high, this level of dysfunction must be swiftly put to rest. other white house officials continue to defend the vp and began doing so months ago when the story began bubbling up locally and now it's become more national, including chief of staff ron klain and advisor cedric richmond all coming to vice president harriss' aid. carley: it was bubbling up. now it's a full boil. thank you for joining us. it started off with bad poll numbers for the vice president and there was a cnn article claiming there was a riff between the vice president and the president, then staffers started to leave, some high profile ones like symone sanders and now there's a washington post article claiming what that she is a bully. i think you're allowed to be a tough boss but you also have to be a effective and so far she has proven not to be effective on that front. benjamin: one of the criticisms has been she is always under-prepared. a number of staffers said she doesn't read briefings and gets upset and angry at staffers when she is a accused of not being prepared as if it's their fault. we're learning more about how she operates and her office operates. some of her staffers in california, they only stayed for five months. they're talking out as well. i wonder if we might hear more damning sort of news coming out about how she operates and look at the elephant in the room, what happens in 2024. people are talking about her as a future president just a few months ago and that seems further away than ever. i think back to in the last few weeks how people are talking about a possible harris/buttigieg ticket which, again, right now seems bizarre and i think it would be a gift to the republicans if that was you true. this is not the sort of news the white house wants to see coming out about their vice president right now. carley: i guess the only problem for democrats, if it's not harris, buttigieg, and this is all speculation because the presidential election is so far away, then who will it be? they don't have a deep bench when it comes to possible presidential candidates. benjamin: that's right. it all depends on whether the be president himself decides to run again. carley: exactly. benjamin: let's turn to this now. former cnn anchor chris cuomo denying new accusations of sexual misconduct against him. cnn firing its star anchor after the network discovered he advised his brother through his own sexual misconduct scandal. carley: ashley strohmier is here with more on the reaction to the new accusations. good morning. >> reporter: the accuser felt she had to speak out to protect other women. she offered to provide evidence of her allegations. her attorney said chris cuomo looked into the director and a told viewers i have always cared deeply about these issues and profoundly so. i just wanted to tell you that. hearing the hypocrisy of chris cuomo's on air words and disgusted by his efforts to try to discredit these women my client retained counsel to report the serious sexual misconduct against her to cnn. steven goldberg, a spokesperson for chris cuomo issued a statement denying the claims, saying to the extent they were sent to cnn to he negate what chris cuomo told his audience, he fully stands by his on air statements about his connections to these issues, professionally and a in a profoundly personal way. if the goal in making these false and unvetted accusations was to see mr. cuomo punished by cnn, that may explain his unwarranted termination. cuomo previously going on air to deny claims of advising his brother in the aftermath of hour for more reaction. carley, ben, back to you. carley: thank you so much for that. and starting today, all international air travelers entering the u.s. must provide a negative covid test taken within one day of boarding flights, regardless of vaccine status. up until now, fliers were required to show tests within three days of flying. according to the cdc, the shortened testing window aims to, quote, provide less opportunity to develop infection with the omicron variant prior to arrival in the united states. benjamin: also starting today, the biden administration will reinstate the trump era remain in mexico policy. migrants will be sent back to mexico to wait while their asylum claims are considered. the biden administration abolished the program in june but missouri and texas argued the policy was ended unlawfully. the supreme court upheld the state's argument. former president trump introduced the policy in 2017. that -- a 2019. that resulted in 100,000 fewer border apprehensions in may of that year. well, texas attorney general ken paxton says he doesn't anticipate the biden administration will change their stance on immigration and he is bashing the double standard between illegal immigrants and a american citizens. >> we have a situation where the federal government, the biden administration is encouraging people to cross the border, knowing full well that they have covid, not vaccinating them and not testing them and i believe on purpose. they don't want to know they have covid, then they can transport them secretly all over the country. i don't know how you explain that other than say they really don't care about covid and they certainly want as many people crossing the border as possible, even if they have covid. benjamin: the latest border figures from october show migrant encounters are up nearly 130% compared to last year. ♪ carley: president biden ordering all u.s. flags to fly at half staff following the death of long-time senator and former republican presidential candidate, bob dole. dole was a world war ii hero and beloved lawmaker, serving our country for nearly 80 years. he represented kansas in the senate for almost three decades before running at the top of the republican ticket in 1996. in february, dole announced he was diagnosed with stage four lung cancer and was receiving treatment. he is survived by his wife, as a surge of brazen smash and grab robberies take hold in major cities. carley: brooke sigman as residents and city officials blame soft on crime policies for the spike in crime. >> reporter: the crime crisis is alarming residents and retailer as bands of smash and grab thieves descend on the cities. some point to bad policy as many say the spike in crime appears to be organized. >> bad law and bad policy is driving the most recent spike in crime we're seeing in los angeles. >> reporter: a former convict said he felt safer during his life of crime after his oakland cannabis dispensary progressive congresswoman alexandria ocasio-cortez is taking heat for dismissing evidence what that crimes are organized. she said a lot of these allegations of organized retail theft are not actually panning out. but retail leaders say ocasio-cortez is ignoring blatant facts with one group saying the congresswoman has no idea what she is talking about and if she's not concerned with organized theft an increasingly violent attacks on retail employees she should just say that and gop lawmakers agree her remarks are disrespectful of crime victims including a security officer who was killed by armed robbers in oakland last month. congressman jim banks calling ocasio-cortez's comments tone deaf and offensive. the white house says the justice department and fbi are stepping in to assist the embattled cities but retailers remain on high alert. benjamin: brooke, thank you very much. and joining us now to continue this is doug hikeen, former new york stay assemblyman, founder of americans against anti-a anti-semitism. you heard what aoc said and you heard the response from walgreens who said she doesn't know what she's talking about. we've seen the stats. we've spoken to people in law enforcement and district attorneys. is she just not aware of what's going on or does she not consider these crimes seem to be a -- either seem to be a mistake. >> aoc is out of control. i don't think she's living on this planet. facts don't matter. she doesn't want to be confused with facts. all she's interested in is defund the police, close the prisons down, defund the prisons. i think it's time to defund aoc. she's a danger. i really think she's a danger. these crimes that are being committed, there are real victims out there. the bail reform that she supports where criminals walk out before the police officer finishes the paperwork. it's ridiculous. causing new victims out there. it is really out of control and i think aoc, you know, republicans are speaking out on this. where are people from my democratic party, are they blind? maybe aoc is blind. clearly, she doesn't see it. where are the others in the democratic party to stand up and defend the innocent people of this country who are being victimized by criminals? benjamin: it's not just the smash and grabs she's denying. you said in the past she never raises her voice about the rising number of anti-semetic crimes either. >> absolutely. missing in action. she chooses what she's going to speak out about and it is a really sad commentary on aoc. you know, she's a big heroine to a lot of people. she is a disaster to the average american. her policies and the things she advocates and the fact that so many democrats are fearful of her and the radical left of the democratic party, when good people are silent, democrats i'm talking about, then we are in real trouble and that is exactly what's going on. why is it only republicans? where are the democrats? where are the moderate democrats who watch on television what's going on in this country, crime out of control in new york, in los angeles, other cities all over america. victims all over america. aoc doesn't care about victims. she cares about the criminals. benjamin: i want to get your views on another topic, related to this. this is jen psaki, blaming the spike in crime on covid. take a listen. >> so when a huge group of criminals organizes themselves and they want to go loot a store, a cvs, nordstrom, home depot, until the shelves are clean, you think that's because of the pandemic? >> i think a root cause in a lot of communities is the pandemic, yes. benjamin: it's strange because i don't think we've seen the similar spike in states like florida or texas that don't have democratic-led governors. what do you say? >> this administration is out of control. this administration, you know, you've got to blame, you blame trump, you blame the pandemic. why don't they look in the freaking mirror? they are responsible. benjamin: what needs to change? what needs to change? >> what needs to change is the republicans getting elected in 2022, taking over the house, taking over the senate. i mean, that's the sad reality. there's nothing -- look, president biden is literally asleep, whether he's sleeping or not, he's asleep. when i watch him, i'm depressed. i'm sad to watch the weakness of our president. nobody takes him seriously except for die hard democrats. it is a sad reality that we are living in that the reality of what's going on out there, the biden administration is missing in action, plain and simple. benjamin: thanks very dean, fox news senior meteorologist and very good friend. janice, good morning. you have an op-ed out at foxnews.com where you talk about it. i want to read a little bit of what you say. you say had they both done the job they were hired to do, this day where they are now both out of work would never have come. strong words that i think many people would agree with. >> right. he's supposed to be a journalist or a reporter and he lied to his audience and lied to us. you know, beginning with the fact that he defended his brother very early on. i mean, the reason why i -- i was going to remain quiet about my husband's situation where we lost both of his parents. it was very personal, deeply personal. my husband is not a person that likes to broadcast his personal issues. but seeing his brother and chris cuomo on several nights during this pandemic when people are dying, literally bodies are piling up outside of nursing homes, joking around who is their mom's favorite son, the love gov, that's coming back to bite him a little bit and then not talking about the issues that we wanted to know about, the thousands of deaths, the nursing homes. i remember seeing both of them with a giant q-tip and that's when my grief turned to rage and i thought these guys can't get away with this any longer. i have a story to tell and i'm going to do it because thousands don't have a voice. carley: i think you make such a great point there. the fact that the sexual harassment scandal, that's the thing that led to both of their terminations. but the nursing home scandal is even worse and in november the new york state assembly, many of whom were protecting governor cuomo up until the bitter end, they completed their investigation and they found that, and i quote, that he was not fully transparent regarding the number of nursing home residents who died as a result of covid-19. you and i and everybody else could have said that. they only revealed that after they had nothing to lose. does that bother you? >> of course it does. there's other investigations that i think will prevail in the next few weeks and i thank attorney general latisha james for releasing that information in january. because i was ready to give up the fight. i remember this time last year i thought to myself their voices are louder than mine, i don't know if i can do it anymore. then she dropped the ag report that said he was covering up the numbers. why was he doing that? well, we know, he was trying to sell $5.2 million book. carley: chris cuomo, there is a new allegation of sexual misconduct against him. we don't know who the accuser is. her laurie leased a statement saying the reason she came forward is hearing the hypocrisy of chris cuomo's on air words, my client retained counsel to report his serious sexual misconduct allegation against her. he is denying this allegation but it sounds like there could be some sort of possible legal fight on this front. what's your reaction to all of this? >> listen, for years we heard about chris cuomo, his bullying behavior, just like his brother and some of the sexual allegations against him, when he was working for abc. carley: there was an abc executive that came out that said that chris cuomo touched her inappropriately and he apologized for it. >> when you hear stories about someone coming up and grabbing someone's behind, what kind of individual does a that had? it's someone that has gotten away with it for several years, i think. carley: do you think cnn acted appropriately how they handled this. he ultimately got fired. what's your reaction to how it played out. >> it should have happened sooner but i think this one was the final nail in the coffin. i don't think we're done with it yet. i think there will be more stories coming out about chris cuomo. the brothers have gotten away with this kind of behavior for too long. carley: if you think about it, over the past year, last year it was still governor cuomo and he had the -- >> still revered. carley: $5.2 million book deal and emmy, chris cuomo was the number one cnn anchor and now they're both out of a job. that must be a whirl wind experience for you. what sort of lessons have you learned throughout the whole process. >> sometimes you have to speak up, even though maybe the rest of the world is against you, the media didn't cover this story. we did, fox news, thank goodness, had they gave me a platform to talk about this. they put their trust in me. when the truth is on your side and when you stand up for something good, eventually other people will stand up with you. carley: i think that's called speaking truth to power and something you certainly do on a day-to-day basis. janice, thank you so much. >> love you. carley: love you too. them with a new tax. the tax will be suspended until at least the end of next year. wow. benjamin: and the owners of a san francisco restaurant now apologizing for denying service to several on duty police officers. in a statement posted on instagram, the owners of the restaurant writing, quote, we hope this will be a teachable moment for us as we repair and continue to build bridges with the sfpd. these are stressful times and we handled this badly. the owners previously say staff was, quote, uncomfortable with the officers being armed in the restaurant but they added they will continue to deny service to any armed customer no matter what their job is. carley: we handled it badly but we're still not going to let you in. the fda is in the early stages of potentially use rioting a omicron -- authorizing an omicron specific vaccine. benjamin: all traveler must provide a negative covid test within one day of flying. cheryl casone has all the latest. >> cdc director says the fda is looking to fast track an omicron specific vaccine as the variant has already been reported in at least 15 states, if not more at this point. this morning, possibly 17. it's unclear if current vaccines are going to be effective against the variant. she says the best weapon is for americans to get vaccinated to stop the spread. today, as you mentioned, new international travel restrictions are going to go into effect. all passengers have to take a covid test within one day of their departure to the u.s. regardless of vaccination status. up to this point it was three days. they're shortening the window. carley: good news for america coming out of texas. cheryl: amid the global chip shortage which affected particularly the automakers, texas' governor said the lone star state will be the home of semiconductor manufacturing. >> those semiconductors will help in the supply chain process but the state of texas economy is growing and thriving and businesses are moving here that are growing here because texas in the land of economic opportunity and innovation. we've been open 100%. there are no vaccine mandates or mask mandates and so it shows that we can remain open and help livelihoods. cheryl: south korea's samsung electronics last month announce plans to build a $17 billion semiconductor factory in taylor, texas. benjamin: i think there's one other story on a similar topic, an important one which we should be paying attention to, if we want to save christmas. what is it. cheryl: get those gifts in time. that's the question mark. so as many americans are >> shame on them. you know, all the gold medals in the world that you can win is not more important than your values and principles. carley: abby, you have people like congressman mike waltz, he said that it's something like there being a concentration camp of uyghur muslims in the united states, do you think people would come here to have the olympics. it would never happen on u.s. soil. that's exactly what's happening in china. you have to wonder if athletes will compete in the olympics. >> and you hear enes kanter freedom now. carley: love the name change. >> you hear him speak out but you see him put actions behind his words. and look, the idea of a full boycott is nothing new. we saw it in 1980 after the u.s. refused to compete in the summer olympics in moscow because of the late 1979 soviet union invasion of afghanistan. so if we see something like that in other countries start to pull out of the beijing olympics, i think that that might send a stronger message. i mean, this is still a message to be sent but maybe we need to take stronger action. carley: you have to wonder about ratings, olympic ratings were down for the last olympics and if it's in china i would imagine there would be a lot of americans who just won't watch because of the location and good for them for not. it's unfortunate for the athletes because they work so hard. >> that by the way is part of what makes this country the greatest in the world is because our freedom of speech and the way americans rally behind other's freedom of speech. carley: well said. last night you hosted the all american christmas tree lighting. for those who missed it. it was so beautiful. take a look at this. >> right there, you're with lawrence jones, in front of the big tree. and it is now on fox nation, right?
