>> exactly. they said of any other defendants ask for the same they want to be separated from them as well. >> it's a good question about what the tactical advantages for kenneth chesebro. could be a couple of things. he could be hoping that the dea is not ready. when i was a prosecutor i used to worry about this. what if someone demands a speedy trial. we're not necessarily ready. i would guess that she is ready. and maybe they want a speedy trial. the reason what we have the speedy trial protections of the constitution is because people are not supposed to have cases lingering over them for longer than necessary. or it could be that this is a coordinated, tactical maneuver where it was basically decided that somebody go firstly. the canary in the coal mine. get out there, for some to do an early trials for the rest of us can sit back and watch. >> i think this is a precursor to what we are going to see play out with all of these indicted individuals. they are all going to have different legal strategies. there is only one person that is trying to prior lay this and running for president. 18 other folks are going to be train wrecked. they are gonna lose their life savings, their career. this is the whole situation. every american watching this, also's with no exceptions would call this the worst day in their life. not only because they are indicted, not only because it's the first time in four months that they are indicted, because 18 of the closest friends and advisers are now going to possibly lose everything because of the selfish behavior around not wanting to admit that you got smoked by joe biden in an election. he is there with not a single ounce of proof. but he is proud of this moment. but everyone around him is not. >> i would just point out that this is vindication for a lot of people. we have become so used to, this is almost a ritual now. every other week we have to sit here and watch this thing. but this is a special case because of the election workers. and the people who, whose lives were destroyed by these lies. these lies have a huge, these lies were like bombs being dropped on ordinary people. just election workers, ordinary people, who are trying to do their jobs, who are trying to do their duty. who are being real patriots. and all of a sudden the president of the united states are saying these people are liars. rudy giuliani, one of the most famous people in the world starts calling these people crack dealers and everything that you can possibly imagine. they will never get that sense of safety back. they will never get that sense of belonging and so, a prosecutor set up for those people. and said you cannot do that. and today, and by the way, this is a stable system working appropriately. you do not see riots, you do not see troops in the streets. you don't see mass demonstrations like you had in other countries. it's a stable system working appropriately when people in office abuse their power, and other branches stand up and say that there are lines that should not be crossed. so there is some vindication here if. we should not get used to it. it's a stable system working and i am proud of it. >> i think it's well said, the only word of caution i think is for many people going away for years for the sense of justice in this process. this may not play out before the election. the variety of different cases. and nobody can take to the bank that we may know whether the former president, gop front runner, is in fact a convicted felon when they have to cast their votes in their election. >> although if there is a speedy trial for kenneth chesebro, it is going to be interesting to see this. i don't know, would cameras be in the courtroom? >> yes, and that's important. because you can actually hear what the states cases against essentially, cheeseborough, but against the former president. >> exactly, all of this evidence will come out. it will be public. we will be able to see it. and by the way. >> by the way this is the inmate number for the former president of the united states. p, is that a zero, paid, 01185, 809. former president of the united states has an inmate number. it is p 01185809. >> i think in what van was saying, it's good passing in four of these arraignments, indictments, that our system has held up. there were questions. people say, what can, we should we be trying a former president in a civilian criminal court, could we sustain that and that we have been through this four times, we were nervous, i know the first indictment here in manhattan there was a january 6th incident, alone wolf, there's a long way to go but i think it's a good testament to our criminal justice system, to the people who protect it, the people who work in jail, systems, and court houses that we've done this now four times and it's gone the way that it shed. >> we also have to remember that there is going to be a defense here. and the defense is, as you see people asked to be separated, and severed, you know the defense had planned to be a unified defense. which starts off with one. we word receiving in the campaign, numerous reports of sivs vicious activity, fraud, and so on. to, we did not have the resources of the fbi or a large agency to investigated so we got people to look at it, we got all these reports in. we had all these suspicions. three, we took this evidence which was not fully baked but it's what we had at the time and to try and slow down the process we went to the courts and dozens of them refused to hear us either on the evidence but mostly aren't standing. and then we went or legislative bodies. so their overarching argument is going to be, it doesn't matter if we won or lost, it doesn't matter if we were right or wrong. it doesn't even matter if we light in a press conference. when it came to using the system, we went to the courts, we went to the legislative bodies, and we believe that we did it by the book. now, you have a special prosecutor in washington. and the district attorney in fulton county to say there were things that were not true. they knew there were not true. this was actually a calculated fraud, actually a racketeering exercise. but the only, i have been involved in 1 million investigations as a reporter. and as an investigator. and an analyst, in police departments in the fbi. you never really know the full story until you hear it all in court. and both sides put all their evidence out on the table. even if you think you do. >> i think that's true. i do want to point out the two things can be true at the same time. there are things that are unconventional, that trump, dead but they are not unlawful. the things that he did, they were unlawful. now it is unconventional for a candidate to take it as far as he did. to play out all these extra innings. the constitution allows for all these extra innings to pass the vote. with the electoral college, for the state legislatures, and all this sort of stuff. it's unconventional for president biden to keep fighting. that's not unlawful, it's not unlawful to pay in the extra innings. it's an awful to treat in the extra innings. and that's what he did. >> the question here, i think, as we watch this play out. is what impact does this have politically on the primary. because we are unlikely to see a trial before that. maybe we do or maybe we do not. but is it going to have any impact rather than tonight or tomorrow? are voters gonna think. our primary voters gonna rethink their boat when they go to the caucuses in iowa. when they go to polls in new hampshire. when they vote in south carolina. i mean that is to be determined and you know we still have got a long way to go here. canadians and others have to prove beyond a reasonable doubt that he did these things. so what political impact does this have? if trump gets. if he gets convicted after that convention what happens? there is so many different iterations. or if he is going to the convention in the four fight. a challenge before like ted cruz is going to do. in 2016 and got to say we are going to wrestle this away from a. we don't think that the president should be doing this. there's going to be a splintered part of the party that is going to do that. for republicans, last night they asked who is going to vote for trump? everyone shot their hands up. we'll see if there's more scenes like this. if there is court testimony and others. >> we're also told that the former president may be speaking before getting on his plane and the airport. if you remember one of the last. i can't -- wear not gonna carry that live. we're going to listen to anything that is newsworthy that he says. we will bring that to you. >> keep in mind at this point. the former presidents poll numbers have gone up with his indictments. at least as far as the primary goes. i think the big open question, georgia's unique because there will likely be cameras in the courtroom. so the public could see the case play out. and actually know what the facts are. what the arguments are. that is likely not the case in any of the two doj investigation, so i think that idea of public sentiment may be changing, primary hinges around the georgia case but we don't know the timing on, and it could be after a convention. >> i think this continues to make the political math even tougher, the political map in the general, i hate to keep picking on the guy because i've done it for a while, but it creates another herschel walker moment, where you create this primary candidate that is an impossible win in the general, there is not a single person that was with donald trump in 2016, turned their nose up to him in 20, walked away from, him it's looking at this video of the fourth indictment, 91 total indictments and saying you know what? i was wrong about that guy. i wanna come back into the fold and vote for him, i'm gonna write him a check in support him, and the guy that is winning today is joe biden, he is probably on the beach out west, or somewhere out west, eating ice cream again today, give him one press conference that is eight words long. >> just in terms of actual cases, what is the next on the calendar? >> here we have a september 5th, i think, arraignment where you get all of these people back in the fulton county courthouse and then they start to go through motions. >> two big motions, there's the motion that we talked about about a speedy trial date, how many people are going to trial, in the november 2023 timeframe. >> is that a set date now? october? >> the judge has said. i will be trying at least can a trees grow on october 23rd, 2023. >> i have to write this on a calendar. i have to clear my calendar that day. >> the other big much impending right now is the two other defendants, mark meadows, and jeffrey, clark trying to get their case pulled out of state court and moved over to federal court, they both made this emergency motion saying i shouldn't have to surrender. the judge predictably denied that. however the motions themselves are still pending. >> you can say they airport terminal already. go ahead. >> mark meadows motion next week. on the 28, and then met jeffrey clark's motion a couple weeks after that. and then they're probably sitting back to see how those. go but they're gonna make the motion. the gist of the motion is if you can show that the charges relate to your official duties as a federal officer, big question mark whether they can make that showing. but if you can make that showing, then you get your case pulled out into state court, in the federal court. so there's a lot of moving parts here. >> and to david's point about this whole idea, have we come up to the convention this coming summer. he gets the nomination, or there is some kind of effort for a brokered convention on the floor. i was there in 2015 when tempo and folks try to do that. it's an uphill battle, it's not easy. and it's not something you do with sky-high approval ratings at the base of the party. who's doing the math now. and spent years investing in that. there's virtually no scenario. >> i'm sure brian jack, in the rest of the team. they've got delicate binders. they will know to a person who is voting for trump who is on the floor. >> i can't help but think about how easy this could've been. if donald trump had stood up and said i think this election is rigged. and he watched georgia go through a recount, after recount, after recount. and finally said you know what? i will come back in when this again. you have done your job. i'm going to move on. we wouldn't have had january 6th, we would not have completely soiled the republican brand for decades. peoples lives would not have been train wreck to the point that there are. >> and his approval-ing rating will be? >> by the way, those advising him through the final days. go around the countries, throughout your accomplishments, get vaccines in the arms, take credit for people going back to work, and he would be in a much better position for winning a general election right now. >> just intercepting the political and legal here. because i get asked this every day. i think it's worth stressing. none of this will disqualify donald trump are running for president. you can run while you're indicted, you can run while you are convicted, the erratically you can run from prison. and the other thing i think is surprising for people, is if you get convicted of a felony in this country. you can and many states lose the right to vote, lose the right to sit on a jury, lose the writer possess a firearm, that's a federal crime. but you can still run for president. people say how can that be? it's just a feature of our constitution. >> 91 indictments should disqualify you from running as a republican for president. >> in terms of the legal battle he is facing. how much of a person's time is eaten up just dealing with all of the staff? >> a couple of things. while you are on trial in a criminal case, you have to physically be there. so whichever trial goes first, whether it is in florida, d.c., new york, or georgia. donald trump has to be there, and that is the contrast that we saw the civil trial involving e. jean carroll. he no showed at that. great strategy. but he will have to physically be there in the courtroom. >> why does he have to physically be there? >> it's a rule of criminal procedure. it has to do with the defendant's constitutional rights to be present, to confront the witnesses against, him to present his own defense. so this will take him off. >> can someone weigh those rights? is he willing to waive that right? >> only in extreme circumstances. but i have never seen. >> president of the united states? [laughter] [inaudible] >> i will say though, if i was his lawyer. i would beg him not to do that. because you have a jury who is deciding your liberty. and they do not take it as a sign of respect if you do not feel the obligation to at least show up. the other thing is, preparing for a criminal trial? as a defendant? ordinarily is a full-time job. you are working along the clock with your lawyer. to have a constitutional right to assist in your own defense. you are helping your lawyers assist in documents, identify witnesses, it's up to donald trump what they want to do, and how they want to split that up. usually this is all consuming for one case. never mind for. >> i just want to point out again, for people, for the equal justice point. regular people lives are destroyed just by the charge. just by the charge. just the mere fact. oh here we go. [inaudible] keep going. we're just gonna be monitoring his remarks. and then we'll bring it back. >> you can begin to understand, some people who don't have exposure to the system. other people because of what they're dealing with, they are exposed to it a lot. just when the handcuffs go on, you're gonna be out of profit, 20, $50,000 that you do not have. or you will have a public defender that is gonna have 30, 50 people to help. if you're gonna do a gofundme. just trying to keep your apartment. just trying to keep your job. innocent! or guilty! your life is destroyed by the charge. and this is a system that people go up again. so if people think to themselves, man, donald trump's 19 friends are going to go through all this stuff. each one of them is going to spend 1 million dollars, 1 million dollars! that they do not have! this is terrible. well if you think it's terrible for those 90 people, and donald trump. think about the people who are right now in that jail, where there is apparently life infestation, and bad ventilation, and they do not have the $50, 000, the $20,000 to get themselves out. this is why both political parties have come together to try to fix the system. and, if you do not like what you're seeing because the republican, or you love what you're seeing because it has happened with donald trump. what is happening with ordinary people, regular people, this is not the best way to get to the right outcome that we want for people. >> and then, you and i have talked about how donald trump just doesn't see things the way normal people do. oftentimes, you would think a fourth arraignment, flying down to georgia, getting arrested, getting mugshot for the first time would be a sobering moment. but again i make this parallel to when he had covid. any went to walter reed, any wanted to do that drive-by. he actually wanted to wear a superman shirt. and he wanted to be seen, even though that meant exposing secret service agents, advance teams, potentially press, his doctors. but he saw it as an opportunity. he knew the media was focused on him. if he was bleeding the news to him, that was a win. even if it was for bad reasons. again, he chose 7:30, he told prime time to turn himself in. because the spectacle of all he sees as a when. even if it is for something horrible like committing crimes. >> and by the way, he commented on the tarmac, he continued to make dishonest claims about the election. we are not going to play it. it's not worth hearing for them all, before many of the claims are just not true. he is now back on the plane. ready to take off. on this case in particular, if they have to go, they will be going to trial in october apparently at least with cheeseborough. does, do you believe that fani willis is ready, i mean is the prosecutor ready for that? >> you are supposed to always be ready as a prosecutor, i was trained if a judge said when we want to go to trial, i would say tomorrow on all of them and that's what she has said. she took a long time. one of the criticisms, i think valid criticisms, is that this took two and a half years for fani willis. to investigate. and to bring the charge. and i have to presume if she is competent, and all indications are that she is competent, that she is ready to go. because of just the scenario. >> one thing i learn from your comments a second ago, is how much time. i didn't realize that he had to be in the courts for all these different hearings. so, hanging out with all these lawyers. i learned so much more. including then, i found out you are a lawyer. but how do you campaign? in your best estimate, do you have 30 extra minutes a day? >> to be cleric, you have to be there for your trial. some of the hearings. your arraignment, you have to be there. but some of the intermarrying hearings about the evidence, in the motions? that the defendants can wave. can't give up his physical appearance. >> the former president is on the plane waiting to take off, let's go back to kaitlan collins outside of the jail. >> thanks anderson, we've been watching as a few people here behind us, the trump supporters and protesters have been dying down as a former president left. he was here very briefly on the ground. joined again by sarah murray, but also the mayor of atlanta, the keisha bottoms. what is it like to see the president come to the fulton county jail and be arrested. have his mugshot taken, and it's booking shaved? >> it's surreal. i don't think there's anybody who loves our democracy that is happy about this. nobody wants to see a former president booked into a jail. but that being said, i think it's a testament to the fact that everybody is being treated equally, if you commit a crime in this state then you will be held accountable. i used to be sitting as a magistrate judge in front of the jail, and it's not a place you want to be, it's not a pleasant place whether you are there for five minutes, or months for shares so it didn't give me any joy to see the presidents of the united states booked into, a former president of the united states, booked into the fulton county jail. but for the sake of ruby freeman, shame on us, and so many others, who have just been subjected to all of that has happened. has transpired. i think this is a testament to the fact that our justice system is flawed. >> and of course you are referring to the election workers who were targeted, not just by the former president but by so many members of his inner circle at the time. people who have also been book to the fulton county jail to be arrested. what is that like for those election workers? who are just doing their civic duty when they were harassed, and bullied, and intimidated, and threatened? >> i had an opportunity to meet them when they were honored at the white house by president biden and they really are's fault of the earth women, very warm spirits and they seem to be very humble and watching their testimony, that attention that they wanted at all, i would assume that this has to give them some comfort. i don't think that there is anything that will erase the prey in and trauma that they were subjected to. but i do hope that they were, the fact that the district of this county seems to remember what happened to them, and not push it aside because of who these people are. hopefully that gives them some comfort. >> can i just, you are mayor of the city. you've been a long time resident of the city. what trump did earlier, going after, talking about the crime rates here. talking about. why is there so much murder in atlanta? why is there so much violent crime? people are afraid to go outside and buy a loaf of bread. all of these wild claims. essentially saying, funny well as, the district attorney should not be prosecuting him. given that. what is your response when you hear something like that? >> funny well as was elected district attorney to do just what she was doing today. and it's not just donald trump and his his entourage that fani willis prosecutor every single day. it there is a big trial going on in the fulton county courthouse. a rapper, young thug, and many other popular rappers. she's not discriminating. if you think that a crime has been committed, then she is going to pursue that. and people after a member, she is not an administrator. she is not a pencil paper pusher. fani willis worked in the district attorney office. as a senior district attorney. trying some of the most notorious cases in our county, so she knows what she is doing. i worked with fani willis for many years. as young attorneys we started out together at the law firm, very young attorneys we work together as prosecutors and at the solicitors office. so she has grown into this role, and she is prepared for this. and at the point that fani it's not an indictment, i thought that there was struggle for the former president of the united states. >> why didn't they? >> she thought that they would pursue an indictment. and that there were something there. >> how do you think she enters that certain level of betrayal, and attacks, not just the former president who is also spoken a lot publicly about our. but also the supporters? we know that the office is just [inaudible] >> fani was built for this, she was raised primarily by a single father. i heard a joke that his idea that his idea of daddy daughter time was working on his cases. and i think that the harder that they tried to intimidate her, the more they try to intimidate, or i think the more that she is going to try to dig in. she is not going to be easily intimidated. she has dealt with bigger and better. for sure. she prosecutes murderers, and, and really the worst of those amongst us. this effort to intimidate her, she is not going to be flustered. when you see her looking very stoic beyond the camera, that is not an act. >> what are the concerns to officials like her? as you know for watching her, this is trump's claim on the tarmac. at this point in the world waiting to take off. it's the primary issue an air force run. they would clear the time act to take off. we were watching him. speaking of fani willis. and given that you know her. it's not just coming from trump in the inner circle. it's what he says for certain people. and we saw the supporters of their earlier. when they saw security lining up and chanting lock her up, and saying fani willis's name. >> when i pulled up, they thought that i was fani, and they started chanting that at me as well. and walking through the crowd. there was a lot of hatred out there. >> they thought that you are fani willis? >> they thought that i was fani willis, a managing that. a lot of hatred and really bad energy out here. but, you know, this is, when you sign up for a public service. you don't get to pick and shows you are good days and your bad. days i had full confidence, and -- was actually the corrections jaipur atlanta, and i saw him just yesterday, he is doing great and there are tough days that come with these jobs and i don't think that anyone wants to be subjected to threats. but i think it's part of the job, and if we get into that, then who are we as a country? that people do not serve because they fear for their lives. that is a threat to our democracy in and of itself. >> what do you make, of not just the threat level of this, it's the political aspect of it too. you know this obviously. when you are working at the white house. and this is something that they are using to their advantage to fund-raise off of. trump before this happened said i just need one more indictment and i will have the nomination locked up. >> i think it's unfortunate. i served as mayor and i have worked with governor kemp. to get the attention, when we did get along, that got the attention. but we worked very closely together. i worked very closely with many republican leaders, and that is what people elected to do. they want us to put aside our political differences and be able to get things done. so when i see what is happening right now during this election cycle. in this republican primary season. it concerns me for our democracy. quite frankly. that we are giving into the worst of who we are in many ways. >> and i wonder if you know this kind of indictment. and this sweeping nature goes beyond people who direct. and ruby freeman, and chavis, i wonder if the district attorney is trying to send a broader message about what happens if you turn and tried to disenfranchise thousands and thousands of voters. and particularly minority voters? >> i think that's extremely important. we will have many more election. there will be many more close elections. i won the mayor's race by less than 1000 votes. i lost a very close race once before. the first time that i ran for office. that's what happens, that's what should happen when you go for office. you win some, and you lose some. but i do think it is important that we send a message very loud and clear that you will not stand for this in the state of georgia. that if you try to intimidate election officials. if you try to intimidate people who are working the polls that there will be a price to pay. >> before trump ordered the steps to the calamities on now. what he said to reporters which we did not air live. but what he said was he still claiming. he had every right to challenge the election. but it obviously went so much further than. that it wasn't just as the attorney general pointed out. trying to file court cases and whatnot. he went so much further than that when it came to trying to directly overturn. it's not just dispute it. >> you do have a right to challenge an election. there's a process to challenging an election, but what you do not have a right to do is to intimidate poll workers, you do not have a right to unlawfully influence the secretary of state. there are so many things that they did where they crossed the line. and as attorneys who have a responsibility to advise your clients not to do illegal things. even if your client does not know what they are doing. >> a lot of people were telling him that. >> absolutely, and certainly it's unfortunate that i am an attorney. it's unfortunate to see that the attorneys have even gotten caught up in this. you don't have the rights to do illegal things on behalf of your client. so, i am not celebrating today. there is nothing to be, there is nothing to celebrate today. but it is reassuring to know that no matter who you are, if you break the law, if you try to intimidate people and try to deny people their boats, that their votes be counted, that there will be a penalty to be paid. >> and what i've been talking about, and reporting throughout the days that trump's new attorney that he met when he got here just an hour ago, i know you know him and you know of him, he's a renowned criminal defense attorney here. but given what you know about him, given what you know about fani willis. do you think she has an airtight case here? >> i would put fani against anyone, on any given day. i have seen them when some, i've seen them lose some. i wouldn't be surprised if there is not an attempt to negotiate a plea. he represents a lot of high-profile people, obviously, but he does not have a flawless record. and fani is a darn good attorney. so if fani it is putting the escapes up. i think everyone should bring the a game to the table. >> how do you think she is watching all of this? do you think she discos about her normal business as the city is shut down for the last few hours waiting for his arrival and having him coming here? >> knowing fani willis as i do, she is matt losing an ounce of sleep over this. and you have to remember, even while all of this is going on, i mention the wildest owl trial with young tongue that is going on, there are other challenges that are happening in the fulton courthouse. other cases where her staff are preparing to try some business. it's continuing. and in the courthouse i don't think that fani is losing any sleep over this one. >> i think she's also trying to make sure the rest of the codefendants have turned themselves in. 18 other codefendants. >> how many have they been now? >> there are many others. and they have not all been processed through the jail. not all of them have responded yet. >> and also there's a mugshot, and i should know that they we are waiting. we do have trump's mugshot. we are waiting on it to be able to post that. but he is just without a doubt in the motorcade. and what you are seeing now is the play in. he is treated like most other codefendants in the sense of what actually happened inside that jail. >> most other criminal defendants would not be out there that quickly. most others would come in, and it would take hours to process them. it will be interesting to watch what happens with harrison floyd, who showed up without posting a bond today. he very likely will be there at least until tomorrow morning. because he will need to have a first appearance hearing. i don't know if he is out, or if the district attorney did something to process them out quickly. under normal circumstances you show up, usually you don't have a bond. you have to wait overnight in the fulton county jail. you are given about the next day after your first appearance hearing. those are the cases, or that's what i used to preside over when i used to sit out here as a judge. then hopefully, you are granted a bond. if you are a defendant and then you are processed out. but it usually takes several hours if not a day or so to get a defendant processed out. >> mark meadows is one of trump's former chief of staff who surrendered. he was trying to push this. he has a hearing on monday, he's trying to get it move from state court, a federal court. and he was essentially arguing, i shouldn't have to meet that deadline from tomorrow. and they push back on that saying, fani willis argument when she responded saying i've already given you two weeks as a courtesy. that's the role of defended that we get. and that's accurate. so for those who have the reverend themselves in. i think they have to wait to find out what happens if they didn't turn themselves. and i can tell you what's gonna happen. what happened today. sheriff's gonna be out looking for them today with a warrant for their arrest. so i think that is. if they want to get in and out of your quickly. and the last thing that you want to do over the plan is to give both the in fulton county jail on friday. and you're there until monday. it jails get really crowded over the weekend and when i used to represent cry and, when i prosecuted, people would say please, don't send me over. it's not somewhere the two of you that certainly want to be if you don't have to be here. when i would sit here presiding over cases, sometimes a lot of. stablemate huber. you can share my close ones i am. >> i mean that's a jail, it's not supposed to be the st. regis. it's not the movie. the case. it's well like a jail. it looks and feel like a jail. >> it's striking how people keep mentioning the smile. >> and i've got you discover? vote because everything who has talked about the jail, mentions the smell. >> conjuring up the smell of my mind is not very pleasant. it is, it is a combination of stale food, and buddy order and, it's a tale, so now opening windows and stagnant air, and even where i work in the jail i was in a courtroom aboard present area of the jail. but you could smell it as soon as you walk into the waiting room. >> what the trump say when he went in there today? >> what he likely saw, if he won in the normal way that clients would go in, you command and there's a task at the fright, it's been a few years since i've been in there but there is a desk at the front and than he go through a more sick course the questions that are going to come as soon as this plane takes off with the former president on board is what the timeline of this looks like and we've seen a flurry, a head spinning amount of activity in today and sense of one of the codefendants was asking to have a speedy trial, the garbage granted that. they set a date of october 23rd. is that logistically possible? >> i think it's logistically possible. it's gonna be interesting to see the pull on the resources. because as i mentioned, you've got the trial going on. and it's a multi, it has been a multi. >> i'm just gonna pause for a moment. because we did get that much out of the former president of the united states, we're going to show it to our audience now, this is just the image to see the former president of the united states, who was just put to the fulton county jail behind us, questions remained even within the same as of this morning whether or not this photo would actually ever exist, there you see it, the watermarks just like every other codefendants that is come before him. the former chief of staff, the former mayor rudy giuliani, and to see the mugshot of the former president of the united states. >> when i look at that and he proposed a very interesting look that he has there. it makes me sad. it makes me sad to see a former president with a mugshot. as i mentioned earlier, i take no joy in seeing him booked into the fulton county jail, it makes me sad that a former president has conducted himself in such a way. that it's from not just one indictment, not two, but three different jurisdictions into the full fulton county jail owns that indictment is harassment and sheer torture of two women that signed up and the people vote in the community. >> jake, i mean, you see that image. trump's campaign was created that he is my campaign. another is a mugshot of the former president of the united states? >> it is a stark, and said of on the left side of your screen. fulton county in may number p01135809, otherwise known as the 45th president of the united states. donald john trump, we see on the right side of the screen, his boeing 737 about to take off from hartsfield international airport in atlanta and its way back into newark, new jersey, dana bash, no doubt the trump campaign and his supporters will try to make light of the image on the left side of your screen but the truth is the allegations and the conduct described in the indictment, whether or not he was found guilty. whether or not you think it is a strong case. the elevations and the conduct are factually accurate. and, tragic. and that image is what i think of when i think of those, that conduct. >> and that is now an image that will be cemented in history, i mean how many images are there of donald trump, he is maybe the most famous person on the planet, but this particular photo with the fulton county, you can tell me exactly what this is emblazoned on the corner there that is going to be iconic and infamous is probably a better way to say it, and i think that you said that maybe they will make light of it. maybe some people make light of it. but they are going to appropriate it. they are going to embrace it. and they are going to use it as the ultimate example of his entire campaign. which is they are able to get me. it does not make it right, it does not make it accurate, it just makes it a very, very potent political tool and weapon, that he very much intends to use. >> we've already seen trump's allies, marjorie taylor greene, they're making their own mugshots using it as a badge of honor. but i think about the whole pattern of facts that we are talking about here, which is a former president officeholder, top officeholder in this country, trying to hold on to power, trying to do it by any means necessary, doing so in a way that method to multiple criminal charges, multiple jurisdictions. now that person is running for president again, and his supporters are treating his arrest as a badge of honor. that's not a good fact pattern frankly per the united states of america. and it is incredibly sad for this country that we have to go down this road. the unfortunate thing is that, you know, other countries go down this road to. this is just our turn to do it. and we have avoided this particular moment because, until trump, there has been a tradition of handing over power when you lose. peacefully. and just doing it. and showing up at the white house with the guy coming after you, and shaking hands, and sitting down, and having a tv. and trump's refusal to do that, that tradition that is not founded in law but as part of our tradition is what has led us to this point. >> and we should point out, there has been numerous disputed elections in the history of this country. 1876, between rutherford and samuel, between 2000 and al gore, george w. bush. >> would never have gotten to this. >> that's my point, i'm agreeing with you. ultimately, they had their day in court, they lost, because they conceded defeat. on that note, i want to, donald trump on the tarmac on his way home, this evening, we did not bring in those comments but just to tell you one of the things that he said. and i want to get your reaction, he said, it's a very sad day for america. and then he went on to say, we challenge an election. you should be able to challenge the election and later in his comments he said, we did nothing wrong, we have every right. every single right to challenge the election that we think is dishonest. we think it's very dishonest. that's accurate. he has every right to challenge an election. and in fact, he exercise those rights. and then he went beyond it. >> right, he exercise the. and then he lost. over and over again. 61 at a 62 court cases, and battleground states, the supreme court declined to hear his case twice. that is a court where he appointed a lot of justices. there were three recounts in georgia, and let's just remember his own attorney general, bill barr, and december 1st said that there was no widespread fraud. chris who is in charge of election security, was a republican, and was fired because he said it was the most to election ever. white house counsel, republican, i just want to say about his election denial again today, this is why former congresswoman, liz cheney and many other lieutenant duncan, or raffensperger i don't think there is a chance in heck with that if there had been evidence of fraud, and otherwise that would've swung the election to donald trump that they would not have embraced it, and stood by donald trump. every single one of them. >> i think you're right but we talked about this earlier, you do remember that they changed the election laws in 2021 after the 2020 election under the guise that there were some irregularities and things and it be fixed. change in place for drop boxes, people that they're with absentee ballots, they try to capitalize on this idea. and now suddenly it appears that they've grown a conscience. if you think about this indictment and i step back sometime from the case, because i think that lori's have to think about how to lose even if the motion is coming on monday. 154 of the 187 at acts that are alleging this and i made a good while he was as a president of the united states. >> right, of hundred 54. >> under 50 for 157. >> that is staggering, everything except for the last document that he sentence of timber 2021. >> those were the two cows that occurred after he was president. when you think about the decision that the federal judge has to make about doing this case, is this a federal executive, is clearly is, to move it to federal court related state in state court. if this is not a case that married some consideration i don't think there ever will be one. >> he is facing charges at the federal level of similar counts. >> the massive question andy mccabe, you were fbi director, we were deputy fbi director. he dealt with donald trump while he was president as a law enforcement official. you look at that image on the screen right now, did it ever occur to you that that would happen? a mugshot of donald trump? >> of course not, right, my interactions with donald trump, my personal interactions with him more early on in his administration. we couldn't see into the future where we would end up, but, i think the point that you make on the consideration of removal, there is no question that could be a very effective legal strategy, isn't obvious and moment is paying for any of these defendants to do. i still think it will be very hard here. i totally respect you are telling of the council, but bolton medley, to make the case that these acts were committed within the scope of their authority director have been authorized by federal law. they have to have been acting on the authorization so federal offshore in, and federal law gives the president of the united intimidation of those two coworkers. the lies about the things that they were saying, they were stealing votes. never mind the sleet of fake electors which is the subject of several of these counts and questions about whether that move and the work that these characters did presumably on the half of the third president to try to steal the georgia election from joe biden, which is effectively the opposite of what donald trump says happened. >> this transfer of motion will be not about is there probable cause, the indictment is great or if there is enough evidence to move forward, this is if there is a plausible claim that he was serving in his federal capacity. >> it's a low standard to me. >> joining me now are senior legal affairs correspondent paula reid was outside the fulton county jail. paula, we just saw donald trump leave after being arrested and booked, where is he next expected back in atlanta georgia? >> jake, it is going to be a busy next month in this case because the next step is arraignment. remembering his federal cases he was processed, he had his initial appearance at the arraignment odd ones. here in fulton county things come in phases. they negotiate bond, and he surrendered, and they scheduled the first hearing before the judge. the district attorney fani willis says she would like to do the arraignment the week of september 5th. the former president at his 18th codefendant will have to come back to fulton county for the arraignment. we could also expect pretty much some ultimately to continue to see legal challenges. we know mark meadows and jeffrey clark have filed challenges trying to move their cases to federal court, we expect the former president will likely tried the same. rudy giuliani has suggested on one of his podcast that he intends to do that. jake, we have to see the legal team solidify, this may be wide to four presidents secured his new attorney because they only have a finite amount of time after the arraignment to file certain challenges to the indictment. someone please ample rudy giuliani, to figure out who is going to represent him throughout the trial, because of course the lawyer who helped with this body has been noncommittal about handling this entire case. it is going to be a really busy that's month for the fulton county case. >> and, the trial, the hearing rather, on whether or not it should be heard in a federal court, it should be transferred from georgia to a federal court, that is monday, is that right? >> that is exactly right, for the mark meadows case on monday, the next thing that is going to happen is a hearing for mark meadows, and the question of whether his case should be moved to federal court. he is confident that if the prosecution gets removed federal court he can get dismissed, he argues that he was protected under a law that protects certain federal officials from state level prosecutions, the dish rigatoni fani willis she waited and she fought back at that, she said look, that had nothing to do with your role as chief of staff, and you are doing. instead those political activity. a real focus on monday will be the infamous call the former president trump and the georgia secretary of state raffensperger. that appears to be what the district attorney really wants to focus on based on what cases the mic of, that gonna be the crux of her case trying to keep that in state court. it is not the only one who is try to make this argument, jeffrey clark has a hero schedule for this and others including trump and giuliani have said they will try this to. >> just game it out for us, let's imagine a judge on monday and the future, any other judges want this to be heard in federal court instead of on the state level, let's say the judge disagrees with them, does this get appealed all the way up to the u.s. supreme court? is that where this is headed, ultimately? >> it's certainly possible these are unique questions, i would expect someone particular like mark melrose who has some of the best double-team in this entire group of people, the appears of the resources to get a lot of legal challenges, he will likely appeal, whether makes it to the supreme court is an issue of first impressions. it's always possible we've seen issues around the former president make their way close to the supreme court if not make it before the bunch. the other thing is if he wins, right? potentially, the u.s. attorney could be the same district attorney is facing now the good wave in the d.a. willis, it will still be a case under state law but a different jury pool. that's another thing that the former president is aiming for. fulton county is a predominantly democratic district and they believe even if they can get the case dismissed at the federal level of damage is get the broader jury pool, that could be more favorable when the former president or any of his codefendants. it's a very unique situation, it's pretty fascinating to see other legal system works and how everybody is trying to game and i'm here. eventually, the case will find its way before adjourning, like literally from fulton county impossibly veterans are. >> the federal jury, thank you so much, paula. i'm back with my team here. a federal jury in georgia, what does that mean? is that geographically different? obviously people feel as though the jury will be more politically diverse instead of as democratic as fulton county's. >> that's probably the biggest upside for him he draws a jury from a large part of the state. if the case stays in fulton county will be in a county that voted predominantly for biden. and his chances won't be good. >> but there won't be jerusalem chen. >> that's the one thing that he will not -- we still have -- you can still question jurors and make decisions about who you want to put on a tremendous transfer to a federal court, the jury pool flawless for multiple counties around the north georgia area. there is a chance that we typically would draw the jury from the atlantic division which would be atlanta counties in the northern district of georgia. sometimes in cases where you don't think you will get enough people from just that division you major off to the entire district which means even in the north district where marjorie taylor greene's from and other people who might be favorable to trump, it expands further they need to do it. it would be unprecedented if they drew a large najarian south of georgia, because they needed to make sure they had enough people who did have some reconceive ideas about the case. that's what will be difficult here, the jury selection is going to go on for a long time, until they can find a panel of 12 an alternate will have no real feelings one where another about the former president. that becomes, i think, a difficulty. you and look at public polling on that. >> i mean, do you think transferring into a federal jurisdiction, drawing from lighter parts of the state, geographically, means that ultimately the odds that donald trump will have one juror, that's all you need, one juror who will vote to acquit? >> i mean, certainly the numbers aren't in his favor if -- or more in his favor if he gets the case moved to federal court for all the reasons michael said. it's important to emphasize that if he gets into federal court he is halfway to getting this thing dismissed on supremacy clause grounds. he has got to get in federal court to make that next argument which will be you should dismiss this case because i was acting within the scope of my federal authority, and that is another whole argument. but, that would be, i'm sure any of the defendants optimal result. >> it's possible that you get 12 jurors who were objective and hear the facts, and they all voted for donald trump twice and ultimately when presented with the facts do their duty and vote the way they think is current the not according to whether or not they like donald trump. >> it's true, but i think the fear for any prosecutor and lawyer talking to roger is somebody not been candid in georgia's election and is getting into the jury almost as a plant. under the idea that maybe they are patient and somewhat. that's a concern. you used the process to weed people like that out but, you don't always do. it just takes one. you could have 11 people whom reach a guilty verdict and the guilty decision in 20 minutes. and the one juror can say i am never going to do it and suddenly he is not guilty. >> i mean i would suspect in this day of social media footprint and intense jury selection, or organizations i would be very difficult trump do not impossible. kaitlan collins? >> yes, jake, nine pm here in atlanta, or sitting outside the fulton county jail where >> exactly. they said of any other defendants ask for the same they want to be separated from them as well. >> it's a good question about what the tactical advantages for kenneth chesebro. could be a couple of things. he could be hoping that the dea is not ready. when i was a prosecutor i used to worry about this. what if someone demands a speedy trial. we're not necessarily ready. i would guess that she is ready. and maybe they want a speedy trial. the reason what we have the speedy trial protections of the constitution is because people are not supposed to have cases lingering over them for longer than necessary. or it could be that this is a coordinated, tactical maneuver where it was basically decided that somebody go firstly. the canary in the coal mine. get out there, for some to do an early trials for the rest of us can sit back and watch. >> i think this is a precursor to what we are going to see play out with all of these indicted individuals. they are all going to have different legal strategies. there is only one person that is trying to prior lay this and running for president. 18 other folks are going to be train wrecked. they are gonna lose their life savings, their career. this is the whole situation. every american watching this, also's with no exceptions would call this the worst day in their life. not only because they are indicted, not only because it's the first time in four months that they are indicted, because 18 of the closest friends and advisers are now going to possibly lose everything because of the selfish behavior around not wanting to admit that you got smoked by joe biden in an election. he is there with not a single ounce of proof. but he is proud of this moment. but everyone around him is not. >> i would just point out that this is vindication for a lot of people. we have become so used to, this is almost a ritual now. every other week we have to sit here and watch this thing. but this is a special case because of the election workers. and the people who, whose lives were destroyed by these lies. these lies have a huge, these lies were like bombs being dropped on ordinary people. just election workers, ordinary people, who are trying to do their jobs, who are trying to do their duty. who are being real patriots. and all of a sudden the president of the united states are saying these people are liars. rudy giuliani, one of the most famous people in the world starts calling these people crack dealers and everything that you can possibly imagine. they will never get that sense of safety back. they will never get that sense of belonging and so, a prosecutor set up for those people. and said you cannot do that. and today, and by the way, this is a stable system working appropriately. you do not see riots, you do not see troops in the streets. you don't see mass demonstrations like you had in other countries. it's a stable system working appropriately when people in office abuse their power, and other branches stand up and say that there are lines that should not be crossed. so there is some vindication here if. we should not get used to it. it's a stable system working and i am proud of it. >> i think it's well said, the only word of caution i think is for many people going away for years for the sense of justice in this process. this may not play out before the election. the variety of different cases. and nobody can take to the bank that we may know whether the former president, gop front runner, is in fact a convicted felon when they have to cast their votes in their election. >> although if there is a speedy trial for kenneth chesebro, it is going to be interesting to see this. i don't know, would cameras be in the courtroom? >> yes, and that's important. because you can actually hear what the states cases against essentially, cheeseborough, but against the former president. >> exactly, all of this evidence will come out. it will be public. we will be able to see it. and by the way. >> by the way this is the inmate number for the former president of the united states. p, is that a zero, paid, 01185, 809. former president of the united states has an inmate number. it is p 01185809. >> i think in what van was saying, it's good passing in four of these arraignments, indictments, that our system has held up. there were questions. people say, what can, we should we be trying a former president in a civilian criminal court, could we sustain that and that we have been through this four times, we were nervous, i know the first indictment here in manhattan there was a january 6th incident, alone wolf, there's a long way to go but i think it's a good testament to our criminal justice system, to the people who protect it, the people who work in jail, systems, and court houses that we've done this now four times and it's gone the way that it shed. >> we also have to remember that there is going to be a defense here. and the defense is, as you see people asked to be separated, and severed, you know the defense had planned to be a unified defense. which starts off with one. we word receiving in the campaign, numerous reports of sivs vicious activity, fraud, and so on. to, we did not have the resources of the fbi or a large agency to investigated so we got people to look at it, we got all these reports in. we had all these suspicions. three, we took this evidence which was not fully baked but it's what we had at the time and to try and slow down the process we went to the courts and dozens of them refused to hear us either on the evidence but mostly aren't standing. and then we went or legislative bodies. so their overarching argument is going to be, it doesn't matter if we won or lost, it doesn't matter if we were right or wrong. it doesn't even matter if we light in a press conference. when it came to using the system, we went to the courts, we went to the legislative bodies, and we believe that we did it by the book. now, you have a special prosecutor in washington. and the district attorney in fulton county to say there were things that were not true. they knew there were not true. this was actually a calculated fraud, actually a racketeering exercise. but the only, i have been involved in 1 million investigations as a reporter. and as an investigator. and an analyst, in police departments in the fbi. you never really know the full story until you hear it all in court. and both sides put all their evidence out on the table. even if you think you do. >> i think that's true. i do want to point out the two things can be true at the same time. there are things that are unconventional, that trump, dead but they are not unlawful. the things that he did, they were unlawful. now it is unconventional for a candidate to take it as far as he did. to play out all these extra innings. the constitution allows for all these extra innings to pass the vote. with the electoral college, for the state legislatures, and all this sort of stuff. it's unconventional for president biden to keep fighting. that's not unlawful, it's not unlawful to pay in the extra innings. it's an awful to treat in the extra innings. and that's what he did. >> the question here, i think, as we watch this play out. is what impact does this have politically on the primary. because we are unlikely to see a trial before that. maybe we do or maybe we do not. but is it going to have any impact rather than tonight or tomorrow? are voters gonna think. our primary voters gonna rethink their boat when they go to the caucuses in iowa. when they go to polls in new hampshire. when they vote in south carolina. i mean that is to be determined and you know we still have got a long way to go here. canadians and others have to prove beyond a reasonable doubt that he did these things. so what political impact does this have? if trump gets. if he gets convicted after that convention what happens? there is so many different iterations. or if he is going to the convention in the four fight. a challenge before like ted cruz is going to do. in 2016 and got to say we are going to wrestle this away from a. we don't think that the president should be doing this. there's going to be a splintered part of the party that is going to do that. for republicans, last night they asked who is going to vote for trump? everyone shot their hands up. we'll see if there's more scenes like this. if there is court testimony and others. >> we're also told that the former president may be speaking before getting on his plane and the airport. if you remember one of the last. i can't -- wear not gonna carry that live. we're going to listen to anything that is newsworthy that he says. we will bring that to you. >> keep in mind at this point. the former presidents poll numbers have gone up with his indictments. at least as far as the primary goes. i think the big open question, georgia's unique because there will likely be cameras in the courtroom. so the public could see the case play out. and actually know what the facts are. what the arguments are. that is likely not the case in any of the two doj investigation, so i think that idea of public sentiment may be changing, primary hinges around the georgia case but we don't know the timing on, and it could be after a convention. >> i think this continues to make the political math even tougher, the political map in the general, i hate to keep picking on the guy because i've done it for a while, but it creates another herschel walker moment, where you create this primary candidate that is an impossible win in the general, there is not a single person that was with donald trump in 2016, turned their nose up to him in 20, walked away from, him it's looking at this video of the fourth indictment, 91 total indictments and saying you know what? i was wrong about that guy. i wanna come back into the fold and vote for him, i'm gonna write him a check in support him, and the guy that is winning today is joe biden, he is probably on the beach out west, or somewhere out west, eating ice cream again today, give him one press conference that is eight words long. >> just in terms of actual cases, what is the next on the calendar? >> here we have a september 5th, i think, arraignment where you get all of these people back in the fulton county courthouse and then they start to go through motions. >> two big motions, there's the motion that we talked about about a speedy trial date, how many people are going to trial, in the november 2023 timeframe. >> is that a set date now? october? >> the judge has said. i will be trying at least can a trees grow on october 23rd, 2023. >> i have to write this on a calendar. i have to clear my calendar that day. >> the other big much impending right now is the two other defendants, mark meadows, and jeffrey, clark trying to get their case pulled out of state court and moved over to federal court, they both made this emergency motion saying i shouldn't have to surrender. the judge predictably denied that. however the motions themselves are still pending. >> you can say they airport terminal already. go ahead. >> mark meadows motion next week. on the 28, and then met jeffrey clark's motion a couple weeks after that. and then they're probably sitting back to see how those. go but they're gonna make the motion. the gist of the motion is if you can show that the charges relate to your official duties as a federal officer, big question mark whether they can make that showing. but if you can make that showing, then you get your case pulled out into state court, in the federal court. so there's a lot of moving parts here. >> and to david's point about this whole idea, have we come up to the convention this coming summer. he gets the nomination, or there is some kind of effort for a brokered convention on the floor. i was there in 2015 when tempo and folks try to do that. it's an uphill battle, it's not easy. and it's not something you do with sky-high approval ratings at the base of the party. who's doing the math now. and spent years investing in that. there's virtually no scenario. >> i'm sure brian jack, in the rest of the team. they've got delicate binders. they will know to a person who is voting for trump who is on the floor. >> i can't help but think about how easy this could've been. if donald trump had stood up and said i think this election is rigged. and he watched georgia go through a recount, after recount, after recount. and finally said you know what? i will come back in when this again. you have done your job. i'm going to move on. we wouldn't have had january 6th, we would not have completely soiled the republican brand for decades. peoples lives would not have been train wreck to the point that there are. >> and his approval-ing rating will be? >> by the way, those advising him through the final days. go around the countries, throughout your accomplishments, get vaccines in the arms, take credit for people going back to work, and he would be in a much better position for winning a general election right now. >> just intercepting the political and legal here. because i get asked this every day. i think it's worth stressing. none of this will disqualify donald trump are running for president. you can run while you're indicted, you can run while you are convicted, the erratically you can run from prison. and the other thing i think is surprising for people, is if you get convicted of a felony in this country. you can and many states lose the right to vote, lose the right to sit on a jury, lose the writer possess a firearm, that's a federal crime. but you can still run for president. people say how can that be? it's just a feature of our constitution. >> 91 indictments should disqualify you from running as a republican for president. >> in terms of the legal battle he is facing. how much of a person's time is eaten up just dealing with all of the staff? >> a couple of things. while you are on trial in a criminal case, you have to physically be there. so whichever trial goes first, whether it is in florida, d.c., new york, or georgia. donald trump has to be there, and that is the contrast that we saw the civil trial involving e. jean carroll. he no showed at that. great strategy. but he will have to physically be there in the courtroom. >> why does he have to physically be there? >> it's a rule of criminal procedure. it has to do with the defendant's constitutional rights to be present, to confront the witnesses against, him to present his own defense. so this will take him off. >> can someone weigh those rights? is he willing to waive that right? >> only in extreme circumstances. but i have never seen. >> president of the united states? [laughter] [inaudible] >> i will say though, if i was his lawyer. i would beg him not to do that. because you have a jury who is deciding your liberty. and they do not take it as a sign of respect if you do not feel the obligation to at least show up. the other thing is, preparing for a criminal trial? as a defendant? ordinarily is a full-time job. you are working along the clock with your lawyer. to have a constitutional right to assist in your own defense. you are helping your lawyers assist in documents, identify witnesses, it's up to donald trump what they want to do, and how they want to split that up. usually this is all consuming for one case. never mind for. >> i just want to point out again, for people, for the equal justice point. regular people lives are destroyed just by the charge. just by the charge. just the mere fact. oh here we go. [inaudible] keep going. we're just gonna be monitoring his remarks. and then we'll bring it back. >> you can begin to understand, some people who don't have exposure to the system. other people because of what they're dealing with, they are exposed to it a lot. just when the handcuffs go on, you're gonna be out of profit, 20, $50,000 that you do not have. or you will have a public defender that is gonna have 30, 50 people to help. if you're gonna do a gofundme. just trying to keep your apartment. just trying to keep your job. innocent! or guilty! your life is destroyed by the charge. and this is a system that people go up again. so if people think to themselves, man, donald trump's 19 friends are going to go through all this stuff. each one of them is going to spend 1 million dollars, 1 million dollars! that they do not have! this is terrible. well if you think it's terrible for those 90 people, and donald trump. think about the people who are right now in that jail, where there is apparently life infestation, and bad ventilation, and they do not have the $50, 000, the $20,000 to get themselves out. this is why both political parties have come together to try to fix the system. and, if you do not like what you're seeing because the republican, or you love what you're seeing because it has happened with donald trump. what is happening with ordinary people, regular people, this is not the best way to get to the right outcome that we want for people. >> and then, you and i have talked about how donald trump just doesn't see things the way normal people do. oftentimes, you would think a fourth arraignment, flying down to georgia, getting arrested, getting mugshot for the first time would be a sobering moment. but again i make this parallel to when he had covid. any went to walter reed, any wanted to do that drive-by. he actually wanted to wear a superman shirt. and he wanted to be seen, even though that meant exposing secret service agents, advance teams, potentially press, his doctors. but he saw it as an opportunity. he knew the media was focused on him. if he was bleeding the news to him, that was a win. even if it was for bad reasons. again, he chose 7:30, he told prime time to turn himself in. because the spectacle of all he sees as a when. even if it is for something horrible like committing crimes. >> and by the way, he commented on the tarmac, he continued to make dishonest claims about the election. we are not going to play it. it's not worth hearing for them all, before many of the claims are just not true. he is now back on the plane. ready to take off. on this case in particular, if they have to go, they will be going to trial in october apparently at least with cheeseborough. does, do you believe that fani willis is ready, i mean is the prosecutor ready for that? >> you are supposed to always be ready as a prosecutor, i was trained if a judge said when we want to go to trial, i would say tomorrow on all of them and that's what she has said. she took a long time. one of the criticisms, i think valid criticisms, is that this took two and a half years for fani willis. to investigate. and to bring the charge. and i have to presume if she is competent, and all indications are that she is competent, that she is ready to go. because of just the scenario. >> one thing i learn from your comments a second ago, is how much time. i didn't realize that he had to be in the courts for all these different hearings. so, hanging out with all these lawyers. i learned so much more. including then, i found out you are a lawyer. but how do you campaign? in your best estimate, do you have 30 extra minutes a day? >> to be cleric, you have to be there for your trial. some of the hearings. your arraignment, you have to be there. but some of the intermarrying hearings about the evidence, in the motions? that the defendants can wave. can't give up his physical appearance. >> the former president is on the plane waiting to take off, let's go back to kaitlan collins outside of the jail. >> thanks anderson, we've been watching as a few people here behind us, the trump supporters and protesters have been dying down as a former president left. he was here very briefly on the ground. joined again by sarah murray, but also the mayor of atlanta, the keisha bottoms. what is it like to see the president come to the fulton county jail and be arrested. have his mugshot taken, and it's booking shaved? >> it's surreal. i don't think there's anybody who loves our democracy that is happy about this. nobody wants to see a former president booked into a jail. but that being said, i think it's a testament to the fact that everybody is being treated equally, if you commit a crime in this state then you will be held accountable. i used to be sitting as a magistrate judge in front of the jail, and it's not a place you want to be, it's not a pleasant place whether you are there for five minutes, or months for shares so it didn't give me any joy to see the presidents of the united states booked into, a former president of the united states, booked into the fulton county jail. but for the sake of ruby freeman, shame on us, and so many others, who have just been subjected to all of that has happened. has transpired. i think this is a testament to the fact that our justice system is flawed. >> and of course you are referring to the election workers who were targeted, not just by the former president but by so many members of his inner circle at the time. people who have also been book to the fulton county jail to be arrested. what is that like for those election workers? who are just doing their civic duty when they were harassed, and bullied, and intimidated, and threatened? >> i had an opportunity to meet them when they were honored at the white house by president biden and they really are's fault of the earth women, very warm spirits and they seem to be very humble and watching their testimony, that attention that they wanted at all, i would assume that this has to give them some comfort. i don't think that there is anything that will erase the prey in and trauma that they were subjected to. but i do hope that they were, the fact that the district of this county seems to remember what happened to them, and not push it aside because of who these people are. hopefully that gives them some comfort. >> can i just, you are mayor of the city. you've been a long time resident of the city. what trump did earlier, going after, talking about the crime rates here. talking about. why is there so much murder in atlanta? why is there so much violent crime? people are afraid to go outside and buy a loaf of bread. all of these wild claims. essentially saying, funny well as, the district attorney should not be prosecuting him. given that. what is your response when you hear something like that? >> funny well as was elected district attorney to do just what she was doing today. and it's not just donald trump and his his entourage that fani willis prosecutor every single day. it there is a big trial going on in the fulton county courthouse. a rapper, young thug, and many other popular rappers. she's not discriminating. if you think that a crime has been committed, then she is going to pursue that. and people after a member, she is not an administrator. she is not a pencil paper pusher. fani willis worked in the district attorney office. as a senior district attorney. trying some of the most notorious cases in our county, so she knows what she is doing. i worked with fani willis for many years. as young attorneys we started out together at the law firm, very young attorneys we work together as prosecutors and at the solicitors office. so she has grown into this role, and she is prepared for this. and at the point that fani it's not an indictment, i thought that there was struggle for the former president of the united states. >> why didn't they? >> she thought that they would pursue an indictment. and that there were something there. >> how do you think she enters that certain level of betrayal, and attacks, not just the former president who is also spoken a lot publicly about our. but also the supporters? we know that the office is just [inaudible] >> fani was built for this, she was raised primarily by a single father. i heard a joke that his idea that his idea of daddy daughter time was working on his cases. and i think that the harder that they tried to intimidate her, the more they try to intimidate, or i think the more that she is going to try to dig in. she is not going to be easily intimidated. she has dealt with bigger and better. for sure. she prosecutes murderers, and, and really the worst of those amongst us. this effort to intimidate her, she is not going to be flustered. when you see her looking very stoic beyond the camera, that is not an act. >> what are the concerns to officials like her? as you know for watching her, this is trump's claim on the tarmac. at this point in the world waiting to take off. it's the primary issue an air force run. they would clear the time act to take off. we were watching him. speaking of fani willis. and given that you know her. it's not just coming from trump in the inner circle. it's what he says for certain people. and we saw the supporters of their earlier. when they saw security lining up and chanting lock her up, and saying fani willis's name. >> when i pulled up, they thought that i was fani, and they started chanting that at me as well. and walking through the crowd. there was a lot of hatred out there. >> they thought that you are fani willis? >> they thought that i was fani willis, a managing that. a lot of hatred and really bad energy out here. but, you know, this is, when you sign up for a public service. you don't get to pick and shows you are good days and your bad. days i had full confidence, and -- was actually the corrections jaipur atlanta, and i saw him just yesterday, he is doing great and there are tough days that come with these jobs and i don't think that anyone wants to be subjected to threats. but i think it's part of the job, and if we get into that, then who are we as a country? that people do not serve because they fear for their lives. that is a threat to our democracy in and of itself. >> what do you make, of not just the threat level of this, it's the political aspect of it too. you know this obviously. when you are working at the white house. and this is something that they are using to their advantage to fund-raise off of. trump before this happened said i just need one more indictment and i will have the nomination locked up. >> i think it's unfortunate. i served as mayor and i have worked with governor kemp. to get the attention, when we did get along, that got the attention. but we worked very closely together. i worked very closely with many republican leaders, and that is what people elected to do. they want us to put aside our political differences and be able to get things done. so when i see what is happening right now during this election cycle. in this republican primary season. it concerns me for our democracy. quite frankly. that we are giving into the worst of who we are in many ways. >> and i wonder if you know this kind of indictment. and this sweeping nature goes beyond people who direct. and ruby freeman, and chavis, i wonder if the district attorney is trying to send a broader message about what happens if you turn and tried to disenfranchise thousands and thousands of voters. and particularly minority voters? >> i think that's extremely important. we will have many more election. there will be many more close elections. i won the mayor's race by less than 1000 votes. i lost a very close race once before. the first time that i ran for office. that's what happens, that's what should happen when you go for office. you win some, and you lose some. but i do think it is important that we send a message very loud and clear that you will not stand for this in the state of georgia. that if you try to intimidate election officials. if you try to intimidate people who are working the polls that there will be a price to pay. >> before trump ordered the steps to the calamities on now. what he said to reporters which we did not air live. but what he said was he still claiming. he had every right to challenge the election. but it obviously went so much further than. that it wasn't just as the attorney general pointed out. trying to file court cases and whatnot. he went so much further than that when it came to trying to directly overturn. it's not just dispute it. >> you do have a right to challenge an election. there's a process to challenging an election, but what you do not have a right to do is to intimidate poll workers, you do not have a right to unlawfully influence the secretary of state. there are so many things that they did where they crossed the line. and as attorneys who have a responsibility to advise your clients not to do illegal things. even if your client does not know what they are doing. >> a lot of people were telling him that. >> absolutely, and certainly it's unfortunate that i am an attorney. it's unfortunate to see that the attorneys have even gotten caught up in this. you don't have the rights to do illegal things on behalf of your client. so, i am not celebrating today. there is nothing to be, there is nothing to celebrate today. but it is reassuring to know that no matter who you are, if you break the law, if you try to intimidate people and try to deny people their boats, that their votes be counted, that there will be a penalty to be paid. >> and what i've been talking about, and reporting throughout the days that trump's new attorney that he met when he got here just an hour ago, i know you know him and you know of him, he's a renowned criminal defense attorney here. but given what you know about him, given what you know about fani willis. do you think she has an airtight case here? >> i would put fani against anyone, on any given day. i have seen them when some, i've seen them lose some. i wouldn't be surprised if there is not an attempt to negotiate a plea. he represents a lot of high-profile people, obviously, but he does not have a flawless record. and fani is a darn good attorney. so if fani it is putting the escapes up. i think everyone should bring the a game to the table. >> how do you think she is watching all of this? do you think she discos about her normal business as the city is shut down for the last few hours waiting for his arrival and having him coming here? >> knowing fani willis as i do, she is matt losing an ounce of sleep over this. and you have to remember, even while all of this is going on, i mention the wildest owl trial with young tongue that is going on, there are other challenges that are happening in the fulton courthouse. other cases where her staff are preparing to try some business. it's continuing. and in the courthouse i don't think that fani is losing any sleep over this one. >> i think she's also trying to make sure the rest of the codefendants have turned themselves in. 18 other codefendants. >> how many have they been now? >> there are many others. and they have not all been processed through the jail. not all of them have responded yet. >> and also there's a mugshot, and i should know that they we are waiting. we do have trump's mugshot. we are waiting on it to be able to post that. but he is just without a doubt in the motorcade. and what you are seeing now is the play in. he is treated like most other codefendants in the sense of what actually happened inside that jail. >> most other criminal defendants would not be out there that quickly. most others would come in, and it would take hours to process them. it will be interesting to watch what happens with harrison floyd, who showed up without posting a bond today. he very likely will be there at least until tomorrow morning. because he will need to have a first appearance hearing. i don't know if he is out, or if the district attorney did something to process them out quickly. under normal circumstances you show up, usually you don't have a bond. you have to wait overnight in the fulton county jail. you are given about the next day after your first appearance hearing. those are the cases, or that's what i used to preside over when i used to sit out here as a judge. then hopefully, you are granted a bond. if you are a defendant and then you are processed out. but it usually takes several hours if not a day or so to get a defendant processed out. >> mark meadows is one of trump's former chief of staff who surrendered. he was trying to push this. he has a hearing on monday, he's trying to get it move from state court, a federal court. and he was essentially arguing, i shouldn't have to meet that deadline from tomorrow. and they push back on that saying, fani willis argument when she responded saying i've already given you two weeks as a courtesy. that's the role of defended that we get. and that's accurate. so for those who have the reverend themselves in. i think they have to wait to find out what happens if they didn't turn themselves. and i can tell you what's gonna happen. what happened today. sheriff's gonna be out looking for them today with a warrant for their arrest. so i think that is. if they want to get in and out of your quickly. and the last thing that you want to do over the plan is to give both the in fulton county jail on friday. and you're there until monday. it jails get really crowded over the weekend and when i used to represent cry and, when i prosecuted, people would say please, don't send me over. it's not somewhere the two of you that certainly want to be if you don't have to be here. when i would sit here presiding over cases, sometimes a lot of. stablemate huber. you can share my close ones i am. >> i mean that's a jail, it's not supposed to be the st. regis. it's not the movie. the case. it's well like a jail. it looks and feel like a jail. >> it's striking how people keep mentioning the smile. >> and i've got you discover? vote because everything who has talked about the jail, mentions the smell. >> conjuring up the smell of my mind is not very pleasant. it is, it is a combination of stale food, and buddy order and, it's a tale, so now opening windows and stagnant air, and even where i work in the jail i was in a courtroom aboard present area of the jail. but you could smell it as soon as you walk into the waiting room. >> what the trump say when he went in there today? >> what he likely saw, if he won in the normal way that clients would go in, you command and there's a task at the fright, it's been a few years since i've been in there but there is a desk at the front and than he go through a more sick course the questions that are going to come as soon as this plane takes off with the former president on board is what the timeline of this looks like and we've seen a flurry, a head spinning amount of activity in today and sense of one of the codefendants was asking to have a speedy trial, the garbage granted that. they set a date of october 23rd. is that logistically possible? >> i think it's logistically possible. it's gonna be interesting to see the pull on the resources. because as i mentioned, you've got the trial going on. and it's a multi, it has been a multi. >> i'm just gonna pause for a moment. because we did get that much out of the former president of the united states, we're going to show it to our audience now, this is just the image to see the former president of the united states, who was just put to the fulton county jail behind us, questions remained even within the same as of this morning whether or not this photo would actually ever exist, there you see it, the watermarks just like every other codefendants that is come before him. the former chief of staff, the former mayor rudy giuliani, and to see the mugshot of the former president of the united states. >> when i look at that and he proposed a very interesting look that he has there. it makes me sad. it makes me sad to see a former president with a mugshot. as i mentioned earlier, i take no joy in seeing him booked into the fulton county jail, it makes me sad that a former president has conducted himself in such a way. that it's from not just one indictment, not two, but three different jurisdictions into the full fulton county jail owns that indictment is harassment and sheer torture of two women that signed up and the people vote in the community. >> jake, i mean, you see that image. trump's campaign was created that he is my campaign. another is a mugshot of the former president of the united states? >> it is a stark, and said of on the left side of your screen. fulton county in may number p01135809, otherwise known as the 45th president of the united states. donald john trump, we see on the right side of the screen, his boeing 737 about to take off from hartsfield international airport in atlanta and its way back into newark, new jersey, dana bash, no doubt the trump campaign and his supporters will try to make light of the image on the left side of your screen but the truth is the allegations and the conduct described in the indictment, whether or not he was found guilty. whether or not you think it is a strong case. the elevations and the conduct are factually accurate. and, tragic. and that image is what i think of when i think of those, that conduct. >> and that is now an image that will be cemented in history, i mean how many images are there of donald trump, he is maybe the most famous person on the planet, but this particular photo with the fulton county, you can tell me exactly what this is emblazoned on the corner there that is going to be iconic and infamous is probably a better way to say it, and i think that you said that maybe they will make light of it. maybe some people make light of it. but they are going to appropriate it. they are going to embrace it. and they are going to use it as the ultimate example of his entire campaign. which is they are able to get me. it does not make it right, it does not make it accurate, it just makes it a very, very potent political tool and weapon, that he very much intends to use. >> we've already seen trump's allies, marjorie taylor greene, they're making their own mugshots using it as a badge of honor. but i think about the whole pattern of facts that we are talking about here, which is a former president officeholder, top officeholder in this country, trying to hold on to power, trying to do it by any means necessary, doing so in a way that method to multiple criminal charges, multiple jurisdictions. now that person is running for president again, and his supporters are treating his arrest as a badge of honor. that's not a good fact pattern frankly per the united states of america. and it is incredibly sad for this country that we have to go down this road. the unfortunate thing is that, you know, other countries go down this road to. this is just our turn to do it. and we have avoided this particular moment because, until trump, there has been a tradition of handing over power when you lose. peacefully. and just doing it. and showing up at the white house with the guy coming after you, and shaking hands, and sitting down, and having a tv. and trump's refusal to do that, that tradition that is not founded in law but as part of our tradition is what has led us to this point. >> and we should point out, there has been numerous disputed elections in the history of this country. 1876, between rutherford and samuel, between 2000 and al gore, george w. bush. >> would never have gotten to this. >> that's my point, i'm agreeing with you. ultimately, they had their day in court, they lost, because they conceded defeat. on that note, i want to, donald trump on the tarmac on his way home, this evening, we did not bring in those comments but just to tell you one of the things that he said. and i want to get your reaction, he said, it's a very sad day for america. and then he went on to say, we challenge an election. you should be able to challenge the election and later in his comments he said, we did nothing wrong, we have every right. every single right to challenge the election that we think is dishonest. we think it's very dishonest. that's accurate. he has every right to challenge an election. and in fact, he exercise those rights. and then he went beyond it. >> right, he exercise the. and then he lost. over and over again. 61 at a 62 court cases, and battleground states, the supreme court declined to hear his case twice. that is a court where he appointed a lot of justices. there were three recounts in georgia, and let's just remember his own attorney general, bill barr, and december 1st said that there was no widespread fraud. chris who is in charge of election security, was a republican, and was fired because he said it was the most to election ever. white house counsel, republican, i just want to say about his election denial again today, this is why former congresswoman, liz cheney and many other lieutenant duncan, or raffensperger i don't think there is a chance in heck with that if there had been evidence of fraud, and otherwise that would've swung the election to donald trump that they would not have embraced it, and stood by donald trump. every single one of them. >> i think you're right but we talked about this earlier, you do remember that they changed the election laws in 2021 after the 2020 election under the guise that there were some irregularities and things and it be fixed. change in place for drop boxes, people that they're with absentee ballots, they try to capitalize on this idea. and now suddenly it appears that they've grown a conscience. if you think about this indictment and i step back sometime from the case, because i think that lori's have to think about how to lose even if the motion is coming on monday. 154 of the 187 at acts that are alleging this and i made a good while he was as a president of the united states. >> right, of hundred 54. >> under 50 for 157. >> that is staggering, everything except for the last document that he sentence of timber 2021. >> those were the two cows that occurred after he was president. when you think about the decision that the federal judge has to make about doing this case, is this a federal executive, is clearly is, to move it to federal court related state in state court. if this is not a case that married some consideration i don't think there ever will be one. >> he is facing charges at the federal level of similar counts. >> the massive question andy mccabe, you were fbi director, we were deputy fbi director. he dealt with donald trump while he was president as a law enforcement official. you look at that image on the screen right now, did it ever occur to you that that would happen? a mugshot of donald trump? >> of course not, right, my interactions with donald trump, my personal interactions with him more early on in his administration. we couldn't see into the future where we would end up, but, i think the point that you make on the consideration of removal, there is no question that could be a very effective legal strategy, isn't obvious and moment is paying for any of these defendants to do. i still think it will be very hard here. i totally respect you are telling of the council, but bolton medley, to make the case that these acts were committed within the scope of their authority director have been authorized by federal law. they have to have been acting on the authorization so federal offshore in, and federal law gives the president of the united intimidation of those two coworkers. the lies about the things that they were saying, they were stealing votes. never mind the sleet of fake electors which is the subject of several of these counts and questions about whether that move and the work that these characters did presumably on the half of the third president to try to steal the georgia election from joe biden, which is effectively the opposite of what donald trump says happened. >> this transfer of motion will be not about is there probable cause, the indictment is great or if there is enough evidence to move forward, this is if there is a plausible claim that he was serving in his federal capacity. >> it's a low standard to me. >> joining me now are senior legal affairs correspondent paula reid was outside the fulton county jail. paula, we just saw donald trump leave after being arrested and booked, where is he next expected back in atlanta georgia? >> jake, it is going to be a busy next month in this case because the next step is arraignment. remembering his federal cases he was processed, he had his initial appearance at the arraignment odd ones. here in fulton county things come in phases. they negotiate bond, and he surrendered, and they scheduled the first hearing before the judge. the district attorney fani willis says she would like to do the arraignment the week of september 5th. the former president at his 18th codefendant will have to come back to fulton county for the arraignment. we could also expect pretty much some ultimately to continue to see legal challenges. we know mark meadows and jeffrey clark have filed challenges trying to move their cases to federal court, we expect the former president will likely tried the same. rudy giuliani has suggested on one of his podcast that he intends to do that. jake, we have to see the legal team solidify, this may be wide to four presidents secured his new attorney because they only have a finite amount of time after the arraignment to file certain challenges to the indictment. someone please ample rudy giuliani, to figure out who is going to represent him throughout the trial, because of course the lawyer who helped with this body has been noncommittal about handling this entire case. it is going to be a really busy that's month for the fulton county case. >> and, the trial, the hearing rather, on whether or not it should be heard in a federal court, it should be transferred from georgia to a federal court, that is monday, is that right? >> that is exactly right, for the mark meadows case on monday, the next thing that is going to happen is a hearing for mark meadows, and the question of whether his case should be moved to federal court. he is confident that if the prosecution gets removed federal court he can get dismissed, he argues that he was protected under a law that protects certain federal officials from state level prosecutions, the dish rigatoni fani willis she waited and she fought back at that, she said look, that had nothing to do with your role as chief of staff, and you are doing. instead those political activity. a real focus on monday will be the infamous call the former president trump and the georgia secretary of state raffensperger. that appears to be what the district attorney really wants to focus on based on what cases the mic of, that gonna be the crux of her case trying to keep that in state court. it is not the only one who is try to make this argument, jeffrey clark has a hero schedule for this and others including trump and giuliani have said they will try this to. >> just game it out for us, let's imagine a judge on monday and the future, any other judges want this to be heard in federal court instead of on the state level, let's say the judge disagrees with them, does this get appealed all the way up to the u.s. supreme court? is that where this is headed, ultimately? >> it's certainly possible these are unique questions, i would expect someone particular like mark melrose who has some of the best double-team in this entire group of people, the appears of the resources to get a lot of legal challenges, he will likely appeal, whether makes it to the supreme court is an issue of first impressions. it's always possible we've seen issues around the former president make their way close to the supreme court if not make it before the bunch. the other thing is if he wins, right? potentially, the u.s. attorney could be the same district attorney is facing now the good wave in the d.a. willis, it will still be a case under state law but a different jury pool. that's another thing that the former president is aiming for. fulton county is a predominantly democratic district and they believe even if they can get the case dismissed at the federal level of damage is get the broader jury pool, that could be more favorable when the former president or any of his codefendants. it's a very unique situation, it's pretty fascinating to see other legal system works and how everybody is trying to game and i'm here. eventually, the case will find its way before adjourning, like literally from fulton county impossibly veterans are. >> the federal jury, thank you so much, paula. i'm back with my team here. a federal jury in georgia, what does that mean? is that geographically different? obviously people feel as though the jury will be more politically diverse instead of as democratic as fulton county's. >> that's probably the biggest upside for him he draws a jury from a large part of the state. if the case stays in fulton county will be in a county that voted predominantly for biden. and his chances won't be good. >> but there won't be jerusalem chen. >> that's the one thing that he will not -- we still have -- you can still question jurors and make decisions about who you want to put on a tremendous transfer to a federal court, the jury pool flawless for multiple counties around the north georgia area. there is a chance that we typically would draw the jury from the atlantic division which would be atlanta counties in the northern district of georgia. sometimes in cases where you don't think you will get enough people from just that division you major off to the entire district which means even in the north district where marjorie taylor greene's from and other people who might be favorable to trump, it expands further they need to do it. it would be unprecedented if they drew a large najarian south of georgia, because they needed to make sure they had enough people who did have some reconceive ideas about the case. that's what will be difficult here, the jury selection is going to go on for a long time, until they can find a panel of 12 an alternate will have no real feelings one where another about the former president. that becomes, i think, a difficulty. you and look at public polling on that. >> i mean, do you think transferring into a federal jurisdiction, drawing from lighter parts of the state, geographically, means that ultimately the odds that donald trump will have one juror, that's all you need, one juror who will vote to acquit? >> i mean, certainly the numbers aren't in his favor if -- or more in his favor if he gets the case moved to federal court for all the reasons michael said. it's important to emphasize that if he gets into federal court he is halfway to getting this thing dismissed on supremacy clause grounds. he has got to get in federal court to make that next argument which will be you should dismiss this case because i was acting within the scope of my federal authority, and that is another whole argument. but, that would be, i'm sure any of the defendants optimal result. >> it's possible that you get 12 jurors who were objective and hear the facts, and they all voted for donald trump twice and ultimately when presented with the facts do their duty and vote the way they think is current the not according to whether or not they like donald trump. >> it's true, but i think the fear for any prosecutor and lawyer talking to roger is somebody not been candid in georgia's election and is getting into the jury almost as a plant. under the idea that maybe they are patient and somewhat. that's a concern. you used the process to weed people like that out but, you don't always do. it just takes one. you could have 11 people whom reach a guilty verdict and the guilty decision in 20 minutes. and the one juror can say i am never going to do it and suddenly he is not guilty. >> i mean i would suspect in this day of social media footprint and intense jury selection, or organizations i would be very difficult trump do not impossible. kaitlan collins? >> yes, jake, nine pm here in atlanta, or sitting outside the fulton county jail where
