dose. the changes are part of an effort to prevent further disruptions to daily life. it comes as the omicron variant is leading to a major surge across america. the u.s. is now averaging 237,000 new cases a day, approaching the all-time high of 251,000 last january. hospitalizations continue to climb, now 71,000. pandemic hospitalization records in four states have hit their all-time peak. and the number of americans killed by covid is nearing 1,500 a day. cnn's elizabeth cohen joining us now to explain these new cdc guidelines. i have to say, elizabeth, i had to read those guidelines four to five times. i think i understand much of it, but i'm really glad you're here to make sense of it for us. >> reporter: and they are so confusing. i read them over way more than that, talked to my producer, called one of cnn's mad cal analysts. he didn't know the answer. the v he got someone else. all of us got together. these are difficult to understand. it's unfortunate that the cdc guidance is guidance for the public but it's difficult for even medical professionals to understand. here is sort of how we boiled it down. if you have covid-19, you do need to isolate, but as you mentioned, it's been cut from ten days to five days. now, five days of isolation and then five days of wearing a mask if you're around others. that is if you are asymptomatic or if you're sick but your symptoms are getting better. that's a big "if." if you're still super sick, you obviously are not supposed to do that. now let's talk about when people are exposed to covid, say someone in your family has covid. you're not testing positive, but you have been exposed, and the rule before was you needed to quarantine. now they're saying if you've had a booster or if your second shot was within the past six months, you don't need to quarantine, but they are saying it's best practice to get a test to see how it's going and also to wear a mask for ten days. you might say, gee, you're exposed to covid and you don't have to quarantine, here's the reason why. the cdc says if you've got an booster, a booster is 75% effective against the omicron variant. so if it's 75% effective, you're not testing positive, you are not sick, they want you to be able to go to work, especially if you are an essential worker. amara? >> elizabeth, we're hearing from the cdc they're updating their numbers on the omicron variant prevalence. there is a discrepancy. can you explain that? >> reporter: yes. so, we were told this thing moves like wildfire and it's just going up, up, up. but, in fact, new numbers that the cdc put out, it reflects a smaller percentage of cases being omicron than the previous week. so what they told us last week was that 73% of the new cases rr omicron, and now they're saying it's 58%. now,ly say that the cdc has been clear that there's a large margin of error here. this is not an exact science. but interesting to see that it's not sort of taking off the way that people thought it might, at least according to these numbers. >> elizabeth cohen, i appreciate you. thank you so much. as you know, the covid surge is leading to long, very long testing lines from new york to austin to milwaukee, people spending hours waiting to just get tested. cnn's leyla santiago is live at a testing site in miami where, yes, people are waiting hours to get tested still. leyla? >> reporter: amara, we just got new numbers at the site where i am right now, one of the busiest in south florida. they tell me that they tested about -- or they administered about 9,000 tests here, 60,000 across miami-dade county. let me put that in perspective for you. that's about a 50% increase compared to the peak during the delta wave. so that really speaks to the volume, the increase and the demand for testing. as a result today, miami d-dade county has opened two more sites and have plans to open more in the next few days because that's what they have do to meet that challenge as so many people coming to get tested given how quickly omicron is spreading and given the holiday gatherings that we're seeing. so we talked to a few people in the line. listen to how they compare what they're seeing right now in these long lines versus what they've soon hereen here in the. >> way too chaotic right now. everybody is freaking out. that's the same thing that happened before the first time. everybody was worried about it. [ inaudible question ] >> there's a spot right by my house where i would go. it would take less than five minutes. i would just walk there and that's it. and now the line extend into, like, the next street. it's crazy. >> reporter: and how long the wait is kind of fluctuating throughout the day. but bottom line, it is typically hours long. we spoke to one woman who came in overnight. she got in that line at 3:00 in the morning because this is a 24-hour testing site. it took her three hours to get a test. now, that is the on-site testing. i should add there is also a part of this site that has vaccinations. much busier on the testing side than it is on the vaccination side. then there are those at-home test kits. miami-dade county districted more than 150,000 for free over a wtwo-day period. they are now completely out and have put in additional requests to the department of health. amara? >> guess to find the positive part of this, i am a little heartened to see that people are actually willing to stay in that line for two to three hours to get tested. what are people telling you about why they're willing to be in that line? what are their plans? why are they getting tested? >> well, so, some people have told me that they, you know, don't feel well. they have fever or chills, so this is a matter of making sure that what they're feeling is reflected in what the diagnosis actually is. other people are trying to do it because of travel or because of the holiday gatherings, because of the holiday season and what could be coming up in terms of more gatherings. so, you know, we've been limited in the number of people that we've been able to talk to, but the reasoning has varied. when we spoke to general manager of health florida who runs these sites, partnering with miami-dade, he was echoing what you said, that it's nice to see that people are actually getting tested, that they are able to offer this, but, yeah, there was a long line because there is such a large demand right now for that testing. >> we're seeing that kind of demand in atlanta. i don't want to stand in one of those lines if i don't have to. i drove around yesterday after the show to find an at-home rapid test at my nearby pharmacies. i went to two and i was unsuccessful. i'll try again. these tests are in short supply. leyla santiago, thank you so much. coming up in minutes, we'll answer your coronavirus questions. also coming up, the family of a teen accidentally killed by l.a. police are speaking out for the first time as video captures the chaotic scene that led to her death. details and a live report next. , enter your goals, the foods you love and what fits into your lifestyle. you don't have to eat diet food. i can enjoy the things that i really love like wine, cheese. you can add points for eating vegetables or being active. i lost 26 pounds and i feel incredible. the all new ww personalpoints program. start the new year with three months free. join today at ww.com. hurry, offer ends january 3rd. ♪ limu emu... & doug ♪ ♪ superpowers from a spider bite? i could use some help showing the world how liberty mutual customizes their car insurance so they only pay for what they need. (gasps) ♪ did it work? only pay for what you need ♪ liberty. liberty. liberty. liberty. ♪ spider-man no way home in theaters december 17th developing at this hour, colorado police are investigating a string of shootings that left four people dead and several others injured including a police officer. officials say the suspect opened fire at several locations in the denver area before being killed in a firefight with police. cnn's lucy kavanagh is live in denver with more. >> reporter: there's more questions than answers at this early stage of the investigation. police say that the first shots were fired or at least reports of them right around 5:00 p.m. local time in central denver where a suspect killed two women and a man was injured. the suspect killed another man several blocks away. at a third location, a gun was fired but no injuries happened there. denver police then spotted the vehicle, which they believe belonged to the suspects. they tried to chase after him, to pull him over. a gunfight ensued in which the police vehicle was damaged. then the suspect managed to get away to the nearby city of lakewood. that police had reports of shots fired almost an hour after the central denver gunshots. a victim was found on the scene proshgs announced dead on the scene. when police found the car and the suspect, another gun battle ensued. he fled on foot to the hyatt hotel, where he shot reportedly another employee there, a clerk, and he also shot and wounded a lakewood police officer who, as of yesterday evening, was getting treatment for his injuries. he was undergoing surgery. we don't know his fate at this hour. more gunfire was exchanged and the suspect was killed. the police chief says they don't know the motive just yet. take a listen. >> as far as what started, that is part of the investigation. we need to really dig in and find out what the motivation behind this was. >> to this point, just one suspect, again, our s.w.a.t. team is diligently going through a large area behind us to clear the area, to make sure. at this point, we do not believe there's any additional threat to the community. we believe there's only one shooter. >> reporter: amara, the amount of area the suspect covered is immensely large. this is a very large crime scene. it will take some time before we get these critical answers. >> lucy kafanov, thank you for that. also developing this morning, in just hours the parents of a teenaged girl killed during a police shooting at a california department store will speak out for the first time. 14-year-old valentina orellana-peralta died in her mother's arms after being accidentally shot by lapd inside of the dressing room. police have released body cam video of the deadly encounter. cnn's josh campbell live in los angeles with more. i mean, you see this video, you see that, you know, there are very tense moments, but your heart just -- there are no words. it goes out to the family. >> reporter: absolutely. a pure tragedy. what we're learning with this new body camera footage released by the lapd is just how chaotic that scene was inside a california department store last week as the suspect went on a rampage, assaulting customers inside that store. now, i want to show you some of the video here that was released. i want to warn our viewers that this is graphic. it is disturbing. we have blurred some of the images. but you are about to see the moment where officers are approaching that suspect. he opens fire. sadly, on the other side of the wall where that suspect is was that 14-year-old girl. watch. >> reporter: so a scene of chaos there. it's worth noting that those officers, as they were on the way to the mall, they received 911 calls of a shooting in progress. so on this body camera footage, you're see they're trying to locate an active shooter as they go through the department store looking for the threat. that shooting resulted in this tragedy. one major question we are getting after looking at this video is how an officer with a high-powered rifle may not have actually looked beyond the target and considered what was beyond the place he was shooting. that obviously part of this investigation. finally, we are expecting to hear from this 14-year-old girl's family. that will be outside of l.a. headquarters, addressing the public. they are demanding answers. >> that is a key question. josh campbell, thank you. joining me now is cnn law enforcement analyst anthony barksdale. he is a former acting baltimore police commissioner. thank you for joining me, sir. look, to my untrained civilian eye, you know, i was taken by this large high-powered rifle that takes up much of the body cam video from this vantage point, and it makes me wonder, you know, was such a high-powered weapon necessary in this response? what are the biggest take-aways for you? >> i think the patrol rifle for an active shooter situation is appropriate, but when we get to the situation, the officers have to evaluate what is going on, what do they see. and at the point where that officer fires that assault rifle, i don't see that there's any way to justify that use of force. to make it even worse, in my opinion, behind that suspect is that 14-year-old girl and her mother. when you pull that trigger, you better know your backdrop. and if you go earlier in that video, the body cams, you'll hear an officer say, "by the dressing room, by the dressing room." who is usually in a dressing room? customers. the area was not cleared, yet we have this use of force occur. i don't see any excuse for what we saw. >> you're right, though, that you hear that audio of "by the dressing room." clearly it was known there was a dressing room beyond the suspect and, you know, there could be casualties beyond that. what should have been done then in that situation? >> okay. so let's pretend that you and i, we're two officers, we are going into the situation. when we see that we don't have an individual with a weapon, with a gun, now that could be dangerous, maybe, but you could go to your less than lethal option and i back you up with a lethal option. you issue verbal commands. i've got your back. you use your less than lethal use of force. if that doesn't work, he comes towards us, then i'm going to engage. we have other options there besides firing that assault rifle in that store. and they also had -- we had other officers there. i counted at least seven or eight following in towards the dressing room after the victim is shot. so we had options. lapd did not use the options. and this is a preventable tragedy, and my condolences to the family. >> can you talk us through some of the audio? yep. lou! mom said she could save up to $400 on her wireless bill by switching to xfinity internet and mobile. with nationwide 5g at no extra cost. and lou! on the most reliable network, lou! smart kid, bill. oh oh so true. and now, the moon christmas special. gotta go! take the savings challenge at xfinitymobile.com/mysavings or visit an xfinity store to learn how our switch squad makes switching fast and easy this holiday season. the omicron variant is leading to a large increase of hospitalizations for children. new york has experienced a 395% increase. the chair of cohen's children's medical center are the largest provider of pediatric health care in new york state. a lot of people have questions how to protect their children. i want to ask you what's happening in your hospital and how the young children who are hospitalized, what kind of condition they're in. >> yeah, so we have -- you know, we've had an increase in cases. we were running sporadic cases for the last year. one, two, three cases in the hospital. we have about 20 children infected with covid right now in cohen children's. three are in the icu, quite ill. about a third of the 20 are people who actually tested positive for either postoperative or in the hospital for something else. so, you know, it's a handleable number. what makes this different than that what has happened in the past is that the hospital -- and this is true for the children's hospitals across the country -- have been very crowded and very busy because interestingly, we had a lot of winter disease late summer and early fall. so going into this surge, we were very busy, very crowded, very few beds, and then adding these two dozens cases to that had just made the situation a bit worse. >> i think a lot of people might be scratching their heads, though, because there's been so much talk about omicron, you know, potentially being -- causing milder disease. so why do you think we're seeing this spike in hospitalizations for covid among children? >> it's just a matter of math. we know that omicron is much more spreadable and many more people, including children, are getting the disease. so with the incredible increase in the number of cases, a few are going to be sick. and, in fact, if you look at the kids who are very sick, they're either very, very young, babies who are going to be more prone to more illness, more severe illness, or there are other children who are older, teenagers and so forth, who have major co-morbidities, whether that's chronic illness with immunosuppression or other major issues. >> and you were mentioning during the break that you're seeing a lull or a delay in flu cases, and you're concerned about a double whammy. how are you bracing for this? >> last year, we had no flu across the country. we have had sporadic flu cases thus far in the fall. we don't have any patients hospitalized in children's with flu. it's hard to predict how many flu cases we'll see in a season. what's confusing is many of the symptoms children present with with covid are the same ones as they present with flu. and so that's why we're telling parents, please have your children vaccinated. if you haven't been vaccinated yet for covid, that's -- you can go in and get a vaccine for covid and flu at the same time. but it's -- we're a little nervous about the numbers, particularly our emergency rooms have been overrun with patients, many of whom are just looking for testing, because testing on the outside has been difficult in many areas. and we're asking parents to not come into the emergency room unless their child is sick, not to come in just for testing if they're healthy because we're expecting flu. it can come any day, any week. we can't predict how severe that season will be. >> yeah. unfortunately, a lot of health experts say things are probably going to get worse and we should be bracing for a pretty tough january ahead. doctor, thank you so much for the conversation. and we know many of you have questions about how to protect yourself, your children, how to protect your entire family. joining me now to answer some of them is dr. edith sanchez, a primary care pediatrician and professor of pediatrics at columbia university, irving medical center. thank you for joining me. let's start with this question from andrea in maryland. she asks, when will booster shots be available for kids 12 to 15? for many of these kids, it's been six months since their second dose. >> great question. at this point, we don't know. i wish we had the answer, but we don't have a clear time line, and that is because we don't have data, we don't have the science on when immunity wanes for this age group. we know that 16 and up, kids 16 and up are now eligible for a booster shot, and that is because we did have the data for that age group for the 12- to 15-year-olds who do not get it, so we don't know when we'll be getting booster shots for them. hang tight, do your best to protect yourselves by getting a booster. >> a question on masks. i read an article on cnn.com that advises us to choose n-95 masks over cloth masks. i have a sizable cloth mask collection, and each mask has a filter pocket. will the pm 2.5 filter add similar protection that the n-95 offers? what do you say? >> yeah. i think many of us have collected quite an array of masks at this point. i would say if you're thinking of wearing your cloth mask, go ahead and add that fitter. it's not exactly the same as an n-95 mask, but if you have an n-95 mask, you are filtering out 95% of 0.3 micrometer particles or more for those 2.5 filters talking about 2.5 micrometer particles that are being filtered out. so the n-95 filters out more and smaller particles. but if you're in an area y where you don't need that protection, the cloth masks with the filter work well. >> does one need to get retested after testing positive and isolating for ten days? by the way, you know the cdc guidelines have been dropped down to five days if you're asymptomatic. she says, if yes, how long after the end of the isolation period? does there need to be retesting after testing positive? >> i get asked. this so much. the answer is no. the official guidance is you do not need to be retepsed at the end of your covid-19 infection once you have recovered. and that is because you can potentially be positive on your test for up to three months even though you are no longer infectious. so we don't want to keep testing and testing in a moment where supplies are short in this country knowing that you can potentially still be positive and no longer infectious. so, no, you do not need to do this to come out of quarantine. >> robert wants to know, and this is a question i think parents have regarding children and outdoor sports -- he says i coach a middle school flag football team. is that a safe activity to do jo outside if everyone is vaccinated? are his demands really under consideration? >> reporter: well, what the united states is saying is that russia can put what it wants on the table and the united states is going to put its concerns on the table as well. they're saying very e cclearly, president putin's points he's put on the table, which is nato cannot allow ukraine to become a member, that nato cannot station troops and military hardware in ukraine because they, in russia's view, threaten the security, the core security of russia. so, you know, what the united states is saying in response to that is, yes, talk, but we're not going to talk about issues related to our allies and partners, nato and ukraine, without them being at the table as well. look, what president putin has chosen to do here is to talk to the united states first because he sees the united states as a real driver of what nato can be expected to agree. but it's no point in talking to nato collectively because that is a sort of -- it could be a very slow and circular conversation, so he's singled out the united states as the strongest partner in nato to push through his demands. what we're hearing from the u.s. side is there can be areas of agreement and areas of disagreement. this is where the difficulty comes because russia wants black-and-white scenario, what is nato's plan for ukraine. putin wants that very clearly decided. so there's long way to go on all of this. >> yeah. very difficult conversations to be had. nic robertson, thank you so much. now to the pain at the pump. you could be paying $4 a gallon for gas by memorial day. in a forecast shared exclusively with cnn, gasbuddy says prices will peak in a few months. cnn's matt egan joins me now to explain. hi, there, matt. >> hi, amara. this is all about supply and demand and covid. when covid first erupted in spring 2020, we saw russia and opec and u.s. oil producers slash their production by record amounts. that made sense because no one was driving. no one was flying. the world was kind of shut down. flash forward, we've seen demand basically come back to precovid levels but supply has not kept up. that's why gas buddy, which is an app that tracks prices and demand, they're calling for gas prices to rise next year. they see a 2022 average of $3.41 a gallon, up from around $3 this year. they think gas prices are going to peak in may at $3.79 a gallon, essentially right as everyone is heading out for the summer, memorial day weekend, we could be seeing gas prices flirting with $4 a gallon before they fall sharply later in the year. now, this would unwind some of the recent progress we've seen on the gas front. the national average is currently $3.28 a gallon. that's not cheap. it's up by about a dollar from a year ago. but it is down 14 cents from the peak we saw in early november. we should note, there is a lot of uncertainty here. others are calling for gas prices to drop. citi group has predicted and warned their clients there's going to be what they called a, quote, radical drop in energy prices. the energy department's research arm is calling for an average of $2.88 a gallon next year. that would be down. i think at the end of the day, amara, these are all just forecasts, and covid has shown it it's really hard to accurately forecast anything in today's economy. >> yeah. the only thing that's certain is all this uncertainty, right? matt egan, appreciate you. thank you. well, there is more trouble in the skies. a los angeles woman facing a federal assault charge after allegedly causing a disturbance on a delta flight. cnn's ryan young has more on what happened. >> reporter: good morning, amara. another flight with another instance of just why would behavior. we've seen this play out so many times over the last year. you had covid restrictions and now unruly passenger behavior. people who work in this industry are sort of tired of what we're seeing on these cell phones. the video we're going to show you is something ha has been tied to a federal complaint. the woman was arrested by the fbi. in this video, we're told that investigators see what happened, post odd atl uncensored, an instagram page, and this shows what happened on that flight floo from tampa to atlanta. >> [ bleep ]. >> as soon as we get to atlanta, you're going to jail. karen. >> the woman in that video is identified as patricia cornwall. she feels arrested and faces charges. this was an isolated incident. we might not be talking about it as much as we are because of what's happening on flights across the country. the number of incidents have spiked during the year. people are concerned, especially those in the flight industry. they're hoping to see some of this behavior tamp down over the next year. cell phones are helping because it's capturing some of these fights that are going on on these planes. there's an industry now calling for some action to stop what's going on in the air. amara? (giggling) 1 . we're on verdict watch in two high-profile trials. in new york jurors are in their fourth day of deliberations in the sex trafficking trial against ghislaine maxwell, and in california jurors are deciding whether former ceo and founder of theranos, elizabeth holmes," committed fraud against investors. joining me now is cnn senior legal analyst elie honig. hi there, elie. let's start with the maxwell trial. we know jurors have asked several trials and asked testimony from victims and other key witnesses, including the four women who make up the core of this trial. what does that tell you about how the deliberations are going? >> well, it tells me the jury is being really careful and meticulous here. it tells me they certainly did not get in the jury room and say guilty or not guilty across the board. they are going witness by witness and count by count. that's what a jury is supposed to do. it shows that they are focused on the key pieces of testimony, the key pieces of evidence and we'll see what they come back with. remember, they can find the defendant guilty on some charges but not others. it's not all or nothing. it's not straight guilty or not guilty, and i think we may end up seeing some sort of split verdict here. >> okay. interesting. then when it comes to the closing arguments, what stuck out to me from maxwell's attorney. she said she's being tried here for being with jeffrey epstein and maybe that was the biggest mistake of her life, but it was not a crime. so they are trying to distance maxwell from epstein. is that even effective? >> i don't think it will be here. this is a we call the empty chair defense when you have some other figure sort of looming over the trial. the prosecution's argument is she was his right hand. she was his accomplice, his co-conspirator, and the defense is just trying to say she was duped or is a scapegoat. the problem is it didn't comport with common accepts. really hard to believe, that and it's contradicted by the evidence. there's no way she was there in some sort of innocent capacity. >> okay. let's move on to elizabeth holmes' trial in california. so jurors there have also asked to hear evidence again. they requested recordings of a call where holmes allegedly made misleading claims, so what can you glean from that? >> yeah, i think that's a good sign for the prosecution, amara, because the question here is was holmes engaged in just sort of your standard salesmanship puffery that happens in the business world, or did she cross that line to where she made a specific fraudulent misrepresentation? the prosecution has argued she did just that. she lied about the efficacy of the blood work products and lied about contracts and deals that she had with the military, with pharmaceutical companies, so if the jury is focusing on those specific lies and misstatements, i think that's a bad sign for the defendant here. >> and something different that elizabeth holmes did is she actually took the stand compared to ghislaine maxwell who didn't and she testified over the course of seven days. do you think this ultimately will have hurt or helped her?
