>> that's for the second case, this mandates vaccinations for people that work at a facility that gets medicare or medicaid funding. seems like the justices were more for holding that mandate. we're reading the tea leaves here, this is super fast-tracked. i expect a decision within days, the most a couple weeks. we're standing by. >> wow. incredible. so they have a fast timeline here. there were some thoughts originally going into this that a conservative court largely might sort of repel the notion of any forced mandates. that might not be a given though, right? >> yeah, i think that's true in both cases. the osha mandate is in more danger meaning it's more likely the justices would stay that one. the one with healthcare workers has a stronger path to victory being upheld. the reality is setting in. eight attended in person. justice sotomayor elected to do it from her office. a couple of the attorneys could not appear today. they had to do arguments by phone. one of them because they tested positive. so they're aware this is very real world. there's always kinds of implications for all of us in this case and beyond when it comes to however far their power reaches. >> neil: wow. wild stuff. shannon bream, i know what will be a dominant part of your show tonight. shannon bream, our chief supreme court columnist. john? >> this hearing went three hours, twice as long as it was scheduled. sounds like the osha regulation, the vaccine mandate in all workplaces, sounds like no conservative justice thought that was constitutional. the three liberal justices saying what could disagree with a great policy? the conservatives said it's up to the states, not the federal government. as you led the show off, companies themselves can impose a mandate as they choose. the other question today about whether the government can require when it spends money on healthcare at hospitals to require healthcare staff to get vaccinated, that sounds like it's on better footing. i expect the court to uphold that one. >> do they make carveouts or exceptions for let's say an international in this case health crisis? justice kagan was intimating that vaccinations were the only way to get this under control and therein lies the reason and the rationale for this push. >> a great question. you raise a good point. suppose this case came up two years ago. suppose president trump said we need to take certain emergency measures. the courts would be much more differential. look at the eviction moratorium. congress didn't give them any power to stop evictions and the court struck it dunn. will the vaccine mandate survive? probably not. it's been two years. congress could have passed allow in the last two years to require this vaccine mandate but they chose not to. they chose to let the states and companies handle it. >> martha: we'll watch it closely. john, a pleasure. john yoo, law professor at the university of california berkeley. as shannon bream reported, a decision could come within a matter of days. i want to let you know, we added 199,000 jobs to the economy. that is about half what most were looking at here. the reality is that there's 11 or 12 million jobs that still go begging. a lot of americans that turned down jobs, quit their jobs. say the hell with it. so where are the workers? >> yeah, it's a really interesting dichotomy. we saw people save a lot when they had the federal unemployment benefits. that ended in september. people had to go through their savings drastically. the normal holiday surge of employment came in less than expected. we missed numbers in november, october, december. it's more than half. where are these people going? it's like -- the only thing that i can see that changed is the federal unemployment benefits ended in september, the afp plan that biden's administration put in. it pays people for children based on how much they earn as a married couple or a single person. that is the only thing that i can think that has changed other than the mandates, other people people being afraid of the different variants to make them not go back to work. we have so many job openings. this is one of the most difficult job markets to hire in. it's impossible. >> neil: the job openings are generous jobs being offered period. top dollar, a lot of $20 or more an hour jobs. people are scoffing at it. it's prompted many businesses to throw in college credits and help with college education. a host of other benefits that are being ignored. i'm wondering if there's something more significant going on here? what do you think? >> there's this wealth effect. people say hey, i don't have to work anymore. look at my nest egg. you may have more money that you made in the stock market. but guess what? inflation will erode the amount of money that you made. i want another point here that is not economic. every study shows that people that work, neil are happier than people that don't work. families stay together longer. it's good for the families and everybody that people are working. so this idea that people can watch netflix all day and somehow that is their road to happiness, it's not. it's bad for america, bad for businesses and bad for -- we need to get the incentives aligned so that people are getting paid for working, not working. people say i'm getting all of these benefits. why should i go back to work? these are tough jobs, a lot of them. >> by the way, netflix is not the only option. they can go to fox business. but i get your point. how long do you think this lasts, rebecca? >> it will last until we get this straightened. we agree to accept that we'll have -- we're going to get to some level of normalcy. i don't know what it looks like. when we do, we have to get the job market back to normal. >> neil: it is weird. you got that right. steve, rebecca, have a great weekend. happy new year to you best. >> happy new year. >> thanks, neil. >> neil: there was another little wrinkle in this employment record that got my attention. got the market's attention. wage growth is going up at a 4% annual clip. the reason why that is significant, the federal reserve has a number in their head that is closer to never letting it get over 2%. it's been steadily well above the 2%. 4.7% is the latest. and that record in general rejiggered the whole prediction game that the federal reserve is going to go ahead and raise interest rates as soon as march and this report provided the proof. thomas honig joins us. is it your sense from this report and the wage growth of 5% year over year that that cinches it, the federal reserve will height rakes and as soon as march? >> it would add to the likely hid that they will. they should. look at the economy of 2021, the strong economy, retail sales of record. we saw credit increases are double digit. so you have this tremendous demand. on the other side, you have the supply factors that i heard you talking about that are very important. the issues with logistics, that will slowly take care of itself. you have fundamental trade issues that are putting supply constraints that raise prices. those are things that they have to worry about. finally, their own policy. they've been in a very accommodative policy for more than two years, before the pandemic. they're continuing that now. so that is going to add to that demand earnings are up 4.7%. that's significant. inflation is up 6.8%. that's 2 basis points difference and labor is losing ground. i expect you see more increases. depending on what the fed does and people become confident that inflation will come down and at this point they're not, the labor will demand and i think going to get given theed unemployment numbers -- >> neil: to your point, everything goes up, the more people get paid, the more the cost of the goods that they pay for themselves. it's a self-feeding beast. where do you see it going? the only way to address it is to raise rates. the federal reserve announced that they will slow down to stop their purchasing of mortgage securities and the rest. the rate hikes themselves seem to now have changed from being a few to more than a official and could be substantial. what are you looking at? >> yeah. think about it. you have basically inflation of 6.8%. you have interest rates near zero. a negative interest rate of nearly 6%. that suggests that you have a very large increase in rates ahead of you. so the fed's challenge is to raise the rates to slow this economy but not kill it. that is a very fine line to run. they have to raise rates. how they do it matters a great deal. not only because of scaring the markets, yes, getting people very uncertain. i'd say they will have to start sooner than later. announce their move of what they're going to do. they need to get moving. >> neil: that's what everybody is scare for but expecting. thomas hoenig from the kansas city federal reserve bank. have a wonderful new year. even with that forecast. covid is in the news again. omicron has one million cases per day. the last four days running. so it's going up and up is. covid here to stay? >> that's for the second case, this mandates vaccinations for people that work at a facility that gets medicare or medicaid funding. seems like the justices were more for holding that mandate. we're reading the tea leaves here, this is super fast-tracked. i expect a decision within days, the most a couple weeks. we're standing by. >> wow. incredible. so they have a fast timeline here. there were some thoughts originally going into this that a conservative court largely might sort of repel the notion of any forced mandates. that might not be a given though, right? >> yeah, i think that's true in both cases. the osha mandate is in more danger meaning it's more likely the justices would stay that one. the one with healthcare workers has a stronger path to victory being upheld. the reality is setting in. eight attended in person. justice sotomayor elected to do it from her office. a couple of the attorneys could not appear today. they had to do arguments by phone. one of them because they tested positive. so they're aware this is very real world. there's always kinds of implications for all of us in this case and beyond when it comes to however far their power reaches. >> neil: wow. wild stuff. shannon bream, i know what will be a dominant part of your show tonight. shannon bream, our chief supreme court columnist. john? >> this hearing went three hours, twice as long as it was scheduled. sounds like the osha regulation, the vaccine mandate in all workplaces, sounds like no conservative justice thought that was constitutional. the three liberal justices saying what could disagree with a great policy? the conservatives said it's up to the states, not the federal government. as you led the show off, companies themselves can impose a mandate as they choose. the other question today about whether the government can require when it spends money on healthcare at hospitals to require healthcare staff to get vaccinated, that sounds like it's on better footing. i expect the court to uphold that one. >> do they make carveouts or exceptions for let's say an international in this case health crisis? justice kagan was intimating that vaccinations were the only way to get this under control and therein lies the reason and the rationale for this push. >> a great question. you raise a good point. suppose this case came up two years ago. suppose president trump said we need to take certain emergency measures. the courts would be much more differential. look at the eviction moratorium. congress didn't give them any power to stop evictions and the court struck it dunn. will the vaccine mandate survive? probably not. it's been two years. congress could have passed allow in the last two years to require this vaccine mandate but they chose not to. they chose to let the states and companies handle it. >> martha: we'll watch it closely. john, a pleasure. john yoo, law professor at the university of california berkeley. as shannon bream reported, a decision could come within a matter of days. i want to let you know, we added 199,000 jobs to the economy. that is about half what most were looking at here. the reality is that there's 11 or 12 million jobs that still go begging. a lot of americans that turned down jobs, quit their jobs. say the hell with it. so where are the workers? >> yeah, it's a really interesting dichotomy. we saw people save a lot when they had the federal unemployment benefits. that ended in september. people had to go through their savings drastically. the normal holiday surge of employment came in less than expected. we missed numbers in november, october, december. it's more than half. where are these people going? it's like -- the only thing that i can see that changed is the federal unemployment benefits ended in september, the afp plan that biden's administration put in. it pays people for children based on how much they earn as a married couple or a single person. that is the only thing that i can think that has changed other than the mandates, other people people being afraid of the different variants to make them not go back to work. we have so many job openings. this is one of the most difficult job markets to hire in. it's impossible. >> neil: the job openings are generous jobs being offered period. top dollar, a lot of $20 or more an hour jobs. people are scoffing at it. it's prompted many businesses to throw in college credits and help with college education. a host of other benefits that are being ignored. i'm wondering if there's something more significant going on here? what do you think? >> there's this wealth effect. people say hey, i don't have to work anymore. look at my nest egg. you may have more money that you made in the stock market. but guess what? inflation will erode the amount of money that you made. i want another point here that is not economic. every study shows that people that work, neil are happier than people that don't work. families stay together longer. it's good for the families and everybody that people are working. so this idea that people can watch netflix all day and somehow that is their road to happiness, it's not. it's bad for america, bad for businesses and bad for -- we need to get the incentives aligned so that people are getting paid for working, not working. people say i'm getting all of these benefits. why should i go back to work? these are tough jobs, a lot of them. >> by the way, netflix is not the only option. they can go to fox business. but i get your point. how long do you think this lasts, rebecca? >> it will last until we get this straightened. we agree to accept that we'll have -- we're going to get to some level of normalcy. i don't know what it looks like. when we do, we have to get the job market back to normal. >> neil: it is weird. you got that right. steve, rebecca, have a great weekend. happy new year to you best. >> happy new year. >> thanks, neil. >> neil: there was another little wrinkle in this employment record that got my attention. got the market's attention. wage growth is going up at a 4% annual clip. the reason why that is significant, the federal reserve has a number in their head that is closer to never letting it get over 2%. it's been steadily well above the 2%.
