it down. the prime minister now says he -- the president now says he believes the new normal will not last forever, but that covid in our environment is, quote, here to stay. biden is also responding to an underperforming december jobs report. we have fox team coverage tonight. alexandria hoff has more on the vaccine mandates. first, though, to lucas tomlinson live at the white house. >> reporter: some medical experts think the silver lining with this new variant is an immunity boost. president biden insists things are going to get better despite a record number of cases nationwide nearly two years into this pandemic. >> no, i don't think covid is here to stay. but having covid in the environment here and in the world is probably here to stay. covid as we're dealing with it now is not here to stay. the new normal doesn't have to be. we have so many more tools we're adopting and continuing to develop that'll contain covid and other strains of covid. >> reporter: of course, that's not what we heard just before the 2020 election. >> i'm going to shut down the virus! i'll shut down the virus, not the economy. i'm not going to shut down the country, i by -- but i am going to shut down the virus. >> reporter: earlier this week the u.s. recorded over one million new covid cases in a single day, shattering the previous record. it comes amid a testing shortage nationwide. the white house has signed two contracts with industry to boost the number of tests working towards the president's goal of procuring half a billion. recall last year dr. anthony fauci predicting that if a majority of american adults are vaccinated, quote, i feel fairly certain we're not going to see the kind of surges we've seen in the past. on the economic front, the u.s. added just over 199,000 jobs in he's, falling well short of expectations according to the labor d.. the good news for the white house, unemployment fell to 3.9%. earlier today the former cdc director rebuked president biden for saying this is a pandemic of the unvaccinated. >> this is not an epidemic of the unvaccinated. i'm very disappointed when i hear those statements. clearly, many, many people that are infected today have been what cdc calls fully vaccinated and some boosted. >> reporter: president biden has accepted nancy pelosi's invitation to give the state of the union address on march 1st, the latest it's been given since 1934. of course, president jimmy carter was the last president to give a state of the union address via letter. jon: lucas tomlinson, thanks. well, chicago public schools will not open on monday unless the district and teachers union can reach a deal this weekend on enhanced covid health and safety protocols. today the union announced a new proposal to hold remote classes most of next week and return to in-person classes the following tuesday. the plan still includes an opt-out program to increase student participation and virus screening but drops a call that all students be tested before in-person classes resume. classes were canceled for a third straight day friday, and is here's what one parent told fox news today. >> it's terrible. you know, our children, we're waking them up early in the morning, my wife and i, we run a small business. we're trying to keep the kids going, so we're waking them up very early in the morning to have them realize to us, a writing -- can read to us, a writing assignment. they're sick of it. i have high schooler9 -- high schools, some of their friends are just going to drop out. jon: the district argues they've already spent millions of dollars. illinois has asked for tests in hope of resolving this dispute. well, as the supreme court heard orlando arguments yesterday -- arguments on the president's vaccine mandate, we got clues as to how the justices might lean. the court's liberals voiced support as a way to help curb cases while their conservative counterparts quelled the power the mandates would give the executive branch of the government. al sand drink that hoff has details. >> reporter: the supreme court is weighing two vaccine mandate cases, first is one for employees at larger companies, the sec applies to health care workers. for the first, justice sonia sotomayor pushed back on the use of the word mandate since employees have the option to test weekly and wear a mask. she along with justices breyer and kagan indicated that they support the requirements. >> more and more people are getting sick every day. this is the policy that is most geared to stopping all this. >> reporter: on the other hand, conservatives like chief justice john roberts questioned how much power such a sweeping requirement would give to the executive branch alone. >> i wonder if it's not fair for us to look at the court as a general periods exercise of power by the federal government and then ask the questions, well, why doesn't the congress have a say in this, and why doesn't this be the primary responsibility of the states. >> reporter: the five conservative justices seemed more receptive to a vaccine mandate for health care workers. one concerning takeaway for many were the false statements shared by justice sotomayor who phoned in to the hearing from her office. >> we have over 100,000 children, which we've never had before, in serious condition and many on ventilators. >> not true. we have not had 100,000 children in serious condition in u.s. hospitals. according to the cdc -- >> reporter: the number is actually around 3,000. but according to the cdc, it's unclear how many children were brought in for other reasons and simply tested positive upon arrival. the biden administration is ready to implement the vaccine requirements next week, so a decision could come in a matter of days or even hours. jon? jon: everybody's waiting. al sand drink alexandria hoff, thanks. a republican powerhouse in the u.s. senate gearing up his re-election campaign ahead of midterms, and another is reportedly joining him. first up, senate minority whip john thune as he runs for a fourth term saying in a statement he's, quote, always promised to do the work even when it was hard, uncomfortable or unpopular. meantime, sources close to senate ron johnson report that he's decided to go back on his promise to retire after two terms and that he could announce a re-election campaign sometime next week. but while the republicans appear ready for re-election, more and more democrats are bowing out of congressional races. so far 25 house democrats have announced they will not be seeking re-election in november, possibly putting the democrats' razor thin majority in jeopardy. joining us now is minnesota congressman tom amore. congressman, 25 democrats in all say they're not going to go back and try and retake their house seats. what does that do for you and your party? >> well, it just, it's actually a sign that they see what's coming. it's not just 25, jon, and i think you're going to see more. three of them are very powerful committee chairs, and there's even a subcommittee chair from the appropriations committee. this is a sign that they don't see a bright future with the election next fall. it just means we've got to work even harolder, jon. they're not going to give us anything, and we're not going to take it for granted. jon: we have images of those 25 who have announced so far that they're not running for re-election. now, some of them are trying to run for senate seats and so forth, but 25 is a fairly significant number, and there are some of the pictures including well known names like bear nice niece johnson of texas and bobby rush of illinois. they are among the 25 who have said they're just not going to run again m -- again. so what do republicans do to try to capitalize on those absences? >> well, jon, you win elections with great candidates with the right messaging, with enough resources. again, i'm confident we're going to have all three. it's -- but we're just not going to take anything for granted. open seats crypt a little -- create a little different measure. we may not have to spend as much money on some of these seats. but again, we've got a record number of candidates that have filed across the country even though it's a redistricting year. we're almost $50 million ahead in our fundraising pace from two years ago, and the biden administration whether it's inflation, crime, the incompetence at the border, they give us plenty for the messaging side. jon: there's a congresswoman you might have heard of from new york, her initials are aoc. her former communications director was on "the story" with martha maccallum and sayings -- says that he thinks the democrats ought to run a primary opponent against president biden in the event he decided to run for re-election. listen. >> you've got a guy that's pushing 80, right? and there wasn't even the certainty he was going to run for a second term when he first ranch so i think there's going to be, you know, if we see a midterm outcome where democrats lose the house and, god forbid, the senate too, i think that all bets are off, and we'll see the democratic party trying to go in maybe a different direction and sort of truncate its losses. jon: is that party splintering? [laughter] >> jon, it's never a good sign when you're not even a year into your first term, and they're already talking about who's going to replace you. yeah, they've got all kinds of different factions on the other side. again, we have got great candidates on this side. we're raising the money. we're going to make sure that we work hard over the next 9-10 months and make that a reality, a republican majority in the house. and if we do our job, jon, i believe we'll have a republican majority in the senate again as well. jon: the numbers, though, for your party have been slipping some. in the latest real clear politics generic congressional poll, 42.7% of respondents said they would vote for a generic republican candidate, 41.1% say they would vote for a democrat. that is hardly the makings of a land slide. and as i said, those numbers for your party have been dropping some. how do you -- what do you attribute that to? >> well, keep in mind, jon, that back in the election of 2020, november of 2020 on election day the generic ballot was d +6. we not only held every republican incumbent in the house for the first time since 1994, we picked up 15 seats. again, i feel very confident. we've got with great candidates out there. inflation is an issue that is the number one issue across this country. the crime wave, these are issues that have been created by the biden administration and democrats in charge, and because of this, voters are motivate to replace them. and that's why we'll win the majority in about nine months. jon: i know you're also encouraging republicans to run on a border security platform. but if you get all the republican votes, you know, for border security in the world and you have a president in the form of president biden and a vice president who don't want to enforce the laws that you and the congress pass, what good does that do you? >> well, again, elections have consequences, and i think people realize that this administration has failed on every step of the way since the beginning of last year. that's why they're talking about replacing this president just one year into his four-year term. jon, again, it's good candidates, the right message. we're going to -- i'm going to tell you, a vote for republican next fall is going to be a vote to get inflation urn control, it's going to be to have law and order, peace in our streets, allow people to be safe in their communities and in their homes. and a vote for a republican next fall is going to be a vote to have competent leadership once again in washington. jon: congressman tom emmer, republican in minnesota and the guy who's kind of in charge of getting candidates to line are up across the country, thank you. >> thank you, jon. jon: well, the biden administration has yet to release an annual report on arrests and deportations along the border for fiscal year 2021. that document typically is parished -- published before the end of the calendar year. i.c.e. tells fox news the report is in final review and is expected to be out later this month. bill melugin live in la jolla, texas, with more on the situation there. bill. >> reporter: jon, good evening to you. it's actually the first time in a decade that i.c.e. has failed to release that annual report by the end of the calendar year. more on that in just a few moments, but first, we had yet another human smuggling-related crash here in the rio grande valley. take a look at this video yesterday morning in farr, texas. this is about 30 minutes away from where we are right now. law enforcement sources tells us a human smuggler was fleeing with five illegal immigrants in his vehicle when he rolled that car over, lost control on the expressway and crashed. no word on any injuries, but we did see several migrants being walked away by border patrol. that human smuggler was arrested. this is incredibly dangerous. keep in mind, just last month a local mother and daughter here in the rgv were killed when they were crashed into by a human smuggler. meanwhile, out of border patrol's el centro sector in california, they apprehended 26 illegal immigrants they found riding on a train in an effort to get further into the united states. many of them were young children. based off what we could see, excuse me, in those photos. and this is something we see often as well, they will hitch rides on train toss try to get deeper into the interior of the country. then more to that i.c.e. report. first time in ten years that this report is not out by the end of the calendar year. this is for fiscal year 2021 which ended on september 30th. it details i.c.e. deportations and arrests, and i talked to i.c.e. about this, and they told me that it's in final review, there's no delay, and it should be out later this month. but a former i.c.e. official tells fox news there's no excuse for this report to not be out yet. they say it's unprecedented. we talked to former director tom homan, he says when he was leading the agency, he had that report in his hands by november. he believes the administration is slow walking it because it's likely going to show a steep drop in deportations during this historic border crisis. take a listen to what he had to say. >> if they're proud of their policies that joe biden is doing the right thing, they ought to be having a press conference and bragging about the success of i.c.e., what i.c.e. has done this past year. but they won't do that because the truth is they have crippled i.c.e. there is no enforce. ment for immigration, and they're proud of it. this is part of the open borders agenda. >> reporter: and, jon, some concerning statistics coming out of the rio grande valley sector, a dhs source telling us since october 1st there have been more than 60 sex offenders apprehended here in this sector, and on top of that, more than 13,000 known gotaways. again, those are the migrants they see on the cameras mourners paid their respects to the at late senator harry reid at his funeral in las vegas. the senator died almost two weeks ago after a long battle with cancer. he represented nevada in the senate for five terms. president biden, former president obama, speaker of the house nancy pelosi and senate majority leader chuck schumer all spoke at the ceremony today. william that jewish necessary is a whole lot, more of a doer than a talker. and one of the funny anecdotes we heard was it didn't matter who you were, harry reid would hang up the phone would saying good-bye, considering it a waste of time and words. today friend and family described him as a loving father and loyal colleague who often prayed in private for guidance. early on reid was a key democrat, his values -- conservative democrat. he fought for the party and rarely gave up, but he was also a pragmatist who crossed the aisle said former president -- excuse me, former senator joe biden, saying reid favored progress over partisanship. >> he never gave up. he never gave up on anybody who cared about him. -- he cared about. like every great leader, he led the democratic caucus just not by speaking, but by listening, by hearing all points of view. >> reporter: reid grew up in searchlight, nevada, he worked in a gas station and later on capitol hill as a policeman to put himself through law school. former president obama gave today's eulogy. he credits reid's humble beginnings for his knack for deal making even with those he didn't agree agree with or, frankly, didn't like. >> pragmatism, sensibility, a premium on getting things done, lack of pretending and abiding loyalty. that's what harry reid represents. >> reporter: reid's legacy nationally was passing obamacare in a very narrow senate but also for using the nuclear option to overcome a republican filibuster which, jon, obviously some people say has come back to haunt the party. here in nevada, of course, he's a legend. he secured water supplies to allow las vegas to grow like it is. the senator will now be flown to washington, d.c. to lie in state at the u.s. rotunda, or the capitol rotunda for a ceremony on wednesday. jon? jon: william la jon: i'm jon scott, and this is "the fox report." it's the bottom of the hour. if you're just joining us, here's a look at our top stories. authorities are searching the last known residence of harmony montgomery, a little girl who disappeared at the age of 5 but wasn't reported missing until two months ago. authorities are asking anyone with information to call immediately. authorities in virginia say they've found another possible victim of the shopping cart killer. investigators believe the body is the killer's fifth victim, and they're searching for others. the suspect, anthony robinson, is awaiting trial in connection with two of the murders. and the oxford, michigan, school shooting case, accused shooter ethan crumbly's case moving directly to trial. meanwhile, prosecutors outlined more evidence showing his parents' reported disregard for their son's mental health including excerpts from his journal and texts he sent to his parents. for more on these and other stories, download the fox news app. you can scan the qr code on your screen or go to foxnews.com/apps. well, the newly-elected manhattan district attorney, alvin bragg, today outlining priorities he says will make the criminal justice system fairer. it comes after he announced his office would no longer prosecute what he calls low-level offenses. alexis mcadams live in new york city with that. >> reporter: hi, jon. this da's only been in office for a few days, and there's so much controversy already. he says he's not soft on crime and plans to go after violent criminals just without destroying the lives of low-level offenders. this morning we were there as he joined the reverend al sharpton to speak about his controversial plan to cut back on crime. in this memo you see here bragg advising his office to not prosecute some hoe-level misdemeanors like marijuana possession, prostitution and resisting arrest. after the big pushback, the da now clarifying that all felonies will still be prosecuted. listen. >> gun crime is on the rise, domestic violence is on the rise, we have got sexual assault. that's what's going on with the status quo, so we know we need a change to address that. and the way to do that partnered with traditional public safety methods is to invest in our communities. this is going to make us safer. it's common sense. i don't understand the pushback. >> reporter: does not understand the pushback, does not understand the controversy, he says. but no matter what the da does plan to do, he does acknowledge that his office has to follow state sentencing guidelines. on friday the new police commissioner reportedly sending an e-mail to the entire department. she believes that these changes will put officers at risk and critics agree. >> what you have here is a da who's just abusing his power right now saying he's going to pick and choose what crimes he wants to enforce. >> reporter: reverend al sharpton says the da and the police commissioner just need to talk. >> well, i think that they need to hear what he said today. i hope they will talk to him to get clarity. >> reporter: bragg released a statement this morning saying he's had productive conversations with the commissioner, also adding that assaulting an officer is a felony that his office will prosecute. jon? jon: alexis, thanks. joining us now, former boston police department superintendent in chief dan ya lin sky, now a fellow at the duff and phelps agency for good governance. chief, you've heard the da in manhattan say he thinks this is going to make this city safer. what's your take? >> yeah, i think it's about time to stop politics and focus on public safety, right? so both sides are on soap boxes. what they need to do is come to the table and have a conversation about designing a public safety strategy that the community wants and the police and prosecutors can provide in new york. discretion is always there. cops not arresting people for shoplifting, every day in my social media feed i see a police officer who's paying for a family that was shoplifting clothes or food for children. that's accepted by all sides. so a lot of that is rhetoric. we do need to -- jon, you're a pilot, right? pilots have checklists, what works and what doesn't work. we know that including the community in our policing strategies has been effective in what we need to do. we know that working together, police and prosecutors, probation, judges, parole, public service agencies, that's a solution to these challenges and problems. and as soon as we can get away from political discussions and focus on what the community wants -- the community doesn't want a crime to be the prosecuted, they'll rally their legislators and have them repeal, rescinded p p or revoked. and that's where we immediate to work together on a case by case basis. not every shoplifting is a shoplifting. the folks who are going into gucci stores with sledgehammers and crowbars, that's not shoplifting. that's armed robbery. it needs to be treated as such. and i think it's less about political pundits in conversation and more about sitting down in the trenches working together. the mayor and the district attorney have four years to work on making improving security in new york, and i think they can do it if they come together at the table with their experience and their teams working hand in hand to identify those truly violent offenders and the challenges facing our community. jon: he even suggested that armed robbery is not a crime that he's going to pursue vigorously. howard safer used to be the police commissioner in this city of new york. here's what he had to say about the new, the a's proposals -- da's proposals. >> he was elected to prosecute crimes, not to change the law. and what he's doing here is changing the law and enabling criminals to do outrageous things. this is stupid. my advice to the people of the city of new york is hold a recall election right now. jon: it was, you know, under the giuliani administration when they started going after small crimes, turnstile jumpers, the broken windows policing, that new york city really got cleaned up. a lot of the guys responsible for little crimes were doing big crimes as well. so does how'd safer -- howard safer has a point? >> how'd safer has a point, but i think it's a little early to make that point. we've heard words and speeches. let's see where the actions are. if the da is legitimately dismissing armed robbery cases and putting people in the community at harm, then i think the residents of the community should hold him accountable. if it's more about thoughts and ideas and the default is we're going to see if there's a way, you know, that this person's drug addicted and no one was seriously hurt, a way we can do something other than putting them in prison, okay, maybe that's what we do. but it's all a case by case basis. professional prosecutors look at each case on the facts that they are and make smart decisions working hand in hand with police officers who are helping to make those decisions who are on the street every day. jon: "the new york post" took a look at his proposals and put out an op-ed titled thus: alvin bragg's psychotic policies are a gift to the gop. it says. and it goes on to read: every republican candidate at every level for every office in the united states and will cite bragg's memo as a vanguard document of the democratic party. is this a political issue? is it going to rebound -- resound, i guess i should say, to hurt democrats nationalliesome -- nationally? >> we have seen where progressive das are trying to get away from traditional prosecutions. and in some areas, it has helped address crime. in boston we've got a progressive da who had some very controversial issues, but yet we saw a reduction in crime because even though there was disagreement on the how and the what, the day-to-day, the prosecutors working hand if hand with police to make sure we provided a scaife and -- safe and secure environment for the citizens of boston. prosecutors have just turned a blind eye and have shut the police out and the community out from some of those conversations, and, again, going back to that checklist, it's when cops, community and prosecutors work together. and that's federal, state and local level trying to deal with the challenges we face in securing our society. at the same time, having a just police system, justice system that allows people to make mistakes and not have that completely destroy their life for the rest of their time on earth. jon: it's one thing to allow judges and maybe prosecutors to have some discretion, but if you announce that you're just not going to prosecute armed robbery anymore, aren't you just invoting more armed robbery? >> they call me mr. six. tibbs. jon: reaction is pouring in after sidney poitier died thursday night at the age of 94. his children called him their, quote, guiding light and say he, quote, always put family first. poitier was the first black man to win a best act terror oscar in 1964. the second, denzel washington n2002 called poitier a, quote, gentleman who opened doors for all of us. ♪ misty water9-colored memories of the way we were ♪♪ ♪ jon: one of the hits co-written by award-winning lyricist and women's rights activist marilyn bergman. she died this morning from non-covid-related respiratory failure. she took home several grammy, emmy, oscar and golden globe awards over span of her career right beside her husband and collaborator, alan. bergman was inducted into the song writers' hall of fame in 1980. new developments in the deadly "rust" movie set shooting investigation. police in new mexico still trying to obtain actor alec baldwin's cell phone despite issuing a search warrant weeks ago. authorities in suffolk county, new york, are now involved in the investigation. christina coleman is live in los angeles with the latest on that. christina. >> reporter: hi, jon. yes, it's unclear why alec galled wynn has not -- baldwin has not turn over his cell phone yet. we've reached out to his attorney and authorities in the new york. authority released this statement saying the suffolk county sheriff's office has received a request from the santa fe, new mexico, police authority's asking for assistance. to work out the differences in laws between new mexico and new york. last month baldwin's attorney said they proactively requested that the authorities get a warrant to obtain his phone to protect his family and personal information that is unrelated to the investigation. a search warrant was issued for the device on december 16th. nearly two months after the deadly october 21st shooting on the set of "rust." but again, baldwin still hasn't turned over his phone. text messages or e-mails pertaining to the film could be hell -- helpful to the investigation. >> now we are weeks later, and they don't have the phone? are you kidding me? last time i checked whenever you issue a search warrant, you take the warrant, you go over to somebody's house -- you don't call up the lawyer and said, hey, since you rep a bigtime celebrity, we want to try try to arrange serving the search warrant. that's not how it works in the real world. >> reporter: even though baldwin was holding the gun when it went off killing the cinematographer and injuring the film's director, he says he's not responsible for the tragic incident. he says he didn't know how live rounds ended up on set, and he also said he was told the prop gun was cold meaning that it did not contain any live rounds. >> do you feel guilt? >> no, no. i feel that there is, i feel that someone is responsible for what happened, and i can't say who that is, but i know it's not me. i mean, honest to god, if i felt that i was responsible, i might have killed myself if i thought i was responsible. and i don't say that lightly. >> reporter: no one has been charged in the shooting yet. the da says it could be months before this investigation is over. jon? jon: christina coleman live in los angeles, thanks. a connecticut community is mourning the death of a high school hockey player in a tragic and horrifying accident on thursday. tenth grade grader the teddy balkind fell on the ice, and then his throat slashed by the blade of a fellow player who could not stop in time. charles watson joins us with more. >> reporter: yeah, jon, it's just a horrible tragedy that some in the world of ice hockey are calling a very rare accident, one that claimed the life of tenth grader teddy balkind who was a student at st- canaan, county. he was competing in nearby greenwich thursday evening when the tenth grader fell to the ice. while he was down, authorities say a nearby player couldn't stop in time and ran into balkind's neck with the blade of their skate. we're told the game was stopped almost immediately to get the young man medical attention before he was transported to an area hospital where he was later pronounced dead. it's not clear yet now if the sophomore was wearing a neck guard at the time of the incident. former coach says while usa hockey recommends players wear one, they're only required for goalies. even then some say there's no guarantee it would have prevented this unusual incident. >> one of the problems with the neck guards besides being so cumbersome is they didn't eliminate the risk of lacerations, and sometimes the skate would hit the neck guard and move to another part of the neck and still penetrate if that was what was going to happen. so these aren't flawless. >> reporter: yeah, and communities both in new canaan and the world of hockey are mourning the loss of balkind, some including nhl stars sharing photos of hockey sticks with the hashtag sticks out for teddy. the nhl tweeting: it mourns the loss of teddy can balkind, a member of the hockey family lost too soon. philadelphia flyers' right wing cam atkinson tweeting that he's heart broken for the balkind family. he goes on to say a horrible tragedy playing the game we all love in new canaan. teddy was a wonderful young man, always smiling, a terrific teammate. no words are adequate for the grief we are feeling and, jon, that is the outpouring of love and support that we're seeing from not only the people we just mentioned, but other organizations like the new york islanders and the new jersey devils and usc hockey as well as folks in that new canaan, connecticut, community. a lot of folks taken off guard by this tragedy, and a lot of folks hurt, jon. jon: so sad. our prayers go out to his family. charles watson, thanks. coming up, we now know why tennis star novak djokovic p says he deserved an exemption from australia's vaccine mandate. the latest on this international standoff next. ♪ ♪ hi susan! honey?
