first, merrick garland grilled on capitol hill today. another rough day for this gentleman. over his memo that called for the fbi to assist with threats of violence by parents against school board members. now, since the last hearing, the national school board association who memo he admits was the basis for his action, they backed down. they said that it was wrong of them to suggest that these parents could be domestic terrorists in this context. so the a.g. was under pressure to do the same thing and to rescind his memo. >> either you run the department of justice or the department runs you. right now looks like the department of justice is running you. >> did you consider the chilling effect your medium random might have on parents exercising their constitutional rights? i think you can answer that yes or no. >> what i consider -- i wanted the memorandum to assure people that we recognize the rights of spirited debate. >> a national security division, judge. these are the people that are supposed to be chasing jihadists and chinese spies what is the national security division have to do with parents at school boards? >> this is not, again, about parents at school boards. it's about threats of violence. >> most of us and most of the person people are flabbergasted if you answer is you have no regrets about this memo. is that what you think? this is wise? >> senator, the obligation of the justice department is to protect the american people against violence including threats of violence. this is not about the american parent. >> i know. it about the politicization of doj. you decided to submit as a vessel and you know better. >> martha: so let's bring in laura ingraham, host of "the ingraham angle" and "california on the edge" with laura ingram. a great documentary about what's going on in california. great to have you with us today. i've seen uncomfortable people in hearings before. but merrick garland look like he couldn't way to get out of there. a lot of i don't knows. why did you move so quickly? over a weekend, you had an nsb letter from the national school board and a bunch of reports that you read in the newspaper and you launch this federal agency investigation into parents. what did you make of it? >> let's switch to facts here. let's just say that bill barr was attorney general and some group wrote a letter to bill barr that, you know, a general conservative orientation, and said well, blm has been linked to groups that commit vandalism, carry out threats, intimidation, campaigns across the nation, riots. we want an investigation into on going into the activities of black lives matter. then he turned around and sent a letter out four days later over a weekend about black lives matter or any other pick your group. the left would i think justifiably so start can asking questions. what violence specifically, who originated the concern that brought it to you, who wrote the original draft of the letter. but -- okay. they would be going crazy. we know that. but today merrick garland, a very smart guy, former federal judge, he gets up there and can't answer simple yes or no questions. he's obviously in a corner. he's backed himself into a corner. really unwise of him to do so on this letter. what he should have said today, i think try to maybe get this behind him a little bit is say look, we maybe jumped the gun, pun not intended, on this, and we would have been wise to take more time to do a further investigation. but he not let go of this, martha. they realize this is the holy grail for republicans right now. they feel like they can't let it go. >> martha: this is an exchange by senator durbin that didn't help either. it paints a picture where there's an assumption that certain kinds of people all fall to the same group. for the sake of argument, call them deplorables. that's the way he portrays them here. he goes over a couple of instances of harassment that are specific, that led to this. watch. >> these are not routine people incensed or angry. they're acting out their feelings in a violent manner over and over again. the same people that we see on airplanes and other places. some of whom we saw here on january 6. >> january 6? what? again, that's their -- that's their lifeline they think to electoral dominance, is going back to january 6. it has nothing to do with january 6. more importantly, martha, we do have state law enforcement. if individuals are making violent threats across the internet or any other form of communication, they can be prosecuted and they will be prosecuted. we have state authorities. how this becomes a federal matter is another question altogether, unless they're using the internet to make threats on facebook. none of that came forward. merrick garland really didn't seem to have any evidencery basis for turning around that memo as quickly as he did. he took it as gospel with what the national school board association said. i've been in washington almost 30 years. i can't believe i'm saying that. i have not seen this level of a fury coming from republicans as i do on this school board issue. it's bleeding over to the independents as well. these are just parents. they want to know what their kids are being taught and they want their kids to be in a safe environment. they don't want to be intimidated. >> martha: indeed. some fall into that same category that we've seen vote for president trump in 2016 and then for biden in 2020. they seem to be questioning what they got. we'll see tuesday. you had scott smith on your program. we played this. this man's daughter was sexually assaulted in a gender fluid bathroom at her high school in loudoun county. this poor man went to the school board meeting and railing about it because he couldn't get anywhere. they said this didn't happen, this doesn't exist. he became the poster man for these crazy parents at these meetings. tom cotton said today, does he get an apology? what did you think of that moment? >> it was very powerful. for all the talk of violence among supposedly being threatened by parents, we had law enforcement tackling a dad whose daughter had been violated in the most -- you can't say what happened to her. but we now know did happen to her. her victimhood doesn't count. the supposed victims who they're creating out of thin air for political purposes looks like get all of the attention and the focus? this family dragged through the mud? something is upside-down in our society, our culture where parents now have to wonder whether it's okay to go to a school board meeting, less they lose their job or less they be called a terrorist or brand add right wing insurrectionist. most of these parents are not political. they're parents and worried justifiably so. >> martha: think about president biden before he became president. he talked about the rape epidemic. that brought to mind if the numbers they looked at were accurate. now a sexual assault in a high school and the attorney general is not aware of it. didn't know it happened. >> how about maisey hirono? in other words, a real bullet, not a blank. they found after an investigation. i ask the district attorney if alec baldwin himself is the man that pulled the trigger and named as a producer could himself face criminal charges. here's that exchange. >> all options are on the table at this point. i'm not commenting on charges, whether they will be filed or not or on whom. the answer is we cannot answer that question yet until we complete a more thorough investigation. >> [question inaudible] >> nobody has been ruled out at this point. >> now, the sheriff said during that news conference that there was "complacency" on the set regarding the handling of weapons. so i asked him what his personal view of that sort of complacency was. here they've exchange. >> any time firearms are involved, there's -- the safety is paramount. i'll say that. anybody knows that. if you know anything about firearms, any time a firearm is around or about safety is paramount. >> does it anger you live rounds were on the set? >> i don't let my emotions get involved. this is an investigation. we rely on the facts. >> now, given that that complacency on set led to the death of the cinematographer, i asked if there was a legal bridge from complacency to criminal negligence. she said yes, there might be. they have not established that bridge at the moment. this investigation clearly just getting underway. martha? >> martha: thanks, jonathan. i want to bring in steve wolf, a weapons consultant. steve, good to have you back today. so what we learned today is that this weapon is an f.lli pietta long colt. what does it take to pick that up and fire it? there's two motions, correct? >> right, this is one of those guns. so when we refer to single-action or double action, we're talking about how many actions are performed by the trigger in a -- i always open and clear the gun every time i pick it up. on a double action revolver, when you press the trigger, it cocks the hammer and releases it. the trigger performs two actions, this is the same gun that was used on the set. the trigger will do nothing unless you have cocked the gun. so you have to pull the hammer back. it sets and then the trigger will activate the dropping of the hammer. so you have to do two deliberate actions in order to fire this gun. >> martha: so the first action of cocking the hammer before pulling the trigger, would that feel different if there was or wasn't a bullet in the gun or be the same either way? >> it would not. there's a mechanical linkage in here, a gear that connects the hammer to the piece that rotates the cylinder. it feels the same regardless of whether there's ammo, blank or nothing in there. >> martha: you said that yesterday when we talked, two days ago, you talked about how certain guns are able to have blanks in them and others are not. does this gun accept blanks? would it work with blanks in it? >> absolutely. soed in the 45 long colt caliber, which is for lack of a better word, an impressive round as handguns go, is this. the 45s that -- the semi autos that might be carried like l.a. highway patrol or something, they shoot this. look at that. this is considerably larger, a lot more gunpowder, great big bullet there. this is the same round that halyna hutchins was shot with. once you opened the cylinder on that gun, you actually access it through a port. you either put in this with the live round on the end or you can put in the blank. if they used a blank, at that distance, probably there would have been no injury. my issue is, you know, why wouldn't she use a gun like this particular one that has been modified such that you can't put live ammo into it. if we were to try to put live ammo in this gun as i showed you earlier, it won't go in guarantees that you can't have a live round in the gun that you're using on set. >> martha: so how easy is it, when you pick up that handgun, how easy would it be to take a quick look at it and figure out whether or not it has live ammunition or not? what would you do to show yourself that? >> it would be as difficult as opening this port, flipping this around and seeing if there's rounds in here. on this end, you're able to see whether there's a bullet or just a hole. so you'd be looking through here to see am i seeing this or am i seeing this. >> martha: which looks very different. >> that's right. so you certainly -- you certainly have to rotate the cylinder while looking at the down range side of the cylinder. you can see in there if there's anything in there. >> martha: you said that's something that you do every time you pick up a weapon. the first thing you do. you look at it to see whether or not there's anything in there. >> every time you pick up a weapon, you verify the condition of it. you want it to be clear because you're going to be dry firing at home or going to be cleaning the gun, putting it in maintenance or storing it empty or verifying that it's loaded because you're doing something that requires it to be loaded. in either case, you know having personally checked what the condition is. given that it's so simple and actors are smart enough to learn all types of skills, i don't understand why the armorer wouldn't have been taught to do this and told them you take it from my hands, i'll check it. it's in your hands now, you're responsible for what happens with it. so i want you to know how to look inside and know if the gun is safe or not. that's all it would have taken. look in there and said, wait, is that the blank? >> i was out at the space command and at norad, which is responsible for defending the united states and north america against nuclear attack a few weeks ago. can't get into the details, martha, but let me say this. this is a sputnik moment. it's sputnik with a nuclear warhead that can reach your house or command and control or anything it wants within minutes and it's maneuverable, can fly around our radars and go places where we can't see it. it falls to the earth so fast that the missiles can't defend against it. incredibly alarming. we need to wake up to the fact that the chinese communist party is in a cold war with the united states. they're openly taking about replacing the united states and putting the military assets in place that we can't defend against. >> martha: here's the way that general austin, the secretary of defense, describes how he sees our relationship with china. >> china is my challenge and we'll remain focused on that. >> martha: what does that mean, my pacing challenge? >> when the military says that, we have all kinds of threats out there. iran, north korea, russia. this is ship for ship, plane for plane, tank for tank, this is the adversary that we have to keep pace with to maintain deterrence and keep stability around the world and godfor bid if we going to blows, fight and win. we need to be focused on china more so than all of the other threats. it's a top priority. here's the thing. this is a much broader issue than military. this hypersonic weapons, they're stealing the technology from our universities, research institutions, through cyber and it's our money through our trade deficit, through the investments that wall street is making through these corporations like nike and coke and apple and others. it's american money that is fuelling this military build-up and it's american technology that they're stealing in order to replace us as a global leader. >> martha: just as one example -- it's extraordinary. we hear about it that are trying to get people to wake up of what we already allowed to happen in the united states in terms of our advantage. something struck me the other day. i read a statement that said the united states would probably lose against china in a battle for taiwan. do you agree with that? >> the war games that we're running now, that's the case, martha. the first shots are almost always fired in space and cyber space. if they have the capability to drop whole portions of our grid, if they have the capability to take out our gps or our satellite constellations that our modern economy depends on and our military depends on, then yes. what they bank on is that we lack the political will in this white house where they smell weakness and even more broadly to commit what we need to commit to defend taiwan. really what it is defending the global economy and stability led by the united states. >> martha: you have spoken out about building a more sort of structured alliance with india. >> right. we have never faced an adversary with an economy that is bigger than ours and that has created dependencies, whether it's our pharmaceuticals, rare earth minerals, you name it that we're dependent on. i don't know that we can keep pace with them alone but we can when it comes to the world's largest democracy, india, japan, australia and nato together. what we have that china doesn't have our friends and allies. but we have to lead them. they have to know that they can depend on us. after this afghanistan debacle that is in doubt with this white house. >> martha: that is the alliance as you describe it that would need to be put together to really confront china on all of these levels. you're speaking out about it today. thanks, representative waltz. >> martha: thank you. stick around. we're about to get an update from bill hemmer who will join me and shows that president biden's support is sliding with independents under the weight of this spending deal and the supply chain problems. bill joins me with a look at virginia. what do you have to keep in mind coming up next. >> americans are so worried about getting their christmas gifts on time, halloween. is this going to be happening? that's not the only challenge the industry is facing. kelly o'grady has the job of spending the afternoon at a winery in california. hopefully she will bring some home since it's hard to get. >> california's wine industry at the center of a perfect storm. the demand is there. there's a sharp increase in consumption. not only are they grappling with a supply chain problems, but they have a drought. north carolina has the worst year on record. production is down 20%. some vineyards are seeing 60%. in many cases, the vines are died, which will impact harvest for years to come. the droughts are not new to small businesses. the supply chain crisis is. >> it's difficult to come by fertilizer. prices are through the roof. we have a shortage of bottles. as simply as that may sound, it's a problem. these is millions of investment. hopefully it will be resolved soon. >> the port backlog and shortage are leaving problems. add in fuel and shipping expenses, you're left with empty shelves and higher prices. as of september, the average cost was 5.4%. as the holidays approach, it's hard to imagine upside for anyone here. as the backlog grows more dire, it's hard for the small business as to plan and order for future harvests when they already make so little profit. back to you, martha. >> martha: thank you. gerri willis joins me. we have no wine and no treadmills. i don't know. i can imagine what jen psaki will say about the wine shortage. major emergency. but it is -- >> i have a feeling she'll be upset: >> martha: gerry, what do you make of this? >> the effects are huge. it's not just about the shortages but what it means for christmas. >> what it means for prices. inflation is going up everywhere. we've seen people increasing their demands. people are buying more right now. consumer spending was up for september. inflation up 5.4%. that is a massive number. gas prices are up 42% year over year. this cuts right in to people's budgets. i have to tell you and i know you know this because you're a former business reporter, it's a tax on people. you can't decide not to spend on gas or not to spend on groceries, which is also very expensive. you have to do it. takes a big bite out of your budget. we'll see how consumers react. so far they're spending and spending big. >> martha: the president whispered it's a tax cut but i don't think people feel it. that may change. it's not a tax cut right now when they go to the pump, this is jen psaki saying this is because the economy is recovering. watch this. >> so many people across the country are purchasing more goods online, maybe some of it is from habits that developed during the pandemic when people didn't leave their homes. some of it is because we've seen an economic recovery that has been underway for the last nine months. the unemployment rate is cut in half that is leading to a massive increase in volume. >> martha: is she right? >> partly. in the beginning that was absolutely it. you remember the visions of the l.a. port, container ships stacked like cord wood. there's another issue here. it's the shortage of labor. there are not enough people to drive trucks. there's not enough people in the warehouses, not enough long shoremen. a lot of issues converging here and creating problems in the economy that will show up in overall gdp growth. you can tell me i'm getting a tax cut but i'm not buying it. >> martha: the military and national guard have trucks and driver. may not solve the problem but could grease the wheels. i read that the truck drivers that live in california in order to be a truck driver in california. that's a high tax state, a tough situation for them as well. that's one of the reasons that they're seeing a shortage of drivers in california. gerri, great to see you. a new poll puts president biden under water in verge, a state he was up by ten in 2020 against president trump. bill hemmer breaks that down why it matters. a big election day coming up. ♪ limu emu & doug ♪ got a couple of bogeys on your six, limu. they need customized car insurance from liberty mutual so they only pay for what they need. what do you say we see what this bird can do? woooooooooooooo... we are not getting you a helicopter. looks like we're walking, kid. only pay for what you need. ♪ liberty. liberty. liberty. liberty. ♪ >> martha: going to get a live look at the campaign trail. terry mcauliffe is at the mic. he has a few more days to make a case to virginia voters. another poll shows this race is in a virtual dead heat. mcauliffe and republican glenn youngkin less than half a point apart at 45% each in the suffolk university "usa today" poll. the same poll shows president biden underway by 11. this is a state that he won by 10. last year, a huge move, in his approval rating in just nine months. the president campaigned with mcauliffe, who he said the president is a little unpopular in virginia but he campaigned here anyway. it's a race that everybody is watching to see to take the temperature in this microcosm of virginia. we have bill hemmer here, who dusted off the big board. it's shiny and new for the election season. he will be with us tuesday night. hey, bill. >> this is the studio f model. made it just for you, as a matter of fact. >> martha: thank you. >> this is the governor result from 2017. ralph northum beat gillespie easily. as you look at virginia, it's been a fascinating state to see the way the demographics have gone. 2009 it was won by a republican. now it's gone the democrats the past several cycles. here's what i do. this is washington d.c. this is arlington, this spec here provides a ton of votes for democrats. that's where president biden was just last night. this is loudoun county, heard so much about the education push. watch this county on tuesday night. see whether or not youngkin can start to chop into that blue lead there in loudoun county. a lot of votes up here. youngkin was with us earlier today on "america's newsroom." he was here in franklin county where you can see the advantage republicans have. roanoke county. again, the republican edge there. over here to pulaski county, a lot of the votes will matter here in the southwestern part where there's so much red. i put a focus here on richmond, virginia. i talked to a lot of experts that watch the polling in the state of virginia. they're saying this area is toss-up. this is richmond city. a heartbed for the blue team, i'd say. enricoh county north of it, things change. chesterfield county, get to the suburbs things are pretty dead even. remember when eric cantor was upset in his congressional race?
