we are following the stories coming in right here! cnn news central. we began with historic devastation in paradise. the maui wildfire. after flames burn down the village of lahaina, there are more than 1000 people still unaccounted for. we have learned that children are among those killed. 40 cadaver dogs from 15 states are right now searching for remains as we look for the dead the survivors are returning to see what is left of their homes questioning why alert system fails. let's take you there with cnn national correspondent gloria pass me know. gloria, what's happening in that area? >> morris, the main road that leads into lahaina has been open and that means residents who were able to get out as a fire was burning are starting to return and they are taking a look at what has been destroyed. just take a look here behind me. we are at a high point here and you can see that entire homes are gone only the foundation is left of their burned out cars. most of this town is completely gone. people are returning. we want to hear directly from the people of lahaina and i want you to listen from a young man who described to us the chaos he experienced as he was trying to get out. >> we left my little brother at home. he was a brave kid. i should've told him i love them and i should've hugged him. i should have done a lot more than what i did. >> jose is only 20 years old, boris, and you can tell he is still in shock. you can imagine the trauma that he's gone through and that the people of lahaina has gone to. he said he has not able to sleep comfortably since the wires thinking of the fact that he was not able to get to his brother as they were trying to get out. now the people of lahaina have a lot of questions and we have been asking those questions about the alarm system and why it was not employed. officials here have told us that the alarm system is designed to send people into higher ground and that would have had the opposite effect because it would've sent people right into the area where the fires were burning. as if they didn't have enough to deal with they are also now having to worry about predatory practices from real estate buyers the governor has put out a warning call warning residents about potential buyers who may be in the area looking to buy property from people in lahaina who are cash strapped as a result of the disaster. he has ordered on the attorney general to be on the lookout for those kind of practices and he says he plans to put a plan into effect to make sure this doesn't happen. i do want to mention the devastation zone, the impact zone is just over the hills behind us and that there is a critical mission that is underway there. you mentioned it is the methodical and slow process of finding any human remains. they are working through the ashes trying to find anyone that was left behind. anyone that did not survive in an effort to identify them, which will take a wild but to bring closure to families would be important and they are really struggling to get by every day with the guilt that they survived and their loved ones didn't. boris? >> in excruciating process. gloria -- gloria pazmino from hawaii, thank you. let's turn to our cnn consumer reporter, nathaniel meyer. nathaniel, there will be serious economic ramifications from these fires, right? >> yes, the app -- economic impact is catastrophic. moody's is estimating it will cost between $3 billion and 7.5 alien dollars to rebuild and put that into perspective he is projecting a severe local recession and this is happening just as maui is beginning to rebound from the impact of the pandemic. tourism supports about 80% of the economy and 75 percent of jobs in maui so this is just happening at a devastating time. >> nathaniel meyersohn, thank you. jim? over to you. >> we are seeing the state senator now who represents the area angus mckelvey joining us. how is your community? >> i'm here briefly, but thank you for having me on. the reporter hit key things that are coming on. i appreciate you having your team here. there has been a disconnect of communication going on that has been added to the frustration. it's been a very long, hard struggle and the stories arm hearing at community hubs and the upper part of west maui we are bracing for more unfortunately numbers of deceased and sadly speaking there could be more children >> just heartbreaking. we hear of estimates of the number missing. do you have any sense of the scale of loss? >> i don't. the day the fire happened, the power was out and the school was canceled. many of the areas had a lot of kids who were there but the parents were at work and there was no warning or nothing and it's just heart breaking and so i am sorry, but when i think about given the loss and the tragedy to hold those accountable is the goal, and we need strong questions asked about the alert system and quite frankly i have heard the line that people would have panic and run up to the mountains because is a tsunami and the reaction is utter disbelief. it's insulting to think people would be that clueless that they wouldn't know the siren blasting was because of the fire and these are not nami sirens, they are disaster sirens. i am very disappointed that this is the statement coming out of the county thinking we will not blow the sirens because people won't understand. >> the thought of children home alone through this is too much to bear. you mentioned the alarm system. there has also been attention focused on the power company and whether there were signs of miss force reps not taken given some of the videos we have seen of what appeared to be sparks. do you believe there needs to be an investigation of the power company's possible role in this? >> i do. a colleague of mine is the chair of the consumer protection agency who is asking for an independent fat -- panel to convene. when i found out from my friend that we had the video time stamped from his office of the beginning part i thought it was imperative he got that to the media so that it would be part of the record of accountability that needs to be creative -- created. i have been telling people if you have seen it report it on your cell phone. we need to put together a thorough investigation. i'm sorry. we have dead that could bypass the nebraska fire. children have died. we should stop at nothing to uncover every bit of truth and hold those accountable for it and i'm sorry if it's inconvenient for people, but this is the truth. we need to do our due diligence to ensure that we investigate and create a record of true accountability i was told there was a large wildfire in california and there was an investigation and accountability. i think it's important we pursue this. we shouldn't be afraid. >> you mentioned steps not taken prior to this. how about the federal response? you earlier this week expressed frustration with the federal response in terms of rescue resources. president biden will now visit maui. what is your message? >> my message to him is that when he comes -- i know when he arrives usually a huge production and i'm hoping that it's not going to cause a lot of chaos in the recovery zone. i appreciate that he is coming. i don't know if i will be invited to meet with him, but if i were i would tell him the community is suffering and we need enteral resources. the biggest thing we need is fema to come off that 30,000 foot cloud and to come out of honolulu and actually do work with the community at the hubble's level. we know what's going on the ground. we are sending it out and we are not getting any kind of response. when decisions are made we don't know about it and of course the community doesn't know about it. here is the reality. when you are in the community, people look at you. doesn't matter if you are state or town, you are government. if you can't provide answers that creates more resentment and distrust. if our government people can't communicate with us, then what about us? that is the frustrating thing. we are not part of the defense chain, but we are the ground and we are helping. that being said, there have and bright spots. we are increasing coordination. we are trying to convince the county that the hubs are actually turning into community centers and that we should support them and not cut them off completely. that is the most important thing right now and i want to give a shout out to my fennec colleagues who have been texting and creating change with me to get information out. senator coit, and were on -- tim richards also congresswoman -- her office has been fighting to get information and be able to get some kind of semblance of what's going on. that's how we have had to triage to move forward. it's frustrating. think about this. you have lost not only your home , but your business and income. you lost your school, your day care, your grocery store. you have lost everything that creates what is known as a life. now you are expected to rebuild and use can't deal with the chaos. we also have areas where businesses and homes are intact. there has been no plan to say what will we do to assess open up and perhaps create some type of availability for people to do their business or what they want? >> there is the connection that donald trump lashes out personally against prosecutors and play tents -- play tents -- plaintiffs. he says if you come after me we come after you and who is we? does he mean donald trump and his lawyers or his talking about his followers which harkens back to the capital violence. what we have in this case is with judge chutkan, the department of homeland security and the people who guarded that courthouse in texas went out to where the call originated from and they spoke t o abigail jo shry. using interstate commerce to threaten a federal official is a very various offense and i think what they are doing with this case is setting an early example which is people that make these threats will be dealt with. >> it was not just a threat to her but her entire family coming from that woman. >> and to a member of congress. >> i want to get your thoughts on the situation with the grand jurors because law enforcement says it up to the fulton county sheriff to announce directed patrols to the grand jurors. do you think that will be necessary? >> i think it will be necessary onto levels. one, if someone is looking at them and they see a police car going by every five minutes, that can have an effect but if you are one of those juries and you say you did i civic duty and now i am getting threats, they know where i live and what i look like, having that extra police patrol and that car that's in front of your house unless on another call, the special attention from police probably gives some measure of a comforting effect. >> nevertheless, this could potentially have a cooling effect on other jurors. john miller, thank you. >> that heightened security situation playing out before the former president turned himself in on the charges sources tell us that is most likely to happen next week as his legal team is working out the details of his surrender at the fulton county jail. let's discuss this case with former trump white house press secretary stephanie guse from an election lawyer, ben ginsberg. stephanie i want to ask you this. if you look at these threat -- threats, the former president has attacked the system and judges and made personal and public attacks. has he helped to give license on his own public attacks with this behavior? >> absolutely you can look to january 6 as a huge example. i know very few republicans want to upset donald trump in any way but why are there no republicans, most specifically people running, calling on him to put something out to say there should be no violence. please do not threaten anybody. please do not threaten the jurors. how is it that there are no republicans that are calling on trump to say something? i think that will also show voters who he is. he is staying quiet and allowing people to continue to be threatened. >> it's a good point because that's what people were asking for on january 6th, a public statement. i think many people were surprised to learn that under georgia law grand juror identities are listed in public court documents. i wonder if that law survives the current time. what do you think from your perspective as someone who participated in many cases? should that change? >> and the incentives behind releasing the names was a good one. it's because you want some transparent in the government, but it's also a rule that was put in at a very different time and so as you see these grand jurors who did do their civic duty now come under harassment and attack, there will be a rethinking of these laws, so there will be transparency that gets taken away in our government. another institutional sort of denigrate. >> it was there for a reason, but the threats might outweigh it. and you have heard a lot about this and some people are making comparisons between trump's attempt to overturn the election and the lies he shared and al gore's election dispute in 2000. of course you took part in that on the republicans tied as it played out and out eventually the election. do you consider those events equivalent? >> no, not in the least. the florida election that al gore contested was 537 votes. under any semblance of what sort of proper behavior is, that an election that you can contest and recount. donald trump went ahead and contested and asked for recounts and brought out litigation and he lost every one of those 63 cases and the bargain in that actuation is that you can take the cases to court, but in going to court you also have to abide by the decisions of the court. donald trump failed to do that. al gore conceded the election rightly and properly and donald trump who continue to basically tear down the institution of american elections with unfounded charges. >> advisers do not believe trump will take part in the gop presidential debate. what do the other gop candidates need to do to stand out and make themselves a viable alternative to trump? >> well, i would say respectfully they need to stop kissing up to donald trump. that is clearly not working for them. and the base they are trying to appeal to, they like people who are tough, clearly. look who they are going for and donald trump, but how can people think these nominees can stand up to anyone if they will not stand up to this one older man, so i think that's something they need to do. they need to change and pivot and talk about their policies and they need to call him out and show that they have the backbone to do it. >> we will be watching for that back bone. thank you much for both of you. white house advisers are treading lightly around the president biden when it comes to his son. details from insiders when we cocome back. have you seeme scramble? no you de-thrown the king. pedialyte. 3x the electrolytes. a new push for accountability after the racist mass shooting at a grocery store in buffalo. attorneys representing survivors and a family member of one of the ten people killed have filed two lawsuits. they named social media companies and the shooter's parents. according to one of the lawsuits, quote, just as the shooter is being held to account criminally for his actions, the defendants named in this lawsuit must answer for the critical roles they played in facilitating this reprehensible mass shooting. let's discuss with a legal expert. she is a civil rights attorney and legal affairs commentator. so of all these defendants, the shooter's parents, the social media companies, gun makers and gun companies, which do you think is most likely to be found liable? >> i think there is a good chance that the gun manufacturer has some responsibility and could be held to be accountable for the emotional damages that the survivors of the tops market lawsuit have claimed in this action. this is a little unique because in typical cases against gun manufacturers, it is the victims themselves or the family members against the victims like we saw in sandy hook. but here, these bystanders, these witnesses are saying, look, we're traumatized by having to witness this mass shooting. we saw the sandy hook case. they sued the gun manufacturer. the supreme court refused to allow them to escape responsibility. that was true to state law in connecticut. but ultimately, that case resulted in a $73 million settlement for the victims' families of the sandy hook shooting. so there is precedent for these losses, even though there is a shield in federal law for gun manufacturers. that's starting to change. >> how about for social media companies? it is surprising they would try to go after google, which is the parent company of youtube. is there precedent there? >> not really, surprising. because what we have seen over the last couple of years in particular with respect to school districts, school districts have been suing social media companies claiming that the content on these various websites is causing increases in anxiety, depression and even suicide rates among students. so there is a big push to hold social media companies responsible for the content on their sites. and, again, by federal statute, these social media companies have enjoyed a great deal of immunity and haven't been held accountable. but in this lawsuit, they're saying this shooter was radicalized on social media. passages from his diary and other statements that he made where he said he hatched this idea to shoot these african americans based on what he saw online. >> i'm also curious about the parents as well because the lawsuits allege they, quote, abdicated their duties when they failed to intervene. what kind of evidence would these plaintiffs need to bring to court to find the parents liable? >> well, clearly they would have to establish that the parents had some prior knowledge, that they knew he was, one, being radicalized online, that he had access to the firearms that he used in the mass shooting and that they had an opportunity to intervene, to prevent him from engaging in this criminal act. courts have been reluctant to hold parents responsible for the actions, the criminal actions of their children. and particularly, i think the plaintiffs may have a difficult time with respect to the parents because the shooter was 18 at the time. so he was of legal age. he's an adult. so i don't see a court holding these parents responsible. but i do think this lawsuit and others like this, where there are mass shootings, are really, really important. they're drawing what we saw with litigation against the tobacco companies, where tobacco companies were held accountable. we saw nuclear verdicts against those companies and those verdicts had an exponential impact on smoking, decreasing of smoking because of the liability that tobacco companies eventually started to face in the courts. >> i wanted to dig into a point that you made earlier about the fact that some of the plaintiffs and these lawsuits are not just victims or loved ones of the deceased. it's also witnesses, employees of the top super market who have been traumatized by this act. if this is successful, could it set a precedent for similar victims in mass shootings? >> absolutely. we would see a lot more class action lawsuits. and, in fact, there was a class action lawsuit filed as a result of the mass shooting in the 2017 case involving las vegas, in that country music festival where i think it was close to 100 people were shot and killed as a result of that. we're not sure what happened to that class action lawsuit. it was closed in 2020. possibly there was a settlement and a confidentiality agreement was entered into. i would not be surprised if we see more class action lawsuits filed by bystanders that have to witness the kind of trauma that we can only imagine, you know, happens when you watch someone get gunned down in a way that these witnesses did and these bystanders at the tops market. >> thanks so much for sharing your expertise for us. >> thank you. >> of course. jim?
