hospitalized after being diagnosed with the virus earlier this month and he was supposed to be sworn into office this sunday. we will have more on this in just a few moments. and i now to this fox news alert, the irs is sending out the first round of $600 stimulus checks as lawmakers battle over the $2,000 payments the president is asking for. president trump's say republicans should get on board unless they have a "death wish." good morning everyone, i'm sandra smith. we made it to wednesday. >> good morning sandra, i'm jon scott. senate minority leader mitch mcconnell blocked a vote on tying those payments, he is looking at other top priorities like repealing section 2:30 which protects civil media platforms from civil liabilities. chuck schumer because of the blatant attempt to ensure the legislation never passes. >> if the president highlighted three issues of national significance which you would like to see congress tackle together. this week the senate will begin our process to bring these three priorities into focus. >> leader mcconnell holds the key to unlocking this dilemma. the solution is a simple one. put both bills up for a simple up or down vote and then let the chips fall where they may. >> sandra: which brings us to this morning, rich edson is reporting live from palm beach, florida, where the president is spending the holidays. good morning from sunny florida. the president is showing some frustration with senate republicans, where do things stand this morning? >> he is, and good morning. but we have here is the president pushing congress to more than tripled a $600 payments. at the house has already approved it and now it's stuck in the republican-controlled senate. to that, the president tweeted "unless republicans have a death wish and it's also the right thing to do, they must approve the $2,000 payments asap." $600 is not enough. also get rid of section 2:30, don't let big tech steal our country. "in the fastest way to those $2,000 checks would be the senate, if they have the vote, to approve the bill to pass the house early this week and that's what democrats are pushing. >> they want help. the leaders of our country, president trump, president-elect biden, minority leader chuck schumer, speaker of the house nancy pelosi, are all in agreement. to raise the direct payment to $2,000. >> senate majority leader mitch mcconnell has initiated a process for a vote on those who thousand dollar checks but he is adding president trump's other demands to that bill. the repeal of a controversial law that gives tech companies certain legal protections and the creation of an election fraud commission. >> the democrats themselves held us up for months and so here in the last minute they are complaining about the normal operation of the senate. i'm an outsider to this process but i can tell you the three things that mitch mcconnell is trying to do are in line with what the president has said. i support with the president is trying to do. >> the bundling those 2,000 are checks with other priorities the president is pushing for also makes this bill more difficult to pass. sandra, back to you. >> sandra: rich edson reporting from west palm beach, florida. >> jon: voters have passed 2 million ballots in the senate runoff as georgia secretary of state slams the federal judge for reinstating more than 4,000 voters to the roles of the ahead of tuesday's election. the judge is the system of dumb academic sister of stacey abrams, the former gubernatorial candidate who's pushing efforts throughout georgia. for more on all this let's bring an peter doocy who is live on the ground in atlanta. >> 4,000 votes could make a difference in a state where the presidential election was only decided by 4,000 people, and those are change of address forms. the republicans tried to disenfranchise over 3,000 georgia voters. they respond to the suppression team where we will win. but those family ties are very troubling to the republican secretary of state here who is now saying this about judge leslie abrams a gardener. a judge would rule on a case brought to a group heavily funded by her sister and it's very concerning. stacey abrams and a fight is coming. the secretary of state added a direct attack on the rule of law and integrity of elections in georgia. billions of ballots have already been cast in this race and we are starting to get a better sense of why the big issues here, of what the big issues are here in a very testy campaign. >> back in the day they used to call it mudslinging. they are good candidates and not so good candidates and we need whatever works today. >> for me, i guess right now we are in the midst of this huge pandemic. if there a lot of different things people are trying to do. i think they had a good sense of their plans for it and how to go about it, and that was just the main topic. for me personally, -- well probably education. >> this morning we are in marietta, georgia, outside of the center of atlanta, and his boss is already here in the parking lot, democrat jon osso ossoff. jon scott? >> jon: peter, thank you very much. >> sandra: let's bring in newt gingrich, speaker of the house and fox news contributor. mr. speaker, always good to see you. as far as the sister of stacey abrams on this case, and we will likely hear more about this at the news conference but he's making the case that her sister, and obama appointed georgia judge undermined the rule of law, he claims, with the voter purge reversal. 4,000 people from these voter rolls, there was questions about their current residence he is, change in status, change of address status. he's saying that this was a direct attack on the rule of law. how you see it and should she have recused herself in this case? >> well of course she should have recused herself. how can you have your sister on the bench when you've given to it a half million dollars to the people filing the suit, how can your sister pretend to be a judge that's going to be neutral? this is one more example of why this year has had the most corrupt elections, i think in my lifetime and maybe a hundred years. also, notice what the argument of the democrat says. just because somebody has moved doesn't mean that they can't be voted even if they are no longer there. then, you have to wonder about all those drop boxes and that's both of those people who have already moved. and in only two counties we are talking about 4,000 votes and those aren't the really big county. so you've seen this again and again all across the country, a desire to maximize the vote of people who don't exist, people who died in people who moved out of state and in that sense what we are seeing in georgia is the same stuff that you've been watching. but also because of the election is so close next week and it's a very tight election, i think a combination of turning voters out and making sure the polls aren't stolen, those two things you probably decide the election because it's so close. but also i think that makes it important for the senate republicans to get a grip, and not try to play parliamentary games with the presidents twodollar payment. both senator perdue and senator loeffler have come out with the president's $2 payment proposal and i think 80% of the country favors it. the senate republicans risk throwing away two seats in controlled the senate when they play parliamentary games instead of having a straight up or down vote. >> sandra: all very important points, and as far as tying the two together, the outcome of those races down in georgia and the battle over the $2,000 payments, use lindsey graham on that. >> $600 is not enough. the president has dug in and wants support on a $2,000 payment to re-support that and he wants to repeal section 2:30 to keep big tech from running the country and to censoring conservatives. i support both of those and i think we will get a vote in the senate if we control the senate. if we lose georgia we will never get a vote on repealing section 2:30. >> sandra: the pressure is on mitch mcconnell right now, what's his next move when it comes to obviously those two big issues that he has to address, repealing section 2:30 in the $2,000 payments? >> he's an extraordinarily smart guy. he's focused on the senate and has booked the long game, it's a brilliant memoir. on this one company's frankly confused different things. the long-term control of the u.s. senate lies in georgia. both georgia senators have endorsed the $2,000 payment that president trump has proposed and mitch ought to bring up the clean vote. he can also bring up repealing section 2:30 which i support as lindsey graham does as a clean vote. he can bring up a fraud commission as a clean vote. but i really am very worried that if he plays it a clever parliamentary game it may looked good inside the senate but it could cost us two senate seats and control of the senate so i would beg him to bring up the $2,000 payment as a freestanding independent vote. not have people like senator loeffler and senator perdue able to come back and vote for it, take it off the table as an issue. because frankly, they could be in favor of the $2,000 unit and could tag mitch mcconnell for the next six days but i think it's very hard at that point to win the race. this is very straightforward. once we get this solved than it's a straightforward fight with two things. turn out and making sure the ballot count is honest and i think republicans have done a great job of developing the best grassroots george has ever seen. i know they are working very hard right now on making sure they would get an honest count. and it's important to also have the 2,000 -- >> sandra: brian kemp laying out the stakes last night, really quick. >> my message to the people is the same on the president had when he was here the other day, people need to get out and vote for david perdue and kelly loeffler to stop socialism and stop handing the key is to pelosi, schumer, bernie, aoc and the others. we are literally the redwall here in georgia so we have to have high turnout and i believe people will do that. >> sandra: we are about to hear from kelly loeffler as well. she's holding a rally. mr. speaker if you'd like to give us your message for your party and what's at stake? >> governor kemp is right. if every conservative turns out to both and i don't think they will be able to steal the election but if, in fact, it's too close and i think about as we just with stacey abrams sister, they have it so close that we might have it stolen. so every conservative in georgia should turn out to vote in which case i think we will be just fine next tuesday. >> sandra: brad raffensperger is about to hold a press conference and he will give us further details about how they are going to ensure the integrity and fairness of these elections. we all hope as americans. mr. speaker, we appreciate your time this morning as always, good to talk to you. >> jon: as coronavirus cases spread across the country, health officials in colorado have now confirmed to the first known case of the new covid strain first seen in the united kingdom. governor jared polis' morning residence there that this new strain is considered to be "significantly more contagious than the original virus. the discovery comes as president-elect joe biden accuses the trump administration of falling short of its goal to vaccinate 20 million americans by the end of the year. >> the trump administration's plan to distribute vaccines is falling far behind. as i long feared and warned the effort to distribute and administer the vaccine is not progressing as it should. the pace of the vaccination program is moving now and continues to move as it is now, it's going to take years, not months, to vaccinate the american people. >> jon: for more on elvis let's bring in fox news contributor guy benson. i suppose it's traditional may be for incoming presidents to criticize a person who is about to leave office but what do you think of joe biden's criticism, is this vaccine rollout slower than it really should be? >> jon i think there is probably a fair argument to make that we would love to see it go faster but there are a lot of moving parts to this and the fact that we are even talking about millions of people having been inoculated already is unto itself a bit of a miracle. so i think that some of this is political, frankly. this line that they are using, if we go at this pace it will take years to get everyone vaccinated. it's not going to continue at this pace, it's ramping up. because this is a country where we have a lot of diffused power, or states and local governments and even county by county of different policies, once operation warp speed gets these vaccine doses delivered there are different delivery systems in place all across the country. some are better than others. shout out to west virginia, other states and other counties around the country are going at a slower pace. i think it's completely legit to say, let's make sure this gets us streamlined as possible, let's find places where there are snags and delays that can be ironed out, but to pretend that the current pace is not ramping up and is going to be representative of where we are going to be even in a few weeks, i think part of that is partisan politics. >> jon: that something we said about vaccines and calendars. listen. >> let me be clear. i trust vaccines, i trust scientists and i don't trust donald trump. scientific breakthroughs don't care about calendars anymore than the virus does. they certainly don't adhere to election cycles. their timing, their approval and distribution should never, ever be distorted by political considerations. >> jon: distorted by political considerations. joe biden and his running mate kamala harris both casted doubt on any vaccine that might be developed under a trump administration so if there are americans out there right now who are doubtful of the vaccine and whether or not to get it, doesn't the incoming biden administration shares some of the blame? >> i would say certainly politicians have done that. joe biden asked a few questions and we heard some of the sound bites, his running mate as you mentioned john kamala harris, was even worse. she had to clean up what she was saying undermining public faith in this vaccine in both biden and harris has publicly taken the shot which i think is good. here's one other point about the process and how many americans have been vaccinated already. keep in mind we are still in 2020 and this pandemic started earlier this year. the fact that we are at this place is extraordinary right now, where we are even talking about millions of people having been vaccinated. the number being discussed all over the news of the moment is just over two 2 million americans and my understanding is based on a lot of people who i have read, who know what's actually happening on the ground. there is a delay or a lag of one, two, or three days before we get full information about all the data so my guess is millions more americans in the coming days will be officially vaccinated, they already have been. the data is just a little bit backed up. >> jon: guy benson, thank you very much. >> sandra: back to capitol hill this morning and more on the death of luke ludlow. he died from complications related to covid-19 just days before he was set to be sworn into office on sunday. congressman was 41 years old. leland bettered his live in washington. >> it's a mystery in so many ways. luke ludlow would have taken his old old boss a seat in congress right after the first of the year. he had been chief of staff and then won the seat in november. the advocate newspaper talk to the chancellor of the medical center at lsu where the he was in the icu. this gentleman had previously said that he had been treated with rimmed a severe and steroids and when asked if ludlow had any underlying conditions that would've made his death more likely the chancellor said, none. this is all covid related. >> he had just gotten elected three weeks ago. he had talked about the things he wanted to do in the committees he wanted to get on. talk about a loss of someone with so much energy, he's got a beautiful young family. my prayers are with julia and his two young kids. >> there is a picture of julia and his two young children. he passed away at age 41. the last representative elected i before taking office was jack swigert who died in 1982. his statue is one of the two from colorado that is currently in the capital. >> sandra: our prayers are with his wife and two young children that he leaves behind. leland, thank you. >> jon: with joe biden assuming the presidency about three weeks from now there are growing calls for the president-elect to get tougher on china. but just how far will biden go to counter the communist regime? >> if you have a gang related intentional murder like this, a seven year offer is unheard of and that's because backdoor, underhanded, unethical do's are just and appropriate. >> so using a prayer strike, a double prison term is unconstitutional and he believes using enhancements overcards prisons, arts minorities and increases crimes. we expect deputy d.a.'s to file that case this morning in superior court. >> jon: it seems pretty clear that he was asking his underlings to contravene state law. that section that you read from california state law makes it pretty clear that you have to consider prior convictions. >> right. and that's why they are filing the challenge or asking a judge to say, listen. we are in a bind to come between a rock and a hard spot. the boss is telling us to do one thing but the law, our ethical judgment, it was already represented to judges in pending cases that we believe this is in the public safety's interest. we work for the people of california and he's asking us to do something different, we can't make these two things work. that's why we are asking the court to intervene. >> jon: william la jeunesse, keep an eye on that story for us. we will be speaking with fernando rojo's sister-in-law amy and the family attorney about their claims of a sweetheart plea deal by a gascon advisor. that's coming up in the next hour. >> sandra: and secretary of state mike pompeo condemning china for sentencing a reporter who covered the wuhan covid outbreak to four years in prison. the chinese communist party has shown once again it will do whatever it takes to silence those who question the party official line, even regarding crucial public health information. lying is a feature, not a bug of authoritarian regime. michael pilsener joins us now as the author of "100 year marathon." this reporter was convicted on the offense of picking quarrels and provoking trouble. does anything about this surprise you? >> yes, it does. he serves as a hero really and exposing what happened and the original chinese communist line was that local authorities cover things up and xi jinping didn't know i think about it. by this sentence and this bizarre charge of picking quarrels, china really implies that they are covering up much more than we thought. that this woman as a citizen journalists really on her own with her cell phone was exposing a great deal of things that china does not want out. this hurts china's interest, it excites really bipartisan anger at china, there seems to be no limit to what they will do to crack down on whatever happened in the wuhan virus back in january. he remains a mystery and there has been no explanation for it. >> sandra: which rings a bigger concerns and questions about how they had administration will handle china and combat china and be tough on china like the current administration has been? here's a flashback to joe biden in 2019, michael. saying that china is not our competition. don't watch. >> china is going to eat our lunch. come on man. they are not bad folks, folks. but guess what? they are competition for us. >> sandra: so what does that tell you, michael? >> while there are a lot of people who support president trump who also believe china cannot compete, they are not going to eat our lunch. there is a famous book called the coming collapse of china 20 years ago by jordan chang. china hasn't collapsed and it's gotten five or six times stronger than the last 20 years so biden has drunk some of that kool-aid or he thinks china is weak and going to collapse. it's wrong and more and more people are telling them and president trump believe strongly that china could in fact surpass us, president trump said that many times it's part of the energy behind president trump's policy and the reason to be strong against china is they are neck and neck with us and they will surpass us unless we take really strong measures. so joe biden will have to listen to his new intelligence advisors when they come in and find out that china is really extremely strong and on the path, will be surpassing us quite soon. >> sandra: there are new reports emerging that the number of cases in the initial stages of this pandemic in wuhan could have been ten times higher than what they were reporting, meaning 500,000 people may have been infected in that city where the virus first emerged. gordon chang was on fox news earlier this morning and basically with a warning to anybody who doesn't think that china is a serious threat to this country. watch. >> he believes that they are not a threat. well if you don't believe they are not a threat then you can't defend the united states. by the way, china poses the greatest threat to the united states by far because if you look at russia, north korea, iran and other threats, those regimes are fueled by china. >> sandra: do you agree with that, michael? [grunting noise] i'll take that. woohoo! 30 grams of protein and 1 gram of sugar. ensure max protein. with nutrients to support immune health. >> sandra: a 7-month-old baby found safe after the car she was sleeping in the store on monday night near atlanta. police say her father went into a store and left the car running. he returned to find a man sitting in the driver's seat, who then sped away. police say it was this man, joshua rodriguez. the car was found abandoned less than a mile away with the child still in her car seat, unharmed. the search of the area led to that man's arrest. >> jon: new york congresswoman elise stefanik is slamming new york's governor andrew cuomo for prioritizing drug addicts and rehab when getting vaccinations before seniors for covid-19. she's calling him the worse governor in america. let's bring in our panel. andre clifton's former consultant to the obama campaign and principal at the clifton consulting firm. patrick griffin is a republican campaign strategist and founding partner and ceo of the firm. thanks both of you for being here on this wednesday. let me read first for our viewers the tweet from congresswoman elise stefanik. she writes "the worst governor in america streak continues, this time prioritizing vaccines for drug addicts over tens of thousands of seniors who have been homebound since the start of the pandemic, an absolute disgrace. this because it governor cuomo decreed that the office of adult services and supports is going to be given some of new york's first vaccines. that means, the people who are in drug addiction recovery programs, and there are 12 of them across the state, patrick, will be among the first to be vaccinated. you could say a head of nursing home residents. the governor says nursing homes will get the vaccine, too, but you can't do both at the same time i guess is what i'm saying. >> i'm not sure if i agree. andrew cuomo may be one of the worst governors in america but i believe gavin newsom was giving him a run for his money in california. so i will wait for the photo finish on that before i agree. but the bottom line is simple. the best indicator of future success is past performance and governor cuomo has made a series of ridiculous decisions as he has been leading new york. new york has led for capital deaths, new york is underreporting nursing home deaths. the governor refused to say he actually even read the states pandemic policy and of course, now we know he's not even able to get this administration of the vaccine right. this is a guy who has been so busy planting his book tour on leadership that he hasn't been able to plan how to effectively get this vaccination out to the people who need it most and first. at those should certainly be seniors in nursing homes who are already underserved, by the way. governor cuomo has brought death and destruction to the people of that state. it's sad and unbelievable but not unexpected. >> jon: marjorie, the elderly are by nature the most vulnerable population. why not take care of them and then move onto addiction centers? >> well first let me say this newest executive order is yet another dictatorial overreaction by our fine governor cuomo and for that reason there are several things wrong with it. first and foremost, here's what the governor is saying and that is, he wants to find providers a million bucks for saving lives because if they are meting out this vaccine to people and we need to, even if they are not in the phases that the governor has set forth, they are still saving lives, are they not? that's why we have the vaccine. so to be find million dollars is simply wrong. number two, these guidelines are either vague or confusing so that they are more bark than they are bite. some of these providers may think they are following the guidelines, sandra. if someone walks in and says on phase one, i'm a first responder, i work in health care, give me the vaccine, what is the provider supposed to do, turn them away, call the governor, take a background check? what are they to do when they had the vaccine available for human beings? >> sandra: now to how the patients could be involved. here's andrew cuomo talking about how anyone involved in this fraud could be held accountable. >> we will not tolerate any fraud in the vaccination proce process. anyone who engages in fraud is going to be held accountable. we want to send a clear signal to the providers that if you violate the law on these vaccinations we will find out and you will be prosecuted. >> defined fraud. first of all we are not talking about law, we are talking about an executive order. second of all, again. how are these provider supposed to know and how are the patient supposed to know whether or not they are technically within phase one, not within phase one and when they are allowed to get a life-saving vaccine. this is governor cuomo doing what he does best, dictating and playing god. people shouldn't tolerate it, his argument won't hold "if he does in fact try to find people millions of dollars. >> sandra: before you go i want to ask about this ongoing investigation the aspen area involving natural gas outage. the fbi has now been brought in. it's an aspen area natural gas outage the police say appears it was an intentional attack. what are we learning? >> early voting for the two senate comic runoff races, and it ends tomorrow. you can see some of those early vote ballots being sorted behind me and then they will be opened and scanned. already 2.3 million people have voted early and we have also learned that president-elect biden come to atlanta on monday to campaign for the two democrats, vice president-elect harris will come to savannah on sunday. at least two races have drawn national attention and national money. at more than $800 million in all, really tv ads blanketing the airways not just here in georgia but in tennessee, alabama and florida as well. of course georgia has been reliably republican for the past 28 years and that changed this time around with joe biden getting a narrow victory, just 12,000 votes out of almost 5 million votes cast. at least two senate runoff races expected to be razor close, come down to the wire and may not be decided on election day. there has been some concern among republicans that repeated accusations of fraud and the general election could tamper republican turnout. the president tweeting last night, i love the great state of georgia but the people who run it from the governor bryan camp to the secretary of state are a complete disaster and don't have a clue, or worse. nobody can be this stupid. just allow us to find a crime and turn the state republican. the president himself will return to georgia on monday to try to drive republican rural turnout for the two republican senators. john, back to you. >> jon: steve harrigan keeping an eye on things from georgia. >> sandra: meanwhile nikki haley is saying americans should be worried about the walk left under president-elect biden. the former u.n. prevent comic ambassador and candidate warning and a tweet that they want to use the full force of the government to achieve their radical goals. he said that includes pushing an anti-american worldview and classrooms. let's bring in ben domenech's, publisher of ""the federalist"." good to see you. what do you make up this morning, i should say continued warnings that we are hearing from nikki haley on this? >> i think she's trying to put herself in the conversation among many people who will be competing potentially in 2024 in the presidential race. i know nikki haley has a bit of a challenge there in the sense that so many other potential candidates have significant current political roles either as governors of states that could be fighting with the biden-harris agenda or as senators, or people prominent on capitol hill who can elevate their position and to take on a lot of these different issues through the mechanisms of government. nikki haley will have to work hard to put herself back in a conversation i feel because she does not have that necessary access to things. i would also be interested in seeing her opinion on some more i think difficult issues to navigate at this moment than taking on the walk left. i'd like to hear what she thinks about big tech, and certainly i think her warning will be one that is hailed by a lot of people going into 2024 and it will be a competition about how many people can critique it in the most pointed way. >> jon: here is his tweet, we should all be worried about the walk left, they stifle free speech in the name of freedom and then enact his criminal tory policy is in pursuit of inequality and do it with the vision that has no semblance to america we know and love. vinyl point on that, what is the talk within the republican party about her as a 2024 hopeful? >> it's generally positive but a lot of people are waiting to see how many of these figures are able to adapt to at this moment and navigated in an intelligent way? it will be a challenge for a lot of people to do this in the context of the fact that president trump himself might end up being the 800-pound gorilla in the room, potentially running again in 2024 or he might deign to pick one of these candidates to back end boost. i'm sure he will be offering us his critiques if you do so throughout the campaign. >> sandra: elise stefanik is weighing in on the decision by new york governor andrew cuomo to give vaccine priority to drug addicts over some seniors in his state. elise stefanik tweeted this "the worst governor street continues, this time prioritizing vaccines for drug addicts over tens of thousands of seniors who have been homebound since the start of the pandemic. an absolute disgrace. is this the right decision on the part of the governor and if not what sort of backlash could he receive for it? >> you know about a month ago governor cuomo was out there saying he was going to sue to have control of the vaccine process when it came to a potential feud with the trump administration. now that he has given control of it he's making already the same decisions we come to expect from him, full of bluster, full of stupidity and without any kind of thought for the elderly citizens of new york state. going forward we will see a patchwork of responses for the need to disturb it this vaccine and distributive appropriately and i think what we are seeing is the dangers of a centralized approach. imagine a system in which that aforementioned local left will determine which people should receive a vaccine based on mike based on equity, not the medical needs or health care needs of the people in the moment. but according to their own hierarchy of who would get it first. frankly, i don't know what that would look like. i don't even know where or how baldwin would end up on that one. but it's one of those situations where you see the danger of how these woke policies actually have an impact on people. it's not just off ads and people writing stupid things in "the new york times," it's now been implemented as policy and implemented i believe in a dangerous and backwards looking way. we should prioritize the people who are at the most risk and from my perspective, addicts are on that list but they are not the people who we should be prioritizing at the moment we should be elderly across the state. >> sandra: meanwhile says senator david perdue made some news on this program yesterday when he said this. watch. >> this should have been done four months ago and that's what the president has been saying the last four months but we were obstructed the senate by the democrats who were playing presidential politics the first time and now they are playing senatorial politics before the january 5th the election. i'm delighted to support the president and it's a 1400 the increment over what we've already done. with the vaccine coming i think this is appropriate so i fully support with the president is doing. >> sandra: he supports the payments and enter and dominate and this tweet. you say they are idiotic talking points, the $2,000 relief thing is -- negotiated the deal. the other than passes the $2,000 relief. i can't believe anyone would be so stupid as to believe either claim. explain. >> sandra, a book. i've heard this talking point quite a bit from a number of people in washington that it strikes me as very dumb. i think the fact is, we should have had more of this direct relief in the proposal from the beginning. steven mnuchin frankly, as the president himself likes to say, he's a democrat and he someone who has prioritize the business of big business and wall street and instead of doing more populous policies we would be directing two more middle and working-class people across the country with a check, frankly, that would really help them. especially here at the end of the year when so many people have so many things up in the air, they are worrying worried about making their next lease payment or the next car payment. in this instance david perdue has seen the writing on the wall which is this is a much bigger priority getting this through and sending a message to the people and voters of georgia that they can get it through than perhaps some of these other policy issues which while important are not the biggest thing when it comes to electoral politics. >> sandra: final thoughts. we had newt gingrich on earlier in the program and he was tying the overall battle for the $2,000 payments to what we are about to see happen for his party, for the republican party down in georgia and the impact that that battle could have on it. so many are tying those together, lindsey graham and others. what do you think ultimately in this battle, possibly a distraction from kelly loeffler and perdue trying to get their messages out, final thoughts on that? >> in this instance we are seeing a tug-of-war between people who want to go and the more popular trump direction where people want to go back to the way things were made before or eight years ago in terms of the approach to policy that they have. that's something that we play out going forward but this is really the first contest where we have the dispute within the republican party about which direction ought to be highlighted and taken. currently david perdue and kelly loeffler are making a bet on the president's policy and that something that they are seeing on the ground in terms of meeting the support from all of the people who came out and voted for in this time. we will see if we can motivate him again in a complex and difficult situation in this runoff. >> sandra: covered a lot of news between wednesday and new year's. >> jon: health officials confirm a mutation of the coronavirus that's even more highly contagious has not been detected in colorado. it was first seen in the united kingdom. anita vogel is following this from los angeles. >> good morning, it's all very much a mystery at this point but here is what we know. the patient is a man in his 20s who lives in elbert county, just outside of denver. he has apparently not traveled anywhere and is currently in isolation until he is medically cleared. lab workers in colorado identified the new variant in a test sample that was positive. they did extensive testing to verify it was in fact the new strain that has spread throughout the u.k. and a number of other countries. here is a tweet from the colorado governor. he says today we discovered colorado's first case of the covid-19 variant b117, the same variant discovered in the u.k. the health and safety of coloradans is our top priority and we will monitor this case as well as all covid-19 indicators very closely. now it is believed to be as much as 70% more contagious than previous strains but thankfully does not lead to more severe symptoms. we don't know how the young man contracted it, but health officials in denver are investigating and performing contacts tracing to find out who else might have it. here is that dr. anthony fauci's take on how to combat the variant strain. >> if we really put our foot pedal to the floor and do all the things, if you do that you will dampen transmissibility. >> elsewhere in the country, the regular covid cases remain on the rise in certain states and december is proving to be the deadliest month since the onset of the pandemic. roughly 65,000 people nationwide have perished so far this month alone, surpassing april's death toll of just over 60,000. california has been hit especially hard with more than 2 million deaths and hospitals are overflowing with patients, especially in central and southern california where i see your capacity is now at 0%. and much to the dismay of many people in those two regions here in california, those very strict very strict stay-at-home lockdown orders have been extended here until at least february. back to you. >> jon: i >> jon: anita vogel from los angeles. >> sandra: now to a manhunt of a suspected cop shooter coming to a close in west virginia. u.s. marshals are arresting kobe francis in clarksburg after he's accused of shooting a pennsylvania police officer outside of the station just over a week ago. the officer was wounded in the neck and shoulder. he's being extradited back to pennsylvania. now he faces multiple charges including attempted murder. >> jon: a celebration of teenage revenge and cancel culture getting front page coverage in "the new york time "the new york times." who is to blame? >> that was the university of tennessee. they have the reigning national champion cheer squad which is a very big deal. a lot of people say cheerleading isn't a sport, trust me, it is. it can be downright dangerous and it takes a real athlete to make a cheerleading squad like that. so the university of tennessee and come up they are culpable here as well, they bowed to the mob after this video was released on snapchat and tiktok and it goes viral. people who spot cheerleading team and then eventually she decided she doesn't want to go there anymore and now this girl who again said these comments at 15, she may be didn't understand the impact of those words. no one is defending that sort of language but then to release this for years later at the worst possible time for her, but then she's going be going to a college where they probably don't have a chilling squad and then "the new york times" six months later to celebrating cancel culture and putting her back in the news again. this has to be traumatic for her quite frankly i'm worried for her to be one and the kid who saved this video in what has to be considered sort of revenge posting, he says, you know, i taught somebody a lesson here. no, he ruin someone's life and future. >> that's exactly right. and if he had an issue with it, and i understand why he had an issue, that whole time he could've had a conversation with her inside, this is wrong what you said it, you should apologize, and she has. you have to understand the impact of your words. instead he does the currently thing that out right as she got into the university of tennessee and now that whole dream is over. for "the new york times" to take him and make them some sort of hero, is that the news that we are covering these days? i look at the traditional media in terms of, are they covering the story as well? fox news is for sure but nbc, cbs, cnn, "washington post," "chicago tribune," no one is touching the story for some reason. i don't know if it's because race is involved, because at last check race hasn't off-limits, and it's a conversation and meet with having every parent can relate to this or that they have young kids are kids in high school, teenagers, it's a story but it's being buried because we covered the food fights or a political stuff too much and not enough around human interest stories that actually matter to people. >> jon: i think the university of has to be asking everyone in the freshman class whether they have ever used that word and then they can apply just as equally. one more quick story. the county executive in erie county, new york, the democrat mark pullen cars is seen skating on an ice rink that has been closed because of covid concerns. now he put out a tweet saying i skated along. but at times in the video there are something like 14 other people seen on the ice with him. what do you think about this? well i won't characterize it, i will let you do that. >> rules for the "not for me" part nine. we don't seem to have any leaders that can follow their own rules and as a result people are saying, i follow the rules in march, april and may come all through the summer as far as social distancing, wearing masks and not going to places i'm not supposed to go. but instead as we saw with wisdom and policy and portable, i can down the line breaking rules. the people what i'm going to break the rules to them because we have leaders out there that can follow their own at this point and that's dangerous. >> jon: he said no rules were broken, i skated along before others arrived. well if others are on the ice you are not supposed to be there, right? >> sometimes justice moves at a snail's pace, but unfortunately the doj here in washington is standing ready to take action as soon as possible in this case. acting attorney general jeff rosen on the job just one week today made the announcement yesterday that he stands ready to prosecute this case and the united states if things do not happen in pakistan. this is over daniel pearl's murder back in 2002. the man convicted of killing pearl, and his name is omar sheikh. he was convicted but later acquitted in the 200 2002 murdef "the wall street journal" reporter after being kidnapped in pakistan. u.s. officials say several terrorists were behind pearl's untimely death and he was just 30 years old. sheikh was sentenced to death for his murder but earlier that year the conviction was overturned over evidence concerns. he was ordered released by the pakistani courts but pearl's family appealed to the country's supreme court. this is where the acting attorney general jeff rosen comes into the equation. he says if the court does not keep him in custody in pakistan that the doj here is ready to prosecute him. rosen released the statement, "we cannot allow him to evade justice for his role in daniel pearl's abduction and murder." in 2002 attorney general john ashcroft announced an indictment against sheikh for pearl's murder in the 1994 kidnapping of an american her wrist like a tourist name to nuss in india. sheikh was born in the united kingdom but had lived in pakistan for many years. he has been in jail since 2002 in pakistan. someone who knows a little bit about federal prosecutions in this country, former new jersey governor chris christie and for the former federal prosecutor, he wrote an op-ed in "the wall street journal" jon and he says the united states should extradite omar sheikh to the united states as soon as possible and give them a taste of american justice. >> jon: keep an eye on that one for us david, thank you. >> sandra: now we are hearing reports that police visited the home of the national bomb suspect more than a year before the christmas day bombing that rocked to that city. the suspect's girlfriend supposedly told police he was making explosives inside an rv back in october 2019. this contradicts why investigators said the suspect wasn't on the radar, right? >> it was 2016 and we were outside just hanging out and i had just gone in the house to sleep when i hear gunshots. i can come out to see my cousin laying on the front yard and all i was told was someone passed by and asked us if we and we said no we don't and they just started shooting and they shot my cousin. i saw him there on the floor lifeless. not knowing if he was alive or dead. >> jon: it was apparently a case of mistaken identity. a guy named rudy dominquez gets arrested and charged with the murder and he has a previous record, sam. then about ten days or two weeks ago, when the case goes to court, george gascon, the district attorney's office, the district attorney there in los angeles, his office offers what? >> well apparently, the family called me outraged because on december 15th they show up to court and they hear that there is a seven year offer for this murder and they were absolutely outraged. it was odd because the district attorney -- actually the prosecutor in the courtroom, he wasn't aware of the deal. this was actually put on the record by the deputy public defender who informed the judge that the special advisor to george gascon had extended a seven year deal to the former public defender who was handling that case which happens to be ms. black now who happens to be now part of george gascon's transition team and policy committee. so you are getting struck by two people within george gascon's administration. talk about clear conflict of interest at the highest level of the liaison. >> jon: george gascon going into office and he wanted to get rid of specials of the senses, somebody that's been previous crimes, specially heinous crimes. and that's what they wanted to drop. they wanted to get rid of any special circumstances in this matter? >> there was special circumstances of a gang allegation of special allegations of abuse of a gun and gun navigations and that is what they moved to on the 15th. thankfully the court said no because the court has to make a determination of this is done in the interest of justice and the court looking at the facts of this case just said this cannot be in the interest of justice to dismiss these allegations. >> jon: it's o oh, man, well, essentially the district attorney's office was saying your cousin's life was worth and seven years. >> yes. and how are you going to say that someone's life, my cousin's life, it's worth seven years? "america's newsroom." i'm sandra smith. >> jon: i'm jon scott. mcconnell wants to tie the stimulus checks to the president's other demands, and investigating the election results. and while the senate is stalled of the house already approved $50,000 and were expecting the ocean from speaker of the house nancy pelosi at any moment now. at $600 checks begin going out today. here is senator ron johnson earlier on fox. >> from my standpoint, $464 billion to the total cost of the package, the money we don't have we are borrowing from our kids as future. we need to target that a little bit more. >> sandra: rich edson is live in west palm beach, florida, with more on that. >> good morning sandra. democrats control the house, they easily passed of this bill which would raise those checks to $2,000. republicans control the senate and the issue has gotten a little completed over there. dad's repeated and a number of times on twitter, and this is what he tweeted earlier. unless republicans had a death wish, and it was also the right thing to do, they must approve the $2,000 payment asap. $600 is not enough. also get rid of section 2:30, don't let big tech steal our country. instead of voting on the bill the house just passed, one that only increases those payments to $2,000, senate majority leader mitch mcconnell has initiated a process as a boat that also includes president trump's alsor demands. that's legal protection and the creation of an election fraud commission. >> we have three additional issues of national significance, we would like to see congress tackle together. the senate began a process to bring the three priorities into focus. >> leader mcconnell holds the key to unlocking this dilemma. the solution is a simple one. put both bills up for a simple up or down vote and then let the chips fall when they made. >> democrats say by combining all these issues in the senate, majority leader mcconnell is simply trying to kill any effort to increase those payments from $600, to $2,000. that would add nearly half trillion dollars to the cost of all this and a number of republicans say that's just too much. back to you sandra. >> sandra: more on this now, john bussey. great to see you. and linking those three elements together, they push the additional elements down the road to a point where more republicans are going to think about this, and more republicans think about where they want to break with the president on it and will side with mcconnell's view. which apparently is the extra several hundred billion dollars that this would cost us too mu much. and it was not targeted at the right people that need the mon money. >> sandra: is a "wall street journal" headline, mcconnell at the bridge. the senate leader tries to minimize the harm from a vengeful trump and the editorial boards go on to say this. we will see how this plays out in georgia but the fault isn't mitch mcconnell's. the political damage to the g.o.p. comes from donald trump whose lashing out at all the sundry and defeat, no matter if it also helps to elect a democratic senate. john, tie those two together. newt gingrich did that at the top of the 9:00 hour this morning. the impact of the ongoing battle over this $2,000 payment to the american people and the senate races in georgia. watch. sorry, just a second. >> i'm very worried if he plays a clever parliamentary game, it may look good inside the senate but it could cause to senate seats and control of the senate so i would beg him to bring up the $2,000 payment as a freestanding independent boat and i will have people like senator loeffler and senator perdue come back and vote for it, and take it off the table as an issue. >> sandra: so will he do that? >> he really doesn't want to. the issue is whether or not the senate in the country has the money for this particular program, this expansion of the program. the editorial was pretty strong on this issue, and i'm on the new side of the journal, not the editorial page. the editorial page is saying, this is trump trying to punish republicans from not supporting the editorial page which causes fantasies about overturning the election. mcconnell is seeing that as well, and at a certain point he will have to break with the president if the republicans are going to stick by policies that they believe are appropriate. greg abbott, our economics reporter at the journal points out that this will cost hundreds of billions of dollars more, once something along 80% or more of the money was sent out and stimulus checks before were either saved or used to pay down debt and stimulate additional land which would create great jobs. one would expect the same thing to happen this time around. the president also has a serious spending other people's money and going into bankruptcy and various of his properties. mcconnell doesn't want him spending peers money and in this last kind of -- for an expanded program that the he did not support initially, he supported $600. the election in georgia will be part of the process because these were two senators who did support the $600 program and are now suddenly changing their view because the president has changed his view when they need his support. so it messes up the georgia election and no one is more sensitive to control of the senate and mitch mcconnell come he doesn't want to lose his job as head of the senate, the senate leader. but i think he is drawing a here. >> sandra: i have to leave it here, but i want to get this bit of news end. senator josh hawley the republican just said in a statement, and this is not beasley big news because he is a first in the senate to do so, he says he will object to the certification of president-elect joe biden's electoral college victory during the session of congress generally sixth. this is something they are following on election laws and he is the first senator to say that he would object to with house republicans saying so as well. and really quick to that, i got five seconds. republican governors and republican secretary of state and the supreme court, biden won the election. but the presidents at the attempts to overturn it are simply not going to advance. >> sandra: got it. john, always good to see you. >> jon: those high-stakes senate races in georgia, they are just six days away now. president trump will hold a rally monday night for republicans at david and kelly loeffler. on the same day president-elect biden will campaign for the two democratic challengers. peter doocy is live for us in marietta, georgia, where democratic candidate jon ossoff is speaking to reporters right now. >> we are going to take a step or two back. that will make a big, big difference. they match up they try to disenfranchise that we continue monitor how where it's necessary we will sue and we will win. but the family ties to stacey abrams in this case are very troubling to the georgia secretary of state who say this. a judge would rule on a case in a group heavily funded by her sister which is very conserving. that's a group associated with the plaintiff in this case and a fight that is coming, the secretary of state out of this is a direct attack on a rule of law and integrity of elections in georgia. i will quiet down a little bit and take you in to try to get a question right after this answer. stand by just a second. >> because people need help now. folks have met credit cards maxed out and can't take rent payments, car payments, can't afford prescriptions or afford child care. people are in dire straits and that senators perdue and leffler who are in the majority in the u.s., and let's be clear. it's the majority that controls for action. if they are serious about $2,000 relief checks for the people than they should put maximum pressure on mitch mcconnell to move that legislation immediately. >> we are actually, really quickly, we are live on fox right now, thank you for the question. you talk in your speech that you just listen to about health and of jobs and justice for all. when i talk more about your experience, your relevant experience and being the best person to deliver on those things? sworn into office on sunday and he was only 41 years old. bobby jindal was luke ludlow's friend and we are so sorry for your loss. a life lost too soon with two little ones at home. >> thank you sandra. i hope people get to know luke as a person. i know people talk about him as a rising star in the republican party and congressmen on the left but i first met him as a college student. he came to work on my first campaign and we spent hours in his truck driving all over louisiana. he was exactly the kind of person washington needs right now. it would have been a great congressman but he loved people. it was a lifelong republican, conservative, christian. but even more than his ideology and politics, you love serving people. he loved constituent services and loved helping people get the help they needed, that's what he was passionate about. i think we could use a little bit more that in passionate ohmic washington. he didn't want to make headlines or make national news, he was going up there because he wanted to help people in the community was born and raised in. he lived his life in the fifth district and so we are all morning the early passing. such an incredible man and a great friend and a great leader for our state and would have been a great leader for our country. >> sandra: i know you are keeping in touch with him all the way up through his final days, he was in the hospital as we know for a couple of weeks and was even provided updates on his twitter account to come up that he was doctors were giving updates that he was receiving treatment. it was reported on one of the louisiana outlets this morning that his doctor said it was ultimately a heart attack due to covid-19 complications that killed him. a tragic ending two as you mentioned, a rising star in his party and of course in his own family, as we see them pictured with his wife and two young children. >> i hope people remember julie and their prayers. two beautiful children, a little boy and a a girl that have to grow up without their father. i remember he and i were in his truck once and we saw a bumper sticker that said something to the effect of, god doesn't promise you tomorrow but he promises you eternity. i hope that we will hug our children extra tight tonight and tell the folks around us that we love them. life is precious, every day is a gift. i do know this about luke, he truly cared about other people and serving other people. that's what he would want his legacy to be. up until his very last day, he was texting me from his hospital bed, i understand they actually had to take his phone away to get him some rest. they thought he was coming home, they thought he would be there a couple more weeks but they thought he would beat this. he was 41 years old, healthy and young and we just thought this would be a blip in a very long career. but i hope people get to know the man, not just a politician. he loved computers, he left politics. he crossed the party i'll come a crossed racial and demographic lines. people like him because he was a good person, not because he was a congressman or in politics, a good man with a good heart. i have to tell you a quick and funny story. he grew up in louisiana and he sold his older brothers your books on ebay when he figured out that tim mcgraw was in those yearbooks, that's a kind of young and fun-loving guy that he was. >> sandra: and he loved louisiana. i believe he was a sixth generation louisiana in and he was very proud of where he was from. and that showed through in his politics and the way he came across with his family, just a tragic loss, a life lost way too soon and we wish him and his family well. we've heard from you and senator john kennedy, congressman steve scalise has waived them as well and that their cases are only a microcosm of what secretary pompeo complains is an all out chinese communist party effort to make americans receptive to beijing's form of authoritarianism. joe biden might think his son's case and that of mr. eric swalwell will pass but they won't because they are part of a larger and more sinister chinese story to which americans are just now waking up. you think we
