it would be the longest sentence by far coming from the january 6th attack and the other leaders of the far right extremist group could also be facing decades in prison. what the prosecutors call the vanguard of political violence in this country. calls for the justice department to intervene in the attempted murder case against two white men who are accused of shooting at a black fedex driver who was just doing his job. a mississippi judge says he had no choice but to declare a mistrial. the reason all boils down to a police officer who is accused of breaking court rules. i'm sara sidner with john berman and kate bolduan. this is "cnn news central." ♪ a major category 4 hurricane has parts of the u.s. bracing for a rare threat not seen in decades. hurricane hilary currently has 145 mile per hour winds as it inches toward california and while the storm will likely weaken just before it strikes the state, the rain and wind could still be deadly. more than a year's worth of rain is possible in just one day for some areas and that could trigger dangerous flash flooding. bulldozers have been moving sand on beaches with wind gusts up to 60 miles per hour possible. this could become the first tropical storm to hit the area in 84 years. meteorologist derek van dam has the very latest for us. where is the storm? where is it headed and when? >> look, john, this storm exploded overnight. it's really a category 4 monster just off the coast of mexico right now. just because you see a category 4 storm now doesn't mean that that's what we will experience when it reaches the southwestern united states. very important, but as the situation comes with tropical storms, we typically get a surge of moisture and it will really be the rainfall threat that i am mostly concerned about across the southwestern u.s. we will break down the details here. look at the projected path from the national weather service, a weakening hurricane as it approaches the baja peninsula. let's take it further out in time from sunday evening through monday. tropical storm force conditions possible in extreme southern sections of california including san diego, and then look at this, the remnants moving into the western half of the u.s. the flood threat cannot be diminished. we have a rare level 4 of 4 from sunday to monday morning for the interior of southern california. weather prediction center does not issue that lightly. we have a moderate risk including san diego northward into las vegas. the potential for mudslides and landslides exists. let's compare this to a previous event. why do you need to care? this happened in death valley in 2022 with a less significant storm, it produced 1.46 inches of rain, on average death valley receives a little over 2 inches of rain in the entire year with this particular system we are predicting anywhere from 3 to 4 inches of rain. so as john so aptly said in the opening statement of the show, we could receive over a year's worth of rain just in a couple of days. this storm will encounter cooler waters as it approaches the southwestern u.s., if it stays more offshore, more coastal concerns in terms of coastal erosion and large waves. if it stays inland, that brings the rain threat a little further inland as well. john, so much to cover with this storm. >> it really it, again, worth noting that storms like this very rarely hit where this one is headed, right towards san diego. >> correct. >> maybe a little bit inland for them. people need to pay very close attention to it, even as the storm weakens, it is still very, very threatening. derek, thank you very much. wild to see it like that. in hawaii the atf is now joining the investigation into the cause of the deadly maui fires. the death toll remains at 111, but more than 1,000 people are possibly still missing. only a handful of the people who were killed have been publicly identified. they include 79-year-old afraid dough galinato. his family believes he died trying to protect the family home that he built. we are also learning of some deaths amongst children. 7-year-old tony takafua, his mother and grandparents are among those killed. they died while trying to escape. relatives say that the remains were found inside a burned out car near their home. as the recovery effort continues the island's emergency management chief has just resigned. he faced early criticism for the initial response as the disaster was unfolding and separately now hawaii's water management agency is also facing scrutiny. cnn has learned a state official may have delayed giving permission to use extra water to fight the flames and all of these questions are leaving some residents frustrated. >> right now the maui community is helping the maui community, and i'm really -- it's really affected me because where is the president? he decides to come here this week, to come here next week. i mean, like where -- aren't we americans, too? like we're part of the united states, but why are we getting put in the back pocket? why are we being ignored? >> the mayor of maui county tells cnn that as of this morning 45% of the burn zone has been searched. so they are making progress every day, but it is a slow, daunting task. cnn's bill weir is on maui with the latest. >> reporter: here on maui as that fatality count tics up a little bit at a time day by day, it's the number of missing that weighs so heavy on the hearts of people here and really around the world watching this story. over 1,000 missing according to the governor's last statement on that. given the fact that a lot of the power is back up on the island, a lot of the communication is back up you think we would have heard from those folks by now. and what's especially grievous is when you think about how many children were home that day. i'm hearing again and again from kids, there was no school when the fire hit, a lot of young ones were with their brand parents or someone else while the parents worked. so you can imagine the agony in those families, if they haven't found their children. i spoke actually to veteran urban search and rescue officer from fema in hawaii from the houston area and he says of the some 90 disasters he's addressed in his career, this is unlike anything else. >> what's been really powerful is the fact that there's a number of local firefighter and pd that have lost their homes, lost their everything and they are out there working side-by-side with us. so this is something very personal for us because this could easily have been our community. to be able to help them and see them working in their own destroyed community is really powerful. >> reporter: he told me how they are searching, sort of square foot by square foot with these dogs that are trained to detect human remains. even down to cremated ashes. and they want to be refer rent shall and standing alongside of them in many cases are maui fire and police faculty who have loved their loved ones as well and digging through the ash ash to try to find anything to put people's minds at ease right now. the winds are kicking back up again, nothing as strong as the firestorm tropical gusts that we saw last week, but a concern for the hot spots still in the upcountry kula fire. there are two helicopters ready to put those out should they flare up but many concerns playing out here. so much trauma. bill wooer. cnn, maui. fema is running out of disaster relief money weeks before the peak of the atlantic hurricane season. from catastrophic flooding, fires, as you saw there, and tornado outbreaks to crippling winter storms it's already been a record-breaking year with 15 weather-related disasters that each cost about a billion dollars. now the relief fund could run dry by the end of august, maybe even sooner. cnn's priscilla alvarez is live at the white house. this is a dire warning, we're watching what's happening in maui where tema has people on the ground, watching this massive hurricane that could be coming up and hit the southwest. what more are you learning about this? what are they going to do? >> reporter: sara, there is growing concern within the agency about what happens next because they are seeing their funds with the potential of being completely depleted by mid to late august and of course as we have seen in maui and elsewhere, disasters are getting worse and fema is going to them to help with the recovery, but without funds it makes it just more difficult. now, the feechl ma administrato noted that there are still enough funds for the initial response to maui, but without additional funding, they would put recovery into next year. take a listen. >> we have enough funding to support the ongoing response efforts because we take events like this into consideration, but it would delay -- if we don't have additional funding -- it would delay some of the recovery projects and push them into next year. >> reporter: now, the white house is aware of this, they're monitoring this, in their supplemental request to congress they've asked for $12 billion in disaster funds. that goes to congress and requires their approval. this is one part of a broader funding request that may face an uphill battle in congress. a fema official told me if they run out of these disaster relief funds it makes it more difficult for them to prepare for disasters because oftentimes these are funds that are used for people and for things to get to places where they anticipate there could be a hurricane, there could be a tornado so that they're ready for that recovery without those funds it just pushes everything on the back end and that is the concern. sara? >> reporter: well, kate, they don't say exactly why they're picking that date in particular, that's a very long time from now, but they have a lot of complaints about why they need time between the date that donald trump is charged and the date he goes to trial. typically defendants who are fighting charges want to go to trial very fast so that they can have the opportunity to clear their name, but that is not the approach here at all from trump's team. they want this april 2026, three years from now, because they say they have so much information to go through that they're going to need to prepare for trial. it doesn't exactly work in the way that they're saying where they are saying they want to read every single document as if it's a novel like "war and peace." that's not really how it works, but they are saying that they have a lot of material that they are going to have to go through. they also have to juggle this with other cases. we'll see exactly what the judge does. the justice department obviously wants this to be much earlier than that in january of next year. speaking of other cases related to donald trump, there is already one of his co-defendants in georgia, jeffrey clark, the former justice department official, he's already pushing back as well to a proposed trial date there from prosecutors saying they've asked for march of next year for a trial and that that is a little bit too soon for them to even make the ask. he hasn't even been arrested yet. none of those defendants including trump have been arrested yet. so there is a question there about what's going to happen with that trial date as well. clearly as jeffrey clark raises in his filing, there may be a race on of which prosecutor gets to try donald trump first. we will just have to wait and see how the court proceedings play out in the next couple days. >> that's exactly right. great to see you. thank you. this morning we have exclusive new reporting on one of the alleged architects of the trump 2020 fake electors plot, attorney kenneth chesebro, and where he was on january 6th. remember, chesebro was one of the unindicted co-conspirators in the federal election case. he's charged in the georgia case. and now cnn has identified chesebro on video following around conspiracy theorist alex jones on the grounds of the u.s. capitol on january 6th. with me now cnn's senior crime and justice correspondent shimon prokupecz. on the video. >> on the video. big question, what was he doing there, right? not only is he working behind the scenes and now we know allegedly that he is the architect of this whole scheme to introduce fake electors, but now we see him actually on the grounds of the capitol on january 6th. what we've also discovered is that he is interviewed by the special -- by the committee, the january 6th committee, by members of congress, and he talks about -- they talk about this sort of idea about creating chaos and his whole idea behind that in terms of trying to slow down the voting, the process of certifying the election, and so it's really interesting now to go back and find this video which was all dug up by our k file team, really just interesting to see him there. the other thing really is that he was a lawyer for the trump campaign, working behind the scenes and now we see him there on the grounds with alex jones who was really the leading voice behind stop the steal there on the grounds of the capitol. we know he's facing a number of charges in georgia, but he's also -- we've identified him as an unindicted co-conspirator in the special counsel case out of washington, d.c. he is expected to surrender by the end of next week in georgia. we spoke to his attorney, gave us a statement saying that they are going to allow this to sort of play out in court. they don't want to comment right now, they want the legal process to play out and they declined to issue any sort of statement. this is certainly very concerning and troubling and raises a lot of questions about exactly what he was doing there that day. >> to be clear, we have no evidence he actually entered the building itself. >> no, there is no evidence he was engaged in any kind of violence, that he went inside. this was all going on outside, but he's videotaping, he's recording on his phone. you see him there recording alex jones and why was he doing that. >> shimon prokupecz, thank you very much for that. sara? sara? >> yes, hello, john, hello, shimon. while kenneth chesebro is a charged co-conspirator in the georgia case the indictment also details 30 unindicted and unnamed co-conspirators. cnn has identified some of them by piecing together details included in the indictment, among them trump political adviser boris epshteyn, bernie kerik and georgia's republican lieutenant governor burt jones. with us now tom dupree. let's start with this new cnn exclusive information about kenneth chesebro. he has been charged in this case with seven different counts in trump's 2020 election tampering case in georgia. could this new information showing that he was on capitol grounds during the january 6th capitol attack have or make a difference in the case against him or donald trump? >> well, it could make a difference if they can show that he had some sort of active participation in the events of january 6th, in other words, if he was there, he was helping coordinate and that sort of thing, which it sounds like we may not quite have yet. look, there's no question that it certainly places him more at the center of events. it makes it difficult for him to argue that he was an innocent bystander or just a mere witness to the events that occurred if he was actually there following people around, hanging out with alex jones and that sort of thing. it's not the place that you want to be caught -- viewed seeing doing on january 6th. >> i was there in d.c. in november when alex jones was riling people up, long before january 6th. so it will be interesting to follow that line of questioning. now, there is a huge number of co-conspirators as we mentioned, 30 that are not charged, not named. why did the georgia da decide to put them in there but not name them and not charge them at this point? >> well, she had put them in there then you would have had something like 50 or 55 defendants which would be even more unwielding. it's reasonably common in these sprawling criminal indictments to include unnamed, unindicted co-conspirators. there's been interesting guessing trying to figure out who is unindicted co-conspirator number 1, number 2 and so on. i think you can get a pretty good sense of who the people are based on the factual allegation that is surround them. these people will play a key role at trial. they at least according to the indictment were part of the conspiracy, even if they are not formally charged. they would presumably have a lot to say about the events and a lot to say about the evidence that led to these underlying charges. >> so they could either be thrilled, they could become witnesses or potentially if the da decided they could eventually be charged, that is potentially. donald trump's legal team has requested a trial date in 2026 in the federal case that is supposed to take place in d.c. over the 2020 election fraud. the prosecutors want this to happen far earlier, january of 2024. what's the judge to do in this kind of case? >> split the difference. look, i think both sides are being overly ambitious. i totally understand why the prosecutors are pushing for a fast trial and i totally understand why the trump team is pushing to delay things. i think what the judge needs to do is take each side's proposal with a grain of salt, look at the schedule and then just make realistic assessments about how long it will take to get up to speed and prepare for a trial and also how often earth you manage this particular proceeding with the three other criminal proceedings involving the former president. i mean, it's like you're managing an airport and you have a lot of planes and you have one runway and you have to figure out some sort of staging or ordering approach because you can't have everything happening at once. so it's a tall order for the district court but i'm sure she'll manage it. >> tom dupree, thank you so much for all of that. there is so many things to talk about. all right. over to you, john. at best a distraction. that is how some u.s. officials view ukraine's recent focus on crimea. and new developments regarding dozens of police cases handled by five former memphis officers charged with the deadly beating of tyre nichols. >> reporter: yeah, kate, these are really wide-ranging conversations. governor kemp is up there now speaking with erickson, senator tim scott just left the stage. they are touching on everything from domestic policy to foreign policy as well. senator scott led with the personal. he has made by personal biography central to his campaign pitch. he spoke about the goodness of america and argued that he would be the best person to compete against president biden in a general election. let's listen. >> a tough start being a small business owner, having a chance to provide the american people with the largest tax cut in american history in 2017, that's one of the three primary authors of the tax act makes me qualified to run our economy, be commander in chief as well as allow my life story to disease prove the lies of the radical left. >> reporter: so scott also spent his conversation with erickson railing against biden economics and talking about weakening the footprint of the federal government. listen, trump won't be here, erickson and trump have had a rift to put it generously, although erickson did at the outset of the event compliment trump on policy but really this event is about all of the other candidates over the next two days. them having an opportunity to introduce themselves to conservative voters across the region here in georgia but also conservative activists from south carolina and florida as well. kate? >> a lot happening there, thank you so much, really appreciate it. john, one thing tim scott does have is high flavor ability. >> kate, i feel like we need to which is ter. >> as you know, as a veteran of campaign events, that is the hardest of reporting jobs, is to whisper report when people are so closely behind you. she did an amazing job. >> eva did a great job. >> please talk louder. another candidate on the trail today, i think, speaking in full voice is former congressman will hurd. he will speak with voters at the iowa state fair. congressman hurd joins you now. nice to see you. i saw you celebrating yesterday that you had reached the 40,000 donor threshold which you need to cross to get in next week's first republican presidential debate. you are not yet, i believe, at the polling threshold, the latest fox news national poll has you, you know, not even at 1%, which is frankly no change since june. so how do you get to 1% in three polls by next week? >> sure. well, john, thanks for having me on and i won't whisper. here is the reality, we were excited about hitting the 40,000 in donor threshold. we have to keep going. we have had two national polls where we have hit the polling requirements and one state poll. we have, you know, just one more poll, whether it's in another early state or national poll to go, so i feel -- i feel good about that. about being able to be ready to go on that debate stage which we're planning on happening. i feel confident we will be in milwaukee on wednesday. >> so if you don't get there, i know you're planning on it, i know you're hoping for it, but -- >> can i interrupt you, john. >> yeah. >> i'm not -- you know, my goal is to be on that debate stage, we're confident we're doing that and a that's what we're planning to do. >> francis suarez the mayor of miami said i think any candidate who doesn't make the first debate should think long and hard about it because you shouldn't take away time from people fighting to get their message out there. he said if he doesn't get to that debate it's likely he will drop out. >> sure. i think folks like the governor of new hampshire, chris sununu, has also talked about how if there's no pathway to victory towards winter, then people need to start thinking about consolidating and i think that's pretty sound logic as well. for me right now we're going to focus on -- we're going to focus on debate prep and getting ready and getting ready to speak the truth to power. i'm not going to be like ron desantis and defend donald trump, which is absolutely crazy, but i'm also going to be articulating a vision of the future. >> let's talk about that. governor desantis. because this leaked memo from his super pac appeared in the "new york times" that appeared to be giving instructions to ron desantis about just what you were talking about, perhaps defending donald trump. i will read from "the new york times," the debate prep memo urges desantis to defend trump when chris christie attacks him with a specific suggestion for an attack line accusing mr. christie of appealing mainly to democrats. trump isn't here so let's just leave him alone. he is too weak to defend himself here. we are all running against him. i don't think we want to join forces for someone on a stage who is auditioning for a show on msnbc. >> first off, this wasn't a leaked memo, this was a memo that was posted to a website and so this was a level of coordination because the ron desantis campaign is circling the drain. the fact that they're having to cut so much staff, they don't have the resources to do their own debate prep, but the strategy itself is flawed. if you are afraid to take on donald trump, then you shouldn't be on that stage and you shouldn't be running for president. the other thing that was missing in that campaign memo was how do you articulate what your vision for the future is? it was just about attacking other people versus laying out a plan for america. so when i'm on that debate stage i'm going to first answer the questions that's asked and you have two great reporters and journalists that will be asking those questions, explain why that particular topic is important to the american public and then outline my vision of that future. america wants someone who is not afraid of donald trump but articulating a vision for the future. that's what that campaign memo should have said. >> in about an hour and 20 minutes president biden will be meeting at camp david with the prime minister of japan and the president of south korea. it's a fairly historic tri-lateral meeting there. how important is that alliance to battling the global influence of china? mississippi courtroom after a judge declared a mistrial in the case of a white father and son accused of chasing and shooting at a black fedex driver. the woman walking away is d'monterrio gibson's mother. gibson says he was delivering packages, just doing his job last year when two men in a pickup truck began blowing their horn at him. he tried to get away but they started chasing him and eventually shot at his fedex van multiple times hit that go van. the men were identified as gregory and branden case, they face attempted murder charges. dianne gallagher is following the story for us. this is a case where there was exasperation and a lot of emotion after the judge declared a mistrial. what happened? >> reporter: yeah, an absolutely shocking moment in court, sara. a police officer admitted under oath to withholding evidence. the detective had integration video, a witness statement with the victim, d'monterrio gibson, that was never turned over to the defense or the prosecution. now, the judge declaring that mistrial after a motion from a defense attorney for brandon and gregory case who, of course, are charged with attempted murder, accused of chasing and shooting at d'monterrio gibson, a black fedex driver who was just dropping off a package at a house on a dead-end road back one evening in january 2022. now, gibson says he was wearing his fedex uniform but he was in a hertz rental van when the pickup truck came behind him blowing the horn. he saw a man with a gun, the pickup truck tried to stop him from getting out and that's when he did hear those shots into his rental van, chased him out of the neighborhood. gibson after the mistrial was declared spoke with cnn and said that, look, it's felt like a lifetime, not a year and a half since that happened. he has faced anxiety and is extremely frustrated with the police. >> it is definitely a screw up, not the first one they have had with my case and other cases. it's just like due to negligence on their part i feel like -- i'm not going to say it's -- everything was purposely done but a lot of incompetent -- in the police department. for them not to turn over certain pieces of evidence, it's not right. >> reporter: now, cnn has reached out to the brook haven police department. they have not returned our request for comment. sara, an attorney for gibson says they do think they're going to get a new trial, but fear it's not going to be until much later this year or even next year. in the meantime, gibson does plan to file a civil lawsuit against the city of brook haven. >> and i understand the judge said he had never seen anything like this, what that police officer did in 17 years. thank you for all of your reporting there. appreciate it. all right. some good weather news this morning. good-ish, if that's a word. kate assures me it is. fresh off a huge winter snow pack water levels on the colorado river are going up for the first time in years. this has prompted federal officials to announce that it will ease water restrictions on the river next year. still, though, the river basin's long-term health remains in serious doubt. between 2000 and 2021 rising temperatures sucked more than 10 trillion gallons of water out of the colorado river basin and that trend is likely to get worse. cnn's lucy kafanov went to moab, utah. >> reporter: this man has spent much of his life on the colorado river. >> it's a remarkable, remarkable area of the world. >> reporter: as an avid adventurer and colorado river advocate, his mission in life is to protect it. >> this is one of the most important places in the nation and it's one of the places that we need to be really diligent about taking care of because it does contribute soo much to all of us. >> reporter: the colorado river is the lifeblood of this region, powering cities, watering farms and quenching the thirst of some 40 million people. it's a critical refuge for wildlife and a playground that's under threat. >> it's being overused. there's more demand on the river, there's more water being taken out of the river than the river can handle. if we continue to overextract the bank account, we are going to run dry. >> reporter: an unusually wet and snowy winter brought some relief, replenishing snow pack and boosting water levels for the first time in years, but with the rapidly changing climate, experts are warning it's not enough. >> it's been so hot and so dry in the southwest that much of the benefit we got out of the snow pack has literally evaporated. >> one or two extra wet winters is not going to solve this crisis. >> my concern is that people will assume that the situation is getting much better and that we can take our foot off the gas in terms of conservation. this system can crash and it can crash fast. >> reporter: over the last century the river has shrunk by roughly 20%. those losses are more apparent in the lower basin states, but the impacts are being felt across the entire water way. rafting the colorado is a breath-taking experience, it's a slow and sometimes bumpy ride through ancient time at a moment when it seems like the earth's clock is speeding up. even here the effect of climate change, rapid growth and water overconsumption are threatening the very existence of this river. >> we boat through cataract canyon, it's the best roller coaster in north america. class 5 rapids all the way down when it's high water and yet my most dangerous part of my job is when i get to this ramp. it's extremely dangerous. >> reporter: the river has shrunk so much that it's nearly impossible for colorado river guides like this man to pull boats out of the you have guides putting roller tubes underneath boats. as that boat is pulled up, guides are running and putting tubes under until we get to flat land on top like ancient egyptian technology literally. >> reporter: such a hassle that many tours float an extra 50 miles downstream, adding up to two days not to mention cost to the trip. what worries him is the threat to future generations. >> if we want to live out west and protect our heritage and want to have enough water for our kids and grandkids, we need to solve these issues now. it's no longer a problem we can kick down the line. >> reporter: a sentiment echoed by ebberly. >> it would be heartbreaking to lose this place. >> reporter: the colorado river remains in a massive climate change-driven drought which is the region's worst in more than two decades, as well as the region's worst in 1,200 years. as you saw in the piece, one unusually wet and snowy winter isn't enough to magically ecrim race this crisis. states and industry will have to keep looking for ways to use less of this dwindling it would be the longest sentence by far coming from the january 6th attack and the other leaders of the far right extremist group could also be facing decades in prison. what the prosecutors call the vanguard of political violence in this country. calls for the justice department to intervene in the attempted murder case against two white men who are accused of shooting at a black fedex driver who was just doing his job. a mississippi judge says he had no choice but to declare a mistrial. the reason all boils down to a police officer who is accused of breaking court rules. i'm sara sidner with john berman and kate bolduan. this is "cnn news central." ♪ a major category 4 hurricane has parts of the u.s. bracing for a rare threat not seen in decades. hurricane hilary currently has 145 mile per hour winds as it inches toward california and while the storm will likely weaken just before it strikes the state, the rain and wind could still be deadly. more than a year's worth of rain is possible in just one day for some areas and that could trigger dangerous flash flooding. bulldozers have been moving sand on beaches with wind gusts up to 60 miles per hour possible. this could become the first tropical storm to hit the area in 84 years. meteorologist derek van dam has the very latest for us. where is the storm? where is it headed and when? >> look, john, this storm exploded overnight. it's really a category 4 monster just off the coast of mexico right now. just because you see a category 4 storm now doesn't mean that that's what we will experience when it reaches the southwestern united states. very important, but as the situation comes with tropical storms, we typically get a surge of moisture and it will really be the rainfall threat that i am mostly concerned about across the southwestern u.s. we will break down the details here. look at the projected path from the national weather service, a weakening hurricane as it approaches the baja peninsula. let's take it further out in time from sunday evening through monday. tropical storm force conditions possible in extreme southern sections of california including san diego, and then look at this, the remnants moving into the western half of the u.s. the flood threat cannot be diminished. we have a rare level 4 of 4 from sunday to monday morning for the interior of southern california. weather prediction center does not issue that lightly. we have a moderate risk including san diego northward into las vegas. the potential for mudslides and landslides exists. let's compare this to a previous event. why do you need to care? this happened in death valley in 2022 with a less significant storm, it produced 1.46 inches of rain, on average death valley receives a little over 2 inches of rain in the entire year with this particular system we are predicting anywhere from 3 to 4 inches of rain. so as john so aptly said in the opening statement of the show, we could receive over a year's worth of rain just in a couple of days. this storm will encounter cooler waters as it approaches the southwestern u.s., if it stays more offshore, more coastal concerns in terms of coastal erosion and large waves. if it stays inland, that brings the rain threat a little further inland as well. john, so much to cover with this storm. >> it really it, again, worth noting that storms like this very rarely hit where this one is headed, right towards san diego. >> correct. >> maybe a little bit inland for them. people need to pay very close attention to it, even as the storm weakens, it is still very, very threatening. derek, thank you very much. wild to see it like that. in hawaii the atf is now joining the investigation into the cause of the deadly maui fires. the death toll remains at 111, but more than 1,000 people are possibly still missing. only a handful of the people who were killed have been publicly identified. they include 79-year-old afraid dough galinato. his family believes he died trying to protect the family home that he built. we are also learning of some deaths amongst children. 7-year-old tony takafua, his mother and grandparents are among those killed. they died while trying to escape. relatives say that the remains were found inside a burned out car near their home. as the recovery effort continues the island's emergency management chief has just resigned. he faced early criticism for the initial response as the disaster was unfolding and separately now hawaii's water management agency is also facing scrutiny. cnn has learned a state official may have delayed giving permission to use extra water to fight the flames and all of these questions are leaving some residents frustrated. >> right now the maui community is helping the maui community, and i'm really -- it's really affected me because where is the president? he decides to come here this week, to come here next week. i mean, like where -- aren't we americans, too? like we're part of the united states, but why are we getting put in the back pocket? why are we being ignored? >> the mayor of maui county tells cnn that as of this morning 45% of the burn zone has been searched. so they are making progress every day, but it is a slow, daunting task. cnn's bill weir is on maui with the latest. >> reporter: here on maui as that fatality count tics up a little bit at a time day by day, it's the number of missing that weighs so heavy on the hearts of people here and really around the world watching this story. over 1,000 missing according to the governor's last statement on that. given the fact that a lot of the power is back up on the island, a lot of the communication is back up you think we would have heard from those folks by now. and what's especially grievous is when you think about how many children were home that day. i'm hearing again and again from kids, there was no school when the fire hit, a lot of young ones were with their brand parents or someone else while the parents worked. so you can imagine the agony in those families, if they haven't found their children. i spoke actually to veteran urban search and rescue officer from fema in hawaii from the houston area and he says of the some 90 disasters he's addressed in his career, this is unlike anything else. >> what's been really powerful is the fact that there's a number of local firefighter and pd that have lost their homes, lost their everything and they are out there working side-by-side with us. so this is something very personal for us because this could easily have been our community. to be able to help them and see them working in their own destroyed community is really powerful. >> reporter: he told me how they are searching, sort of square foot by square foot with these dogs that are trained to detect human remains. even down to cremated ashes. and they want to be refer rent shall and standing alongside of them in many cases are maui fire and police faculty who have loved their loved ones as well and digging through the ash ash to try to find anything to put people's minds at ease right now. the winds are kicking back up again, nothing as strong as the firestorm tropical gusts that we saw last week, but a concern for the hot spots still in the upcountry kula fire. there are two helicopters ready to put those out should they flare up but many concerns playing out here. so much trauma. bill wooer. cnn, maui. fema is running out of disaster relief money weeks before the peak of the atlantic hurricane season. from catastrophic flooding, fires, as you saw there, and tornado outbreaks to crippling winter storms it's already been a record-breaking year with 15 weather-related disasters that each cost about a billion dollars. now the relief fund could run dry by the end of august, maybe even sooner. cnn's priscilla alvarez is live at the white house. this is a dire warning, we're watching what's happening in maui where tema has people on the ground, watching this massive hurricane that could be coming up and hit the southwest. what more are you learning about this? what are they going to do? >> reporter: sara, there is growing concern within the agency about what happens next because they are seeing their funds with the potential of being completely depleted by mid to late august and of course as we have seen in maui and elsewhere, disasters are getting worse and fema is going to them to help with the recovery, but without funds it makes it just more difficult. now, the feechl ma administrato noted that there are still enough funds for the initial response to maui, but without additional funding, they would put recovery into next year. take a listen. >> we have enough funding to support the ongoing response efforts because we take events like this into consideration, but it would delay -- if we don't have additional funding -- it would delay some of the recovery projects and push them into next year. >> reporter: now, the white house is aware of this, they're monitoring this, in their supplemental request to congress they've asked for $12 billion in disaster funds. that goes to congress and requires their approval. this is one part of a broader funding request that may face an uphill battle in congress. a fema official told me if they run out of these disaster relief funds it makes it more difficult for them to prepare for disasters because oftentimes these are funds that are used for people and for things to get to places where they anticipate there could be a hurricane, there could be a tornado so that they're ready for that recovery without those funds it just pushes everything on the back end and that is the concern. sara? >> reporter: well, kate, they don't say exactly why they're picking that date in particular, that's a very long time from now, but they have a lot of complaints about why they need time between the date that donald trump is charged and the date he goes to trial. typically defendants who are fighting charges want to go to trial very fast so that they can have the opportunity to clear their name, but that is not the approach here at all from trump's team. they want this april 2026, three years from now, because they say they have so much information to go through that they're going to need to prepare for trial. it doesn't exactly work in the way that they're saying where they are saying they want to read every single document as if it's a novel like "war and peace." that's not really how it works, but they are saying that they have a lot of material that they are going to have to go through. they also have to juggle this with other cases. we'll see exactly what the judge does. the justice department obviously wants this to be much earlier than that in january of next year. speaking of other cases related to donald trump, there is already one of his co-defendants in georgia, jeffrey clark, the former justice department official, he's already pushing back as well to a proposed trial date there from prosecutors saying they've asked for march of next year for a trial and that that is a little bit too soon for them to even make the ask. he hasn't even been arrested yet. none of those defendants including trump have been arrested yet. so there is a question there about what's going to happen with that trial date as well. clearly as jeffrey clark raises in his filing, there may be a race on of which prosecutor gets to try donald trump first. we will just have to wait and see how the court proceedings play out in the next couple days. >> that's exactly right. great to see you. thank you. this morning we have exclusive new reporting on one of the alleged architects of the trump 2020 fake electors plot, attorney kenneth chesebro, and where he was on january 6th. remember, chesebro was one of the unindicted co-conspirators in the federal election case. he's charged in the georgia case. and now cnn has identified chesebro on video following around conspiracy theorist alex jones on the grounds of the u.s. capitol on january 6th. with me now cnn's senior crime and justice correspondent shimon prokupecz. on the video. >> on the video. big question, what was he doing there, right? not only is he working behind the scenes and now we know allegedly that he is the architect of this whole scheme to introduce fake electors, but now we see him actually on the grounds of the capitol on january 6th. what we've also discovered is that he is interviewed by the special -- by the committee, the january 6th committee, by members of congress, and he talks about -- they talk about this sort of idea about creating chaos and his whole idea behind that in terms of trying to slow down the voting, the process of certifying the election, and so it's really interesting now to go back and find this video which was all dug up by our k file team, really just interesting to see him there. the other thing really is that he was a lawyer for the trump campaign, working behind the scenes and now we see him there on the grounds with alex jones who was really the leading voice behind stop the steal there on the grounds of the capitol. we know he's facing a number of charges in georgia, but he's also -- we've identified him as an unindicted co-conspirator in the special counsel case out of washington, d.c. he is expected to surrender by the end of next week in georgia. we spoke to his attorney, gave us a statement saying that they are going to allow this to sort of play out in court. they don't want to comment right now, they want the legal process to play out and they declined to issue any sort of statement. this is certainly very concerning and troubling and raises a lot of questions about exactly what he was doing there that day. >> to be clear, we have no evidence he actually entered the building itself. >> no, there is no evidence he was engaged in any kind of violence, that he went inside. this was all going on outside, but he's videotaping, he's recording on his phone. you see him there recording alex jones and why was he doing that. >> shimon prokupecz, thank you very much for that. sara? sara? >> yes, hello, john, hello, shimon. while kenneth chesebro is a charged co-conspirator in the georgia case the indictment also details 30 unindicted and unnamed co-conspirators. cnn has identified some of them by piecing together details included in the indictment, among them trump political adviser boris epshteyn, bernie kerik and georgia's republican lieutenant governor burt jones. with us now tom dupree. let's start with this new cnn exclusive information about kenneth chesebro. he has been charged in this case with seven different counts in trump's 2020 election tampering case in georgia. could this new information showing that he was on capitol grounds during the january 6th capitol attack have or make a difference in the case against him or donald trump? >> well, it could make a difference if they can show that he had some sort of active participation in the events of january 6th, in other words, if he was there, he was helping coordinate and that sort of thing, which it sounds like we may not quite have yet. look, there's no question that it certainly places him more at the center of events. it makes it difficult for him to argue that he was an innocent bystander or just a mere witness to the events that occurred if he was actually there following people around, hanging out with alex jones and that sort of thing. it's not the place that you want to be caught -- viewed seeing doing on january 6th. >> i was there in d.c. in november when alex jones was riling people up, long before january 6th. so it will be interesting to follow that line of questioning. now, there is a huge number of co-conspirators as we mentioned, 30 that are not charged, not named. why did the georgia da decide to put them in there but not name them and not charge them at this point? >> well, she had put them in there then you would have had something like 50 or 55 defendants which would be even more unwielding. it's reasonably common in these sprawling criminal indictments to include unnamed, unindicted co-conspirators. there's been interesting guessing trying to figure out who is unindicted co-conspirator number 1, number 2 and so on. i think you can get a pretty good sense of who the people are based on the factual allegation that is surround them. these people will play a key role at trial. they at least according to the indictment were part of the conspiracy, even if they are not formally charged. they would presumably have a lot to say about the events and a lot to say about the evidence that led to these underlying charges. >> so they could either be thrilled, they could become witnesses or potentially if the da decided they could eventually be charged, that is potentially. donald trump's legal team has requested a trial date in 2026 in the federal case that is supposed to take place in d.c. over the 2020 election fraud. the prosecutors want this to happen far earlier, january of 2024. what's the judge to do in this kind of case? >> split the difference. look, i think both sides are being overly ambitious. i totally understand why the prosecutors are pushing for a fast trial and i totally understand why the trump team is pushing to delay things. i think what the judge needs to do is take each side's proposal with a grain of salt, look at the schedule and then just make realistic assessments about how long it will take to get up to speed and prepare for a trial and also how often earth you manage this particular proceeding with the three other criminal proceedings involving the former president. i mean, it's like you're managing an airport and you have a lot of planes and you have one runway and you have to figure out some sort of staging or ordering approach because you can't have everything happening at once. so it's a tall order for the district court but i'm sure she'll manage it. >> tom dupree, thank you so much for all of that. there is so many things to talk about. all right. over to you, john. at best a distraction. that is how some u.s. officials view ukraine's recent focus on crimea. and new developments regarding dozens of police cases handled by five former memphis officers charged with the deadly beating of tyre nichols. >> reporter: yeah, kate, these are really wide-ranging conversations. governor kemp is up there now speaking with erickson, senator tim scott just left the stage. they are touching on everything from domestic policy to foreign policy as well. senator scott led with the personal. he has made by personal biography central to his campaign pitch. he spoke about the goodness of america and argued that he would be the best person to compete against president biden in a general election. let's listen. >> a tough start being a small business owner, having a chance to provide the american people with the largest tax cut in american history in 2017, that's one of the three primary authors of the tax act makes me qualified to run our economy, be commander in chief as well as allow my life story to disease prove the lies of the radical left. >> reporter: so scott also spent his conversation with erickson railing against biden economics and talking about weakening the footprint of the federal government. listen, trump won't be here, erickson and trump have had a rift to put it generously, although erickson did at the outset of the event compliment trump on policy but really this event is about all of the other candidates over the next two days. them having an opportunity to introduce themselves to conservative voters across the region here in georgia but also conservative activists from south carolina and florida as well. kate? >> sure. well, john, thanks for having me on and i won't whisper. here is the reality, we were excited about hitting the 40,000 in donor threshold. we have to keep going. we have had two national polls where we have hit the polling requirements and one state poll. we have, you know, just one more poll, whether it's in another early state or national poll to go, so i feel -- i feel good about that. about being able to be ready to go on that debate stage which we're planning on happening. i feel confident we will be in milwaukee on wednesday. >> so if you don't get there, i know you're planning on it, i know you're hoping for it, but -- >> can i interrupt you, john. >> yeah. >> i'm not -- you know, my goal is to be on that debate stage, we're confident we're doing that and a that's what we're planning to do. >> francis suarez the mayor of miami said i think any candidate who doesn't make the first debate should think long and hard about it because you shouldn't take away time from people fighting to get their message out there. he said if he doesn't get to that debate it's likely he will drop out. >> sure. i think folks like the governor of new hampshire, chris sununu, has also talked about how if there's no pathway to victory towards winter, then people need to start thinking about consolidating and i think that's pretty sound logic as well. for me right now we're going to focus on -- we're going to focus on debate prep and getting ready and getting ready to speak the truth to power. i'm not going to be like ron desantis and defend donald trump, which is absolutely crazy, but i'm also going to be articulating a vision of the future. >> let's talk about that. governor desantis. because this leaked memo from his super pac appeared in the "new york times" that appeared to be giving instructions to ron desantis about just what you were talking about, perhaps defending donald trump. i will read from "the new york times," the debate prep memo urges desantis to defend trump when chris christie attacks him with a specific suggestion for an attack line accusing mr. christie of appealing mainly to democrats. trump isn't here so let's just leave him alone. he is too weak to defend himself here. we are all running against him. i don't think we want to join forces for someone on a stage who is auditioning for a show on msnbc. >> first off, this wasn't a leaked memo, this was a memo that was posted to a website and so this was a level of coordination because the ron desantis campaign is circling the drain. the fact that they're having to cut so much staff, they don't have the resources to do their own debate prep, but the strategy itself is flawed. if you are afraid to take on donald trump, then you shouldn't be on that stage and you shouldn't be running for president. the other thing that was missing in that campaign memo was how do you articulate what your vision for the future is? it was just about attacking other people versus laying out a plan for america. so when i'm on that debate stage i'm going to first answer the questions that's asked and you have two great reporters and journalists that will be asking those questions, explain why that particular topic is important to the american public and then outline my vision of that future. america wants someone who is not afraid of donald trump but articulating a vision for the future. that's what that campaign memo should have said. >> in about an hour and 20 minutes president biden will be meeting at camp david with the prime minister of japan and the president of south korea. it's a fairly historic tri-lateral meeting there. how important is that alliance to battling the global influence of china? >> the greatest existential threat the united states of america is facing is the chinese communist party and the chinese government is trying to surpass the united states of america as the sole global super power. the only way we are going to be able to defend against this is to have allies and to be working together. japan and south korea are super important in that. i would have invited australia to come to this event because they are a critical partner in our operations in east asia. improving the cooperation between the japanese and the south koreans is super important as well and that alliance is not only important to countering the chinese government, but also the threat of north korea is always there, and the likelihood that the north koreans could end up killing hundreds of thousands of south koreans and americans within minutes is a threat that we always have to be prepared for. but we need to make sure -- >> i have to let you run, but all this talk about strengthening economic alliances in the pacific and defense alliances do you ever reflect the fact that tpp was blown up because that was something that would have strengthened pacific alliances vis-a-vis china. >> you're absolutely right and what's even crazier is not only was it blown up, but because the trump administration pulled out of it, you had the chinese get into it, which is absolutely insane and we would be in a much stronger position if we had a trade alliance with our allies in east asia. >> will hurd, congressman, thank you for being with us. best of luck. >> thank you. >> sara? mississippi courtroom after a judge declared a mistrial in the case of a white father and son accused of chasing and shooting at a black fedex driver. the woman walking away is d'monterrio gibson's mother. gibson says he was delivering packages, just doing his job last year when two men in a pickup truck began blowing their horn at him. he tried to get away but they started chasing him and eventually shot at his fedex van multiple times hit that go van. the men were identified as gregory and branden case, they face attempted murder charges. dianne gallagher is following the story for us. this is a case where there was exasperation and a lot of emotion after the judge declared a mistrial. what happened? >> reporter: yeah, an absolutely shocking moment in court, sara. a police officer admitted under oath to withholding evidence. the detective had integration video, a witness statement with the victim, d'monterrio gibson, that was never turned over to the defense or the prosecution. now, the judge declaring that mistrial after a motion from a defense attorney for brandon and gregory case who, of course, are charged with attempted murder, accused of chasing and shooting at d'monterrio gibson, a black fedex driver who was just dropping off a package at a house on a dead-end road back one evening in january 2022. now, gibson says he was wearing his fedex uniform but he was in a hertz rental van when the pickup truck came behind him blowing the horn. he saw a man with a gun, the pickup truck tried to stop him from getting out and that's when he did hear those shots into his rental van, chased him out of the neighborhood. gibson after the mistrial was declared spoke with cnn and said that, look, it's felt like a lifetime, not a year and a half since that happened. he has faced anxiety and is extremely frustrated with the police. >> it is definitely a screw up, not the first one they have had with my case and other cases. it's just like due to negligence on their part i feel like -- i'm not going to say it's -- everything was purposely done but a lot of incompetent -- in the police department. for them not to turn over certain pieces of evidence, it's not right. >> reporter: now, cnn has reached out to the brook haven police department. they have not returned our request for comment. sara, an attorney for gibson says they do think they're going to get a new trial, but fear it's not going to be until much later this year or even next year. in the meantime, gibson does plan to file a civil lawsuit against the city of brook haven. >> and i understand the judge said he had never seen anything like this, what that police officer did in 17 years. thank you for all of your reporting there. appreciate it. all right. some good weather news this morning. good-ish, if that's a word. kate assures me it is. fresh off a huge winter snow pack water levels on the colorado river are going up for the first time in years. this has prompted federal officials to announce that it will ease water restrictions on the river next year. still, though, the river basin's long-term health remains in serious doubt. between 2000 and 2021 rising temperatures sucked more than 10 trillion gallons of water out of the colorado river basin and that trend is likely to get worse. cnn's lucy kafanov went to moab, utah. >> reporter: this man has spent much of his life on the colorado river. >> it's a remarkable, remarkable area of the world. >> reporter: as an avid adventurer and colorado river advocate, his mission in life is to protect it. >> this is one of the most important places in the nation and it's one of the places that we need to be really diligent about taking care of because it does contribute soo much to all of us. >> reporter: the colorado river is the lifeblood of this region, powering cities, watering farms and quenching the thirst of some 40 million people. it's a critical refuge for wildlife and a playground that's under threat. >> it's being overused. there's more demand on the river, there's more water being taken out of the river than the river can handle. if we continue to overextract the bank account, we are going to run dry. >> reporter: an unusually wet and snowy winter brought some relief, replenishing snow pack and boosting water levels for the first time in years, but with the rapidly changing climate, experts are warning it's not enough. >> it's been so hot and so dry in the southwest that much of the benefit we got out of the snow pack has literally evaporated. >> one or two extra wet winters is not going to solve this crisis. >> my concern is that people will assume that the situation is getting much better and that we can take our foot off the gas in terms of conservation. this system can crash and it can crash fast. >> reporter: over the last century the river has shrunk by roughly 20%. those losses are more apparent in the lower basin states, but the impacts are being felt across the entire water way. rafting the colorado is a breath-taking experience, it's a slow and sometimes bumpy ride through ancient time at a moment when it seems like the earth's clock is speeding up. even here the effect of climate change, rapid growth and water overconsumption are threatening the very existence of this river. >> we boat through cataract canyon, it's the best roller coaster in north america. class 5 rapids all the way down when it's high water and yet my most dangerous part of my job is when i get to this ramp. it's extremely dangerous. >> reporter: the river has shrunk so much that it's nearly impossible for colorado river guides like this man to pull boats out of the you have guides putting roller tubes underneath boats. as that boat is pulled up, guides are running and putting tubes under until we get to flat land on top like ancient egyptian technology literally. >> reporter: such a hassle that many tours float an extra 50 miles downstream, adding up to two days not to mention cost to the trip. what worries him is the threat to future generations. >> if we want to live out west and protect our heritage and want to have enough water for our kids and grandkids, we need to solve these issues now. it's no longer a problem we can kick down the line. >> reporter: a sentiment echoed by ebberly. >> it would be heartbreaking to lose this place. >> reporter: the colorado river remains in a massive climate change-driven drought which is the region's worst in more than two decades, as well as the region's worst in 1,200 years. as you saw in the piece, one unusually wet and snowy winter isn't enough to magically ecrim race this crisis. states and industry will have to keep looking for ways to use less of this dwindling
