>> want to fight inflation? support build back better. >> this will reduce inflation. >> if you care about making sure that we ease inflation in the upcoming months, in the future, voting for this, the build back better act is the way to go. >> martha: so will that play with voters as the president's numbers continue to slip? including a new real clear politics average that just came out. this is a low for the president. 41.9 approval. that's a basket of a number of different polls and that's the average of it, approval rate at 41.9. tom bevin is from real clear politics. thanks for being here today. >> good to be with you. >> martha: one of the things that strikes me, the language that you hear from the biden administration and also from senator schumer, from the build back better plan, it was reduce inflation pressures. they're not saying it was reduce inflation. their argument is that if we have this free stuff surrounding it, it will be easier for families across the country, right? >> that is what they're saying. that's what jen psaki said from the podium yesterday when asked about inflation. you know, she said no economists believe this plan will increase inflation. that's not true. there's plenty of economists out there. the white house has gathered economists that said this will ease inflation pressures over the long-term. that may or may not be true. in the short term, certainly most economists believe it won't help and may make things worse. >> martha: just to be pointing out, we've been watching this event that the president is at and we have it in the lower box. there's about 30 people there. we're told it was an invite-only audience. he's going to detroit tomorrow. i'll ask about this in just a moment. in a piece today that rich lowrey write, he said the problem there's a disconnect with the message the white house puts out and the things that people care about. it's interesting. the president said when i took the train back and forth from delaware and washington d.c. and look at the lights of the people on, that's what we care about, the kitchen table issues. rich says not only is there sticker shock, it's little connection to things that people care about. the infrastructure bill polls well. one that goes about their daily lives, but nobody goes about worried about the alleged crisis of crumbling bridges and tunnels. is he on to something there? >> absolutely. a perfect example biden just gave. he said this bridge in new hampshire, we're going to fix this bridge. it was built in 1939. sure, people are in favor of that. why wouldn't they be? the problem is he said it's vital for business. the problem is all the cars and businesses that use that bridge, everything they're transporting is higher in price. even the gas that they use to get across the bridge cost more for the average american consumer and for businesses. that's the disconnect. in the abstract, yes, people want infrastructure. they want newer bridges and roads and airports and wi fi and all that. but that does nothing to address the immediate needs that people have at their kitchen tables when they talk about the price of food, gas and all the other prices that are rising all around them every day. the administration simply does not have an immediate plan to deal with that. >> martha: so there's no doubt that when they think about that, they look at polls like this, that was a whopper that came out from the abc "washington post" poll. they said if the election for the house were hold today, would you vote for the democratic candidate or the republican candidate? gop candidate 51%, democrat candidate 41%. tom, how does that historically translate in to the mid-term elections? >> it's the highest number of republicans ever had in the 40-year history in that poll. in fact, martha, it's worse. "the washington post" surveyed eight senate battleground states. eight senate battleground states. arizona, georgia, north carolina, new hampshire. the republican lead in those eight states was 23 points. four of those states were held by republicans, four held by democrats. in that case, republicans would win all four senate seats and then races in places like colorado, washington state. these are bad numbers that would lead to a bloodbath if democrats can't turn this around. >> martha: you hear joe manchin and krysten sinema and others being very cautious about the huge sticker shock that lowry talks about and what the impact is on americans and how they read that and when they think it makes sense when we put about $6 trillion in to the covid period to try to get the economy rolling again. the way they see it affecting them is by the huge inflation numbers. so that isn't being spoken to in a very direct way. >> no, look, every administration tries to take the economic numbers and spin them in the best way possible. we had a very good jobs report last year. retail sales up 1.7% in october. out this morning. which is a good numbers despite rising prices. so the administration will tout those numbers and say the economy is coming back and all the jobs that they created. the problem is that they can't deny or ignore the fact that inflation has gobbled up pay raises across this country. people are now under a lot of pressure financially. not feeling very good about where things are. again, to the extent the administration doesn't directly address those, tries to ignore or denied them, they will continue to pay a political price for that. >> martha: i want to squeeze in one more question about kamala harris. this has been interesting to watch and goes to the 2024 question, which is further out. they came out yesterday smiling, had their arm and each other after this very long cnn piece that was posted about the dysfunction inside kamala harris's frustrating start as vice president is the title here. it says many of those close to her feel like he's shirks her political duty to promote her and setting her up to fail. worrying that even the base democratic vote is starting to give up on her. tom, what do you make of this? they go on to say that think think there's a pumping up of pete buttigieg as a potential replacement. >> shows the uncertainty going on in the democratic party. we've never seen anything like this. ten months in, we're talking about the infighting acc back fighting going on, positioned for 2024, a lot of uncertainty over who will be the party leader moving forward, this is reflective of that. >> thanks, tom. >> thanks. >> tom bevin from real clear politics. as president biden touts the path of a $1 trillion infrastructure bill, as we just said, he's warming up to push through another one. this is a 1.75 trillion dollar social spending. they say this would bring us up to $6.8, maybe seven trillion in terms of total spending since the beginning of covid. on page 1,647, because i know you've been reading through it over the weekends, right? on that page, this is what was found. possible child tax credit pay-outs to illegal immigrantses. senator tom cotton was pressed on money for illegal families separated at the border and issues surrounding this in a hot hearing with secretary mayorkas. he will join us next to talk about that. >> who do you think is more deserving of cash payments of the united states government, illegal migrants that cross our borders or the families of soldiers killed in action? 2,000 pages we printed out. 2,135. we're highlighting when we get a look at what is in the fine print of the $2 trillion social spending plan that the president says will transform the country. page 1,647, here's what you'll find. the bill calls for ending the requirement to have a social security number to receive the child tax credit, which is monthly payments of $300 per child to families across the country. should that go to people that are here illegally or to people that have social security cards and numbers and pay taxes in the united states? so foxnews.com reports more than $2 billion in taxpayer funds would be needed to make the payments to all of the children who are living in the country whose parents came here illegally. that's something to think about in this bill. in moments, tom cotton who was in on a heated questioning on issues like in and surrounding this with the homeland security secretary, alejandro mayorkas a short time at the senate judiciary hearing. he's here in a moment. first to aishah hasnie who recapped what's is going on in there. hi, aishah. >> yeah, that hearing just wrapped up. the secretary got quite a grilling from republican senators including ted cruz who really pressed him on how this administration is treating unaccompanied children at the border. watch. >> how many children have been in the biden cages in calendar year in 2021? >> senator, i respectfully disagree with your use of the term "cages." >> has kamala harris been down to see the biden cages, this facility? yes or no. >> the vice president was at the border. >> several senators asked about those settlement payments for families separated at the border. mayorkas punted to the doj. he says he's not involved in that. now as you mentioned, billions in taxpayer money could be on the way to illegal immigrant families. democrats just changed the rules for the child tax credit program in the president's massive build back better plan. so families no longer have to provide a social security number to cash in on that credit, which now opens upwards of $2.3 billion for parents of illegal immigrants. here's senator tom cotton grilling mayorkas about his priorities. >> what should be a higher priority of the us government, securing or border our giving amnesty to illegal aliens that are already here? >> senator, justice is our priority. that includes securing our border and providing relief to those that qualify for it under our laws. >> martha, bottom line, mayorkas says our immigration system is broken but it's the job of congress to fix it. martha? >> thank you very much. joining me now, tom cotton who you just heard questioning secretary mayorkas. senator, good to have you here today. here's the rest of that exchange. you asked him if he thought that it's more important to give payments to families that were separated at the border under the prior administration or to those that lost their lives, american citizens that fought for our country. here's what he said. >> i think that the families of those that lost their lives wearing our nation's uniform are our greatest responsibility as a nation. >> martha: is that the policy we're being seen carried out, senator? >> no, martha. joe biden was not aware that his administration was going to pay reparations up to $450,000 per person for illegal migrants detained during the trump administration. his staff told him a couple days later and gave a fiery defense of it. most americans agree it's appalling that we're going to reward illegal migrants, get more of them, paying them 4.5 times more than the families of american troops killed in the line of duty that would receive from the government. >> martha: with regard to what's in this build back better program, and we so the president taking a victory lap for the infrastructure bill that was signed in to law yesterday and now the attention is turning to the build back better program, which is just under $2 trillion of social programs, climate change and elder care, child care. when you dig in to it and you look at these things -- i don't know what will end up in this bill and what isn't. what is in there, if you're in the country illegally and not only reparations but as the $300 check per child, you know, throughout the course of the year. >> yeah, martha, if i have anything to say about it, hopefully nothing will end up in that bill because it won't pass. i commend you for doing light bedtime reading, all 2,100 pages of the reckless tax and spending bill and finding what you call a turtle on the fencepost that didn't get there by accident. the democrats went out of their way to repeal the pre-existing requirements, you have a social security number to benefit from these massive monthly checks. they did that specifically because they want to send checks each month to illegal aliens. if you have a family of three, you'd get $10,000 from the u.s. tax payfer you're in here illegally. that's only going to provoke more illegal migrants crossing our border adding to the 1.7 trillion that we had this year which is three times more than last year. >> obviously you want to help people and you want to make them comfortable. look at social security is about to run out. these are the things that senator manchin has been talking about for why he thinks that we can't pass this because we can't pay for it, can't pay for the entitlements that we have and the people that made into those, those are already running out of money. it's a question of where it's all going to come from. a lot of focus on vice president harris and the past few days. here's an exchange with secretary mayorkas about whether or not she is -- what her responsibility actually is with regard to the crisis that we're seeing at the southern border. watch this. >> vice president harris, our border czar, what kind of grade would you give her? >> vice president harris is not the border czar. vice president harris has been asked by the president of the united states to focus on root causes. >> martha: have we figured out how that is going in terms of alleviating the pressure of people coming to the southern border? my truck...is my livelihood. so when my windshield cracked... the experts at safelite autoglass came right to me... with service i could trust. right, girl? >> singers: ♪ safelite repair, safelite replace. ♪ >> martha: we're waiting for the indication that there's a verdict in the kyle rittenhouse trial, a trial that has great britained the nation that we haven't seen in a very long time in this country. a lot of focus on all sides of this case. today kyle rittenhouse himself picked the names out of a container to determine which jurors will be alternates and which 12 of those jurors would decide the fate of this young man, whether or not he's guilty of murder or shot and killed two men and wounded a third in self-defense. garrett tenney live watching all of this play out for us today at the courthouse in kenosha. high, garrett. >> martha, good afternoon to you. as these deliberations continue, it appears the jury is also zeroing in on those self-defense arguments. the one request the jury made so far was for 11 copies of the jury instructions specifically the portions dealing with self-defense. the jury is made up of seven women, five men. almost all white with one person of color. the judge will allow them to deliberate as late as they want to. if they have questions, the court will reconvene and discussed in open court. the scars from last year's riots are fresh for this community though. a lot of folks here are on edge as we await this verdict and the potential for more unrest. >> knowing the actions of the people, i'm assuming that there will be. i know kenosha is ready for them. >> i pray people aren't going to come in from other states and do more damage. >> i pray it doesn't happen but i don't see it happening. i don't see it. they're taking the measurements to get on top of it before it starts. >> local and state leaders are trying to re-assure folks that if there's any inrest, this time it will be different. 500 national guard troops are on stand by and local law enforcement says they improved the capabilities from last year. today wisconsin governor tony evers said that the people from wisconsin are stronger. regardless of the outcome in this case, i urge peace in this area and across our state. you can see a small and lively group of protesters outside the courthouse. at this point, there's no reason to close down any roads or to enforce any kind of a curfew. they say they hope it will stay that way in the days ahead. martha. >> martha: thanks, garrett. let's bring in former prosecutor in new jersey and criminal defense attorney, bob bianchi. good to have you with us today. heading in here in terms of background, i'm struck by the governor's tweet. i was listening to reporters that covered a lot of the riots, the terrible situations that we saw across this country of businesses burning last summer. they said that they went to minneapolis but never saw anything like what they saw in kenosha. when we get to kenosha, the striking thing is a that while these these businesses were being burned and people were looting and breaking windows, there was no police and no national guard anywhere for days. now you hear tony evers has 500 national guard on stand by. you wonder if this whole thing would be in the court right now if that kind of protection had been brought in when it was needed. that's when kyle rittenhouse decided to bring his gun to his father's hometown of kenosha to see what he could do. what are your thoughts when you hear about this jury and the requests for the documents? >> i think it's bad for the prosecution. i can tell you throughout, something didn't seem right with this prosecution to begin with. having investigated prosecutions for years, the fact that they filed charges days after the incident before having the autopsy, before having the crime scene evidence, before having the witness interviews, before looking at the videos, the defense made a big deal of that in summation to say this was about politics. this was not about having a proper prosecution. they needed somebody to blame. if it wasn't for the lawlessness, this would have happened. martha, that's the importance of the self-defense claim and why the jury is probably focusing in on that. i can tell you as a homicide prosecutor, i wouldn't like that question from the jury because what they're trying to determine is whether or not it was reasonable that he was in fear of his life or great bodily harm. a lot of people on the other side of the situation keep going to this concept of provocation. that's what the prosecutor had to say this was about. the case was about that rittenhouse provoked the violence. if you look at the jury charge, i'm looking at it right now, that says very clearly and i'm sure the jury is looking at this in the self-defense section of the jury charge, it only applies to a person that engages in lawful conduct of a type likely to pro vote violence. martha, many people had the ar-15s out there and weapons out there and didn't provoke violence. kyle rittenhouse based on the state's own witnesses, which i could not believe, i can -- i was listening to the state's witness. i asked my producer, is this a defense witness called out of turn or is this a state's witness? it was the state's witness talking about how rittenhouse was trying to get away. he was outmatched. he had rocks being thrown at him, shots being fired, hit by a skateboard and so on and so forth. so the question for the jury, was it reasonable for him to believe that he -- it's not just die, suffered great bodily harm. that's what this jury is focusing on. if they come back with yes, that's what it is, this was an outright acquittal. people will be upset about it, but the fact of the matter was, like the defense lawyers said in summation, this was a rush to judgment in order to point the finger, to blame them for what law enforcement didn't do, which as you point out right now apparently now they're going to. >> martha: you never know what's going on in the minds of these jurors, seven women, five american. one of them is a person of color who is a man. they're inside the room and the justice -- the judge was very clear. he said you have to forget everything that has happened outside of this story. everything that you've heard in the press, you need to focus on really what they asked for, which is the six pages of the instructions. was he acting in self-defense moment by moment, from what you have learned throughout the course of the trial. we'll see. bob, thank you very much. good to have you with us. we'll see what happens. >> my pleasure. >> so democrat adam schiff pressed on russia hoax regrets after he made comments like this. >> certainly say with confidence that there is significant evidence of collusion between the campaign and russia. >> martha: in light of what we now know about the baseless anti-trump dossier, which was the essential piece of this whole investigation, without it, they said they couldn't have gotten the search warrants that they got. congressman jim jordan joins me on that. >> none of that conduct is diminished by the fact that people lied to christopher steele? >> first of all, whoever lied to the fbi or lied to christopher steele should be prosecuted. >> martha: there's this p.r. executive number 1 who is the person that he refers to. adam schiff says whoever is the person that lied to christopher steele should be pros cuted. that was chuck dolan, an associate of the clinton campaign. so how is that prosecution effort going? >> we'll see. but he's saying that the clinton campaign should be pros cuted. frankly everything we've said about this the last several years turned out to be true. the only thing we were wrong about is it was worse than we thought. it went directly to the clinton campaign. at least what we know now, mr. dolan. that's where the lies started. the island that the fbi didn't know this was garbage, i find that hard to believe. we'll see what mr. durham turns up. >> martha: we have a scrolls, the "washington post" -- i wouldn't call it an apology. they're corrections. they went back to all of these stories that we're scrolling on the screen and may have made corrections to dozens of articles, some are broader articles that deal with the russia collusion issues in different places. some of them were on the list that won a pulitzer price, some were not. regardless of that fact, this is under the radar as can be. you have people who oversee media and journalism at columbia and other places saying whoa, these institutions need to take a hard look how they got so far down the rabbit hole on this story. >> and mr. sussmann was feeding information to the press at the same time that he was walking in directly. so he forgot the middleman. he didn't work through steele. he went to the fbi, handed the fbi false information. this supposed connection with trump business and russia is false. he handed in the information to not just anyone but jim baker, at the same time he handed it to him, he's spinning up the press saying i got information to the fbi, this is why it's so bad. so thank goodness they admitted there was wrong statements in all of these stories in the past. but people need to be held accountable. i don't know if it goes to top people in the fbi like andy mccabe. we'll find out. sure seems like it does. >> neil: there were stories that they won pulitzers for. the stories pulled up are the ones that they made corrections in. we'll see how many will be issued as this moves forward. i want to ask you a last question on an issue that we discussed in the past. merrick garland and the effort by the doj to make sure that any of these parents speaking out at the school board meetings that step over the line are under the purview or investigation of the fbi, a new development in that? >> there is. we just had a whistle-blower come forward. we got information from this individual yesterday. as he points out, the fbi, the day before, merrick garland was the, he testified october 21 there was a memo that goes out instructing them to put threat tags on parents. they were cataloging and categorizing parents that may pose a threat. this is a federal categorizing only moms and dads showing up at school board meetings. that is frightening. merrick garland said it's not going on. but we want more information. it reminded me -- back when the irs targeted people with the bolo list? that's what this reminded me of. >> martha: we know what happened to them. agents show up their doors and go through their financial documents. this was was just reported in the "wall street journal." congressman jordan, thank you. >> you bet. >> a story exclusive with the loudoun county gym teaching celebrating a big victory in his fight against school policy on transgender students and the way he approaches them and speaks to them. this has been a huge back and forth in loudoun county. we'll speak to him next. >> i'm a teacher but i serve god first andly not affirm that a biological boy can be a girl and vice versa. it's against my religion. cough cough sneeze sneeze... >> the concern i've always had about this administration is the strength of their resolve. you have to recognize that clearly coming in to this meeting, the first meeting between these two leaders since the fiasco in afghanistan where we walked away from a 20-year ally and surrendered, that is on the mind of president xi when it happened and in terms of resolve of the united states. you've seen the aggression that russia is taking and you've seen the aggression that iran is talking all post afghanistan collapse. it's got to be in the back of his mind. what we should be doing is clearly making certain that given the fact that there's no break-throughs at these meetings, that president xi walks out of there with the absolute clear and unequivocal view that the united states is going to stand strong with our allies in the region and tell him straight out what you're doing. as a result of your aggression, president xi, i'm signing troop deployment orders to up-gun or capabilities in the region. you are precipitating and arms race that you said you didn't want to participate in. but i have no choice to do that. we're going to stand by our allies in the region. i'm going to make sure that their security and u.s. interests are protected. make certain that president xi walks out of that meeting with the conclusion that biden is dead serious here. that's the concern that i've had from the outset with this administration. lots of rhetoric. i'm not certain about the mental toughness and certainly the evidence that happened in afghanistan is an indicator of that and i'm not certain about their ability to convince president xi that we're up to the task in dealing with this relationship. >> why is the question. my mind goes back to you saying a similar thing about president trump the way he spoke to about vladimir putin. sometimes i don't know why he's not taking a tougher stance. it's a head scratcher. why do you think president biden is not taking a tougher stance when he has the opportunity to lay down what you laid down? >> well, because i think the administration tip toes around being tough. we have a tendency to want to play nice and talk nice. you have to recognize what we're dealing with here. this is a man who still has not admitted that they are the cause of this pandemic. likely out of the wuhan lab. how much better would the world be if xi said look, we looked at this, we made a mistake, inspectors verify it. let's work together to solve the problem. how different would the trust and the relationship be just by dealing with that? have you had an instance since this happened where a student said to you, i'd rather you refer to me by this game or this pronoun? have you run into that since you made that statement? >> i had one student that asked me to call them by a name. i decided to do that. i just wanted to make sure, martha, to understand for everybody that this is a huge win for teachers in this community and i just -- i'm so glad to be back with my students and my students are happy that i'm there. you know, i feel vindicated. you know, i just hope other teachers feel confident as i do now with this huge victory and maybe they'll go advocate for their students. >> martha: they do have rights of conscious and faith. this statement is from the pro equity parent group statement. it says parents deserve their children to be recognized and provide a safe place to learn and grow regardless of a teacher's beliefs. we hope mr. cross will provide a safe place for all of our children to learn. sounds like you did that. a student asked you to call him or her something and you agreed to that. how did that come about?
