immediate investigation and asked for the inspector general to look into this irregularity with the nursing homes, governor cuomo should be held accountable. i called for his resignation as governor because this is a clear violation of the law, a, let's, not the first time i called for governor cuomo's resignation. powerful people in new york state including chasing -- of the hobart. i think the governor has to pay a price for this, we need a new governor, too and new york doesn't have a recall statute like they do in california, we could put in a new governor but at this point it is unconscionable what has happened in our nursing homes, the tragedy of so many people who prematurely lost their lives under governor cuomo. jillian: we will follow the legal battle should continue congress elected by his or her district off all committee assignments. members are supposed to work on committee. it is the way they represent their constituents. at the same time they have to have responsible behavior before and while they are in office. this is a complicated case. having political figures be involved in conspiracy is something that is very troubling in american politics. just apologizing for that behavior sometimes isn't enough. we have to think through how to have a more responsible congress but that is the democratic side where there has been indecent behavior toward republicans for years especially donald trump and those members were not thrown off committees. we've got to have balance and consistency for the american public to believe congress is a fully functioning body and it doesn't feel that way in any corner. shannon: they took steve king off of his committee assignment when he crossed the line and there are those in the republican party pointing to statements they view about 9/11 on the other side of the aisle. where do we go from here? >> i'm not confused at all, democrats are taking the page directly from the republican playbook and acting like they are in charge for the very first time in a long time. with the bottom line is what is good for the goose is good for the gander and the goose, the democrats are in charge and if republicans don't like it, in 2022 they can win. republicans will stand there and say they have a long list of democrats they will be they should take off committees, doesn't work that way because they are not in charge, republicans have done and will do if they get in charge again exactly what they want to do. this is what donald trump wanted and democrats are following, democrats of stood up and made people like me very optimistic about the future of the democrat party because they have to realize they will lose in 2022, joe biden may be talking about unity but voters are telling them to push the line. shannon: i want to talk about joe biden's future. a couple headlines where he has gone so far, the washington examiner says growing pains, biden slowed by early stumbles in first two weeks, that contracts with washington post, the headline, same day said biden's surprisingly successful first two weeks. the truth lies somewhere in between, what do you make? >> the most telling part is how he set the tone wanting to accomplish unity but i just heard that he hasn't and that is exactly right. he could have on his first couple days as president said i will not pursue an ideological agenda for the left. i'm going to try to recognize half the country didn't vote for me and i'm not going to sign a sequence of executive orders that will be against what iran on and that is the opposite what he did. what he did is he signed executive orders to his pledges. he did not go to pennsylvania and say he will ban tracking, that he would ban the keystone pipeline and certainly day he would sign a radical transgender executive order that is receiving backlash and outrage from voters across the country. as a conservative and supporter of the president i want to see president biden succeed for the country. the more he continues to sign radical executive orders and divide the country with rhetoric i find highly charged i wish he would heal the country, what he said he wants to do. i have seen 0 evidence in that regard whatsoever. shannon: this $2 trillion package that republican senators of gone to the white house to meet with the president, we heard there would be bipartisanship, working together and what we saw on capitol hill was this is going to be a partyline vote, $2 trillion package pushed through. >> we also saw on capitol hill terrorists storm the capital. charlie is saying he wants biden to heal the country, the bottom line is we are long past this summit the end of the day joe biden is responsible to his voters. great to see half the country voted for donald trump needs to bring those together but they didn't keep that energy when donald trump was in charge. i came on 6 years straight into the same thing when republicans were in charge, they can run it movement, she deals with the speed of vicious attacks on asian americans as you see in the surveillance video. rick leventhal has that story tonight. >> some business owners won't talk about it for fear of scaring off customers. with 20 unprovoked assault and robberies in oakland's chinatown neighborhood in just the past few days, locals say it is an unprecedented crime wave targeting asian americans. the attacks are shocking and blue, often captured on surveillance cameras including a 91-year-old man finally shoved her from behind when walking down the sidewalk leaving face first on the pavement, treated and released from a local hospital along with two others also knocked to the ground on the same block on the same way on the same day. police released images of the suspect in those stories, a black mail 20 to 30 years old asking the public for help with getting him and others involved in the recent violence. >> even if you have little information, even if you cannot describe your assailant please come forward. >> other incidents include brazen robberies inside an herbal medicine store where some women have their wallet stolen and a purse snatching inside a bakery. locals admit it will be tougher because the department faces a $62 million budget deficit. the oakland's mayor said the city budget won't allow bringing back foot patrols in chinatown but she hopes veteran make of it? >> i have no idea why he continues to exaggerate his personal experiences but it has been a long history of them doing this, this goes all the way back to 1998 campaign when he had to drop out for plagiarism, exaggerating his academic credentials. i don't know how to explain it, there's some kind of insecurity here for never having served, maybe perhaps when you have done nothing but be a politician since your late 20s hasn't served overseas, doesn't bring anything to the table except having been a politician maybe there's some underlying insecurity to exaggerate what type of danger he has been in. shannon: there have been requests to the white house for comments. we haven't seen one yet on the latest comment from the president. want to talk about breaking news reported by the wall street journal. they say under the headline iran un inspectors find radioactive traces raising fresh concerns, goes on to say materials were found in sites where in parts inspections by the international atomic energy agency. we had admission from the biden administration in recent days that they are fearful iran could have a nuclear weapon developed within months or even weeks. what do you make of this headline tonight? >> it is not surprising. the israelis have been releasing information that shows iran has never set aside its march towards a nuclear weapon was the iran deal didn't do what he promised. it gives the iranian regime a ton of money up front and only suspends the program. one of the things we constantly have to remind people is there are three key components to a nuclear program, there's the missiles, actually being able to make the bombs and being able to weapon i set, get it onto a warhead and all the iran deal did was temporarily suspend one component of that and the inspectors had to give notice months in advance, the iranian regime rejected there for 7 months last year and could only inspect certain sites so just by way of analogy it is like having a bank robber on parole and the parole officer has to give a month's notice to check their house and can only check one bedroom and when they do, no surprise it is relatively clean. proponents of the iran deal many of which are in biden's administration are saying there is nothing there. the deal was absolutely a farce. what i hope the biden administration, the new secretary of state blinken and the national security adviser and others have an open mind, look at the intelligence, trump's maximum pressure campaign was working, the amount of oil they were able to sell on the market, they've not paid they terrorist proxies anymore. had to curtail essential programs, the regime is truly struggling and if we keep up the pressure we can get back to a better deal but from a position of strength with true leverage and not just go back to the obama era thinking. that is my hope but we will see in the coming weeks and months. shannon: breaking news on the front in yemen, the decision to change terror designation, the new york post says biden's human withdrawal will embolden the terrorists, biden's withdraw from human may have been intended as an olive branch to tehran in anticipation of a new diplomatic engagement but it is unlikely the iranian regime will respond reasonably to any such outreach when it senses weakness from the united states. with terror designation changing we are told is to have humanitarian efforts to get into that area. others see it as a potential overture to iran. what do you make of it? >> it has been a brutal and difficult war but the salaries have made it clear they want to get to a negotiated agreement, the united arab emirates, the partner in that effort have made the same overtures so i don't see it as a huge tremendous shift here although the biden administration is messaging it that way. at the end of the day the houthis launched into saudi arabia, launched rockets, drones and other types of attacks at airports and civilian targets at the uae, they are behaving like a terrorist organization back by terror on, launched an international shipping, negotiated -- walks like a duck, talks like a duck it is a duck and i think this diplomatic rhetorical shell gameing so the biden administration looks like it is doing something different but a lot of these efforts already underway in the last year or two moving pennsylvania high school student who face disciplinary action after using colorful language to curse out her cheer team after finding out she had made the varsity squad. the first amendment did not allow the speech outside of school to be grounds to be punished but they moved online a lot of them, does that impact the high court's decision? we will hear the case later this spring but we will recognize schools already are allowed to punish certain kinds of speech off school grounds. if the student has been harassed or threatened to kill another student off school property were outside school class hours most of us would accept the school could accept all that student. and also punish the student if she said this on school property in the middle of class so the question is does it really matter whether the speech occurred on school property or not? i take your point the we're in a day and age most students are not learning on school property but in a virtual classroom. school has become a process, not a place. when that happens, the jurisdiction, the power of the school to discipline students even though they are spread all around town for the state because of zoom, will say students do not shed their first amendment rights, speech in school can be honest if disruptive in the classroom here we have to look at this individual student. she was not in school. it was over school hours or during school hours is something the court will have to look at and dive into but it is a serious issue of censorship and school punishing students, their speech that happens outside were passed over for assignments on charter school, the lawsuit is exhibit c that says she was told that trip and all other sports and corporate charter trips were available for a preferred list of flight attendants, consist entirely of you full white flight attendants most of whom are blonde, united is denying these claims. >> we are only allowing white attendants or asian attendants to work on certain flights, the question is if you look at the case, you can't have official documents or official policy. don't how they figured out with attendance on these flights are all white because they
