children, ivanka trump and donald trump jr. and the insurrection one year later. the committee investigating the riot knows what donald trump was doing during the siege this week as washington plans tributes and ceremonies, trump plans to counter are a program with more lies from mar-a-lago. we begin with major covid news. the fda this morning authorizing pfizer vaccine booster shots for 12 to 15-year-olds, and it chopped a month off the time line to get your booster from six months to five months after your last shot. the hope is to stem this, a stunning code of, the u.s. averaging 400,000 infections a day and more than 1,300 deaths a day. hospitalizations overall are not rising as fast as cases, though pediatric hospitalizations are surging. let's get straight to cnn's elizabeth cohen who is with us now to walk through what the fda is doing, elizabeth, and why. >> john, let's take a look because this is so important. the parents of children this age, they started getting calksnated back in may, john, so for many of them, those -- those two vaccines may have waned because we've seen that vaccines do wane than having a booster is really important when we're trying to fight omicron, so let's take a look at what the fda said today. they said that if a 12 to 15-year-old is pat least five months past their second shot, they can get a booster. five month, not six like they were saying before. that means about 5 million 5 to 12-year-olds would be eligible now to get a booster shot. the fda say they were relying on real world data from israel. israel has been giving boosters to children this age for months now and when they look at data from around 6,300 children this age, they can see that this booster is safe. john? >> elizabeth, we're also waiting. dr. fauci hintd over the weekend there would be an update from the cdc perhaps adding a testing element to the recently updated isolating guidelines. what do we know? >> that's right. he sort of hinted that that's a possibility. we mow that they are going to put out some sort of an update or something to kind of clarify what they said last week, what they said last week a lot of people took issue with it because you can get out of isolation without testing. let's take a look at what they put up last week. last week they said if you have covid but you're asymptomatic or your symptoms are getting better you need to go into isolation for five days starting after that positive test and then after that you need to wear a mask for five days and you don't need to take a test to get out of isolation. so we expect to hear about that test. also it will be interesting to see will they have different rules if you're vac nate or not vaccinated, if you're an essential worker or not. we're looking to see the clarified guidelines to see if they make the changes. john? >> stand by for those in the week ahead. thanks for kicking us off. the omicron surge causing disruption across american life as we open this first work and first school week of the new year. severe winter weather in parts of the country is an added complication. whether the issue is air travel or back to school. districts across the country now struggling to keep schools open and staffed. some large public school systems already make the call to start this new year virtually. >> cnn's athena jones is with us now and exploring this question, the omicron back-to-school question. >> schools in several states have decided to start remotely so they are being very cautious because of the people coming back from the holiday season that you see on the list. here in new york city though, mayor eric adams has repeatedly stressed how important it is to keep the schools here in new york city oh. you could call this one of his first big tests and one of his most pressing challenges. this is the -- the nation's largest school system. he argues there are so many drawbacks to children having to do remote learning. there are missed meals, children being exposed to an environment of crime. there are children who are housing insecure or in poorer communities who don't do nearly as well and are falling behind when it comes to remote learning and the mayor is also stressing that the transmission rate in schools last year was 1%, so they do have a plan. part that have plan is over the weekend and over the last few days they sent 1.5 million tests to every single school across the city. they are also going to have an incident command center that allows them to keep a real time tab on staffing issues. they say the school and mayor are prepared to deal with potential absent teeism due to covid, due to this omicron variant, and so they have a pool of substitute teachers waiting to stand by. they have anyone prepared to teach, they say can step in should it be necessary, and they also say that if there is a -- a -- a case in a school they are going to test every close contact, isolate positive cases but keep the rest of the young children there in schools and safely learnings burks still, it's going to be a real big challenge here. >> a real big challenge right in that city and mayors across the country. thank you. let's get some insight from the co-director-of-the-infectious disease center at the university of alabama birmingham. let's start with the fda and their decision to authorize booster shots for kids ages 12 to 15. why toss that matter? >> it's good news because it is, as elizabeth says, gives parents one more arrow in their quiver to be able to protect their children, in this case their young adolescents to middle age adolescents from the omicron variant that's really sweeping through the country right now. previously we had booster recommendations authorization for 16 and over, and now we have 12 through 15 as well and then maybe a third doze option for immunocompromiseded 5 through 11-year-olds. the next step with this is for the cdc's advisory committee, the acip, to get together later this week as has been report in the "new york times" to be able to look at the data and then determine what the actual recommendations that this authorization might allow for should be. >> a conversation that we've had since the beginning of covid. this is now going to be our third covid january is which data should we look at when you get all this data? amopgt data you look at, hospitalizations nationally, this is everybody nationally, children nationally, 17 or under, pediatric hospitalizations are now in excess -- you can seat number right there. it's higher than during the delta surge in. your state of alabama it's not quite. it's trending up. pediatric hospitalizations but still well below where it was in the delta surge. what do you make of those numbers? overall hospitalizations are not tracking this explosion in cases, but pediatric hospitalizations run. why? >> well, we'll know more in the next week or two. i hesitate to give too specific an teens that. i do think, john, your point is really well taken. from the very beginning, think back. in march 2020 everything was about flattening the curve. it was about decreasing the surge of cases that would lead to hospitalizations, and now fast forward almost two years, and we're really talking the same thing. i know that we seem to kind of be jumping around whatever the shiny object is in front of us in terms of where our conversations go, but the emphasis remains and needs to remain on what hospital capacity is in a given community, in a given state in, a given region of the country and really those are the important numbers. they also really have an important impact in terms of what we think about when we consider what we want our advantages opens and our boosters to do. if we want our boosters and vaccines to prevent every runny nose, we're not going to be successful with that. that's asking too much of any vaccine, but if we want the boosters and the vaccines to keep people out of the hospital and to keep them from dying, we really have very good news to consider, certainly better than a yore ago when we were just rolling out vaccines in the first place. >> that's a key point, especially when you look at averaging 400,000 cases, new infections a day and knocks you back on your heels. to your point with omicron so far the data tells us most of these cases are not as severe which is why this from the former fda commissioner scott got lieb over the weekend jumped out at me. listen to this, sir. >> it does appear now based on a lot of experimental evidence that we've gotten in the last two weeks that this is a mild form of the coronavirus. it appears to be more of an upper airway disease than a lower airway disease. good for most americans. the one group that that may be a problem for is very young children, toddlers, who have trouble with upper airway infections. >> this is your wheelhouse, proceedtic infectious diseases it, what does he mean by toddlers and the upper airway problem? >> well, anecdotally here in alabama we've been seeing as an example of this to what dr. gotlieb was getting at. we've been seeing younger children, you know, 1 and 2-year-olds coming in with croup, that barky cough and they are testing positive for covid so it's possible, possible that omicron, while staying in the upper part of the airway in an adult like you or me would cause a bad cold, and in a younger child it can still settle down to the upper part of the airway that's narrower because they are smaller, their necks are smaller and cause a condition such as croup or other conditions as well. not settling all the way down into lungs, that's good but still causing problems, and so one other thing i want to point out is that when case numbers, i emphasize the hospitalization numbers about. i'm going to shift back to the skyrocketing case numbers now. that's still actionable information because cdc has recommended for months now that when neuroan area with substantial or high transmission and that's based on cases per 100,000 people, that you should mask indoors, so use your case numbers to determine your behavior, masking indoors is an example. everybody should get vaccinated 5 and over, and now everybody 12 and over should get boosted. use -- use that information for that -- for that kind of aspect in terms of what to do next, but use your hospitalization numbers in terms of where your real anxiety should be for your local community. >> as always, but especially now, grateful for your time and insights. thank you. >> up next for us, the new york attorney general opens the year with a big move into the investigation of the former president. speech arksz for the trump children. olay body wash hydrates to improve skin 3x better, from dry and dull to firm and radiant. with olay body, i feel fearless in my skin. in a recent clinical study, patients using salonpas patch reported reductions in pain severity, using less or a lot less oral pain medicines. and improved quality of life. ask your doctor about salonpas. it's good medicine. it's your home. and there's no place like wayfair to make the morning chaos, organized chaos. however you make it, make your home a place like no other. ordinary tissues burn when theo blows. so puffs plus lotion rescued his nose. with up to 50% more lotion, puffs bring soothing relief. a nose in need deserves puffs indeed. america's #1 lotion tissue. this holiday is all about t-mobile. let's go to diane. new and existing customers can trade up to the new iphone 13 pro and t-mobile will pay for it. t-mobile is bringing it all together for the holidays. upgrade to the iphone 13 pro on us. plus get a free year of apple tv plus. only at t-mobile. important news breaking just last hour. the new york attorney general has issued pope isas for documents and testimony from two of the trump chirp, ivanka and donald trump jr. the speech arksz part of the new york investigation into former president donald trump's business practices. what's your understanding of what information prosecutors hope to get here? >> well, this investigation is focusing on the trump organization and the trump executives and how they valued certain property. that includes golf courses and condo buildings so what james office is seeking through the subpoena are documents and testimony from donald trump jr., one of the top executives, one person involved in a number of properties and ivanka trump who was also a senior executive at the company before she joined the white house when trump was president. this comes days after james' office had subpoenaed trump for his testimony and trump use lawyers said they were going to move to quash that pope isa and they are going to move to try to quash those speech arksz as well. eric trump, who is a top official at the company, had already provided testimony for james' civil investigation, but things have changed since then. that was back in october of 2020. since then james' office has joined the criminal investigation but the manhattan district attorney's office and they are looking at some of the very same issues and questions about valuations, and that's one of the reasons why trump's lawyers are looking to move to quash the subpoenas because it could affect the ongoing criminal investigation which is obviously much more serious. now trump has called this investigation a witch hunt. we have not heard yet from attorneys for donald trump jr. or ivanka trump, although the trump organization and donald trump have moved and filed a lawsuit against james saying that she is biassed in this investigation and hoping to get a judge to stop it. ultimately it will be up to a judge as to whether donald trump or either of his two children sit for a deposition and when. john? >> fascinating questions. we'll watch them play out in the courts. appreciate the breaking news. also today, some damning new details merging as we approach a very sobering anniversary. thursday marks one year since a trump-fueled mob attacked the u.s. capitol in a effort to block certification of the to 20 election result. the committee investigating the insurrection will hold public hearings soon and they have firsthand knowledge of then president trump's actions during the siege on the capitol. the committee's vice chair liz cheney gave this preview sunday. >> the committee has firsthand testimony now that he was sitting in the dining room next to the oval office watching the attack on television as the assault on the capitol occurred. we know members of his family, we know his daughter, firsthand testimony that his daughter ivanka went in at least twice to ask him to please stop this violence. >> cnn's special correspondent jamie gangel is joining with us more details. liz cheney says the committee has firsthand knowledge of what the former president was doing. walk us through what we know. >> so, first of all, this is bad news for donald trump because firsthand testimony is someone in the rom, firsthand. now what we've learned is in addition to what congresswoman cheney said, a person with knowledge of the investigation has told me that the january 6th committee has information from multiple sources with firsthand knowledge, so it's more than one place and that they describe what president trump was saying, what he was doing and maybe most importantly what he was not doing during the riot. the source said, john, quote. there's a collection of people with relevant information. so translation, firsthand indicates someone with direct contact or none. it could be someone who was in the room, someone who is on the phone, but bottom line the committee, john, has broken through trump's wall. >> so if they have broken through the wall, james, who might some of these people be, the star witnesses, full. >> there's one very public who we know and one witness who has given a deposition to the committee is keith kellogg, former vice president mike pence's national security adviser who was actually with trump in the white house that day when the lythe was going on. our colleague alex mark-yard reached out to kellogg who told him that he testified under oath to the january 6th committee but he declined to comment about the substance of his deposition. one thing that's very interesting about keith kellogg, he's considered, john, a trump loyalist, but he's also a retired general who i'm told takes his testimony seriously, and let's just underscore he was in the room. he was with donald trump during those hours. and what we've learned today is there are multiple, other people, other sources like that with relevant information. >> fascinating. we're going to watch it play out again as we hit the very sober anniversary later this week. thanks for the fresh reporting. with me to share the reporting and insights margaret at alloff and lauren fox and arabia rasko. up on capitol hill republicans have tried to forget this happened and others have tried to undermine it. when you hear testimony like that, keith kellogg, a trump loyalist, testifying under oath among the firsthand witnesses who say the president essentially sat there when people were calling from capitol hill, his daughter at least twice said dad, do something about this. will cha that change minds among republicans on capitol hill or will it continue to whitewash? >> i think they are clearly attempted to whitewash what happened on january 6th and i don't expect in a to change. remember, kevin mccarthy sent a left commemorating the fact that january 6th was coming up and didn't mention that letter to his colleagues, just a brief mention of january 6th but one thing to keep in mind about all of this is that it was ever present on the mind of kevin mccarthy and other republicans a year ago when they were trying to get donald trump to act, when they were trying to get help on capitol hill, when they were trying to understand where in the heck was the national guard, so will the anniversary stir up some of those memories, perhaps, but i think publicly you're going to see the same posture from republicans and from democrats that you've seen over the last eight to ten months. >> it's a fascinating moment because those behind the committee say, number up, it's important to remember what happened. remember, this was the day they were certifying the election results. the mob was trying to subvert american democracy and most people believe they were doing it because donald trump wanted them to do it. listen to the chairman benny thompson. he says it's not just important to look back. he says the committee needs to complete its work and have public hearings because he's wore teed could happen again. >> yes, i am. unless we give it right given the attitude of what's occurring in this country now. it could happen again. when i see people legitimizing storming the capitol and the activities around it, i'm very concerned. i'm concerned to the point that sometime people feel they can break the law if they are dissatisfied. >> we we are doing hear from the president and the vice president on january 6th. what message do they want to convey to back up sort of what the chairman is there saying that you need to shake some people loose about what they think about that day? >> well, i think they are going to play up and talk about the violence of that day and talk about how bad things were because they want to stop this whitewashing of that day, and they want to try to call americans together, to try to say that even though there may be differences, that this country is found on democracy and that they should try to come together. the problem is there's a very large contingent of the country that will not be listening to that and that former president donald trump is not going to be on that issue. that's the issue. >> that is the issue. >> margaret, when you hear liz cheney talk about just calmly and bluntly we have firsthand witnesses, firsthand witnesses of what donald trump was doing and more importantly what he was not doing. lauren mentioned kevin mccarthy and his letter at the top of the program. do you think he had a sense here in that he had a chance to have a real bipartisan committee. he blew it up. liz cheney and adam kinzinger joined it, the committee surprised a lot of people by methodically going about its work and having its case and you don't have a distraction of some trump ally blowing it up because kevin mccarthy walked away. >> john, i think mccarthy a year ago made a calculated decision that it was a political imperative for him to stick with donald trump on this and not go his own way and he stuck by that for better or for worse, both politically and substanttively. i think what the committee is doing now is important on two different tracks. what we're seeing in terms of testimony about different people including the president's children, that's important to him because it will put on the record into the timeline so much of what we've already seen in the reporting. axios has reported, the "new york times," "the washington post," a lot of people have timelines about who reached out to mark meadows that day and such, but perhaps even more northern what the committee is doing is the stuff that actually requires a subpoena from let's say banks, right? the attempt to connect the dots financially and to connect the dots organizationally to understand the coordination behind the event. that's much more difficult to report without subpoenas and has the potential to be much more revel la try in terms of putting new information into in this time line for the sake of history and now, understanding what happened and -- and how these various groups are connected, and i think, you know, the messaging that we're going to see on january 6th itself will probably hear more from mitch mcconnell than from mccarthy. this may be all we hear from kevin mccarthy, primarily a day for the democratic messaging and for the president, president biden and nancy please but in terms of the committee's work it's that work that requires subpoenas that could be the most important. >> well, if a man who wants to be speaker of the house is not prepared to step up and be responsible on that anniversary, that would speak volumes, i would say. we'll see what happens as we get to thursday. more conversation to come this. quick programming note. joan jake tapper and icooper for an unprecedented gathering inside capitol with the police, lawmakers, live from the capitol january 6th one year later. begins thursday night at 8:00 p.m. eastern right here on cnn. up next for us, this new year is an election year with control of congress at stack, if you're placing current bets, both the current numbers and history favors the republicans. woo hoo! ensure, complete balanced nutrition with 27 vitamins and minerals. and ensure complete with 30 grams of protein. ♪ ♪ your shipping manager left to “find themself.” leaving you lost. you need to hire. i need indeed. indeed you do. indeed instant match instantly delivers quality candidates matching your job description. visit indeed.com/hire what does a foster kid need from you? >> well, i think a lot of what they tried to do is they tried to make sure that they can -- that they can do something to make sure that -- i'm having some technical difficulties here. a lot of what they can try to do is to make sure that they have their agenda, that they can get their agenda through and that means that they are probably going have to cozy deup to joe manchin. >> cozy up to joe manchin is one way to look at t.appreciate you trying to wrestle through the technical difficulties. this is a letter from chuck schum earning majority leader who says in addition to trying to work through the build back better plan, the biden domestic agenda, that he is prepared, senator schumer is, to try to change the senate rules so the democrats can move on to pass voting rights. what are the odds of that happening? >> pretty slim, john, and this is about showing momentum. if you can't actually enact your agenda, perhaps you can show people that you're trying. they are trying to turn democrats out to the polls. that's what democrats are going to try to do, burks remember, manchin and sinema, they don't support the kinds of rules changes that schumer is threatening the senate will vote on before martin luther king day. >> so margaret at alloff, if you look heroic the presidential approval rating at the end of the first year in office, obama at 51%, donald trump at 36% and joe biden at 43% and we can show you what happened to obama and trump. obama in his first mid-term lost 63 house seats, lost 63 house seats and trump in his first mid-term lost 42 house seems the mar jibs are so close and districts drawn a different so. joe biden won't lose if the numbers continue anywhere near the number, he doesn't have, to because the democratic margins are zero in the senate and a handful in the house. again, the question for the white house is what's the plan? >> yeah. that great shellacking, joe biden was around as vice president that year and it hangs over him like a very threatening persistent storm cloud. there's a couple of things that biden has to do. one is either the economy has to continue improving and people have to believe it's improving or covid has to be under control in a way that it does not appear to be because of omicron right now. and i think that messaging challenge, you know. we keep using the word message and the eye roll, but it really has been a challenge for this administration is to take the positive news out of economy, economic growth in the face of a pandemic, right, and -- and at least for now gas prices coming down and convince people that that's real, but the other is just to show some momentum on build back better initiatives that the white house is talking with manchin again. the negotiations have resume. that's important, but having said all of that, the only time in recent pattern being disrupted was during 9/11 in terms of mid-term losses, and while you can look at the pandemic and say that should be a 9/11 style event, that galvanize the country and makes americans want to stand behind their president, it's broken in a completely different way. it's so polarized and nothing like 9/11 iners of the public response so even if biden and his team doing everything right it's not clear that they can turn the tides. >> sorry for interrupting. that's the great question for the white house. how much do they think we need to prove we can get things done in washington and how much is covid exhaustion, the psychological impact on mefrmts again, this is our third cove january, the president has some control over because he has leverage of government and of course it's a pandemic and he can't control it in a lot of ways. >> a lot that is not in his control. as president and as the white house i don't think they are going to sit back, but the fact is they don't have control over omicron and it spreading like wildfire. that's not something that any leader in the world has been able it was to get a handle on. what they can do is show they are getting testing, getting people vaccinated and that there are new treatments coming out but the other thing that they can do and they do have control over is they can try to get something done because a lot of complaints that you do hear from voters is they say they voted for democrats and they don't know what they have delivered for them. of course the white house will make the case, but the key legislation has stalled, and that's what they are trying to get through now. >> it will be a fascinating year ahead. we're just beginning. it will have a lot of ups and downs. we'll do politics here. that's our brand. some think it's too much and some think it's too little. we'll do this quite a bit. >> congresswoman marjorie taylor greene kicked off her main twitter account for covid misinformation. the tweet that went too far next. does it worry me? >> we don't know exactly howie is vehicles but they are saying that putin will pay a heavy price if he goes ahead with this invasion uncertain difficult situation for the president to deal with. obviously his predecessor you know, former president obama dealt with this and caught a lot of flack for not doing enough when the first invasion happened, and so now biden is carrying this burden of not wanting to look weak but deal with a very serious international incident, the potential. >> well, it's just the buildup, isn't it. you're right about that and we'll see if it escalates from there. president selenski had an interesting tweet after the phone conversation with in biden. it's the first conversation of the year and talked about the, quote, special nation of our relations, and he said we appreciate the unwavering support of ukraine so there seems no doubt at least from the ukrainian part that president biden moans what he says but the question is where's the line? >> yeah. john, i think that's right. i mean, if you go back to like the summertime, selenski was finding out about what the u.s. was doing on nordstream 2 through press briefings and selenski was begging publicly as well as privately for conversations with biden that. relationship has obviously changed over the last several months and weeks and he now believes in messaging to his own constituency that the u.s. is firmly at their side. i think biden has made the calculation that they have to come through when it comes to sanctions and the kind of tough behavior they have promised, both for domestic message, both for this idea that they not appear weak or in any way appear to replicate afghanistan or running away from obligations or anything like that. second of all, this is a moment for opportunity for biden to show strength on the foreign policy front and to get americans to see them in a different way and thirdly from a foreign policy perspective if the u.s. does blink it would be a real problem in terms of russia's position in the region going forward so i think the u.s. is -- has made a resolve that if putin does go forward and further invade as biden says, ukraine, that they have no choice but to respond strongly but precisely what do the sanctions look like and how scared is russia really, how impactful could the sanctions be? i think that's a big question mark. >> what are the conversations up on capitol hill. there's bipartisan support even though there's republicans who criticize joe biden. what are the other conversations about where we're headed here. >> this is also an area of foreign policy where democrats and republicans don't necessarily fit into strict party lines. there are some republicans who want biden to act decisively and some republicans who will always find a reason why his actions are not strong enough or perhaps they are too strong so there is going to be a moment on capitol hill where democrats and republicans have to come together potentially behind the president in whatever he decides to do in terms of the strength of those sanctions. >> thanks to all of you for coming in today. coming up next, the new mayor of new york city hits the ground running. eric adams and his very eventful beginning. that's next. with less moderate-to-severe eczema, why hide your skin if you can help heal your skin from within?
