>> well, it must have been pretty hard, pete, for them to print that cover. i mean, they have done everything except spoon feed joe biden anything he might possibly need to succeed as president of the united states. and, yesterday, he has still seemed to fail. so i assume that was a really tough thing for them. but i think it shows you that things have gotten so bad in america. we have such a low point right now that even the far left "time" magazine who loves to hate donald trump, who loved to fawn over any democrat possible even they can't say anything good about joe biden. i mean, he is literally in storm on their cover. i'm happy to see that the least people are recognizing the abysmal failures of this administration. the problem is we have three years left. will america ultimately survive this? this is the administration that killed fitness and gym industry. i can't even stop. >> pete: good point. >> rachel: let's just move on. i'm not a fancy lawyer like will cain. so i don't understand all the legal stuff. can i just say as a normal citizen i'm confused. why are we even debating a mandate for a vaccine that we know doesn't work, doesn't stop you from spreading covid. in fact, you are more likely to get it from -- if you have the vaccine than natural immunity and why are we debating a vaccine mandate for a medicine for which there have been no long-term studies? i am not a lab rat. my children are not lab rats. we should have the right to decide whether or not we want to put this in our bodies when there have been no long-term studies. this is insane. it doesn't matter if i work for the federal government or not and i feel sorry for our military because i guess they are not included in this. >> pete: and they have not given a single religious exemption to anyone across all of our military branches. will, as our fancy lawyer on the program tonight as rachel aptly titled you, what are the legal consequences of this? >> well, buckle up, put on your seat belt, because here comes some fancy law talk. there is morals and then there is legal analysis of this news today. let's start with the legal. because i don't think it's as promising as it probably sounds in the short-term. i'm a little surprised at this judge's judgment, pete. because, look, you would know, this you served in our military, you know that there are many shots that you had to take as a member of that military and as a member of federal employment. what more, the supreme court just said that they could force hospital workers whose hospitals took money from medicare and medicaid to get the vaccine. this was different than the private employers. that came down just last week. so it would surprise me if on appeal the supreme court or appellate court didn't say no, no, no. federal employees you have to follow executive order. that's my legal analysis. here is the moral analysis. it doesn't matter. the supreme court is not in charge of morality. the supreme court is not in charge of medicine. the supreme court is not in charge of the philosophical foundations that underpin this country. free people are. as we watch countries like australia or several european countries now wander down the path of mandating the vaccine for their citizens the only real thing that will protect us as free people will not be the supreme court of the united states. it will be ourselves. we have to stand up for ourselves. yes, at the ballot box but in every other possible way we have to stand up for ourselves because joe biden and people like him will take every inch of freedom along the way that we allow. >> it make please think of aequales gym in new jersey the guy who said you are not going to lock our gym down when phil murphy went after them team and time again and said this is not going to end. and it hasn't to your point. they advised kick boxing and yet you can't go n a lot of places. we unfortunately have to leave it right there. you guys are the best as always rachel and will. thank you so much for your time tonight. on "fox news primetime" and great job by the way each of you hosting throughout the year. around 6 trillion of your tax dollars have been spent fighting covid-19 so far. that's more money than was spent on world war ii. 6 trillion. let it soak in. where did all the money actually go? get this number. well, 357 billion of it was given to people who weren't even unemployed. joining me now host of no interruption on fox nation tomi lahren and charlie hurt. charlie, tomi, thanks for being here. tomi, we give the federal government trillions and trillions of dollars. would -- with very limited parameters on who gets it and how we oversee it. should would he be surprised by any of this? >> surprised that government incompetence? no, i don't think so. but think about any other job, any other role in the yants and around the world for that matter where you could give away $100 billion fraudulently and still keep your role, still keep your title, still keep your position. that's what we're allowing the federal government to do. to make matters worse they want more of it they see a problem. they see fraud. they see corruption. they see mismanagement and do you know what? how old was the suspect? does the suspect have a criminal past is what we have seen in the past is that a lot of people who should be behind bars end up getting let go or not prosecuted for prior crimes because we think we can just quickly and easily rehabilitate them. unfortunately, in a lot of these cases we can't. and then something potentially like this can happen. >> pete: absolutely. we are getting more information in realtime as i mentioned. gunfire erupted around 5:10 on west 135th street. police responding to a dispute between a mother and son. one of the officers was struck in the face by gunfire. law enforcement sources says the suspect was also shot according to initial reports. nypd urging people to avoid that area in a tweet and mayor eric adams headed to harlem hospital where the officers were being treated and now, according to sources, are now confirmed dead. you had mentioned, again, we have -- don't have a lot of information that's early. mentioned eric adams going to the scene. is he a mayor who was elected in part on cleaning up the crime that has happened in new york city. similar to across the country. >> yeah. this is time to show his experience as an officer, not just as a leader of the city but as someone who understands what now this department is going through. when you lose an officer, let alone two, the entire department hurts, and we have seen officers all across the country feel like they are not getting supported by political leadership or by the citizens that they are representing. so, now is the time to show that kind of compassion to people who lost their partners in all of this. this hurt. >> pete: you better believe it hurts. and it's infuriating. it's absolutely infuriating when you consider what these men -- they don't get paid a lot to do this. they go out on behalf of us and we don't have their back. jason rantz you covered this so well. thank you for being a voice on this tragic evening. more "fox & friends" -- excuse me not "fox & friends."
