welcome to our viewers joining us in the united states and all around the world. just ahead on cnn newsroom,. >> all i want to do is this. i want to find 11,580 votes. >> indictment brings felony charges against donald john trump. >> i think there is a trail of information that america is going to get to see. >> you got a different player that just stepped on the field with a different playbook and a different sense of what justice looks like. it is tuesday, august 15th, 4 a.m. here in atlanta why former president trump and 18 codefendants have been indicted for allegedly attempting to overturn georgia's election results in 2020. the 41 count document was unsealed hours ago revealing all people that abilities as a, quote, conspiracy to unlawfully change the outcome in favor of the names includes several high named individuals thate ten da to surrender. and includes rudy giuliani and john clark, among others. he faces 13 charges, including conspiracy to commit false statements and forgery in the first degree. the district attorney broke down the reason for the indictment. >> the stake roll and the process is essential to our democracy. george, like every state, has laws that allowed those that believed that the results of an election of wrong whether from intentional wrongdoing or unintentional error to challenge the results in our state order. the indictment alleges that rather than abide by georgia's legal process for legal challenges, they engaged in a criminal racketeering enterprise to overturn georgia's election results. an indictment is only a series of allegations based on a grand jury determination of probable cause to support the charges. it is now the duty of my office to prove the charges in the indictment beyond a reasonable doubt at trial. >> and finally, willow says that she will push for a trial date within the next six months. >> reporter: former president trump facing his fourth indictment. fulton county district attorney lonnie willis brings charges against former president trump in georgia. he is one of 19 defendants charged of this case and it was unsealed late monday evening. donald trump is facing 19 charges and one of 19 facing a serious racketeering charge in the case. among the others are prominent names in the circle like his former attorney rudy giuliani and former chief of staff, mark meadows. the district attorney said that the defendants are innocent till they are proven guilty and she's going to try to push the trial date in six months. and she wants to charge them all together. we'll see how that goes. trump's events that unfolded is shocking and absurd. and now we wait to see donald trump and his other codefendants turn themselves in. the district attorney said they will have till august 25th to surrender voluntarily. so let's discuss this now with a criminal defense attorney and former prosecutor. i appreciate you joining us. >> thank you for having me. >> so there is a indictment, including rudy giuliani and mark meadows are charged with 41 counts withests to with the charges and charged with violating the state's racketeering act. what is donald trump legal generality here? >> he faces a lot of exposure. this is the fourth indictment that donald trump is facing in less than five months, the fourth indictment. but specifically here in georgia, what he needs to be concerned about is it that, one, we're dealing with state charges. what does that mean, state charges? no matter if he wins the presidency or another republican wins the presidency. they will not be able to pardon him on state charges. the ability of having cameras in the courtroom is open, so we'll be able this watch the trial. the most common one, he is facing five years, at least five years incarcerations on the top count of the indictment and that is the rico charge. he's not able to get probation on that charge. why should be concerned? because there are 18 other defendants on the indictment. and the other 18 defendants are also facing at least five years. what does that mean? there is pressure that is going to be applied on the other 18 individuals to do what? to flip. why? because they don't want to do jail time for donald trump. so the thing is what will break dun and flip against him and make the case stronger for the fulton county district attorney. >> this is the critical challenge, isn't it? he is facing jail time here, prison time. use mentioned, he's not going to be able to pardon himself because of the state charges. so let's talk about what path he has legally going forward when with you consider the charges against him and the strong evidence? >> as you see from his campaign, the campaign are the criminal indictments. his criminal are the criminal charges and allegations stemming across the country. he's using that as a platform across the country. why am i saying that? he's trying to jeopardize the jury pool in all of his cases, meaning he's go in the courtroom, his attorneys, even if the prosecution pulls it beyond a reasonable doubt, he is going to argue for jury notification. of course he's trying to win in the public media, for the federal charges, he has to hope that if he were to win, he'll be able to pardon himself. what it comes to the state charges, he's not able to do that. before he was not concerned because the new york charges were not state charges. but he is not worried about, any jail time. and he may try to push this case out as much as he can and try to point the finger on other people under the indictment if their namessed or not names and five, to say they're all coming after me. this is all politics. they're trying to get me out of the running. this should not be allowed. there are so many ways that he's going to attack the prosecution. the question it will he succeed against those, against donald trump? >> it is up to the judge to set the date for the trial. the district attorney said they want to try all 19 defendants together and do that within the next six months. how feasible is that, do you think? are you kidding? >> there you, man. >> reporter: archie is a hall of fame surfer and lifeguard that goes back nine generations. this is your house here? >> yes. we were lucky because our neighbors they were here fighting the fire and the fire department said that this is our last stand. we're going to hold the line right here. >> reporter: there is so much frustration over the response so far, he said that officials deserve some understand is just because of the side of the disaster. >> this is a crime scene. the government has to do its due diligence before they start moving in. >> reporter: is it a humanitarian response in the middle of a working crime scene? >> exactly. >> reporter: but another relief pod at a beach nearby, frustration has turned to anger. >> everybody is like, they don't come and help. they don't come and help. nobody cares about that. we rely on you guys that have compassion like we do. we need help. we need the next step. this is just the first week. this is the first inning of what we're facing. >> reporter: tourism is our number one source of income. i would hope that our representatives and politicians our government would ask the people from here, when can we open? they should not telling us, we want to open six months from now. the truth of the matter, when you look at the overall devastation, we are not going to be ready to allow people to see what we're living through in six months. >> reporter: there are a lot of conflicting emotions around the tourism industry around the hawaiian locals that some tourists did not he'd shelter in place or orders while the fire was raging and clogged the roads and some even went snorkeling which was very offensive to the locals. they say it was the power lines that brought this down. they were hot well after the fire started. and that is a lot of the reason that a class-action lawsuits that just been filed against hawaiian electrical over the weekend. the stock in the company dropped 40% on the news. so a lot of questions where it started and where the warnings were for the locals and where the help is now? as you know, in this jurisdiction trials are set by the judges. and to it will be the judge that sets the date of the trial. this office will be submitting a proposed scheduling order within this week. however that will totally be at the discretion of the judge. i want to try him and be respectful for our sovereign state. we want to move this case alone and we will ask for a trial day within the next six months. former president trump is reacting to the georgia indictment, calling it politically inspired and trump's former attorney, rudy giuliani said, quote, an front to american democracy. but fulton county's district attorney spent more than two years investigating the case. we have more on the da fanny willis. >> it doesn't matter if you're rich, poor, black white, democrat or republican, if you violate the lay, you're going to be charged. >> reporter: fulton county district attorney willis talking about donald trump attempt to change the election. >> i just want to find 11,780 votes, that is one more than we have. we won the state. >> reporter: what that call was made, willis had only been in office for one day. ever since, she has been leading the charge on the investigation. >> we've been working on this for two and a half years and ready to go. >> reporter: it is the acquisitions of racism, unfounded. team trump also included willis in the ad called the fraud squad. despite it all, willis hardly seemed rattled by trump's continued attacks. >> it is ridiculous in nature. but i support his right to be protected by the first amendment and say what he likes. >> reporter: willis said she has been subjected to racist taunts. >> i've never been called the n word so much in my life. she but a name for herself in the atlantic public school cheating schedule, securing convictions for 11 of the 12 defendant. she is juggled investigating trump and subpoenaing some of his top rallies and going after drug gangs and rich. >> reporter: after her parentss' divorce, she was mainly raised by her father what was a lawyer. she worked in the private sector for a time and joined the fulton prosecute's office. her conviction rate is close to 90%. in donald trump is indicted in fulton county, this will be the biggest case in her career. >> i'm going to do the job that i'm blessed to be able to do it . >> donald trump is now facing 31 charges. one is classified documents, four charges in the special counsel's sub version case and now 13 in the georgia election case. we have a special cnn political analyst. i appreciate you joining me. >> quite a night. >> yes, quite a night. we focused on donald trump's 41 criminal charges trying to overturn the defeat. let's look at the political ramifications of this. what stands out, is if trump is re-elected in 2024, he will not be able to pardon himself or his allies. will that be his most challenging indictment? >> it is his most challenging indictment. if he is elected in 2024, he cannot make it go away. and the governor cannot make it go away. the governor cannot pardon him. so there is the potential that this is a case could transcend a successful re-election for trump and put him in legal jeopardy as president if he was re-elected and create conditions and circumstances and legal questions that we have not had to deal with as president. >> how did the gop graupel with that, the fourth indictment and state-based? >> i think the vast majority of the republican officials have made a decision that that they are in with trump to the end. they are so dependent, that they cannot stand up to him in any way or draw a line. it is a self fulfilling prophesy. one of the reasons that she stay with him through all of these indictments, is that her not hearing from my voices they trust for a counter argument for the presidential race. so they are along for the ride. they have latched themselves to his mask as they have throughout his presidency. and there are a minority of republicans that are uneasy about it. but right now, the dominant faction in the party is the trump faction. he sold to them, the argument is that the indictments are really to silence them by going after them. >> how big a problem is it politically that georgia's district attorney fanny willis did not answer the question about how the document leaked a little earlier just before the official indictment was released. critics are already climbing all over this. >> it will be a republican talking point. but i'm not sure they need a talking point at this point. you saw kevin mccarthy, the house speaker out again tonight where he could have read through this very detailed voluntary indictment. this is the view of the republicans. the leak however it came about, gives them a weapon. but if that didn't exist, there would be something else. donald trump will have a press release tonight. saying that the prosecutor is the daughter of a black panther. so in essence, he's accused her of being a racist and two other african-american criminal justice officials are, racist. he is essentially trying to fold all of these indictments into the predominant belief among the republican voters that the real victims of discrimination and diversifying society is basically them, whites, christian, conservatives. that messaging is in place for republican voters. it is a complete different question if the republican voters are on board that he is the victim of a massive nationwide conspiracy of prosecutors. >> the da wants to try all 19 defendants together within six months that will collide with the gop primary calendar, getting crowded with cases. what are the likely political ramifications with that? >> that is the next week. the other republican candidates, buy and large, replicating the strategy of 2016 have close season to really minimize the directed confrontation with trump. they are still hoping that some ex external event will cause the voters to peel away from him. we're seeing that again. and through these indictments that is not happening. the opposite is happening in the context of the republican primary. is it still an open question if any larger share of republican voters will react differently if a trial is going on, much less if he is convicted. we have to say based on current evidence that there is not a lot of chance of meaningful numbers from the voters. but that is still unpredictable. with the broader electorate, i think the conviction could be devastating to the prospects of him being president. heavy fighting wasas on ukrainine's eastern front linen as russia launches new missile attacks and civilians. that is coming up. wow, you get to watch all your favorite stuff. it's to die for. and it's all right here. streaming was never this easy, you know. this is the way. you really went all out didn't you? >> reporter: we have been speaking at the moscow security conference, which is an event they're holding there is a lot of countries, where there is no nato countries. what we glean is that russia is doubling and tripling down on the idea of it being a watershed moment, this struggle against western and u.s. dominance in the world as they see it. they say that the u.s. and the allies are trying to stoke conflicts around the world. and they said that her continuing this policy in ukraine. >> what this fire leads to is clearly seeing the example of ukraine by pumping billions of dollars in the regime and supplying it with equipment, ammunition and sending the military advisers and missionaries. everything is being done to draw other states into it. >> the fact is that russia invaded ukraine almost 18 months, and it is russia said that the ukrainian air force launched 12 missiles over them. the western region seems to be the hardest hit. this is a hundred kilometers over the border. so i think putin is making the argument that they need to band together and show that russia is the key destabilizing force here. >> thank you for joining us live from london. u.s. retail earnings are out later today with the quarterly results from target, walmart and home depot. they will be looking for clues on the resiliency of the consumer spending power after an earlier washing that the americans are spending more on the necessities and less on discretionary purposes, that the retails is a way for the federal reserve's decision whether to raise rates next month. you see that they closely. and u.s. fuel prices been fraudulently moving higher. and now they're at their highest level in nearly ten months. we look at why. >> reporter: don look now, but u.s. gas prices are creeping towards $4 a gallon. the national average hit $3.85 on monday according to aaa. that is the highest level in ten months. and the good new is that the gas price spike has slowed recently. the gas prices are inching higher. the audit, they are still well below the record high set last year. it is up 32 cents since the fourth of july. it is threatening to undercut some of the progress that central bankers have made on inflation. oil prices rebounded and recession fears have eased. if saudi arabia and russia ini intentionally holding production right now. and that makes the prices go up. some companies are sidelines because of the triple digit temperatures and that stops the production of gas just when people need it the most. the trend has stopped in its tracks and now gas prices are now only slightly below where they were last summer. drivers in some parts of america, they're dealing with $4 gas. there are 11 states averaging $4 or higher, including arizona, illinois, and, of course, california. you have colorado and michigan, they're just pennies away from the $4 level. still to come, a huge legal victory for young environmental activists in montana as a judge sides with them in a a landmark trial.
