after testing positive. it is driving up ambulance response time and leading to longer waits in emergency rooms. the l.a. fire department has 299 of 300 employees out sick. the highest since the pandemic began. >> these are big numbers, numbers reflecting the staffing challenges that all of us face whether the private sector, public sector and across all the city departments. the response times have an impacted by lack of staff can do to covid. >> police have authorized additional overtime to meet the minimum staffing needs. the hospitals have extra challenges, mostly for the surgeon cases brought on by burned-out health care workers quitting their jobs. now, with many of those who remained getting sick, it shrunk the number of hospitals available to take new patients. currently arguments over vaccine mandates at the supreme court hours from now. let's bring in fox news medical contributor dinesh and special counsel jeremy dyson to break it down. great to have you both back. >> hey, shannon. >> thank you for having me. >> shannon: i want to talk with breaking news "the washington post" is reporting tonight. they say the white house is finalizing details for the postal service to deliver 500 million test kits to households across the country. the administration will launch a website to request the rapid test. officials aim to be shipping the kids by october. what does that mean to get a handle on things? >> absolutely, they are a central workers. i think the most vulnerable group of people as well should have priority to these test in short supply and short demand right now. if you have people on the frontline, doctors, nurses, essential workers, postal workers, food deliveries from a personnel, we need to make sure they are prioritized and those with underlying medical condition should be first in line to get a test if they have heart disease, lung disease, diabetes and obesity because they are the one most at risk of severe complications. so we need to do the best we can to accommodate until we can get the supply that we need as you know. we have been struggling the past month since omicron hit. i've never seen the changes in the amount of test available for my patients. >> shannon: i know it is difficult to track down. people are waiting hours in line but in the meantime people be waiting to see what the supreme court does jeremy with two important case is one with the workplace mandate with employees over 100 employees and the other one health care workers at any facility with medicare or medicaid funding. this is what jen psaki, white house press secretary said today about this on the cases, the need and urgencies for these policies is greater than ever and we are confident in the legal authority for both policies with these federal mandates to stand. >> well, at this point in the pandemic may pandemic of the autocrat. president biden has way overstepped the boundaries that he is limited to by the constitution. he is attempting to federalize the workplace and the economy. that just can't be done. look, this policy, this mandate is authoritarian and the commerce clause by taking away powers due to the states and takes away and assumes authority. congress has not given to it. and it also tramples the first amendment by forcing religious organizations to violate their religious mission and the latest conscious spirit separation of powers and religious liberty is so precious. if the president can pass these orders and expect them to be obeyed, the constitution really means nothing right now. i hope the supreme court understands that and reimpose is little bit of sanity and restraints this president from overstepping his balance further. >> shannon: one of the briefs before the court that they will consider says this "delaying force meant is a standard and can cost many lives per day in addition to large numbers of hospitalizations and other serious." they have the power to do this to save american lives. >> they keep running up against the pesky thing called the constitution. there is no pandemic exception to the first amendment and certainly no exclusion to the constitution itself. the president is bound by that. if the president so badly wanting to pass this mandate, take it to congress. have congress weigh in on this right now. congress has not delegated this authority to osha. the supreme court will understand that when presented tomorrow against the doj and the administration here. this is quickly becoming a pandemic -- we've seen from andrew cuomo to president biden and it needs to stop right now before more people come organizations and where religious organizations are put to the test. >> shannon: things continue to change but this virus. we learn new things everyday, no numbers, we talk about that all the time and it gives us more to work with in americans and scientists and researchers, doctors. so when talking about the mandates in november, the idea was to get the vaccine, protect the workplace, protect the spread appear a doctor, since then, we have a situation people faxed, boosted, everyone is getting covid and everyone is capable of spreading it. according to the biden administration, the cdc and other top agencies. how will that argument work? the legal part of it, but now what is the argument for saying everybody must be vaxxed and boosted when it seems like it was about stopping the spread and it's not 100% effective in doing that. >> everyone should have a choice. no one should lose their job or be fired or penalized for not being vaccinated. we need to have exemptions. we need to take natural immunity into consideration as well. the covid battleground is changing, shifting and with that the mentality and fundamental approach to managing this disease must be modified as well. i think it is a matter of time. everyone could potentially pick up this fire is, this disease. it is a matter of being in the best shape possible for to fight it off. for example, get your vaccine. we know that getting a vaccine cannot stop you from picking up covid, but it can prevent severe complications. it can prevent you from shortness of breath where you have to enter the hospital for hospitalization and iv fluids. know your risk and protect yourself. we have to have to be open minded. we have to understand the dynamics are changing. this may be, omicron may be a common cold for most people, but for some it can be serious and severe. know your risk and protect yourself. we have to move on from there. >> shannon: we are now two weeks into the nation's prolonged travel nightmare with thousands of flights canceled by the day due to widespread impact of covid related staffing shortages on top of severe weather. persisted, no doubt into the new year and in fact since christmas eve, the stats show 20,000 u.s. flights were canceled. 20,000. of course, that translates into long, long lines and passengers sleeping on floors of airports and weights. but the silver lining, things are starting to slowly unwind. for context on monday, 3,000 flights were grounded around the country and yesterday that number was around 1700 but mother nature is not letting up just yet with additional problems are expected for the next several days. additional snow and ice impacting the system expected in some places. so we cued the frustration. >> my flight was at 1:00 but it's been delayed four times. >> we were rerouted to leave at 6:00 p.m. >> i have been at the airport since 9:00 p.m. these plates were limited to. >> cities not experiencing winter weather, los angeles running into hiccups and look at the line there. that is because major staffing shortages you probably heard about. the other major factor here and the airlines, federal airport workers all experiencing the latest covid search and reports of employees calling out sick and that is stretching already tight resources even tighter. we are talking everyone from flight attendants, those taking the tickets back here and loading the bags on the ramps. the list goes on and on. it is a vicious cycle, one that is not over any time. shannon. "the bream team" to debate, richard fowler and former presidential appointee to the commission on social status, a black men and boys, jack brewer. great to have you both back. >> good to be here, shannon. >> shannon: i want to start with a buddy andy mccarthy who actually with cases, he writes "damage to the capital was minimal as opposed to the world trade center of 9/11 or oklahoma city courthouse in '95. the terrorist attacks that pales in comparison to january 6 or opposed to minneapolis kenosha, portland with anti-police riots. on the very evening of january 6, congress was able to reconvene in the seat of government. so jack, is it fair to say, listen, you can think that was a terrible day and people made awful decisions and there are crimes that needs to be prosecuted, but it does not equate to the worst day terrorism has ever seen. >> definitely but let me be straight up. if my child had broken into the capital or gone through the window, i would have smacked them in their butt. that is despicable. but to disrespect the lives lost after 9/11 and the lives lost after pearl harbor and all the men, women and family who but on a uniform and fight for the nation as a result of those horrible situations, to compare those, we all know that is political pandering and plating games. no one believes those things compare. anyone that does is playing a political game. but it is exposing what is truly important to allow these politicians that is power. that goes a little bit on both sides come i have to be honest. >> shannon: listen the wall street editorial board said that too, they called people across the political spectrum. both sides are trying to make political hay out of this. democrats led by speaker nancy pelosi to exploit that day to regain power while donald trump wing insisted it was merely a protest that got a little carried away but the bottom line american democratic institute held up under pressure, richard, they are arguing both parties are guilty of trying to make something out of this but what it showed us at the end of the day, institutions come together and survive under pressure. >> thank you for having me, shannon. a couple of things, when you look at what happen in the capital, the context of what are all of this happening in american history? you know i'm a student of history. thinking about the severe to least severe. when you think about what happened january 6th last year, the only thing that comes close to that american history based on my research could possibly be the inflation of the reach of the capital may 12th. we make that comparison because then what time we have seen people get into the capital and stop congress operating in session. and what makes it more severe, the day congress does one thing that we do every four years, which has certified the election of the american people, especially after election where people voted more than ever before. i won't compare it to a terrorist attack or invasion from a foreign country. but what i will say, this is one of the worst breaches of the u.s. capitol that we have seen in american history, period. they went definitely a dark day. it is being investigated. congresswoman liz cheney the vice chair of the select januaro this talk to bret baier earlier tonight. here is a little bit of what she had to say. >> we have to be faithful to the constitution and rule of law. if we are not faithful to those things and don't tell the truth about history, then the institutions themselves began to unravel. >> shannon: jeff, what do you make of this commission? i want to be transparent for the american people so they know what led up to that day. she has plenty of criticism from president trump. she feels he is responsible for what happened. what do you think of the committee? >> i think it is ridiculous to point out one person in particular when you can go back and listen to the tape of president trump's demands saying clearly to go there peacefully. so that, in my opinion, is another political pandering to fighting for power. at the end of the day, we need a commission for that and we need a commission for everything else going on in the nation appear this past weekend you have hundreds of people shot in the communities. there was no commission to stop the warfare in the streets. we have all these other issues going on in the school system, the breakdown of the family. we have all of these issues, crisis going on right now in america. we want to fixate on this thing to divide the nation, things people can use for political power and political gain. they don't really care about the goodwill of the people. if they did, they would treat every situation the same and bring some fairness to stop coming through the biocides. there is too much bias going on in washington, d.c. american people are better than that. we need to get representation for folks who do care about what is good and pure about the people they are serving. it is getting ridiculous. >> shannon: over to you, richard, final word. >> a couple of points that i do agree we have a lot of bias in our system but where i do disagree and agree with liz cheney, is this. the reason so violent, we have to figure out how this was breached and so it never happens again. based on the interview and testimony that we heard today in the past couple of days, we know that the president steps away from the briefing room had an opportunity to go to the briefing room and say "you guys need to stop this." he waited almost 90 minutes to a couple hours later to come out and say this is the video telling my supporters to stop here they were using the american flag as a battleground to break windows in the united states capital. >> shannon: well, they are still many, many unanswered questions i have many americans do as well. it will be great to get to the bottom of the issues. richard and jack, thank you for coming back. good to see you. >> god bless you, shannon, take care. >> shannon: two days into office and prime source, the district attorney's doubling down on his controversial initiative to start seeking prison sentences for a slew of crimes. laura ingle, good evening. >> shannon, outreach is growing as manhattan's new d.a. is waiting through tough criticism about proposed policy to not seek prosecution for a list of criminal offenses. >> nobody has a monopoly on good ideas, but god almighty this is a bad one. speak with her day in office eltham bragg sent a memo stressing diversion and alternatives for incarceration such as crisis intervention program instead of sending some criminals to jail. no jail time exceptions or murder or crimes with deaths or a felony. nick who is a partner with starbright floral design in new york city says he thinks his plan to reduce crime in the city by letting some criminal behavior slight is straight up a bad idea. >> i have never seen one policy that anybody can come up with which at the same time can demoralize one faction, the police departments and on the other hand, give criminals a checklist of things that they can do that can no longer be considered crimes. >> shannon: bradley is open to dialogue but not backing down following criticism of the plan to stop seeking prison sentences like marijuana misdemeanors, ing with arrest,, and trespassing. in interview with eric shawn, the current system is not working in his new policies will create a pathway to safety and justice. justice. speak with these policies give criminals a green light? >> i don't have a developed position on the poster per se, but i think it is good at my university, princeton university we have robust and flexible system for religious and other relative exemptions. i think what universities need to take into consideration, to get out of the pandemic and population nearly 100% vaccinated, covert is not going anywhere and the university has to get zero risk of obsessive covid regime out of mine in order to get back to normalcy. >> shannon: and i know you worried that a lot of the policies on the campuses are very isolating. you can't leave your dorm room. you can't go out to eat. based on where you are going to school and what the rules are, what is after a couple of years of this, the impact on students like you? >> well my thank god i don't go to yale where students cannot eat outdoors in new haven until they are vaccinated. at princeton, we have nonsensical restriction, for example we are not allowed to gather groups of 20 and have to wear a mask but university put together masks and dining halls. this is reminiscent where we were last spring. with less springs recognition a record number of mental health hospitalizations. so with this new restrictive regime, students are worried that is where we are headed again. we are concerned we will never get back to normalcy despite super high vaccination rate and now mandated booster. >> shannon: so, princeton is trying to keep you safe. what is your message to the administration?
