victory on wide open borders with a texas judge permanently blocking the biden administration's 100 day freeze on deportations. former department of homeland security acting secretary, chad wolf, coming up on why the new immigration crisis threatens all of us. a bombshell new report further exposing the means and methods use by obama's fbi to spy on the trump campaign in 2016 to try and take him down in an effort to find, quote, anyone to help them frame trump. former white house trade advisor peter navarro's reaction to learning he was among those vetted for russia collusion, all that ahead and we look ahead right here, right now, on "sunday morning futures." and first this morning we continue our deep dive investigation into security precautions taken on and leading up to the january 6th capitol attack. sources telling the dailier caller that the former sergeant at arms, paul irving, is, quote, covering up for house speaker nancy pelosi and that contrary to public statements made by her office, he was told by them, prior to the siege, to keep the national guard off of police capitol grounds, citing optics. earlier this month, mark meadows was here on this program telling us president trump offered up the national guard and capital police but was rebuffed. take a listen. >> the president was very vocal in making sure that we had plenty of national guard, plenty of additional support because he supports the rule of law, he supports our law enforcement. and offered additional help. even in january, that was given as many as 10,000 national guard troops were told to be on the ready by the secretary of defense. that was a direct order from president trump and yet here's what we see is there's all kinds of blame going around but yet not a whole lot of accountability. that accountability needs to rest with where it ultimately should be and that's on capitol hill. maria: joining me right now to talk about that is congressman devin nunes, the ranking republican on the house intelligence committee, the author of countdown to socialism. congressman, great to see you this morning. thank you so much for joining us. first off, let's talk intelligence around the capitol siege. do you see the kind of intelligence that would warrant what you've got going on, forcing you and your colleagues to go through metal detectors, to do a vote on the house floor, seven-foot fencing and barbed wire around the capitol. >> no, maria. this is nothing compared to the threats we've seen over the last two decades since 9/11/2011 of radical islamic potential attacks on the capitol and the targeting of politicians and other government buildings. so what this is really about, this is a hollywood production scene. so nobody's in washington, d.c., you can't find anybody, nobody's on the streets, the restaurants are mostly closed. and what they did is they put up fencing that should have been there in the first place. one of the basic rights we have in this country, for over 200 years, has been the right -- the freedom to assemble. and i've been through many protests that have -- while i've been in washington, protests that come, people have a right to do it. it happens all the time. you see it in front of the supreme court. so to have this perimeter -- it's not just a perimeter right around the capitol. it stretches for three or four blocks. so this is all about narrative building. what they want to do is they want to label every conservative and republican across the country as some type of dangerous domestic terrorist threat. i think it's going to blow up in their face. i don't think this is going to work. it looks ridiculous. it looks worse than a third world country. i've been the to a lot of third world countries during my time in congress and to see this fencing, this razor wire is completely absurd when we've had over the past real serious threats that continue to this day in terms of foreign intelligence looking at radical lace mick problems that we still face. maria: well, nancy pelosi is creating a new commission, a 911 like commission to investigate. senator johnson has already participated in a hearing in the senate about what information was available. how culpable is the fbi? they had the intel, right? and what about this upcoming commission, will we find out the answers in terms of what they knew and why these people were able to break through into the capitol? >> well, look, this is not very complicated. there was going to be tens of thousands of people, possibly hundreds of thousands of people that were going to be on the capitol grounds. every time that happens throughout history, you have the proper fencing in place. but instead, they had little three-foot fencing that anybody -- that my kids could jump over. so this is not about -- no, there's no intelligence failure here. they knew the day before. it doesn't matter. any time you're going to have tens of thousands of people, you have to make sure that you secure the basic capitol complex. we've done it for over 200 years. so the whole idea that you need to have a thousand new capitol police officers, we're going to have to spend $100 million, it's preposterous. it's a joke. at the end of the day, pelosi is the one that is the mayor of the capitol. she is the one who -- i don't know if she knew or what she knew and when she knew it. but she's in charge. and if this was previous speakers in the past, they've come out and they would take responsible. they would say -- responsibility. they would say i get it, i'm in charge. that's what she ought to be doing but she's not because these are sick individuals that are trying to label the republican party as having something to do with domestic terrorism. it's sick and it's wrong and i think the american people are going to reject this. the capitol hill complex has been closed. it's not just that it's been closed. it's been closed for a year now. and they like it this way. they like it because they could draft legislation, they can draft legislation in the dark of night, just like they did with the $2 trillion bill. it hasn't gone through any committee. i know you'll talk to leader mccarthy about this. it's $2 trillion supposedly for covid relief. we haven't spent the covid relief money that we have and the current bilker it's very little to do with covid relief. what it is, i said it at cpac yesterday, this is a slush fund in order to use to buy votes that biden can use for the next four years. it's a trojan horse with $2 trillion in it so they can build things like goofy high speed rail that they haven't completed that was done last time we did this in 2009 when -- remember when obama did his stimulus bill. that was used to do things like high speed rail that never got completed and now you see they want to build with all the tech oligarchs in silicon valley, they want to build an underground tunnel between san francisco and san hoe same i -- san jose, i think the american people know that doesn't have anything to do with he covid relief. maria: the general will recordedly tell congress they need 1,000 more call toll police officers and -- capitol police officers and additional barriers, and that will be $100 million. we have all these other costs that are culminating because of the fencing. i want to talk about what you discussed at cpac. you discussed the potential recall of governor newsom. before i get to that, let's talk about john durham. you've done such extensive work on exposing what was truly just a fraud on the american people, fake warrants to spy on people like carter page and others. john durham resigned as u.s. attorney in connecticut. does this mean we're not getting any accountability? you've been working on this recently. what are you expecting from the durham investigation? >> well, i may be the only one that still has faith in some of our institutions and i do have faith that john durham's going to do the job. i don't think it's a surprise he was going to leave as u.s. attorney, typical, that happens when have you a change in administration. so all the u.s. attorneys are going to be replaced. the special counsel is in place. i have more concern about biden and his new attorney general getting rid of durham. that's a big concern. i'm not concerned that durham, who has a long career, he knows that throughout history he is going to be the man that's going to be responsible for getting to the bottom of how the fbi and the department of justice were corrupted by the democratic party and a i expect that the dirty cops will be held accountable. i know it's going to be a challenge because we have the indictments, i'm assuming will likely have to be brought in washington, d.c. that's a very partisan place with 95% of the people there vote for liberal democrats. so i think durham has his challenges, i think at a minimum he'll be able to bring the indictments, he should be able to bring indictments, hopefully he gets the prosecutions and hopefully there's a full accounting of everything they did here because they ruined lots of people's lives. if you look at just the news, john solomon who appears on fox a lot, he had new breaking evidence that even stuff that i hadn't seen were clearly they were running spies into the trump campaign, into numerous republicans and it's wrong. and i know you're going to have peter navarro, he was one of them, i know he's going to be on the show flare the hour. maria: solomon reported that sources told him that we'll know about charges in march, durham negotiating with witnesses and is focused on three to five people at the fbi. those who have not been interviewed include comey, mccabe and strzok. what do you think in terms of where the indictments could happen? based on what you know, what is clearly broken laws? yeah. >> well, what i was referring to is there's new declassified documents that solomon released this week that president trump had declassified. when you go through that, it's frightening. imagine being spied upon by your own government and then that spy makes up a bunch of lies about everybody. i mean, they framed general flynn. they framed the former head of defense intelligence agency. they framed him. and it's clear in this evidence. and this is evidence that should have been brought when i was chairman of the house intelligence committee, it should have been brought nearly four years ago. we should have seen what they were doing and how they were running these spys in the campaign. we had to sit around for a year, oh, we're not going the to call it spying. the american people are eventually going to learn the truth and hopefully we're going to see indictments. maria: and by the way, we spoke about how they set up flynn before and they tried to use the logan act. meanwhile, here we have news that john kerry has been traveling the world, meeting with people in iran, iranians to undermine the trump policy of getting the u.s. out of the iranian nuclear deal and yet they tried to come up with the logan act against general flynn. real quick, before you go, you spoke at cpac about recalling governor newsom. do you think that governor of california will get recalled? >> well, i think it depends on if the people in california actually begin to receive real information. if they found out that the speaker of the house was getting her hair done when other people couldn't get their hair done during covid, if they find out the governor was having certain places that were open while others were closed, some people were eating outside while he was eating inside at one of the nicest restaurants in california, without wearing a mask, without social distancing, i think 10 or 12 people, drinking thousands of dollars of wine, i think those types of issues if the independent voter, the people that don't pay attention to politics learn about the corruption of the democratic party and socialist party in california, i think a republican as long as there's one, as long as there's one republican that runs on the ballot, we'll have to rally behind one, i think they'll have a very good chance of winning. one of the things i said yesterday at cpac to watch closely for is will the democrats turn and actually put -- have put themselves on the ballot. because the question will be, do you want a recall, yes or no. if the answer is yes, who would you vote for? and so the democrats will be taking a real risk if they do not run a prominent democrat on there because it would potentially only be republicans on the ballot. maria: yeah. and real quick, devin, before you go. this whole throwing cuomo, throwing newsom under the bus from democrats, you say that is a larger theme. there's a reason that democrats are throwing these two governors of new york and california under the bus right now. real quick. why? >> well, i think it's real easy the democratting party is really a socialist party. it's how it runs in california. i said it before. kamala harris never had to run for anything. when she did run for something, she couldn't even get 1% in a democratic primary. she had to drop out, after blowing through $100 million. so what they're doing here, what i believe they're doing here is, is that cuomo and newsom are expendable now. they're a threat. they're a threat to the system, a threat to harris. because before, all the stuff about cuomo was known for a long time. maria: in 2024. you're saying they're -- >> it's eliminating the opposition. eliminate the opposition so that she has a free run in 2024. and isn't challenged by a prominent governor from two of the bigger states, new york or california. maria: many a big victory at the border this week with a federal judge in texas indefinitely blocking president biden's 100 day freeze on deportations. texas attorney general ken paxton sued the administration as you know back in january, calling the executive orders out of president biden on immigration, quote, unconstitutional, illegal and bad for texas and the nation. he joined me on "mornings with maria" on friday to encourage other states and attorneys general to fight back.h. >> it's shocking, the brazenness with which the president did this in the very first day, looking at federal law and saying don't worry about federal law passed by our congress, by elected representatives. you don't have to worry about it. you don't have to enforce it. that's acting more like a king than it is a president. it gives me a lot of concern that he thinks he can do this on that issue, why not every other issue which is why it's so important that we stand up as he does that, if he does it, we need to stand up and fight it so he doesn't continue to do it. maria: joining me right now is former department of homeland security acting secretary, chad wolf, currently a visiting fellow at the heritage foundation and chad, it's good to see you again. thanks very much for being here. good morning to you. >> thank you for having me. maria: so so many keck testifye orders to go through with you and overturning of yours and president trump's policies, give us the significance of the legal win for texas and ken paxton, in your judgment. >> well, it's absolutely critical and i'm glad the courts have ruled on that. what we know from a halt in deportations is you are turning on the head the rule of law in immigration law. so if i.c.e. and dhs can't do their job, can't remove individuals that have no legal right to remain in the u.s., then the whole nature of our immigration law is up in the air so it's the right ruling. unfortunately i would say that dhs already decided to put further restrictions on who i.c.e. law enforcement officers can and cannot deport even though the court ruling is a win, dhs has given i.c.e. instructions that they can only remove individuals in three specific classes. those that come across the border, those that are aggravated felons and those that are terrorists. that takes off the board about 80, 90% of individuals they could legally remove out of the country and so, again, just more concerning actions from the biden administration. maria: chad, the administration also halted the border wall construction, leaving high volume areas like the rio grande valley quite vulnerable. we have a shot of the map to show people where most of the people are coming in. i know your colleagues have said it's 4,000 people at the border every day. what is the situation that the border patrol agents face on the ground? walk us through this here. >> absolutely. the border wall system, i talked about it numerous times, it's not only the physical infrastructure which people usually assume the fence, it's the lights, it's the cameras, the roads, fiber optic sensors that gives border patrol agents the full picture on the border. you mentioned rgv in texas, that is ground zero for illegal entries into the united states. we had designated certain high priority areas for a border wall system and now we know that the biden administration has stopped all construction. so it puts a further strain on the men and women of the border patrol to do their job. at the end of the day, what it means is you're going to see more and more individuals coming across those areas. you mentioned about 3500 to 4,000 a day is who border patrol is picking up. that doesn't account for what we call the got-aways, another 15 to 20% of that number is that, again, they don't have the resources to pick up so it's very concerning that you're going to take a tool off the table out of the toolbox for our lawen forcement officials. maria: so the 3500 and 4,000 is at a minimum, then. let tas a short break. i want to get your reaction to the biden white house blaming the trump administration for the border crisis, caused by their executive wolf. i want to get your take on what's happening at the border. we were talking about the undocumented immigrants. president biden says they should be getting the covid vaccine without i.c.e. targeting them. many high risk americans who need the vaccine don't have the access to the vaccine. he's also planning to make sure undocumented immigrants have food, noting that his $1.9 trillion coronavirus relief package increases funding for nutrition assistance for illegals. your reaction? >> it's just more of the incentive that the biden administration is signaling to those folks south of the border, now is the time to send those individuals across the border illegally. they'll get a number of benefits that you outlined and they'll be free from law enforcement action that will remove them. so it's very, very concerning. as i've said repeatedly, they have brought this crisis that we see on the southwest border today, it is of their own making. we gave them as we left the administration, we gave them the tools, gave them a playbook that we kept the situation at the border under control and they decided to take the tools off the table, they decided to encourage and facilitate that illegal entry and it's -- like i said, it's concerning. i think the american people see this. but it's also very concerning for the dhs law enforcement officers who are on the frontlines who are having to deal with thousands of individuals that have no medical history, have little identification, you don't know where they came from. and they're having to deal with these folks in a covid environment. so we're putting their lives at risk as well. and i just, again, my heart breaks for them. maria: and everybody's heart is breaking for them. now they're in these facilities which the biden administration claims is not the same situation that was the case for the trump administration. and during the trump administration, we had all these headlines that trump was putting kids in cages. it's absolutely incredibly hypocritical to hear jen psaki, now the spokesperson for president biden, defend this. here she is this week talking about one of the biggest stories of the week. listen to this. >> i just want to ask you about cpac. i know you've got questions about this yesterday. if i could try again. based on our reporting, former president trump is going to be talking about president biden's immigration policies, he will point to the uptick in migrants coming to the u.s. how is the administration planning to -- >> we're not looking to former president trump or any of his advisors as the model for how we're approaching immigration. in fact, we're in the circumstance we're in because not only was their approach inhumane, it was ineffective. and so we're going to forge our own path forward. we'll see what he says. but our focus is certainly not on what president trump is saying at cpac. maria: your reaction to that, chad? she says our own approach. but isn't that approach the same exact building where there were kids in cages under president trump but now they're migrant facilities according to the washington post. >> the comments by jen psaki are not only absurd, they're dishonest. i don't believe she knows what she's talking about. the situation on the border today is, again, the own making of the biden administration. they knew the numbers as they were coming into power, as we were making the transition over to dhs officials throughout december and into early january, they knew what the numbers were. they knew what the policies and procedures we had in place to control those numbers. and what we saw on day one of inauguration day is they took all of those tools off the table and they took them away from the dhs, law enforcement personnel and now we see e-mails from dhs to i.c.e., to cdp asking them to do more. that is just, again, dishonest to say you need to do more but i'm going to withhold a bunch of tools that will allow you to do more. and so it's just -- it's as bad as it can get at the moment. we see about 5800 children coming across that border in january. it's going to be almost double that in february and they're forecasting about 1300 -- sorry, 13,000, perhaps in the month of may alone. you're at crisis levels that you have never seen before. and again, it's at their own making. maria: but why? why? do you have any answer to why they're doing this? why make so many people vulnerable? even offering the illegal immigrants the vaccine before regular americans. why? >> well, again, it's just a different approach that they have. they prefer not to enforce the law. we've seen that time and time again. we talked about it on the earlier segment. they want to make sure that they facilitate this entry of illegal aliens into the country. they want them to stay here in the u.s. as they wait for their immigration proceedings which we know the facts will tell us that they just don't show up for their immigration proceedings. another population that's increasing are family units. and between 2014 and 2020, we had over 1 million family units, individuals making up families come into the country. almost 90% of them are still here. they are still here, either in the shadows or going through proceedings. so what we know and what the facts tell us, is they don't leave. even though they have no legal right to be here. so i think at the end of the day, one has to assume that's what the biden administration wants. maria: all right. we will leave it there. chad, good to see confident to and through retirement. maria: welcome back. the covid relief plan passed the house, now a breakdown of president biden's $1.9 trillion stimulus plan, it passed the house in a near party line vote shortly after midnight saturday night. here's a look at the pie. you read it right, 9% of the money is going toward coronavirus health spending. 91% of the $1.9 trillion is being reserved for non-covid special interest projects, this was first revealed by my next guest. he says we should stop calling this a he covid relief plan and instead refer to it as the pelosi payoff. house minority leader kevin mccarthy joins me right now. thanks for being here. welcome. >> good morning, maria. thanks for having me back. maria: let's take a look at this my which you tweeted out. you've got money for the unions, you've got money for the railcar in san francisco, pelosi's tunnel. schumer's bridge, nationalen dowment for the arts getting almost $300 million. planned parenthood, universities, another several hundred million dollars. walk us through why this is called a covid-19 relief bill when you only have 9% of the $1.9 trillion actually allocated for covid related spending. >> it's just unbelievable. this thing is just so corrupt, so costly. and you look at it, it's so liberal. think about it for one moment. less than 9%, we have done five other covid bills and every single one of those was bipartisan. the biden administration's become the most partisan administration in modern history. think for one moment. we still have a trillion dollars sitting out there that those be appropriated sent to the economy. the money in this bill for schools, 95% of it won't even go out this fiscal year. two-thirds of it won't go out of until 2023. i mean, the real focus here should be putting back to work, back to school, and back to health. this bill does not do it. and the irony here is, nancy pelosi when it came public that she put in $112 million for a subway project that has failed just outsite of her district in silicon valley n the dead of night, right before, she added more money to it. it's up to $140 million. what we did, we tried to redirect the money, we put an amendment up to say let's take the 140 million, apply it to parents to be able to use it for children's mental health. with kids being out of school, we find depression, suicide, anxiety, in my own district i'm finding the d's and f's are continuing to go forward. we could redirect the money to be spent there. every single democrat voted no on that. maria: well, i mean, every single republican in the house voted no on this bill and it still passed. what are you going to do about snit can you as a leader of the republican party do anything about this agenda that includes executive orders that blow-off the law and money for pet projects. >> you're right. the only bipartisan vote we had on the overall bill was no. every republican and two democrats joined with us. the democrats only have a five seat majority. they just spent almost $2 trillion in the most partisan way you can. the one thing they did cut, medicare. this bill cuts more than $36 billion this year from medicare and next year and next year, for the next 10 years. that's what the democrats voted for. so what we need is people joining with us. and i believe if you look forward, their agenda is going so far -- the socialists have brought the swamp back. that's what the bill shows. the swamp is back in washington and that's what we have to fight and i think we're going to put up a pretty good fight. you wait, i believe in a short timeframe you're going to watch us winning. maria: you're going to win the house you believe in 2022. >> i believe it for so many reasons. think of the future between democrats versus republicans. the future for the democrats is governor cuomo, gavin newsom, eric swalwell. think about the republicans, we've got senator tim scott, kristi noem, governor ron de santis. i think our ideas have proven he's person any the last year that we help people, we keep states open. and one of the worst parts of the last covid relief bill, they changed the funding systems to states where they reward bad behavior. if you have a pension out of whack f you over-spent your money, if you kept your state closed, you get rewarded by taking hard working taxpayers money and giving it to them instead of states that have done the right thing, about keeping open, getting kids back in school. maria: well, congratulations on this rasmussen report and the favorability survey. the survey indicated that you had a 43% favorability rating, a larger number than any other congressional leader. 35% had an unfavorable view of you. you are the leader here in terms of favorability. reaction to the fact that mitch mcconnell was at 29%, schumer worse than that at 33%. aoc, 34%. and nancy pelosi at 37%, lowest favorability rating in congress, congressman. >> well, i think the american public simply said they don't want the swamp back, they don't want the socialist ideas. i always said and your viewers know this, we will listen to the men and women that have not been listened to be, the forgotten men and women, those are the people we're working for. to make america first and continue to grow. we have a partisan administration that opens the border, has a plan to open the border, not open our schools. the democrats' most important bill, the bill they're moving, hr-1, is about protecting them, not helping the american public. they want to take taxpayer money and use it on their own campaigns, they want to change election laws so they could guarantee they would always win. they want a czar to take away free speech and what's happening in the campaigns. this is the most important think them, to hold onto power. maria: this was my next subject to raise with you. nancy pelosi's number one priority is election reform. you being the leading republican, you have the most to lose. from an unfair election. what are you going to do to ensure that the future elections are safe and fair? here's what supreme court justice clarence thomas wrote. unclear rules threaten to undermine this system. they sow confusion and ultimately dampen confidence in the integrity and fairness of elections. to prevent confusion we have peteedly -- repeatedly blocked rule changes made by courts close to an election. this is a major issue and republicans continue to worry that you're not going to have any leadership positions so long as elections are not fair. i spoke with senator rand paul this past week on "mornings with maria" over on fox business. he says did georgia -- georgia had a big win because state senators passed a bill to require identification to vote. there's a novel thought. how about id to vote. here's rand paul this week with me. listen to this. >> i'm terrified of election integrity. i'm all for election integrity, but the opposite of what nancy pelosi thinks is. i think we need in person voting, it needs to remain in control of the states. i've been going to the states, including my states, and trying to get election law reformed. i think you need to vote in person. i think you need to make it such that secretaries of state and the government shouldn't be out paying and using taxpayer money to go to your house with ballots and applications to vote. maria: congressman, your reaction? >> i don't have the most to lose. the american public has the most to lose. we would lose our freedom. when you put a bill into congress, the majority party reserves the first numbers. this is hr-1. this is most important for nancy pelosi to hold onto her power. what we have to do is people lose their confidence in elections, you break society down and we will lose america as we know it. we know that there's a real question in the confidence in the last election going forward. what you have to do is exactly this. you have to clean up the rolls. in la they have more than 1 million people on their rolls where they don't have people that age that have that many people there. have you to sue to make sure you clean up the rolls. we
