a few hours from now arguments with mississippi 15 week abortion ban kick off at the u.s. supreme court. the final decision overturned roe v. wade and we will tell you exactly who you should keep your eyes and ears on and they pick up the case wednesday morning. plus americans most frustrated tonight with lingering inflation and the negative impact and president biden expected to address the key administrations wednesday after monday, the latest developments on that tonight. and that is where we check in with kevin corke because we have new warnings from the federal reserve tonight. the factors pushing upwards to linger 2022 and also, kevin, the variance with a large threat to our economic recovery. what do you have for us, kevin? cool moe replied, "on it." and then later wrote, "no one has heard that yet." ari fleischer said see and it failed to pursue the case. >> but the thing is he obviously crossed the line and he did it months ago and went cnn in a statement today said there was more to the store that they learned today from the ag's emails, cnn did not go looking for the full story when this originally broke. >> shelley the tv producer who had a crew though mike accused chris, you need to publicly acknowledge wrongdoing to women to victims of sexual harassment, assault and gender bias. to his colleagues, to the other colleagues e tried to compromise into the viewers he misled. and others are reporting that the suspension wasn't just about the new york ag's transcripts. "the daily beast" says cnn jeff zucker got beat like jake tapper and that cuomo had become unpopular among network staffers and fellow hosts. cnn says cuomo suspension is for further evaluation but no word when that evaluation might happen, shannon. >> shannon: all right, thank you very much, trace. breaking tonight we learn new details about the shooting of a high school in michigan where three students died and several others remained in critical condition tonight. the suspected gunman a 15-year-old sophomore is in custody. the police had the gun used in the shooting was purchased by the suspect's father and the suspect posted pictures of the gun on social media before the attack. correspondent gary henry has the latest, garrett henry, good evening. because the three young people who lost their lives were 14, 16, 17 years old, two girls and a boy. eight other people were also shot including a teacher and are now treated at local hospitals. the police identified the shooter as a 15-year-old sophomore, who they say you semiautomatic handgun with multiple magazines to fire 15 to 20 shots at oxford high school. at first, a lot of students didn't realize what was happening, but then rushed outside and away from the school when reality set in. >> i didn't think anything of it, no, because like i said, apparently it was not a drill. it was very scary. >> other students barricaded themselves inside classroom. a student record of this video told fox 2 and detroit, moments after the shooting ended, some hidden under the desk when someone tried to open the door to this classroom and it was a sheriff's deputy. which they knew that it was not what a real deputy would do. the actual deputy confronted the shooter within 5 minutes of the first 911 call and he gave himself up without any kind of a fight. at the police station, he refused to answer any questions and asked for an attorney. >> we don't have a motive at this point in time. we are still investigating that. ultimately, we will get to the bottom of this. we are executing a search warrant at his house. >> governor gretcn whitmer and are reacting to the shooting. >> this is every parent's worst nightmare. we learned the full details but my heart goes out to the families and during the unimaginable grief of losing a loved one. >> the school was canceled tomorrow as investigators process the crime scene and they began the process of interviewing potentially hundreds of students without the shooting, shannon. >> shannon: garrett, thank you very much. protesters honoring rights disbursed by a motorist who forced their way through the crowd. killed back in april by kim potter, x officer now that said she thought she was pulling the taser when she drew her gun and shot right. the jury selection started outside the courthouse. one person jumped on the roof and another punched against a window and the car eventually drove off. apparently no injuries to the driver. the police officer ryan remington fired after shooting 61-year-old man in mobility scooter last night. allegedly made off with a toolbox from walmart and pulled a knife when confronted. remington was working off-duty security at the store when the man ignored remington's orders to not enter nearby loads and shot nine times and died at the scene. to some police said remington used a clear violation of the department policy and directly contradicts use of force training. breaking tonight two police officer among a people that have been shot in the town of rex georgia. the winded officers rushed to grady memorial hospital in atlanta. one is in critical condition and the other has nonlife-threatening injuries. the crime crisis is where we begin with the green team panel. leslie marshall, joe concha and jason chaffetz. welcome back to all of you. >> hey shannon. >> hi, shannon. >> shannon: want to read out of philadelphia temple university student shot dead in broad daylight and loading a car after home to visit. his family for thanksgiving. his eyes death brings the homicide rate to a record-breaking 506. the soaring homicide rate has lead to tensions between the cops and district attorney and officers accuse him of allowing crime to skyrocket by failing to prosecute, though mike gun crime. jason your thoughts. >> this is a problem in more than one city. you have gun crime and they don't get prosecuted. even back when i was in congress, we were questioning the obama/biden administration why aren't you prosecuting more gun crimes? it is very simple, police, neighborhood by neighborhood but i've seen the democrats take exactly the opposite approach of making sure they get out on bail as quickly as possible. that is what kamala harris was doing last summer for writing, people allegedly committing other types of crimes. so you have to prosecute these people and they have to know there is a real consequence or you will have escalation of violence. >> shannon: an opinion piece in "the wall street journal" gets to this, kim strassel is the one who wrote it "democrats have the waukesha problem where this guy ran into the parade and killed six. there were dozens of others injured. waukesha is one of those rare moments where the consequence of extreme ideology or brutally exposed to a nation. it is a big new midterm problem for democrats, one can prove difficult to overcome writing inflation, and backlash against educational that's like critical race theory." but the story for a lot of media outlets has gone away at this point, at least the waukesha event. >> it completely has a peer that is driven quite frankly by the commander in chief who during a national tragedy should come be the chief and visit the scene, small town in this case or tragedy struck due to murderous madman who targeted the victims, grandmothers, children, innocent people at a christmas parade. for whatever reason president biden is not visiting but flying over wisconsin in order to get to minnesota for political reasons to push the build back better plan here at the white house press secretary and jen psaki asked by peter doocy and to say well, certain assets need to be in place and made logistical argument, that is an insult to all those families where there are still children in critical condition in hospitals where that tragedy struck here it's a look, the objects are plain horrible here, shannon appeared i'm shocked joe biden elected because he does seem as a candidate and senator for all those years have a caring jeans that some politicians lack for him not to go there seems does not care and national media doesn't care as a result. speed, don't ask me when i want to get to two topics and leslie this has to do with chris cuomo, cnn said "we appreciate the unique position and understand the need to put family first and job second, however, the documents prove a greater effort than we previously knew." leslie he is suspended and there are a lot of document showing conversations he was having that didn't show much more involvement than we saw. >> it did but in addition to that, i think the real reason they suspended him indefinitely was one of the women said that she wanted him to be fired in light of this information that came out. and to me, that sounds like lawsuit coming down the pike. on a network, perhaps i will put that person out to pasture for a bit. listen, i was thinking, what would i do in a situation like this? i'm an anchor contributing on the network. i love my brother and i pretty much would do anything for them, but there is a line, a line of integrity that you have as an anchor, host, journalist, contributor, and you just can't cross that. for me, it wasn't sagging, listen, the manner in which my brother should respond. but needs to be more emotional. i don't think it was wrong, and things like that. my big problem was when he was going to look into his journalistic forces to find out what women were going to be coming forward and what they were going to be saying, not just across the line as a journalist but that gets into a questionable area with legality and really messing and an area he shouldn't. >> shannon: want to give a quick comment on this, media expert and we get one more topic. >> should have been outright fired. this is an anchor is a political hit man to leslie's point to smear accusers of sexual harassment against then brother governor? and the suspension leaves the door open for him to come back because remember this is the same network jeffrey toobin, hands down, the long range of legal analyst after self-serving way he conducted himself on a zoom call in front of female workers. while cuomo himself to be given a second act? time will tell, shannon. >> shannon: it will come adjacent the third topic we want to get to. the president tomorrow we think about the issues and the economy but the poll looking how the president is doing his job performance on the economy, 39% approve 59% disapprove. what does he need to say tomorrow? >> with the person to watch as brett kavanaugh which i'm sure making liberals grit their teeth after tried to stop and get confirmed in the court and covered a few years ago. that is because three liberal justices who are clearly going to vote to keep the roe trimester that there are three justices thomas, and others who think roe should be overturned and wrongly decided. it is the two trump justices amy coney barrett and brett kavanaugh whose votes are in play and will make the decision. chief justice roberts is not going to decide this case. his vote does not matter anymore now that amy coney barrett and replaced ginsberg. i think amy coney barrett when it comes down it to overturn roe. she said as much in her work as law professor. so it comes down to brett kavanaugh we know nothing about his views on abortion. >> shannon: let me read this from "newsweek." they talked about last year they questioned the sixth amendment, brett kavanaugh with an 18 page opinion and no other justice joined it, set up a framework how he may rule in abortion case in the future. brett kavanaugh said roe could be egregiously wrong and significant real-world consequences. do you read much into that one way or the other? >> i think it does put its finger on what the real issue is. it will not be about whether mississippi law which bans abortion after 15 weeks is consistent with the real framework. i don't think it is possible to harmonize the two. the only reason roe would survive to brett kavanaugh or the chief justices because they they want to respect and maintain former president even when they think it is wrong. now brett kavanaugh has published an opinion saying, welcome i will not overturn past opinions even if wrong and list those three factors are present. on the other hand, i have a hard time thinking brett kavanaugh is going to be the justice who wants to be the fifth vote to uphold roe and go down history is harry blackmun or the anthony kennedy or david souter conservative justice who kept his roe alive. >> shannon: it sounds like you are just going ahead and put the chief justice john roberts in the column to uphold roe. do you think that is because of his -- he's going to want to adhere to precedent and the idea? do you think he is persuadable? >> you watch the court closer than i do, shannon. you know that last year were a few years ago, he actually struck down regulation on abortion. because he thought it should be followed. even though he said, i think earlier supreme court cases are wrong. these are the cases with texas and louisiana about whether a state could require abortion doctors to be licensed to practice in local hospitals. so i think if that is the case, i think he was signaling that he would be a fourth vote to uphold roe. but is not really the fifth vote. strangely the chief justice vote will not make a difference in the outcome here at. >> shannon: i do think this will be one of those cases a lot of back-and-forth behind the scenes. we will have to wait until june, the 1st of july when all that the decisions are due. i think this will be one of the last once we get and it could be big. we'll have to see. i'm excited for the arguments and we will have full coverage on fox news. john, thank you very much. >> thank you shannon. >> shannon: why so much of the media it checked out on the waukesha killings, and what could be coming next for the durham investigation "fox news @ night" host frankia kelly is up and we'll have plenty to say and he joins us next. to afford her that permanent solution.
