thanks to brand-new photos from the daily mail, it appears ray epps has been relaxing on his ranch just outside of felix arizona. the daily mail asked epps whether he had any involvement with the fbi and he answered by yelling at reporters to get off of his property. fascinating story. we will be watching. the department of justice's case against five men accused of plotting to kidnap michigan governor gretchen whitmer is falling apart. the fbi's first arrested these men late last year, and instanty received endless praise from the media. >> militia men who were so angry about whitmer's covid restrictions in michigan that they were plotting to kidnap and possibly kill her over it. those men were ultimately arrested by the fbi. >> just hours at after the fbi expose a dangerous terrorist plot to kidnap her. 13 men were arrested in and alleged domestic terrorism plot to kidnap and execute governor whitmer for treason in an attempt to spark a second civil war. >> will: whitmer also thank the fbi from saving her from these men she says were trying to kill her. >> earlier today, attorney general dana national was joined by officials from the department of justice and the fbi to announce state and federal charges against 13 members of two militia groups who were preparing to kidnap an. if you break the law or conspire to commit heinous acts of violence against anyone, we will find you, we will hold you accountable, and we will bring you toin justice. >> will: but here's an update. in a court filing this week, the accused demanded the charges be dropped. the attorneys claim federal informants funded and encouraged theed plot, so it is looking moe likely this conspiracy never would have been materialized without the fbi's involvement. that is the allegation. julie kelly is in a writer for american greatness and has been covering this case from the very beginning, well plugged in, and she joins us now. julie, what and how would we characterize the fbi's involvement? what are the defendants saying the fbi did? >> well, the defense attorneys have been building over the past few months a very convincing and detailed example of fbi entrapment. now it is important to note that whenn gretchen whitmer gave that overwrought press conference, that was october 8th or 9th of 2020. early voting was already underway in the pivotal state of michigan. this case brought all kinds of national headlines. joe biden gave a statement, accused donald trump of inciting an act of domestic terrorism. i don't know if that sounds familiar. but what is happening is this case is falling apart. we find out there are at least a dozen fbi informants involved in this case that had fbi agent richard trask, who started the s arrested for assaulting his wife in a drunken rage after a swingers party, he action had been fired by the fbi. and almost impossible feat. the other fbi agents handling the 12 or 13 informants that were involved in this plot, they also have been removed from the case. justice department just informed the court that they will not be testifying. so this case is falling apart, at the same time it is exposing a really egregious example of fbi entrapment of innocent men to concoct this plot, make really negative headlines for donald trump, and voting was underway in the 2020 election, and now the trial is scheduled for march but the government's case is in a lot of trouble. >> will: quickly, julie, so mane alleges entrapment, where these agents where these informants, where the instigators, where the enablers, here is the question i think the court has two decided i want to ask you: would this plot have happened, would it have occurred without the fbi's involvement? >> yeah, you know, will, i have been beating this drum beat since last april when i first started talking to tucker. the issue here is immunity. and really, there is no way around it. what we need to be able to determine is whether or not every day americans are immune or not. it's not so much to vaccine everybody indiscriminately with 3-5 boosters. it's whether people have a high level of antibodies. this is the most strategic blunder the biden administration and dr. fauci are making. they are actually blocking americans and not encouraging americans to check their status of covid immunity. we were to determine the status every day americans immunity, a couple of categories of people become clear. i can tell you in my own practice i've been able to convince people who are not immune to get the vaccine, and they have gotten it. people are optimally immune and have had antibody levels -- frankly, i'll tell you, this is problem only, and i will repeat this, probably a scientific intelligence failure on the scale of pearl harbor because the cost can be measured in lives. >> will: yeah, i think failure at a minimum, why we have shown so little interest in figuring out natural immunity, that we have antibodies, do we need a vaccine? why has it been discouraged? i do want to follow-up this question i ask you, there are increasing reports out there, studies suggest there is such a thing as a vaccine dependency. if we keep getting these boosters, do we ever build up the ability of our immune system to fight covid? what do you make of these reports? >> look, there is a very basic phenomenon in immunology, called immunological exhaustion. the idea is toto continuously stimulate in a short span of time the immune system to hyperactivity, the clones of b and t cells that normally respond will become unresponsive and actually become tolerant to the virus, so that means a lack of immunity. i think it is a bad idea to be hyper immunizing people. i was a deviation from the science of i'm immunology dr. fauci and biden administration is really a seris national security threat, and that is because instead of focusing on the science of immunology and making sure every day americans are fully immune, what we're doing is is forcing vaccination on people, many of whom do not need it. for example, kids getting booster mandates and colleges, some of these kids have had covid and have had two mandated shots already in the span of a year. my own kid goes to boston college and boston college has actually mandated this. again, i would state is completely irrational. what we should be doing is working on antibodies and looking at antibody levels as many immunologists have been saying from the beginning. >> will: i think the number is easily 3,000 or more colleges are now mandating a third booster shot, and as our pointing out, there is potential for real hard with those booste. shots, and i just want to say this again, these people are not incompetent. failure is a kind explanation for what has gone on with theat absolute dis- interest in natural immunity. dr. hooman noorchashm. >> the problem is -- >> will: thank you -- >> the problem is administrators are making medical decisions they are not qualified to make and this is a federal failure on the part of the bite administration dr. fauci. i hope they're listening and change as quickly. >> will: because they are driving out a medical solution but a political solution. i appreciate having you on tonight. i would like to chat to you in more detail. this is not insignificant. or producers unfortunately just had to watcht. upsetting footage of antagonizing procedures on puppies. it is all connected to a federal investigation into a company called in vigo. in just one example of abuse, investigator alleges in vigo workers injected euthanasia drugs into puppies without sedation which caused the dogs immense pain. since september of last year, the national institutes of health spent over $1.2 million in taxpayer money buying beagles from this facility for experiments. this should not be happening anywhere, much less in the united states of america, and the head of the nih dr. anthony fauci has some explain them to do. daphne is a senior vice president at peta and she joins us now. daphne, great to speak with you. this morning, what do we know about these experiments and the nih's involvement? >> well, what we know is the nih spends about $19.6 billion a year on animal experiments, and as you mentioned, they have contracts worth more than $1.2 billion -- million dollars, i'm sorry come over the last ten years or so buying beagles from this facility located in central virginia, where how they buy puppies in hideous conditions, they have been cited by the u.s. department of agriculture for direct and critical violation for failure to provide basicic necessities of life to these nursing mother dogs and their puppies, keeping animals in temperatures as high as 92 degrees without airir conditioning, plunging needles into the heads of puppies to drain hematomas. depriving nursing mother dogs who are famished of food for up to two days, and so much more, and the federal investigation is ongoing, and i should mention that these dogs are being raised for cruel experiments that are useless, and it is not just our federal government and our tax dollars, but contract laboratories and universities f that are fueling this industry, torturing these animals with a variety of cruel experiments. >> will: daphna, i think it is important that we speak to people that we do not always aligned with ideologically in every issue and i think we might as well point out the obvious. many of our viewers watch her ip our probably skeptic of peta based on pitas positions on other issues, but this is not simply a peta issue, this is an investigation by the usda and a serious issue that spans government bureaucracy and it is a grotesque come as you point out. we cannot show some of the footage, just for viewers to no, we cannot footage on screen because it is so ugly and over-the-top. i want to ask you this one question and i assume you know the answer to this, why beagles? >> it is not racist but they sae apparently it has been used to go after drive-by shooters as it was intended and they just happened to be black. that is the argument that they are trying to make.pe that is the only argument that they could try to make, but obviously if someone is white and is committing a drive-by shooting, they too would be subject to the exact same law, so as it stands, this bill basically says it can no longer be considered an aggravating issue concerning first-degree murder charge. the aggravating factor makes it a mandatory life sentence without parole, so instead, you would be hit with a murder one charge, and that generally is 20-30 years punishment, it could be life in prison but that generally doesn't happen. the funny thing about this is this particular aggravating murder charge isn't used very often. in fact, one of the lawmakers behind this, tara simmons, herself by the way a convicted felon who madeke it into the ste legislature, she says it has only been used once. i don't necessarily think that is the case, this is not something very easily trackable, but let's say it was in fact usn just once, that literally means it is not racist, it is not being t used to target black peoplepe and this would have zeo impact whatsoever on racial equity in the criminal justice system. one time does not mean it is a problem. in fact, the argument should be we are not using it enough. >> will: so with the rationale, jason, that lawmakers and californians have used it to go about leaving shoplifting can for example, and small theft unpunished because they cite disparate impact on african-americans punished under those laws, so their solution was don't punish those laws, it is the same rationale with drive-by shootings. the vast majority of drive-by shooters are black therefore enforcing the law would be racist. here's my question to you, jason:l what is the racial makep of the victims of drive-by shootings?
