be a devastating war between russia and ukraine. following this morning's critical meeting with his russian counterpart, blinken promised a severe and united response by the west if russia invades. >> this was not negotiation but a candid exchange of concerns and ideas. i made clear to mr. lavrov there are certain issues and fundamental principles that the united states and our partners and allies are committed to defend. that includes those that would impede the sovereign right of the ukrainian people to write their own future. there is no trade space there. none. >> basically saying the u.s. is not going to rule out nato membership for ukraine. blinken standing firm. both sides did signal after today's talks there could be at least more diplomatic discussions ahead. we'll see where those go. nic robertson joins us from moscow. but first fred pleitgen in geneva where the talks took place. expectations were low and managed going into this. do the sides consider these talks successful? >> reporter: well, jim, i'm not sure they necessarily consider them successful. i'm not sure the russians consider them to be system. but i think they consider them to possibly be a launching pad to wilder negotiations that could happen along the way and possibly even bigger negotiations between president biden and president putin, possibly in the future as well. but as the secretary of state was saying in that sound bite you played, he didn't call them negotiations. he said they were an exchange of ideas. i think that's less than the russians wanted. they had been saying for days they wanted written responses to some of those concerns and demands they had put forward during the last round of talks in the geneva. they obviously didn't get those. they will get those in search form at least next week. i was able to ask the russian foreign minister sergey lavrov in a press conference whether the russians felt any sort of heldway had been made, but the russians were disappointed the way the meeting went down. listen to what he had to say. >> antony blinken repeated his position on the right to choose alliances. i asked how america is going to fulfill its obligation, which was approved at the highest level in the framework of the osce along with the right to choose alliances, the obligation does not strengthen anyone's security at the expense of infringing on the security of others. >> reporter: as you can see there, the russian foreign minister sergey lavrov saying there will continuously be talks, this is not the end of the dialogue. we under anthony blink season about to depart here from geneva in what has been a beautiful but cold day, about to head back to the u.s. after these very important talks that the russians won't be completely satisfied with but certainly does seem as though there will be another round, other rounds of talks ahead, which, of course, is preferable for the united states, its allies and especially the ukrainians to alternatives that could have been in play with those russians continuing to amass their forces near ukraine. as we learned today, jim, also now having placed anti-aircraft system in belarus. >> we saw antony blinken board his u.s. state department plane for his departure from geneva following those talks. >> it's interesting. as this was playing out, ukrainian president zelensky gave an interview to "the washington post" reiterating he thinks the sanctions the u.s. is threatening if russia invades how would go into effect now to deter russia if invading. but i want to turn to nic now, because russia has said that they're going to be waiting for the u.s. to share its concerns in written form next week, even lavrov suggesting they would make that public. how significant is that response, and could that lead to further talks or perhaps the end of talks if they don't like what they see? >> reporter: yeah. there certainly is an opportunity here for the diplomatic process to continue, but it does seem to be contingent on whether the russians are happy with what they hear or see written down. the russians have been pushing and pushing and pushing for about a month to get the united states to give a written response to what they put on the table in mid-december, this -- you know, their security concerns. they know the answer. this is the problem. they know the answer they're going to get. secretary blinken made it very, very clear on russia's demand that ukraine can't join nato. that's off the table. so the russians know this. so the clock is ticking. the clock is ticking. the question is really is president putin trying to run down the clock as he maneuvers more forces into position, big military exercises coming up in belarus that will put another 100,000 belarus and russian forces closer to the capital of ukraine? is that what this is about, or is there a path to diplomacy? there was a hint in that to what sergey lavrov responded to fred's question that, you know, one nation's security can't binge on neighboring nations' security, sort of an osc fundamental that the united states and russia are both members of and lavp rov pointing out that the u.s. signed up to that. you know, i think when you look at that, is lavrov there saying that we're willing to settle for arms control agreement and reciprocal forced positions across the border which the u.s. says that's something we can discuss? it just seems so unlikely at this stage. it seems very hard to know how much longer the kremlin can continue to play this out when they're not really getting the answers that they want. >> and through all this, we should remember that eight years ago russia already invaded ukraine, remains in ukrainian territory, crimea as well as in eastern ukraine. they've done this before. john roberts, fred pleitgen, thank very much to both of you. joining me to discuss this and other issues is the british ambassador to the united states, dame karen pierce. thanks for taking the time this morning. >> thanks very much for inviting me. >> despite these talks this morning, i hear from speaking to u.s. officials a fair amount of pessimism about russian intentions. and i wonder what the uk view is this morning. does the uk believe russia will invade ukraine? >> it's not that we believe russia definitely will invade. it's the risk that she does is extremely high. i'm a firm believer in capabilities, not intentions. as your report said, the russians have forces in belarus, force on ukraine's eastern border. there's the crimea example. if we go back to 2008, there's a georgia example of russian intervention. and the russians are not de-escalating. so i think to be honest that president putin, russia has a number of octobbjectives, they' run them in parallel. they typically have a range of scenarios and push one or the other depending on circumstances. but we have got to be ready for a russian intervention, a russian invasion, and as the secretary said today we really urge president putin to step back. >> as you note tlushgs all this, all these talks, those russian forces have not moved. in fact, in cnn's reporting and others, russia has added forces in recent weeks. what has diplomacy achieved so far? >> well, diplomacy is keeping going. i don't want to overstate that, but i do think it's important that the talks continue and that secretary blinken was able to meet mr. lavrov today in geneva. we need more of that. we need more nato/russia talks. but fundamentally, the european allies and america are very close together on this. and we do urge the russians to use the existing agreements on european security. there are lots of agreements. they go back to 1975 and the helsinki final act. >> as you know, when president biden spoke on wednesday, and the white house has later clarified, walked back these comments, he did reference potential disunity among nato allies if russia does not carry out a full invasion but something short of that. he described that as minor incursion, though, as i said, the white house is trying to clarify. i do wonder, though, was the president revealing there that there is some disagreement among nato allies as to what to do in response short of a full invasion? is there disagreement? >> i haven't seen any disagreement. in my experience, when nato confronts securities like this, it typically looks at a range of options and a range of scenarios of what will happen in circumstance x or y and what are your options in those circumstances. i don't find it unusual ta the allies would want to face different scenarios and responses. i think the key thing is any incursion by russia will bring a very severe response. and we hope moscow knows that. >> you heard the ukrainian president say why not impose sanctions preemptively? why wait? by the way, russia has not responded to the threat so far as we've noted. the forces are still there. would it be smart to impose sanctions today as opposed to wait for any invasion? >> i think in general terms nato and the west were a defensive alliance. i really want to stress that. we tend to wait for things to happen and then respond to them. that's the way we do things. that's the democratic way. it's the defensive way. but i'm sure all options on sanctions remain on the table and our leaders are getting together very frequently to talk about the best response in various scenarios. >> in the midst of this crisis, there is a political crisis at home for the british prime minister, boris johnson, including within his own party. do you, as the uk senior representative here in the u.s., have confidence in johnson's leadership? >> well, i'm a civiler is vantd, a public servant. the answer is yes, of course, i support my government. i work for my government. i think you'll find the prime minister is absolutely focused on the russian/ukraine crisis. he's been making phone calls. he talked with germany this morning about ukraine. and he's also been leading the response on omicron. i'm pleased to say that the uk looks as if it's coming down to the pandemic and we've been able to relax our restrictions. so hopefully, that is a piece of good news and the prime minister is focused on those. >> the uk, i should note, for folks listening in the u.s., has also relaxed restrictions for international travellers to the uk. significant. before we go, i should note for folks that you were uk ambassador to afghanistan in years past. as you know, the u.s. and nato left behind tens of thousands of afghans who worked for the west through the years in the war against the taliban, and many of them faced grave threats today. i've spoke on the folks in that category. do you believe that nato owes those people, particularly those who served in the military in the fight against the taliban, owes them a safe exit from that country? >> reporter: no question. and you saw more and more as that criticism got louder and louder members of the committee strategically putting out whether in public in clear ways in letters or in other ways that they have gotten a lot of information voluntarily from members of the trump administration, people who were in and around meetings. we now know that keith kellogg, a top adviser to mike pence, we know he spoke to the committee, but we know he gave a lot more information than we realized. and there is a lot we don't know. but what is clear, if you combine the witness testimony and now what the committee is going to get and is already getting, the hundreds of pages of documents that the former president was so desperate to keep from the committee, they're going to have a much more fulsome picture. and we know that whether it's the democrats or the two republicans on the committee, they want to know the whole picture, not just about the fbi, not just about the actual insurrectionists but most importantly the president's role and the role of the people around him. it looks like they are more and more painting that picture. >> we already know what the trump world's response is and will be to january 6th the january 6th committee. they'll call it a partisan committee, though it's not. it has republicans on board, a lot of former trump administration officials testifying under oath as to his potential wrongdoing. but i wonder, given the multitude of investigations, is there one that they are particularly worried about? lawyers will say it's the georgia one that has the most potential for criminal charges. is that the one that trump world is most nervous about? >> reporter: yes. yes. now, let's just say, politically speaking, the former president and the people around him are going to do what they have always done, which is to say it's a witch-hunt, there are people who don't like me, they're trying to take me down and use the court system to do it. having said that, jim, i believe in talking to people in and around the trump circle that georgia is, of all the things that have happened this week, the most worrisome because it is a criminal probe. now, the grand jury that was impaneled is fact-finding. they don't -- i don't believe they can actually indict him or anyone. but it is a first step and it is the kind of step we haven't seen before. it's perhaps the most significant that we have seen thus far when it comes to this. as he possibly can. this reporting, i encourage everyone to look at it from michael warren and melanie zanona, is really, really great. because it is explaining what those of us here in washington are hearing, i'm certainly hearing multiple times a day, which is an open question, m murmuring rumors, not just rumors but discussion i'm having with republicans who will have a vote about whether or not mccarthy is a shoo-in if republicans take control. and the fact that there are clearly, based on this reporting, so many of his members who are actively, outwardly threatening to withhold their vote if he doesn't act their way, it's just one of the many tricky dynamics that he is facing and that republicans are facing, because if not mccarthy, then who? and that is that cases are starting to go down? >> yes. i think we are starting to see that. i think it's still going to be a rough few weeks. even if you look last year when we didn't have much way of population immunity from vaccination or natural effects, you saw a decline in hospitalizations and death base mid-february. i would expect we'd see that this year, but it will involve different areas of the country at different times and depend on the percentage. >> what are you seeing in terms of how hospitals are handling the surge in patients right now? we have been covering the fact that many doctors and nurses have been calling out sick, and there have been a lot of concerns about the hospitals being short staffed and inundated with patients. where is that standing right now? >> with philadelphia, things are getting better. the number of cases are clearly coming down in our hospital in the percentage of children who were admitted to the hospital for whatever reason who were covid positive is clearly coming down. i think the problem with omicron is that it's slightly off target for vaccine-induced immunity in terms of protection against mild disease. so even if you've been vaccinated, vaccinated and boosted, you can still possibly get a mild infection, which means at least in our hospital that you're not going to be coming in until you're asymptomatic and then, you know, and only then can you come in. it's ban hit on the hospitals. plus, after two years of this, i can tell you the hospital staff is a little demoralized at this point. not all the patients we take care of in the icu are unvaccinated, which is really frust frustrating. >> unfortunately, the only community and part of the community that is unvaccinated through no fault of their own are those you deal with on a daily basis, and that's young children, 5 and under. we did get some promising news this week that perhaps, perhaps we could start seeing them vaccinated within the next month. how optimistic are you that that could play out? just ask your asthma specialist about dupixent. lisa here, has had many jobs. and all that experience has led her to a job that feels like home. with home instead, you too can become a caregiver to older adults. apply today. i didn't know my genetic report could tell me i was prone to harmful blood clots. i travel a ton, so this info was kind of life changing. maybe even lifesaving. ♪do you know what the future holds?♪ right now a georgia judge is considering what evidence will be allowed at a federal hate crimes trial for the three white men sentenced to life in prison for the murder of 25-year-old ah aahmaud arbery. the lawyers for travis mcmichael and roddy bryant are back in court. >> bryant's lawyers filed a lawsuit to keep his alleged hostile i to black people out and that includes text messages and a disapproval of his daughter dating an african american man. we're joined by criminal defense attorney sara azari. i think folks have forgotten there's now this federal trial coming up here. tell us the impact of this particular evidence on those federal charges. >> good to be with you, jim. yeah. this is a critical motion because it's going to determine essentially whether the prosecution can prove its case. you know, the georgia trial barely touched on the issue of race, and the federal trial is all about race. so, you know, hate is the centerpiece of the prosecution's case. so the idea that, you know, absent a confession, hey, i called arbery because of the color of his skin or our ability to crack open their heads to see what they're thinking, their attitudes, their racist beliefs, this is exactly the type of evidence that it takes for the prosecution to prove racial motive here. so if this motion gets granted, the prosecution is going to have a very difficult time proving its case. if it's denied, as it should be, because this information is relevant, then they'll be able to more readily prove their case. the court is going to assess the relevance, obviously it's highly relevant, and then it's going to balance the prejudice against the probative value. so, you know, this is bryant's motion, essentially. bryant is arguing, hey, you know, i'm not affiliated with, you know, an organization that's anti-black. i've never expressed a harming a black man or a desire to harm a black man. you don't need that sort of narrow view. it just takes relevance, and you don't need these sort of formal affiliations to be able to get that evidence in. >> sara, from a principle and from a moral standpoint, this case is clearly justifiable, right, for the nation to see. but given that these three men already face life in prison, legally, what is the significance of it? >> yeah, so the significance varies, right. the mcmichaels have already been sentenced to life in prison, and depending on who you ask, we only have one life, so for them it's not going to have a big impact if they're found guilty. but for bryant, bryant was eligible for parole, you know, life with the possibility of parole. there is no parole on the federal side. so if he's found guilty, he's got a life sentence that perhaps he wouldn't otherwise have in georgia with potential parole early. >> proving hate crimes, right, different standard. tell us what that standard is and do you see the evidence here to meet it? (excited yell) woo-hoo! ensure max protein. with thirty grams of protein, one gram of sugar, and nutrients to support immune health. a new cnn investigative report on a series of fatal highway shootings in new orleans over three days. a 34-year-old woman was killed in the most recent incident. police are not saying whether these are random or targeted. >> it's just so frightening. records from 2021 show about 20 interstate shootings took place in the city. nick valencia reports on an epidemic of gunfire on new orleans highways. >> reporter: new orleans on alert as the city has been experiencing a steady uptick in highway shootings. 34-year-old whitney watts was fatally shot in louisiana on wednesday while driving down i-10 in new orleans according to police and family members. one of her children was in the car when the shooting occurred. police say watts was pronounced dead at the scene. her family is devastated. >> i'm going with her daughter and my son's daughter. i get a call on the phone saying my daughter is dead, my daughter got shot. you don't bury your children. >> reporter: last weekend another shooting happened on interstate 10, this time killing a 52-year-old man and injuring a 45-year-old woman according to politician. police were investigating a nearby incident when they heard gunshots just after 3:00 a.m. on sunday. responding officers found the two victims in the car. a new orleans police department is asking the public to come forward with any and all information. no suspects or motives have been identified in either shooting. since january 2021, there have been over 30 interstate shootings in louisiana according to the new orleans police department. interstate highway shootings have been on a steady incline in new orleans since 2019, and they come with some distinct challenges for law enforcement. >> by the time somebody calls 911, it goes through a dispatcher. that dispatcher then goes to the police. the police get the call, get up on the expressway, and look for that, that vehicle is gone. >> reporter: like many cities nationwide, new orleans is seeing an uptick in homicides. carjackings are up 200% year to date and homicide incidents involving firearms are up 150%. >> what are we going to do yesterday to come up with a plan to attack this violent crime so that no one who's hurting, robbing, raping, carjacking ever falls through the cracks again? >> reporter: the spate of highway shootings in new orleans represents just a small percentage of overall gun violence, but as you saw in that report, it's on an uptick at an alarming pace. police have not released any details, motives, or any details whether or not this individual and this shooting was targeted or perhaps a random attack. but in a recent interview with "the times" picayune, investigators say that a majority of these shootings are chance encounters between random mote russell wilsons that eventually lead to road rage. >> nick valencia, thanks so much. thanks for joining us today. it's friday. i'm jim sciutto. >> i'm bianna golodryga. have a good weekend, everyone. be a devastating war between russia and ukraine. following this morning's critical meeting with his russian counterpart, blinken promised a severe and united response by the west if russia invades. >> this was not negotiation but a candid exchange of concerns and ideas. i made clear to mr. lavrov there are certain issues and fundamental principles that the united states and our partners and allies are committed to defend. that includes those that would impede the sovereign right of the ukrainian people to write their own future. there is no trade space there. none. >> basically saying the u.s. is not going to rule out nato membership for ukraine. blinken standing firm. both sides did signal after today's talks there could be at least more diplomatic discussions ahead. we'll see where those go. nic robertson joins us from moscow. but first fred pleitgen in geneva where the talks took place. expectations were low and managed going into this. do the sides consider these talks successful? >> reporter: well, jim, i'm not sure they necessarily consider them successful. i'm not sure the russians consider them to be system. but i think they consider them to possibly be a launching pad to wilder negotiations that could happen along the way and possibly even bigger negotiations between president biden and president putin, possibly in the future as well. but as the secretary of state was saying in that sound bite you played, he didn't call them negotiations. he said they were an exchange of ideas. i think that's less than the russians wanted. they had been saying for days they wanted written responses to some of those concerns and demands they had put forward during the last round of talks in the geneva. they obviously didn't get those. they will get those in search form at least next week. i was able to ask the russian foreign minister sergey lavrov in a press conference whether the russians felt any sort of heldway had been made, but the russians were disappointed the way the meeting went down. listen to what he had to say. >> antony blinken repeated his position on the right to choose alliances. i asked how america is going to fulfill its obligation, which was approved at the highest level in the framework of the osce along with the right to choose alliances, the obligation does not strengthen anyone's security at the expense of infringing on the security of others. >> reporter: as you can see there, the russian foreign minister sergey lavrov saying there will continuously be talks, this is not the end of the dialogue. we under anthony blink season about to depart here from geneva in what has been a beautiful but cold day, about to head back to the u.s. after these very important talks that the russians won't be completely satisfied with but certainly does seem as though there will be another round, other rounds of talks ahead, which, of course, is preferable for the united states, its allies and especially the ukrainians to alternatives that could have been in play with those russians continuing to amass their forces near ukraine. as we learned today, jim, also now having placed anti-aircraft system in belarus. >> we saw antony blinken board his u.s. state department plane for his departure from geneva following those talks. >> it's interesting. as this was playing out, ukrainian president zelensky gave an interview to "the washington post" reiterating he thinks the sanctions the u.s. is threatening if russia invades how would go into effect now to deter russia if invading. but i want to turn to nic now, because russia has said that they're going to be waiting for the u.s. to share its concerns in written form next week, even lavrov suggesting they would make that public. how significant is that response, and could that lead to further talks or perhaps the end of talks if they don't like what they see? >> reporter: yeah. there certainly is an opportunity here for the diplomatic process to continue, but it does seem to be contingent on whether the russians are happy with what they hear or see written down. the russians have been pushing and pushing and pushing for about a month to get the united states to give a written response to what they put on the table in mid-december, this -- you know, their security concerns. they know the answer. this is the problem. they know the answer they're going to get. secretary blinken made it very, very clear on russia's demand that ukraine can't join nato. that's off the table. so the russians know this. so the clock is ticking. the clock is ticking. the question is really is president putin trying to run down the clock as he maneuvers more forces into position, big military exercises coming up in belarus that will put another 100,000 belarus and russian forces closer to the capital of ukraine? is that what this is about, or is there a path to diplomacy? there was a hint in that to what sergey lavrov responded to fred's question that, you know, one nation's security can't binge on neighboring nations' security, sort of an osc fundamental that the united states and russia are both members of and lavp rov pointing out that the u.s. signed up to that. you know, i think when you look at that, is lavrov there saying that we're willing to settle for arms control agreement and reciprocal forced positions across the border which the u.s. says that's something we can discuss? it just seems so unlikely at this stage. it seems very hard to know how much longer the kremlin can continue to play this out when they're not really getting the answers that they want. >> and through all this, we should remember that eight years ago russia already invaded ukraine, remains in ukrainian territory, crimea as well as in eastern ukraine. they've done this before. john roberts, fred pleitgen, thank very much to both of you. joining me to discuss this and other issues is the british ambassador to the united states, dame karen pierce. thanks for taking the time this morning. >> thanks very much for inviting me. >> despite these talks this morning, i hear from speaking to u.s. officials a fair amount of pessimism about russian intentions. and i wonder what the uk view is this morning. does the uk believe russia will invade ukraine? >> it's not that we believe russia definitely will invade. it's the risk that she does is extremely high. i'm a firm believer in capabilities, not intentions. as your report said, the russians have forces in belarus, force on ukraine's eastern border. there's the crimea example. if we go back to 2008, there's a georgia example of russian intervention. and the russians are not de-escalating. so i think to be honest that president putin, russia has a number of octobbjectives, they' run them in parallel. they typically have a range of scenarios and push one or the other depending on circumstances. but we have got to be ready for a russian intervention, a russian invasion, and as the secretary said today we really urge president putin to step back. >> as you note tlushgs all this, all these talks, those russian forces have not moved. in fact, in cnn's reporting and others, russia has added forces in recent weeks. what has diplomacy achieved so far? >> well, diplomacy is keeping going. i don't want to overstate that, but i do think it's important that the talks continue and that secretary blinken was able to meet mr. lavrov today in geneva. we need more of that. we need more nato/russia talks. but fundamentally, the european allies and america are very close together on this. and we do urge the russians to use the existing agreements on european security. there are lots of agreements. they go back to 1975 and the helsinki final act. >> as you know, when president biden spoke on wednesday, and the white house has later clarified, walked back these comments, he did reference potential disunity among nato allies if russia does not carry out a full invasion but something short of that. he described that as minor incursion, though, as i said, the white house is trying to clarify. i do wonder, though, was the president revealing there that there is some disagreement among nato allies as to what to do in response short of a full invasion? is there disagreement? >> i haven't seen any disagreement. in my experience, when nato confronts securities like this, it typically looks at a range of options and a range of scenarios of what will happen in circumstance x or y and what are your options in those circumstances. i don't find it unusual ta the allies would want to face different scenarios and responses. i think the key thing is any incursion by russia will bring a very severe response. and we hope moscow knows that. >> you heard the ukrainian president say why not impose sanctions preemptively? why wait? by the way, russia has not responded to the threat so far as we've noted. the forces are still there. would it be smart to impose sanctions today as opposed to wait for any invasion? >> i think in general terms nato and the west were a defensive alliance. i really want to stress that. we tend to wait for things to happen and then respond to them. that's the way we do things. that's the democratic way. it's the defensive way. but i'm sure all options on sanctions remain on the table and our leaders are getting together very frequently to talk about the best response in various scenarios. >> in the midst of this crisis, there is a political crisis at home for the british prime minister, boris johnson, including within his own party. do you, as the uk senior representative here in the u.s., have confidence in johnson's leadership? >> well, i'm a civiler is vantd, a public servant. the answer is yes, of course, i support my government. i work for my government. i think you'll find the prime minister is absolutely focused on the russian/ukraine crisis. he's been making phone calls. he talked with germany this morning about ukraine. and he's also been leading the response on omicron. i'm pleased to say that the uk looks as if it's coming down to the pandemic and we've been able to relax our restrictions. so hopefully, that is a piece of good news and the prime minister is focused on those. >> the uk, i should note, for folks listening in the u.s., has also relaxed restrictions for international travellers to the uk. significant. before we go, i should note for folks that you were uk ambassador to afghanistan in years past. as you know, the u.s. and nato left behind tens of thousands of afghans who worked for the west through the years in the war against the taliban, and many of them faced grave threats today. i've spoke on the folks in that category. do you believe that nato owes those people, particularly those who served in the military in the fight against the taliban, owes them a safe exit from that country? >> reporter: no question. and you saw more and more as that criticism got louder and louder members of the committee strategically putting out whether in public in clear ways in letters or in other ways that they have gotten a lot of information voluntarily from members of the trump administration, people who were in and around meetings. we now know that keith kellogg, a top adviser to mike pence, we know he spoke to the committee, but we know he gave a lot more information than we realized. and there is a lot we don't know. but what is clear, if you combine the witness testimony and now what the committee is going to get and is already getting, the hundreds of pages of documents that the former president was so desperate to keep from the committee, they're going to have a much more fulsome picture. and we know that whether it's the democrats or the two republicans on the committee, they want to know the whole picture, not just about the fbi, not just about the actual insurrectionists but most importantly the president's role and the role of the people around him. it looks like they are more and more painting that picture. >> we already know what the trump world's response is and will be to january 6th the january 6th committee. they'll call it a partisan committee, though it's not. it has republicans on board, a lot of former trump administration officials testifying under oath as to his potential wrongdoing. but i wonder, given the multitude of investigations, is there one that they are particularly worried about? lawyers will say it's the georgia one that has the most potential for criminal charges. is that the one that trump world is most nervous about? >> reporter: yes. yes. now, let's just say, politically speaking, the former president and the people around him are going to do what they have always done, which is to say it's a witch-hunt, there are people who don't like me, they're trying to take me down and use the court system to do it. having said that, jim, i believe in talking to people in and around the trump circle that georgia is, of all the things that have happened this week, the most worrisome because it is a criminal probe. now, the grand jury that was impaneled is fact-finding. they don't -- i don't believe they can actually indict him or anyone. but it is a first step and it is the kind of step we haven't seen before. it's perhaps the most significant that we have seen thus far when it comes to this. as he possibly can. this reporting, i encourage everyone to look at it from michael warren and melanie zanona, is really, really great. because it is explaining what those of us here in washington are hearing, i'm certainly hearing multiple times a day, which is an open question, m murmuring rumors, not just rumors but discussion i'm having with republicans who will have a vote about whether or not mccarthy is a shoo-in if republicans take control. and the fact that there are clearly, based on this reporting, so many of his members who are actively, outwardly threatening to withhold their vote if he doesn't act their way, it's just one of the many tricky dynamics that he is facing and that republicans are facing, because if not mccarthy, then who? and that is that cases are starting to go down? >> yes. i think we are starting to see that. i think it's still going to be a rough few weeks. even if you look last year when we didn't have much way of population immunity from vaccination or natural effects, you saw a decline in hospitalizations and death base mid-february. i would expect we'd see that this year, but it will involve different areas of the country at different times and depend on the percentage. >> what are you seeing in terms of how hospitals are handling the surge in patients right now? we have been covering the fact that many doctors and nurses have been calling out sick, and there have been a lot of concerns about the hospitals being short staffed and inundated with patients. where is that standing right now? >> with philadelphia, things are getting better. the number of cases are clearly coming down in our hospital in the percentage of children who were admitted to the hospital for whatever reason who were covid positive is clearly coming down. i think the problem with omicron is that it's slightly off target for vaccine-induced immunity in terms of protection against mild disease. so even if you've been vaccinated, vaccinated and boosted, you can still possibly get a mild infection, which means at least in our hospital that you're not going to be coming in until you're asymptomatic and then, you know, and only then can you come in. it's ban hit on the hospitals. plus, after two years of this, i can tell you the hospital staff is a little demoralized at this point. not all the patients we take care of in the icu are unvaccinated, which is really frust frustrating. >> unfortunately, the only community and part of the community that is unvaccinated through no fault of their own are those you deal with on a daily basis, and that's young children, 5 and under. we did get some promising news this week that perhaps, perhaps we could start seeing them vaccinated within the next month. how optimistic are you that that could play out? just ask your asthma specialist about dupixent. lisa here, has had many jobs. and all that experience has led her to a job that feels like home. with home instead, you too can become a caregiver to older adults. apply today. i didn't know my genetic report could tell me i was prone to harmful blood clots. i travel a ton, so this info was kind of life changing. maybe even lifesaving. ♪do you know what the future holds?♪ right now a georgia judge is considering what evidence will be allowed at a federal hate crimes trial for the three white men sentenced to life in prison for the murder of 25-year-old ah aahmaud arbery. the lawyers for travis mcmichael and roddy bryant are back in court. >> bryant's lawyers filed a lawsuit to keep his alleged hostile i to black people out and that includes text messages and a disapproval of his daughter dating an african american man. we're joined by criminal defense attorney sara azari. i think folks have forgotten there's now this federal trial coming up here. tell us the impact of this particular evidence on those federal charges. >> good to be with you, jim. yeah. this is a critical motion because it's going to determine essentially whether the prosecution can prove its case. you know, the georgia trial barely touched on the issue of race, and the federal trial is all about race. so, you know, hate is the centerpiece of the prosecution's case. so the idea that, you know, absent a confession, hey, i called arbery because of the color of his skin or our ability to crack open their heads to see what they're thinking, their attitudes, their racist beliefs, this is exactly the type of evidence that it takes for the prosecution to prove racial motive here. so if this motion gets granted, the prosecution is going to have a very difficult time proving its case. if it's denied, as it should be, because this information is relevant, then they'll be able to more readily prove their case. the court is going to assess the relevance, obviously it's highly relevant, and then it's going to balance the prejudice against the probative value. so, you know, this is bryant's motion, essentially. bryant is arguing, hey, you know, i'm not affiliated with, you know, an organization that's anti-black. i've never expressed a harming a black man or a desire to harm a black man. you don't need that sort of narrow view. it just takes relevance, and you don't need these sort of formal affiliations to be able to get that evidence in. >> sara, from a principle and from a moral standpoint, this case is clearly justifiable, right, for the nation to see. but given that these three men already face life in prison, legally, what is the significance of it? >> yeah, so the significance varies, right. the mcmichaels have already been sentenced to life in prison, and depending on who you ask, we only have one life, so for them it's not going to have a big impact if they're found guilty. but for bryant, bryant was eligible for parole, you know, life with the possibility of parole. there is no parole on the federal side. so if he's found guilty, he's got a life sentence that perhaps he wouldn't otherwise have in georgia with potential parole early. >> proving hate crimes, right, different standard. tell us what that standard is and do you see the evidence here to meet it? (excited yell) woo-hoo! ensure max protein. with thirty grams of protein, one gram of sugar, and nutrients to support immune health. a new cnn investigative report on a series of fatal highway shootings in new orleans over three days. a 34-year-old woman was killed in the most recent incident. police are not saying whether these are random or targeted. >> it's just so frightening. records from 2021 show about 20 interstate shootings took place in the city. nick valencia reports on an epidemic of gunfire on new orleans highways. >> reporter: new orleans on alert as the city has been experiencing a steady uptick in highway shootings. 34-year-old whitney watts was fatally shot in louisiana on wednesday while driving down i-10 in new orleans according to police and family members. one of her children was in the car when the shooting occurred. police say watts was pronounced dead at the scene. her family is devastated. >> i'm going with her daughter and my son's daughter. i get a call on the phone saying my daughter is dead, my daughter got shot. you don't bury your children. >> reporter: last weekend another shooting happened on interstate 10, this time killing a 52-year-old man and injuring a 45-year-old woman according to politician. police were investigating a nearby incident when they heard gunshots just after 3:00 a.m. on sunday. responding officers found the two victims in the car. a new orleans police department is asking the public to come forward with any and all information. no suspects or motives have been identified in either shooting. since january 2021, there have been over 30 interstate shootings in louisiana according to the new orleans police department. interstate highway shootings have been on a steady incline in new orleans since 2019, and they come with some distinct challenges for law enforcement. >> by the time somebody calls 911, it goes through a dispatcher. that dispatcher then goes to the police. the police get the call, get up on the expressway, and look for that, that vehicle is gone. >> reporter: like many cities nationwide, new orleans is seeing an uptick in homicides. carjackings are up 200% year to date and homicide incidents involving firearms are up 150%. >> what are we going to do yesterday to come up with a plan to attack this violent crime so that no one who's hurting, robbing, raping, carjacking ever falls through the cracks again? >> reporter: the spate of highway shootings in new orleans represents just a small percentage of overall gun violence, but as you saw in that report, it's on an uptick at an alarming pace. police have not released any details, motives, or any details whether or not this individual and this shooting was targeted or perhaps a random attack. but in a recent interview with "the times" picayune, investigators say that a majority of these shootings are chance encounters between random mote russell wilsons that eventually lead to road rage. >> nick valencia, thanks so much. thanks for joining us today. it's friday. i'm jim sciutto. >> i'm bianna golodryga. have a good weekend, everyone.
