crime crisis? fox news asking yet again. you are not going to like the answer we got. carley: andrew cuomo lashing out after he was asked to hand over the millions he made off of his pandemic leadership book but the story of the disgraced ex-governor does not end there. neil: soccer on the twitter verse. carley: even democrats are fed up with surging brazen crime in the state the one progressive mayor saying rampant crime is destroying the city. todd: they take bold action to protect their cities. >> reporter: liberal leaders in the golden state had enough of crime in their cities. san francisco's mayor ready to crack down on retail theft running rampant, not mincing words as she announced a series of changes to combat the problem. >> it is time that the rain of criminals who are destroying the city to come to a end. and it comes to a end when we take the steps to be more aggressive with law enforcement, more aggressive with changes in our policies and less tolerant of all the [bleep] that has destroyed our city. >> reporter: some of the proposed changes she's talking about our increasing funding for police resources, amending a surveillance ordinance to make it easier for law enforcement to access cameras to fight crime in real time, disrupting illegal street sales of stolen goods and in los angeles the california retailers association said smash and grab crimes are out of control. >> i got another email three smash and grabs in la. i see it constantly. sounding the alarm for years before this saying this is a growing problem. >> reporter: widespread crime promptings in california lawmakers to use office funds from their district rest of the patrols as the white house continues to deflect blame for spiraling crime. >> would you consider one of the reasons prosecutors were cutting people accused of many criminal defenses leave too quickly? >> what you see in data is an increasing crime since the start of the pandemic. i will let police try to determine a possible motive for the attack. as crime surges in the city chicago's affluent bucktown neighborhood hiring private security to patrol is community for 8 to 10 hours a day. the city on track to surpass 800 homicides this year alone with 767 reported so far. disgraced ex-governor in new york state andrew cuomo lashing out as he is ordered to return $5 million in profits from his book on pandemic leadership. carley: brooke is here this morning, good morning. >> reporter: the new york state ethics panel says andrew cuomo must return $5.1 million he earned from his book. american crisis, leadership lessons from the covid 19 pandemic. cuomo's spokesperson saying the move is political hypocrisy and duplicity at its worst but in a 12-1-vote the state ethics panel rules cuomo, quote, lacked the legal authority to engage in outside activity and received compensation in regard to the book. the panel saying cuomo violated a pledge that he would write the book on his own time without using any state resources or government staff. cuomo was ordered to return those profits all within the next 30 days to attorney general latisse a james who will decide how to distribute it. ron kim applauded the news yesterday saying as he chased on publishers he was suppressing life-and-death information from lawmakers especially about how the pandemic was impacting nursing homes. listen to this. >> thousands of unnecessary deaths. took away the belly to legislate and took away family's ability to make decisions for themselves, take their loved ones out of nursing homes. he will be held accountable. >> reporter: it is not over yet. cuomo's attorney vowing to go to court over the money calling the order unconstitutional and driven by political interests rather than facts. carley: thank you. the new york state joint commission on public ethics voted 12-1 to force governor cuomo to give the money back. a big chunk of change, $5.1 million because they say he used resources to write the book meaning his employees were helping him write it and he is saying they were volunteers and other people do it too. sound like that is the rebuttal. todd: there are two parts of this was the fact that he did in all likelihood use state resources is one but the second part coming in order to sell the book and sell himself as this great governor who did great things there was the need to suppress the bad news coming out of the nursing homes because otherwise you don't have a book to promote, you don't have a book to sell. as result when you combine those things you get the ethics side but also the government responsibility side of it. when these things go together you have a lawyer for cuomo defending himself, defending his client but in the end he has to pay that. carley: think back to where we were a year and a half ago when national news coverage of every press conference he gave he was considered the love go, the emmy, $5.1 million book deal despite the pandemic hadn't ended and now look where he is today. a lot has changed and people fighting against him because of the nursing home scandal i waking up happy this morning. todd: we will on the economy more than half are not happy. congress avoided a us default over raising the debt limit by $2.5 trillion, could be the last thing democrats agree on before the end of the year, the in hours president biden tour kentucky after the most of us aiding tornadoes kill 74 people including 12 children. carley: eight deaths confirmed that the collapsed candle factory is staff claim they were threatened with being fired if they fled. todd: caroline shively has details. >> reporter: when president biden tours the streets of mayfield he will see scenes like this. this is the nursing home friday night, 74 residents were inside when the storm hit. amazingly no one was killed. only a few were injured. two with minor injuries happened here. it could have been worse. one of the wings on this structure completely collapsed. residents and some just days before but they were removed because of construction that was happening. they had a tornado drill day the tornado hit. many in kentucky of the 74 people who were killed were not so lucky, the death toll acrostic state stand at 88, eight of those deaths were at a nearby candle factory, eight workers missing. the company denies it but some workers said they were told they would be fired if they left before the tornado hit. a forklift operator rescued after a concrete slab fell on him at the factory spoke to "fox and friends" last hour. he told us nobody prevented him from leaving because his supervisor was out for the whole week. he says production is a priority and getting the product out is a priority so sometimes the product comes before emergencies. >> when i was looking outside i saw the ice cream cone and started backing up. as the thunder hit i started running back and people started running towards me. >> reporter: house after house we toured have been condemned, they can't be salvaged and will have to be torn down. thousand by living in shelters. >> you walk outside your town doesn't look like a town anymore. it is nothing but trouble. everything you love and all the memories you have, it is heartbreaking to see that. >> reporter: the cleanup here will literally take years according to the kentucky governor. todd: the images do not get easier to look at. carley: first responders and relief organizations like the red cross are working around the clock and states hit hard by this tornado. todd: joining us live from missouri, what is the next step in your efforts? >> reporter: as you know, we have had tragic deaths here, many people lose their home but we have been very fortunate compared to people in kentucky and our hearts go out to them. it is interesting the areas that was affected in st. charles county has a historical connection to kentucky. it was settled by people from kentucky including daniel boone and his family. our tornado here touched down about two miles from nathan boone's home where daniel spent his last years, 2000 yards from his grandson's home. neither one is affected but we did have some terrible devastation and some people without their homes and i am very proud of the first responders that were there very quickly. the pioneer spirit was still out there and one of our biggest problems at first was people wanted to get out, they didn't want to wait for government to clean up. they wanted to get out on the roads and start cleaning up immediately and we had a lot of power lines that were down and we had to tell those people hold on, we need to wait for the electric company to get here to give us the go-ahead and once they did that, the ambulance people were there, the fire people were there, we got the injured to the hospital. probably this was out further in the county, took me an hour or so to get there but by the time i got there the red cross was already there and they were talking to the people who had lost their homes. they were providing shelter for them. they were assisting the first responders and we need to thank the red cross for the effort they made. carley: where your county is, 3 and a half hours northwest of mayfield, kentucky, hardest hit area, how massive this weather event was. going through a tornado is a terrifying thing. you talked about the pioneer spirit but i'm sure there are people that were really scared. when you talk to people in your community how are they doing? >> they are tough people and they are hanging in and already like i said working hard to help each other and government is doing everything it can to help them. the governor was here sunday. we were putting together pick ups for debris and organizing efforts to help people rebuild but it was interesting. i was out there saturday and we saw a house and the only thing left was the basement. at that point i told the journalist who were there, show this picture to people and hopefully they will understand why they are told when the sirens go off to get in the basement. the basement was the only thing left. todd: appreciate from the book and it looks like he has to give it back. >> he may have to get a loan from his brother by the time chris cuomo gets $18 million out of cnn. when people ask why the governor and his top aides cover up the nursing home deaths the way they did? now we know, to secure a $5 million book deal. when cuomo was negotiating this book deal in the middle of the pandemic he had approval ratings around 70%, usually the highest of his career so it was the right time to write a book and the wrong time to have bad news about the nursing home scandal come out because obviously leverage is gone as far as getting the book deal and the love governor needs to hand back that money. this is a guy who thought it was a great idea support covid positive patients back in nursing homes and covered it up, was awarded amy for doing the worst job of any country on covid. now he is out of his job as his pr chief in the form his brother, and chris, how the not so mighty have fallen. todd: it is not just the accusations of having your staff write the book which is enough to force you to pay back the money but the fact that he needed the positive public in order to promote and sell the book. a key point you make. the cuomo spokesperson who is not his brother responding, quote, this is political hypocrisy and duplicity at its worst, government resources cannot be used in the words and any staffer who assisted in this project did so on their own time. isn't that patently false? >> when i'm not working for a governor, or working for the hill or fox news in my own time i hope people write books for free. that is what you do in your off time in new york when you have other things to do, so ridiculous. how do you take anything he says seriously or take credibility in any way, shape or form. carley: a piece that is getting some attention, kamala harris has redecorated the vp's office. is the meaning behind her choices and the twitter account hitting back saying crazy how she doesn't have time to visit the border, she's going to get all that but what do you think of her getting this string of positive coverage from news outlets. what do you make of the timing of that? >> last week ten days ago, we heard reports that the biden administration having secret meetings with top news organizations and you've got to sell bills back better, infrastructure, give us better pressure, hitting is too hard and magically they are getting a lot of these, 43% approval is one of the best polls miss harris has received and sometimes was not sure what they approve of, you mentioned the border and her performance there is a catastrophe. it is not her work ethic. she's as visible as in snowden, her habit is have her as scripted as any politician we've ever seen, she might as well be the lead singer of read of the meat conglomerates. that is a better fit. todd: we saw chuck todd over the weekend make excuses for president biden, now coming to the office of kamala harris, a great
