what they say about when brian got back and what he and his dad were doing in the driveway with one of the vehicles. meanwhile, we're learning more from gabby's friends. this is her friend, rose davis, talking about what was going on recently with the couple. >> i do believe their relationship was getting problematic. seemed like there were more and more arguments. everything she did i feel like, you know, he thought was wrong. >> martha: we're all over the story. begin at the search site with phil keating. hi, phil. >> hi, martha. may be on the calendar the first day of autumn but here in florida's back country, it's still very hot and very humid. the search continues with about 60 law enforcement representatives including dive teams, side sonar equipment and cadaver dogs. all combing through thousands of acres behind me in the carlton reserve. through it all, not a sign of the 23-year-old person of interest, brian laundrie wanted for questioning in the confirmed death of his fiance, gabby petito. no evidence of laundrie has turned up. searchers are using atvs and high water vehicles. plenty of alligators, snakes and mosquitos. laundrie's parents said their son went for a hike last tuesday. here's the search commander today. >> these guys are law enforcement partners. they're motivated and hungry to find brian laundrie. they're ambitious to partner with us. >> the teton county wyoming coroner that the body found sunday is petito. the cause of death, homicide. what type of homicide, method of death is yet to be determined. she and laundrie were on across-country road trip visiting the country's national parks. and moab police questioned the couple after someone dialed 911 to report a guy was slapping a girl in the face. somebody that gabby petito denied happening. she said her fiance pushed or grabbed her face. monday, the fbi executed a search warrant and taking out boxes of evidence like computers, hard drives, cells phone, anything that would have a history of e-mails texts, any kind of communications that could endanger the parents of laundrie and to perhaps being implicated criminally but also as to whereabouts of brian laundrie himself. when their son returned three weeks ago, he returned with the white van that they left with without petito and he's not spoke to them since. >> martha: thanks, phil. phil keating outside of the reserve where they're searching for brian laundrie. charlene and william guthrie love across the street from the laundrie home where brian and gabby were living before they went on this trip. thanks nor being here. i know you moved there at the beginning of the summer and literally across the street. when did you observe when brian returned from the trip and you saw the white van that had belonged to gabby in the driveway. >> didn't know it was gabby. we didn't -- just assumed it was his van. we just thought they had come back from wherever. we didn't know they were on a trip. we assumed they went back to their house or wherever they got a house, wherever they were. we didn't know much about them at all. nothing at all, actually. and they just came back home. we thought she was in the house with the parents or mother or whatever. that was pretty much it. >> martha: so after that, the fbi came and took that van away. you saw brian and his dad working on one of their campers in the driveway? charlene, can you tell me about that? >> i didn't i my husband saw that. >> martha: so what did you see in the driveway? >> i was doing some work in the front yard. you know, i noticed that they got a new camper for the back of the pickup. i didn't think anything unusual. they got a new camper. so they wanted to put their own touch inside of it. i saw them doing some work. and then when they prepared for their trip, i saw them loading the camper. >> martha: you're talking about brian and his parents after he returned home. is that correct? in a different camper? >> yes. the van is the -- is his. his father has a pickup truck which they purchased an in-bed camper. >> martha: like an attachment camper. then you say they packed up the camper, brian and his mom and dad and they went camping. do you know that for sure? >> we saw them -- i saw them loading it up. so i assumed that they were preparing for a camping trip with their new camper. >> they were going for the weekend. >> martha: how long after he got back alone in the white van, how long after that was this, when you saw them working on this other camper and getting ready to go away together? >> yeah. i can't remember, you know, the dates. >> 1 1/2 weeks. >> yeah, probably 1 week, 1 1/2 weeks. i agree. >> martha: did the police talk to you about what you saw? you saw the parents and brian working on the new camper and leaving for a few days. did they ask you about that? >> i believe that we did give them that information. >> we did tell them that they had gone on a camping trip for three days for the weekend. >> martha: did you think there was anything unusual about that? >> well, to me -- >> after we knew they were missing, yeah. after gabby was missing. when they came to our house saturday night a week ago and told us they were working a missing person's case. yeah. >> also, which struck me as odd, i spoke to my wife about, that the parents going on a trip, i can see that. taking their 23-year-old son in a small camper that is on the back of the truck struck us as odd. >> martha: okay. very interesting. thank you both for being with us. charlene and william guthrie observing this. i'm sure it's shocking from across the street of the laundrie home. >> a nightmare. >> martha: i can imagine. thank you both very much for being here. >> you're welcome. >> martha: thank you. joining me now, judge jeanine pirro. a former district attorney, years of experience investigating and prosecutoring crimes and really specializing in domestic abuse cases. anything jump out at you from what they're talking about? >> yeah. the last thing they said, they thought it was unusual that a 23-year-old boy would go camping with his parents. they didn't know if it was camping, but they went away in a camper connected to a pickup trump. my mind spinning started saying where were they going, casing something out, looking for something together? the parents have said nothing. he came home alone without gabby. gabby was living with those parents. they all knew that something was off. then they take this trip a week to ten days later according to the guthries, the neighbors. why are they taking this trip? what are they looking at? what are they assessing? how is it the parents know that once brian goes with his own camper to that area where he usually hikes that they know where to go to pick up his van? it may be that he left it there many times before. they knew when to go when they were looking for him. what i also thought was unusual when brian laundrie's sister spoke to one of the networks and said i'm sure it's all just a misunderstanding. that word sent me to a tizzie. that is a week ago. like she understands that there was something going on that caused him to come home without her. that family has information. they know what is going on. they got counsel right away. so as we now look for the body, for the person of brian, he's got a choice to make. is he on the run because sooner or later we're going to find him, or has he -- >> martha: you think he's still alive? >> that's the or. has he done something to himself. does he know he will be prosecutored and convicted and this is the kind of case, a domestic violence case from the time that they were stopped in moab utah. i have my own feelings about the police handled that. we can talk about it another time. most states have mandatory arrest policies in domestic violence cases. the truth is that is he going to off himself or get away with it and hide. is that what they tried to assess on the weekend, where he could go, are they throwing him off with finding his van near the place where he hiked. a lot of unknowns. i don't think he's alive. >> martha: you don't? >> no. >> martha: based on? >> instinct. you say to yourself, this is a selfish dude and he would do anything to take care of himself. i don't think he's that smart. if he were in where in that area where they're use cadaver dogs and dive teams, they know something we don't know. so the fact that the fbi is covering all of these bases tells me that maybe they have a hunch as well. >> martha: yeah, i want to play this from gabby petito's father, joe. i keep thinking about how this white vehicle and we saw the picture with her flip-flop on the back of it parked where here body was found. that van was at this home for ten days at least. who knows what was going on in that van and what kind of evidence might have existed in there. gabby's father is asking the same questions. watch this. >> came home without her. then you had the van for ten days in your driveway. now what happened with the van? did you clean it? did your parents help you clean it? did they help cover up a crime after the fact? i want to know. i have these questions. >> yeah, clearly there would be an effort, if there were evidence of a crime and the question comes, can the parents be charged are they aiding an abetting. are they lying. did they lie to the feds, accessory z after the fact. there's obstruction of justice. all kinds of issues that we can deal with. >> before i let you go, the most frustrating thing, why they won't able to surveil him and watch him. i remember we watched scott peterson go everywhere. went to the grocery store, cameras on him, a police car a far distance away. why is it not the case at this house as well? >> i was in a county with 43 police departments. if there was a case with too much for us, there's mutual assistance. other departments help especially in a case like this. there's no excuse for not watching that individuals. he lawyers up immediately, comes home without her. >> martha: refusing to talk. >> how much do we have to go through. >> martha: one of the police officers on september 16 was asked, do you know where he is? >> tech: that's service you can trust, when you need it most. ♪ pop rock music ♪ >> singers: ♪ safelite repair, safelite replace. ♪ >> martha: now to the border. the white house says it's standard procedure for some migrants to be released in the united states after reports that thousands camped out in del rio, texas, are being released on a "very, very large scale" according to people that are watching what is actually happening on the ground there. offering this update on the border patrol agents on horseback who are trying to push them back towards the border. >> i would reiterate there's an investigation that will be completed by next week, which the secretary confirmed that will determine the next steps on policy and personnel. all important questions people are asking. in the interim, those people were placed on administrative leave and not interacting with migrants. >> martha: fascinating. let's bring in brandon judd from the border patrol council who has e-mail documentation of his warnings about what was going to happen, that he was sent to the biden administration and we'll get to that in just a moment. he sent those in june. brandon, good to see you today. obviously you're right there on the scene, watching this as it plays out. with regard to these men on horseback, law enforcement, texas law enforcement on horseback and pushing people back from the border, this is what the vice president, kamala harris, had to say about her thoughts when she was asked about the situation. this is what she pointed to. >> what i saw depicted about those individuals on horseback treating human beings the way they were is horrible. and i fully support what is happening right now, which is a thorough investigation. human beings should never be treated that way. i'm deeply troubled about it. >> martha: your reaction to that, brandon. >> she's already made up her mind without a thorough investigation. we welcome this investigation. we know that once this is all said and done, it's going to come out that these agents acted absolutely appropriately. acted under the training and protocols that they had been given. the same training and protocols that new horse patrol agents are getting under the biden administration. so again, they've already jumped to conclusions and deflect. >> martha: can you explain how they're trained? >> absolutely, a number of things we do. they're split reins. they're not a loop rein which you'll see. they're split reins so we can make immediate reactions. the reins are a little longer so that the horse can take the proper cues. we will twirl the reins to keep people away from the horses for their own protection. those horses can step on people. they can kick people causing injuries. we will twirl the reins to keep people away. the images that you're seeing, there's a still shot if you look from the back of the main image that everybody is using, it clearly shows that the agent wasn't even holding the reins in the supposed picture in which he hit that person. none of our agents strike people with those reins. it doesn't happen and it didn't happen in this case, which is why i welcome this investigation. these agents will be exonerated. >> martha: what do you think about the job that kamala harris has done in terms of addressing this whole issue and the root causes? i can't help but think has she been on the phone with the president of haiti, talking to them in columbia about this group, which you warned them months ago was on their way? what has she been doing to prevent this situation from happening in the first place? >> i'm not trying to be snide, but i would ask what job has she been doing. she's not done anything as far as we can see. in eight months under this administration, the only thing they have done is torn down all of the programs and policies in place that kept the border secure. they have not implemented any new programs, new any policies, any new operations that are helping border patrol agents like myself secure the border, this isn't happening. this administration is a dumpster fire when it comes to border security. >> martha: so you sent some e-mails. here's one june 1. we suggest sending agents to the field in del rio with tablets to start the intake process when a large group crosses the river instead of letting the group sit there while space is cleared in the station. the response from the national border patrol council, the federal agency here, was came 16 days later and it just says "this is being explored and several other platforms are being considered that are more efficient" what did you think of that? >> again, if this is efficiency, the federal government is broken. this is anything but efficient. they didn't take any of the suggestions that my vice president that sent that e-mail. they didn't take any of the suggestions that is status quo. any suggestions that are good suggestions that will help protect the american public, they just don't take them. they're pandering to their open border base. that is making the american public a lot less secure. it's frustrating and disappointing to the agents especially when this administration is attacking their own agents solely to deflect from their failure. >> martha: the border patrol is outmanned 200 to 1 on the border right now. the images you're seeing are not at the border. they're in texas. those thousands of people under the bridge are in texas. it's very inhumane. they're in squalor conditions. this is a huge problem and something like 25,000 more that are massing to come this way. we point everybody to your editorial piece that you wrote on foxnews.com. an interesting background. >> thanks, martha. >> martha: we're waiting for results because we know the forensic testing continues that would determine the manner of death. we know it was a homicide. was it blunt force trauma, a gunshot wouldn't? >> my understanding from what i have seen in the videos is that there was no attempt to bury the body or to conceal the body. >> martha: what does that tell you? >> that doesn't tell me anything in particular except that the person doing it may have been in a frenzy and didn't know what to do. the death occurred, whether he meant to kill her or not is hard to explain till you get to interview him. one of the things that did a lot of dna swapping of the clothing and him. the boyfriend's dna will be on that because they were together. but if per chance that they found the dna of a third person, then there would be an issue whether or not -- >> martha: on her clothing. >> her clothing. then -- or the rape kit that they did, that would be a different story. the way the boyfriend reacted and the family of the boyfriend reacted, doesn't look good for the boyfriend. >> martha: what about the time frame? when would you expect the final report? >> i would think that they might to wait two weeks until they got in the toxicology and got in microscopic slides, all of which won't affect the manner of death being homicide. it's not an accidents, it's not a suicide, it's not a natural cause of death. all things had to be considered in doing the autopsy. they're just straightforward with a homicide, whether it's a murder or not is up to the district attorney. self-defense -- >> martha: if it was a strangulation, the amount of time her body was out there, would they see his fingerprints and his dna on her neck? >> we have not seen before such a rapid migration, regular migration of individuals as we have observed and experienced with respect to the haitians. >> martha, even after visiting the border and seeing things close, mayorkas testified that he does not believe the border is any less secure than it was under the previous administration. martha? >> martha: aishah, thanks very much. let's bring in the one that you just heard of, the top republican, texas congressman, michael mccaul. thanks for being here. >> thanks, martha. >> martha: it's very difficult to understand when you're running dhs and they have people that they're putting on buses and vehicles. they're taking them to other towns. they have taken them to tucson and other places to be processed. they put people on planes. are you telling me the united states government is not counting how many people are on those vehicles? >> it's chaos at the border. so mismanaged right now. the secretary of homeland security couldn't tell us how many haitians they're letting in under this fear of political asylum case versus how many were being deported. we were told that airplanes are leaving by the hour deporting them to haiti. we heard something different today. overall, this is a guy that said it's unsustainable and losing in his own words. when i asked him about the migrant protection protocols that the united states supreme court has mandated that this administration put back in to place -- remember, this is what has caused this whole migration phenomena according to the secretary, the worst in 21 years, to happen in the first place. when i talked to border patrol down there, they say because biden rescinded the remain in mexico policy under the trump administration and the asylum agreements for central america had a direct cause and effect. now you have the highest court in the land mandating this administration put that back in place. he answered my question that he would follow those orders. let's see what really happens. i doubt very seriously that mexico will enter back into that agreement. we have no leverage over them at this point. >> martha: i was watching last night, tucker carlson was asking why doesn't president biden get on the phone and call the president of mexico and work this out. right? work out something. i don't understand when you become -- when you take over a new administration when you don't look at the policies in play and say all right. we have different ideas about this but this worked right now. so let's work on some immigration reform and see how we can improve it. let's not remove it until we know what the ramifications will be. i know you're concerned about the people that are penetrating the border and who may be coming from other countries, other international -- terrorists organizations. tell me about that before we let you go. >> yeah, the thing is, because it had trump's name on it, they just threw it off the desk and rescinded it. it was a policy working. we had the border under control. now it's out of control and he owns it. >> martha: it's no more humane when you look at the situation that these people are living. a very tough argument to make. thank you so much. great to have you here today, congressman. >> thank you, martha. >> martha: so john walsh knows quite a bit about america's most wanted. one of them is out there right now as the man hunt for brian laundrie intensifies this afternoon. where is he?
