irs status. we begin tonight with an unpopular president hitting the road monday to push a massive spending bill he hopes will help his poll numbers rebound. trace gallagher is on the case. good evening. >> good evening. in an effort to pitch his social spending plan i thought to be in the ballpark of 1.75 trillion, the president used both new and old arguments for the old being that the plan will expand opportunity not denied and the new slogan is that components of the bill like the child tax credit is a "tax cut." the president has also repeatedly said the bill will cost $0 because it will be paid for with tax increases. now that statement already labeled as untrue is creating even more skepticism considering the plan to raise taxes on corporations and high earners now appears to only a certain number of questions or his staff does not want him to keep talking. today he was caught on camera talking about that with some kids. what can you tell us? >> he was finishing up remarks with elementary school students in new jersey when he pointed to the back of the room toward media and he said the following. >> -- they are working. get to ask you all kinds of questions and you try to figure out how you can avoid answering some of them. >> avoid answering. of course we all heard the president say repeatedly that he is not supposed to take any questions or that he is only calling on journalists that are preapproved. and mostly as you know what we have seen is the president giving scripted remarks and kind of turning and walking away as the media shouts their questions. so some political and say they believe the president and the white house might be trying to control the tempo but it is notable that he has yet to answer questions on the lousy job numbers in september, rising inflation, and the supply chain crisis. so maybe he is heading ground rules but as we noted, his approval numbers are at the lowest point of his presidency. >> shannon: and peter doocy -- they smuggling and other criminal activity. here is bill melugin with the images he will not see anywhere else. >> a shocking scene in texas monday afternoon as we witnessed dozens of illegal immigrants hiding inside of a train car in which they had been hitching a ride in the blistering heat. while embedded with texas dps, we watched as troopers pulled the migrants out one by one. all of them single adult men who had been hoping to use the train to get further into the u.s. 23 men were pulled out in total. and their demeanor changed noticeably when texas troopers told them they would be going to jail for criminal trespassing instead of being handed off to border patrol. earlier in the day, we sought more migrants hitching rides on trains passing through the area which is about 40 miles inland from the border. when this train came to a stop, texas dps rest of the migrants on board. five of them in total. all men. they told us they were trying to get to san antonio. troopers check them for tattoos, looking for possible signs of gang affiliation and then took them into custody. they will also go to jail for criminal trespassing. and take a look at this video. on sunday in the exact same area, texas dps found 19 migrants hiding inside a brand-new cars that were being shipped on trains. how they got inside of them is unknown. texas dps has been working for train yards for months now. often encountering runners and migrants were trying to evade. they have made more than 1300 arrest on trains since july. that includes gang members and cartel members. in texas doesn't believe in catch and release. >> you will beat a branded and facing jail. not going to lay out the red carpet like with the federal government is doing. going to place them in jail and that's what we are doing right now. >> wanting to point out is the federal government -- border patrol is not out here. it is only texas dps. state troopers tell us they are the last line of defense when it comes to these poll numbers declining in the fact that hyper inflation is -- we are likely to see a change in leadership in the house and senate and i know we are a long ways away as you say, but still it all, the results are showing, and people are unhappy. >> shannon: a year feels like forever in politics. so we will see but it will be about a year from now. pulling all over the place including fox news and other places showing people are worried about the inflation and economy. then we have this from "the new york times." thanksgiving 2029 is shaping up to be the most expensive meal in the history of the holiday. nearly every ingredient from the turkey to the after dinner coffee expected to cost more than ever. so that is the real world, kitchen table kind of stuff that people relate to and when they feel in their wallets and pocketbooks, they have a reaction. and these poll numbers seem to show that. >> absolutely. i think when you see the price of bacon if you like or turkey stuffed with bacon. and you see what going for $18 a slab, there is a problem with inflation. it points to the reason why you need a bill like build back better. you have a job market where there are -- one of the reasons they are not going to back to work as they are tired of the pandemic. 2.9 million also job. one of the reason why a lot of women are returning back to work is because the cost of child care is far too high. build back better will help bring the cost of that down. republicans -- also a problem. we bring the cost of child care down and we get women back in the workplace, 2.9 million who lost her job, this is a step in the right direction. and understand it also has to do the global supply chain issue in the way houses been better responding to that. something that the bill also does. investing in manufacturing here in america. entering the folks that are sitting on the sidelines are back in their. investing in businesses. all things we have to do because we cannot have a supply guys back. thank you both. we have new details tonight about that fatal shooting on a movie set in new mexico. in which actor alec baldwin discharged what he believed to be an unloaded prop gun killing a cinematographer and wounding the film director. she corresponded jonathan has the latest tonight from los angeles. good evening. >> according to the director of the movie "rust" and other crew members, at least to go people likely handled the gun that killed cinematographer halyna hutchins before that gun was handed to alec baldwin. as it series of visuals were held over the weekend, new information released by the sheriff revealed that baldwin was rehearsing a scene at the time. drawing his gun from his holster and pointing it directly at the camera where hutchins was standing. the affidavits released by the sheriff revealed that according to the director who was injured in the shooting, someone had shouted cold gun when the weapon was handed the baldwin meeting it should have been safe to use. others have identified the person who said that as dave hall's, the assistant director. one of those with responsibility for checking the weapon. and other crew members within the industry have come forward to real that they had previously raised concerns on different productions about hall's approach to safety issues. concerns have also been raised about the armor-yeah on-site, the person directly responsible that was anna gutierrez. neither she nor the assistant director have publicly commented. baldwin's wife posted on instagram today saying "my heart is with her, her husband, her son, their family, and loved ones." it said there are no words because it is impossible to express the short and heartbreak of such a track foul tragic accident." how on earth that a life round get into a gun that was about to be used on a movie set? who put that live round in the gun and why? shannon. >> shannon: jonathan, thank you for the update. claims being leveled against liberty university about an alleged silence of sexual assault cases. we have correspondent kevin corke taking a look at this. good evening, kevin. >> there are some women at liberty university her accusing administration there have not taking accusations seriously in recent years. in fact, about 50 former students and staffers spoke with propublica and accuse the school of actively dissuading students from reporting sexual assault accusations. according to propublica in the article is very lengthy, liberty told students they could be published for conduct violations after the reported that they were. students were told by school officials according to some that they had violated the school's moral code which is known as the liberty way which includes not doing things like underage drinking or premarital sex and drugs and the like. there were other claims by students saying they were not made aware of the option of reporting it. so they were saying they were dissuaded from involving law enforcement have it all. liberty is denying this and in a statement tonight by the university they say they prefer not to issue public comment on litigation but the university would like to affirm its commitment to take all allegations of sexual assault seriously. and in accordance with the law. one former liberty official, scott lehman of the communications department there who expressed concerns over the university's handling of title ix allegations is now suing the school. >> i am pushing them. let's start talking about these things. and instead it gets shut down. i declined the severance package. say you are never going to silence me. the next day i was called and fired. >> among his other concerns, he has felt like the law firm which was hired to allegedly look into the matters was there to defend the school and not investigate the allegations. we also spoke to a gentleman by the name of daniel who is a senior at the university and founder of justice for -- he told me that group is pushing for an independent audit of all known cases against the school. they deny the allegation and say and another statement of fox news, in the meantime, the for the kinds of booths and groups were part of the community there and that you all were told at some point the glenn youngkin signs had to come down. and essentially the explanation you were given as of the school was trying to preserve its nonprofit status and it didn't want to violate that by in any way appearing to back your particular candidates. your response. >> that's exactly right. we were referred to the school's policy on political expression and told that we were in violation and at risk of endangering the school's tax-exempt status. >> shannon: so we reach out to them for some explanation. they say their guidance on political activity which is long-standing, implemented in a fair and nonpartisan way, is in place to protect the annuities they are a long-time proponent of freedom of expression. and they're just trying to complying with irs code. you have any indication that they treated any other groups different the question mike >> not in the selection to my knowledge. we have had instances in the past where students have had political positions on campus that were permitted. >> shannon: out to play something from president obama who was there. he is going to buy it. what do you say? >> i would say this is a serious issue. doesn't affect everyone in virginia but i am a student. i attend school in virginia, and i would like to have free expression to share my support and educate my fellow students about the candidates running for office appeared to be one of the school says it doesn't want to infringe on individual student or employee expression. is it your sense going forward that for your group, even though you clearly identify yourselves as republicans, you will not be able to support his candidate or any others? why -- >> we were told -- like i can still personally not sent another email to other students. can't give out flyers on campus as a student. the irs has itself clarified that these are laws and regulations don't apply to students, the just the university as a whole. >> shannon: it seems odd that group on campus would be able to speak for the university or that someone on the outside would think or get that was there something lost in the communication over that notice? >> yes. no, we did submit prior to the trip documentation stating that he cannot wear a mask and cannot tolerate a mask. frontier airlines still refused to board him saying that corporate has over say and jurisdiction over a licensed pediatrician and they would not let him on the flight, making us miss our entire flight to boston to receive that care. >> shannon: and they continued to say they didn't get in a timely fashion so they couldn't do this. but you did make it there. you took a different airline. i know they have patrick and the different roles. people still figuring this all out so you were able to get to where your son had an appointment today, correct? >> yes, much later in the evening. around 8:00 p.m. we left on a delta flight. stranded in an airport most of the day because of this and trying to re-accommodate him and dealing with him having a meltdown for several hours because he didn't make the flight and couldn't understand why were not on the flight and it just was a total nightmare and frontier airlines had seo regard for the ada, zero regard for accommodating a disability, forcing a child who has no understanding of a mask mandate to wear a mask and a very condescending and rude about the whole incident. >> shannon: i know that you are part of a lawsuit as well and so we will follow that and just a reminder to all of us traveling these days to check ahead of time for any special requirements because it does a very airline to airline. we wish your family the best with treatment and safe travel back home. business owners and floored it saying the growing homeless population is taking over city sidewalks and scaring away their customers. there may be a crackdown coming but is it legal? >> separate from the business owner's concern, the issue here is that citywide ordinances have been found to be unconstitutional for a number of reasons, not just one, but many different aspects of the constitution are potentially violated by this type of law. >> shannon: the aclu has weighed in on this. sarasota herald tribune quoting them says michael barfield, the president of the aclu of florida said the ordinance is "clearly another effort to attack the homeless and their panhandling in the city." and he said what molly said, has been ruled unconstitutional or ordinances trying to discourage it. joe. >> this issue about the unconstitutionality of such an ordinance is not clear cut. yet the united states, there have been challenges. first amendment, fourth amendment, eighth amendment, due process rights, there's been a mixed bag of rulings in terms of some in favor of upholding the ordinance and some against the ordinance. but at base, we have to have a community that is safe and welcoming and that permits economic vitality of the community. and so those are legitimate public interest that need to be upheld and the courts, when confronted with that against the application of these laws, have upheld the ordinance. >> shannon: here is what the sarasota herald set on this a few days ago. they say do you want -- they'd talk about this. the sand the surface it sounds like a legitimate and well-intentioned aim but there is always a fine line that separates using a tool and a measured way to rectify a problem and wielding in a way that risks creating more dilemmas. is there a way to find a balance? >> not through a law like this pair the eighth amendment prohibits cruel and unusual punishment and impart what it says it is of the government can't criminalize status. and in this situation, if he supposed the mic homeless people to have any will to go, not enough beds in the shelters for example, then this law criminalizes homelessness rather than aggressive panhandling or something other, some other behavior along those lines. so i think maybe the city is better off providing more beds and more resources for the homeless rather than just issuing citations for violations of this type of law. >> shannon: in the meantime, what do you to those businesses who say they are moving?
