famously wrote that which we call a rose by any other name would smell as sweet. that is obviously true. it is also true that words matter and a challenge that looks like a crisis to others along the us southern border. >> is there a crisis at the border? >> we don't need to put labels on what we've already conveyed that is challenging. >> a challenge they say but the white house and the biden administration writ large still refused to call what is happening at the southern border a crisis, that is despite the fact the number of migrant children detained at the border has tripled in two weeks. the department of homeland security is asking for volunteers to help amid the migrant search, thousands of children are in holding facilities which the new york times says are, quote, akin to jails and despite a rising number of covid-19 positive migrants and that's just the ones have been tested. many have not been and still being released into the interior of the country. no answer from mister biden and to hear critics to let the nonanswers are significant at the border. >> if you bring a child to the border or send your child to the border we will let them in. this is completely shannon: thank you very much, good to see you. breaking tonight a sixth woman coming forward to accuse new york governor andrew cuomo of sexual harassment. that incident allegedly occurring at the executive mansion in albany. aishah hasnie has the latest tonight live in new york city. >> reporter: there's been such a flurry of these allegations in the last several days but even governor andrew cuomo today told reporters he didn't realize there was another accuser. the latest allegation comes from an unnamed member of the executive chamber. the woman claims she was summoned to the governor's mention for work late last year where cuomo inappropriately touched her. when asked to respond cuomo claimed this was news to him. >> i'm not aware of any other claim. as i said last week this is very simple. i never touched anyone inappropriately. >> reporter: a total of six women accuse the governor of sexual harassment or misconduct. everything from being kissed on the lips to being propositioned for 6. the top two democrats, the senate majority leader calling on cuomo to resign while the speaker questioning his ability to lead. the government refusing to step down, waiting for the results of an independent investigation. state democrats releasing a letter demanding cuomo handover all documents connected to his book on leadership during the pandemic saying they are suspicious about the timing of its release. the governor began talking publicly about writing a book just four days after releasing a public report our nursing home death. the report wall street journal says top aides altered to show a low number of deaths than what we now know. >> this book has been disgusting from minute one and he needs to come clear with how much money he made, when the timeline was for his payments. >> tonight the new york times is reporting that publisher has paused promoting, even printing cuomo's book as long as those investigations, federal and state level investigations into nursing homes is underway. shannon: minneapolis is a city on edge tonight with jury selection underway in the trial of a former police officer charged in george lloyd's death. with the expected protests and calls for the conviction of derek chauvin are not the biggest source of tension. mike tobin has that story live in minneapolis tonight. >> reporter: there's been gunfire at the intersection where george lloyd was killed every night since saturday. saturday night a man was killed, sunday night a man was shot in the foot and last night there was a moving gunbattle in which 30 rounds were fired. chris kelly lives half a block off george lloyd square, he showed us the bullet holes in his new car and says they got there in an instant last night. >> someone opened fire on us, 30 rounds were fired and when it started i put my head down in the passenger seat and as soon as they let up i drove off. >> he says the gunfire became commonplace four months after george ford died. the intersection became a gathering spot, gangs became more visible every night is police with city council looking to disband them became less visible. >> i think city council should be disbanded, they put us in this mess, they allowed this to happen. they should pay the consequences. someone to take care of our community because they don't. >> reporter: police show up at george ford square frequently, the crowd turns on them creating a threatening situation. >> i've had reports of officers who had to shield other officers who have been providing for an overdose victim and they are there to do nothing but block injectables. >> that is the drug use to bring someone back from near death in the event of an opioid overdose so we have a situation where you have police sent in to protect the police who are trying to save someone and greatest tension is yet to come as this moves forward. >> glad you are on the scene to bring us the facts, thank you. breaking tonight a group of doctors who studied the risk of coronavirus transmission for students and teachers returning to in person classes now says in a usa today op-ed the cdc misinterpreted our research on opening schools. let's discuss the larger issue of reopening with fox news medical contributor doctor mark siegel and father of 3 from virginia who worked in the political world and is actively fighting to get his kids back into the classroom, rory cooper, listen to both of you. let's start with those doctors. on four say keeping schools close reading partially closed is not unwarranted, harming children has become a human prices should, the science shows we can safely reopen schools for full-time nonhybrid learning and keep them open. why would the cdc disregard or misinterpret if you want to give them the benefit of the doubt that guidance and how it is communicated to school districts around the country? >> that is their own research they are ignoring, the cdc published a group of studies that showed it was safe to open schools, one of them was written by this group you are talking about in usa today, doctor monica, a top disease infectious specialist behind a lot of this and obviously there is political pressure here, but teachers unions involved, the idea that there is a lot of fear involved and i have written a book on fear. everyone is afraid the teachers are afraid, fears are stoked but parents like warrior increasingly aware the risk of suicide is far greater than the risk of harm from covid-19. there's been 280 depth of children in the entire pandemic compared to 500,000 plus total, children tend to get very mild illness are asymptomatic and don't spread it very much. what harms them is keeping them out of school in terms of socialization, mental and physical health issues. >> reporter: one of the doctors let us study out of wisconsin, they studied 4876 k-12 students, 654 staffers and here's what they found. out of over 5000, 7 students contracted the virus, the community rate was a positive rate of 41.6% in wisconsin. i thought twitter thread you had talking about financial motivation, you claim schools are making money by staying close and renting out the school space to people who are not your students, the wealthiest districts are the most closed so your argument is more money is not going to help you schools open. >> that is what we've been told, but we can't open schools and so there's enough funding. the problem putting aside the funding still sitting on the shelf in 2020, the schools that are closed right now are saving money because as you imagine they had less operation they have to funds, schools that are open are the ones that are losing money. we are told that we have to get more money for the schools are closed. in fact half the schools in america are open 5 days a week. schools that are closed are the ones that are sticking to the cdc guideline that their own researchers say are incorrect was the real sticking point is over the 6 foot and community spread. when you tie school reopening to the 6-foot ruling community spread, if you open at all you will only opening a hybrid fashion because you only bring half the kids into your classroom. even though cdc director admitted three feet is sufficient. we need schools open two days a week, not four, we need schools open five days a week and reopen today. >> tori's point. shannon: talking about how people aren't getting food, medical attention, socialization, the help they need in many cases these authors of the study in this article say it is inhumane for kids. >> completely inhumane for kids. the wisconsin study we are talking about that got published by the cdc clearly showed three feet was safe enough and did not increase spread. take kids out of school for over a year they don't interact with people or get the usual socialization or nutrition or checked for immunizations, developmental delay, they get very depressed, their parents don't know how to look for this. a lot of this gets picked up in schools. all of this is cumulative and it was one thing to do this for the first month or two last spring. another point in europe, the article points this out also, in europe the variance are spreading, another fear term, the variance are spreading, actually it is not making it worse in terms of the schools. in spain, france and italy and the uk even with the variance the spreading in communities is much greater than the spread in schools. shannon: we will track the schools that are open and those that aren't and the impact on kids and staff because the numbers are there, the data is there. thank you both. queen elizabeth says the royal family will address allegations of racism in buckingham palace, recollections of what happened to harry raised particularly that of race are concerning, some recollections may vary they are taken seriously and will be addressed by the family privately. how did the show and there and what do you make of the queen's response? >> the windsor family at war, there are no winners. the queen's statement is very short, 61 words long but mentions the family three times and that is very significant. the good book said blessed are the peacemakers, the queen is a peacemaker. she is trying to put oil on troubled waters at that is what is needed here in this situation. shannon: she talked about how much she on that front. the associated press had this was megan's racism claim comes as no surprise to black britons whether it is the disproportionate impact of covid-19 and people of color or the lack of claims and in this interview, how does that impact the monarchy? how does it resonate or not with the people of the uk? >> racism is a factor, a princess or a popper. in 1996, i became the only black lord in the world out of 1800. it was a very lonely place to be to have this title but very little support around me and i had to learn the hard way that there is only one race, the human race. it's but is still a part of our lives that you have to tackle this with compassion, strength, dignity, not doing it the way she's doing it in my opinion. having said that she's raised an important issue there are those who worry that she and philip are very hurt that their grandson would go public with these claims and things that could be very hurtful. >> the queen has done it the right way. a very short statement today but in that statement she mentions the word family three times. she emphasizes the fact that megan is not an outcast but is still part of the royal family but not working royal. she says this, this is a story about a fiercely loyal, loving and dedicated father who rescued his daughter from a life-threatening situation, people were harming her and exploiting her says he would love nothing more than to see that britney doesn't need a conservatorship and if britney spears wants to end that she can file a petition to end it but in 13 years she never has. are you hoping ricky will come and testify about this issue? >> i am. the issue of conservatorship is a serious one which many americans every day suffer at the hands of their own guardians, not able to control their estate, decisions over there person. the congress, republicans don't have the authority or power to legislate, we are in the minority but we have the power to convene issues of importance. it is my hope judiciary chairman jerry natalie will agree with jim jordan and myself that we are to have discussion and review a bill of rights where they can have transparency, and where they can have some review and that statement leaves out that britney spears has been diligently trying to replace him as the conservator, to get a bank or cpa or some professional so she's not left destitute like so many throughout the country are. shannon: you wrote about this, not only britney but others say people who need a conservatorship were controlled by people trying to change their will or finances or other things, why did you decide to get involved in this? >> it is an issue a lot of people are not aware of. britney spears and her celebrity will bring some attention to it and i'm grateful congressman matt gaetz and jordan are bringing attention to it. matt -- matt gaetz and i are unlikely to be champions for britney spears, but if her case can help people understand other cases, in alabama the case of joanne brzezinski, the heir to the golden white, she has passed away but she had two employees that refused to take care of the investments she asked them to do, she fired them, they turned around and said she had dementia even though her doctor, her lawyer and she herself said she most certainly didn't the courts gave the control of her entire estate, the wonderful philanthropist in alabama to a court-appointed guardian. it finally got reversed but by that time the lawyers made a lot of the money instead of the money going to the charities that she would have given it to. it is an abuse and exploitation of people and it shouldn't be happening. shannon: britney spears does bring the celebrity element that will bring awareness to it. what do you hope to accomplish because there are those who say she has clearly had some issues that appear to a mental health issues, she needed assistance and help with her young children, with managing her career, she had trouble in the public eye. >> we are not saying britney spears is a person who doesn't need some assistance or even some participation from another entity but it does raise these questions about when a ward could ever be rehabilitated from a conservatorship and if someone like britney spears who sat atop the pop world doesn't have the power to fight back against the system imagine what and 87-year-old person in the state of florida who is being abused or taken advantage of would be able to do to fight back so this does right and the question. i would push back a little, i don't think he
