world cup later. but first, today could be charging decision day for former president donald trump and the federal investigation into efforts to overturn the 2020 election. it's tuesday. so the grand jury in that case may be meeting just a few hours from now as we learn new information in the other federal investigation into the ex-president. the classified documents case, his mar-a-lago property manager out on $100,000 bond after appearing in a miami courtroom. carlos de oliveira telling the i.t. director, quote, the boss wanted surveillance video deleted. it's now in the hands of the lawyers for both the defense and prosecution, according to a new court filing. legal action means legal bills. new this morning, what we're seeing just how big those bills are. how much is this costing the former president? well his political action committee save america is burning through cash and now has less than $4 million left in its account. that is down from $105 million at the beginning of last year. it does not seem to be hurting trump politically in the polls. a new poll shows trump statistically tied with president biden in a hypothetical matchup in a general election. 43 and 43 "the new york times" college poll. senior crime and justice reporter katelyn polantz joins us. good morning. indictment watch for weeks and it's tuesday. so the grand jury may be meeting. also waiting for prosecutors to meet with bernie carrick. would that happen to happen before a potential indictment? >> not necessarily. the justice department are able to do a lot of things and bring an indictment and continue investigating. we know they are still looking into this close associate of rudy giuliani, bernie carrick. they want to talk to him. he's going to be talking to him very soon. he already turned over a great deal of documents. that could happen even after an indictment is filed. and right now, where we sit, is that donald trump says he believes an indictment is imminent. there is nothing that says that that is incorrect. and that's because this grand jury in washington that's been looking at january 6th, they have had quite a bit of momentum, especially over the last few weeks. so, if you dial back the clock a bit on july 16th, that is when donald trump received the target letter from the justice department telling him that he was very likely to be indicted for the second time related to this january 6th investigation that federal prosecutors had been conducting, using a grand jury that has been meeting in washington, d.c. for many, many months. that grand jury often meets tuesdays and thursdays. so here we are on a tuesday. if they gather today, they very well could be asked to look at the indictment and to vote on it, to approve it and bring it into the court system as formal charges against the former president. that happened two weeks ago when he got the target letter. since then there has been additional witnesses into that grand jury and last week the trump defense team met. so a lot has been happening behind the scenes. we have to see exactly what emerges publicly from the federal court. >> swing back to the mar-a-lago case. obviously we saw the de oliveira arraignment yesterday. the surveillance video now in the hands of the prosecution of trump's defense lawyers. what's your sense of what that footage actually contains? could that be damning to the former president and his codefendants? >> it could be. but we have to see exactly what is revealed at the trial if these particular charges do end up going to trial as they're charged now. so carlos de oliveira and walt nauta the other codefendant are accused along with donald trump of trying to talk about and get rid of surveillance footage. not that any surveillance footage that the trump organization had of that property was actually deleted, but they're charged with wanting to try and take steps to get rid of it because it very well may have captured them moving boxes that had federal records in them when the justice department was seeking to get those returned. and that surveillance footage, that's only one piece of the evidence. from what we can see in the indictment itself, phil and poppy, there is a description of de oliveira and walt gnauta walking throh a tunnel with flashlights just after days donald trump became aware they would be subpoenaed for all this surveillance footage. there's another episode just a couple days after that de oliveira is captured walking through the bushes and then walking back through the bushes on the grounds of mar-a-lago. so all of that together could be quite substantial, but then there's also very likely witness testimony that could come into play here. >> a lot of moving parts. i was going to stay stay on high alert. i think you pretty much always are at this point. great reporting as always, katelyn polantz. >> let's bring in senior legal analyst elie honig. good morning to you. catch us up on this 2020 election probe, what's the latest. i guess an indictment could come any day. >> yeah, pop. so we are clearly in end game. the big question is when will we arrive at the end? as it turns out we have a pretty good example because this same prosecutor already indicted donald trump of course in the mar-a-lago classified documents case. what does that tell us about when we might see an indictment in the election probe? let's do a probe here. in the last case and in this case, jack smith sent target letters over to donald trump. in the mar-a-lago case he sent that letter on may 19th. the indictment came on june 20th. that's a 20 day lag. in the january 6th case the target letter went out on july 16th. we're now 16 days in. there does not have to be mathematical precision here, but it can give us a rough sense of where we are. will there be an indictment? we don't know. we're in the ballpark. now, tore thing that happened at the very end of the other case is the defense lawyers came in and met with doj to make this last pitch why you should not indictment my client. last time that happened on june 5th. indictment came down on june 8th. that was three days. and this time the meeting happened on july 27th. we are now five days after that. so again, what we can safely say is we are in the ballpark. when the end will come, will be up to the prosecutors and the grand jury. >> this is as reflected in the target letter that jack smith said to donald trump according to trump's team. by the way, last time the charges in the target letter were similar but not identical to what charges ended up in the indictment. here we know that the charges listed in the target letter include conspiracy to commit an offense against the united states and deprivation of civil rights. these tell me the emphasis is really likely to be on the weeks and days leading up to january 5th. the scheme to try to steal the election. then the third is witness tampering. i put an asterisk there on purpose. i actually think it will turn out the be a different. there's a very broad statute that, yes, covers witness tampering and but also covers obstruction of an official proceeding relate to congress from counting the electoral ballot. as soon as we get this indictment, let's see how this measures up. >> also who the team of prosecutors have -- who the grand jury heard from, the witnesses in all of this. who jack smith talked to. that really is a key clue, is it not? >> yeah. one thing i think we can discern from all this is jack smith is looking at the seven-state strategy. donald trump's effort to steal the election in these seven states. we know doj has spoken with various officials from the seven states. brad raffensperger from georgia, officials from arizona, the former governor. they're clearly looking at this -- >> from every state. >> broad lens. related to that, the fake elector scheme the submission of these documents we know they have spoken with some of the fake electors. they have spoken with mike pence the former vice president. and we know they have spoken with various people who were at the rally beforehand. >> okay. we'll watch. elie, thank you very much. well, you know what the legal issues are. where there are lawyers, there are expenses. trump's political operation for his re-election, they're burning through money quite fast to meet those expenses and using questionable financial tti to cover those expenses. according to the fec filings trump started 2022 before any of the indictments came down $101 million for his joint political action committee. now e same pac at this moment based on the filing that arrived last night, less than $4 million in the bank. the campaign is spending more than it's inging in, even though its various fundraising arms for the former president brought in $53illion in donations, the first six mompbts of the year it has spent when you look at the entirety of its committee finance consolation more than $53 million. in fact, you add in the super pac spent more than $100 million in the first six months of the year. also trump's leadership pac spent about $21 million on legal fees. the president and its associates the first six months. if you look at what that means, more than 70% of the total distributions through the first six months of the year. now, trump's fundraisi entities are trying toov the costs in any way they can and this is by far the most fascinating dynamic of this fec fing and the entire universe now. the political action committee transferred 60 or donated $60 million to the super pac, make americgrt again. super pacs and the political operations of the candidate ar not allowed to coordinate. they are not allowed to operate within one another or talk to e another or give one anothe money technically when it comes to giving it back, political action committee asked for a refund of $60 million in total. what we have seen in the fec filing they have gotten $12.3 that's a larger refund to some degree you want to put refund in quotes here than has ever happened before at least on my read of fec filings up to this point. the question is, one, how is this happening? why is it happening? clearly we know it's a legal bill problem. they have a liquidity issue both the campaign and going to the super pac to get money back. this is something i have never seen before in campaign finance. it's not those rules are actually really strong to some degree. trump campaign made clear they followed everything bto the rul of the law. it's fascinating. >> it is. let's bring in anchor of spectrum news errol louis. . it's harder to return a dress than it is to return or ask for 60 million bucks back from an entity by the way that is supposed to have no conversations, official ties with any candidate. that's the only rule i suppose any more around pacs and where did it go? >> yeah, no. we're seeing really innovative uses of pacs. inknow vnovative -- >> i like that. that's good. >> ron desantis is good with this never back down pac that has a ton of money as well. obviously the advantage for the pacs is they can raise as much money as they need to. they raise a ton of money and figure out how to work with the candidates as much as they can within the bounds of the law. the thing i think is fascinating about this whole trump scene is that he is both bound by the fact that he has all these legal bills but also now in this increasingly noncompetitive primary. so he needs to raise a lot of money to pay his legal bills was anticipated, hey, we need to win this fight. it is starting to look like a fight. it's not over until it's over, that adds layer of problem for him he wasn't anticipating. >> that's a great point. the super pac was designed and has up to this point the tune of $23 million been their tv side spend. that's how they've been attacking ron desantis to the tune of 20 plus million dollars. now they don't feel like they necessarily need to spend, but they would even if they win the nomination have a fretty intense and very expensive general election battle. does this matter? is there a tangible cash crunch? >> it absolutely does matter. there are people who are not necessarily going to write that second or third or fourth check to the extent that this becomes the main issue. you have will hurd sort of put it out there for the whole campaign to sort of look at, he is running to stay out of prison. he is raising money to pay his legal bills. this is a legal case and not necessarily a political campaign. and there may be people around the margins, maybe i don't necessarily need to write that next check. maybe send it to my senator. or just sit and wait until the general election. but, paying donald trump's legal bills is not necessarily going to be a viable strategy. to the extent that he gets in front of rallies and says, this is all about political persecution, you have to help me out. sure, that will make some sense up to a certain point, but the cash crunch is going to continue for sure. >> elie, it's not just if he's indicted in this other federal probe. it's what happens in georgia, which we'll know in the next month, really month from today. what i thought was so interesting, trump lost in terms of what he wanted in terms of a dismissal of evidence and wanted fani willis gone. hoe lost. in the ruling from this judge yesterday, he wrote something interesting that ties to the point that phil and errol are making. he said, talked about trump's efforts to capitalize on these legal woes. for some, quote, being the subject of a criminal investigation can a la rumple stilt skin make it seem more problematic. that was striking. >> that motion was procedurally and legally flawed. i gave it a 0% chance of success on this show i don't often do. thankfully that turned out to be correct. i'll take issue with that statement by the judge. there's nothing illegal about politicizing an indictment. you're actually allowed to do that. you're allowed to fund raise off of i've been indicted and this is unjust. >> he's not saying it's illegal, but he's pointing it out. >> the judge should not be the police of manners here. the judge should be worried about the law and conflicts of interest. fani willis fund raised off of this case. >> she has used subpoenas in this case to say, hey, everyone. i just subpoenaed lindsey graham, a republican senator. donate to me. donald trump doing what he is doing is distasteful, perhaps manipulative as errol and phil pointed out people donating to him don't quite realize this is not going for yard signs, going for lawyers for people don't flip. >> another candidate that raised a ton of money and used to be the totem for quick burn rate was ron desantis to some degree. he released his economic plan. you're a fellow nerd and also ohio guy, by the way. point that out. the desantis economic plan a lot of was very very well known, republican, conservative policies, trump era republican policies. stuff on crypto i thout was ining. student loan position was interesting. what's more interesting is i don't know that yby cares. >> that's right, yeah. >> i think that to me is fascinating to go down this route when you're this far down and clearly need to retool your campaign, does anybody care. we're showing some of the bullet points on the screen about a policy proposal. >> no. one of the signal moments in donald trump's 2015 when he first announced he came out. he was on "meet the press" with chuck todd in august of that year. chuck todd said, i don't think people care about policy papers. he's right. what's really important about desantis doing that yesterday is it came out right after the new york times poll in which it was very clearly made -- they asked these questions, what do you think of these policies, policies that ron desantis -- we think those are great. he's losing by 30 points to donald trump. the question that really summarizes it is that both of them were seen as likable but donald trump was seen as fun. he wasn't seen as this nerdy guy. he'll throw bombs at the opponents and talk. and that's what's winning in this race. >> that's really interesting. final word, people don't care about policy, they did care on foreign policy when ron desantis submitted that questionnaire to tucker carlson about ukraine. they did care. a lot of republican voters did care he didn't seem supportive of funding of ukraine. >> that was extraordinarily over the top. but the point is well taken. if ron desantis' argument is essentially, you know, donald trump never built that wall and made mexico pay for it, i'll really do it. he missed the entire point. the wall was a metaphor. people didn't care whether the wall actually got built. they wanted something done about immigration and wanted something to talk in a way that was disruptive of the long-standing three decade long inertia on immigration. that's what donald trump delivered. donald trump is sort of playing the wrong game and not winning at that game. >> thank you, their nationals out of the african nations days after the country's president is overthrown by members of his own presidential guard. larry, what precipitated the actual evacuate? felt like it had been heading in this direction. why now? >> reporter: it had been heading in this direction, phil, especially after sunday's protest turned violent and the french forces had to use tear gas to disperse the citizens trying to break into the embassy. they were smashing windows, throwing things into the embassy. they say because of the closure of the air space, the military junta did after they deposed president bazoum and people cannot find their own means to leave the country, the french foreign minister said there are several hundred french citizens in the country as well as several hunt european citizens that french forces will be evacuating, they expect this to be over in 24 hours. we don't understand if this is airborne, heading to niger or taken off from niger heading back to paris. we're seeking clarification on that. this situation escalated quickly. overnight, we saw the two neighboring countries mali and burkina faso say any military intervention in niger will be equal to an act of war and they will respond. and the third country, guinea, will also not be enforcing the sanctions announced by the regional bloc there. the thing these four countries have in common, they have had coups, five coups since 2020. i want to play for you some of these statements from the military juntas in these three countries. [speaking in a non-english language] >> translator: warn that any military intervention against niger would amount to a declaration of war against burkina faso and mali. >> translator: the transitional governments invite the live forces to lend a hand to the people of niger in these dark hours. >> translator: the brother peoples of mali, burkina faso, snie jer, guinea aspire to more recognition and respect for their sovereignty. >> reporter: major anti-western sentiment. this will be even more unsafe there. the u.s. about 1,000 troops involving counterterrorism operations. so far, phil, no word on whether american citizens will be evacuated out of niger. >> very fluid situation. thank you so much. this morning, armed man in memphis was shot by policed after firing shots outside a jewish school when he couldn't get in. the suspect fled the scene and they were able to track him down. p congressman steve cohen who represents this area says his office learned that the shooter is jewish and a former student of the school. the suspect is in critical condition this morning. thankfully no one inside the school was injured. also today, the suspected gilgo beach serial killer set to appear in court for the first time since he pleaded not guilty to the murders. rex heuermann is accused of killing three men in new york and ditching their bodies in a now famous long island beach. last night his wife's lawyer told cnn investigators completely tore up her family's home on their search for evidence. brynn gingras is live. what are we expecting from this hearing today. >> reporter: yeah, phil. this is a status conference hearing. the next step in this legal process. so we're expecting really the attorneys to go back and forth with discussion as far as evidence is concerned, but really no big headlines to come out of it. just again another big step in the process as heuermann is -- six charges in rels to the murders of the three women whose bodies were found not far from here more than a decade ago. we're not expected to hear from rex heuermann himself. we did hear from the divorce attorney for his soon to be ex-wife. i want you to hear what he said on cnn last night. >> it's been extremely overwhelming for her and the child trying to piece life back together what it was two and a half weeks ago. i don't know if they will ever return to normalcy, but day by day she is getting better. she needs to show her strength so the children have something to focus on, strong focal point of their mom getting better. she's getting better each day. >> reporter: that's heuermann's soon to be again ex-wife divorce attorney, saying that her life has really just turned chaotic. remember, she is not considered a suspect in these cases. but she and her children are going back to their massapequa park home. police were there for nearly two weeks. really tearing it apart and seeing if anything could relate to the murders heuermann is charged with and possibly other murders that they're still investigating. they shared pictures of what their home looks like now. they quite literally are say they are trying to piece together their life. trying to take an inventory of what police took from their home, what they left and sort of get their life back together. as far as her communications with rex heuermann, her divorce attorney saying they have spoken. she has not visited him behind bars. no insight into what those conversations are. it does seem like she is just trying to get her life back together at this point and receiving support actually from people who live in that community and also we're hearing from her divorce attorney from the family of other serial killers who have reached out and been in a similar position as she has, interestingly enough, guys. >> brynn gingras, thank you. >> we have been transparent. we have it on the website where we detail exactly what we did. that's why they're able to criticize the methodology. we stand by it, of course. but that's just one claim he's made. in fact, he's kind of dropped that claim in the last week. and what he's now saying is that another study that we did that quantified, that put some numbers around the increase in hate, in hate speech on that platform, when mr. musk took over, he is saying that's the problem now. the truth is that he's been casting around for a reason to blame us for his own failings as a ceo. because we all know that when he took over, he put up the bat signal to racists, to anti-semites saying that twitter is now a free speech platform. he welcomed them back on and reinstated accounts that were suspended for spreading that stuff. now he's surprised when people are able to quantify that there has been a resulting increase in hate and disinformation on his platform. >> the methodology aspect that he's criticizing here in part, musk's attorneys say that you chose 100 tweets and that that is not representative, for example, of nearly 500 million tweets per day. can you just explain to our viewers how you come to these findings? >> so what we did is we took 100 random tweets which we found to contain hate from twitter blue accounts. we reported it to the platform using their own reporting tools crucially. then we went back and checked what action was taken. now, of course, we know that twitter has terms of service. it has community standards. it has rules of its own. we have a reciprocal right to expect others to have to abide, too and platform to enforce those rules. we found 99 times out of 100 they failed to enforce those. mr. musk rather than doing the right thing which is to go crumbs what's gone wrong with the platform and the way we administer it, he's instead blaming the messenger? >> what is your goal. let me put on the screen some other things that your organization alleges you have noted that since musk took over twitter, tweets containing slurs have raisin by 202%. also tweets linking lgbtq plus people to, quote, grooming have more than doubled. climate denial content and accounts are -- climate denial content and accounts are surging. what is your hope by putting this data out there? is it that you hope musk will change how x is run and what it allows on the platform? he allowed kanye west back on this week. >> leaving kanye west aside. all we do is hold up a mirror to the platform and ask them to consider whether or not they like the reflection they see in it. never before has one of these social media companies -- we, of course, analyze all social media companies without fear or favor. but when others don't like their reflection, they seek to change it. what mr. musk has done is said i'm going to sue the mirror because i don't like what i see in front of it. that is what is so extraordinary about what's going on right now. >> you're a nonprofit. can you afford this lawsuit against your company? because i wonder of other watchdogs out there might have a chilling effect being sued? >> it will almost certainly have a chilling effect across the civil rights sector. it's not us that have done this research, the naacp, so many organizations. we are right now the tip of the spear when it comes to creating the research that drives change, that brings information into the public sphere, that allows people to draw their own conclusions. mr. musk is targeting us as a reason. of course, it's going to be incredibly expensive. of course we're a nonprofit. we're small. rely on public donations. we don't take money from social media companies or take money from governments. what we rely on is the generosity of philanthropic trusts and the public. in the last 24 hours on our website counterhate.com, thousands of people have visited there. so many have left -- given donations. that's what we need if we're going to survive. >> we read through the lawsuit. it came the middle of the night filed in the northern district of california. i want to allow you to respond to one of the key allegations they make. they say that your group scraped data from x's platform in violation of the express terms of the agreement and that your organization convinced an unknown third party to improperly share logging credentials and to a secure data base that ccdh then accessed to retrieve information without authorization. your response? >> i mean, there's a lot of unknowns that they're claiming to get to where they want to get. it sounds a bit like a conspiracy theory to me. i think what's really important to note here is that the reason that organization like ccdh have to rely on methodologies like we do because there's no transparency on these platforms. mr. musk talks a big game about free speech, but when it comes to transparency, one of the vital elements in any democratic society, he is failing. he has an f grade. now, the truth is that we need federal legislation to ensure transparency and accountability for these companies. and until then, the best hope that the public have when it comes to protecting our kids, protecting ourselves, protecting our democracy is organizations like mine, the center for countering digital hate. >> thank you. you're welcome back, as of course, elon musk and any representative from twitter is also welcome on the program. thank you. >> my pleasure. is it actually possible to stop ageing? >> sort of trying to enhance your natural biology. the belief is that if you did everything right, how long could you live? some say around 115 years. so we are probably leaving 35 to 40 years on the table based on the average life expectancy. what can we do to improve that? enter hitting fasting, cold plunges, things like that. there are different ways people are looking at aging. the dorian gray approach, which is basically to say that we are going to slow down aging. the wolverine approach, reverse ages, and peter pan approach, where agingner occurs in the first place. how does that influence those types of approaches to aging? that's what it is. it's a huge burgeoning field. it's part of -- people quantify theirselves, measure everything about theirselves and try to figure out how to enhance their natural biology. that's basically what it is. >> i assume a big money-making field -- >> huge. >> so to help our viewers not get ripped off, what do they need to know? >> these are the hardest studies to do because fundamentally the outcome is did you live longer and that can take decades. how long do you know you would have lived otherwise, right? it's really challenging. there are various hallmarks of aging. what is aging? how much your immunity declines, how much inflammation you build up, how many cells are not working well. there are ways of measuring aging other than revolutions of planets. some are focussing on specific things. i talked to a aging researcher, the head of aging research at einstein and he talked about a diabetes drug used to target aging. listen to what he said. >> can we say that at this point that if you take metformin that you will delay what are often referred to as age-related diseases?
