>> we all want to go back to school. we also want to go back to school safely and make sure in addition to getting high up on the priority list of being vaccinated we want to make sure there is robust testing. when i was home a few weeks ago with family members in the school system they had to insure they got their test. proper protocols. >> the biden administration says they're following the signs. we've known since last summers that schools are not a place of spread for covid-19. the school systems got 65 billion last year from congress in covid relief to put in safety precautions to allow teachers to get back to school. the bottom line at this point is that good teachers who want to go back to school are being held hostage by these teachers unions and they're now extorting the american taxpayer for more money claiming they don't have enough money to go back to school when they've been funded and we have the science again with the cdc report this week showing that this disease does not spread in schools. as far as the white house goes, they've also moved the goalpost on what they plan on doing. now you have them yesterday saying that in order for teachers to go back to school, it has to be, quote, safe and therefore they need a $2 trillion rescue package to pass probably in march. and that's not the way that we've heard the science over the past nine months. so this idea now that you can't reopen schools without a $2 trillion package when all the science says the opposite is just ridiculous. i don't think that we can overstate our understate how terrible this has been for children. the data on this is absolutely horrific. >> dana: i also want to remind everybody that rural america also has problems. 17 million kids don't have high speed internet. they can't even zoom even if they wanted to. one other thing i want to get to you today. we know that people that are in high places, sometimes they have people that want to draft behind, that could also be the case for president biden and his family, apparently biden this is according to "politico" told his family for christ sake, watch yourself as one of his brothers was discussing a new venture with major donors before biden entered the white house. donna, this can happen. does biden need to be more forceful here? we already had a controversy and it is not over yet with hunter biden. >> absolutely. we saw in the last administration where people complained about the former president having his family members in the white house and people trying to profit off his businesses. so yes, i think there needs to be one standard of ethics and yes, i believe that the president is right to not just say that to his family, but also to numerous people who are entering the administration. you know in the last couple days of the trump administration he reversed himself on draining the swamp in terms of giving people access to lobbyists and so forth. so i do believe there should be one standard. >> bill: katie, jim was approached by fox news in the weeks before the election and showed them away. frank biden his other brother had a law firm ad taken out on inauguration day. if that doesn't smack of a conflict of interest, what does? >> it's pretty swampy, bill. we know from revelations last year that the biden foreign family affairs were not limited only to hunter biden. we still know hunter biden as far as we know is still under investigation by the department of justice. and when you are a new president, you don't want scandals from your family members who are trying to get rich off your new political position to get in the way of your new agenda. it seems like that is what joe biden was trying to do by telling his family members to be careful. >> bill: you guys be careful in the swamp, right? it's getting high down there, ladies. >> there are lots of critters. >> i'm from swamp country. it doesn't frighten me. some of the best seafood comes from the swamp. >> dana: i knew it would come to dinner. >> bill: president biden taking backlash over halting the keystone pipeline as part of his climate plans. it runs through the state of montana. how will it impact the state and its workers? perhaps in a significant way. the governor gianforte is with us. >> good morning, it is a misguided decision. president biden is really pandering to these radical environmentalists. the impact on montana is massive. not only do we lose hundreds of jobs and this is the best way to get crude oil to market but it is a lifeline for rural montana. it would have generated over $100 million a year in taxes to help us pay for schools, law enforcement, infrastructure. this is devastating. president biden needs to reverse his decision. >> dana: i want to play for you from the new climate czar john kerry how he thinks it might be easy. watch. >> workers have been fed a false narrative. no surprise, right, for the last few years. they've been fed the notion that somehow dealing with climate is coming at their expense. the same people can do those jobs but the choice of doing the solar power one now is a better choice. >> dana: governor, is there anybody in the state of montana working in oil and gas today that could walk off their jobs and walk right into a job the next hour working on solar panels? >> we had crews on the crowd burying pipe, building substations, capital was being invested when this executive order came out we had people packing up their lunch pails and going home. not going to another job. >> bill: you can always write code or build solar panels. that was the suggestion by some in washington as they can convert these jobs and not lose a step. let's talk about covid in your state now. in montana mere are numbers, 92,000 doses administered. total of fully immunizeed are about 21,600. how is it going out there? what are your concerns today, governor? >> this vaccine is safe and effective. it is the light at the end of the tunnel. we're getting out the vaccine we receive. 87% of the doses that we've received are in people's arms. by the end of this week virtually all of our nursing homes, long-term care facilities and front line healthcare workers will have been vaccinated. we have moved into 1b. focusing on the elderly. we don't have enough vaccine. i sent a letter to president biden yesterday saying give us more, we'll get them into people's arms. >> dana: did you hear back from them? >> we have not. >> dana: what are you doing in montana to get these administered that other states might not be doing? is there something you're doing? in some of these states only 50% of the vaccines that they've been given have been administered. >> well, we mobilized, i have a covid task force i meet twice a week just on vaccine distribution and honestly i would say it's the montana work ethic. we just get her done. the hospitals have pitched in, the pharmacies have pitched in, public health offices and we've been clear in our communications. we were one of the first states to deviate from the cdc's confusing and complicated guidelines and focus on the most vulnerable. we took kind of a cowboy approach and said if you are subject to complications or death you should be at the head of the line. that's why we prioritized seniors and people with underlying healthcare conditions. that made clarity of mission much better and we were able to get shots in people's arms. >> bill: have you shared that with other governors? remember when you think back to the tech companies saying we have terms of service. but i don't think it's at all clear-cut and i think it's very hard to defend a hedge fund. >> bill: here is the catch, though. you don't know -- when you are dealing with this kind of volume in trading and dollars, you don't know what happens today. or next week. so how do you change the rules in the middle of the game and get away with it? >> dana: make it up as you go along? bad for the system and bad for business as well. this is also captured washington's attention. we have team coverage with fox business. we start with edward lawrence on capitol hill. critique us. anything wrong here? >> well, you know, there is a lot going on here. it has piqued the interest of washington the house financial services committee chairwoman maxine waters saying there will be a hearing of robinhood halting the stock actions like game sto*k. it prevented the small investors bidding up the price of that stock. we have classic david versus goliath. one side the institutional investors, hedge fund, large corporations that do this. they bet that gamestop and other stocks go down called a short. when the stock falls they end up making money. on the other side of that you have thousands of individual investors who have organized over social media like reddit and facebook to buy gamestop and other companies that institutions shorted. so over the past few days you have the institutions losing billions of dollars a day because those stocks are being bid up and not losing price. listen. >> no, i think it's fair game for any investors to take on a hedge fund and ingenious what they've done. the short sales and positions out there and gone after those stocks. >> a former regulator there. it has lawmakers concerned -- what has them concerned is robinhood has blocked certain trades allowing the big institutions yesterday to cover some of their shorts and make money. now you have reddit and facebook closing down those chat groups that were used to organize the small investors. so all of this has senator ted cruz and representative ocasio-cortez on the same side on this. in a tweet yesterday aoc took it a step further calling senator cruz to resign. lawmakers are watching it and so is treasury secretary janet yellen. >> dana: ironic to have robinhood robbing the poor to pay the rich. thank you, edward. >> bill: lawrence simonetti continues our coverage. what did we get wrong? that's the question we have. >> i think everybody is confused at this point. let's try to go through exactly what is happening. short selling is betting against a stock. it is betting that the price of that equity goes down. it is risky because losses are unlimited. so here are some slides. a trader tells their broker go buy x stock at let's say $100 because he or she thinks the stock is really worth $70. the trader sells the stock on the market and guess what? he or she is right. that price does fall to $70 so he buys it back at the lower price covering his position. okay. the trader gives the stock back to the broker and he makes money, $30 profit. he also pays a fee. this is what many hedge funds specialize in. so what's happening now is gamestop and others, blackberry, the bet is that those stocks go down. but you have swarming on social media. the army of reddit chat app traders taking on the hedge funds by buying the stocks and pushing the prices up. that causes the cover their position. that's where we are now. let me give you some examples. melvin capital management had to be bailed out. had a large short position in gamestop. others are getting hurt, too. not only because of these short positions but because the pain the shorts are creating is spreading through the market right now in some instances. we've had a very volatile week. an en abeler of this is robinhood that lets you by stocks, options, cryptocurrency for free and 13 million users, median age is 31. millennials. they get free stock. transactions are celebrated with confetti drops and robinhood makes netflix style recommendations. it feels like a casino when many people can't go to vegas to gamble right now because of the pandemic. what this platform is --ist is going up against the suits and establishment. there will be ramifications of all of this. the question in my opinion the business model of free trading is one reason robinhood and others had to put some limits on specific trading yesterday is because they needed to make sure they had enough money to carry out these trades. so it gets complicated. the decision to block some of those trades, by the way, is not going down well with the reddit crowd chat app. the end result could be this young crowd of retail investors is teaching wall street something they didn't know. >> bill: i like it. thank you. i guess we got it all right. i was not corrected, were you corrected? >> dana: i think everyone is confused. that was a gentleman way of saying we didn't have it right. >> bill: we're working on it. 9:30. markets are open on wall street. >> dana: an oregon mayor condemning the riots and he joins to discuss how to end the violence in his state. when will new york governor andrew cuomo respond to the report his administration dramatically underreported nursing home deaths from covid-19? now you can sell your policy, even a term policy, for an immediate cash payment. we thought we had planned carefully for our retirement. but we quickly realized that we needed a way to supplement our income. if you have one hundred thousand dollars or more of life insurance you may qualify to sell your policy. don't cancel or let your policy lapse without finding out what it's worth. visit conventrydirect.com to find out if you policy qualifies. or call the number on your screen. coventry direct, redefining insurance. >> bill: investigation by the new york attorney general finding the state undercounted coronavirus deaths in nursing homes by as much as 50%. the lower number impeded efforts to make those facilities safer. the cover of the "new york post" reads this. deadly lies. we've been on the story from the beginning and we pick it up today in brooklyn. good morning. >> good morning. despite months of pressure and lawsuit new york governor andrew cuomo and his administration refuse to reveal the true number of nursing home residents that died until now. the attorney general released a report. the state department of health decided after that to reveal that 12,743 people who lived at nursing homes died of covid-19. that's about 4,000 more than the cuomo administration had acknowledged before. that's because new york had only been counting those who died at the homes, not those who died after being transferred to hospitals. now with the new death toll new york now tops the list as the state with the highest number of covid-19 deaths in long-term care facilities nationwide. for months grieving families and lawmakers believed that the state had been intentionally playing down the number of deaths to avoid blame. the department of health commissioner howard zucker released a 1700 word statement yesterday saying this does not change the total count of covid-19 deaths. it is just a different way of breaking down the data. he went on to blame others for the nursing home tragedy, quote, ultimately the oag's report demonstrates the recurring problems in nursing homes and by facility operators resulted from a complete abdication by the trump administration of its duty to manage this pandemic. all of this confirms that many nursing home operators made grave mistakes and were not adequately prepared for this pandemic. the a.g.'s report notes that nursing homes in new york did not have enough ppe, personal protective equipment nor did they have enough covid-19 testing. we spoke to the head of a group that represents many nursing homes in new york who says politicians abandoned them. >> at new york state policymakers did not prioritize nursing homes with equal priority as they did hospitals. >> we have reached out to the governor's office and still awaiting a direct comment from governor cuomo. >> bill: we await that. >> dana: thank you, we want to bring in a former assistant hhs secretary and coronavirus testing czar. good morning. >> bill: if we assumed what they were doing last march and april. they did not. why should we assume they know what they're doing now. >> i think the report yesterday speaks for itself that it was truly a tragic and anti-science-based decision to send sick infectious people back to nursing homes. if there were ever the public health equivalent of putting out the fire with gasoline that's exactly what happened. i think the report yesterday just shows the tragic consequences are even now becoming more evident. >> bill: back to the question why should we assume that what they are telling us now is correct? >> you know, again i read the report yesterday. i think the report is very fact based. i think the attorney general did a good job. i can't say whether it's 12,000 or 8,000 or 15,000. but the bottom line is just this. it was a poor decision at the time that cost many lives. the number of lives it cost was amplified yesterday by the attorney general's report. clearly nursing homes were the most severely affected population, they were the most at risk and vulnerable. the one place you don't send infected patients back to is nursing homes. there were numerous other choices that were better. every choice would have been better than that. i think you are seeing the tragic consequences of that. >> bill: they were defenseless. >> dana: the governor blames the federal government for that. do you want to comment on that? andrew cuomo said the federal government is the one who gave the guidelines initially. >> that's completely non-true. what governor cuomo said is the nursing homes had to take back these patients. mandated to do that. what the cdc said is under very specific circumstances where a nursing home had all the training, ppe, isolation requirements, all the staff and training, then it would be permissible to do so. in no way was this federal government guidance. that is absolutely wrong and he can't shift the blame. he has to own this one. >> dana: let me ask you about this. new variants including the one from brazil and south africa and the two people in south carolina test positive with that variant yesterday. they didn't know each other, hadn't traveled. because you understand testing so well, as more americans get tested do these tests keep up with the variants? >> so in general the tests we have will not detect that it is a specific variant. if you are with a variant you will test positive but the normal routine test will not tell you whether you have a variant or not. that has to go to a different type of test called sequencing where the entire genetic code of that virus is sequenced or the portions there. that is done more of a surveillance method not routine testing. >> bill: i want to make one more point about these nursing homes. in new york 70% of the 35,000 deaths in the state were people age 70 and older. really just breaks your heart for what these people had gone through. there is a push now to break down some barriers you tried to set up to prevent opioid abuse during your time the last four years. what is your concern now with the new administration about that? >> well, it is probably one of the most inconceivable and anti-science decisions and anti-patient decisions i could ever imagine. right now one million physicians can prescribe oxycodone, morphine, fentanyl to any patient they want. because of antiquated laws and overregulation over 66,000 of those 1 million can prescribe medication assisted treatment that is the number one treatment we have against opioid use disorder. what we did was issue practice guidelines that would allow any physician who can prescribe morphine or oxy to also be able to prescribe the lifesaving treatment. the biden administration reversed this. it is inconceivable to me. nearly every medical society supports this. the national academy of medicine. 39 know that the opioid crisis is getting worse. partially because of the pandemic. we expect that there will be 85 to 90,000 deaths in the u.s. in 2020 due to drug overdoses. the majority of them are due to opioids. this is one thing we can do, provide treatment. how can the democrats be against providing treatment to all those who need it? what do you think? >> let's find out what the administration wants to do. this economy is very strong underlying if you look at the fourth quarter. 4% growth. if you look how we survived last year a terrible year, the economy came through it in a pretty remarkable way. into 2021 we should have a lot of momentum. the question is what kind of policy are we going to have? are businesses going to have incentives to invest and be excited starting new projects or will they look at the executive orders and say oh oh, i don't want to touch that because anything could be undone with a stroke of a pen. >> dana: when you look at executive orders and a big covid relief bill the "wall street journal" editorial said today the truth is mr. biden is inheriting a recovering economy poised to surge once there is enough herd immunity. the threats to growth will come when mr. biden the regulations and tax increases arrive. does it show a need for such a broad bush big package instead of mortar geted relief for the people who need it? >> i favor targeted relief and a big package. the economy recovered half the hole that we dug when the crisis began and stalled out. look at the jobs numbers. this is not a great economy. the economy is starting to fall apart precisely because under the trump administration we did not get control of the virus. and now we have to turn that around. for as long as the virus rages you are going to need relief money. >> bill: it grew by 4% in the fourth quarter, 33% prior. the point of the piece is that we're on the way up. that's a good thing. the question is whether or not the policies stunt the growth. bill deblasio in new york says he will redistribute the wealth of the city. elizabeth warren is on cnbc saying what they want to do is not only keep their wealth but build their wealth faster. i thought that was the idea. that's capitalism, brian and what rich people do. >> this war on wealth, this war on the idea of generating wealth is so unhelpful. go back to how it hits average people. when you generate wealth, when you create capital that's what gets invested into new businesses and where the hiring comes from. austan talks about the labor market situation. we want to see more hiring. guess what? you have to give businesses a reason to invest. if you are attacking wealth, if you are attacking the generation of capital that goes into those businesses, you are not going to get the hiring. let's get the messaging right and let's not give businesses the sense that they will be hitting massive regulations this year which will only discourage them from building and growing their businesses. >> dana: from an economic standpoint do you support a big tax increase going into 2021? we have to ask the expert. chris wallace anchors "fox news sunday". thank you for being with us, chris. we'll see how the briefing goes. bring the news as it comes. actually she just started. let's listen to her quick. >> health guidelines until their turn to get vaccinated. there may be a lot of questions for us about the trial data or johnson & johnson. i won't get ahead of the experts who you will all get to hear from in the next hour in our public health briefing from the covid response team. they will discuss this more with you and what everything means then. at wednesday's briefing i also shared some of the engagement and outreach the white house is doing to move forward the american rescue plan from the president and the vice president on down. that work has continued and accelerated. yesterday senior staff spoke again to governors about the challenges they're facing and the importance of relief. today national economic council deputy director will meet with the council of state governments. the office of public engagement will brief black civic group and hunger and nutrition advocates and invite feedback. these conversations are critical to moving the president's bill forward and getting support. we also saw evidence this week the american people overwhelmingly want their elected leaders to work with the president to confront the pandemic and put people back to work. according to a poll released wednesday 71% of the american people what republicans in congress to work with president biden. that number is up nearly 10 points from right after the election meaning the trend of support for working in a bipartisan manner with the president is only growing. finally, the president is committed to getting relief to working families, hence he is also meeting this morning with his economic members of his economic team with the vice president and treasury secretary janet yellen for a briefing on the cost of inaction and the impact of a delay in moving forward with a relief package. millions of americans don't have enough food to eat and millions more lost their jobs. interest rates are at historic lows and it means it's the right time to make smart investments. moody's said we could end up with 4 million fewer jobs if we don't act on the president's plan. 4 million americans who could get back to work. i'm sure they will discuss all of that at their briefing later this morning. last thing we're venturing to provide a week ahead to all of you or return to provide a week ahead to all of you. so a quick preview next monday the president will meet with the secretary of state at the state department. on tuesday president biden will deliver remarks and sign an executive order advancing his priority to modernize our immigration system and friday is, of course, jobs day and the president will deliver remarks about the economy. we'll have hopefully more over the next couple of days but wanted the provide as many details as we could. with that why don't you kick us off? >> with violence surging in afghanistan is the president still committed to winding down operations there and bringing troops home? >> the president -- i have not spoken to our national security team about this. his commitment remains. >> at the top you mentioned that americans should follow public health guidance. one of the challenges has been public health guidance from state to state varies. some states have mask mandates and dining open and schools open, others -- what guidance should the american people follow? their governor's guidance or the president? >> well first what we're venturing to do is provide more concrete guidance from the federal government, from the cdc, from health and medical experts on the important steps all american people can take to keep themselves safe that includes the importance of mask wearing, of course. and how vital that is to keeping us safe. it also includes the importance of hand washing, of restricting travel. these are all guidelines that have come in recent days and weeks i should say from the president of the united states and from our medical and health experts. in addition as we discussed yesterday, there are guidelines including the -- for the safe reopening of schools he signed an executive order on directing both the department of education and cdc to produce those guidelines to give more specific advice and markers to states and local school districts on what they should follow. so it will ultimately be up to states to governors, to local school districts and others the make determinations but provide more clear guidance from the federal government based on the expertise of health and medical experts what people should follow and keep the american people safe. >> the cdc study was discussed a couple of days ago one was part of reopening schools was close indoor dining and restaurants and bars. is that a part of the federal guidance that we should be expecting to see from the cdc and department of education, too? >> the good news is you get to hear from the director of the cdc in about 45 minutes and medical and health experts and you can ask them if there will be any updated guidance. go ahead. >> dr. fauci says the u.s. may not be able to meet that goal of reopening most grade schools in 100 days because of the trajectory of the pandemic. is the president going to adjust his goal of trying to get the schools reopened in 100 days? >> as we talked about a little bit yesterday the president wants to not only reopen schools he wants the schools to stay open and -- but he does rely on the guidance of his health and medical experts. he is not going to do anything that is not safe and doesn't keep teachers, students, and our school districts safe. but a key part of this is the guidelines as we mentioned. the executive order he signed to insure that school districts are getting the information they need and clarity they need on what steps that they should take to keep their students safe and teachers safe, of course. it is also funding. we've talked about this quite a bit in here. the american rescue plan is pivotal for a number of reasons. including there is food on the table and shots into the arms of people across the country but also that school districts, public schools have the funding they need to take steps on everything from ventilation to ppe to testing. and the longer that's delayed, the harder it is going to be to meet that goal. >> has president biden spoken to former president trump since taking office? if so, can you give us any update on what president trump said in his letter to president biden? >> i don't have any updates or calls to report on. there are no calls to report on, i should say. i don't have any update on the letter. as i said when we talked about this about a week and a half ago. it seems longer than that. the president thought the letter was gracious and generous but he plans to keep it private. go ahead. >> i understand you don't want to get too much into the johnson & johnson vaccine given the data that's out there but it likely won't be the only vaccine that is less effective than the pfizer and moderna vaccines. i wonder what is the president's message to those americans who would be more reluctant to get one of those less effective vaccines and are you concerned about the impact that would have given how many doses have already been bought on the front? >> first, when the president announced his plan earlier this week to insure we have enough vaccines to give every american two shots by the end of the summer with the purchase of moderna and pfizer vaccines he was doing it without the need for additional vaccines approved. if additional vaccines go through the fda approval process that's a positive step. in doubt about that. he purchased these -- the large orders for vaccines that we'll have by the end of the summer to get into the arms of americans to insure we would be able to do that even without any of those steps moving forward. >> you would encourage americans to get any vaccine that is approved by the fda for emergency use authorization? >> we won't get ahead of the fda. but we'll rely on our health and medical experts to advise if there are additional vaccines if and when i'll be optimistic that are approved by the fda and how it will impact our vaccine distribution plan. >> on the coronavirus relief bill his first month in office president obama traveled to a number of key states to drum up support for the recovery act. does president biden have any plans to do something similar to drum up support for his 1. trillion dollar coronavirus relief bill? >> then vice president biden also traveled to a number of states to drum up support for the american recovery act at the time. we weren't dealing with a pandemic. the circumstances were quite different. he fully recognizes the importance of speaking directly to the american people about the components of this package. whether it's the importance of funding to get schools open or get vaccines in the arms of americans or insure that people know they can put food on the table. so we are having to take a number of creative steps to do that. whether it's direct television or local media, or from the president, the vice president and others. we're doing that. whether it is engaging with governors and local elected officials to insure we're answering all the questions they have and they can convey to the public. so we're taking a number of creative steps outside of the box. preference would be to get on a plane and fly around the country. it's not a step we're planning. >> president biden did travel a fair amount in the final weeks of the campaign. he has received both doses of the vaccine and the number of safety precautions are in place for his travel. >> it is about keeping the public safe and we're not going to do a rally with 20,000 people. it wouldn't be a recommendation from our health experts. >> to travel without a crowd and go into the country? >> we may travel certainly but i have nothing to preview for you at this point in time. what i'm conveying it is vital for the president and the vice president and every member of our team to be speaking directly to the american people and so we're looking for creative ways to do that. >> after navalny was poisoned last summer biden said there was no doubt the kremlin was responsible for his poisoning and vowed to hold the putin regime accountable. the president conveyed his concerns to president putin but hasn't taken any actions to hold russia accountable. does president biden hold president putin directly responsible for the poisoning of navalny and if so, why hasn't he taken sanctions action to punish russia for its actions? >> well first the president spoke with president putin earlier this week as you know. he did not hold back in his concerns about a number of the actions of the kremlin and of the russian government. there is a review underway we've spoken about a bit in here by our national security team and we'll let that review carry forward. that includes the solar winds breach. poisoning of navalny, includes the kind of losing my thought here but it includes a number of steps, a number of concerning actions they've taken. we want that review to carry forward and to be completed and the president always reserves the right to respond in the manner of his choosing and the time of his choosing. >> will he hold putin responsible? >> we'll let the review carry forward and we'll have more to say about it that the point in time. >> the new york attorney general released a report yesterday saying that the state had under counted the number of covid deaths by as much as 50% in nursing homes. would president biden support a federal investigation into what happened and governor cuomo's role? >> i've seen those reports. any investigation i would point to the department of justice. >> does the white house think it should be looked into further? >> any investigation would be led by the department of justice. we are oef in a new age. they're independent and they'll determine what paths they take moving forward. >> on immigration you said yesterday it was never 100% today would be immigration day, it was an early draft and things change. can you help us understand what exactly changed and why it is taking a little bit longer for these executive orders and actions on immigration to execute? >> sure. one it's been widely reported that the president is planning to announce his task force -- plans to announce his launch of a task force on reunifying families and children. something that he is personally committed and his wife is personally invested in and make that announcement next tuesday. the task force will be led by secretary of homeland security once confirmed mayorkas and we plan to sign that executive order today or at the end of this week i should say. early plans sometimes do change and that was a draft plan which those change many times, i can assure you from sitting through many scheduling meetings. we had planned to do it this week because we had hoped that mayorkas would be confirmed by the end of this week. because of the filibuster of his nomination, we expect him to be confirmed on monday evening and therefore the president will sign it on tuesday and then secretary mayorkas will be overseeing that moving forward. >> one more question. can you give us a little more timeline in terms of how much longer you think it will take for the white house to engage with iran on its nuclear program because you had one of iran's top diplomats saying yesterday it believes the window is closing. >> well, i'm not going to give the timeline on it. it requires iran complying with the requirements of the nuclear deal. we've said previously but i will reiterate here that the president also sees it as an opportunity to build on the plan from there and i just want to make sure i give you the exact language. he believes that through diplomacy the u.s. should strengthen the nuclear constraints and address other issues of concerning including iran's ballistic missiles program and regional activity. but again iran must resume compliance with the significant nuclear constraints under the deal. he also talked about and we've talked about how working with our partners and allies, including the europeans, members of the p5 plus 1 pivotal any engagement moving forward and the future what the iran nuclear deal is. >> would the president consider -- [inaudible] maybe following president obama's example having a conversation with him? >> i think we're getting ahead of where we are in the process. the first step here is for iran to comply with the significant nuclear constraints under the deal. i'm certain we'll continue to discuss this issue in here and at the state department and other parts of government. go ahead. steve collins. i didn't recognition you with your mask. >> did president biden call on putin to release navalny? >> yes, as we have publicly and as our team has repeatedly called for through the course of the last several weeks. in terms of the specifics of the conversation i don't have any more details four on that. >> you don't know what putin said or did he make any promises? >> i don't have anything to read out on president putin's comments. >> is there a public role the white house can play in educating people in the dangers of this behavior? >> i point you to a statement by the sec. we respect the role of regulatory agencies. they are closely monitoring the situation but it is under their purview at this point in time. part of our education can be conveying to people the sec is the regulatory body that would oversee this and can speak to it further. go ahead. >> on security. the acting chief of police on capitol hill recommended permanent fencing around the cap to. i was wondering if the biden white house or president biden has any thoughts on this permanent fencing if that's the right answer, does it project the wrong picture to the american public? >> i'm not sure we'll have any comment on that specifically. i'm happy to talk to our national security and homeland security team if we have anything further to add. >> speaker pelosi said i believe it was yesterday she feels that threats are coming from inside the house. other members being allowed to carry guns and conspiracy theorists among the ranks of the gop now. do you have and does the white house agree with that assessment that there is threats coming inside the house? has biden spoken to pelosi and he is worried about the physical safety of members of congress? >> he speaks with speaker pelosi and reiterated his support for her and members of the caucus and he has spoken publicly about his concerns about the rhetoric around the events of january 6. some of the rhetoric that has continued and the role of social media platforms. he is in close touch with her about events on the capitol, about the safety of members, i don't think i have anything more for you to read out beyond that. go ahead in the back. >> two quick foreign, one domestic. can you confirm officially that o'malley has been appointed special envoy for iran? >> i believe it was announced this morning, yes. i guess i can confirm it here for you. >> -- a major obstacle to getting the palestinians back to the negotiating table. would president biden consider -- does he believe settlements are -- should be halted in the west bank so that the palestinians will come back? >> i don't have any new comments from president biden on this or the current circumstance. he has spoken to this particular issue in the past and conveyed that he doesn't believe security assistance should be tied but i don't have anything more for you on the path forward for the two-state solution. >> the capitol hill fence. a temporary fence around the white house up since last summer. president trump took a lot of criticism for it. would president biden considering bringing that fence down so people can take photos in front of the white house again? >> i think we would all like that including members of my family and people in washington but i will talk to our security team and see if there is anything further to convey to all of you. go ahead. >> as you guys are thinking about the task force to reunite the parents and separated children what are you learning about the scope of that challenge? is it something that groups have tried to do in the past and failed. how many people would need to be tasked to that to actually make it effective? >> those are excellent questions and i expect that when we announce -- when the president signs the executive order next week and put the task force together and mayorkas is confirmed as secretary of homeland security we can have him come to the briefing room but there is no question that we recognize this is going to be incredibly challenging. that there will be a lot of work to be done. that is why this will be a priority, not only a priority for the president but secretary mayorkas. but i will leave it to him and to others at the department of homeland security to preview for you the path forward. go ahead. >> thank you. i know president biden and first lady are aware of the sacrifices that military families make. that being said we have an incident with the garage with the national guard that was kind of embarrassing and now i'm hearing from guard members that they had a covid outbreak and were not tested or vaccinated before they arrived in d.c. i'm wondering if there is any concern by the president about how these guardsmen are being treated, whether he can do anything specifically to safeguard their health before they arrive, while they are here. can he get vaccinations to and testing to governors specifically for the purpose of providing some health safeguards to these soldiers? >> well, as you noted at the beginning of your question but i would just reiterate, the role of the national guard and i've spoken to the president about this directly and the incredible sacrifices they make is something that is personal to him given his family connection to the national guard. he had called the head of the national guard just last week when the reports came out about the treatment of the national guard and the fact many had been sleeping in garages and of course conveyed his dismay of the photos he had seen and their treatment and also offered his personally any help that he could provide even if it was boosting morale. that line of communication remains open should there be something that he can do from his end. in terms of specific prioritization of the vaccine i would point you to the department of defense and leaders over there to speak to that more specifically. >> one follow up. on the question of nancy pelosi's talking about the enemy within, has the president been briefed on such a threat? does he agree that the national guard should be here until mid-march during the impeachment trial? >> i'll speak to the department of homeland security colleagues here to see if there is more specifics we have from our end. i would point you to the department of defense and national guard team otherwise. >> the reporter asked i've learned the irs employees nationwide are having telework suspended and being called back into the office despite a directive tuesday to have federal agencies have 25% capacity. if irs employees have been doing telework successfully why is it now to bring them back into the office? >> i would point to the department of treasury for comment on that. >> on the defense production act. you've been asked about specific instances of the defense production act being used. ron klain suggested yesterday it was being used as it relates to the production of n-95 masks, anything specific you can tell us on that or any other companies or products where the act is being used now? >> we won't get into specific companies. there are procurement processes here that take place at federal agencies but also we're still early in the process. it was invoked just last week. more specific detail in terms of how we plan to use it on vaccine supply. i think products that ron klain spoke about was low dead space syringes are the key to getting more vaccines into the public. n-95 masks, isolation gowns, nitro gloves, safe and keeping people safe from infection. high absorbent swabs for testing and lipid nanoparticles key to the mrna vaccine and bags that they are produced in. a lot of this is materials that will help insure the vaccine can be used by vaccinateors and transported to various locations. >> at the national security agency michael ellis a trump political appointee was installed as the general counsel, a career position as you know. is -- are you guys considering reviewing that decision or attempting to remove michael ellis from his position as general counsel of the nsa? >> i don't have anything new for you on that. i don't have personnel announcements. we are re viewing personnel across government most political appointees have left. i don't have anything new on decisions there. i promised you, go ahead. >> bill: fema has asked active duty troops, the use of vaccinations centers. does the white house support that request? >> i asked our team about this. i think i have something on it, one moment. thanks for your patience. lots to say about covid, no doubt about it. let's see. let me talk to our team about it. i know i've seen that request from fema. part of our objective is insuring that we have vaccinateors on the ground. i know that's not what you were asking about but the ability to move materials and move vaccines. so we are tapping into any resource we can. but it is more predominantly focused on a health and medical core and the ability to get those people into communities. i will check with our team and get you something more specific. >> double masking. there has been increased discussion about that publicly. we've seen pictures of the president double masking and those around him. is that a personal preference or has he been adviseed by his medical advisors to do that? >> you'll talk to the medical advisors in the next 15 or 30 minutes and you can ask them. there hasn't been specific cdc guidance as you have seen dr. fauci spoke to this i believe in the last couple days and said it was common sense or made sense. i can't remember how he phrased it. there hasn't been additional medical guidance given. i've been around the president where he has been wearing one mask. he abides by the health and medical advice. it looks like two masks sometimes because we put the n-95 one on and more comfortable to have this on on top of it. i would encourage you to ask the medical teams during the call coming up. >> did the white house have advance notice of the johnson & johnson results and did that affect the white house's decision to purchase 200 million doses from pfizer and moderna? >> the decision was made to purchase the pfizer and moderna doses to insure we had enough doses to give two shots to americans by the end of the summer. and we did our planning without the need for an additional vaccine to go through approval. remember, even though we saw the news this morning we don't have a timeline of fda approval. we leave that to the fda. go ahead. >> a couple questions on the economy. starting with china. president trump signed a phase one trade deal with beijing. does president biden consider that -- >> bill: we have a laundry list today. a lot of topics there. what hasn't come up with prominent recognition is this nursing home story here in the state of new york. >> dana: everybody gets a choice what they'll ask. they decided not to ask about it. >> bill: maybe it comes up. if it does we'll get you back there. >> dana: we also know andrew cuomo the governor of new york is slated to make a statement and hopefully i guess he would take questions an hour from now. >> bill: that will happen at 11:30 eastern. we'll take you there, too, about the covid response here. state a.g. released a scathing report on the handling of the virus pandemic in nursing homes in new york. now that investigation finding up to 50% more nursing home residents may have died than the state previously report. it is called deadly lies in the post. we'll talk about it with mercedes cohen and joe concha. welcome to you. stunning numbers. mike lawler, let's begin with you. where does it go? >> just the other day governor cuomo said incompetent government kills people. yesterday attorney general confirmed it. what's clear over the past many months is that the governor's administration has covered up the total number of deaths from their directives that they issued on march 25th and the attorney general's report makes it clear that that policy had a very real and direct impact killing thousands of nursing home patients and residents unnecessarily. so when the governor talks about incompetent government, he was talking about himself. and what i and many of my colleagues are calling for today is for the legislature to revoke his emergency powers that he has had since last march, unilateral control over the response in new york, and to start holding him accountable and the decisions that his administration has made from the nursing homes, to the vaccine distribution, to shutting down our restaurants and small businesses, and religious institutions. we are a co-equal branch of government and we need to act like it. i'm hopeful that many of my colleagues will use this as a wake-up call to rein in this government's emergency powers and return to order in the state legislature. >> dana: i want to play you sound from admiral giroir talking about how governor cuomo has often blamed the federal government for this. here is how he responded. >> what governor cuomo said is the nursing homes had to take back these patients. they were mandated to do that. what the cdc said is under very specific circumstances where a nursing home had all the training, ppe, all the isolation requirements, all the staff and training. then it would be permissible to do so. in no way was this federal government guidance. that's absolutely wrong and he can't shift the blame. he has to own this one. >> dana: is there a legal component to this, any liability for the governor of the state? >> well, that's a great question because frankly there is immunity for public officials. so he may be able to trigger that immunity to protect himself unless she established his gross negligence led to the deaths of this poor population. the problem. you have a lot of finger pointing. people are already starting to sue the nursing homes saying you faltered and didn't follow these policies. even the government says you didn't follow the policies that were required and therefore that led to the deaths. there will be a lot of finger pointing if we point to the government, certainly the nursing homes may actually say we just follow what we were told to do. if they are going to be -- if that blame will be shifted to the nursing homes they will turn around and say oh no, we followed what we were told to do and unfortunately we may not have had the proper staff. we didn't have the ppes and let's be honest this is a virus that has taken the world by storm. you can't just blame us for all of it. >> bill: march, april and may of last year all over the country watching the briefings. he was really treated as a media darling. here is the amount of coverage given on this so far. abc zero. cbs, 8 minutes. nbc minute half. cnn8 minutes. cnbc 3 minutes. >> let's say if it was instead of andrew cuomo, governor, democrat, new york. ron desantis, republican, florida, i have the feeling those numbers would be double and triple the coverage. during the press briefing you caught me looking at my phone. i looked. there was a question about this to white house press secretary jen psaki whether there would be a federal investigation launched in addition to the new york state investigation into this report. and psaki punted and said that's something for the d.o.j. to decide. the question i would have asked governor cuomo was on president biden's then candidate biden's short list for attorney general and spoke on his behalf at the democratic national convention. will president biden pick up the phone and talk to andrew cuomo and say what exactly happened here? and what are we going to do about this? because at this point andrew cuomo can't say this is trump's fault. this isn't a trump thing anymore. this is a new york investigation into the actions of a new york governor. i have a feeling now in 2022 he may not run for governor. this is something that is now on the front page of the "new york times." this is something he can't run from anymore and say it's a conservative media thing. it may result perhaps in a governor dean. i'm talking about governor janice dean and perhaps instayed of political machines we'll have weather machines in politics and it could be a good thing. >> dana: mike, can we ask you about that? there will be -- elections have consequences and it is one way to hold an elected official accountable. >> absolutely. and this governor has got away with many poor policy decisions over the years. i think for once something may stick. this was a democrat attorney general who released this report. i have democratic colleagues in the legislature who have joined my calls for investigations. there has already been threats of subpoenas. yesterday when the governor and the commissioner of the department of health finally responded to this, they acknowledged that the number is, in fact, accurate. that you know what? however, it is quite eye opening. if you will take all of this action in the first nine days of your presidency and not even try to have a meeting with somebody like a kevin mccarthy to see what could be possible in working with the opposition, what does that say about unity and how we move forward? >> well, you are 100% right, dana. there are two ways to look at this. one is political and it is a total gift to the republican party because you look at some other republicans and we have a diverse party but you look at things even meghan mccain said about it. ron johnson. the spectrum of our party is all condemning this action and saying exactly what you said. you ran on this idea of unity and anti-governing through executive orders and now you have done the opposite. the other way to look at it is it's terrible policy. when you eliminate gas and oil industry from america. you put a piece of legislation in or executive order that says we'll fund abortions internationally with taxpayer money, when you get back into the paris agreement that's the opposite of america first. so you put policy on the table and politically you unify a republican party that has bickering with each other over the last several weeks. >> bill: dana mentioned kevin mccarthy. he was down with president trump in florida. here is part of the statement he put out. for the sake of the country, the radical democratic agenda must be stopped. united conservative movement will strengthen the bonds of our citizens and uphold the freedoms our country was founded on. in addition to that statement he said the president is committed to working for the republican party and getting republicans elected in congress in the year 2022. what do you want to add to that today, reince? >> well look, bill, the president still is the most popular person in the republican party. so i don't think republicans need to be wasting their time debating about whether the party is moving forward with or without trump. we're moving forward with trump and all of those things are great but i think it's a bit of a waste of time. what we need to do as a party is telling people what we stand for. if 2022 is a debate about what republicans believe and what democrats believe we'll have a much better chance in 2022. go back to 1992. the party was decimated and what happened? we signed a contract with america. went out there and told what our ideas are, what we believed in, and we crushed the democrats. so 2022 has to be the focus. what we believe in, trump is on board, conservatives have to be on board. republicans on board and we will have a better opportunity. so my view is no talk about 2024. >> dana: sounds great and the class of 94 big deal. who comes up with the contract with america. president trump is not allowed to be on twitter or facebook not doing much media since the election. who and how?
