nowhere. some teachers are refusing to go back to go to in-person learning. mayor lightfoot said city has spent more than $100 million on covid protocols. charles watson. charles: chicago teachers union is offering to send members back to classrooms monday but it won't be for in-person instruction, the newest offer proposes teachers show up to help students sign-up for covid-19 testing and handout laptops for remote learning which would begin on wednesday, according to data from chicago public schools, covid infections are surging across the district if case numbers slowdown, the union's proposal would allow in-person learning as early as the 18 and this would include weekly random school testing that allows student to opt out. in a press conference with reverend jesse jackson, the union says this is the best way going forward. >> i know that's been a concern but we are dealing with the high point of a surge, we have to have adequate safety measures in place. this is a plan that puts those in place, gives people the assurance and specific date that allows us to resume first instruction and then in-person schooling soon. charles: chicago mayor lightfoot remains schools are safe to students shoot the idea down on twitter and not listening and calling for return to in-person learning as soon as possible. lightfoot tweeting, quote, that's what parents want and that's what the science supports, we will not relent. now eric, according to reports there's agreement on both sides on issues like health screeners and contact tracing but stalemate remains in terms of metrics that would decide whether remote learning should be initiated and, of course, the big issue at hand is kids returning to in-person learning come monday, eric. eric: all right, charles, thank you so much. arthel: despite objections of some teachers unions, mayors, experts and even president biden have stressed the importance of keeping kids in school. and now the cdc director weighing in this morning on fox news sunday with bret baier. >> i want to remind people that in the fall of this year we had a delta surge and we were able to safely keep our children in school before we had pediatric vaccination. fast-forward to now, we have pediatric vaccination, of course, every jurisdiction is going to have to make the decisions locally but i will say is the most important thing we can do is get our children vaccinated, get our teachers vaccinated, get our teenagers vaccinated. arthel: let's bring in the dean of public health, doctor, good to have you. i want to ask you how much would vaccinating all eligible children reduce or alleviate the need for school closures? doctor: thanks for having me back. first and foremost there's no reason for school closures at this point. remote schooling has been a disaster for america's kids, two years after the pandemic this is even on the table. to your direct question, it would help a lot. it would help a lot for two reasons, and even omicron breakthroughs it's better to be vaccinated and second, some kids really do get sick and you would make a big difference but it's not necessary or essential as doctor walensky said, we can get kids back to school during the surge. arthel: what do you think of the schools that for whatever reason haven't been able to improve their ventilation systems? >> two first sets of issues. ten months ago. schools haven't spent the money doing that. that's irresponsible and people should be held to account. the second question what do we do now in schools that have not done it and what we know especially if you think about, for instance, teachers and their safety, teachers have all been vaccinated, boosted and people can ware high-quality mask which are readily available. ventilation and testing would be helpful. i'm a big believer of those things but they are not absolutely necessary to keep kids in school safe and we should be working on those things but while we get teachers and kids back to school. arthel: cdc endorsed pfizer for ages 12 to 15, five months after their second shot. this guidance is effective immediately. i want to ask you personally, would you give your eligible children a third shot? >> yeah, i have a 16-year-old who became eligible a month or six weeks ago and she got boosted and 14-year-old who just got eligible and we are setting up an appointment for her in the next week or so. the issue is with omicron two shots provides some protection and certainly but 3 shots are much, much better. over the lung run we will come to realize this is a three-course vaccine, 3-shot vaccine like polio, i do feel comfortable and i think the data is pretty clear that 3 shots are really helpful. arthel: what is your guidance on quarantining, testing and masking? doctor: yeah, a lot to cover there. what i believe is when it comes to fewer infected, the first five days or when you are most contagious, that's the super contagious time period. everybody should isolate for those 5 days. so you slow down the spread and to get a negative test and rapid test and it's negative, that makes you much safer to get out. if you're going to be in any kind of higher risk setting, you absolutely need to be wearing a mask because there's so much virus and so much spread happening right now. so the point is you can lower the isolation and you can keep people safe, we don't need 10-day isolations anymore. the key is first five days. arthel: okay, so when will we get past the first wave of omicron and how close are we drn coronavirus variety pack of seasonal viruses? >> two good questions. first how quickly are we going to get through the wave. i believe and predictions are tenuous but my best guess right now is we are going to see a peak of the omicron some time in the next couple of weeks, two weeks, obviously different parts of america and about once we get into february you will see case numbers really drop off. at that point, i think we as a country really need to look hard at covid and think about exactly what you raised. this becomes a part of a broader array of rsv, there's a series of respiratory virus that is we deal with and we have to develop a strategy to keep all of those down because we need to have hospitals functional and people in workplaces. we can do that if we take the long-term strategy. >> really quickly before you leave, cdc has been criticized for unclear messaging. however, can we expect some level of changing guidance as the behavior of the virus changes and the pandemic prolongs eventually, you know, evolves into an endemic or evolves into an endemic? doctor: you don't want cdc guidance from two years ago. so i think changing guidance is totally fine, i expect it will be more as we learn more. that is a natural part of a pandemic. i do think that maybe -- i'm hopeful that omicron is our shift away from acute pandemic more towards the endemic state but we will have to see how things go in the next few weeks and few months. arthel: okay, maybe more people get vaccinated and that will help curve this -- >> it'll help by a lot. arthel: dr. jha, thank you very much. eric: now to southern border, where the migrant humanitarian crisis shows no signs of letting up. bill is live at the border in la joya, texas with the very latest on that. hi, bill. bill: hi, eric, good afternoon to you. it's been a much slower week for you in the rio grande valley compared to what we are used to seeing. the mexican military is actually been patrolling the other side of the river this week and with that being said, the activity never just stops, take a look at what we saw yesterday right here in la joya yesterday in the afternoon, still people crossing, migrants, they are in much smaller groups compared to the pest. not groups of 3 to 500, individuals, smaller family groups mixed in with runners as well. even with the slue activity, so far, dhs source just since october 1st, well over 140,000 migrant apprehensions already in that activity is expected to pick up once the mexican marines leave the other side of the river and the temperatures start warming up once again. meanwhile you mentioned governor abbott, take a look at the video we shot yesterday. he was down here in rio grande valley in mcallen officially announcing his bid to be reelected for texas governor, he has made the border a huge part of his office so far and it's going to be a huge part of reelection campaign. he's blasted the biden administration. he said that texas has had the surge resources,ing inial guard, dps, building own border wall and spending millions of dollars to secure the border themselves. take a listen to what he had to say. >> i have deployed thousands of national guard troops and dps. and now texas is building its own border wall. bill: and speaking of the border wall, take a look at the video, this was last month in rio grande city and we were there as governor announced official construction of the border wall, 1.7-mile stretch going up. the idea behind it that it's going to plug the gaps where there's no federal wall. all being built with texas money, last thing his opponent beto o'rourke he's seizing on the border wall. he say that is texas doesn't need the border wall. that it's a waste of taxpayer money. he says the national guard shouldn't be down here and he says governor abbott doesn't know what border communities want. back out here live. the border crisis much bigger than just texas politics and what's been happening largely to play huge part in the attorney is facing more criticism from police saying he's too soft on crime. union representing nypd sergeant now claims the da's office, quote, intentionally omitted all facts when handling a case of violent death, alexis mcadams is live in new york now with the details. >> the union telling fox news this morning the district attorney's office is leaving out specific details to lessen charges telling officers to not sign off on any charge that is do not reflect the facts of this case. now this all comes as manhattan new district attorney you can see here attorney alvin bragg is under fire for controversial plans that he believes will make the criminal justice system more fair. last week bragg sending out memo outlining changes including no longer prosecuting some trespass offenses, the charge of resisting arrest, subway and bus fair beating and also sex work. bragg is reducing charges for stealing from stores or home storage areas and some accounts of drug dealing. though he says he's focused on getting violent offenders off the street the association telling me this morning which represent 13,000 active and retired police sergeants in new york, the policies that he's trying to make are not his job as district attorney. >> last i checked it was work with law enforcement, it was to uphold the laws of the state. he took an oath just like i took an oath 30 plus years ago to protect the citizens of this city. if we wants to change the laws and the pencil laws of the state, obviously he should have ran for a different position. >> we reached out to the da's office here in manhattan for comment and haven't heard this morning. no matter what the da plans to do, the office has to follow state sentencing guidelines. it's a story that we will continue to follow, arthel. arthel: new yorkers want to feel as safe as we did before the pandemic. alexis mcadams, thank you. eric. eric: guatemala says another migrant caravan is on the way, bill just showed us the migrants in smaller group but it's not letting up. critics continue to call on the biden administration to do more so how can our country finally put a stop and get control of a border, texas congresswoman beth van dye straight ahead when fox livert continues this sunday. arthel: as omicron variant continues to spread across the nation, california governor gavin newsom is pushing for more virus spending in hard hit state. the governor on saturday proposed $2.7 billion in emergency funding to combat the recent surge in coronavirus cases. much of the money would increase hours and capacity at testing sites and distribution of at-home tests. eric: we are still waiting on the biden administration to release report on border arrests and deportations for the fiscal year of 2021. this is the first time in a decade that the report has not come out in the calendar year. the administration could be stalling ugly numbers but the roundup of migrant crossings will be released within this month as migrant flow show nos sign of stopping. congresswoman, do you think they are late because they are still counting, so many zeros they have to keep going through the numbers, this is the first time in a decade or is it covid or just been delayed? >> it's a fair question and i don't want to speculate as to why it's late. they know what the numbers are. as they've been accumulating, accumulating this last year to horrific numbers, we know what they are, let's be clear, the administration from pretty much day one shut down building to have wall and opened up our borders and empowered human traffickers and smugglers and prevented ice from doing its job in the communities and now they are trying to hide the numbers or at least put a really good spin on them and that's going to take time to do. it should frustrate law enforcement agents across the country and that's are looking at this data to be able to prepare. it's bad enough that they are not doing that but now they are not releasing the numbers so police in our own communities and families can take -- can take the necessary arrangements that they need to be able to protect themselves. your last segment had to do with closing schools, focused on closing schools for public health for public safety and yet we are completely ignoring open borders and it's got to the point where the american people is getting frustrated. eric: how do they put a good spin on what's happening? >> that's the question in three weeks. we have seen, we have seen really good spins on the double talk, they say they will do one thing in a title when actually if you read a bill it's the exact opposite. we will see what they say. the numbers of illegal crossings has increased dramatically. the humanitarian crisis that's down there, you have been phenomenal in showing the pictures and yet even when you show the pictures, a tinny lens. i've been down there 7 times. when you see the humanitarian crisis, when you see thousands upon thousands of people that are coming over, it's crazy. it's all happening under the biden administration. eric: the numbers have been higher in the past during the george w. bush administration, in the thousands, you have been down to the border seven times, what are those humanitarian conditions like, are they letting in people with covid and what should the administration do right now the try and get a handle on this? >> i could tell you it's more difficult to come in from our southern border if you're american flaying from a vacation from mexico if you're walking in illegally, they have been honest that they are not able to give tests for folks coming back in and not able to give vaccinations for people that are coming back in. people are walking over the border freely. that's what i have seen firsthand and that's what reporters across the country have been able to capture and we are not just looking at covid issues, but we are also dealing with the botched afghanistan withdrawal and now we have inquiries terrorist activities at our border and that's to be concerning and -- >> eric: when you say terrorist activities, what reports do you have about that? >> hopefully that will come out in the report. when you look at the people they are coming over, they had over a dozen people on the terrorist watch list this past year that have been stopped. we had no idea who had come on through but while the entire focus of the administration has been on covid, they have destroyed the number 1 killer of americans under 45 which is fentanyl and fentanyl is coming in illegally over our borders because we don't have the controls that we had under the previous administration. eric: finally quickly, the remain in mexico is back because of court order but turns out there's only 30 people a day are sent back. how do you handle of that if it's just over two dozen? >> the fact is they are not doing their job. the motivation from mexico to be able to work with this administration is a joke because this administration has shown that they have no teeth. eric: congresswoman beth van of texas, former mayor, always good to see you. >> happy new year. eric: you too, arthel. arthel: manhattan's new district attorney says he's surprised he's taking so much heat from critics who call his policies soft on crime. next a victim's rights advocate and widow of a murder victim with personal perspective. ♪ ♪ ♪ s arthel: u.s. and russian diplomats meeting in geneva for security talks on ukraine, this comes after weeks of tension over russian troops along the border there. moscow already taking a hard line even before the opening handshake. senior foreign affairs correspondent greg pelcok live from geneva of the greg, what are you seeing from there? greg: we are all outside in geneva and that's where the crucial talks will be starting tomorrow. they're all triggered by one hundred thousand. >> u.s.-led alliance to back off from russia. here is how secretary blinken described the choices putin is facing. >> i don't know if the decision has been made and it's cleared that we have offered him two paths to it. diplomacy and dialogue and the other deterrence and massive consequences for russia if it renews aggression with ukraine and we are about to test which path president putin wants to take this week. greg: what wendy sherman and others will be trying to find out if russian deputy ministers and his team if there's any common ground to be found. there are some areas reportedly u.s. is ready to discuss including adjusting military exercises and the placement of missiles but it's not clear that that would be enough and the biden administration is catching flak for agreeing to the talks at the end of the barrel of russian guns. arthel, the talks are informally starting right now tonight with working dinner between the two sides and then to viena on thursday for international group. the stakes could not be higher, back to you. arthel: yeah, really interesting to see how putin responds. greg in geneva, thanks, greg. >> the policies are giving criminals a green light? >> no. it depends upon your definition of criminals and for all too long anyone we put in jail is a criminal. well you know what, we are putting in jail homeless people. eric: that's part of my interview with new district attorney bragg, progressive democrat who has come under fire for changing policies on prosecuting some crimes in new york city. he's reducing felonies to misdemeanors capping murder sentences at 20 years and says he will not prosecute a variety of other laws from drug deal to go resisting arrest. he says with rising crime the current criminal justice system is not working and needs alternatives like crisis intervention to deter criminals. this is the latest, just happened hours ago, a 19-year-old girl working at a burger king in east harlem was shot in violent robbery, she died. kristin naves shot dead in the robbery. jennifer harrison founder of victims right, new york pack, a group that speaks for crime victims, her boyfriend was stabbed to death allegedly by a parolee. what do you think of policies, not just mr. bragg but probation reporters across the country? >> exactly. i urge alvin bragg to meet with this attorney's family and let them know why this person that stole all of their hopes and all of their dreams does not even deserve to do 20 years in prison. i want him to explain to these parents who have to bury their young daughter why, how his announcement might have enticed this thug to grab a gun and rob the burger king. eric: the hall of justice talking about this saying that in some cases you need to have other approaches such as diversion, do you think that will stop crime and could that potentially have stopped this murderist thug who walked in the burger king, pistol whipped someone else and shot the poor 19-year-old teenager working on saturday morning, shot her and she died? >> you know, providing services and diversion is all great and we need to implement that but we can't remove any kind of enforcement at the same time, they need to coincide and work together. alvin bragg first day in office, i think, it was, he stood with families of criminals impacted by mass incarceration, meanwhile prosecutors have no idea what to tell families of victims who are awaiting trials, murder trials that are anxious and traumatized but indifference toward human life and lenient policies. when is alvin bragg going to meet with madeline, son survived afghanistan and served in afghanistan and did not survive new york city. he was a veteran, his four killers are up for trial. why is there -- why are their lives more important when they butchered his body? why are their lives more important than his and he needs to explain that to hassán's mother's world. >> will enforce violent laws and felonies, here he is yesterday talking about armed robbery. >> did you go into a store in manhattan to rob a store, that's armed robbery, that's serious and will be prosecuted, armed robbery in manhattan. y'all don't need to hear because that's the obvious but for anyone that needs to know, there it is. we are her he says this will be prosecuted but what you're saying the stress is on criminals and not the crime victims? >> exactly. you know, he can say whatever he wants in public bus his memo says differently. he's having his -- his da's falsify reports to account for and disguise lenient prosecution and, you know, maybe alvin bragg's private school and harvard education taught him that da stands for defense attorney but i beg to differ, it actually means district attorney, his job is to prosecute crime and enforce the law and if he could remember that and start fighting for the innocent victim that is he swore an oath to protect, that would be really great. eric: finally, you have been personally affected by murder, your boyfriend was murdered savagely stabbed. what is this like for crime victims and what would you tell mr. bragg and the other prosecutors. there's a case now where the police -- police officer refused to sign off on an arrest of someone who was charged with robbery that had sheers that threatened the security guard. what would you say to mr. bragg about being a crime victim? >> mr. bragg has never known what it feels like to be carried out of funeral home because you were so overwhelmed with emotion that you can stand up or carried into the church or to live for 17 years not knowing what would have happened if your loved one was not taken from you so horrifically or watch pictures on facebook or social media for 8 years of their -- the people that stole this from you and stole your life, spend christmas with their family and, you know, until he understands what that is like and until he meets with victims like myself and like madeline brame, he won't understand it and he refused to do so so far. i urge him to meet with the victims and not the criminals. eric: we will see if that, indeed, is what happens, if he meets with the family of the poor teenager, 19-year-old shot dead less than 12 hours ago in east harlem. jennifer, arthel, search warrant out of new mexico was issued 3 weeks ago for bad win's cell phone, detectives say it could help with investigation but baldwin has not turned phone in yet. the santa fe da's office has reached out to authorities in suffolk county new york where baldwin has a home for legal assistance on this. baldwin justified the situation on instagram. >> this is a process where one state makes the request of another state, someone from another state from another state can't come to you and say give me your phone, they can't do that. they are to go through the state, process that takes time and specify exactly what they want and you can't just go through your phone and take, you know, your -- your photos or love letters to your wife or what have you. of course, we are 1,000% going to comply with all of that. christina: attorney and legal expert has been following the case closely and he saw the instagram post and says baldwin's legal team is delaying handing over the phone based off of a jurisdictional technicality. >> technically speaking alec baldwin's legal team is correct, they don't have to honor a new mexico search warrant but customarily people would honor that and provide the evidence, the optics of alec baldwin's legal team fighting, executing a search warrant for his cell phone for 3 weeks isn't good. it doesn't portray a person that does want to comply. christina: no charges have been filed in october 21st shooting yet. detectives are looking how live rounds ended up in the film set and could take months before the investigation is over. arthel. arthel: all right, christina coleman, teach. eric. eric: police have found fifth victim linked to a man called the shopping cart killer. charged with the murders of two women, the police there say there are likely two more victims, possible with serial killer case, alexandria. >> the fifth potential victim has been identified as 40-year-old sonya champ of washington, d.c. her body was discovered near union train station back in september inside of a shopping cart. a tip connected this case to the others. >> we believe this may be anthony eugene robinson's fifth victim. this is based on digital evidence that puts him in the same vicinity around the time of the victim's disappearance. sad and tragic. >> robinson is currently in prison awaiting trials for the murder of two other women, tanita smith and aline redman found in november. additional charges are being prepared for 48-year-old stephanie harrison and 21-year-old shayane in dc. their bodies in a container in a shopping cart. brown's mom told fox news that additional victims amplify the pain. >> this is so unreal. this is just sick. it's bad enough you start it with one but to continue to do this like you're a tracking monster. >> police fear that there could be more victims up and down the east coast that they are combing through missing person's cases, robinson is from new york and living in dc, he was
