shark-infested waters that's after a wave wiped out his boat. ♪ good morning, and welcome to our viewers in the u.s. and around the world, i'm rahel sol solomon. let's start here, donald trump's tours have in the afternoon to meet a deadline in this alleged attempts to overturn the election. and that will limit what he says during discovery. and the judge has ordered trump's side to respond to that request. this is all part of ans indicating back and forth that included trump making threats and insults at the justice department saturday night. >> i will direct a completely very, very powerful overhaul of the doj. we're not going to have cowards, we're not going to have cowards like bill barr. virtually every poll, we're kicking biden's ass. if i wasn't, we wouldn't be under investigation by deranged jack smith. he's a deranged human being. >> cnn's alena train has more on the speech. >> reporter: the president spend much of saturday night reeling against the charges he's facing as well as attacking special counsel jack smith directly. donald trump called him, quote, mentally ill, as well as deranged. now, the former president also making an appeal to republican lawmakers on capitol hill. he argued that they needed to step up and do something in order to help defend him against his recent legal battles. but one big thing that i found to be different, came less than 24 hours after jack smith wrote in a court filing asking a judge to set limit ossen what trump's team can do with the evidence shared in the election subversion case. a judge ultimately ruled on saturday that donald trump's team must respond to that proposal by monday afternoon. but there are a lot of questions going into saturday night. whether donald trump's team would encourage him to change his rhetoric, in light of that court filing. but clearly, he did not, alayna treene, cnn, columbia, south carolina. and sticking with the case over efforts to overturn the 2020 election, former vice president mike pence tells cnn if ordered by the judge, he would take the stand. >> i have no plans to testify. but, look, we'll always comply with the law. but, look, i want to tell you, i don't know what the path of this indictment will be. the president's entitled to a presumption of innocence. he's entitled to make his defense in court. there actually are profound issues around this pertaining to the first amendment, freedom of speech and the rest. i'm confident he and his lawyers will litigate all of those things. >> and now he says one reason he's running for president is he thinks, quote, anyone who puts themselves over the constitution should never be president of the united states. >> trump meantime responding on truth social wrote i never told pence to put me above the constitution adding he's delusional. all right. this just in, ukraine security service has detained a woman in connection with what it says is a plot to assassinate ukrainian president volodymyr zelenskyy. let's get straight to cnn's clare sebastian. she is in london with the details. clare, this is just coming into us here at cnn. what more do we know? >> reporter: yeah, rahel, good morning. we're getting a statement from security forces they say they've detained an alleged informant for russia a female, the resident of the mykolaiv region, and they say she was sort of preparing intelligence for russia to launch an air strike during a recent visit to president volodymyr zelenskyy to that southern region, fairly close to the front lines there. they say she was trying to establish the time and list of locations of approximate route of head of state. that she was also actually tasked with identifying locations of electronic warfare, infrastructure, ammunition, things like that for ukraine. but they tracked her activities after they noticed what she was doing, continued to track her, trying to gain more intelligence about what she was up to. and eventually managed to detain her. they put in extra security measures for that visit as well which of course went off at the end of the july without a hitch. they have not named this woman. but believe, we understand it's a ukrainian citizen, who was informing for russia. so, like this is something that we know has been happening. russia's been relying on intel and informants throughout the conflict. we know ukrainian security forces have been obviously taking a dim view of this to try to hunt these people down, crack down. so it seems that the efforts are still an ongoing trend within this conflict but very significant that this is being seen as an assassination attempt on president zelenskyy himself. there was some reporting at the beginning of the conflict that this might have been part of russia's strategy. but this is the first we've heard about something like in a is very long time remark hell. >> clare, as you say, this woman has not been named next. >> what can we expect to happen next when might we see this woman and learn about this person? >> reporter: we'll be getting reports it depends how much information they release on this. but i think there may be an element wanting to deter people from doing this in the future. obviously, a major security threat since now president zelenskyy does travel around the country with some regulatrityeg. and this person was not only gathering information on the whereabouts of the president himself but also on military installation, infrastructure, things like, for the service that's happening at a critical point in the conflict itself. so, i think we may see legal proceedings against this woman. we may learn more about it. as i say, they're not naming her. >> clare sebastian, thanks. turning to west africa where niger's closest airspace closure with a military coup. so the airspace closure came the same day as the deadline for west african nations for democratically elected. i want to bring in larry mall doug madowo. what you can tell us? >> reporter: the economic community or ecowas, of mohame bazoum, or will they extend the deadline and allow for solutions to the crisis. president bazoum was overtaken, overturned july 26th. overturned by his own presidential guard. the man ahead of the presidential guard now has declared himself president of niger, the west africa state said you have to return him in a week or they'll use measures including force. so far the deadline expired saturday night. the military junta with military intervention imminent, listen to a spokesperson on state television. >> translator: niger's armed forces and all of our defense and security forces backed by the unfailing support of our people are ready to defend the integrity of our territory and the honor of our homeland. this and the national council for safe guarding for the youth to stand ready to defend the homeland. >> reporter: the measure of junta, they are the main stadium in the capital yesterday with supporters, they came to show e ecowas, in the world, they have public support. some of these military supports have major activist groups that proposes france interest in the country, france being the colonial power there, but this is the decision point. do they truly have public support or can this group of west africans come in and what will kind of long-term consequences. what kind of ripple effect would this have in the region, that neighboring niger has said if there's there they'll consider that an act of war. >> as allude to how this impacts the people in niger, thank you. a routine fishing trip turned into an incredible tale of survival for a florida man. his familyaid he survived 35 hours in the atlantic ocean clinging to the remnants of his small boat while dodging sharks, jellyfish and trying not to go under. cnn's camila bernal has more now. >> reporter: this is a fascinating story of survival. and i spoke to raymond gregory who is the father of the 25-year-old lawful at sea. this son charles gregory went out friday morning according to his father, he went out fishing and said he's always done this for years. but this time around, according to his father, he didn't realize that the tide was going as fast as it was. and that's when a wave comes and hits the boat. it capsizes. and that's when he loses his throw cushion, his cell phone, his life jacket and the father saying that charles had to remove the motor of the boat. and then just try to hang on to his boat for as long as he could. he says, of course, he's getting sunburnt. severely getting sunburnt. and of course, also sees sharks and big fish. and gets stung by jellyfish. he said he actually did see other boats and saw airplanes and the helicopters. he took off his shorts and tried to wave them in the air to get people people's attention that did not work. and out of everything that happened to him, charles told his father that the worst was the nighttime. because he says he was so sunburnt, that the wind at night was just making it freezing cold. so he would try to get in the water to warm up, but it was extremely difficult. thankfully, the coast guard rescued him on saturday morning. his father saying that charles is, of course, dehydrated. that he is weak. that the muscle tissue was breaking down, so he does need some days to recover because of the sunburn and the bites. he says it's vit's very difficu move. he is in bed at the moment, trying to drink gatorade, trying to eat. the father says he's not eating a lot, not speaking a lot and trying to rest. the father saying charles is going to be okay. but the one thing he did tell me was that at the end of the day, the moral of the story, in his opinion is never give up. camila bernal, indictment. this one in the state of georgia. cnn's brian todd has a look at what the charges might be and what's at stake. >> this was never supposed to happen in america. >> reporter: the already enormous legal pressure on the former president is likely about to intensify. a grand jury in georgia expected to consider criminal charges against donald trump and ris republican allies. >> in terms of the georgia case it's going to add a significant burden on him to defend yet another case. these cases will all have significant trial deadlines and pretrial deadlines for hearings that he's going to have to be involved with and that did detract from this campaign. >> reporter: a decision whether to seek charges against the former president in georgia will be made in the next few weeks by a team led by fulton county district attorney fani willis. >> we've been working 2 1/2 years, we're ready to go. >> reporter: the case focuses on the multipronged effort trump launched to overturn the results in georgia. it included pressure on georgia's governor and secretary of state, both republicans to find enough votes to flip joe biden win in the state. >> what are we going to do? i only need 11,000 votes. fellow, i only need 11,000 votes, give me a break. >> reporter: when they refused to go along, urged urged a special election. >> this election is a sham. >> reporter: trump ally rudy giuliani went to the georgia house and senate with bogus voter fraud claims. >> rudy giuliani is considered to have a lot of exposure in georgia, because he spoke at those legislative hearings. and we know a lot of the information he shared was not true at the time. >> reporter: other trump allies who could face criminal charges are republican activists that trump included to serve as fake elects. they allegedly played key roles in a failed plot to block the election from being certified. >> about half of them have received immunity deals which indicates they're working with the prosecution to tell them what they know. >> reporter: cnn has reported that fani willis has considered bringing charges of conspiracy and racketeering in this case. >> a.racketeering are broader schemes involving individuals essentially the maximum punishments for those types of charges are typically much higher than others mentioned here. testimony has been sought in the georgia case from former chief of staff mark meadow and lindsey graham. fani willis has told local officials of threats she's received. many of them of a racist nature during the period she's been investigating the case. >> i've probably been call you the "n" word more times in the laugh 28 1/2 years than anybody combined. >> reporter: throughout the investigation, donald trump has vehemently denied wrongdoing. trump has lashed out at fani willis calling her racist and quote, a luna ticket marxist. brian todd, cnn washington. >> our thanks to brian. let's bring in jennifer rogers. she's a former cnn analyst and former federal prosecutor. jennifer, thank for being with us. it is the deadline for trump's lawyers, 0 to respond to that protective order that essentially put it on trump in that process called discovery. how do you expect this to play out? >> well, know we trump and his team are going to respond today. and we know what they're going to say, because his lawyer was on all of the shows yesterday telling us essentially they are going to object to a protective order, saying that the public and the press should be free to understand the evidence and to know what happened here. they want to be able to share that widely. now that may just mostly be an acknowledgement that their client donald trump can't stop himself or help himself, or at least he won't stop himself, from talking about the evidence publicly. in any case, the judge has to weigh a couple of different things. she has to assure that the defense and defendant has his rights protected to review the discovery, in order for his lawyers to defend himself. but also that other people are protected. and we know this defendant has a long history of threatening and intimidating witnesses which tampers with the justice system as well as putting people at actual risk of physical harm. the judge will rail at these issues. she make take point with what the judge proposed but in the end, she will enter a protective order here. >> jennifer in the matter of full transparency, we're talking about the january 6 interference trial, just to be clear. jum trump was on all of the major networks, i want to play a small clip what he said to us. >> you're saying that asking is action. no, asking is aspirational. it's core free speech. what former president trump did not do is direct vice president mike pence to do anything. he asked him in an aspirational way. asking is covered by the first amendment. jennifer, what are your thoughts about that, asking is -- it's aspirational is what he says? >> yeah, actually that's what conspiracy and contempt laws are. you can't say because it didn't work he's actually off scot-free. listen, they can raise this defense, i suppose, if they think it will work. but i don't think the jury will buy it. the first amendment doesn't cover absolutely every single sound that far comes out of a person's mouth. if you listen to the president's lawyer yesterday, that seems to be what he's saying, if there is speech, it's protected but criminal speech is not protected and our fraud law, our conspiracy laws are constantly using speech as part of the evidence to prove crimes that is criminal speech, in other words, asking for something unlawful to happen. and meets the other requirements of the law. so, you know, i don't know why they're focusing so much on this. it seems to be a losing argument. it seems to be more for public consumption, than it will be for the jury once they get into the laws of the program. >> zbrern, you told our producer that the legal defenses he's talking about, the lawyer there, are not at all persuasive. he's going to have to do better in the courtroom, if they have any hope of succeeding on these counts. >> i think that's right. up know, there's such a big difference between what happens in the public sphere and what happens in the courtroom when you have a captive audience of 12 people who sit there for weeks and weeks likely. in this case, listening only to evidence that's admitted by the judge. so only things that are actually supported under the law. it's just a lot different. there's not all of this noise and things that are put forward without any support whatsoever. so that's why you see results being very, very different, once you actually get into the justice system so, i look forward to that process playing out and seeing what the jury does when they hear the actual case and not the case as it's being spun. >> well, speaking of the jury, jennifer, we know that trump's team is also trying to get the judge recused and get the case moved out of d.c. because trump's team say they don't believe they can get a fair trial in the district of columbia, do you see either request successful? >> i don't. the recusal is a nonstarter. we haven't even had an appearance. the judge hasn't done anything that brings into question anything about her fairness or partiality. plus, it's very hard to get a judge recused first, because that motion goes to the judge herself. and the venue motion is the same. the point of haven't knew motion can be tried fairly but you have to say there's nobody in washington, d.c. that can put aside any pre-existing biases, and listen fairly. in d.c., you have to impanel a jury effectively before you can even make that argument. so there's no way that either of these motions are going to succeed. he'll have to move forward with discovery, with motions and ultimately the trial. >> jennifer rodgers, great to see you, thank you. >> thanks. quick hits across america launched a formal investigation into a deadly train derailment. at least 30 people were killed and dozens were injured when a passenger train crashed sunday into the southern province. cnn's anna coren covering the story from hong kong. anna, good morning to you. any early theories what may have caused this? >> reporter: rahel, we don't know what's caused this train crash, we know that the death toll from sunday's train derailment is expected to rise, due to the severity of injuries. that's according to local officials. and, you know, looking at the pictures of the mangled wreckage of the aftermath, it's not difficult to understand why, yesterday, pakistan's largest city, karachi, 8:00 a.m. local time, 50 passengers on board. the train derailed near the town in sindh province. the authorities say the train was traveling at moderate speed, 28 miles an hour, when it ran off the tracks. ten cars in total derailed. now, this is a remote farming area so the first people on the scene were villagers trying to pull people from the wreckage the. eyewitnesses spoke of people screaming and bodies strewn against the ground of women and children. local media reports it took hours for help to arrive. they had to bring in heavy machinery for people trapped. the military also assisted. the injured were taken to local hospitals. there were body bags lying on the ground next to survivors. let's have a listen to one of those survivors. >> translator: it was so sudden. and we were seated comfortably in then. we hurt the growling sounds. and i gathered that the train had derailed pen then a storm of dust spread. then a burst fell on my head and blood splashed. >> reporter: rahel, as i said, the cause of the crash is unknown, but the railway minister said it could be either a technical fault or act of sabotage. an investigation is under way. >> anna coren live for us, thank you, anna. quick hits arod the globe. right now, israeli missile strike near damascus has filled four syrian soldiers and injured four others. this is according to syrian tv. with targets in the area. four u.s. navy destroyers were recently deployed to alaska to keep an eye on 11 russian accomplishments to take part in the accomplishments including the inflation reduction act which you'll remember included $370 billion meant to combat climate change. now, the president will visit arizona first. and sources tell us that he is considering designating a new national monument around the grand canyon. this is something that native tribes have been lobbying for for years and prevent new drilling in the area. so the president really trying to bolster his climate agenda ahead of the 2024 election. of course, this is a critical issue for key members of the democratic coalition. progressives, young voters, people who haven't necessarily been satisfied with the president in this carry so far, when it comes to drilling for fossil fuels. when it comes to cutting carbon emissions. the president really hoping to show voters that he is serious about combatting climate change. now, this is all part of a bigger effort by the biden administration to take more credit for their economic agenda in the month of august. you'll see the president, the vice president, members of the cabinet, all out talking about their economic record. and idol believe they have a good story to tell. inflation is easing. consumer sentiment is ticking up. and certainly, hiring remains strong. but there does remain a disconnect with voters. in a poll last week by cnn, 75% said they viewed economic conditions as poor. and that is translating into political headwinds for president biden when it comes to his approvalal rating. certainly, the challenge for president biden as he gears up for re-election is to close that gap and remind voters all he's accomplished when it comes to the economy, kevin liptak, cnn, wilmington, delaware. later today, a new consumer credit report will be released giving fresh insight into america's borrowing habits from. 40% are currently carrying credit card debt month to month. we go to a senior military analyst at bankrate.com. ted, great to see you, starting with 47%. but that in context? is that standard? is that higher than usual? what does that mean to you? >> it's up, a couple years ago, that percentage was 39%. so, really what we're seeing here, more people carry more dead. the fed says credit card balances are at a record high. for longer periods of time. that was another part of our survey, 60% of credit card debt has had it at least a year. up ten percentage points over 18 months. finally, the high interest rates. the average credit card charges about 20.5%. there are definitely worrying signs there. >> yeah, the interest rates have been brutal. so, ted, what is your number one tip for people? people ask me all the time and i'm not a financial analyst, i get concerned giving people financial advice but what is your financial advice for people holding credit debt? >> get a zero percent credit card. these are widely available. they let you pause that clock for up to 21 months. you take your high-cost debt move it over to bank of america card or citi simplicity. the business case they bring in balances, after the clock expires, the interest rate goes way up. for 21 months, the ability to avoid interest is powerful. that can save you hundreds, maybe thousands of dollars. >> the caveat is you have to pay off the principal. that's for sure. ted, what about student loan payments? a lot of people coming out of october suddenly are going to have another bill to pay. how certain, if at all, is this? >> in something about 1 in 6 households are dealing with. so, i think the big picture is not so bad. i don't think this will really do much to dent the economy overall. but at the individual level, i'd like to say, all news is local. not just geography, of course, but do you have credit card debt or not. do you have student debt or not. the average student loan payment is close to $500 a month. so if that's something that you haven't been used to paying for a few years and now you need to fit that into the budget, i think it's really important to recalibrate, figure out where you're at. i do think for those households this could be an obstacle. and maybe this does meet credit card debt either directly or indirectly. >> ted, what about the auto loan space. we know that interest rates are high there. but car prices are also very high. what are you seeing in this space? >> i think this is the biggest trouble spot in terms of delinquencies, especially subprime auto loans. those are more delinquent. those speak to high car prices. the average new car price is close to $50,000. actually that, even more are higher interest rates making it harder to pay off. a lot of people have $800 car payments. that's tough to swing. many people are starting to fall behind. especially those with lower incomes and lower credit scores. >> yeah, really hard to wrap your head around a $800 monthly car payment. ted rossman, great to have you, thank you. team usa's chase for historic three-peat at the phenomenon was born. and when those two films opened, really, now their in their third weekends each, they doubled the original projection that they expected to open to. and now "barbie" has over $1 billion, $1.03 billion, to be exact, according to the com-score numbers. "oppenheimer" over $500 million. these two movies, i think, are always going to be linked. they're both incredibly important films.
