[bleep] [bleep] >> the jury was shown photographs of his face with what what he says was bruises and a cigarette burn that was caused by his ex-wife. and the actor claimed that he lost part of a finger as a result of an attack by her. >> she walked up and grabbed the bottle of vodka and then just, stood back and hurled it at me. and i looked down and i realized the tip of my finger had been severed. >> then they will tell the court her side of the story and the jury will have to decide which is acting in which is telling the truth. >> thank you so much, jonathan. okay, a giant defamation case and the justice department decision striking down the federal travel mask mandate. we have the washington times tis legal affairs attorney and former chief nomination counsel mike davis, and we welcome you both back. >> thank you for having me. >> thank you for having me. >> i would like to start with the mask mandate. here's what we found. the cdc says that it is a continuing assessment that at this time in order requiring the court or remains necessary for public health, they believe that this is a lawful order well within the cdc legal authority to protect the public health. so might come of the doj, the joe biden administration, is going to appeal to try to get that mask mandate reinstated. >> you know, i think it is a bad legal and political decision, as they pursue it here. a decision out of tampa is a very strong decision, ruling that the cdc did not have statutory authority to issue this mask mandate. and they did have the support of the judge with the administrative procedures act, what the cdc is going to do is get a bad ruling of the 11th circuit level and that is going to be part of it. i will note if this is so important to public health, why aren't they seeking an emergency state of the judges order. >> they are not asking for this, knowing this is supposed to expire in a few days anyway. here is what they said. >> the nation is struck with another significant wave, what do you make of the decision by the joe biden administration? >> i think it signals that they are looking to extend the mask mandate beyond the may 3 deadline. i also think that it does to mike's point, it comes on the same day that they wanted to remain in place and also the 11th circuit is a conservative court and beyond that the supreme court and they have been critical with the addictions moratorium. so i think they do have an uphill battle. >> you mentioned the judge, the critics have immediately said she's too young, unqualified and they are upset about the nationwide injunction, the things that makes this thrown out for the entire country. but it was very popular when trump was in office, dozens of them that i can remember. >> yes, so the judge on the court, she is now clicking on the link and individuals that oversee it. that includes the justice clarence thomas who oversees it as well. so if you read her opinion it is a brilliant opinion. it is very well reasoned and nationwide injunctions, that is what we currently have, like what was said. and so if they want to get rid of the nationwide injunctions, let's start doing that going forward in this case. >> potentially the supreme court, what they think about the decisions by the stretch in florida, i would like to turn to the trial today, we got a little bit with what we heard today in the courtroom. >> it could begin with a slap, a shove. it could begin with throwing the tv remote at my head, it could begin with throwing a glass of wine in my face. banging on the doors, screaming obscenities. wanting to have a physical altercation. >> so he was on the stand today, pointing the finger at her. but he kept it very calm, whether this is acting or coaching or just the way that he actually is. >> and of course she says she was the victim here. what we make of this hollywood trial? >> i agree with you, i think that he did a good job when being questioned by his attorney. i did wonder why they were not objecting more to relevancy when they were talking about her drug and alcohol use. and you know, it seems a little bit more like character assassination. i think we need to wait and see what evidence she doesn't bring. we have to remember in 2016 she was able to get a restraining order against him and at the same time the attorneys did have a little bit of this late this afternoon and i thought they did a relatively good job and they brought up that there was a an article prior to the op-ed suggesting this and that the captain was going to be diminished, captain sparrow, his character. which said it results in him losing that role. so we will have to see what tomorrow brings. >> yes, we will, we we are out of time. but we are having those there and we thank you very much. >> safety regulators in new mexico state have issued the maximum possible fine against a stone production company for firearms and safety failures on the set where a cinematographer was shot by the actor and producer alec baldwin last october. nearly $137,000 in fines came with safety failures in violation of standard industry protocol. and issuing a statement tonight is tran-nines that her family is going through deep healing after her husband hit chris rock. she says she will post more about the discoveries of the healing when the time calls for it. and a mother of two, her body was dumped in a duffel bag after being killed, the police believe she did believe to know her killer. we have the latest developments in this case tonight. >> shannon, there are reports that the killer left behind a pair of gloves soaked boots at the crime scene. still, investigators are still looking at the situation. >> outside the garage of this home in queens, is cooperating and turned over his cell phone. reportedly receiving a threatening text message the night she was brutally stabbed nearly 60 times, warning him in part that his whole family is next. the husband was reportedly looking at colleges when the family was at the home in queens. friends and neighbors are still in shock at this time. >> everyone is trying to piece together what is happening. how did this happen. why did this happen. >> also there are reports that police are investigating several people of interest. including a handyman who knew the home well and where the spare key was hidden. they are working to learn more about the person caught on surveillance footage the morning that her body was found, seeing here at dragging a rolling duffel back through the neighborhood. the mother of two found dead, roughly nine blocks from her home, leaving investigators back to the side door of her home. and the manager at the local bar says to the "new york post" that she came in late friday night, had her usual moscow mule, and left around 12:30 a.m. the hunt for her killer continues. shannon? >> shannon: thank you, laura ingram, for the update. let's review what we do and don't know about the case so far. talking about the information released by police so far, what it means to the investigation. we are joined by our washington dc homicide detective, ted. it's great to have you back. >> it's my pleasure, shannon. >> okay, making mention of this. they said they found it that she was stabbed 60 times nearly saturday. there was a handyman who said that he had a fling with her is being sought for questioning, but they have not publicly identified a suspect in the case. all right, and we are told that there are other things that led them back to the clues. does that suggest that this is not well-planned? that it happened in haste? >> well, shannon, i don't think it was well-planned. but i can tell you that when you stab someone 58 to 60 times, that is a rage killing. it is believed that the killer knew her and one of the questions is how does the killer get into the house. they already have access, did they follow her to the house and this is what it is believed that what happen was that she was killed shortly after returning from the club. the person dragged her in the duffel bag around 4:30 a.m. normally when somebody kill someone, they want to get away from the body right away, and you do not stay in the house for any amount of time like that before you leave with the duffel bag. >> it sounds led her son is in the house, that he was questioned and then allowed to go, although we are told this was down in the basement and where it happened. i want to talk about something from nancy grace. >> is critical, someone felt that they could murder this individual, that they could kill her, dismember her, stuff her in a hockey bag and this is an amateur. an amateur that was on foot that we find is very unusual. >> you mentioned that this person felt comfortable in the house, they point out all the different things that happen. does that suggest that there is potential evidence left behind for cops to work with? >> i do not know. i know he doesn't listen to republicans, he doesn't listen to those of us that talk about this, so i don't know if you will listen to democrats, many of them it is a political issue. and i know that it is about policy because they know that communities are being overrun, hispanic voters are coming to the party rapidly. and there are a lot of issues, but this is an issue with those in the border region. >> we have seen polling that many highly disagree with the president. and it has been shipped away from him. title 42 was a jenna phobic policy that disproportionately impacted black and brown migrants. i am glad to see that they are following the science and ending this rule, an incredible victory for immigrants and refugees. she says that it was cruel and genophobic. >> they say you have to wait until you can come here. but today, shannon, we are on pace, if you go back to the border patrol statistics, you can see from 1990 through 2019, there were about 28 million people that came here illegally. we think that we catch one of every three, but if we were very conservative for one that we apprehend, now you are up to over 50 million people. and that means that people that we see on the cameras that we cannot catch, we are on pace to be 15 to 20% of people living in america legally and if he repeals title 42, right now we are on pace that another several hundred thousand and another several million that we saw over the miles of border that we have to protect, we could see anywhere from a low of 12 to 20 million people coming into this country. there are only 29 million texans. then we even have citizens over the four years. and border patrol is expecting it could be between five and 6 million people per year. so this is a crisis of magnitude. and just to put in perspective how much work we have to do, and the border with mexico in texas, 1254 miles, that is further than the distance from boston to jacksonville. so when you think of that, how do you know people are getting and, well, you don't know. but it would be impossible to cover the entire area. that is what the border patrol faces under this and joe biden doesn't care that he is allowing the country to be invaded. we would like to have a constitutional showdown go back to the supreme court and say that in texas we have a right to protect the border and the citizens. >> we will see if he gets this with this pressure that seems to be growing. thank you, governor 2 thank you. >> a former assistant principal so she was forced out of her job due to a slip of the tongue during antiracism training. we have that coming up next.
