we have fox team coverage. north carolina republican congressman will join us to weigh in on this in a few minutes. but we begin tonight with mark meredith, live at the white house. >> good evening, jon. president biden says he's convinced that congress will eventually get around to passing his economic agenda. after a wild week at capitol hill, not even some democrats are convinced it is going to happen. the president went up to the hill on friday to get a chance to convince some of these lawmakers to vote his way. he wants moderates and progressives to make a deal and pass a massive spending bill that would expand the government's safety net programs. progressives are refusing to go along with that effort to also address the infrastructure bill, that is, until they also talk about a lot more money for this safety net program. we asked the president today if and when a final deal can ever be reached. >> do you think by thanksgiving, sir? do you think this could all be done by thanksgiving? >> i think it could be done by 2:27 a.m. on december -- come on. i think it will get done. [inaudible]. -- for giving people the breaks they need. >> house speaker pelosi continues to weigh in. she released a letter today urging her members to reach consensus sooner rather than later, but the speaker is even receiving some criticism from democrats after she chose not to hold a vote on infrastructure this week over fears it wouldn't pass because she couldn't get the progressives on board. arizona democratic senator kristen cinema wrote a statement today saying the failure of the u.s. house to hold a vote on the infrastructure and jobs act is inexcusable and disappointing for communities across our country. some moderate house democrats are warning that the longer this goes on, the longer this is prolonged, this could be a bigger risk that nothing gets accomplished, and it could hurt democrats by next year's midterm elections. republicans starting to chime in. we heard from the senate minority leader mcconnell today who says this unified democratic government must stop putting radical wish lists ahead of basic governance, or they will thrust our nation into even more foreseeable and avoidable crises on their watch. so we now have the republicans weighing in to see what's going on with this democratic disarray on capitol hill. as for that disarray, the president says he's again convinced. he's working the phones this weekend reaching out to lawmakers while he's in wilmington, delaware. next week he will hit the road trying to stump for the massive pending proposals. -- spending proposals. when will congress get its act together? >> jon: we will be watching it, mark meredith thank you. panama's foreign minister issuing a warning to the u.s. about another massive surge of my grants heading for the -- migrants heading for the southern border. it comes after a majority of the haitian migrants were released under the u.s. after camping out under a texas bridge. jeff paul is live on the border with del rio texas with the latest on that. jeff? >> yeah, jon, a fairly quiet day here on the border. we've seen about two different migrant groups cross the rio grand in this one spot in del rio, texas tx, but authorities warn that one of the big large migrant caravans we saw a few weeks ago here in del rio texas could be right around corner arriving anywhere on the southern border within weeks. this video is exclusive to fox news. this is what it looks like across from our location in del rio, texas. a shelter has been set up. it houses about a thousand migrants while they wait to figure out their next move. there was an update that could impact these migrants. secretary of homeland security mayorkas is telling i.c.e. agents to put the emphasis for deportation on those who impose a risk to public safety or national security. meaning someone's immigration status alone isn't enough for them to be detained or expelled back to their home country. but brandon judge says the change will undoubtedly cause issues for authorities along the border. >> the number of people that will draw to our borders illegally is going to be astronomical. again, it ties up our hands. we can't do our jobs effectively because we're too busy dealing with things that we shouldn't be dealing with. >> now, since that huge group of mostly haitian nationals crossed the border a few weeks ago, we haven't seen anything quite like that since. it's mostly been smaller groups of five to six people, and the ones we have spoken with are all from cuba or venezuela. one migrant says she's thankful to have arrived, but it is bittersweet knowing she's left her family behind. >> my heart has pain because they don't have anything like this [inaudible]. nothing. nothing. nothing. nothing. it's hard. it's hard. >> now, the mayor here in deal del rio texas -- in del rio texas says they have information that there could be as many as 20 to 50,000 migrants in mexico who are looking to cross somewhere here along the border. our sources on the ground tells us really at this point it is not a question of if, but when. jon? >> jon: jeff paul on the border in del rio texas, thank you, jeff. meantime, there are new concerns about keeping tabs on afghan evacuees in the united states. hundreds of them reportedly have left military bases prematurely before finishing their resettlement program. lucas tomlinson has the latest on that from washington. >> jon, there are now 53,000 afghan refugees spread out over eight bases in the united states. as you mentioned, some 700 have already decided to leave on their own. the department of homeland security says they are not breaking any laws by doing so. dhs did not refute the reuters story only saying if afghans choose to leave the bases, they are responsible for completing any medical requirements on their own and may forfeit other benefits. afghan refugees were only supposed to be on the bases for days or weeks. now that mission has been extended for months. according to the top general for u.s. forces in north america. >> we're prepeared to be here as long as we need to conduct this mission that's best addressed by dhs, the lead federal agency. we stand ready to support. we'll be ready if we need to support through the winter months and into the spring. >> there are still 14,000 afghan refugees at bases overseas including at ramstein in germany waiting for flights to the u.s. that have been suspended for weeks because of a measles outbreak. now the general says all afghans have been vaccinated for measles and those flights should resume soon. he says 84% of afghan refugees have received the coronavirus vaccine. fox news asked the general why afghans were fully vaccinated against measles but not the coronavirus. he says he has a bigger worry. >> i want to remind that the covid positivity rate is .4%, less than 1%, and so, you know, we haven't had significant challenges. i will tell you that the task force's concern is primarily flu outbreak at this point, and we're working hard to get the flu vaccine as well across all of the afghans. >> last week, a female u.s. army soldier at ft. bliss in texas says she was assaulted by a group of male afghan refugees. two other afghans were arrested in fort mccoy in wisconsin, one for allegedly assaulting a child, the other for assaulting his wife. jon? >> jon: lucas tomlinson in washington, thank you. turning back now to the uncertainty on capitol hill. democrats holding up president biden's economic agenda as they remain divided over multiple spending plans. joining us now, north carolina republican congressman ted bud who is a member of the house financial services committee. congressman, as you know, most of americans are in favor of getting some kind of an infrastructure bill passed. it passed the senate back in august. what happened in the house? >> well, what we're seeing is the socialists are really showing nancy pelosi who is boss. i mean, they are actually right now arguing over how much of the government they want to run americans' lives. this has nothing to do with real infrastructure. what we saw in the failed 1.2 trillion dollars bill, it never even came to a vote, thus making nancy pelosi fail and to keep her promise to the moderates. she didn't even keep her promise to them. so i mean, this is just total disarray. i was talking with democrats in the elevator yesterday in washington, and they were ashen. they were stunned at joe biden coming in there and tanking their own bill. this has nothing to do with real infrastructure, but it's simply a trojan horse to get them to the 3.5 trillion, and now they can't even come to grips on what order they want to do that in. >> jon: as i said in the introduction, i mean, americans want their roads fixed. they want new bridges. they want new water projects. why can that not come out of the democrats on capitol hill? >> i mean all americans -- i wouldn't say all but most americans really want true roads and bridges and add to that, jon, rural broad band especially when so many had to work from home during covid, but this is not real infrastructure. this is only 10% of the 1.2 trillion, about 110 billion dollars in real roads and bridges, and this is 1.2 trillion, so why call it infrastructure when 90% of it is not actual roads and bridges? >> jon: the president has taken some heat directed at these spending bills. here's what he had to say. i want you to listen to it, and then i will get your reaction on the other side. here's president biden. >> there's nothing in in any of these pieces of legislation that's radical, that's unreasonable, when you look at it individually. the problem is, you know, one of the reasons why people said well, i heard on television, why wasn't biden going around the country selling this? well, for a few little things, like we had hurricanes and floods, and we had little things like -- anyway, a lot was going on. a lot was going on. so i'm going to try to sell what i think the people -- the american people [inaudible]. i'm convinced -- >> [inaudible]. >> look, you asked me if i'm confident. okay? am i unyielding? do i submit that i'm going to do this? come on. i believe i can get this done. >> jon: there is nothing in these pieces of legislation that's radical, that is unreasonable. that's how he started that particular clip. your response, congressman? >> look, that's absolutely not true. essentially the 1.2 trillion dollars is a trojan horse to get to the 3.5. but they just can't agree on which one they want to go first. they are afraid if the 1.2 trillion goes first that the socialist progressives won't get their vote on the 3.5 trillion. if they do the 3.5 trillion first, the moderates are afraid that they won't get to the 1.2 trillion, but essentially the democrats want both of them, which is over 5 trillion, and if you take out the tax gimmicks, you're well over 6 trillion dollars. so this is socialist spending. i mean, you have to realize if you're spending money that you don't have, and you're going to tax the generation that's not even here yet, and you're going to take away rights of people, then, absolutely that is socialism, and joe biden is fully on board, even to the point of tanking the 1.2 trillion dollars bill yesterday so he could get to the 3.5 trillion dollars more quickly, bernie sanders level of spending. >> jon: the senator of arizona is one of those who is not in favor of that bigger bill. here's what she had to say after speaker pelosi cancelled the house vote on the 1.2 trillion dollars bill. she says over the course of this year, democratic leaders have made conflicting promises that could not all be kept and have at times pretended that differences of opinion within our own party did not exist. even when those disagreements were repeatedly made clear, directly and publicly. cancelling the infrastructure vote further erodes that trust. what do you say to senator sinema? >> look, i think there's a real division within the democrat party, but when you see what they're doing, we don't want them to succeed because we think it weakens america, and when america is strong, the world is a better place. so this is not good for our country what either one of them are trying to do. yes, back to your earlier question, jon, we do want real infrastructure. we want roads. we want bridges. we want broad band, but this is not that. this is just a trojan horse to get us more socialist. >> jon: i want to put on screen quickly some of the elements of that 3.5 trillion dollars spending bill. 5 billion electric cars for the government, 3 billion in tree planting and tree equity programs, a billion for electric vehicle charging equity program, and then you can see the rest, leken troic voting for -- electronic voting for union, community climate incentive grants, and 15 million in resource centers for older people with gender identity issues. congressman, i wish we could talk more, but we're going to have to say good-bye. north carolina republican congressman ted bud, thank you for being with us. >> thank you. >> jon: the search for fugitive brian laundrie keeps hitting dead ends. dog the bounty hunter's search at a campground has come up empty so far. this is shifting to cassie laundrie on the last time she saw her brother brian. a person of interest in the case. charles watson has more. >> as the search for brian laundrie continues, protesters have made it their business to show up outside of the laundrie family home on a daily basis demanding the family speak up. >> doesn't hurt to come out of the house and answer them? [inaudible]. >> -- returned home from his cross-country trip without petito. the trip coincides with documents obtained by fox news that show the laundries checked into the de soto park campground on september 6th, before checking out two days after -- two days later on the 8th. the laundrie family attorney confirms brian's sister cassandra laundrie also joined in on the september 6th family trip, seemingly contradicting her claim to abc news last month that she hadn't seen brian since he returned on september 1st. in a statement, the family's attorney tells fox news, quote, law enforcement agencies are well aware of these dates. any prior communication by cassie that does not reflect these dates is simply a difference of relating an answer to a question misinterpreted by cassie or poorly posed by the enquirer. this morning the son of famed investigator said he thinks the family has been less than forthcoming about their contact with brian. listen. >> i think it's just another excuse. they got caught in a lie. i hope she's telling the truth. you know, i hope she's working with law enforcement as she's saying she is. but with this discrepancy in the timeline, it is not adding up to great stuff. >> now, dog the bounty hunter who is also joined in on the hunt for brian, says he was tipped off to the laundrie family's camping trip. he and a private team have since searched islands close to the de soto park and have come up with nothing. meantime, the latest body cam footage by the moab police department in utah shows an emotional petito speaking with police, during a suspected domestic incident weeks before her disappearance, despite multiple reports to 911 of a violent dispute between gabby and brian, no arrests were made. >> in no way, shape, or form that i can perceive that what happened here, a little slap fight between fiances who love each other and want to be together, can i perceive that this is going to digress into a situation where he's going to be a battered man? >> jon, republicans have not won a statewide race in virginia since 09 with a lot of hot-button issues at play, this battle for virginia governor has become a campaign case study of sorts for national voter sentiment ahead of the midterms. this afternoon, the virginia family's first rally kicked off to voice concern over what attendees see as divisive educational programs. >> i wish terry has been as honest when he was running against me eight years ago as he was this week in how he feels about is turn your children over to us. >> what he's speaking is a statement made by former governor terry mcauliffe who is trying to win back his seat. he said this during the last gubernatorial debate. >> i'm not going to let parents come into schools and make their own decisions. i don't think parents should be telling schools what they should teach. >> here's mcauliffe's opponent on special report. >> parents want their children to receive a great education, and they want to be involved in it. and what we've heard from terry mcauliffe is he doesn't want them involved in it. >> education secretary cardona weighed in on the topic too first saying that parents had an important but not primary role in their kids' teaching but later shared a change in perspective. >> parents are the child's first and most influential teacher, and any educational program worth having keeps parents and their voice at the center of the conversation. that's clear. >> back in virginia, mcauliffe does still hold a slight lead. doug inhofe joined mcauliffe on the campaign trail this morning. mcauliffe has been focused on trying to [inaudible] to former president trump. a tactic democrats nationwide are eyeing up to see if it works. jon? >> jon: that's white house press secretary jen psaki ripping republicans for only pointing out the problems at the border claiming they are not offering any solutions. this despite critics who accuse the president of creating the chaos at the border in the first place and the disaster could become more dire in the coming days as panama warns the u.s. tens of thousands more migrants are making their way here. the crisis causing the president's approval rating to slip with voters, as a new poll shows most americans do not approve of the way he is handling the situation. now some states are taking matters into their own hands. joining us now jonathan turley, constitutional law expert, law professor, and a fox news contributor. good to have you on this evening. thank you. >> thank you, jon. >> jon: what is the federal government's responsibility when it comes to the border? >> there's a great number of responsibilities. the question is whether you can force them to shoulder those responsibilities. you know, courts protect us from a lot of things. they don't protect us from bad policies or even bad presidents. they look at whether a president can do, what they have decided to do, and at the border's a president's authority is at its apex. courts really defer to them to a degree that you don't see in the interior of the country. so president biden can be fairly loose or stringent as he sees fit with border controls, and the states along the borders will bear the costs of that. >> jon: as you know, states like texas have tried to build their own border walls, for instance, and tried to restrict the number of immigrants illegally walking into this country. they've asked for help from other states. is that constitutional? is it legal? >> well, it's tricky. they can build walls on non-federal land inside of the border, by any degree to which they interfere with the federal immigration policies will end up in court. the federal government has a really dominant role along the border, and courts will defer to it, but can states create their own walls on private property or state property? yes, i think they can. but the federal government is going to be looking very carefully as to any degree to which that interferes with their policies. the biden administration is openly hostile to this idea of the states closing off the borders with internal fences. >> jon: so you say the courts generally will let the administration do as it will on matters like border policy, so if republicans say in the united states senate or the congress, or, you know, the house were to file a lawsuit and say, you know, federal court, we want you to force joe biden to enforce immigration laws. you don't think a court would take up a lawsuit like that? >> well, it would take it up, but i'm not too sure it would end as these members would want. you know, we've seen presidents, like president obama declare that he will not enforce certain immigration laws. that was certainly the case with the dreamers. he basically told the agencies not to deport whole classes of individuals. the courts largely supported that. what's ironic is that for the last four years, democrats have been in court challenging the right of president trump to use that discretionary authority. they're now in the opposite position, where they're claiming that inherent authority on behalf of president biden. >> jon: brandon judd represents the border patrol officers in this country. he had this to say regarding the secretary homeland security mayorkas and his border policies. listen. >> when secretary mayorkas talks about new enforcement priorities, all he's doing is announcing to the world that our borders are in fact open. -- that policy's going to be challenged. it is going to be overturned. but in the meantime, the damage it is going to cause, the number of people that's going to draw to our borders illegally is going to be astronomical. >> jon: he said he is implementing amnesty through policy. is that accurate? >> i think critics have raised that point. there are numbers that support this concept of an open border. you know, take the haitian influx that just occurred, the vast majority of those people were in fact allowed into the united states, so they did in fact succeed. that is going to draw more immigrants to the border, right? it is common sense. there's only a couple of thousand that we know of that were flown back to haiti. you know, these individuals were very desperate, and, you know, we can all have a great deal of empathy for them, but they're rational actors, they can see that the vast majority of that group did indeed make it into the united states. >> jon: you have an interesting column in the hill today regarding president biden's pronouncements regarding the mounted border patrol agents who went after apparently some haitian immigrants. the pictures that came out of that looked sort of scary and maybe inhumane to some people. president biden said these people, meaning the border patrol agents, will pay. you take that one on in your column. give us your assessment. >> well, i was really astonished by the president's comments. they were entirely inappropriate, and they shattered his own investigation within the executive branch and also shattered the reputation of these agents. you know, these agents had just been put under investigation, and what we now know is they did not whip these migrants, at that water's edge. even a couple of news organizations have now corrected their story. there was a use of still photos, instead of the videotape that made it look like they were whipping migrants. these agents could sue for defamation or what's called false light. you have members of congress calling them white supremacists whipping migrants. the rhetoric was really off the charts. and so what are we going to do now? we have an investigation where the president has already said they will be punished. the president said that they scrapped these individuals, which is not true. in the past presidents have followed this cautious line not to talk about the ultimate responsibility of matters under investigation. in the military this is called command influence when a superior officer basically says what he thinks the conclusion should be, and it is sort of like the red queen of alice in wonderland, that you get a sentence first and a verdict afterwards. >> jon: meantime, you know, the administration has been sending back or promising to send back thousands of haitian immigrants who are black while allowing other immigrants who come from other places to stay. is there any constitutional or legal justification for that? >> no. i have no tell you, i see no intelligent design in any of this. it is a mystery to me how they are differentiating between undocumented immigrants. some are being flown back. others are allowed in. some are given court dates. others are just told to show up and report themselves. it's an utter mess. in that type of chaos is when you have a great influx. you know, these people who are making a lot of money smuggling individuals view this as a bonanza because when they seek chaos, they see opportunity. these people are making millions and millions of dollars off the suffering of thousands of people. >> jon: it is all so sad. jonathan turley, professor turley, thank you very much. >> thank you, jon. >> jon: a 16-year-old girl fighting for her life after she was shot in the head with a stray bullet in new york city yesterday. it's the latest in a series of recent shootings of young people in the city days after mayor bill de blasio unveiled a plan to have the nypd turn its focus to, quote, customer service. david lee miller live in our newsroom with that. david? >> jon, so far no arrests in the shooting of the 16-year-old teen who was in a brooklyn park talking with a friend when gunshots rang out. she was on the ground with a bullet wound to the head. only hours later, a 16-year-old boy in brooklyn was struck in the leg after he got into an argument at a brooklyn park. the gunman is still being sought. according to data compiled by the new york post, so far this year street violence has claimed the lives of 21 kids, triple the number of fatalities compared the last two years. the spike in crime affects new yorkers of all ages. police released a video of a brooklyn gunman who they say fired repeatedly striking a 21-year-old man in the shoulder. the shooter still on the loose. year to date the number of shooting victims in new york increased slightly, but yesterday, that's year to date, but yesterday was especially violent. eight people city wide were shot compared to two on the very same day a year ago. this week mayor de blasio took heat for calling on the police department to improve what he calls customer service. his plan calls for greeters to meet members of the public when they arrive at a local precinct. the department says improving community relations and fighting violent crime are not mutually exclusive. meanwhile, a criminal justice professor and former nypd detective says the city reinstate proven crime fighting tools in order to halt the bloodshed. >> one initiative that could bring crime down is bringing back plainclothes officers. by bringing back plainclothes officers, they have the ability to infiltrate a lot of the gangs and a lot of these gun dealers and traders. >> crime is up. city hall says so too are gun arrests, increased more than 30% compared the last two years. this fall new yorkers are going to elect a new mayor. the two leading contenders are a former cop democratic adams and guardian angels founder a republican, crime fighting is a priority for both campaigns. one thing they both agree on is there are too many guns on the street. back to you. >> jon: david lee miller, thank you. coming up the battle over school covid rules heats up with one state set to require that all students get the vaccine. - [female narrator] they line up by the thousands. each one with a story that breaks your heart. like ravette... every step, brought her pain. their only hope: mercy ships. the largest floating civilian hospital in the world. bringing free surgeries to people who have no other hope. $19 a month will help provide urgently needed surgery for so many still suffering. so don't wait, call the number on your screen. or donate at mercyships.org. >> jon: arizona's supreme court is wading into the controversy on school mask mandates. the state's highest court agreeing to hear oral arguments about the matter next month. it comes after a lower court ruled unconstitutional arizona's ban on any law that would make people wear masks. that judge mostly taking issue with how the measure was passed. the ruling by the lower court frees public school leaders across arizona to require masks on campus, at least for now. california governor newsom announcing his state will be the first in the nation to mandate that all schoolchildren be vaccinated for covid-19, eventually impacting more than 6 1/2 million public and private school students. christina coleman is live in our los angeles bureau with more on that. christina?
