and average per day up from 313 per day from laszlo, 4200 children in custody, 2943 held beyond the 72 hour limit placed on border patrol. homeland security says the us could soon reach the highest number of people apprehended at the border in 28 years. immigration lawyers say the migrants are sending their children over the border alone so they won't be sent back. democrats are blaming donald trump for the overwhelming surge of the border, hit his successor, president joe biden are speaking out tonight, the biden administration still refuses to call what is happening a crisis. >> people are coming in by the hundreds of thousands, young children are coming in and they believe -- they think it is going to be so wonderful and our country can't handle it. it is a crisis like we have rarely had and certainly we've never had on the border but is going to get much worse. shannon: welcome to fox news at night. white house correspondent kevin cork is tracking what donald trump and president biden are saying about the border tonight. >> from the sharp rising gas prices to encouraging all-americans to take the covid 19 vaccine if you can, donald trump had plenty to say about the state of the country and most notably about the job joe biden is doing and while he said he wasn't quite sure if or when he might announce another run for perhaps office in the future he certainly didn't have any shyness about talking about the things he is seeing happening on the border with respect to illegal crossings. >> they are coming in from everywhere, they are dropping them off and pouring into our country, it is a disgrace. >> donald from holding nothing back in his assessment of the devastating crisis on the southern border with illegal migration exploding on mister biden's watch and he says because of his lax policies. >> my policies were working better than they have ever seen on the southern border, the wall was almost complete, they should finish it but they are destroying our country. >> the pointed comments part of a wide-ranging conversation with maria bartiroma on fox news primetime and coming amid reports that there are boards of 13,000 illegal migrant minors in us custody among the border, a problem the former president says he's successor is responsible for but biden is pushing back on the idea that he has thrown down the welcome mat for illegal migration. >> the idea that joe biden said come, i heard the other day they are coming because they know i am a nice guy. here's the deal. they are not. >> do you have to say don't clear? >> i can say don't come. >> a message of don't come but policies that won't turn them away if they do. thousands of migrants now being released into the interior of the country with no family matched dna test, no covid-19 test and no guarantees they will show up for court dates once process in contrary to the border wall and remain in mexico policy. the former president also took a bit of a victory lap his administration's operation work speed which delivered multiple vaccines in record time and he encouraged all-americans to get the shot as soon as possible. >> we get the vaccine done in 9 months instead of 5 years. that's normally going to save our country, it will save the world. i would recommend it and i would recommend it to a lot of people that don't want to get it. >> is for the possible 2024 white house run he was more cautious as i mentioned earlier, he said an excellent chance of flipping the house and senate and said he would like to see how that plays out before he makes any public announcement about his intentions so he did acknowledge he has plenty of support among gop voters and that should point out very quickly, march 20 fifth is when we will finally get a news conference from mister biden. shannon: you will cover it for us that night. thank you. california governor gavin newsom bracing for a recall election on the eve of the deadline for the required 1.5 million signatures. jonathan hunt tells us where things stand, he's live in the west coast newsroom in la. >> reporter: after months of saying nothing about the recall effort gavin newsom is suddenly saying a whole lot. >> we will fight it, we will defeated, we are ready to go. >> as he toured is in to be reopen schooling going on national networks to push his claim that the recall is driven by right-wing extremists. >> you have people that are part of the coalition that started this petition that are avid proud boy members, part of the 3%, the right-wing group, they are supporters of qand on conspiracy thirst, way to premises groups, that is factual. >> newsom was push during an interview on whether he believes all of the 2 million california to have reportedly signed the petition are extremists. the governor sites that question. the fact is we don't know, neither does gavin newsom with the political affiliation of those are back the recall but one of them movement's most outspoken leaders claims he does know and he told us tonight around the third of those who signed are either democrats or decline to state a party. >> it is about people and people have -- to stay on the ballot. >> the recall effort has been backed by some progressive such as an actress pairing, host of the interests show. >> a failure in the state. >> in several silicon valley tech moguls also support the recall. among, billionaire part owner of the golden state warriors and one of the founders of paypal. the recall signature is scheduled to be delivered to officials by tomorrow. each of them will be verified or disqualified in the final numbers reported to the california secretary of state, under 1.5 million of the reported 2 million signatures have to be accepted for a recall vote to go ahead. if it does it is likely to come in october or november. shannon: thank you for the update. president biden says new york governor andrew cuomo should resign if the investigation finds the state attorney general confirms the growing sexual harassment allegations made against him. alex hogan has the latest from new york city. >> reporter: governor andrew cuomo is accused of sexual harassment, inappropriate behavior and a hostile work environment. a leaked conversation given a look into how lawmakers are handling the scandal. >> reporter: the governor hot topic of conversation among assembly democrats. the audio obtained showing varying opinions on how to move forward. in a heated debate a majority of democrats say they want the governor to go but don't think he will. one can allegedly arguing we have a moral duty, a constitutional duty to remove him if he did not resign was members anchored, carl hastings said whoever did that is a coward. last week casey approved the start of an impeachment investigation, something republican chairman nick layingwere the calls hollow rhetoric. >> the attorney general report which we don't have time right now. >> reporter: earnings reports, new york state majority leader says she believes, not noting if there are enough votes to impeach. in the report by the new york times finding days after the first accusations by lindsay boylein began circulating an open letter attacking her credibility, the goal allegedly to have former aides, especially women, sign it. the president weighing in tonight in an interview with abc saying if these claims turn out to be true cuomo should reside and would probably end of being prosecuted. shannon: the washington post under scrutiny over a correction the paper had to issue for using a single on a the source who claims donald trump in a december call with a top investigator for the georgia secretary of state told her to, quote, find the fraud. >> one thing i will say the washington post due to correction. a lot of pressure was put on the but they did a correction because they realize what they did was wrong so now you have to find out was at the washington post's fault or the people that run the elections in georgia? >> let's get reaction to the interview tonight, and the washington post correction with fox news contributors guy benson and roy murdoch. good to have you with us. the washington post, misreporting the words of the highest elected official in the land is a serious lapse and one that in this case seems so unnecessary. when it comes to phone calls the only good sources are the ones who are dialed in. >> i would like to focus on the consequences of the story, not some little random ever. this is fake news that wound out as part of the second impeachment trial, serious stuff. the question of consequences is will anything happen to the writer who wrote the story, the editors who approved it? will these people be fired? suspended without pay? will they pay any price for this or just go on and continue as if nothing happened? so often in these egregious errors occur nobody pays any price and that is why this thing keeps coming up and we see more examples of this every day or every other day. shannon: the federalist says similar errors cost a great deal of trouble for donald trump and they can't discern any consequences, 5 other totally bogus stories designed to her trump the media got away with, the wikileaks email, michael flynn's russian relationship, us intel agencies, scaramucci and the direct investment fund and directions to live. it doesn't seem to be an isolated incident and they all seem to, these errors or anonymous stories, seem to fall in one direction. >> that is a key piece of this because if it was evenly distributed with story that made big mistakes in favor of donald trump and big mistakes against him that would be one thing, people make errors, we are all human and journalism isn't perfect but when you see the sort of zeal among almost all the press corps who hated the former president, corners were cut of the goal was to help take him down and there was a huge appetite for that, a huge incentive among the press corps especially the elite press corps to taken down a peg and that is why you see the direction of almost all the mistakes, dominoes falling, the cascade in one direction so this is the latest one, black eye for the washington post and the many other news organizations who ran the exact same falsified quote saying they had independently corroborated his i guess from the same source, now we have the source material, here, corrections, eye-opener. shannon: when you look at this, the former president raising claims this could have impacted this georgia senate race because of the suggestion he was doing something inappropriate or georgia didn't have things under control and other ripple effects what happened there and the new york post, a store that had hunter biden silenced by big tech leading into the election. how stories are drafted, what stores are promoted, which are suppressed, it does have a big impact on elections essentially. >> it has a huge impact and a great contrast, the fake story was pumped up and the actual ballot story that there's a federal investigation of hunter biden, that story was squelched, the new york post, the oldest newspaper in america had its order page unplugged for 15 or 16 days at the height of the political campaign, the time voters want to get in should get information to make the decisions. so that contrast is quite dramatic and very telling and very unfortunate as well. shannon: to the issue about punishment and the fact the number of companies and media out of done this kind of thing over the last 3 or 4 years probably dating way before that, they make mistakes or they make errors a lot of people worry and wonder whether they are intentional because of a driving ideology behind the story as it is being written but what will there be for consequences? people who are reading these stories, many subscribers wanted to hear that donald trump was doing something wrong, they are not going to run out and cancel your subscription to the washington post. how does anybody get held accountable for what happens? >> part of a wider truth, or higher truth, general truth even if the specific details in a given story are factually wrong and that is inexcusable, certainly not journalism. a lot of journalists talk a lot and pay much lipservice to the concept of accountability for politicians, there has to be accountability for members of the media as well and if the media looks at the polling right now, it is not news as it has been for years, they are especially these days at a nader. many americans, majority of americans, super majority of americans do not trust the news media and the whole phrase fake news which roy used a few moments ago is not just something people chant in a trance, donald trump didn't emerge on the scene, and people started applying for no reason, people have been angered, even radicalized by these types of mistakes that seem agenda driven for years and trump started punching back hard, sometimes too heart in my opinion but it resonated with people because of the dishonesty and here we have a concrete example of fake news that ran in one of the most prestigious and influential newspapers in the country and as you said it is not the first time and i suspect it won't be the last time. shannon: thank you both. a man is in custody following a series of fatal shootings at three atlanta area massage parlors the left people dead. fox 5 in atlanta reporting live on the latest details. >> reporter: it started 30 miles from where i am standing two spots on a busy part of the plant is so police say they were responding to one spot when they got a call about shots fired across the street. they found three bodies, they found one body, all were after tweeting his resolving his, justice reform will prevail despite a backlash by tough on crime types. let's discuss the latest development in la county with sheriff alex nolan a waiver. good to smart on crime. shannon: this is what george gascon is think of the present justices service, requiring safeguarding the integrity of the system going forward and to look back to correct the injustices of the past. do you have any issues with that going to these old cases, if there is racial bias or prosecutorial misconduct. he says the number of people in jail awfully convicted is higher than we would think. >> is judged by the people he surrounded himself with. he goes to jail and believes everyone, you can't find the court in sam quentin but the point is does the process already, the scales of justice allows, due process, gives ample opportunity for someone who is innocent of the investigative level at the very beginning, first up is on scene, who gets detained, who gets arrested, investigators further that, the search warrants, they execute that, it goes to trial and the da's office police prior das to prosecute someone to the full extent of the law based on this and then from there there's ample opportunities for appeal but now he wants to review as if everyone in jail is innocent and all our cops, while decreasing his prosecution of violent criminals. shannon: rearing from victims of family members left behind watching him take these reforms in hand. i want to play something from keith boyer, the celebrated california officer about how he feels under watch everything they do. these are the people that are protecting us so going forward it is terrifying to me, as a normal member of society, what this means just being on the street. shannon: we have talked about victims and family members who are left behind the gascon has said they have to go into these hearings and face people who are poor parole but maybe have harmed or killed members of their family and the prosecutor is not allowed to go with them. we hear more and more people talking like this young man, saying they are worried what is happening in the area under these new plans he has. >> i spoke with a family member whose son was murdered and prosecuted and the person was up for parole, and she explained to me yesterday she was previously assisted by the district attorney's office, they abandoned her, she herself had to copy the investigative file, something she never saw and she was shielded, there were images of her murdered son in graphic detail and she had to sit through it herself and explain to the parole board why this person was not suitable to be released and that is just unconscionable why we would victimize people who have already suffered for so much. so we will step in where we can but we are only one third of the cases coming out of la county. the chiefs of police and all the investigators from other agencies to do the same to fill in the void the district confirmation hearing calling him the new attorney general to look into what he's calling the potential fake fbi investigation into the claims against the justice. >> there are stark differences between the cases. now brett kavanaugh initially faced a single accusation with no corroborating evidence from high school, that were two additional accuses including one who backtracked her story almost completely when pressed on the fact. no new york democratic governor andrew cuomo stands accused by 37 women of harassing words or actions, they either worked for him or covered him while he investigator believes the virus could have come from research being done on a bio weapon from 11 wuhan, china. that investigator david asher joins us, welcome. >> nice to be with you. >> i want to read something from medicalpress.com. they talk about a huge delay getting experts and the country to look around in china and the origins report likely next week according to who. and the end they, this team of investigators arrived more than a year after the first cases of sars covid 2, they were first discovered in december of 2019. with that lapse in time what can we expect to find out, what may we never find out. >> one of the first things your listeners need to understand is these people really aren't investigators, they are medical doctors in different capacity in the medical field but none of them is a real professional investigator, there are people who are out there in the world who are medical sleuths. we have a community from the center for disease control but none of them is actually invited to join the who delegation and the one american who is leading the us contingent for the delegation is a fellow who was employed by the wuhan institute of virology on joint research funded by the national institutes of health so the level of complicity and compromise to begin with, the massive time delay, the time the chinese have taken to destroy evidence, cover it up and now hand pick the members of the delegation including their guy who worked with them under contract ironically funded by doctor anthony fauci is a mystery but it is also marias on raise that may sound complicated but it is not. it is the manipulation of genetic material to increase the virulence of disease. for some reason the united states medical disease community and with many international partners decided we can get ahead on biology using synthetic techniques and we've been doing it and in partnership with chinese wuhan institute since at least 2007. i argue the difference between that and the context of developing a weapon and in the context of developing a virus, a vaccine to protect against a weapon, there's not much of a difference these days so you are not going to really understand the nexus of this program and what it was trying to accomplish unless you understand who was involved, where the money was coming from and what the motivations were and what we discussed on january 15th at the state department was this was a military funded secret program being carried out by the people's liberation army scientists, not just normal folks, directly tied to the biological weapons program of the chinese government. this was the national institutes of health, this was something resembling something out of sensitive us military program so the whole thing is screwed up from top down and the fact the chinese covered it up is largely because they want to protect was was a weapons program in my mind. shannon: they had a lot of time. we will watch, knowing what you said
