voting machines. bornean. top of the hour this friday morning. so glad you're with us on c"cnn this morning". what a week it has been. >> and so much more to come. >> that's exactly right. >> this is going to be a very intense, very consequential months, years. >> many years. sawyer, dejected, defiant. donald trump's mood, state of mind after his third arraignment in four months. trump, for his part, proclaiming his innocence and accusing the special counsel of leading a political persecution. >> and indiana's near-total abortion ban appears to be underway. some clinics in the state have already stopped taking appointments, forcing women to seek out-of-state options. we will talk to illinois governor j.b. pritzker. also, the jops report, we will get an example of the economy in general after a pretty shaky week for u.s. markets. this hour of "cnn this morning" starts right now. here's where we begin this morning. former president trump back in new jersey after pleading not guilty to his arraignment in the past four months from his effort to stay in power aer his 2020 elec loss. the next hearing soon, schedul for august 28th. five case after the first republican primary debate. a frontrunner going on trial throughout the 2024 election cycle -- >> that doesn't include what's happening in georgia. the atlanta area grand jury investigating efforts to overturn his election in the state is expected to begin today. the district attorney, fani willis, said she will announcement she talked about how some of the ugly threats she received in recent months. >> very grotesque things. we are on family television. i don't know that i like to say all of them. slave whore is one of them. i'm receiving phone calls and texts -- excuse me, phone calls, emails and communications that are derogatory in nature. they don't always state what they -- what the reason is that they're calling, but i probably have been called the "n" word more times in the a last two and a half years than most people combined. >> security barricades have been placed outside the fulton county courthouse in anticipation of those potential charges. all as in michigan a pro-trump lawyer was charged and the investigation that involves attempts by trump supporters to breach voting machines. two other trump allies charged in the same plot earlier this week. >> zach, good morning. great reporting on this all week. we are watching this play out in states all over the country. talk to us about what we know now in terms of this allegations in michigan. >> good morning, guys. this pro-trump lawyer is now the third prominent republican in the state of michigan to face state-level criminal charges related to what prosecutors say is a conspiracy so seize and access voting machines. they are accusing lambert and co-conspirators to convince local officials to take essentially seize voting machines from their elections office, which under michigan law is illegal. now, lambert is a fairly -- not a very well known figure, but she is tied to someone who is under -- an unnamed co-conspirator in the jack smith indictment. she is very -- works closely with trump lawyer sidney powell. cnn identified powell as an unnamed co-conspirator in the jack smith investigation. these are two separate investigations. a state-level probe in michigan and the federal probe. there is interesting areas of overlap. lambert was involved in georgia, someone who helped powell pay people to go to a rural georgia county and analyze voting machines there, too. so, you know, multi-state effort that is part of the state-level investigations as jack smith is, you know, files his indictment against donald trump as part of the la f >> to be clear. you mentioned the difference between the michigan case and jack smith's case. this is different from the michigan fake electors scheme, right? >> it is. that's also a separate investigation at the state level in michigan, overseen by the attorney general dana nessel there. and unlike jack smith's indictment, which focuses on the people who were at the top, right, the trump-level people who were organizing these electors, the state-level probe into the fake electors is saying they committed crimes under state law by signing the certificates by sending them to the senate. >> thank you. >> sorry. >> no, that's all right. >> david urban and laura -- and national coalition director for biden/heir ashley allison. good morning. >> what is your reaction to what we saw this week for trump and how he responded yesterday? >> so, you know, i mean, obviously, we could talk about it for hours. the interesting part -- for me at least about this, is, you know, we have the january 6th hearings and the run-up to those hearings, and this indictment. what you don't see is a specific charge about the insurrection, right. you see all the fake elector scheme, the preparation for that, you see the, you know, going and calling different states, but you don't see anything about the actual assault on the capitol. and i think that gives, you know, earlier in your piece -- i saw david, you have a -- interaction about, you know, kevin mccarthy and republican responses. not having that charge about the insurrection, the assault on the capitol, allows people to kind of say, listen, this is about something else. this isn't about the, you know, that violent insurrection we saw. this is about a dispute about how the election played out, right. and that's why, you know, mccarthy's pushing back and saying it's like gore/biden, you know, clinton, others. it gives him the space to do that. it's interesting to see that specific piece of that charge. >> they are not trying to bring insurrection charges. charges related to -- that's an important point. you could say trump wasn't directly responsible for that. you can't read his mind in terms of his intent on walk down to the capitol, put pressure on you. >> i agree with you. jack smith's a smart prosecutor, knows what he could get a conviction on. take a swing at a former president, not able to land a punch, right? if they charged something on january 6th, it would be a higher bar, longer road to get there. i think they feel on firmer ground here. but i think that, you know, there is no -- you can't defend the assault on the capitol. you see those visuals, you listen to the people, there is no way you can stand and say, well, let me explain what i think's happening when this fake electors scheme is taking place, we had a dispute about the election, these machines, we were trying to seize the machines because there was fraud, that's what you're gonna hear. they will relitigate all these pieces -- >> his attorney said we are going to relitigate this. >> whereas, if we are talking about the assault on the capitol and you see people beating capitol police officers with flagpoles and fire extinguishers, it's hard to defend that in any way. >> ashley, you know, just, again, the fact that you are a former white house policy advisor, biden totally trying not to say -- not saying anything about this, the white house not saying anything about it. merrick garland being attacked by the right in terms it of this. how does he run without addressing this when this sucks up all of the oxygen? >> i think it's important that president biden stay out of this conversation in the legal realm because there is an implied firewall between the white house and doj. and in a time in our country where so many people do feel -- whether it's justified or not, feel like doj is being villainized, the president keeping his head above water is really important. the question to how he runs, well, he needs to talk to the american people about what he has done in the last two and a half years and what he would to if he gets another four years. and i think he has a strong record to run on, whether it's about the economy or infrastructure or gun reform. so there is an opportunity to do that. most importantly, he still need to govern. our country is improving, but it has a lot to go -- >> i get -- i get not talking about the legal aspects of it in the justice department. but the foundation is so interesting because this is the foundation on which biden rested so much of his prior run -- you know, stability of our democracy and the importance of upholding that. >> including the launch of the re-election campaign. >> yeah, it's like that's what it was about. >> also why they did better in the 2022 midterms. >> that is true. but you think you can talk about the attacks on our democracy without going down the rabbit hole to talk specifically about this case. there is no -- to david's point, we all saw the images of january 6th and we all know why people came to washington, d.c., on january 6th, because the then-president, donald trump, put a tweet out. it's a fine line to walk, but i think the way the president has done it to date, he should continue to do it. otherwise, if he starts to talk about what the special counsel should do, what, you know, merrick garland's role, i think it gets too sticky and gives ammunition, really, to the republicans to say, see, i told you biden is trying to persecute trump because he doesn't want him to be his opposition. >> we spernt a lot of time on kaitlan collins' interview with bill barr, former attorney general. he said some things that trump's attorney responded to. listen. >> free speech doesn't give you the right to engage in a fraudulent conspiracy. >> laughable. what's the fraud? tell me what the fraud is. what's the fraudulent speech? donald trump, president trump was out in the open petitioning the state legislatures, petitioning the courts, there was nothing fraudulent going on. this is absolutely protected first amendment speech. for mr. barr to say that is a complete and utter ignorance of what the basic law is with respect to freedom of speech. >> well, i have a great deal of respect for former attorney general barr. it's at the intersection of political activity, legal advocacy and criminal conspiracy. all three of those things combine, and the nuances between those i think will be really difficult to discern and we are going to be, you know, this is going to be litigated. you heard the trump lawyer talking about it. obviously, it's been repeated over and over again in the media and print and television. that's, obviously, their line. we will have to see. i don't think that will hold lot of water. that's their argument. >> were you surprised to see how candid bill barr was? >> interestingly, i was there in the green room with the attorney general before the interview and then followed up afterwards. i have known him for a while. he is a pretty candid fellow. he is not pulling any punches here. i thought it was -- it was a great interview. it was insightful. i think we may see him again, at the trial perhaps. >> real quick before we have to go, your response to kind of that argument, the free speech argument? >> i understand it. it kind of goes to what kevin mccarthy said about hillary clinton and al gore. at some point they took the legal -- al gore took the legal pathway to go to the supreme court and when he lost, he conceded. and hillary clinton within 24 hours conceded to donald trump. the problem is, is even the day he is arraigned, donald trump is still pushing the fact that he won the election. and so he did not. and that's why he is going to court. >> yeah, they keep leaving out that the other two conceded. >> that's right. >> very interesting. david and ashley, thanks, guys. appreciate it. more than 50 million americans under heat alerts still this morning. many of the same cities that just experienced weeks of triple digit temps heating up again. the national weather service is predicting oppressive heat across the south central united states, including phoenix, el paso and baton rouge. our meteorologist allison chinchar has the forecast. >> nearly a dozen states under some type of heat alert in the short term. these are likely going to continue to the weekend for a lot of these areas. phoenix still topping out at 115. that's 10 degrees above normal. vegas 108. palm springs at 112. it's not just the desantis southwest. dallas 107. similar for houston, new orleans. cooler in nashville and birmingham during to the rain. we have had a tremendous amount of rain across much of this area here in the last 24 to 36 hours. there is a flash flood emergency across portions of northwestern tennessee. we have had a foot of rain in just the last 336 hours. that has been triggering evacuations in that area and, unfortunately, a lot of this rain is training across the same areas. so that rain is going to continue to pile up as we go through the rest of the day. again, here you can see that tiny pink area showing at least ten inches of rain has fallen in just about the last 24 to 36 hours. but it's because of ma we expect going forward, the additional rainfall, that's likely going to keep a lot of these flash flood watches and evening warnings in place for the next 24 hours. >> thank you. former president trump's actions since the 2020 election have been unprecedented . what it all means for the state of our democracy. that's next. xpensive. use priceline, they've got deals no one else has. what about work? to start 30,000 feet, what can we spare this to in american history? >> yeah, the only moment we can compare it to, the only other time that the peaceful transfer of power was not realized is 1860. one of the things lincoln said was, so what happens? the south loses the election. the democratic party lose to the republican party in the south. they decide to secede from the union. they will not accept the loss. lincoln said if we allow that to stand, the struggle is really about, then democracy will be considered an absurdity. ordinary people cannot govern them serves. the only other time. everytory time the person who lost -- and what's so important about playing those clips as you did is to show the human emotions involved. a person has been in an election for months. they are exhausted. they are sad at losing. one of the things that carter said when he was in his concession speech, i promised i wouldn't lie to you, but i must tell you now, i am really hurt. this is hard. on the other hand, i accept that i have lost. and he said, i have had a great chance to have some shaping of the destiny of our country. no man can ask for more. i congratulate the winner. we needed that time and time again. it's what democracy is about. you can either vote the guys in or throw them out, and the guy who loses has to be able to accept it with humility and dignity only now, in 1860, two times in our history. >> bringing up lincoln, he also said in that debate with stephen douglas, with public sentiment, nothing can fail. without it, nothing can succeed. you just look at where the public sentiment is now among republicans and i wonder if that makes you worried. >> you know, poppy, you are absolutely right. lincoln said that more important even than a law that is passed by the supreme court, more important than a congress that is passing a law, is public sentiment. what he meant by that was not a snap public opinion. what he meant was that at a certain point in a country's history, there is a settled feeling that comes on the country that something is right and something is wrong, something doesn't meet the ideals of the country. that's what happened as the anti-slavery movement built up momentum so that finally slavery was going to have end. once public sentiment knew that, it was inevitable it was going to go. right now the challenge is for the country to build up an understanding that what president and former president trump tried to do is wrong. it's against the ideals of the country. i think that's why it's so important that the trial be on television so we can see what's at issue. that's why it's so important we talk, as we are this morning, about what the peaceful transfer of power means. it's not just a slogan. it's something that humanly has shown character of the people who run for office, that they are willing at that hardest moment to accept loss, and public sentiment can be changed. so far, there is a rock bottom republican party that's not willing to do it. that's still not the majority of the country. the country has to organize at every level to make sure that public sentiment changes. if it changes and overwhelmingly understands what happened and if the trials and the indictments help to do it as january 6th did, then we will be okay. if it doesn't, then lincoln's worry will be absolutely my worry as well. >> i think my skepticism is based on the last six years of public sentiment not shifting when you would think it would based on traditional kind of political realities or traditional national realities to some degree. why do you think a televised trial, why do you think anything can change where the 35% of where trump supporters have been or a significant portion they have been due to the power trump has in the party would ever change? >> you guess my hope is that one of the reasons why public sentiment has not changed among some of the republicans is that this alternative networks that are spewing out different facts. so you are getting a different story in different places. if a trial is there, it's going to be like in the old days when fdr gave a radio chat. 80% of the radios would be tuned in. it was the only thing in the air in 1960s until the time of cable. you had three television networks saying the same thing rng the same facts, if not different opinions. a trial will be watched. a trial will be there. you are not going to be able to change the facts of the trial, even though it could be interpreted differently. maybe that will allow us to have a majority looking at the same thing and making a decision on the basis of what's right and what's wrong. i have to hope. you have to believe that. >> one the reasons we love doris, because she has hope. doris, finally, you want a televised trial. rick hassan, the constitutional scholar at ucla writes, u.s. v trump will be the most important case in our nation's history. you know the history. do you think it will be, at least up to this point? >> reporter: well, a couple of things. first, we've created hotlines for both providers and for patients. if you're a patient coming from another state, you may not know where you can go. you may not know where you can stay overnight. you may not know what to do with your children while you're having a procedure done or seeking health care from a doctor in illinois. so we've got hotlines that are available for people to find out, and also for those who can't afford an abortion, whether it's a medication abortion or a procedure, we even have non-profit organizations that will support your effort to seek out your reproductive rights. unfortunately, we are seeing thousands pour across the border from just our neighboring states, and tens of thousands from across the country. >> yeah, planned parenthood released data, they saw 35 increase, 40% coming from out of states. do you believe what you have set up in terms of infrastructure for that can handle the influx without delays to others? >> not yet. and the answer is we've got to increase capacity. we are doing everything that we can, though. frankly, we have to build out facilities. we have to make sure that we're giving people the, you know, proper procedures to follow, and, of course, we want people to know their rights are protected in the state of illinois, whether they are here in illinois or coming from another state. >> i thought it was interesting that last week you signed a different bill. and i read through it. what it does, is it penalizes anti-abortion centers for using what you deem deceptive practices or misinformation. you are basing this legally on a consumer fraud act that you have in the state of illinois. you were sued immediately by a law firm in your state that calls it a blatant attempt to chill pro-lifer speech. yesterday a federal judge upheld that. are you confident that this bill is going to survive the courts? >> i am confident this is constitutional, it's legal. remember what they are doing. they are putting their crisis pregnancy centers next door to abortion rights centers, and they are directing people to go in their front door or telling the things that aren't true often. and when that's the case, they ought to be held liable. there ought to be a private right of action for anybody dissuaded or sometold something false. what they say, that's fine, as long as what they are doing is not deceptive. it's fraud in our state and we will prosecute people for that. >> one beat on that before we move on. it's largely their claim to have this right, is largely based on rifra, right, religious freedom and making their argument from a religious perspective. how do you counter that free speech argument? you are basing yours on a consumer fraud act. i understand that. as you face the first amendment question? >> well, it's just like the case against president trump. you have a right to free speech, but you don't have a right to lie. you don't have a right to use those lies to push people into situations in which they, frankly, are breaking the law or where they are unaware of what their full rights are. so, you know, we need to make sure that people know their rights. this came about, in part, because the attorney general of the state of illinois was driving into a planned parenthood and actually one of these people stopped the car, you know, acting as if they belonged to the planned parenthood organization, and started directing them towards the crisis pregnancy center and telling them things that weren't true. the attorney general couldn't believe that was happening and after he realized it, you know, came to the legislature and said, we shouldn't allow this to happen. >> finally on the biden administration, you told my colleague jake tapper last year the federal government should be doing more to protect abortion rights. "new york" magazine has a pro fievel you this week. this is post the leak of the dobbs decision, and you are with biden in a motorcade and you say to the president, you need to be out there. you can't have the vice president doing all the talking. is president biden out there enough on this? >> look, you can't be out there enough. but the president has done a lot, i have to say, and he is protecting women across the country. we need to make sure he gets re-elected. every one of the people on the republican side running wants to take away women's rights. and it is president biden who is protecting them. so i'm pleased about the messaging coming out of the white house and the work that he has done to protect women's rights. there is more work to do. we have 15 or 16 states that have literally cut off a woman's right to protect herself, to have reproductive rights exercised, and in illinois we are an oasis. if you look at the map, every state around us has outlawed abortion, and we are the ones who are protecting it. that's why we are seeing an influx of patients. >> on biden, it's always the economy. whether it's only the economy that people vote on is to be seen, but it's often right up there. he is just not resonating with voters on the economy. we have this new cnn polling out this week, 63% of folks disapprove of how he is handling the economy, 70% disapprove of how he is handling inflation. the numbers across the board are getting better on the economy. >> well, i think you just made the point that things are getting better. it takes a while though for people who have been feeling the ill effectsful frankly, the trump-era, the last year of the trump administration in which he did absolutely nothing to protect people from coronavirus. and it is president biden that rescued the country, its health, and its economy. we're seeing the benefits now. there is literally full employment across the nation. we're seeing the wages go up in real terms for people. it takes a while for that to sink in. of course, you have to fight off the false rhetoric coming from the republicans, who are, you know, pushing facebook fakery. >> facebook fakery. the vaccine, i'll say, came under the trump administration. i appreciate your time, governor, very much. especially talking about this really important issue. you are welcome back anytime. >> thank you. >> yeah. the labor department just released the july jobs numbers. we will break them down coming up next. also, republican presidential candidate chris christie is in ukraine. >> this is a surprise visit. what we're learning about his trip, next. i need it cool at night. you trying to ice me out of the bed? baby, only on game nights. you know you are retired right? am i? ya! sa up to $500 on the new sleep number® smart bed. plus, free home delivery when you add an adjustable base. shop now only at sleep number®. and there he is. chaz. the rec league's self-crowned pickleball king. do you just bow down? no you de-thrown the king. pedialyte. 3x the electrolytes.
