here in the united states and all around the world. it is wednesday, january 19th. i'm john berman. brianna is living the night life this week, and kasie hunt is here. >> it's great to have you here. >> look at all the beautiful buildings behind us. >> it's a beautiful morning. >> we have breaking news from overnight. major development and new details in the civil investigation of the trump organization. in a court filing, new york attorney general letitia james uncovered significance evidence, those are her words, of misleading and fraudulent practices to obtain economic benefits. this is a big escalation in her language. and the first time she has gone this deeply into specifics. >> the case also turning up the heat on trump's children. james said have been closely involved with the transactions in question. investigators now taking legal action to compel ivanka and don jr. to supply with subpoenas and appear for sworn testimony about the company's financial dealings. kara scannell has the latest breaking details from new york. >> reporter: new details emerging overnight in the new york attorney general letitia james' effort to compel the testimony of donald trump, don jr. and ivanka. the attorney general alleging there is significant evidence of misstatements and omissions in these financial statements. the statements were provided to lenders and to insurers. as part of this, they say the statements have covered kind of the gamut across a number of properties, including golf courses in scotland and los angeles, including trump tower, the president's own penthouse, invo involving seven springs. they are trying to understand what role he played because his name is on these statements. a number of them as we previously discussed, say he came up with the valuations. they write, mr. trump's actual knowledge of and intention to make the numerous miss tatateme are essential components to resolving the oag's investigation in an appropriate and just manner. likewise, donald trump jr. and ivanka trump worked as agents of mr. trump, acted on their own behalves, and supervised others in connection with the transactions at issue here. their testimony is necessary for appropriate resolution of oag's investigation as well. donald trump jr. was involved in one of these commercial buildings under scrutiny. he also took over the company after donald trump became president, along with brother eric trump. whether they will cooperate and testify remains to be seen. that will go to the judge who will decide this. what we did learn from the filing, when eric trump went in for testimony and the chief financial officer, they both asserted the fifth amendment and did not answer more than 500 questions each, according to the new york attorney general. kasie, john. >> kara scannell, thanks very much for that. >> contributing columnist and i should note one-time trump tower property owner, george conway. thank you for being with us. this is the furtherest letitia james has gone, saying she has significant evidence of misleading statements and documents. what do you see as the significance here? >> well, i think the significance she's willing to go out and say this, as you pointed out, is something. you don't go out and make these statements unless you have something to back it. that's one level. on another level, it is not that surprising. this investigation has been going on a long time. the district attorney's office and state attorney general both together have been investing a great deal offest. lots of personnel, lots of investigators, lots of talking to witnesses that have seeped out to the press over time. and hiring very expensive expert accounting witnesses, potential witnesses or potential experts for trial or at least to understand the documents. they have been at this for a while. it's hard to imagine that there isn't something serious to look at there. and there's been public reporting that's talked about the question whether or not the trump organization and individuals at the trump organization were essentially keeping two sets of books. one for purposes of persuading lenders to lend money. that's where you want to say, oh, these properties are worth so much money, so much money. and then for tax purposes, you may not want to say the buildings, the properties are worth as much money. so basically you're telling the truth to somebody, or not. you may be telling the truth to one person or not, or lying to both. it's a serious question. why report two different values for the same property? that's the question that i think the trump organization and trump, the question is, is there evidence in the documents, is there evidence that some of the witnesses can provide, the ones who aren't taking the fifth, as to why are there two sets of numbers for things. and that seems to be the scope of the investigation. and it seems to be, you know, if these charges were easily dismissed they would have gone away long before now. >> so, george, let's talk a little bit about the political context of this. we have the former president down at mar-a-lago with a circle of advisers. they are potential talking about what his role is going to be in 2022 but also what he is going to do in 2024. i guess my question for you, how much head space is this investigation taking up in the former president's head? how much is he focused on it? how much does that distract from his political ambitions? and how much of a problem does he think this probe is? >> i would not dare try to get inside too much of the mind of donald trump. okay. that's a scary place to be. but it has to be taking some head space, obviously. these are -- you know, he's got several groups of prosecutors that are looking at his conduct. he's got two sets of prosecutors in new york, as we've just discussed. he has a potential grand jury investigation in georgia that's been ginning up for a while because he asked for a specific number of votes for the secretary of state there. and you've got the january 6th committee and possibly a department of justice investigation into what happened between november 3rd and january 6th. i mean, all of these things probably increase the level of paranoia and persecution that he naturally feels as someone who tends -- who has the personality that he has. and it's got to be distracting to some extent. at the same time, he may feel that may be the thing that motivates him into running because he may feel the best protection against criminal charges and being held responsible for his possible conduct would be to be president and therefore immune from prosecution again. >> george, stick around. because this is a perfect segue into the other major news from overnight. so the civil action in new york just part of this. the other major development has to do with the january 6th investigation. the house select committee issued a subpoena to former trump lawyer rudy giuliani, a central figure in the failed bid to overturn the 2020 election to other lawyers who pushed lies for the former president, jenna ellis, sidney powell, along with boris epshteyn who worked with giuliani at the willard hotel. >> in a cnn exclusive, we are learning the committee subpoenaed and obtained phone records of eric trump and kimberly guilfoyle. >> leaders and fighters for freedom and liberty and the american dream, the best is yet to come! >> so i guess she did warn us. evan perez is in washington with this top story. evan. >> reporter: yeah, kasie, look, i think this committee has a lot more to come. and this is only the beginning of what we think we're trying to get to the bottom of, which is trying to understand what eric trump, what kimberly guilfoyle and others in the trump family knew about those plans to overturn the election results. and what the committee has done, has obtained the call logs belonging to the phones of eric trump and kimberly guilfoyle. he spoke at the rally before the riot. and we know that kimberly was a fund-raiser for some of those stop the steal activities that preceded all of that and then what happened january 6th. so you can see the number of people now that these were significant names. in addition to eric trump and kimberly guilfoyle, you have sidney powell, jenna ellis, some of the lawyers pushing the lie that there was fraud in all these states. and of course boris epshteyn who was reportedly inside the willard hotel war room. again, all of these people now being asked for testimony. the three lawyers and boris epshteyn being asked to provide testimony. we know they have obtained their phone records. we have already seen a lot of activity from this. >> thank you very much for that. george conway is back with us. george, i want to start with the phone records for eric trump and kimberly guilfoyle. what could turn up on the phone records that could be damaging? >> i think -- my guess would be, and this is not based on any specific knowledge but based on the subject matters that the committee is looking into and where these people were positioned, they will look at two things. one, they will look at the planning and organization for all the things that led up to january 6th. what involvement did people around trump have in the organization of january 6th, what context did they have with the people who were running the so-called willard hotel such as giuliani and others. and the question also is what happened on january 6th when, you know, the things started to go awry on capitol hill. what was donald trump doing? and that is all extremely important because it goes to donald trump's state of mind. i mean, his defense is going to be i didn't incite these rioters and these insurrectionists. i told them to go up there peacefully, although i did tell them to go up there. well, if that was really -- he used a lot of inflammatory language at the same time. if his intent was really innocent, well, why didn't he immediately go out on the front lawn in front of the cameras at 2:30 or 3:00 and say, everybody stop it, go home. family members, chief of staff had to keep bringing down ivanka trump to say, please, say something, is say something. people rp calling the white house left and right. why was he just sitting there? and stephanie grisham said he was watching gleefully. people were fighting for him. that goes into his state of mind and what he intended. and it goes to his state of mind generally, which is critically important when it comes to potential charges on the question of whether he and others conspired to and did try to obstruct the proceedings january 6th. a lot of insurrections have been charged with violations which prohibits the corrupt attempts to interfere with or impede an official proceeding. it defines an official proceeding to include proceedings of congress. and the courts here in the district of columbia includes the all-important joint session of congress to count electoral votes. it's just plain language. okay. did he try to impede and obstruct the january 6th counting of votes? he certainly did. he did it in a number of ways. he lied his ass off, excuse the language. . >> very early for that, george. . >> i'm sorry. i didn't even have my coffee. he lied his derriere off for two months. he tried to persuade his vice president into saying that -- into refusing to count the electoral votes saying wouldn't you like to have that to stop that and basically so the two of them could install themselves in office undemocratically. he was talking to these lawyers such as john eastman whether pence could stop the count and refuse to count votes. they were doing that on the basis of fake certificates. what involvement did trump and others have? the question is did they try to impede january 6th? they did. and the question becomes, sphaufpl, did they do so corruptly? well, lying is corrupt. submitting false certificates is corrupt. encouraging somebody like the vice president and trying on bludgeon them into failing to conduct their legal duties properly seems corrupt to me. trying to coerce the justice department into announcing, you know, a fake investigation and drawing fake conclusions about the pro bright of the elections. just say this, just go out and say this. you don't have to go and bring a lawsuit or do anything. trump basically said leave it to us. a purely political and fraudulent act because there wasn't anything he was threatening to do. he was threatening to fire people. >> yeah. >> and the thing about it is maybe, maybe at the end of the day there wouldn't be enough to prove before a jury in the district of columbia beyond a reasonable doubt that trump had criminal intent. that's possible. but when you look at all these things, they didn't all happen by accident. they were all designed to benefit one person. if there's one thing we expect the president of the united states to do and require him to do is adhere to his oath of office. a critical element of the constitution of the united states involves the peaceful transfer of power. he used to talk about how he would shoot someone on fifth avenue and nobody would care, he is trying to shoot the constitution here. if the justice department does not look into this, it would be a great travesty. . >> i remember sitting inside the capitol complex and wondering about all these things, who was talking to the president, what were they saying, was he going to come out and call the people off who were invading the building. in looking at these subpoenas and what we have learned this morning, it seems they are circling in. we don't see a subpoena for mark meadows. nothing yet for for stephanie grisham. when you conduct an investigation like this, do you get the sense they're working from the outside in as they try to build the cases you say should be brought? >> well, yes. the january 6th committee and the justice department, that's the classic way you investigate a lot of things that involve possibly giant, very large criminal conspiracies. you kind of start at the bottom. we understand you are just a pawn. that is one of the words a federal judge used in sentencing. they want to have the pawns point fingers at the bishops, knights, all the way up to the king and queen. that's how they work their way in. that does seem to be what the january 6th committee has been doing. you really don't have the same level of ability to see into a grand jury proceeding. there was a report in the "washington post" over the weekend late in the story points out that some of the insurrectionists's lawyers, proud boys or oath keepers lawyers are saying their clients, to the extent they're cooperating with the department are being asked about rudy giuliani's involvement, roger stone's involvement and their activities and conversations with them. that is one step away from president trump. . >> indeed, it is. george conway, stick around for us. we want to keep talking to you about what we have coming up next. florida governor ron desantis once a special police agency to monitor elections. why it is sparking concerns of voter intimidation. secretary of state antony blinken in ukraine a mid fears. the post office under pressure to deliver 5 million free at-home covid tests. is this going to delay your valentine's? ago with president zelensky to reinforce the united states's commitment as tensions with russia continue to build. the meeting comes as sources tell cnn the u.s. government is considering additional military support for ukraine. joining us now, former european affairs director for the national security council, alexander vindman. thank you for being with us this morning. we really appreciate it. i think what we're wondering here this morning is simply is, is there anything left for the united states to do here that will actually deter this potential russian invasion? i know you tweeted that should be the goal. or are we at the point where it is essentially inevitable? >> i think we're at the tipping point. it is probably, in my view, inevitable, that the russians will conduct their offensive. this will be the largest offensive in europe since world war ii. cruise missiles, air power, all sorts of weapons to destroy ukraine's will to resist, the ukrainian armed forces, more importantly, to destroy their will to exist as a sovereign independent state. there are still things that can be done. this bout of diplomatic engagement is going to include germany. probably the linchpin in the european alliance. he's now in ukraine talking to the ukrainians i'm sure with a keen eye to providing maybe additional support including weapons that could affect them. and they will talk to lavrov saying this is not just about diplomacy. we will support ukraine. maybe all that together, and this bill is circulate through the senate which is very broad ranging by senator menendez, as a package, might still have some effects. we're at the tipping point. >> colonel, at this point, do you see the russians actually making this decision in a way that ultimately will break the spine of nato the way vladimir putin has talked about, or do you think the threat is not quite that great in the event of an actual invasion? >> it is very, very significant. i think his primary objective is to achieve what he had wished to do in 2014 when he first attacked the ukrainians with military force, which is break the back of the ukrainians and their will to resist, fold them back into the russian sphere of influence. but there is an equally important objective on the geopolitical landscape and has to do with exploiting the seams between the u.s. and the europeans, how far they're willing to go with regard to sanctions and support but also internally. there's an east-west divide between the eastern flank of nato subject to soviet power for much of the 20th century and western europe which think they still need to preserve their economic relationships skpr ties. those are the things that will have seismic effects on the geopolitical landscape. everything needs to be done to avoid this. we're at the tipping point. it should be a full-court press on the pressure track. the pressure track includes weapons that probably won't be militarily deterministic but will start to affect the calculus. very potent, powerful sanctions. this bill that signals u.s. support, bipartisan support from democrats and republicans led by the executive branch and president biden, all that brought to bear might still have an effect on putin's calculus. but we should remember that we have over 100,000 troops on ukraine's border. the last really elements to support a full-scale military offense are going into place to add weight to a northern vector of attack that goes to the capital of eye cukraine, kiev, buildup of the black sea fleet at the port of odessa. the last bits and pieces are coming together for an attack in days. i would expect this to unfold in the middle to late part of february. . >> dire prediction there. lieutenant colonel alexander vindman, we really appreciate >> reporter: well, kasie, there are a lot of moving pieces to get this done. this is one of 43 usps facilities that will be spwrs where they will be working on this program, bringing in temporary workers who will put the test kits together and get them shipped out. as you mentioned this morning, usps, the postal service, they're already dealing with staffing issues, serious issues, because of this surge. and now they are facing growing pressure as well as the biden administration, to deliver. this morning, the new government website covidtest.gov is up and running with just a name and address, families can request four free at-home rapid antigen tests to be delivered to their home. the biden administration faces growing pressure to fixing the shortage. the white house says they have tens of millions of tests ready to go and are spending $4 billion to deliver the first 500 million, passing pressure to the postal service to quickly deliver. the postmaster general saying they are well prepared to accept and deliver test kits on the first day the program launches. but right now the u.s. postal service is facing some problems with communities in several states dealing with mail delays because of omicron. >> it is mostly bulk mail. >> reporter: derrick reynolds just got mail delivered to his home for the first time in three weeks. >> it is weird to have things you know are coming and you don't know when they are going to arrive. >> reporter: as of tuesday, 19,000 postal workers were either sick or quarantining. just shy of the agency's pandemic high and more than twice as many as just two weeks ago. . >> there are households where there has been no mail delivered for days. >> reporter: eleanor holmes norton sent a letter to the postal service about the delays in d.c. >>? if we can't get the mail, how are we going to get a covid test? >> reporter: the postal service is ramping up operations, setting up 43 centers where they will pack and ship the tests and hiring more than 7,000 temporary workers. many of them still staffed from the holidays. usps said their mitigation plans continue to play well during omicron, adding 90% of first-class mail was delivered on time in the first week of january. >> well get those test kits where they belong, providing the test kits get to the post office. >> reporter: don't expect overnight delivery. the white house predicts most will ship in 7 to 12 days and not until late january. the tests should be used in three situations. if you have symptoms, five days after exposure, or before gathering indoors with high-risk people. >> order the tests before you need them. if they wait until they have an issue, by the time the tests arrive, the optimal time for testing may well have passed. >> reporter: dr. william schaasc schaafer in authority on immunization practices. >> you will have to find testing resources elsewhere. >> reporter: casey, what's not clear is whether or not the postal service is adding more mail carriers to deliver these tests given the staffing issues they faced. two of the postal unions tell me their understanding is they will not be adding any mail carriers. it will fall on those already on staff. we haven't gotten much in the way of logistics from usps other than the postal service telling us they are confident they can get this done. kasie?
