and can't get anything done. the explosion in covid-19 cases on his watch after he promised to shut down the virus. meanwhile some schools across the country are actually shutting down again. let's ask about that if we could. our own sean hannity says today's news conference is really about one thing. >> they aren't concerned at all about their failing policies, spiking inflation, rising gas prices, open borders, supply chain crisis or of course the americans they left behind in afghanistan that we will never forget. instead the administration apparently believes that they have a messaging problem. just the problem is messaging and in order to solve the messaging problem some advisors want joe biden to spend more time communicating directly with you, the american people. >> harris: even cnn is calling out biden with this headline. an overdue presser. biden set to take reporter's questions in first formal news conference in months. they're right about that, jackie. >> it sure is overdue. a lot of us are looking forward to this today. the president will face questions on his first year in office amid deepening democrat angst over his struggle to deliver on some key promises. legislative losses on build back better, voting rights, police reform. record inflation, persistent supply chain issues, lagging polls, escalating foreign policy challenges and surging covid cases and crime. the white house is trying to spotlight accomplishments. >> it was the biggest year of job growth in american history. look a year ago, only 1% of adults were fully vaccinated. 74% of adults are fully vaccinated now. 40% of schools were open a year ago. now over 95%. >> it comes as democrats are calling for a reset ahead of the mid-terms. they want a new cdc director. talk among moderate democrats breaking up build back better. bipartisan talks about modest election law changes. and administration is looking to executive orders to log some kind of movement on police reform. covid has been the biggest thorn in the president's side especially after his promises to shut down the virus. >> there is enormous anxiety about covid and anxiety about prices. the president will speak to that this afternoon as well at the press conference. he is focused on doing everything in his power to tame the virus and to bring prices down. >> we'll likely hear from the president about foundation his administration laid for future progress that is ahead but we likely will not hear is any sort of legislative strategy. there is a new effort from within the white house to have the president appear more like the president and less like the senator he was for 36 years, harris. >> harris: wow, okay. thank you very much. jason chaffetz fox news contributor and former utah congressman. let's start there. make him look more like a president? what does that even mean? is there a reset that one can do for that? >> you know, i like what my former colleague jim jordan said. if the biden plan is working how come it's not working? so he can try to reset but if you go back to the beginning of this presidency joe biden's promise was that he would unite the nation. he was going to bring us together and work on both sides of the aisle. what we should have been listening to is bernie sanders. sanders said he would be the most progressive president in our nation's history. the fundamental problem for joe biden is his policies are failing. they are disastrous for the economy and for america. so he can try to pivot and sway one way or the other but the other core problem he has, harris, he is not a good communicator. you let him loose on the microphone he is no bill clinton or barack obama. he will cause more problems than solve them by talking more. like kamala harris's biggest failure. i need to get out of the office more but it make things worse, not better. >> harris: crazy about the microphone. a song, not really. the president came into office with a 200-page plan to shut down the coronavirus. jason, we talked about this. it's the reason why a lot of people voted for him even though those who maybe weren't as yoked to his policies otherwise. the "washington post" is going through it now page by page and here are a few of the points where the president struggled or failed to deliver. let's turn to page 59. predictable and robust federal purchasing of coronavirus tests. well, we know how that is going. it's still going. page 81. support schools and implementing covid-19 screening testing. flip to 103, insure patient safety in nursing homes by boosting staffing and vaccinations. we'll hear what the president has to say about his pandemic response later today. i imagine he will be asked all about it. yesterday, though, press secretary jen psaki was asked about a report claiming biden was not present at a briefing by covid advisors who recommended mass distribution of tests. the white house rejected that advice and we saw a massive surge. watch. >> was president biden personally briefed at the time on that recommendation before it was passed over? >> we've done a lot of what was discussed in that meeting that happened a couple months ago including massively expanding our testing programs and capacity. >> i'm wondering who were the advisors and was president biden briefed on this idea at the time? >> i think i just answered your question which you may not have been listening zbloo. that's not the question i asked. >> do you have another question of the. >> was president biden briefed at the time. >> i've answered your question. >> harris: i met you on the hill before tv. you were chairman of the oversight committee in the house. if you had somebody on your staff who didn't communicate with you clearly about that type of detail there is a surge coming and people will die you better get more tests you would fire them. your response. >> you would think. look, if the president wants a major reset on covid, he will have to fire dr. fauci because the people that he puts out front to be the mouthpiece for this administration i just don't think are trusted by the majority of americans. the guy has more time for press briefings and photo shoots and doesn't have the time to do the science. until he is fired i think america is still going to wonder what's going on there. and look, the president has admitted that he forgot to order the tests. he probably should have done that. the problem is now we're trying to do the masks and we'll throw out all these tests to all these americans? yeah, hang on, i'm about to break my own record. only pay for what you need. ♪ liberty. liberty. liberty. liberty. ♪ it's been nearly two years since the pandemic started. our students and teachers tried their best, but as a parent, i can tell you that nearly 18 months of remote learning was really hard. i'm so angry that instead of helping our kids get back in the classroom, the school board focused on renaming schools schools that weren't even open . please recall all three school board members now. for the sake of our kids, we can't wait one more day, never mind a whole year for a fresh start. >> two more democrats announced today they aren't going to run for reelection. they can no longer defend the president or their own party. they see the writing on the wall and know republicans will win back the majority and they can't defend it any longer. >> harris: well, it does seem like the list gets longer almost by the day. two more house democrats say they will retire after their current term. the total now 28 dems retiring or seeking another office by november. that is about 12% of the party's entire caucus. and that gallup poll out yesterday showed americans giving the most support to the republican party since 1995 with nbc news with a grim assessment. here it is. right now the arrows are pretty much pointing in the shell acting territory for president biden and the democrats. power panel now, caldwell and walling, great to see you both. i want to go to your first to kind of pick it up from there. >> yeah, you know what's particularly interesting. you see the poll that came out recently shows there is a 39% approval rating for joe biden and i believe that's because joe biden's policies have become a leetch that sucks your blood on the american people. when i think about it maybe leetchs are more popular than him these days. he is losing african-americans. they now have a 48% approval rating of joe biden when it was in the high 80s prior to what has happened. folks realize that a lot of the promises and commitments he made whether it be he would eradicate covid or get the economy back on track or he was going to broaden our respect on the world stage, none of those things happened. things have become worse under his leadership democrats responsibly and those smart know it's time to retire. they have no more room to run this country. >> harris: kevin, what is your rebuttal to that? >> listen, we see this all the time in mid-term elections where the party in control of the white house loses a good number of seats and you see a lot of retirements in advance of that and what your reporting demonstrates. we saw the same thing with republicans in 2018. an uphill battle for democrats holding the house. i feel confident about the senate. >> harris: i adore you, kevin. before you sum up our reporting it's showing the numbers will be epic. this is not the typical for at least a couple of decades of presidency, maybe longer. not typical in terms of the numbers this president will shift. >> bill: barack obama lost 64 seats in 2010. you aren't talking about that level. i don't think it will happen again. republicans did pretty well down ballot in 2020 despite president biden winning by 7 million votes. there is a far less seats up for grabs for republicans because they had a pretty good night. i'm trying to make the republican argument. they had a pretty good night in 2020. >> joe biden has been in the basement president. a trophy president. barack obama is not to be compared to joe biden in the same light. >> we talk about seats lost in a mid-term election. >> joe biden is not the same person. he is not the same there will be a major shift. we have never seen it like this. even in 2008 the economy hasn't been like this. >> 2008 the economy was in awful shape coming out of the great recession. >> harris: look, let's dial it back to what you both were just talking about. i heard you throw that out there kevin you talk about campaign styles. one of the big criticisms across the board of president biden is that the messaging is a mess coming from him and his white house. that is when they can agree. let's toss that in. do they even talk? look at the latest. did president biden go to that meeting on testing and learn how desperately we would need it by now? he didn't go to the meeting. did you brief him? i'm moving on. you've already asked that question. that was jen psaki at the press briefing yesterday. when the messaging can get on the same page it is messy. it is basically a campaign problem. we've been seeing that forever except for the fact the first part he was mostly in the basement. now he is mostly in delaware. kevin. >> we'll hear from the president directly at 4:00 and he will answer all these questions coming before him in terms of covid, mid-terms and filibuster and in terms of all these issues facing the american people especially including inflation. we'll hear directly from the president this afternoon and we'll hear from him directly on march 1 for the state of the union speaking directly to the american people. >> harris: did he reset and get the polling numbers up? absolutely. we see this all the time in the first year of a presidential administration. bill clinton was in shambles and barack obama was in shambles without a lot of accomplishments. george w. bush was -- coming out of 9/11 in terms of reset. you see it all the time. >> harris: we'll move to this. delaware is where the heart is. according to the "new york post" that's where biden is spending a lot of his time, 28%. every four days he spends a day there. the white house is withholding visitor records for who is actually going and coming from the bidens' homes in wilmington and rehobeth beach. press secretary jen psaki defended that decision once again. watch together. >> well, the president goes to delaware because it is his home. it is also where his son and his former wife are buried. and it is a place that is close to his heart. a lot of presidents go visit their home when they are president. >> harris: this comes after biden repeatedly vowed complete transparency from his administration throughout the last year. that bit that she tossed in at the end about the familial connection. we all get that. loved ones notwithstanding, that's a lot of time down there. >> absolutely. a lot of time spent and the hypocrisy is simply put wasn't he the same folks criticizing trump for not being in the white house seven days a week? these are also the same people who said this would be the most transparent administration in the country. certainly we've not seen that. there is a cloud over the administration. a cloud over the administration from the election when it comes to the hunter biden issue, chinese influence. those considerations are fueled there. what happens is the lack of transparency on this issue only deepens those consideration and provide a greater cloud. >> harris: kevin, from my experience in media, the less we see of him direct like this, this formal news conference is the first in many, many months, the more i guess hungry they get, the hungryer they become and more questions on the topics that jen psaki says he might not want to touch. >> i'm a big believer to be biden be biden. >> harris: what does that mean exactly? who is biden? >> i want to see him doing more press conferences. he gives speeches two or three times a week. >> harris: not helping his polling. >> let's see more of him, though. again i'm a big -- i want him to be front and center. i want him to be accountable and answer these questions from the american people. these conversations about the visitor log are a side show. he is coming on the heels of donald trump who refused to release any white house logs. this administration released all the white house logs and coming on the heels of donald trump who spent 150 days in his first year in office at one of his homes. again, this gotcha stuff is silly because republicans do it, too. democrats, republican presidents are allowed down time and become better presidents when they feel at home and have that release as opposed to constantly being in office. >> harris: you and i don't have time for us to go back over former president trump and what was released and obama. the ruling about what you release to also came from merrick garland. we could talk for half an hour. i do want to pause for a second to hit what you just said. biden is in a special position right now because it was widely reported that right before the pull-out in afghanistan that turned out to be deadly and chaotic he was headed there. he was headed back to delaware and had to be just talked to about maybe now is not the time. just want to point that out. gentlemen, i have to let you go. >> let's hope in the 100 day press conference he doesn't refer to his vice president as president harris. >> we'll be watching. >> harris: thank you. police in california are searching for the man accused of killing graduate student brianna kupfer and sadly not shocking anymore, they say he should have never been out on the streets with his criminal history. and this. >> the mayor here is a disappointment. alleged murderer had a history of crime and had eyes of law enforcement authorities and mental health authorities. >> harris: new york city that brand-new mayor eric adams speaking at a vigil for a woman pushed to her death onto the subway track. people demanding he crack down on crime. the mayor says it is a lot of the problem that really people don't understand. it is just fear, he says, not reality. really? joe gamaldi fraternal order of police in "focus." with no down payment. and they're holding the line on purchase loans with rates in the twos. already own a home and need cash? with the newday100 loan, you can get up to $60,000 or more and lower your payments $615 a month. no bank, no lender, no one knows veterans like newdayusa. >> harris: police are searching for the subject of graduate student brianna kupfer. smith has a long rap sheet. there is a good chance he is getting around on public transportation and should be considered armed and dangerous. jonathan hunt is live in los angeles with more. jonathan. >> brianna kupfer was working alone in the store on that fateful day and according to police, texted a friend and said someone who had come into the store was giving her, quote, a bad vibe. minutes later the 24-year-old lay on the store floor dying, covered in blood stabbed, police believe, by the person who was giving her that bad vibe. now they've issued an appeal to find 31-year-old shawn lavalle smith seen leaving the store in a back alley and later going to a store and paying for a vaping pen and calmly walking out. smith is believed to be homeless. a long criminal record across the country. the most serious charge against him appears to be firing a weapon into an occupied vehicle. that incident happening not here in california, but in south carolina with smith freed there on a $50,000 bond having, according to our sources, put up less than 10% of that bond in charleston, south carolina. police say that smith is out here believed to still be in l.a. somewhere, probably, they say, using the bus or local train system and they say no one should approach him because he is very clearly armed and very dangerous. harris. >> harris: we'll stay on it. thank you very much. for more on this i want to bring in joe gamaldi national vice president of the fraternal order of police. great to have you in "focus." i want to start off with what we're seeing unfold and the types of crimes. >> yeah. i think what you are seeing right now is violent criminals getting out over and over again thanks to rogue d.a.s like george gascon in l.a. in his environment we've had murders go up 71% in l.a. a complete disaster. crime and disorder everywhere you look. you have 30 municipalities voting a no confidence vote in him. if he had any shame or integrity he would resign in same from his position. when we talk about these horrific crimes that happened to that young girl like brianna we forget about the families impacted. her life was taken from her. this family will have to recover from this. nobody stops to think about the things that they have to go through on the back end of this. and the worst part about it is the d.a.s who continue to push these policies that have caused so much pain, so much despair and trauma, they have no intention of changing whatsoever. and history is going to judge them for their cowardice. >> harris: in the meantime we have to live through their decision. we are looking into the abyss right now. while you were talking we had on screen something and i want to pop it back up. i'm curious to see what you think of the videotape. brianna kupfer died and now we have the video of what happened with the suspect after her death. what do you make of what we're seeing in terms of, you know, what we face right now? >> i think what we're truly facing is monsters like the suspect who brutally murdered young briann yeah. they don't fear the criminal justice system anymore. he walked out of that furniture store and casually goes to the store and picks up a new vape pen. they don't fear being caught because they know they'll be let out on a low bond and not prosecuted to the fullest extent of the law and they'll get out once again to continue to offend. look at this individual. he has been through the criminal justice system for the last 11 years. most recently picked up for resisting arrest and theft charges a few months back and had the court system and d.a. done their job, this young woman would still be alive with us today. >> harris: and i think about all the cops, too. they see this going on. you lead them at the f.o.p. and they can't stop it. it is out of their hands. they can do the reassessing and do their jobs. he is the suspect. we don't know all of the details yet. but the videotape is there and we can certainly speak to that. new york city brand-new mayor eric adams was among the hundreds of people at a vigil last night for michelle go. go was pushed onto the subway tracks and she died after what police say was a mentally ill homeless man who shoved her. there was an oncoming train. critics say mayor adams needs to do more to address violent crime particularly on the subway especially after comments like these. >> one crime on our subway system. but we know that public safety is not only actual but it is perceived and when you have an incident like this the perception is what we're fighting against. >> harris: however, the "new york post" says the fear is warranted. police data show subway crime is up by 65% in the first two weeks of this year. mayor adams telling our own bryan llenas just yesterday. you heard what he said on saturday. this was on tuesday. so as we deal with the crime problem, we also have to deal with the fact that people feel unsafe. that's the dual battle that i had because we don't do them both together. if we don't, we fail. i would add to that a few more of his words because i'm reading from that interview. what do you make of this? on day one i took the subway system and felt unsafe and saw homeless everywhere. people were yelling in the train. how do we go from that to no, it is all in your heads to oh, it's both. what's going on? >> yeah, i'm going to have to disagree with the mayor who says when it is just fear. this is reality for new yorkers. murders are up 45% in new york. shootings are up 102%. you mentioned subway crime is up 65%. he wants to say it's just fear? no. it is reality. and i applaud the mayor he is talking about crime and appears he wants to do something about it. right after we had that horrible tragedy where ms. go was shoved, this monster on the tracks and we have a sitting council member and say we need to erect barriers around the subways to stop people from pushing people. really? >> well, i think the quickest way to say it putin knows he can get away with it with little cost and repercussions. he invaded ukraine under the obama administration days after the sochi olympics and what did he get in terms of costs in return? he got access to the black sea through crimea, one of the most industrialized productive regions of ukraine. very little repercussions and he will do it again. the other piece, harris, i can't overstate how biden's energy policy is playing into this. when you shut down american pipelines, fracking and drilling and move us away from energy independence you make the world more reliant on putin's oil and gas. every time you see the cost of oil going up and the price on that barrel going up, putin is getting richer, more bold and he smells weakness right now and he is taking advantage of it. >> harris: look, you mention energy and i kept help but think an article i read yesterday saying germany is rethinking the in order steam 2 pipeline. one of the first things the president did was wipe away the keystone pipeline and he was okay with the deal of russia. does everybody see the crayon on the wall? >> by the way, harris, biden did that for environmental reasons but his own energy secretary admitted in a hearing with me that the type of gas moving through nord stream to is dirdy. it allows putin to bypass and hold ukraine hostage. biden talks about putting sanctions in place. for them to be in work they have to be in dollars and euros. i don't see germany getting on board because again, they are now dependent as soon as they turn that pipeline on. >> harris: quickly ukraine. would we ever be in a position to have to defend them? they aren't officially in nato. >> we're not talking hundreds of thousands of american troops on the ground. what we can do and should be doing and democrats and republicans in a briefing i was just in on this matter are frustrated and fully support sending more supplies, more resources and more and better types of lethal aid that ukraine has been asking for. they are willing to fight. we have to help them do it. we have to deter putin from making this decision on the front end and stop talking about getting tough after they are invaded. >> harris: what you just laid out i don't know if he will listen. he will get together with xi at the olympics. that's being reported, too. he has his tentacles everywhere. >> the more we allow democracies fall, this is a slippery slope biden is on. >> harris: associated press is reporting a government watchdog warned the pentagon months in advance from what we knew that afghanistan's air force would crumble without help from the united states. the report also notes that the u.s. spent 8 1/2 billion dollars supporting the afghan air force over nine years yet the system fell apart after most american troops left and the taliban quickly folded in. congressman waltz, some of this we were getting a drip drip. what do you think of the latest details? and can't get anything done. the explosion in covid-19 cases on his watch after he promised to shut down the virus. meanwhile some schools across the country are actually shutting down again. let's ask about that if we could. our own sean hannity says today's news conference is really about one thing. >> they aren't concerned at all about their failing policies, spiking inflation, rising gas prices, open borders, supply chain crisis or of course the americans they left behind in afghanistan that we will never forget. instead the administration apparently believes that they have a messaging problem. just the problem is messaging and in order to solve the messaging problem some advisors want joe biden to spend more time communicating directly with you, the american people. >> harris: even cnn is calling out biden with this headline. an overdue presser. biden set to take reporter's questions in first formal news conference in months. they're right about that, jackie. >> it sure is overdue. a lot of us are looking forward to this today. the president will face questions on his first year in office amid deepening democrat angst over his struggle to deliver on some key promises. legislative losses on build back better, voting rights, police reform. record inflation, persistent supply chain issues, lagging polls, escalating foreign policy challenges and surging covid cases and crime. the white house is trying to spotlight accomplishments. >> it was the biggest year of job growth in american history. look a year ago, only 1% of adults were fully vaccinated. 74% of adults are fully vaccinated now. 40% of schools were open a year ago. now over 95%. >> it comes as democrats are calling for a reset ahead of the mid-terms. they want a new cdc director. talk among moderate democrats breaking up build back better. bipartisan talks about modest election law changes. and administration is looking to executive orders to log some kind of movement on police reform. covid has been the biggest thorn in the president's side especially after his promises to shut down the virus. >> there is enormous anxiety about covid and anxiety about prices. the president will speak to that this afternoon as well at the press conference. he is focused on doing everything in his power to tame the virus and to bring prices down. >> we'll likely hear from the president about foundation his administration laid for future progress that is ahead but we likely will not hear is any sort of legislative strategy. there is a new effort from within the white house to have the president appear more like the president and less like the senator he was for 36 years, harris. >> harris: wow, okay. thank you very much. jason chaffetz fox news contributor and former utah congressman. let's start there. make him look more like a president? what does that even mean? is there a reset that one can do for that? >> you know, i like what my former colleague jim jordan said. if the biden plan is working how come it's not working? so he can try to reset but if you go back to the beginning of this presidency joe biden's promise was that he would unite the nation. he was going to bring us together and work on both sides of the aisle. what we should have been listening to is bernie sanders. sanders said he would be the most progressive president in our nation's history. the fundamental problem for joe biden is his policies are failing. they are disastrous for the economy and for america. so he can try to pivot and sway one way or the other but the other core problem he has, harris, he is not a good communicator. you let him loose on the microphone he is no bill clinton or barack obama. he will cause more problems than solve them by talking more. like kamala harris's biggest failure. i need to get out of the office more but it make things worse, not better. >> harris: crazy about the microphone. a song, not really. the president came into office with a 200-page plan to shut down the coronavirus. jason, we talked about this. it's the reason why a lot of people voted for him even though those who maybe weren't as yoked to his policies otherwise. the "washington post" is going through it now page by page and here are a few of the points where the president struggled or failed to deliver. let's turn to page 59. predictable and robust federal purchasing of coronavirus tests. well, we know how that is going. it's still going. page 81. support schools and implementing covid-19 screening testing. flip to 103, insure patient safety in nursing homes by boosting staffing and vaccinations. we'll hear what the president has to say about his pandemic response later today. i imagine he will be asked all about it. yesterday, though, press secretary jen psaki was asked about a report claiming biden was not present at a briefing by covid advisors who recommended mass distribution of tests. the white house rejected that advice and we saw a massive surge. watch. >> was president biden personally briefed at the time on that recommendation before it was passed over? >> we've done a lot of what was discussed in that meeting that happened a couple months ago including massively expanding our testing programs and capacity. >> i'm wondering who were the advisors and was president biden briefed on this idea at the time? >> i think i just answered your question which you may not have been listening zbloo. that's not the question i asked. >> do you have another question of the. >> was president biden briefed at the time. >> i've answered your question. >> harris: i met you on the hill before tv. you were chairman of the oversight committee in the house. if you had somebody on your staff who didn't communicate with you clearly about that type of detail there is a surge coming and people will die you better get more tests you would fire them. your response. >> you would think. look, if the president wants a major reset on covid, he will have to fire dr. fauci because the people that he puts out front to be the mouthpiece for this administration i just don't think are trusted by the majority of americans. the guy has more time for press briefings and photo shoots and doesn't have the time to do the science. until he is fired i think america is still going to wonder what's going on there. and look, the president has admitted that he forgot to order the tests. he probably should have done that. the problem is now we're trying to do the masks and we'll throw out all these tests to all these americans? about 9 or 10 months later than they should have been. >> harris: senate majority leader chuck schumer plans to force a vote on changing the filibuster rules so democrats can ram through that proposed elections overhaul despite not having the votes to get it done. he sent this message to republicans and fellow democrats who won't fall in line. >> we must consider and vote on the rule changes that are appropriate and necessary to restore the senate and make voting legislation possible. we're going to vote. we're all going to go on the record and republicans will have to choose which side they stand on. >> harris: mitch mcconnell called out democrats' hypocrisy and more. >> voting the break the senate is not cost-free just because a bipartisan majority of your colleagues have the wisdom to stop you. democrats want the american people to believe the filibuster was not a jim crow relic in 2005. it became a jim crow relic in 2021. briefly stopped being a jim crow relic last thursday but now back to being a jim crow relic this week. >> harris: he is following the trail of times the democrats said we like it, let's keep it and then we don't. jason. >> the hypocrisy is stunning but i probably differ than almost all of my former colleagues here. i think the house and senate should be voting more often, not less often. america shouldn't be afraid of voting on things. i'm opposed to changing the filibuster and opposed to the underlying legislation they are trying to pass but i applaud the idea we'll vote more nofn this country rather than put our finger to the wind and say the whip talked to members and they don't like it. go ahead and vote. i think it will get defeated as it should. >> harris: all right. let's check this out. liberal late night host stephen colbert mocked senator krysten sinema on her support of the filibuster. >> they hope the spend the holiday spending much needed voting rights legislation and need to modify the filibuster. that dream died last week thanks to arizona senator and mrs. hamburglar sinema. she announced that while she values voting the filibuster is her first love. >> harris: he was roasting her and critics wroteed him. this is supposedly comedy. the jab at the woman's appearance is a fun one. the misogyny of the radical left has been on full display the last few days. jason. >> i guess as republicans we're used to it. it happens day-by-day from the late night talk show hosts but if they think they are going to make joe manchin and kyrsten sinema into their way. these people are principled. when they take a position it won't be stephen colbert trying to get them to change their position. but i haven't found him funny in a while. i think he is a partisan democratic hack at this point. >> harris: wow. he called that woman a hamburglar. oh boy. jason chaffetz. thank you very much. that woman is a sitting senator. make sure to tune in for fox news channel to watch president biden's news conference live today scheduled for 4:00 p.m. eastern. our coverage begins with martha maccallum. and, of course, with plenty of analysis after you don't want to miss this. and there is no place like home. the white house is defending president biden for spending a lot of his first year, 28% of it, in his one of two houses in delaware. but it is not just the amount of time which people are noticing. it is not knowing who the president is spending all that time away from the white house with. the log, what's on them? yeah, hang on, i'm about to break my own record. only pay for what you need. ♪ liberty. liberty. liberty. liberty. ♪ it's been nearly two years since the pandemic started. our students and teachers tried their best, but as a parent, i can tell you that nearly 18 months of remote learning was really hard. i'm so angry that instead of helping our kids get back in the classroom, the school board focused on renaming schools schools that weren't even open . please recall all three school board members now. for the sake of our kids, we can't wait one more day, never mind a whole year for a fresh start. >> two more democrats announced today they aren't going to run for reelection. they can no longer defend the president or their own party. they see the writing on the wall and know republicans will win back the majority and they can't defend it any longer. >> harris: well, it does seem like the list gets longer almost by the day. two more house democrats say they will retire after their current term. the total now 28 dems retiring or seeking another office by november. that is about 12% of the party's entire caucus. and that gallup poll out yesterday showed americans giving the most support to the republican party since 1995 with nbc news with a grim assessment. here it is. right now the arrows are pretty much pointing in the shell acting territory for president biden and the democrats. power panel now, caldwell and walling, great to see you both. i want to go to your first to kind of pick it up from there. >> yeah, you know what's particularly interesting. you see the poll that came out recently shows there is a 39% approval rating for joe biden and i believe that's because joe biden's policies have become a leetch that sucks your blood on the american people. when i think about it maybe leetchs are more popular than him these days. he is losing african-americans. they now have a 48% approval rating of joe biden when it was in the high 80s prior to what has happened. folks realize that a lot of the promises and commitments he made whether it be he would eradicate covid or get the economy back on track or he was going to broaden our respect on the world stage, none of those things happened. things have become worse under his leadership democrats responsibly and those smart know it's time to retire. they have no more room to run this country. >> harris: kevin, what is your rebuttal to that? >> listen, we see this all the time in mid-term elections where the party in control of the white house loses a good number of seats and you see a lot of retirements in advance of that and what your reporting demonstrates. we saw the same thing with republicans in 2018. an uphill battle for democrats holding the house. i feel confident about the senate. >> harris: i adore you, kevin. before you sum up our reporting it's showing the numbers will be epic. this is not the typical for at least a couple of decades of presidency, maybe longer. not typical in terms of the numbers this president will shift. >> bill: barack obama lost 64 seats in 2010. you aren't talking about that level. i don't think it will happen again. republicans did pretty well down ballot in 2020 despite president biden winning by 7 million votes. there is a far less seats up for grabs for republicans because they had a pretty good night. i'm trying to make the republican argument. they had a pretty good night in 2020. >> joe biden has been in the basement president. a trophy president. barack obama is not to be compared to joe biden in the same light. >> we talk about seats lost in a mid-term election. >> joe biden is not the same person. he is not the same there will be a major shift. we have never seen it like this. even in 2008 the economy hasn't been like this. >> 2008 the economy was in awful shape coming out of the great recession. >> harris: look, let's dial it back to what you both were just talking about. i heard you throw that out there kevin you talk about campaign styles. one of the big criticisms across the board of president biden is that the messaging is a mess coming from him and his white house. that is when they can agree. let's toss that in. do they even talk? look at the latest. did president biden go to that meeting on testing and learn how desperately we would need it by now? he didn't go to the meeting. did you brief him? i'm moving on. you've already asked that question. that was jen psaki at the press briefing yesterday. when the messaging can get on the same page it is messy. it is basically a campaign problem. we've been seeing that forever except for the fact the first part he was mostly in the basement. now he is mostly in delaware. kevin. >> we'll hear from the president directly at 4:00 and he will answer all these questions coming before him in terms of covid, mid-terms and filibuster and in terms of all these issues facing the american people especially including inflation. we'll hear directly from the president this afternoon and we'll hear from him directly on march 1 for the state of the union speaking directly to the american people. >> harris: did he reset and get the polling numbers up? absolutely. we see this all the time in the first year of a presidential administration. bill clinton was in shambles and barack obama was in shambles without a lot of accomplishments. george w. bush was -- coming out of 9/11 in terms of reset. you see it all the time. >> harris: we'll move to this. delaware is where the heart is. according to the "new york post" that's where biden is spending a lot of his time, 28%. every four days he spends a day there. the white house is withholding visitor records for who is actually going and coming from the bidens' homes in wilmington and rehobeth beach. press secretary jen psaki defended that decision once again. watch together. >> well, the president goes to delaware because it is his home. it is also where his son and his former wife are buried. and it is a place that is close to his heart. a lot of presidents go visit their home when they are president. >> harris: this comes after biden repeatedly vowed complete transparency from his administration throughout the last year. that bit that she tossed in at the end about the familial connection. we all get that. loved ones notwithstanding, that's a lot of time down there. >> absolutely. a lot of time spent and the hypocrisy is simply put wasn't he the same folks criticizing trump for not being in the white house seven days a week? these are also the same people who said this would be the most transparent administration in the country. certainly we've not seen that. there is a cloud over the administration. a cloud over the administration from the election when it comes to the hunter biden issue, chinese influence. those considerations are fueled there. what happens is the lack of transparency on this issue only deepens those consideration and provide a greater cloud. >> harris: kevin, from my experience in media, the less we see of him direct like this, this formal news conference is the first in many, many months, the more i guess hungry they get, the hungryer they become and more questions on the topics that jen psaki says he might not want to touch. >> i'm a big believer to be biden be biden. >> harris: what does that mean exactly? joe gamaldi fraternal order of police in "focus." with no down payment. and they're holding the line on purchase loans with rates in the twos. already own a home and need cash? with the newday100 loan, you can get up to $60,000 or more and lower your payments $615 a month. no bank, no lender, no one knows veterans like newdayusa. >> harris: police are searching for the subject of graduate student brianna kupfer. smith has a long rap sheet. there is a good chance he is getting around on public transportation and should be considered armed and dangerous. jonathan hunt is live in los angeles with more. jonathan. >> brianna kupfer was working alone in the store on that fateful day and according to police, texted a friend and said someone who had come into the store was giving her, quote, a bad vibe. minutes later the 24-year-old lay on the store floor dying, covered in blood stabbed, police believe, by the person who was giving her that bad vibe. now they've issued an appeal to find 31-year-old shawn lavalle smith seen leaving the store in a back alley and later going to a store and paying for a vaping pen and calmly walking out. smith is believed to be homeless. a long criminal record across the country. the most serious charge against him appears to be firing a weapon into an occupied vehicle. that incident happening not here in california, but in south carolina with smith freed there on a $50,000 bond having, according to our sources, put up less than 10% of that bond in charleston, south carolina. police say that smith is out here believed to still be in l.a. somewhere, probably, they say, using the bus or local train system and they say no one should approach him because he is very clearly armed and very dangerous. harris. >> harris: we'll stay on it. thank you very much. for more on this i want to bring in joe gamaldi national vice president of the fraternal order of police. great to have you in "focus." i want to start off with what we're seeing unfold and the types of crimes. >> yeah. i think what you are seeing right now is violent criminals getting out over and over again thanks to rogue d.a.s like george gascon in l.a. in his environment we've had murders go up 71% in l.a. a complete disaster. crime and disorder everywhere you look. you have 30 municipalities voting a no confidence vote in him. if he had any shame or integrity he would resign in same from his position. when we talk about these horrific crimes that happened to that young girl like brianna we forget about the families impacted. her life was taken from her. this family will have to recover from this. nobody stops to think about the things that they have to go through on the back end of this. and the worst part about it is the d.a.s who continue to push these policies that have caused so much pain, so much despair and trauma, they have no intention of changing whatsoever. and history is going to judge them for their cowardice. >> harris: in the meantime we have to live through their decision. we are looking into the abyss right now. while you were talking we had on screen something and i want to pop it back up. i'm curious to see what you think of the videotape. brianna kupfer died and now we have the video of what happened with the suspect after her death. what do you make of what we're seeing in terms of, you know, what we face right now? >> i think what we're truly facing is monsters like the suspect who brutally murdered young briann yeah. they don't fear the criminal justice system anymore. he walked out of that furniture store and casually goes to the store and picks up a new vape pen. they don't fear being caught because they know they'll be let out on a low bond and not prosecuted to the fullest extent of the law and they'll get out once again to continue to offend. look at this individual. he has been through the criminal justice system for the last 11 years. most recently picked up for resisting arrest and theft charges a few months back and had the court system and d.a. done their job, this young woman would still be alive with us today. >> harris: and i think about all the cops, too. they see this going on. you lead them at the f.o.p. and they can't stop it. it is out of their hands. they can do the reassessing and do their jobs. he is the suspect. we don't know all of the details yet. but the videotape is there and we can certainly speak to that. new york city brand-new mayor eric adams was among the hundreds of people at a vigil last night for michelle go. go was pushed onto the subway tracks and she died after what police say was a mentally ill homeless man who shoved her. there was an oncoming train. critics say mayor adams needs to do more to address violent crime particularly on the subway especially after comments like these. >> one crime on our subway system. but we know that public safety is not only actual but it is perceived and when you have an incident like this the perception is what we're fighting against. >> harris: however, the "new york post" says the fear is warranted. police data show subway crime is up by 65% in the first two weeks of this year. mayor adams telling our own bryan llenas just yesterday. you heard what he said on saturday. this was on tuesday. so as we deal with the crime problem, we also have to deal with the fact that people feel unsafe. that's the dual battle that i had because we don't do them both together. if we don't, we fail. i would add to that a few more of his words because i'm reading from that interview. what do you make of this? on day one i took the subway system and felt unsafe and saw homeless everywhere. people were yelling in the train. how do we go from that to no, it is all in your heads to oh, it's both. what's going on? >> yeah, i'm going to have to disagree with the mayor who says when it is just fear. this is reality for new yorkers. murders are up 45% in new york. shootings are up 102%. you mentioned subway crime is up 65%. he wants to say it's just fear? no. it is reality. and i applaud the mayor he is talking about crime and appears he wants to do something about it. right after we had that horrible tragedy where ms. go was shoved, this monster on the tracks and we have a sitting council member and say we need to erect barriers around the subways to stop people from pushing people. really? >> well, i think the quickest way to say it putin knows he can get away with it with little cost and repercussions. he invaded ukraine under the obama administration days after the sochi olympics and what did he get in terms of costs in return? he got access to the black sea through crimea, one of the most industrialized productive regions of ukraine. very little repercussions and he will do it again. the other piece, harris, i can't overstate how biden's energy policy is playing into this. when you shut down american pipelines, fracking and drilling and move us away from energy independence you make the world more reliant on putin's oil and gas. every time you see the cost of oil going up and the price on that barrel going up, putin is getting richer, more bold and he smells weakness right now and he is taking advantage of it. >> harris: look, you mention energy and i kept help but think an article i read yesterday saying germany is rethinking the in order steam 2 pipeline. one of the first things the president did was wipe away the keystone pipeline and he was okay with the deal of russia. does everybody see the crayon on the wall? >> by the way, harris, biden did that for environmental reasons but his own energy secretary admitted in a hearing with me that the type of gas moving through nord stream to is dirdy. it allows putin to bypass and hold ukraine hostage. biden talks about putting sanctions in place. for them to be in work they have to be in dollars and euros. i don't see germany getting on board because again, they are now dependent as soon as they turn that pipeline on. >> harris: quickly ukraine. would we ever be in a position to have to defend them? they aren't officially in nato. >> we're not talking hundreds of thousands of american troops on the ground. what we can do and should be doing and democrats and republicans in a briefing i was just in on this matter are frustrated and fully support sending more supplies, more resources and more and better types of lethal aid that ukraine has been asking for. they are willing to fight. we have to help them do it. we have to deter putin from making this decision on the front end and stop talking about getting tough after they are invaded. >> harris: what you just laid out i don't know if he will listen. he will get together with xi at the olympics. that's being reported, too. he has his tentacles everywhere. >> the more we allow democracies fall, this is a slippery slope biden is on. >> harris: associated press is reporting a government watchdog warned the pentagon months in advance from what we knew that afghanistan's air force would crumble without help from the united states. the report also notes that the u.s. spent 8 1/2 billion dollars supporting the afghan air force over nine years yet the system fell apart after most american troops left and the taliban quickly folded in. congressman waltz, some of this we were getting a drip drip. what do you think of the latest details? >> bottom line is the biden administration knew that the afghan army would fail without the support of the afghan air force and that the afghan air force would fail without us providing the maintenance and logistics. we provided for years the pilots and aircraft but we hadn't fully trained the logistics piece. they knew it yet they withdrew many of them were contractors, they withdrew them all anyway. afghan president gani's last request and top priority was please to biden in july was to allow these maintenance teams to continue to support his air force so that they could fight on. biden withdrew them anyway. >> harris: wow. it is so great to get your perspective and the details coming from these meetings that you are having this on the hill and the house armed services. so important for the american people to see that today. appreciate you being in "focus." congressman. thank you. >> thanks, harris. >> harris: thank you for watching "the faulkner focus". up next after the commercial break "outnumbered." ever wonder what everyone's doing on their phones?
