midterm elections. you know, the this issoid goingo be a talking point and advertisements that are being drafted as you and i arebe speaking tonight aboutut how it is important to vote for democrats to save women from back alley abortions, fill in the blank, et cetera, butan all of that is a lie. laura , i mean, this is i an insurrection level that if you talk about really insurrection against the court, but when you look at what this this opinion, if it turns out to be correct and i agree with professor turley that in honor and dignity the justices are likely to not change their votes. the ones who are honest n and stick with this opinion, it returns to the states, a decision that always should have been there and this draft opinion goes through the v analysis very weller that there never was a consensusus in this country about abortion. it a. doesn't fit in the jurisprudence of the 14th amendment when you look at the mississippi law itself, it provides exceptions for the life of the mother t and for significant fetal defects. so it isn'tnini evendefects. a n after the 15th week and so and you're going tok have a look at what the democrats have done on the political side in california. you have a bill in front of our assembly that talks about dead babies dying in a perinatal setting that is up to twenty eight days after birth that being protected from prosecution. so that they have gotten law after that and the roe v. wade more and more pronatalist extreme when the rest of world does not permit any of this . this is about abortion on demand.isbout this is utter fanaticism i and it's burned downs the court in order to try to get your way from the same crowd that claims to be the great protectors of our entire democratic system to barmaid's point professor, the author of that politico piece that leaked this supposed draft opinion. again, we don't know if it's draft opinion people think it is. we don't know. watch. spoke to msnbc tonight . >> watch this opinion that he's written, which is, you know, just a withering take down of the roe v. wade precedent. holp it pulls no punches at all.s pry it's pretty brutal and in the way it's structured, it kind of needs to be that way because of the way alito confronts this issue of a court precedent. stari decisis is the legal term . a lot of people thought the original roe opinion was brutal owas as well given what happened to 50 plus million babies. but in response to his comment ,professor? >> well,l, as you know, we as ai draft it can change. this was a fabulous draft. the votes can change, e.although whoever did this probably made that less likely. it does have elements opinion that do sound like justice alito. he hass spent his entire careero questioning the basisni for roe and casey. he was not alone, by the way, professor tribe at harvard called roe a smoke screen. you know, the late justice ginsburg said that she hadsa reservations about how roe was written. r so roeoe has really been a difficult path a for the court . it has been really subject to a series of five four decisions. often decisions-4 that were quie fractured, nuanced, beyond definition for some people. but the court has never been on terra firma. what this court would suggest i is that if it is in fact a legitimate craft that they have a secure five justice majority, it would make sense that alito would be picked if chief justice roberts was not initially in the majority, he might be going with a dissent or he mayy have decided if he could not sign with the majority. but the decisionmaty. itself has aspects to of the type of analysis we've seen from justice alito who does not believeite that this right is found in the constitution as opposed to resting with the states. >> we have former doj attorney james truste with us as well tonight . james, bernie sanders tweeted something moments ago saying congress must pass legislation a that codifies roe vs. wade as the law of the land and if there aren't 60 votes in the senate to do it and there are not, we musthe end the filibustr to pass it with 50 votes. well,,vo this seems like the gol of the leaker, jim . goal. i mean, this that seems prettyvi obvious at this point.ou i mean, alreadydy with the politics, the second this thingl dropped and politico is like almost like they had it planned ahead of time, almost like well, almost like they talk tos each other about what's coming. but if you kind of stolen my characterize it as . and i have two things t that lep to mind. one is what is one of the associate justices was involved in the leak. i mean, that magnifies an already historic, horrific moment into somethingc beyond belief and maybe as a as a possible way of deflecting from that concept. deflecting that. this supreme court needs to speak as one tonight or tomorrow morning and issue a statement that condemns the living out of what just happened. i don't care change. i take your point. p i want all of you to chime in here. to me it seems like the court needs to come out like an hour h agoou and immediately the chief justice should come out and issue a statement in the age of computers..do tha you can do that .t ie i understand that you can issue a statement saying this is on authorized obviously from the court and lay out the points as to why how this leaker must be found. and there has c to be consequences, harmeet, for this individual, whoever it was and we can guess their names floated out there, i'm notn going to say any names on television, but there are people who have been connected to the author of the piece and our current clerks again, i'm not going to get into it really has to happen is that conservatives and especially those justicesav on the supreme court have to hang tough, have to stick to their principles and cannot back down to this intimidation. it is shocking, as you said as we started discussing here. it'sg shocking both in substance and it is also shocking in terms of what ite means abot the court and what it means about the stakes here that someone was willing to do this . it is just j a remarkable thing. remarkable. imagine if this was a thought to be aim concern of law clerk o leak something in a case that the liberals were allou thrilled about. imagine what rachel and the crowd would be saying tonight . kurt o. i cann imagine laura and i think we all know that they'd be rather upset. we've been hearing for h over almost a year and a half a about attacks on our democracy and insurrection. this did d more damage than a bunch of elderly trump voters taking selfies in the rotunda. n >> weda the actual decision itself is is huge. it's probably the most important decision since plessy vs.an ferguson was overturnedve by brown versus boardrt. as in that case, the democrats u are very, very upset about it. but i think you're in our supreme court. and then second is just this is if in fact the decision of the court turns out to be what w was in thisas brief, this would be a huge step forward and ad huge victoryan for the protectin of life, which is certainly where the conservative and republican party is in pennsylvania in a number of democratsli a. and this is an issue on the campaign trail. it's already been a flashpoint . i'm someone who's pro-life, has been pro-life and this is something where my my primary competitor mehmet ozg wh three three months three years ago to this month had spoken out on avi breakfast club interview about his concerns about this very scenario that if roe v. wade v was overturned that the. states would put in more restrictive policies regarding abortion, more pro-life extreme left, whether it's the question of transgender transitions in schools or whether it's t the history that's being taught about americaeing, these are all flashpoints where parents and voters in
