down a bombshell ruling yesterday calling for the mandates for planes, trains and buses unconstitutional. the reaction was swift. >> overturned the mask mandate. if you choose to, you may remove your mask. >> congratulations. [applause] >> bill: you saw a ton of those videos online last night. mark meredith live at the airport. reaction now. >> good morning to you. i bet the airport bars will be packed today with travelers celebrating the fact they aren't legally required to wear a mask for the first time in about two years. airlines started in masking rules in 2020. as you mentioned the mask mandate has been struck down after a judge ruled in florida who said it had to go. she was nominated by trump in 2020 striking down the mandate set to expire in early may. in her decision the judge writes the mandate exceeded the cdc's statutory authority. improperly invoked the good cause exception to notice and comment rulemaking and failed to adequately explain its decision. you guys showed it off the top. there are videos all over social media showing people learning of the news in realtime yesterday. i heard stories about pilots announcing it on the planes. people at sky clubs say it was a good thing and a long time coming. the white house, though, says it is disappointed in this decision but it is unclear if it will continue to push for the reinstatement. administration official did talk to the media yesterday saying the agencies are reviewing the decision and assessing potential next steps. in the meantime today's court decision means cdc public transportation masking order is not in effect at this time. so while some passengers will still choose to mask up while traveling others see it as a long-overdue change. the airlines know it will be a jolt for another people. delta said you may experience inconsistent enforcement during the next 24 hours as the news is more broadly communicated. remember to show understanding and patience with others who may not be aware of the enforcement no longer being required. just had a little cough there. yesterday there were 2.2 million people that passed through airport security checkpoints. that's a lot of people. travel demand is expected to surge heading to the summer. this goes well beyond just where i'm standing in airports. amtrak pulling back its masking rules as well as uber sending its customers an email letting them know they don't have to wear a mask when they get in the car. if they have a problem they can cancel the ride. one survey i took at the airport i would say 8 out of 10 people still wearing a mask this morning. i bet it changes as the day goes on. >> bill: habits are hard to break. nice to see you at reagan national. >> dana: fox news you a lert. migrant apprehensions at the southern border have surpassed one million in six months. the fastest rate in 20 years after we learned that agents caught as least 23 people on the terror watch list last year alone. the white house says it proves cbp agents are doing their job. alexandria hoff at the white house. >> just last month there was 221,000 migrant encounters at the border. that's up 33% from the month prior. in addition, the biden administration has released more than 216,000 migrants from detention relying on them to self-report their whereabouts. this is all according to data released by u.s. immigration and customs enforcement. most of that self-reporting is expected to happen through the cell phones provided to those migrants once they cross the border. of the 23 known or suspected terrorists who remain in custody the message from the president is this. >> he is grateful to the border patrol for doing their jobs and stopping these people and preventing them from getting into the country. >> she added it is uncommon for terrorists to cross the u.s. border. those who evaded border agents all together andy biggs wants to know how one can be so sure. >> the word i got was there there were 800,000 gotaways last year. and if that's the case, and you look at 23 out of 2 million and you are still adding to that list and people with information tell me it may be 40 or 50 that actually made it into the country. we don't know. we simply don't know. >> the number of democrats opposing the biden administration's to end title 42 grows. there are some that say they would like to see it extended. a poll conducted, 90% of americans -- you have texas governor greg abbott continuing to send migrants to d.c. the white house has called it a publicity stunt. still lots of questions asked about the value in doing this. it does seem to offer some symbolism on the way that these illegal entries into this country can impact non-border states and for democrats who are running tight races right now that's simply not something they want to contend with. dana and bill. >> dana: we appreciate it. i think it was this morning in the newsletter said -- an excellent newsletter basically the white house is playing defense on all these different issues. where do you get on offense? >> look, i think it is not mere happenstance that democrats up for election or in swing areas are saying don't get rid of title 42. i think the politics and the polling on this is extremely clear. i'm intrigued the administration didn't so far appeal the transportation mask mandate. and it could be that they didn't do it so that they can then say if there is no masks on planes we can go ahead with title 42. i don't know why the administration wants to push title 42 in view of all this opposition. certainly they would be making a mistake. i predict they'll pull back here. >> bill: we'll see if that's the case. dana and i are on record saying the same thing. 41% of americans worry about immigration. kellyanne, the highest rate we've seen in 11 years but also in the poll they find democrats are not worried. that shows a clear division among parties as to how they view the number of people crossing that border on a daily basis. >> that's right. in fact the 56% i referenced that oppose biden pulling back on title 42, 60% support among democrats. 8% among republicans and 31% among independents. independents are aligning with republicans on this. bill, i don't understand why this white house is not paying more attention to the public. they can't take a win on yesterday's judicial announcement that you no longer have to wear masks. instead of saying let's see they should be taking a win and not be taking the joif away from the public. on the issue of immigration they look at it through the donald trump lens. that's a mistake. they say trump bad, we're good. spite is no way to run a country. this is why his own democratic base, senators, excuse me, are turning on him a little bit. taking incoming. i would be very curious to see what senator maggie has lynn who won by 1,000 votes in 2016 if she welcomes biden's visit today. fentanyl is a large killer of people including new hampshire. >> bill: we're often the only network that covers the border issue. no one else is there. if they are, their stories aren't on the air, mark. >> it's the number three issue. if you look at issues it's the economy, virus, immigration, and then typically healthcare. so other networks should be covering it although i agree with kellyanne, it is mostly animating republican voerts, not democratic voters in terms of the way it plays out. most voters grossly underestimate by a factor of 10 how many people are really crossing the border. >> bill: mark, thanks. mark penn and kellyanne conway. thanks for coming back this week and we'll talk again next week. >> thank you. >> dana: johnny depp set to testify against his ex-wife amber heard. we're live outside the courthouse. chilling details emerging where a mother is found stabbed in a duffel bag in a safe neighborhood in new york. what police are revealing searching for the suspect. >> i saw her yesterday in her backyard. >> she was pretty calm. loves her family and boys. >> normal family, normal kids. nothing out of the ordinary. no, no, no. they're both invested... in green energy. and also each other. digital tools so impressive, you just can't stop. what would you like the power to do? as you point out it is not just l.a., it's across the country. >> we just arrested over the weekend in orange county an 18-year-old man who killed his mother when he was 13. a judge let him out on halfway house on an ankle brace let. he cut off his bracelet. we had to go out on easter sunday to arrest him. this is happening all over the country. we are electing woke judges and prosecutors. in my county they've recruited an individual to run against me from george gascon's team. people need to go to todd spencer.com and help me fight back this wokeness. we have to stop this. thank goodness for fox news and the fact you are actually telling people about what is going on in our communities. it is out of control. crime is up. think about this. a juvenile, this kid rodriguez, let's go back to that. what does he say? >> only after a disaster. the early 80s paul volker put us through a terrible time to cure the inflation of the 1970s. since then they've had a bad record at it. they did a little bit in 1994 but they just don't know -- how can you fine-tune 330 million people in this country. you can't do it. the fed should try to keep the dollar stable in value. if they had we wouldn't have the inflation we have now and in the future and leave it at that. why are they manipulating interest rates? it's like rent control. controlling the price of money. they always get it wrong. the question is how much they'll get it wrong. so in this book we go in the past how governments have messed up inflation. occasionally they do it right. most of the time they do it wrong. the movie today is an old one that goes back centuries. in romance time they used to blame christians. now it's meat company and oil company executives. >> dana: the white house has gone through the five stages of inflation grief. at first it was trtransitory, then trying to blame it on putin and saying there is nothing we can do about it. is there something they can do it? if they can't do anything policy-wise can they blame the fed instead of trying to blame putin? >> who reappointed the chairman of the fed? joe biden. senate looks like it will go through. they can't blame the fed on that since they put those people in there. now in terms of what should be done there are two kinds of inflation as we explain in the book. one is non-monetary when you get a war or drought or the shutdowns we had with this economy. the best thing you can do about that kind of inflation is leave the economy alone. let it heal. this administration won't do it. it is going to war against the energy industry. putting in regulations which raises costs. if they leave it alone it would work its way through. >> bill: this administration won't do that. >> on the fed side what they should do is stop printing so much money and stabilize the dollar and let the thing work itself out. it will work itself out quickly. let markets set the rate. >> what should the fed do? >> not artificially raise interest rates but borrowers and lenders set rates. in terms of the dollar the fed has over $9 trillion of its balance sheets. they should sell the bonds. a worse inflation today is last year the fed was printing $120 billion of new money each month. they bought the bonds, they buy them from you and credit your bank account with money created out of thin air. what they did then is they then borrowed the money back from banks overnight. so it was like pouring -- pouring a bucket of water in one end of a pool. >> bill: revolving door. economy 101. >> they have potential money ready to flood the economy. they should reduce that and let those bonds run out. stable dollar,let the economy alone. let the american people do the job. >> bill: in the interest of time if you're an american and age 40 or under or 45 and under you may not understand what inflation is all about. how do you explain that to someone who has not lived through it? >> it would definitely blow it up if they were to hit israel. one of our greatest allies in the region. the larger point survives that we're going to usher iran, if you will, back into the international community, normalize them, if you will, when they are trying to hold at risk our allies from abu dhabi to saudi to israel. and i'm not sure that's the formulation that should work for the united states as we try to insure that we -- our interests and allies are protected. >> dana: what about the fact that our allies there frustrated with the united states on several different fronts including energy policy? it's a joke. >> dana: i got it. very funny. >> bill: indulge me. >> dana: we were on that all hour. >> bill: russian forces now attacking cities and towns along the front hundreds of miles long in eastern ukraine a full scale offensive to capture the country's industrial hartland. president zelenskyy rejecting russian demands for surrender. >> no matter how many soldiers are drawn there we will defend ourselves. we will fight and not give up anything ukrainian. >> bill: matt finn picks up our coverage live in yu -- ukraine today. >> good morning, bill. the president here in ukraine is vowing to continue to fight but the reality is that russia has now officially begun its second major push in this war targeting the eastern portion of this country. even russians foreign's minister is confirming russia has begun a new attempt to try to control the future of ukraine. >> now we can already state that russian troops begun the battle for the dan bo*s which they have been preparing for a long time. significant part of the entire russian army is now concentrated on this offensive. >> this comes as the pentagon confirms ukrainians will begin training on american-provided howitzer within days to shoot down russian missiles or aircraft. in ukraine we interviewed a ukraine fighter pilot head of the military administration in the done ex region. the dire need for more equipment to secure the skiles in defense against russian missile attacks. 24 hours ago here in the town of lviv four missile strikes, three that hit civilian locations killing seven people. the first war-time deaths in this city. one missile struck a large tire shop and one worker there tells us about the moment his workplace blew up. >> i came up and start evidence -- start evidence to put the fire out. i started to put out the fire and everything started to explode. i just saw their bodies lying. i can't get over it yet. >> also in the city of mariupol there is an ongoing stand-off between ukrainian marines stuck in a major steel plant and thousands of russian troops there. every day the ukrainian troops resist and survive. they are pulling the russian troops away from the front lines in this new attempt. bill and dana. >> bill: lviv, ukraine, thanks. >> dana: republicans are laser focused on inflation ahead of the mid-terms talking about it every chance they get. democrats not so much. republican lawmakers using the word inflation six times more often than democrats since the start of the year. karl rove is former deputy chief of staff to george w. bush and fox news contributor. this doesn't work to ignore something and never talk about it especially when you can't hide inflation from people when they go to the grocery store and the gas station every day. they feel it every single day. >> absolutely. and boy do they feel it. let's take a look at some of the inflation numbers. groceries up 9.9%. gas up 18%. shelter, rent for example 5%. eating out 7%. milk 13, meat 14%. these are the kinds of things people are paying every single day and as a result it will dominate the fall campaign unless and until it starts to go away. it ain't going away. >> bill: here in the state of new york, 26% of voters say the economy is their top concern. public safety trumps it at 32%. i was just telling dana we'll have surprises in the mid-term that nobody sees coming. you can see some shockers in a place like new york where people looked around and said it ain't working out the way we expected it to go. >> absolutely. the numbers nationwide for inflation are worse. let's have a mini board. we'll do the mini board next. 36% approve of the president's handling of the economy and 56% don't. lots of polls ask the question do you approve of the president on the economy. a couple asked about inflation. those numbers are in the 20s. if he have is at 36 on the overall economy he is in the low 30s or high 20s on the issue of inflation. 22% think the country is going in the right direction. 77% think it's on the wrong track. terrible numbers driven largely by the inflation. also being driven by immigration. also being driven by crime. but the number one issue remains the economy. it is the number one issues and remains the number one issue and what the whole economic issue is mostly made up of are people's concerns of what they're paying at the grocery store and pump. >> dana: i have to bring up the democratic candidate texas beta o'rourke taken three different positions on title 42. this is the immigration policy that is on the chopping block right now. here is his latest position. watch here? >> i think it's time to end title 42. i don't think we should have implemented in. a cynical reading of u.s. law that has done nothing to improve public health or safety. >> dana: he was for it and now against it and he has flip-flopped more than john kerry. >> he is having this problem on a lot of things. for example, he in his earlier incarnation he said he would tear down the border wall. now not so certain he would tear it down. he was opposed to title 42. now he says we shouldn't get rid of it unless we have a replacement. this guy will be flip-flopping left and right. maybe trying to outdo john kerry. he is succeeding quite well early in the campaign. >> bill: the sound bite we played was sunday. five days prior call for three. five days, karl. it doesn't make sense to end this until there is a real plan and capacity in place to handle and address those that come over. that's a pretty fast one. >> if you don't like his opinion wait a couple weeks and he will change his mind on it. look, this is going to be an interesting race to watch. unlike his senate campaign where he could say things like i'm in favor of abolishing private insurance because i'm for medicare for all. every one of these things will be responded to by the governor abbott's campaign and as a result texans will see him for what he is. not capable of having a firm opinion and explaining it. >> dana: help me understand something. why would the white house, knowing what they are dealing with in terms of poll numbers and the fact that all these democrats are pulling away, including gary peters from michigan, senator saying guys, we can't do this. why would they float this, wait and go through all the political pain just to basically leave title 42 in place and get none of the political benefit for having made a good policy decision? >> well, i think they are between a rock and a hard place on this one. the left of the democratic party wants open board rs and they see title 42 policy as being a major deterrent. on the other hand, if you remove it, what we're effectively saying to people is if you are not in the united states and you want to claim asylum, you can now get here and you can claim asylum and remain because we've removed one of the last obstacles to be able to rapidly remove you out of the country. namely the threat of a title 42 eviction. so, you know, they want to play -- placate the left but they don't want the scene of large numbers of people. we're talking millions of people crossing the border. we have had last month i think it was the record number of apprehensions at the border. and for every one we apprehend there are people who are getting across who we don't apprehend. they are in a tough place. if you want to stop the scenes we saw over the last year at the border because they know what kind of impact that will have on public opinion by the fall election, then you have to have a policy like title 42 in place to give you a tool to remove people who would otherwise make a claim for asylum and be here. >> dana: we'll see what they end up doing. it seems obvious to me. thank you so much as always. >> bill: we mentioned this last hour how democrats and republicans see the issue very differently. for the first time in 11 years republican concern higher than it's been in more than a decade. democrats pretty much according to this polling are okay with this. whether or not it changes in five weeks is something else. >> dana: if the rest of the media covered the story it might not be that way. >> bill: no mask no more. listen. >> we just got an announcement a few minutes ago. some of you may have seen the press release a judge overturned the mask mandates. my company -- my company says at this moment if you choose to, you may remove your mask. >> bill: so that is just one scene. there were many. passengers on board a flight when they heard from the pilot they could take off their mask after a federal judge in florida who shot down the cdc mandate for public transit in flight. mask rules are no longer in effect for the train or the bus or the plane. and the tsa won't enforce it. fox business correspondent grady trimble at o'hare in chicago with the latest on the ruling. what did you find out? >> bill, they need to update the p.a. announcements at o'hare saying you still have to wear a mask under the law. it's not the case any more. a fair amount of people in the terminal choosing to wear a mask but a lot aren't as they board flights today. united was first of the major airlines saying they weren't requiring masks anymore. within a few hours all the other major airlines followed suit. as you just saw earlier there were a lot of people on board flights yesterday when they got the news. here is more of their reaction. >> congratulations. if you kill them, why do you take them away? you take them away because you don't want to be discovered, the person who committed this heinous offense also had entry to that home. >> bill: so far this is a mystery. who took the life of the mother of two. according to police, this woman went out with friends for a night in manhattan friday night. she was later found stabbed more than 50 times and her body discovered inside of a hockey duffel bag at 9:00 a.m. the next morning. former lieutenant of the police department is here to talk about this. you know the streets very well. queens, new york, east of manhattan. go back to your days wearing the badge, right? you show up on scene and what questions do you have as an investigators when you discover the gruesome nature of this killing. >> you want to identify who the victim is off the bat. the proximity of where the body was found to the house you find out is literally around the corner. a short distance. right underneath the jackie robinson over there. if you make the right over there it goes along the park. that's very close to where the house was. her residence was. that's somebody that just i feel wanted a short place just to get the body out of the house. it was anybody that planned this, they wanted the body someplace else not around the corner from where she is. >> bill: you are saying the person did not plan it? >> i'm saying they didn't plan what to do with the body. >> dana: then do you agree with the thinking this is -- the perpetrator is likely to have been somebody she knew well? >> i believe it. it's a crime of passion. somebody known to the victim because of the stabbing and how many times the person was stabbed and it could be like i said a crime of passion and i believe that that tip they have with the texting to the father could be just to throw somebody off. >> bill: so she has two sons. one age 17 was on a college visit in the state of oregon with his father. she has a 13-year-old boy apparently was home at the time. he must have heard something. >> you would think he would hear something. they questioned him and they released him to a family member later on. so they questioned him. doesn't mean they can't bring him back in, all right? they got the answers they wanted at the time and they'll see if he recants on anything later on. they'll examine the crime scene right now. it's somebody in the house that was familiar with the area. so you have to look at the son. no doubt about it. you do have to look at the son. >> bill: what are you watching as an investigator and waiting for? do you look at his phone, his computer? >> i believe they're looking at all of that right now and put a timeline to her as to when she came home. they can ping the phone and find out what time her last call was made and last text was made and see if anything if they can put a time of death on it as well an see if any calls or texts were made after that they'll put that into the timeline as well. they will put all the pieces together and i'm sure they are not in a rush with this. they'll go through it methodically and combine it with the accident scene and the corner. it will extend from the house to the body. >> dana: people in the neighborhood are shaken and upset and scared. but given what you have said, do you think they have reason to believe there is somebody there in the neighborhood that they should be worried about or specific to that particular house and victim? >> i think this is specific to this victim. the fact that she was stabbed 50 times. this person had a vengeance for her. for what reason they don't know. they have a person of interest. if it were somebody that's a danger to the public i can guarantee they would put something out there to tell the public you need to be aware. when it's close to home like that i believe they are on target and will proceed what they are doing right now. >> bill: "new york post" reported this morning two years ago in may of 2020 the husband reported the wife missing from the house. apparently she went out for a walk around midnight and didn't come back until 7:30 the next day. he called back and said he found her. does that mean anything? >> they will look at that and also look and see if there is domestic violence associated with this address at all and see who she was associated with. it could be many different things. it could be somebody she was involved with that nobody knew about. this is somebody that knew that house and could get in and out of the house and do what they had to do. so that's the big part about this. >> dana: we hope they find the perpetrator soon and bring that person of interest if that's the suspect. we'll know maybe soon? what are our border patrol supposed to do with that number? >> that's a daily occurrence. i get pictures sent to me of these unaccompanied children. just a couple of days ago down here in arizona there was a group of nearly 100 individuals from cuba and amongst them there were several children that were minors under the age of 6 from the three central american countries. so that's a daily occurrence. it is happening. continuing to happen because again there is no consequences for individuals coming across our borders. in america, where you can't even leave a dog inside a car with the windows rolled up, yet individuals are allowed to turn over their children to drug smugglers, human smugglers, sex traffickers and at the end are facing zero consequences for it. that's horrific to hear. >> bill: think about texas stadium between dallas and ft. worth. what does it hold, 70,000 or 80,000 people. think about that, right? fiscal year since october 1, six months now. you have a 1 million 26,000. how many times can you fill texas stadium for that number of people? year previous it's 571,000. you just wonder. >> that's the number of people getting apprehended. >> bill: the people making decisions in this country just don't care and have to be okay with it. >> it's horrific. that's just the individuals that are being apprehended. you start looking at some of the numbers of the individuals getting by or what they determine might be getting by and then you start seeing the amount of drugs coming into the country. so it has created a complete domino effect. not just what is being apprehended and released in the country. the drugs coming across, what's not being apprehended and the drug cartels are the ones heading this entire operation. they'll flood one area with huge volumes of individuals. that way it distracts agents ashd makes agents go to that area and they have to process and there are gaps. that's where they are bringing everything else acoos into our borders. >> dana: agents feel like they're not supported. we hear that every day. if you remember last fall there was this incident of the haitian migrants coming across, mounted border patrol being accused by the administration of whipping migrants. that criminal investigation is finished. just to remind everyone this is what the administration said at the time back then. >> it was horrible to see as you saw. to see people treated like they did. horses nearly running them over and people being stra.d it is outrageous. i promise you those people will pay. there will be an investigation underway now and there will be consequences. >> what i saw, those people on horse back treating human beings they way there were was horrible. >> i don't think anyone would think it was acceptable and appropriate. >> dana: the criminal investigation is finished. >> you accused these officers of brutal and inappropriate measures. now that they've been told they won't be criminally charged will you apologize >> there was an investigation into their behavior so that investigation is playing out. whenever it's going to be announced the department of homeland security will announce that and have a comment on it after that. >> dana: i imagine the border patrol agents won't get an apology. will they be able to get back to work soon? >> no doubt we've entered a new phase. a lot of people will celebrate. this is a story as much about the overreach of the administrative state. you take the alphabet soup of federal agencies, fsa, fda. sec. these organizationers are exceeding their legal authority and i'm proud for the judge in florida who stood up and say they did not have the legal authority to pass the regulations that they did. guess what? our administrative agencies can only administer the laws passed by congress. what we're seeing in this country every day in the name of science. you are seeing administrative state exceed its legal authority. that's what i think is the most important fact of the ruling was the heart of the legal basis for it. >> dana: strange thing to me is also that nobody yesterday in the administration said well we might be disappointed with the ruling but let's remember we aren't where we were in march of 2020. we have vaccines. we have therapeutics. many people with natural immunity. we know a lot more than we did before. we know planes are safer because of the recirculated air. no attempt to even assure people who might be concerned about this move. i have think that's a missed opportunity. >> i think it's a missed opportunity but more than that. i think it is rooted in a philosophy that actually has nothing to do with facts or science. while actually claiming to masquerade in the guise of fact and signs. i think this judge put her finger on the right pulse. this is about the overreach of state power itself. we have a constitutional system of checks and balances that says that if the people in this country want to have mask mandates on airplanes there is a way to do it. elect representatives to congress and to the senate who pass the law. what is happening via the white house and administrative state is they're trying to do what the constitution doesn't allow them to do by evading political accountability to do it disguising it in the judgments of the cdc, faa and the tsa. that's the reason why. ist is not just an error,ist -- it is part of the intention itself. >> bill: musk said board salary zero if my buy-out concedes. conventional wisdom investors thought about this deal over the weekend and saying it is not going to happen. but when you see the stock price now around $47, $48, i see it differently. investors are saying there will be a deal eventually and it will either be $54 or higher than that, maybe 60 or beyond. how do you see it?
