right now save up to $900 off mattress sets during purple's labor day sale. visit purple.com or a mattress firm near you. deadline to surrender. donald trump and his 18 co-defendants in georgia must turn themselves in to the fulton county jail this week. what we're learning about when they will actually show up in atlanta as the former president says he will not show up to this week's gop debate. a wet and muddy mess in california. the southwest cleaning up from rain and flooding after historic tropical storm. we are tracking the impacts and the lingering threat. and soon president biden will arrive in hawaii to see the aftermath of deadly wildfires. some residents criticizing the official response so far, with hundreds of people still missing on maui. we're following these major developing stories and many more all coming in right here to "cnn news central." we begin this hour in georgia. today donald trump's defense attorneys are expected to negotiate his bond terms with the fulton county d.a.'s office. trump and his 18 co-defendants have until noon friday to turn themselves in on charges tied to his attempts to overturn the election in georgia. we are closely watching two key sites in atlanta. the fulton county courthouse. that's where those negotiations will happen. and the jail where the defendants will have to show up and be booked. cnn's katelyn polantz is outside the courthouse. katelyn, what more do we know about these talks and about how long they'll take? >> reporter: well, we're expecting these negotiations between the prosecutors here in georgia and donald trump's december lawyers to happen this afternoon and that there may be other lawyers for other defendants. some of those or maybe all of those 18 to be coming in or somehow negotiating with the prosecutors in this case. what they have to negotiate is how these arrests are going to work because donald trump, he is going to be arecerested here. he's now been indicted. he will have to enter his initial pleading, very likely not guilty, same with the did defendants but that can't happen until his lawyers talk to the prosecutors about getting bail terms set, how these people will be released if there are any specific terms that the prosecutors want, maybe travel restrictions, maybe money that they might have to put up. and so we're waiting to see some evidence that these negotiations are taking place here. we have a large team spread out around here at the courthouse complex awaiting this development to see how it goes. there is a pretty heightened level of security here. but it really isn't clear yet when these negotiations would be finalized. and also we're watching to see if donald trump is going to be treated like any other criminal defendant in the system here in georgia. the sheriff here previously said at the beginning of august that any defendant would be treated the same no matter who it might be. but at the end of the day donald trump isn't just any defendant. he is the former president with a secret service protection for life himself. and whenever he goes over to the jail he would be very different than many of the people who would be held there in that he comes in with his own security, he might not need to be mug shotted because he's so recognizable. but that will be for later in the week. we're waiting to see exactly what emerges from these bond talks when we can confirm that they happen. >> yeah. among the many questions. mug shot? fingerprints? we'll see. katelyn polantz outside the courthouse there. thanks so much. boris. let's expand the conversation now with cnn chief legal analyst and former federal prosecutor laura coates. and laura, we've got to update that intro because you're also the newest cnn primetime anchor at 11:00. look forward to that. congrats. >> thank you, boris. you're such a sweetheart. thank you for mentioning it. >> let's get to it. donald trump and his 18 co-defendants set to turn themselves in later this week. what are you anticipating? >> a bit of a circus. a bit of a parade of unexpected people who normally would not be seen in this venue. you're talking about rudy giuliani. you're talking about mark meadows. you're talking about donald trump. and you have a host of other people including a lot of attorneys, including sidney powell and beyond. so you're going to see something that's very unexpected and uncharted. but the key here is to recognize that some of the things you might expect of high-profile defendants might not be present here because when you are indicted in this particular jurisdiction and across the country you ought to be treated equally. equal justice under the law recognized the same way. now, of course donald trump stands in stark contrast for the reasons katelyn talked about. no one else is going to have secret service with them. but as far as the detail as we now know them, it appears they're going to follow every protocol they normally have for any defendant. >> well, on that note because this is uncharted it leads me to a question about a mug shot because we've seen donald trump take every legal battle that he's had and sort of kung fu it into an advantage. we see his poll numbers go up. we see his fund-raising go up. i wouldn't doubt they would take a mug shot and then start making t-shirts or paraphernalia. does that at all go into the considerations over that decision? >> i'm sure politically it's advantageous as he has said already, i just want one more indictment and i can win this thing. well, be careful what you wish for, mr. president, because you had that one more indictment. now, you've had a lot of other famous people with mug shots. nick nolte, frank sinatra, wesley snipes. i mean, tom delay, i think, had one as well. a lot of people who've had mug shots before. so it's not unheard of. but the notion of him having one could be very well used as a kind of campaign propaganda. a kind of saying listen, his whole platform has been it is me against the world, they actually want to get to you but i'm standing in the way, so really this weaponized government is doing just this. that could be a possibility. but really mug shots are supposed to be a part of the entire booking process for two reasons. one, to identify the person. we already know who he is. but of course we know other famous people as well. and number two, as a part of the system and a part of what the track record has been. he has now three other indictments. they have a record of him. they know where he is. they probably have his fingerprints already. but still, he may not be afforded all these luxuries of saying hey, you know what, it might be off-putting. well, he has now indictments. >> that nick nolte mug shot will go down in history -- >> oh, yeah. with the hair. it was crazy. i remember it. >> it's special. you mentioned something i wanted to dig deeper into, be careful what you wish for. for most defendants they're worried about federal charges. but even if he's elected president the state charges are not something he could freeze or get rid of. those potentially carry more weight. >> oh, that is going to be baggage that will cover and carry into the white house if he were to be elected the president of the united states. i've heard people mention things like this is an insurance policy for jack smith, having fani willis's indictment. i don't see it that way. these are two separate sovereigns. now, if they have complementary laws that are at issue or complementary indictments, that is merely a coincidence. but it's not an insurance policy that one actually coincided according with the other. it's more saying look, a state prosecution will stand as it is. there's a reason for that. fani willis and fulton county and georgia has a vested interest in how their elections are run and how they are undermined. we know the constitution, our founding fathers, our laws give our states the power to regulate and oversee their elections. so in some respects if georgia and the allegations are true, that would all be georgia state territory. and a federal prosecution would have to stay in its own lane. there are very interesting reasons to look at both of these. but at the end of the day a state prosecution overseeing state voting laws is going to be extremely important in how elections are run from here on out. but the federal charges do not give the side eye to them, boris because they're very significant. but if he is the president he could pooh-pooh that and do away with it. >> no sideeye for me. >> no side eye. >> we should also note a slew of georgia officials from the governor, lieutenant governor, the secretary of state have all said that the elections there were fair and free and there was no supposed -- >> and these are republicans too. >> precisely. precisely. so on to the question of mark mead oelz, meadows, trump's former chief of staff. he's now essentially trying to get a federal court to intervene in the state charges to dismiss them saying i was just carrying out my duty as chief of staff, following orders. does that have legs? could that stand up? n. court? >> well, he will argue that in court. but the criteria is one, you had to be acting under color of office. meaning what you were doing was actually a part of your duties. think about it. a federal office looking at the actual state elections are already at odds with one another for the reasons i just said. the other aspect of this of course is the jury you might get. you might want demographicwise, maybe the district of georgia the north as opposed to the primarily democratic-voting fulton county perhaps as your motivation for that. that's jury shopping, though. and we don't want that in our system of justice. also, to prove that you actually could be removed, remember, you've got to prove to the judge, and that federal judge is far more seasoned, frankly, than the new judge that's been assigned and appointed -- nominated by governor brian kemp more recently that has the case right now. it would put the prosecutors in a bit of unfamiliar, uncharted federal territory although they are able to do both. but there's really a rock and a hard place. federal courts are not meant for the faint of heart. the laws, the evidentiary burdens, all that's going to be very, very important. so if you choose that, it might be out of the frying pan and into the fire. either way you have to prove you actually have a reason to get there. it can't just be i don't feel like being in state court. >> laura coates, appreciate the expertise as always. look forward to seeing her at 11:00. >> thank you. >> of course. brianna? [son inflates] we can do it! ♪go to your happy price♪ ♪priceline♪ donald trump says that he will skip the first republican debate on wednesday while a super pac that is backing him is trying to skip right to the general election. pro-trump maga incorporated releasing a new tv ad today hitting president biden on the economy. it's the second trump versus biden ad that the group has put out in two weeks. cnn's alayna treene is near trump's bedminster golf club with more on this. alayna, what are you hearing about the trump campaign strategy? >> reporter: well, brianna, they are clearly trying to set up a contrast directly between the former president donald trump and president joe biden. and make this seem like a pivot toward a general election strategy rather than focusing on the primary. now, the ad itself is really hitting on the big picture themes that i know that the former president's team wants not only voters to focus on but wants the former president to focus on as well. themes like the economy, china, the border and crime. all messaging that they think can help him win. boat in the primary and potential general. i also have had many conversations with donald trump's team over the last few days and hours and i know that donald trump both privately and publicly has been boasting about his commanding lead in the polls and pointing to them as some of his reasoning for why he thinks he can just skip that debate on wednesday. and remember, while all of his republican rivals are currently preparing to take the stage in milwaukee donald trump won't be there. and so this is kind of where their posture is right now. they're focusing on a general. but of course again, this is very early on in the race. the primary elections are a far way away. and a lot can change between now and then. especially as you have all of his legal troubles hovering around this. and of course donald trump is expected to head to georgia this week and surrender. and it's still unclear what these legal troubles will do and how they'll play out in the campaign down the line. >> alayna treene live for us in bedminster, new jersey. you mentioned those legal troubles. we are following those as well. i do want to head now to fulton county, which is where our katelyn polantz is with some breaking news. what can you tell us, katelyn? >> reporter: we do have the first of the bond agreements of these 19 criminal defendants in the state of georgia related to the 2020 election and the aftermath working around donald trump. the first one that we can see the paperwork on, what has been agreed to, is for john eastman, a lawyer who worked for trump as an elections lawyer and became quite a prominent name in arranging with fake electors and other people. his bond, $100,000. that's for the nine different counts that he faces here in georgia that he will be arrested for now that those bail terms are set. he also will have to be arraigned before a judge or waive his arraignment on a piece of paper and enter his pleading of not guilty. that's what we expect john eastman to do. but some of the additional terms here, it's not just money that has to be put up, either a percentage or the full amount in cash if he so chooses, if he doesn't want to use a bail bonding firm. he also is ordered not to have any communications with other defendants in this case or with any possible witnesses in this case about the facts of this case. so that is all of the things around the 2020 election that he would have been doing for donald trump. we're going to be watching to see if there are other consent bonds that are made between these defense lawyers one by one and the prosecutor's office. and we do believe there are negotiations going on throughout the day, even this afternoon, even for donald trump and his lawyers working with the prosecutors here in georgia. >> go through a little bit just to refresh people's memories of who john eastman is, katelyn. >> reporter: yeah, john eastman has become one of the most central figures in what happened after the election. he was an elections attorney for donald trump. he had a letter saying he was coming aboard the trump campaign. and then he became someone who was pushing these ideas, not just of using fake electors but also the idea that mike pence and others in congress could block the election's results. and he was moving that forward. we actually have seen quite a lot about him before. we've seen his e-mails. a judge previously, totally separately in a lawsuit in the house investigation previously, there was a judge that released his e-mails to the house, which became a crucial part of some of the facts of this case and all of the other investigations around january 6th. and that judge, when he had looked at what john eastman had done with donald trump said yeah, it did look as if these two men were trying to advance some sort of crime. now we have john eastman charged alongside donald trump in this case. we also have him in the federal case related to january 6th as a co-conspirator. so his bond term, $100,000, that is a steep price as he faces these charges to remain free and not have to await a trial in jail. >> such a key player as we monitor this development. katelyn polantz as we monitor this from georgia. thank you. jim? >> let's discuss some more the politics with cnn politics commentators. alice stewart and maria cardona. great to have you both. >> good to be here. >> first a look at some of this polling in iowa. trump with a big lead. i want to ask you just as a devil's advocate for a moment, the thing about iowa is that second choice votes matter. if your first choice duntsd make it then you can switch to another candidate. is it possible that even if trump wins a viable alternative might emerge from this that consolidates some of that non-trump vote? >> it's completely possible for that to happen. and that's the beauty of iowa, is that it's not necessarily there to pick the winner for the nom nomination, it's there to winnow the field. and what you're talking about is the person who puts on these polls because she understands iowa politics. what you're referring to is what he this call the iowa footprint. as caucusgoers, you can go in and like you said pick your first or second choice and they're still looking at it. what this poll does, it asks people what is your number one choice, your number two choice and your third choice. that is the iowa footprint you look at. with these numbers donald trump is 63, ron desantis 61. so the iowa caucus process and the footprint is not as great for donald trump as the original numbers show. ron desantis is really nipping at his heels. and the iowa caucus process being unique as it is is beneficial to someone other than trump. >> that's notable. it's interesting too when you look at history. reagan, george h.w. bush, and by the way trump in 2016 lost the iowa caucus and still went on to get the nomination. i wonder, maria cardona, are democrats silently hoping for trump to be the nominee? >> you know, that's a good question. and i've heard both things. both yes because clearly he is somebody that joe biden already beat and i believe that if trump is the nominee as well as other republican strategists believe this too, which is why they're trying to find somebody else desperately, that joe biden will beat him again. it will by no means be easy. but i also believe that no matter who is the nominee, if it's not donald trump, and that's a big if, i believe that joe bide lenn beat that person as well. again, not easy. we cannot take anything for granted because we live in a super polarized, divided country. but the fact is that every single candidate who has any possibility of making it out as the nominee is supporting an extremist maga agenda that the vast majority of the american people do not agree with. and what is so harmful for the republicans as a party is that they have to be all in, they have to promise that they will absolutely support this extremist maga agenda in order to win the nomination. but that agenda is what is anathema to the vast majority of the american people including independent voters, which they need to -- >> i have the sense you want to pipe in. >> if i can just clarify one point that my good friend maria made. it is not the extreme maga agenda an electorate that would be taking on joe biden. part of what this republican party is doing and what we're seeing with the rnc in this debate, asking all of those participating in this debate to sign the loyalty pledge, this is not just a loyalty pledge to support the nominee. it is a beat biden pledge. the republican party is going to galvanize together as we get a nominee to beat biden and beat these policies that are causing the economy to be the way it is, safety and security for the american people to be at a place where they don't like. and if you want to run on the economy, that's unfortunate because the american people aren't feeling good about the economy. >> we should note that the current front-runner has not signed that pledge. a guy by the named of donald j. trump. >> that's exactly right. >> is there any credible race that's quiet behind the scenes among democrats for an alternative to joe biden? >> absolutely not. >> are you sure about that? >> yes. >> there are some pacs that have been set up by gretchen whitmer, for instance. >> by people who might in an imaginary world and given the reality that we're in today, you know, they're not thinking correctly, i believe. right now joe biden is going to be our nominee, is our nominee, is running for re-election. and he is in an extremely powerful, strong position to beat again, like i said, whoever is the republican nominee because my dear friend alice might want to say that the whole republican pack is focused on beating joe biden. but what you're going to see in the debate is they're going to all try to outmaga each other. they're going to say who is going to be the extremist, that is going to talk about getting rid of the 14th amendment, talk about who can ban more books, talk about who is going after the woke in the country, going after more places where they can take away women's rights to choose. and they're all going to be supporting donald trump, who is a huge threat to our democracy. so by all means, this is going to be a wonder list of things that democrats are going to be running on in the general election because again, the vast majority of the american people do not support the extremist agenda. >> before we go i can't give you too much time but on reproductive rights you know that doesn't work for republicans in a general. are the positions staked out in the primaries among republicans going to irreparably harm them in the general? breaking news. john eastman, donald trump's former attorney, has just reached a bond agreement with the fulton county district attorney. $100,000. eastman faces multiple criminal charges for his alleged role in helping trump try to overturn the 2020 election in georgia. remember, he's one of 19 defendants facing charges including the former president himself. cnn chief legal analyst laura coates is back with us now. so laura, $100,000 bond. how do you read this? >> well, looking at the documents right now, remember, he is charged with multiple counts. and they're very serious. from rico to conspiracy and beyond. this is actually quite typical to have bond. a real way to think about this is listen, i'm going to allow you not to be in prison or in jail awaiting your trial but you've got to give me some sort of guarantee that you're actually going to show back up and i can trust you. and the trust comes in the form of a monetary payment, hence the $100,000. so he will go to a bail bondsman who will ask you for 10% of the ultimate charge. if you do not pay that, of course, you can be a fugitive. you can have a warrant in defense of a bounty. obviously not lethal. on one's head to have you return to court. this indication to give this sort of bond means a judge said you don't pose a threat to society, a public safety risk and perhaps even a flight risk because i believe this $100,000 is going to guarantee you're going to show back up for your trial date. i will note, though, in this he has to report to pretrial every 30 days meaning you're passing a drug test, you're checking in with somebody every so often, and perhaps the most important thing here, boris is that he cannot communicate in any way either through intimidation or otherwise to a co-defendant. 19 people, essentially. or to a witness in this case. which means that at some point you're going to hear from fani willis's team to say who are the witnesses that could be in this case. this happened in the jack smith case as well. down in mar-a-lago. the co-defendants of walt nauta and carlos de oliveira. but here it's more people involved. and how are you able to sort of thread the needle not to communicate, not to intimidate ought to be an easy concept, of course. >> well -- >> but not so much these days. >> let's talk about that. because if we anticipate that former president trump's bond agreement is somewhat similar to john eastman's, it may get complicated given that the former president doesn't bite his tongue when it comes to talking about witnesses like former lieutenant governor geoff duncan on social media. >> he has more than toed that line. he's probably crossed it a number of times. hence the concern of the judge in washington, d.c., chutkan, on the request of jack smith. this is a different case, though, and will be treated differently. but you're right. unlike the other issues, we had the valet, walt nauta, or someone close to his residence in mar-a-lago, this includes people he may have correspondence with. you have giuliani, you have sidney powell. you've got mark meadows, a former chief of staff, obviously. not too aware at this point of what their actual relationship is at this point in time. people thought he was going to be a cooperator in the other matters. but having been named here is the key. ultimately, though, this court will look to make sure that the matters of justice are not fatally undermined by somebody saying listen, it would be a shame if -- it's a nice house you've got here, it would be a shame if anything happened to it. or i want you not to testify against me. or on twitter or truth social any way of making someone feel intimidated enough. what that threshold looks like can be different for every defendant. a generalized statement on truth social about an issue with the justice system or a complaint about a prosecutor or a complaint about him feeling railroaded, these are all things that might not rise to the level. however, a specified threat, a specified statement that would make somebody less likely to feel compelled or interested in testifying, that's a serious one. >> laura, i also want to take a step back and talk about john eastman generally. he was at one point a very well-respected constitutional lawyer, and now he has a $100,000 bond agreement with fani willis and the california state bar is trying to disbar him. talk about the developments in his professional career. >> remember who he is. he is known as sort of the architect of the pressure campaign against vice president pence based on what he believed or he said he initially believed was a surefire way to actually have an elector scheme that would say your role can be more than ceremonial, you can actually say no, we're not going to do this. now, his lawyer in his disbarment proceeding said this is a matter of scholarly debate. i'm not sure which classroom we're having this debate of course, boris, because it's very clear that the role of the vice president is not to be anything more than ceremonial. you have members of congress right now trying to have that law changed or rewritten to make sure that it's all the more clear. but he is suggesting that he was simply trying to opine on these matters and not trying to do anything that was untoward, that was illegal or in any way would undermine justice. however, he also is the person according to at least one person, mr. jacobs, who said he believed that he would lose this argument in front of the supreme court 9-0. remember that famous statement. 9-0. except he thought because he was the clerk of clarence thomas once maybe he could lean on him in some way. at the end of the day, though, the most important things to think about, because of that disbarment proceeding you mentioned, on january 6th in front of congress he did not testify. he pled the fifth multiple times. we saw it played over and over again. in the disbarment, though, he took the stand. ( ♪ ) constant contact delivers the marketing tools your small business needs to keep up, excel, and grow. constant contact. helping the small stand tall. - i'm sherry - and i'm john. i'm a pharmacist. as we were starting to age, it's like, well how can we help our cognitive abilities? we saw prevagen. i did read the clinical study and went ahead and gave it a try. i feel that prevagen is helping me with overall clarity and as a pharmacist, i've recommended it to, not only just customers, but also to friends and family as a safe product to try. prevagen. at stores everywhere without a prescription. meet the team... behind the team. the coach. the manager. and the snack dad. all using chase to keep up with their finances. the coach helps save goals here, because she saved for soccer camp there. anddd check this out... the manager deposited a check. magic. and the snack dad? he's getting paid back. orange slicesss. because this team all has chase. smart bankers. convenient tools. one bank with the power of both. chase. make more of what's yours. more news out of fulton county, georgia. another surrender agreement for one of the defendants. cnn's katelyn polantz has been covering. katelyn, who is it and what's the deal? >> reporter: well, this is the second term agreement that we have learned of today, and we now see on paper. this is for a man named scott graham hall who is accused of working with sidney powell and others to try and access these vote tabulating afghans in coffee county, georgia. part of this racketeering case. scott graham hall's bond is set at $10,000. and actually, he's a bail bondsman himself. so we now have those terms of agreement here at the fulton county courthouse. there are negotiations clearly taking place this afternoon. there's a lot of law enforcement activity. we just saw some additional lawyers head into the courthouse. ken cheseboro's lawyer was walking in, very likely to do his version of the negotiations for his client. ken cheseboro was one of those people who was working with other lawyers around trump trying to set out as architects of this fake electors plan, the use of fake electors for donald trump in battleground states across the country. and then we also have a bail term set for john eastman. these are going to be coming in one by one for each of these defendants. very likely today. could go into the future days. but all of these terms, these defendants are going to want to have set because it allows the judge to sign off on how these people can be released as they await trial so that whenever they go to the jail to turn themselves in to be arrested, to be processed they don't have to sit there for a long time. they can be processed. and then they can be released. but there will be a question of how long all of them including donald trump will be in that jail and exactly what donald trump's release terms might be. >> can we learn anything from these early deals for eastman and hall that relate to the president's case, or is that dealt with entirely differently? for instance, on the question of mug shots and fingerprints, for instance. does this particular co-defendant have to be subjected to that in the way that the president, the former president might not be? >> yeah, we haven't actually learned how that process is going to play out. this is something that's being done by the prosecutors and the court is signing off on it. the people who do the processing, the mug shots, the fingerprinting, the searches over at the jail, that's the sheriff's office. so another entity entirely. so what we're seeing here right now, it's just a one-page set of terms. but releasing these people for these charges on these substantial amounts of bond, that is something that is notable. not everyone who's charged as a co-defendant of donald trump is being given a bond, at least in federal court. trump has zero dollars so far for his bond in the two federal cases that he faces. now, the other thing that's notable in these arrangements is it appears that these people are getting a provision where they're not able to communicate about this case, or the facts of it, with other witnesses or other defendants, something really to watch because these are legal circles. people who know each other quite closely, who've worked together. and that is a provision that the prosecutors do appear to want to put in place as they await trial. >> and do they abide by those restrictions. katelyn polantz at the fulton county courthouse, thanks so much. and we'll be right back. boris, there's a heightened sense that something is happening right here now at the fulton county courthouse complex. that's because negotiations are taking place this afternoon very clearly among these 19 defendants, their lawyers talking to the prosecutors here in fulton county, the office of district attorney fani willis, to set the terms of bail for each one of the defendants in this case around donald trump and the 2020 election. we're just getting those agreements. we have the agreement of lawyer john eastman. one of the top lawyers who was assisting trump after the election. to try to block the transfer of power in congress on january 6th. john eastman will have a $100,000 bond agreement. another defendant here, scott graham hall, he has a $10,000 agreement. he's agreed to work with others to access tabulating machines in rural county georgia, coffee county, working with sidney powell and others. we don't have donald trump's yet. we believe his lawyers will be negotiating if they aren't already with the district attorney and they will set a bond term for the former president. in his federal cases, he's had to post zero dollars bond. so we are waiting to see if this is a little bit different. in one aspect, it will be different in that all of these defendants, they aren't just arrested before their appearance, before a judge. inside a very quiet federal courthouse. they have to go to the very busy jail here in fulton county to be arrested and processed. something could take a little time but very likely at the end of the week. >> plenty of developments there. keep us posted on what you are learning. right now millions of people out west are dealing with significant storm damage. the mud and debris that was left in tropical cyclone, post tropical cyclone hilary's wake has trapped some california residents inside their homes. when you look at some video we have from a clean-up crew in san bernardino, there is a mud slide, you can see, that just has slathered the streets and the sidewalks there. this is a storm far from over. 60 million people under flood watches still at this hour from southern california all the way to idaho. stephanie, tell us what you're seeing. >> reporter: people come to the desert for spa treatments and get the mud baths. this is not what they were looking for. we're seeing the water recede but that thick, kind of juicy mud, is all over the roads. you can see that it is still down in the distance, it is cut off some access to the interstate 10 freeway here because there are still big trucks and cars blocking the road. we did just confirm that some of the roads are being reopened. but the three major roads into palm springs are still closed. you can get in from other ways. it is still a big mess here. we did just see the owner of the small black car here that is right in front of the white car, he was not driving. he was home. his car floated away. that's how it ended up here. it floated several hundred feet from where it was. he just told us, he didn't want to go on camera to give an interview but he said his car is completely totaled. that's how i'm assuming the white car got here, too. you see the mud is up to halfway in the wheels. the other car, the black one, she's been sitting there for five hours. she drove past a roadblock into the mud and got stuck. exactly what they don't want you to do. >> take note. that is a cautionary tale. we talked to you a couple hours ago and she was still there. thank you for that report. i'm joined by brian ferguson, the deputy director for california's office of emergency services. brian, thank you so much for joining us. we're seeing these pictures. give us a sense of what you are dealing with right now. >> reporter: it's been a long busy night for us. certainly the worst of the storm has passed for most of our state. there are many areas still seeing the secondary impacts of the water coming down from the hills and mountains. we're looking very closely at that for the rest of the day today. no loss of life so far. very minimal impact to residences. a lot of steps happened on the front end of this disaster to put first responders in place early to get people out of the communities that are most impacted, and while there's certainly going to be a long clean-up effort underway, we're pretty pleased with where we are right now and a lot of that goes into the preemptive work that happened in advance. >> the preparation certainly sounding the alarm for people expecting this. what are the ongoing risks that people should be aware of. you mentioned some of the secondary water still coming down. >> reporter: yeah, so this storm continues to make its way northward throughout our state. there is additional watches and warnings in place for northern california today. we're keeping a very close eye on the burn scars. places that wildfires have gone through in recent years. any amount of water on these burn scars could lead to mud and debris flows as you've seen and we want california to remember the role they play to keep their loved ones safe as you identify, not driving around roadways. if told to evacuate, doing so early. in leading the advice of first responders. so far, so good. if we can get out of this without a loss of life, we'll feel very lucky and that work will continue through the day into the night in california. >> this historic storm is one of the few things that you all are dealing with there in california. wildfires, snowfall this winter broke a 40-year record. do you have the resources to continue dealing with these record-breaking events? >> certainly this is a highly unusual event. the first cyclone we've had like this in close to 75 years. we've been luckied under gavin newsom to make really big investments in this so we have some of the best resources for first responders any place in the country. really sophisticated stuff that we can ooth states can pick up on and take lessons from. our governor if he could, he would be out clearing the road himself. that's how committed he is. we have the resources at the state level and we're also in almost constant communication with the federal emergency management agency. if there is federal assistance or resources that need to be brought in, we'll have to bring the additional resources to help the folks get through this.
